Householder Submission Guide

Purpose of guideThis guide is to help applicants and agents submit a perfect householder application. Within this guide are details of which documents are required to accompany an application, when they are required and what each document is.

However, please note that the submission of a planning application in accordance with this guidance does not guarantee that planning permission will be granted. Each application will be determined on its own merits and in accordance with local and national policies and guidance.

By adhering to this guide it is likely that an application will be registered with the minimum of delay, and can be passed to the planning officer for processing.

Application form

Please ensure you complete every question within the form. One copy of the form is required for a paper submission. These can be downloaded via the Cornwall Council web site by following the instructions to the right.

Alternatively, the application can be submitted electronically through the Planning Portal. To submit an application electronically

via the Planning Portal, go to:

Certificates There are four ownership certificates within the form, Certificate A, B, C or D. One of the ownership certificates must be signed and dated accordingly as required by the Town and Country Planning (Development Management Procedure) Order 2010.

Certificate A - sole ownership

Certificate A should only be completed if the applicant is the sole owner of the land to which the application relates (i.e. the applicant is the freeholder and there are no leaseholders with seven years or more remaining on their leases).

If the application involves a leasehold flat where less than 7 years is remaining on the lease, then certificate A does not apply as the applicant is not the sole owner. Therefore, in this circumstance, the applicant should complete certificate B, C or D (see details below).

Certificate B - shared ownership and agricultural tenants (all other owners / tenants known)

Certificate B should be completed if the applicant is not the sole owner but knows the names and addresses of all the other owners (e.g. this certificate will need to be served if the proposals encroach onto adjoining land).

The Notice to Owners (Notice 1) must also be completed and sent to all known owners.

A copy of the notice must also be submitted with the application.

Certificates continued

Certificate C - shared ownership (some other owners / tenants known), including the Agricultural Holdings Certificate.

Certificate C should be completed if the applicant does not own all of the land to which the application relates and does not know the name and addresses of all of the owners.

The Notice to Owners (Notice 1) must be completed and sent to all known owners.

Where the owner is unknown the Notice to Unknown Owners (Notice 2) needs to be published in a local newspaper.

All full planning applications must include the appropriate Agricultural Holdings Certificate to be considered by the local authority.

If the land to which the application relates forms an agricultural holding or part of an agricultural holding, as defined by the Agricultural Holdings Act 1986, and comprises land subject to an Agricultural Tenancy all agricultural tenants must be notified prior to the submission of an application.

If you are the sole tenant of the Agricultural Holding, insert ‘sole tenant - not applicable’ in the table under option (B).

A copy of the notice must also be submitted with the application.

Certificate D - shared ownership (all other owners unknown)

Certificate D should be completed if the applicant does not own all of the land to which the application relates and does not know the names and addresses of any of the owners.

The Notice to Unknown Owners (Notice 2) needs to be published in a local newspaper and displayed on site. A copy of the notice must also be submitted with the application.

Location planOne copy of the Location Plan at a scale of 1:2500 or 1:1250 must be submitted. The location plan must identify the application site by way of a red outline and this must be part of the curtilage of the dwelling.

Where the proposals would affect an access to a highway (such as alterations to the access or use of the access for construction vehicles) then the access to the highway must also be outlined in red. Where other land owned by the applicant is close to or adjoins the application site then this should be outlined in blue where relevant to the application. Applications for new windows or re-roofing would not need the other land to be outlined but a two-storey extension which affects neighbouring dwellings in the applicant’s ownership through overlooking or overbearing impacts should by identified by a blue line. Site plan/block planUnless submitted electronically, all applications must include One copy of a block plan based on an up-to-date map, if the site proposal includes operational works. The site plan should be drawn at an identified standard metric scale (1:200 or 1:500). It should accurately show the site boundaries, the type and height of boundary treatment, especially where a change is proposed, and the position of any buildings or structures neighbouring the site, where these could influence or be affected by the proposed development.

