INTRODUCTION

GMDC is the flagship company of the Government of Gujarat, registered under the Com panies Act; 1956.GMDC is in the business of extracting and selling various minerals like Lignite, Bauxi te, Fluorspar and Manganese. GMDC has also established 2 x 125 MW

lignite based power plant at Nani chher, Kutch.

PROJECT DATA

1.00 Site Description Akrimota Thermal Power Station is a pi t head power station in Kutch

District, Gujarat (India) having capaci ty of 250 MW(2x125 MW

each)under Stage-I; with a future provision of Stage-II extension with identical units of the same capacity.

Highway # 8A to Gandhidham. State Highway # 45 connects Bhuj to Lakhpat and to Narayan Sarovar (Koteshwar). Site is 2 kms west of

Lakhpat-Narayan Sarovar road. There are many cause ways between Bhuj & site.

1.04 Site Elevation : 15 M above MSL 1.05 Type of Atmosphere : Hot, humid and corrosive oxides of

sulphur and chlorides present in the coastal saline atmospheric air.

(To be read & studied before quoting the Tender)

1. No escalation in price/rate will be allowed once the offer is submitted.

2. All bid docum ents shall be signed by the authorized person/representative of the

candidate.

3. The bidder shall bear all costs associated with the preparation and the subm ission of

the bid Whether or not, the bid is accepted or even if GMDC withdraws the bid

invitation, the bidder shall not be entitled to claim any costs, charges, etc in

connection with the bid.

4. It is the bidder’s obligation to conform to the scope of the work and work to the best of

the efforts to complete the work as per the expected schedule provided by them.

5. GMDC reserves the right to reject any or all of the bids or accept any of the bids in

part or full

6. The bid shall be evaluated only for the bidders who meet the eligibility criteria.

7. If required the tenderers m ay visit the site along with the tender copy, to s tudy the

project before submitting the offer.

8. No escalation in price / rate will be allowed on any ground, extension in time limit m ay

be granted with an explicit understanding.

9. Tenders will be opened in Two Bid system , i.e. Technical or Prequali fication Bid and

Price Bid. First the Technical or Prequalification Bid will be opened on the date of

opening of the tender in the presence of the tenderer. The Corporation will scrutinize

the sam e and the Price Bids will be opened only of those tenderers, who quali fy

themselves in Technical / Prequalification Bid. The technically qualified

tenderers (Prequali fied Tenderers) will be informed regarding the date, time and

venue for the opening of the price bid..

10. The tenderer is required to submit the DD of EMD as per Lim ited tender notice. It

should be noted that if the demand draft of EMD is not subm itted, the tender will not

be considered for scrutiny and will be summarily rejected.

11. The tenderer will have to submit ‘NO DEMAND CERTIFICATE’ along with the final

bill of the work, as per the Proforma given in this docum ent.

12. Successful tenderer will have to enter in to the agreem ent with the Corporation on an

appropriate stam p paper of Rs. 100/- (to be provided by the contractor) after

accepting the Letter of Intent and having agreed to and accepted the terms and

condi tions of the tender.

13. No page from the tender documents shall be defaced or detached. Also no correction

in the tender docum ents shall be made by the tenderer. Any comm ents which the

tenderer desires to m ake, shall not be placed on the tender documents, but shall take

the form of a separate s tatem ent, as brief as possible, and giving reference to pages

and clauses of the tender documents.

14. Wherever the tenderer find any discrepancy, om ission, ambiguity or conflict in

or among the documents forwarded or be in doubt as to their meaning and

interpretation; such matter should be called to the attention of the GMDC not later

than 7 days period to the date of submission of tender. On receipt of such quarries

the GMDC/consulting engineers will issue a clarifying bulletin which will also form a

part of the contract. Neither the GMDC nor the Engineer-In-Charge/consulting

engineer will be responsible for any oral instructions.

