Things are improving but slowly
There are a lot of comments on the market about how much it is improving. If we
take a look to the information provided by the Ministry of Housing, the number of
sales registered on the third quarter, not only on Benahavis but also in Marbella, has
been the best of the last six years. That means something by itself.
If we look at the data of Benahavis, the year up to now is not as good as 2012 but it is
already much better than 2011 so I think it is going to be a good year.
On the other hand, the number of sales in Marbella has been, on this time of the year,
the best since 2008. The increase in sales has been a 24% when compared to those of
2012. However, it is still a 35 % lower than the average of the “good years”.

Can we say that the market has recovered?
My opinion is that we should not say it yet. It is true that the market is doing better
but when you are working on the field, you can feel that things are slightly better but
seems that there is still a way to go. It is still complicated to close operations and
there is not any sense on the buyers that they can lose a property if they wait some
time to decide. When talking to one of the big notary offices of Marbella three weeks
ago, they stated that they have registered an increase of 10 to 15% in the number of
sales when compared to the same period of 2012. That confirms the better sensations
that all we are in this field are noticing. A friend told me recently: we have started
the engine and we have started to move but still some time to reach the pace.

TIPS AND INSIGHTS ABOUT:
The process of canceling a mortgage on a property is simple but requires some steps. If the pending debt has been already
cleared, it is fully recommended to proceed with the inscription of the mortgage’s cancellation at the Land Registry in order to
avoid future problems. These would be the steps to be followed:
1.‐ The Bank
The first step is to approach the bank and ask them for the total amount pending to cancel the mortgage. They will include the
main capital pending, the interest up to the cancellation date and, depending on the mortgage, a cancellation commission. Once
that amount is paid, the bank will issue a certificate of “zero debt” stating that the amount pending has been fully paid.
2.– The Notary
The second step would be going to the notary with the certificate issued by the bank and sign a public deed of cancellation of the
mortgage. The Notary officials can prepare that deed.
3.– The Tax
With the copy of the cancellation deed, the Impuesto de Actos Juridicos Documentados has to be cleared. Since 2001, the mort‐
gage cancellation deeds are exempted on paying that tax but a certificate issued by the Tax Office stating that exemption is need‐
ed to proceed with the Land Registry cancellation.
4.– The Land Registry
Once the tax has been cleared and with all the documentation produced on the previous steps, it is the time to approach the Land
Registry to request the inscription of the mortgage’s cancellation. This would be the last step of the process.
If the property has been sold and the buyer is not interested on maintaining the mortgage on the property, that mortgage has to
be cancelled prior to the signature of the selling deed. That is usually done on the same day, same Notary and just before the sig‐
nature of the purchase deed. The bank will have to prepare a certificate with the amount pending on the date of the signature and
the buyer will bring a check for that amount that will be given directly to the bank representative that will sign the cancellation
deed. The Land Registry cancellation will be done prior to the inscription of the purchase by the new owner.

Las cosas están mejorando pero lentamente
Hay muchos comentarios en la calle sobre la mejora del mercado pero creo que hay
que tomarlos todavía con cierta cautela. Si echamos un vistazo a la información pro‐
porcionada por el Ministerio de Fomento, el número de ventas registradas en el ter‐
cer trimestre, no sólo en Benahavís sino también en Marbella, ha sido el mejor de los
últimos seis años. Eso ya significa algo por sí solo.
Si nos fijamos en los datos de Benahavís, el año hasta ahora no es tan bueno como
2012 pero ya es mucho mejor que 2011 por lo que creo que va al final va a ser bueno.
Por otra parte, el número de ventas en Marbella ha sido, hasta ahora, el mejor desde
2008. El aumento de las ventas ha sido de un 24% en comparación con los números
de 2012. Sin embargo, sigue siendo un 35% inferior a la media de los ʺbuenos añosʺ.

¿Podemos decir que el mercado se ha recuperado?
Mi opinión es que todavía es un poco aventurado. Es cierto que el mercado está me‐
jorando pero cuando se esta en la calle se puede percibir que aunque las cosas están
un poco mejor aun queda mucho camino por recorrer. Todavía es complicado cerrar
operaciones y los compradores siguen sin tener la sensación de que pueden perder
una propiedad si esperan un poco de tiempo para decidirse. Al hablar con una de las
notarías grandes de Marbella hace unas tres semanas, me comentaron que han regis‐
trado un incremento del 10 al 15% en el número de ventas en comparación con el
mismo periodo de 2012. Eso también confirma las buenas sensaciones que todos los
que estamos en este sector estamos percibiendo. Un amigo me dijo hace poco: hemos
puesto en marcha el motor y nos movemos pero aun nos queda para alcanzar ritmo.

INFORMACION DE UTILIDAD:
El proceso de cancelación de una hipoteca sobre una propiedad es simple pero requiere seguir algunos pasos. Si la deuda con el
banco ya se ha liquidado, habría que proceder a la inscripción registral de la cancelación de la hipoteca con el fin de evitar proble‐
mas en el futuro. Estos serían los pasos a seguir:
1.‐ El Banco
El primer paso es acercarse al banco y pedir el importe total de la deuda pendiente para cancelar la hipoteca. Incluirán el principal
pendiente, los intereses hasta la fecha de cancelación y, en función de la hipoteca, la comisión de cancelación. Una vez que se pa‐
gue esa cantidad, el banco expide un “certificado de deuda ceroʺ, certificando que el importe pendiente se ha pagado en su totali‐
dad.
2.– La Notaria
El segundo paso sería ir a una Notaria con el certificado emitido por el banco, los datos de la hipoteca y la propiedad para firmar
una escritura pública de cancelación de la hipoteca. Los oficiales de la Notaria pueden preparar este documento.
3.– Las Tasas
Con la copia de la escritura de cancelación, hay que liquidar el Impuesto de Actos Jurídicos Documentados. Desde 2001, las escri‐
turas de cancelación de hipotecas están exentas de pagar este impuesto pero se necesita un certificado expedido por la Agencia
Tributaria ratificando dicha exención para proceder a la cancelación de la hipoteca en el Registro de la Propiedad.
4.– El Registro de la Propiedad
Una vez que el impuesto se ha liquidado y con toda la documentación que se genera en los pasos anteriores, es el momento de
acercarse al Registro de la Propiedad para solicitar la inscripción de la cancelación de la hipoteca, último paso del proceso.
Si la propiedad se ha vendido y el comprador no tiene interés en mantener la hipoteca existente sobre la propiedad, la hipoteca
tiene que ser cancelada antes de la firma de la escritura pública de compraventa. Por lo general, esta cancelación se realiza en el
mismo día, el mismo Notario y justo antes de la firma de la escritura de compraventa. El banco prepara un certificado con la canti‐
dad pendiente a la fecha de la firma y el comprador lleva un cheque por esa cantidad que será entregada directamente al repre‐
sentante del banco que firmará la escritura de cancelación. La cancelación en el Registro de la Propiedad hay que hacerla antes de
la inscripción de la compraventa por parte del nuevo propietario.
