1. Political Parties and Symbols

1.1 General.

It has been realised out of experience, that a strong, vibrant democratic

system of Government requires an effective party system. In the Panchayati Raj system, however, opinion is divided as to whether political

parties should play a role or not. Though the various Urban Local Bodies

Acts are silent about the role of political parties in panchayat

administration, the Tamil Nadu Town Panchayats, Third Grade

Municipalities, Municipalities and Corporations (Elections) Rules, 2006 lay

down that elections may also be held on party basis and that political

parties may sponsor their candidates for such of those elections held on party basis. Under rules 31, 32 and 33 of the said Rules, the Tamil Nadu

State Election Commission has to notify periodically as to which elections

are to be held on party basis. The Tamil Nadu State Election Commission

in its Statutory Order No.28/2011/TNSEC/ME-1, dated 14.09.2011 has

notified that the following elections shall be held on Party basis:-

(i) Members of Town Panchayats;

(ii) Councillors of Municipalities and Municipal Corporations;

(iii)Chairman of Town Panchayats and Municipalities; and

(iv)Mayors of Municipal Corporations.

The Tamil Nadu State Election Commission has issued the Tamil Nadu

Local Bodies Election Symbols (Reservation and Allotment) Order, 2011, (herein after referred to as the “Order”) under rules 31, 32 and 33 of the

aforesaid Urban Local Bodies Election Rules and the corresponding rules

for the Panchayats Elections. The provisions of this symbol order are

discussed in the following paragraphs.

1.2. Recognised Political Party for the purposes of Local Bodies elections in

Tamil Nadu

Every political party which has been recognised by the Election

Commission of India as a National party or as a State party in the State of

Tamil Nadu under the Election Symbols (Reservation and Allotment)

Order, 1968 will be a recognised political party for the local body

elections.

1.3. Registered - Unrecognised Political Party

Every political party which had previously been recognised by the

Election Commission of India as a National party under the Election

Symbols (Reservation and Allotment) Order, 1968 and subsequently lost its status as a National party, every political party which has been

recognised by the Election Commission of India as a State party in any

State other than Tamil Nadu under the Election Symbols (Reservation and

Allotment) Order, 1968 and every political party having its head office in

the State of Tamil Nadu which is registered with the Election Commission

of India but not recognised either as a National party or as a State party

in Tamil Nadu by the Election Commission of India under the said Order

will be a “Registered - Unrecognised political party” for the purpose of

local body elections in Tamil Nadu. The list of such parties which are

entitled for preference over independents in the matter of allotment of free symbols will be notified / communicated by the Commission from

time to time.

2. Allotment of symbols and publication of final list of contesting

candidates

2.1. Approved Election symbols-Candidates to choose symbols:

The State Election Commission has issued an order called the Tamil

Nadu Local Bodies Election Symbols (Reservation and Allotment) Order,

2011 to provide for specification, reservation, choice and allotment of

symbols at the elections to local bodies, and for matters connected

therewith. Notification of (i) the list of Recognised Political Parties and the

symbols reserved for them, (ii) the list of registered - unrecognised

political parties entitled for preference over independents in the matter of

allotment of free symbols and (iii) the list/s of free symbols were issued

by the State Election Commission in S.O.No.26/2011/TNSEC/EG-2, Dated, the 10th September 2011 (Copy enclosed in Annexure II). The nomination

form (Form-3) provides for the choice of three symbols by the candidates

in the order of their preference. A copy of the Tamil Nadu Local Bodies

Election Symbols (Reservation and Allotment) Order, 2011 is given in

Annexure 1.

2.2. Forms A, B and C and allotment of Symbols:

Before a candidate, set up by a political party (recognised / registered -

unrecognised political party) be assigned a symbol, certain formalities

have to be fulfilled by the candidate. First of all, the candidate should give

a declaration along with his nomination paper in Form 'C' (which has been

printed along with the Nomination form itself) that he has been set up at

the election by a particular political party. This statement should be

confirmed in writing in Form 'B' and Form 'A'. Forms A and B or Form B as

the case may be, should reach the Returning Officer well before 3.00 p.m. of the last date for withdrawal of candidatures. According to para 8(2) (a)

of the Symbol Order, the communication in Form A shall be signed by the

President / the Secretary or any other office bearer who has been

authorised by the party in this behalf to send such communication.

