    Inthemeetingfollowingresolutionshavebeenpassed.

    On the aforesaid agenda looking into the considerable

    decreaseinnumberofcoronapositivecasesinLucknow,and

    alsoinviewofthefactthatnormalfunctioninghasstartedin

    every sphere of the society and further, the video

    conferencing system is yielding new technical issues

    everyday,theGC resolvesunanimouslythat,

    3.Thefreshcasespiledintheregistrymaybepassedand

    may be listed for admission/hearing before the

    moreparticularlyincriminaljurisdiction,sothatpending

    5.During meeting the General Secretary placed the

    representations offew members in which theyhave

    requestedtonottostartphysicalhearing.TheGCfinding

    thatunderchangedcircumstancesithaslostitsefficacy,

    hencerejectstheserepresentationsunanimously.TheGC

    furtherresolvesanysuchrepresentationofanymember

    ofAwadhBarAssociationdirectlygiventoHon'bleChief

    Justice orHigh CourtAdministration demanding non

    restorationofphysicalhearinginHighCourt,Lucknow,

    maynotbetakenintocognizance.

    6. Taking cognizanceoffew messageson SocialMedia

    regarding proposed agitation,the GC requests the

    RespectedmembersnottostageanyDharanaoragitation

    inregardtothedemandofstartofPhysicalhearing,asGC

    itselfismakingeveryeffortinthisregardandapositive

    dialogueisinvogueandsinceourotherdemandslike

    openingofChambers,openingofhallofladyAdvocates,

    filingfrom propercounterinsideetc.hasbeenalready

    accepted,wehopeandtrustforacceptanceofourabove

    demandsalso.

    Today on 10-04-2020 at 12.30 PM an Emergent Meeting of theGoverning Council of Awadh Bar Association, High Court, Lucknow hasbeen held by means of Electronic Media Conferencing under theChairmanship of President Sri H.G.S. Parihar, Senior Advocate.

    Pandemic caused by Noval Corona Virus (Covid-19) has forced thehumanity to shelve its pace in idle mode and so is the situation of thecommunity of Lawyers, who though aid the State in discharge of itssovereign duty of dispensation of Justice, but get no social andeconomic security from the State. Under these peculiar circumstances,when the High Court of Lucknow is indefinitely closed since 19-03-2020, the Governing Council of Awadh Bar Association has decided toprovide financial assistance to its Members vide it's resolutions dated23-03-2020, 26-03-2020, 05-04-2020 and 08-04-2020. In the lastmeeting held on 08-04-2020 the General Secretary of Awadh BarAssociation was authorized to frame a Scheme for FinancialAssistance of its members. Today the General Secretary Mr. SharadPathak has placed the draft of the 'Awadh Bar Association EmergencyCare Scheme-2020' before the Governing Council. The GoverningCouncil after discussing the draft of the scheme unanimously passedand approved the same. The scheme shall be the part of theResolution. The Governing Council authorized the General Secretary totake necessary steps for its effective implementation.

    Further, the respected Members of Awadh Bar Association arerequested to take care of their Clerk and to provide necessary FinancialHelp for their subsistence.

    Proceedings of Today's meeting has been closed with the consentof Honble President with a Vote of thanks.

    " The Awadh Bar Association Emergency Care Scheme 2020 ."

    Object

    This scheme has been framed to aid and support those members of the ABA who, like the present difficult timeof closure of High Court due to Corona pandemic; may be in actual financial distress and need assistance to tieover the difficulties.

    This Scheme has been approved by the Governing Council of Awadh Bar Association in it's meetings dated10.04.2020.

    1 - Name of the Scheme :

    This Scheme shall be called as "The Awadh Bar Association Emergency Care Scheme 2020" {hereinafter termedas "Scheme" } and shall come into force w.e.f. 10.04.2020.

    2 - Definitions:

    In the "Scheme",

    (I) 'ABA' shall mean Awadh Bar Association, the Society registered under the Societies Registration Act 1860,bearing registration no.254 dated 24th November 1914,

    (II) 'GC' shall mean the Governing Council of ABA,

    (III) ‘member/members' shall mean the member of ABA as defined in clause 4(b) & 4(d) of the Rules andConstitution of the 'ABA',

    (IV) ‘Sub-Committee’ shall mean committee consisting of,

    1- General Secretary of ABA,

    2- Treasurer of ABA,

    3- Vice-president (middle) Ist of ABA,

    4- Joint Secretary 1st of ABA,

    5- Member GC (Above 15 years, Ist) of ABA,

    6-Member GC (Below 15 years, Ist) of ABA,

    3.Fund :

    For giving effect to the provisions of the Scheme a fund shall be created by,

    (i) By borrowing a sum of Rs 12,25,000-/ from the Photo Affidavit Account of ABA【Current A/c no. 38611712902in the State Bank of India, High Court, Lucknow】, which shall be refunded back to the same account as soon asthe sum received by sub-clause (ii&iii) exceeds the borrowed amount after disbursement under the Scheme.

    (ii) by collecting a sum of Rs 2,75,000-/ from contribution of the members of the GC.

    (iii) by collecting fund from donations given by the distinguished members of ABA.

    4- Distinguished members of ABA are requested to donate in the Account of ABA bearing No. 10066506629 in

  • State Bank of India, High Court, Lucknow. IFSC Code SBIN0006219.

    5. Eligibility

    The emergency fund so created shall be used to disburse the amount maximum up to Rs 5,000-/ per applicant,subject to the availability of fund and fulfilment of the following conditions,

    (i) The applicant is not in the arrears of any dues, including membership dues of ABA preceding 4 months on thedate of application,

    (ii) has filed minimum 5 Vakalatnama in the High Court , Lucknow in last calendar year {e.g. For the current year of2020, the calendar year 2019 shall be taken into consideration}.

    6.The members desiring to be benefited under this scheme will have to submit their information on the proformaappended to the 'Scheme' as Appendix-A.

    Provided if any false information is found to be furnished in the Appendix-A, appropriate action shall be takenagainst such member by the GC.

    7. Such applications shall be processed and recommend by the Sub-Committee. Thereafter such recommendedapplications shall be placed in a list A in the order of seniority. The applications not found fit shall be placed in listB, disclosing the reason for rejection in brief.

    8. Recommendation of the Sub-committee shall be placed before the President for approval and thereafterdisbursement of the amount shall be done from account no.10066506629 of ABA, referred hereinabove, to theapplicants in reverse order from the list A prepared under Rule 7, which shall not exceed Rs 5,000-/.

    9. Necessary reflection of income and expenditure will be made in the books of account of the ABA.

    10-GC is honoured to come to the aid of its members in difficult times and urges members to donate towards thisscheme so as to compensate for expending amount from the existing deposits.
