The Harmonized Commodity Description and Coding System, generally referred to as "Harmonized System" or simply "HS“.
Is a multipurpose international product nomenclature developed under the auspices of the World Customs Organization (WCO), an independent intergovernmental body. The tariff schedule containing the headings, subheadings and the corresponding number codes, the notes to the Sections, of the Chapters and the Subheadings, as well as the General Rules for the interpretation of the HS.

HARMONIZED SYSTEM (HS)
The Harmonized System is based on a fundamental principle that goods are classified by what they are. In some cases, end-use is considered when a product is specifically constructed for it.
General Rule Nº1 for the interpretation of the Harmonized System:
The titles of Sections, Chapters and sub-Chapters are provided for ease of reference only; for legal purposes, classification shall be determined according to the terms of the headings and any relative Section or Chapters Notes.

Methyl bromide 98% (with 2% chloropicrin as odoriferous substance) packaged in 1 or 11/2 pounds cans, represent one dosage, therefore, according to the stipulations of Note 2 of Section VI, it cannot be classified by Chapter 29.
In accordance with the Note, it classifies by 3808.

It can only be classified in chapter 29, when it is packaged in containers with valves that allow repeated use. In 30, 50, 100 Kg. cylinders or in iso-tanks (tank containers).

This heading includes, provided that they are not separate chemically defined chemicals and are not included in a more specific heading, organic solvents and diluents organic (although containing 70% by weight or more of oil petroleum). The reagents of this heading are on a backing or in the form of preparations, therefore they are more than a single constituent. They may consist of admixtures of two or more reagents or of single reagent dissolved in solvents other than water. Reagents of this heading may also be put up in the form of kits, consisting of several components composed of various components. The products of this heading should de clearly identifiable as being for use only as diagnostic or laboratory reagents.