Hence, it provides that where the notice in Form B is signed by any such

office bearer authorised by the party, Form A need not be insisted upon.

2.3. Further points to be taken note of in the allotment of symbols to

candidates sponsored by recognised political parties:

2.3.1. A candidate sponsored by a recognised political party shall

choose and he will be allotted only the symbol exclusively reserved for

that party. He will be allotted no other symbol. In view of this, such a

candidate need not indicate in his nomination paper three symbols in the

order of preference; but he should have opted for the symbol reserved for

the party which has set him up as a candidate in the nomination papers

filed by him/her or on his/her behalf. If a candidate has not claimed that reserved symbol in his nomination paper or has failed to fill up the

declaration in Form 'C' or has failed to produce Form 'B' and Form 'A' or

Form 'B' as the case may be, before the time allowed for withdrawal of candidature indicating that he had been set up by the particular political

party, such a candidate should be treated only as an independent

candidate.

2.3.2. It may be noted that the notices in Form A and Form B or Form

B, as the case may be, must reach the Returning Officer not later than

3.00 p.m. on the last date for the withdrawal of candidatures. It shall be

the responsibility of the candidate or the political party to ensure that the

documents reach the Returning Officer in time.

2.3.3. Unless the Returning Officer is definitely informed in time by

means of the prescribed Forms A and B or Form B as the case may be, as

to who is the official candidate of that party, the Returning Officer should

not allot the party symbol. In that case, the Returning Officer will have to

treat such candidate as non-party candidate and allot free symbol. So

also is the case of a substitute (dummy) candidate of a political party who

refuses or fails to withdraw his nomination in time.

2.3.4. Political parties are, however, permitted to either cancel the

authorisation in Form B given in favour of one candidate or change such

authorisation by substituting the name of their candidate subject to

following conditions, namely:-

(a)subsequent authorisation cancelling or substituting the earlier

authorisation in Form B is received by the Returning Officer not later

than 3.00 p.m. of the last date for withdrawal of candidatures;

(b)such subsequent authorisation in Form B is signed by the same person

and is unambiguous and clearly shows that it either cancels or substitutes the earlier authorisation, as the case may be;

(c) the Returning Officer is satisfied about the genuineness of subsequent

authorisation; and

(d)the candidate in whose favour subsequent authorisation has been given

has already made a declaration in his nomination paper that he has

been set up by the said political party.

2.3.5. If a political party submits authorisation in Form B in respect of more than one candidate, then the Returning Officer shall treat all such

candidates as independents, unless the authorisation in respect of all

candidates except one has been cancelled in the manner described in sub-para (a) above.

2.3.6. The Symbols Order does not recognise electoral alliances which

are often entered into by political parties. Therefore, the Returning Officer should not allot the reserved symbol of a recognised political party to

another recognised political party even with the consent of both the

parties. The Returning Officer should be strictly guided by the provisions

of paragraph 8 of the Symbols Order in all cases of allotment of symbols

to candidates set up by political parties.

2.3.7. Where a candidate had not made a declaration in any of the

nomination papers that he/she has been set up by a particular political

party, he/she shall not be deemed to have been set up by that party even

if that party gives the Returning Officer intimation to that effect in Forms

A and B or Form B, as the case may be, and he/she shall not be allotted

the symbol reserved, if any, for that party.

2.3.8. Similarly, if a candidate has made a declaration in his

nomination paper that he/she has been set up by a particular political

party but that party sets up some other candidate, he shall not be deemed

to have been set up by another political party even if such latter party

wishes to adopt him, unless that candidate has filed within the prescribed time another nomination paper in which he/she has made a declaration to

have been set up by the latter party.

2.3.9. If Form B has been produced by two recognised parties for the

same candidate and none of them has been cancelled or withdrawn by the

political parties before 3.00 p.m. of the last date for withdrawal of

candidature, then he /she shall be deemed to have been set up by the political party to which he/she has made a declaration in Form C.

