Shri B. L. Maru, Regional officer and Representative of the Member Secretary, GPCB;

welcomed all present to the Public Hearing and said that this Public Hearing was being

held according to the Notification S.O. 1533 and also mentioned the advertisement

regarding the same was published in English in "The Indian Express" dated

12/06/2014 and in Gujarati in "Gujarat Samachar" dated 12/06/2014. Executive

Summary in Gujarati and copy of Gujarati Newspaper was sent t o all locally affected

panchayat office for villager for their information. For broad publicity of Public Hearing

to villagers and villages located in remote area were also announced by loud speakers

in Auto Rickshaw.

He also added that only locally affected people were allowed to make their

representations in public hearing, according t o the above Notification and also

according t o a Circular issued by GPCB on 20.09.2007. He added that two written

representation was received before Public Hearing. One is f rom NGO- "Paryavaran

Mitra", Mr. lvlahesh Pandya from Ahmedabad and other one is f rom Samarth

Organization Trust, Vijapur. At the t ime of Public Hearing one writ ten representation

was received from Vishva Bandhu Jagruti Mission, Kadi. These representations and

their reply will be enclosed in the minutes. The representation and the reply to the

same given by the project proponent would be included in the minutes.

We have studied the draft EIA report of the above-mentioned project. Following are our observation/comments/questions regarding project and draft EIA report.

1. Whether company has submitted environmental audit report regularly to GPCB for existing plant? Please give copy of GPCB visit report and air/water/solid waste sample analysis report for existing unit of last two years.

2. Whether company has been issued show cause notice/closure notice/notice under Water act-1974 or Air Act 1981 or Environmental protection Act 1986 for the existing unit? If yes give copy and also give the remedial measure taken to restart operation?

3. Please give details of actual production, water consumption, waste water generation, solid waste generation of existing unit for the last 2 years?

4. As per EIA, water balance, 87 KLD will be evaporated in MEE, out of which 80 KLD will be recovered as condensate. So is it possible to recover 91% of condensate from MEE?

5. Please justify ! 5 KLD of domestic water consumption for 160 employs? 6. As per EIA report, 10 K ~ D water will be used for gardening in 14000 m2 land. Please

justify the quantity with respect to the area. 7. As per EIA report, generated ash will be sold off to brick manufacturer, cement

manufacturer for use in PPC cement, to hollow concrete brick manufacturer etc., and also will be supplied to the company for land leveling, conditioning and road construction, etc. Please give the quantity of ash generated and the exact quantity that will be used in various ways?

In the Compliance of CC&A Vide its Order No. AWH- 61 160, dated 21/03/2014, valid up to 14/02/2019, under conditions under the water Act, condition 3.2 states that "The quantity of trade effluent discharge from the industry shall be nil as effluent shall be passed through RO system. RO permeable shall be reuse back and RO reject shall be sent to MEE in sister concern unit MIS. Akshar Chem. (India). While in water balance diagram of the existing unit, it is given that effluent is sent to solar evaporator. Please clarify.

10. What is the socio-economic developmental activities industry has done as a part of CSR

e activity till now in the affected area? Please mention the broad areas with budget allotted in future for CSR activity for proposed project.

The copy of the SCN is attached here as Annexure - A. In this regard, we would like to state that on the day of Board's officials visit to our plant, the functioning of jet-pulse system, for the clearling of Bag filter was disturbed. And hence, the efficiency of bag-filter could not be achieved.

After the Board's officials visit to our pla.nt, the automatic system of jet-pulse system, has been installed and the functioning of the same has been verified.

Based on the above explanation, we request you not to take any action merltioned in the notice and oblige.

This indicates that you have failed to fulfill the conditions given in the consent order. Consequently you have rendered yourself liable to be prosecuted under the penalty provisions of the consent order.