Please see below a correctly labelled block plan at the scale of 1:500, showing the northern point, scale bar and drawing title.

ElevationsOne copy of the existing and proposed elevation plans must be submitted for applications involving new development, and where existing buildings are altered by the proposed development. These should indicate, where possible, the proposed building materials and the style, materials and finish of windows and doors. Where a proposed elevation adjoins another building or is in close proximity to it, the drawings should show the relationship between the two buildings and detail the positions of the openings on each property. Elevations must be submitted at the acceptable metric scale of 1:50 or 1:100, these should also be labelled appropriately to incorporate a scale bar, title, the drawing number and North, East, South or West orientations.

Floor plansOne copy of the existing and proposed floor plans must be submitted for applications involving new development, and where existing buildings are altered by the proposed development. These should highlight any existing walls or buildings that are to be demolished, where applicable. This information will need to be submitted at the acceptable metric scale of 1:50 or 1:100, these should also be labelled appropriately to incorporate a scale bar, title and the drawing number.

Roof plansOne copy of existing and proposed roof plans for any roof that would be created or altered by the proposed development, showing the shape of the roof, its location, and specifying the roofing material to be used must be submitted with the application. This information needs to be submitted at the acceptable metric scale of 1:50 or 1:100, these should also be labelled appropriately to incorporate a scale bar, title and the drawing number.

Site sections, finished floor levels and site levelsOne copy of existing and proposed site sections, finished floor and site levels must be submitted with the application, where a change is proposed on levels or new detached buildings are proposed. These should show: how the proposed development relates to existing site levels and adjacent development (with levels related to a fixed off site datum point); details of existing and proposed foundations and eaves where a change is proposed; and how encroachment onto adjoining land is to be avoided.

Supporting statement/informationOne copy of a design and access statement will be required if your site lies within a conservation area or a world heritage site. The statement will need to include information on the design, materials and scope of development. The statement should demonstrate how the proposal will fit in with the existing dwelling and materials. Depending on the complexity of the proposal will therefore depend on how in-depth the statement is.

Exemptions of fees y For alterations, extensions, etc. to a dwelling house for the benefit of a registered disabled person (provided the works are reasonably necessary for that persons enjoyment of the dwelling and proof of this can be provided)

y If the proposal is the first revision of an application for development of the same character or description on the same site by the same applicant within 12 months of making the earlier application if withdrawn or the date of decision if granted or refused and NOT a duplicate application made by the same applicant within 28 days.

Supporting documentsPlease see below a list of other documents that may be required depending on development circumstances.

Flood risk assessment

A flood risk assessment may be required if the application site falls within flood zones 2 or 3, is within 20 metres of the top of a bank of a main river, or if the development includes culverting or control of flow of any river or stream. The flood risk assessment must be submitted in accordance with the Environment Agency flood risk standard advice, which can be accessed via their web site: http://www.environment-agency.gov.uk/

Critical drainage

A copy of a critical drainage statement may be required if the application site falls within a critical drainage area, identified by the Environment Agency. The statement will need to demonstrate whether or not the proposal will impact on the existing surface water drainage system and what mitigation will be put in place.

Parking provision

Where a scheme reduces the available parking or turning pace, changes access arrangements or significantly increases the size of a property and therefore has the potential to increase the demand for parking, details should be submitted stating how access will be provided, what arrangements are to be made to ensure that safe access and egress can be achieved and the reasonable parking demands are met within the application site.

Tree survey

Where there are trees within the application site or on land adjacent to it that could influence or be affected by the development (including street trees) an arboricultural report carried out by a specialist will be required, to contain information on which trees are to be retained and how the design and implementation of the scheme makes provision of their protection.

Bat and barn owl survey

If there is a reasonable likelihood that bats or barn owls are nesting at the property, a bat and barn owl survey must be submitted with the application. Bat and barn owl surveys should be carried out by a suitably qualified person, further advice can be obtained from Natural England.