2.3.10. Once the allotment of symbols has been completed following

the procedure enumerated above, the candidates should be informed in

writing the symbol allotted to them individually and they should also be

provided with a specimen of the symbol as it would appear in the ballot

paper. The specimen symbols and the symbol booklets will be printed and

supplied centrally by the Commission.

2.4. Incorrect allotment of symbols:

The allotment of a symbol made by the Returning Officer to a candidate

shall be final except where it is inconsistent with any direction issued by

the State Election Commission in this behalf in which case the State

Election Commission may revise the allotment in such manner as it thinks fit. The Returning Officer should, therefore, ensure that no mistake occurs

in allotting symbols.

2.5. Revision of symbols:

Where the allotment of symbol has been revised by the State Election

Commission as stated in paragraph 2.4, the Returning Officer should

publish a revised list of contesting candidates in conformity with the

directions of the State Election Commission.

3. Allotment of symbols to candidates of Registered - unrecognised

Political Parties:

3.1. Every candidate who is set up by the Registered - unrecognised

Political Party should declare in his nomination paper, his choice of three

free symbols from the list of free symbols collectively, i.e. from Table 4 and Table 5 in the list of symbols from the list of free symbols notified for

the party based elections. Allotment of symbols to such candidates will be

completed first and only thereafter the allotment of symbol to independent

candidates will be taken up and allotted from among the remaining free symbols. Where a free symbol has been sought for by only one candidate

set up by a Registered - unrecognised Political Party, as his first choice, it

shall be allotted to that candidate and to no one else.

If two or more candidates sponsored by Registered - unrecognised

Political Parties seek one and the same symbol as their first choice, lot

should be drawn to decide the candidate to whom it should be allotted.

3.2. Who is a candidate set up by Political Party? (Recognised / Registered

- Unrecognised)

A candidate will be deemed to be set up by a political party, if

i. the candidate has enclosed a declaration in Form 'C' along with the nomination paper stating that he/she has been set up at the election

by the party;

ii. he/she produces a notice in writing in Form 'B' to that effect before

3.00 p.m. on the last day of withdrawal of candidatures issued by the President, Secretary or any other office bearer who has been

authorised by the party in this behalf or any other person who has

been authorised by such office bearer of the political party, certifying

that he/she has been nominated to that election by the party; and

iii. he/she delivers to the concerned Returning Officer the

communication in Form 'A' with regard to the name and specimen

signature of the authorised person and signed by the President, Secretary or any other office bearer and who has been authorised by

the party in this behalf to send such communication before 3.00

p.m. on the last date for filing of nomination.

4. Procedure for allotment of symbols.-

4.1. Para 7 of the said Symbols Order gives detailed procedure for

allotment of symbols to the candidate set up by the recognised political

parties, registered - unrecognised political parties and the independent

candidates. An extract of para 7 of the said order is given below:

“Allotment of Symbols in Elections held on party basis.- (1) In an

election held on party-basis, a candidate set up by a recognised political

party shall choose, and shall be allotted, the symbol reserved for that

party and no other symbol:

Provided that when there are conflicting claims for any such

reserved symbol due to defect of substantial character either in the

nomination paper or in Form B or Form C filed, none of the claimants

shall be allotted that reserved symbol and all the claimants shall be

treated as independent candidates and allotted the free symbols left

after allotting to all other candidates in that election;

Provided further that no reserved symbol shall be sought or allotted

in an election, to any candidate other than a candidate set up by a

recognised political party to which that symbol has been reserved, even if no candidate has been set up by that recognised political party in that

election.

(2) Choice of symbol by candidates set up by registered-

unrecognised political parties and by independent candidates: Every independent candidate shall declare in the nomination paper first

filed by him or on his behalf, his choice of three free symbols from the

list of free symbols for that election indicating the order of his

preference. Every candidate who is set up by the registered -

unrecognised political party shall declare in the nomination paper first

filed by him or on his behalf, his choice of three free symbols

collectively, (i.e. from Table 4 and Table 5 in the list of symbols) from

the list of free symbols notified for the party based elections. The

symbols shall be allotted in accordance with the procedure laid down

below:

(a) The allotment of symbols shall be considered in the order of the

preference made by the candidates, that is to say, the first preference

of the candidates will be considered first, the second preference next

and the third preference last:

Provided that the allotment of symbols to candidates set up by the

registered but unrecognised political parties shall be completed first and

only thereafter the allotment of symbol to the independent candidates

shall be taken up and allotted from among the remaining free symbols.

(b) Where a free symbol has been sought for by only one candidate

set up by a registered but unrecognised political party, as his first

choice it shall be allotted to that candidate and to no one else. If any free symbol has been sought for by more than one candidate set up the

registered but unrecognised political parties, the allotment of that

symbol shall be decided by drawing a lot among these candidates and

the candidate whose name is drawn first shall be allotted that symbol.

(c) If any candidate set up by the registered but unrecognised

political party could not be allotted the symbol sought for in his first

preference in the lot, he shall be considered for allotment of the free

symbol sought for, as his second preference. Should the second choice

of symbol could also not be allotted, due to conflicting claims for that

symbol and failure in the lot, he shall be considered for the allotment of the free symbol of his third preference. Even if this could not be

allotted, he should be allotted by drawing a lot, any one of the free

symbols left after allotting to other candidates set up by the registered but unrecognised political parties in accordance with the procedure set

out above.

(d) After completing the allotment of free symbols to all the

candidates set up by the registered but unrecognised political parties, the remaining free symbols shall be allotted to the independent

candidates in accordance with their choice and preference by adopting

the procedures for allotment of symbols to candidates set up by the

registered but unrecognised political parties.”

5. Allotment of Symbols; Illustration:

5.1. The following example will make the position clear (symbols chosen

are for illustrative purposes only).

I. Allotment of symbols to recognised political parties.-

The candidates are allotted the respective reserved symbols.

II. Allotment of symbols to registered - unrecognised political

parties and to independents.-

The candidates set up by registered - unrecognised political parties are

entitled for preference over independents in the matter of allotment of

free symbols as already given in para 3.1.

The detailed instructions are given in para 3.1. and in the Symbol

Order (Annexure 1).

5.2. In case where the number of independent candidates exceeds the number of symbols notified for any one election, the Returning Officer /

Assistant Returning Officer should immediately contact the State Election

Commission and settle the issue in accordance with the directions of the

Commission. As soon as the allotment of symbols is completed, every candidate should be informed of the symbols so allotted and also

furnished with a specimen symbol under proper acknowledgement. This

will be the record of assignment of symbols of the Returning Officer which

should be one of the election records.

5.3. Publication of final list of contesting candidates for the election of

Members/Councillors of Urban Local Bodies:

After completing the assignment of symbols to all the candidates the

list of contesting candidates in Form 9 should be completed and published by the Returning Officer at the following places:-

(1)on the notice board of the Office of the Returning Officer, i.e., office of

the Urban Local Body;

(2)and in the respective ward of the Urban Local Body.

5.4. The list should contain the names of all the validly nominated

candidates who have not withdrawn their candidature, within the time

specified in this behalf. In column 6 of Form 9, the symbols allotted to

each candidate should be entered. In the case of unopposed candidate,

the question of filling up column 6 may not arise. Only the name of the

symbol assigned to each candidate need be mentioned in the last column of Form 9 and there is no need to draw or affix the symbol itself. The

date of poll and hours of poll should also be noted at the end of the list for

the information of public. The form of list of contesting candidates should

be published ward wise.

5.5. In order to avoid complaints from some candidates that their

names have not been correctly spelt in the ballot paper at a later stage,

each candidate may be required to give in writing the correct spelling of

the name of the candidate, either at the time of filing of nomination paper

or immediately after the scrutiny of nomination is over.

It should be noted that names of some persons in Tamil begin with a

letter of the Sanskrit alphabet viz., $. _. &. \. | and they usually write

their names using these alphabets. In such cases, their names in the list

should be written after all the names beginning with Tamil alphabets have

been written, in the order in which these letters are noted above

(Annexure III).

6. Records to be kept in safe custody:

6.1. After the publication of the list of contesting candidates is over, the

Returning Officer should keep the following records in safe custody in the

office of the Urban Local Body.

1. All nomination papers received and disposed of together with all the

documentary evidence produced during scrutiny or at the time of

rebuttal, arranged ward-wise (including Form C).

2. Office copies of Forms 4, 5, 6, 8 and 9.

3. Notices of withdrawal of candidates received in Form 7 together with authorisation letters.

4. Report regarding wards or urban local bodies for which fresh election is necessary.

5. Other records.

6.2. Safe deposit of paper relating to nomination, scrutiny and withdrawal

of candidatures with the Commissioner/ Executive Officer:

All election papers and proceedings relating to nominations, scrutiny

and withdrawal of candidatures for an election in each ward/local body

should be put together in a packet or envelope. This should be sealed

with the seal of the Returning Officer and kept in the office of the local

body for safe custody after the declaration of the result of the election is

made. The name of the ward/local body and a brief description of its

contents should be noted on the packet or envelope for ready reference.

Annexure - I

THE TAMIL NADU LOCAL BODIES ELECTION SYMBOLS (RESERVATION AND ALLOTMENT) ORDER, 2011

An order to provide for specifications, reservation, choice and allotment of

symbols at elections to local bodies in the State of Tamil Nadu and for matters connected

therewith.

WHEREAS, the superintendence, direction and control of all elections to local

bodies in the State of Tamil Nadu are vested in the Tamil Nadu State Election

Commission (hereinafter referred to as ‘the State Election Commission’) by the

Constitution of India, the Tamil Nadu Panchayats Act, 1994 (Tamil Nadu Act 21 of 1994),

the Chennai City Municipal Corporation Act, 1919 (Tamil Nadu Act IV of 1919), the

Madurai City Municipal Corporation Act, 1971 (Tamil Nadu Act XV of 1971), the

Coimbatore City Municipal Corporation Act, 1981 (Tamil Nadu Act XXV of 1981), the

Tiruchirapalli City Municipal Corporation Act, 1994 (Tamil Nadu Act 27 of 1994), the

Tirunelveli City Municipal Corporation Act, 1994 (Tamil Nadu Act 28 of 1994), the Salem

City Municipal Corporation Act, 1994 (Tamil Nadu Act 29 of 1994), Tiruppur City

Municipal Corporation Act, 2008 (Tamil Nadu Act 7 of 2008), the Erode City Municipal

Corporation Act, 2008 (Tamil Nadu Act 8 of 2008), the Vellore City Municipal Corporation

Act, 2008 (Tamil Nadu Act 26 of 2008), the Thoothukudi City Municipal Corporation Act, 2008 (Tamil Nadu Act 27 of 2008) and the Tamil Nadu District Municipalities Act, 1920

(Tamil Nadu Act V of 1920) (hereinafter referred to as ‘the Acts’);

AND WHEREAS, it is necessary and expedient to provide in the interest of purity of

elections to the local bodies in the State of Tamil Nadu and in the interest of the conduct

of such elections in a fair and efficient manner, for the specification, reservation, choice

and allotment of symbols and for matters connected therewith:

NOW, THEREFORE, in exercise of the powers conferred by Articles 243 K and 243

ZA of the Constitution of India read with relevant sections of the Acts, and rules 33, 34

and 35 of the Tamil Nadu Panchayats (Elections) Rules, 1995, rules 31, 32 and 33 of the

Tamil Nadu Town Panchayats, Third Grade Municipalities, Municipalities and Corporations

(Elections) Rules, 2006 and, in pursuance of the orders of Hon’ble High Court dated 1.10.2001 on the Writ Petition Nos. 17248, 17685, 17886, 17893, 17984 and 18095 of

2001 and the orders of the Hon’ble High Court dated 23.8.2006 on the Writ Appeal Nos.

2226 to 2229/2001 filed by the Tamil Nadu State Election Commission and in

supersession of the State Election Commission's Notification No. 242 published at pages

13 to 27 of Part VI - Section 2/373(d-2)/2006 of the Tamil Nadu Government Gazette,

dated 11.9.2006, the State Election Commission hereby makes the following order:-

1. Short title, application and commencement.-(1) This Order may be called the

Tamil Nadu Local Bodies Election Symbols (Reservation and Allotment) Order, 2011.

(2) It shall apply to all elections held under the Acts.

(3) It shall come into force at once.

2. Definition and Interpretation.-(1) In this Order, unless the context otherwise

requires, -

(a) “Contested election” means an election where a poll is taken;

(b) “Election” means an election held under the Acts;

(c) "Form" means a form appended to this Order;

(d) “Free symbol” means a symbol other than a reserved symbol;

(e) "Government" means the Government of Tamil Nadu;

(f) "Local bodies" means and includes all the Village Panchayats, Panchayat Unions,

District Panchayats, Town Panchayats, Third Grade Municipalities, Municipalities and

Municipal Corporations;

(g) "Ordinary election" means an election held to fill up a vacancy occurring by efflux of

time; and

(h) ‘Political party’ means an association or a body of individual citizens of India

registered with the Election Commission of India as a political party under Section

29A of Representation of the People Act, 1951.

(i) “Reserved symbol” means a symbol which is reserved by the Election Commission of

India for exclusive allotment to a contesting candidate set up by a recognised

political party.

(j) “Recognised political parties” means and includes every political party which has

been recognised by the Election Commission of India as a National Party or as a

State Party in the State of Tamil Nadu under the Election Symbols (Reservation and

Allotment) Order, 1968;

(k) “Registered - Unrecognised political party” means and includes

(i) every political party which had previously been recognised by the Election

Commission of India as a National Party under the Election Symbols

(Reservation and Allotment) Order, 1968 and subsequently lost its status as

National Party’

(ii) every political party which has been recognised by the Election Commission of

India as a State Party in any State other than Tamil Nadu under the Election

Symbols (Reservation and Allotment) Order, 1968; and

(iii) every political party having its head Office in the State of Tamil Nadu which is

registered with the Election Commission of India but not recognised either as a

National Party or as a State Party in Tamil Nadu by the Election Commission of

India under the Election Symbols (Reservation and Allotment) Order 1968;

(2) Words and expressions used but not defined in this Order but defined in the

Tamil Nadu Panchayats Act, 1994 (Tamil Nadu Act 21 of 1994) or the rules made there

under or in the Chennai City Municipal Corporation Act, 1919 (Tamil Nadu Act IV of 1919)

or in the Madurai City Municipal Corporation Act, 1971 (Tamil Nadu Act XV of 1971) or in

the Coimbatore City Municipal Corporation Act, 1981 (Tamil Nadu Act XXV of 1981) or in

the Tiruchirapalli City Municipal Corporation Act, 1994 (Tamil Nadu Act 27 of 1994) or in

the Tirunelveli City Municipal Corporation Act, 1994 (Tamil Nadu Act 28 of 1994) or in the

Salem City Municipal Corporation Act, 1994 (Tamil Nadu Act 29 of 1994) Tiruppur City

Municipal Corporation Act, 2008 (Tamil Nadu Act 7 of 2008), the Erode City Municipal

Corporation Act, 2008 (Tamil Nadu Act 8 of 2008), the Vellore City Municipal Corporation

Act, 2008 (Tamil Nadu Act 26 of 2008), the Thoothukudi City Municipal Corporation Act,

2008 (Tamil Nadu Act 27 of 2008) or in the Tamil Nadu District Municipalities Act, 1920

(Tamil Nadu Act V of 1920) or rules made there under shall have the meaning

respectively assigned to them in those Acts and rules.

(3) In the absence of such definitions, the Tamil Nadu General Clauses Act,

1891(Tamil Nadu Act 1 of 1891) shall, as far as may be, apply in relation to the

interpretation of this Order as it applies in relation to the interpretation of a Tamil Nadu

Act.

3. Notification by the State Election Commission of elections to be held on party-

basis.-For the purposes of this Order, the State Election Commission shall, in

consultation with the Government, notify from time to time the election or elections

which shall be held on party-basis and the election or elections which shall not be held on

party-basis.

4. Notification by the State Election Commission of the list of recognised

political parties and their symbols, the list of registered - unrecognised political

parties and the list (s) of free symbols.- The State Election Commission shall notify

from time to time a list of recognised political parties, the symbols respectively reserved

for them and a list of registered - unrecognised political parties and the list or lists of free

symbols.

5. Allotment of Symbols.- In every contested election, a symbol shall be allotted to a

contesting candidate in accordance with the provisions of this Order and different

symbols shall be allotted to different contesting candidates.

6. Allotment of Symbols in Elections not held on party-basis.- (1) In every

contested election not held on party-basis, symbols shall be allotted to the candidates in

the sequence of the symbols in the list of free symbols meant for that election by drawing

lots.

Example.-If election of member of a ward of a Village Panchayat is not held on party-basis and if there are five candidates and if the first five symbols in the list

are, say, (1) “Key”, (2)“ Comb”, (3) “Cot”, (4) “Car” and (5) “Conch”, then these

five symbols should be taken for allotment and assigned to the five candidates by

drawing lots. The candidate whose name is drawn first shall get the symbol “Key”

and the candidate whose name is drawn next shall get the symbol “Comb” and so

on. If there had been only three candidates in the above example, only “Key”,

“Comb” and “Cot” could be allotted in that order.

(2) In such election, the allotment of symbol shall be done only by drawing lots

even if the contesting candidates agree among themselves upon their symbols.

7. Allotment of Symbols in Elections held on party basis.- (1) In an election held

on party-basis, a candidate set up by a recognised political party shall choose, and shall

be allotted, the symbol reserved for that party and no other symbol:

Provided that when there are conflicting claims for any such reserved symbol due

to defect of substantial character either in the nomination paper or in Form B or Form C

filed, none of the claimants shall be allotted that reserved symbol and all the claimants

shall be treated as independent candidates and allotted the free symbols left after

allotting to all other candidates in that election:

Provided further that no reserved symbol shall be sought or allotted in an

election, to any candidate other than a candidate set up by a recognised political party to

which that symbol has been reserved, even if no candidate has been set up by that

recognised political party in that election.

(2) Choice of symbol by candidates set up by registered - unrecognised

political parties and by independent candidates .- Every independent candidate,

shall declare in the nomination paper first filed by him or on his behalf, his choice of

three free symbols from the list of free symbols for that election indicating the order of

his preference. Every candidate who is set up by the registered - unrecognised political

party shall declare in the nomination paper first filed by him or on his behalf, his choice

of three free symbols collectively from the list of free symbols notified for the party based

elections. The symbols shall be allotted in accordance with the procedure laid down

below:-

(a) The allotment of symbols shall be considered in the order of preference made

by the candidates, that is to say, the first preference of the candidates will be considered

first, the second preference next and the third preference last:

Provided that the allotment of symbols to candidates set up by the registered -

unrecognised political parties shall be completed first and only thereafter the allotment of

symbol to the independent candidates shall be taken up and allotted from among the

remaining free symbols.

(b) Where a free symbol has been sought for by only one candidate set up by a

registered-unrecognised political party, as his first choice, it shall be allotted to that

candidate and to no one else. If any free symbol has been sought for by more than one

candidate set up by the registered-unrecognised political parties, the allotment of that

symbol shall be decided by drawing a lot among these candidates and the candidate

whose name is drawn first shall be allotted that symbol.

(c) If any candidate set up by registered - unrecognised political party could not

be allotted the symbol sought for in his first preference in the lot, he shall be considered

for allotment of the free symbol sought for, as his second preference. Should the second

choice of symbol could also not be allotted, due to conflicting claims for that symbol and

failure in the lot, he shall be considered for the allotment of the free symbol of his third

preference. Even if this could not be allotted, he should be allotted by drawing a lot, any

one of the free symbols left after allotting to other candidates set up by the registered -

unrecognised political parties in accordance with the procedure set out above.

(d) After completing the allotment of free symbols to all the candidates set up by

the registered - unrecognised political parties, the remaining free symbols shall be

allotted to the independent candidates in accordance with their choice and preference by

adopting the procedures for allotment of symbols to candidates set up by the registered -

unrecognised political parties.

8. When a candidate shall be deemed to be set up by a political party.- (1) For

the purposes of this Order, a candidate shall be deemed to be set up by the political

party if, and only if-

(a) the candidate has enclosed a declaration to that effect in Form C along with

the nomination paper;

(b) a notice in writing in Form B to that effect has, not later than 3.00 p.m. on the

last date for withdrawal of candidature, been delivered to the Returning Officer;

(c) the said notice is either signed by the President, the Secretary or any other office bearer and who has been authorised by the party in this behalf or any other person

who has been authorised by such office bearer, to send the notice; and

(d) the communication in Form A with regard to the name and specimen signature

of such authorised person are delivered to the Returning Officer not later than 3.00 p.m.

on the last date for withdrawal of candidature.

(2) (a) The communication in Form A shall be signed by the President, the

Secretary or any other office bearer and who has been authorised by the party in this

behalf to send such communication:

Provided where the notice in Form B is signed by any such office bearer

authorised by the Party, Form A need not be insisted upon.

(b) Form C shall be signed in ink, while printed/cyclostyled/photocopies of Forms

A and B with facsimile signature can be presented.

9. When splinter groups or rival groups claim to be that party.- If in an election to

the local bodies held on party-basis, rival sections or groups of a recognised political

party claim to be that party, the State Election Commission may decide on allotment of

symbols to the candidates sponsored by such sections or groups and the State Election

Commission's decision shall be final.

10. When two or more recognised political parties amalgamate into a new

party.- If in an election to the local bodies held on party-basis, two or more recognised

political parties join together to form a new political party but the recognition for it under

the Election Symbols (Reservation and Allotment) Order, 1968, is pending before the

Election Commission of India, the new party may be allotted by the State Election

Commission any of the reserved symbols already allotted to the constituent parties,

provided a request in writing for such an allotment is made jointly by the Chief Executive

Officers of all the constituent recognised parties.

11. Power of State Election Commission to issue instructions and directions.-The

State Election Commission may issue instructions and directions-

(a) for the clarification of any of the provisions of this Order;

(b) for the removal of any difficulty which may arise in relation to the

implementation of any such provision; and

(c) in relation to any matter with respect to the reservation and allotment of

symbols for which this Order makes no provision or makes insufficient provision, and the

provision is, in the opinion of the State Election Commission, necessary for the smooth

and orderly conduct of elections.

NOTIFICATION

WHEREAS, the Tamil Nadu State Election Commission has issued an Order viz.,

the Tamil Nadu Local Bodies Election Symbols (Reservation and Allotment) Order, 2011

to provide for specification, reservation, choice and allotment of symbols at elections to local bodies in the State of Tamil Nadu and for matters connected therewith; and

WHEREAS, it has become expedient to notify the list of recognised political parties

and the symbols respectively reserved for them, the list of registered - unrecognised

political parties and the lists of free symbols for the use in the local bodies election:

NOW, THEREFORE, in exercise of the powers conferred by paragraphs 4 and 6 of

the Tamil Nadu Local Bodies Election Symbols (Reservation and Allotment) Order, 2011

and in supersession of the earlier notifications, the Tamil Nadu State Election Commission

hereby notifies,--

(a) in Table 1, the recognised political parties and the symbols respectively reserved for

them;

(b) in Table 1-A, the list of registered - unrecognised political parties.

(c) in Table 2, the free symbols for the use in election of Members of Village

Panchayats;

(d) in Table 3, the free symbols for the use in election of Presidents of Village

Panchayats;

(e) in Table 4, the free symbols for the use in election of Members of Panchayat Union

Councils, Members of Town Panchayats, Members of Third Grade

Municipalities, Councillors of Municipalities and Councillors of Municipal

Corporations; and

(f) in Table 5, the free symbols for the use in election of Members of District

Panchayats, Chairman of Town Panchayats / Third Grade Municipalities /

In respect of party based Elections, every independent candidate shall

declare in the nomination paper first filed by him/her or on his/her

behalf, his/her choice of three free symbols from the list of free symbols

for that election in Table 4 or Table 5 as the case may be, indicating the

order of his/her preference.

Every candidate who is setup by a registered - unrecognised political

party shall declare in the nomination paper first filed by him/her or on his/her behalf, his/her choice of three free symbols collectively from the

list of free symbols notified in Table 4 and Table 5 for the party based

elections.