The rates should be written both in figures and in words. In case of any di fference

between rates in figures and words, the rates in words will prevail.

15. Tenderers must disclose the names of their partners , if any, in the particular

contract. Any tenderer failing to do so will render him self liable to have his earnest

m oney deposit forfeited and the contract, if entered into, cancelled at any tim e during

its currency.

16. If it is found that two or more persons who are connected with one another

either financially or as principal and agent or master and servant have tendered

under different nam es for the sam e contract without disclosing their connections,

then such tenders will be rejected and the earnest money deposit shall be forfeited.

Any contract entered into under such condi tions is also liable to be cancelled.

17. In case the tenderer is a joint stock company, the contract must be affixed with

the seal of the company in the presence of witnesses and signed by two Directors or

by persons duly authorized to sign the contract for the com pany under a power of

attorney. The tenderer shall produce a certified copy of such power of attorney at the

time of making the agreem ent.

18. The tenderer must fill in all blank spaces in the form of tender and sign in long

hand as and where shown and scan the sam e. Only the principal authorized to make

the contract, should sign the tender, and execute the contract on behal f of the

tenderer.

19. The tenderer must be very careful to deliver a bonafied tender. Such a tender

m ust propose any other condi tion than those laid down in this Document.

20. Any tender who proposes al terations to any of the condi tions lay down, or

which proposes any other conditions of any description whatever is liable to be

rejected.

21. Incomplete tenders are liable to be rejected

22. The tenderers are required to visit the site along with the E-tender copy, to study the

actual working condition before submitting the offer.

23. All the rates quoted by the tenderer must be inclusive of all taxes, service tax, duties,

turn over tax etc.

24. The tenderers are requested to send along with the tender the solvency certificate

(form at attached) for Rs.20 Lacs (Twenty Lacs), which would not be older than one

year from any Nationalised Bank, ICICI, IDBI, AXIS, HDFC Bank

SPECIAL NOTES

1. If rates of current taxes, Sales tax/ duties , sales tax, service tax, VAT etc undergo any revision during contractual com pletion date, the sam e shall be allowed as statutory variation. However i f any variation take place after contractual date of com pletion, the same shall not be allowed, even if delayed are accepted by bidder.

2. No statutory variation shall be adm itted, if current taxes, Sales tax/ duties, sales tax,

service tax, VAT etc become payable because of exceeding the prescribed lim it for turnover of the tenderers after the date of offer.

3. Date of comm issioning shall be reckoned within 120 days from date of issue of Letter of

Intent.

4. Security deposit will be refunded on demand after successful completion of Contract.

5. Other term s and conditions of the tender shall be read and considered as a part of the tender documents.

6. The rates/prices quoted by the bidders will be final and any sort of escalation will not be

considered.

7. Clarifications/queries if any by the bidder should convey by Fax/ E-Mail well in advance

before 2 days of due date as mentioned in Tender Notice.

8. These are to be com plied by the tenderers, in case thei r tender is accepted.

9. Submission of tender will be the conclusive evidence that the tenderer has fully satisfied himself as to the nature and scope of the work to be done, site conditions, and

all other factors affecting the performance of the contract and the price and also as to the term s and condi tions of the contract.

10. The tender notice along with the tender documents as detailed together with any

other documents as may be hereafter mutually agreed to by the parties, will form the contract agreements referred to above.

11. Wherever the tenderer find any discrepancy, omission, ambiguity or conflict in or

among the documents forwarded or be in doubt as to their meaning and interpretation; such m atter should be called to the attention of the GMDC LIMITED not later than 7 days prior to the date of submission of tender. 12. The tenderer is expected to quote rate for each item after careful analysis of the cost involved for the execution and perform ance of each item considering all the condi tions

of contract and the speci fications. In case it is noticed that the rates quoted by the tenderer for any i tem are unusually high or low it will be sufficient cause for the rejection of the tender unless the GMDC LIMITED/ engineer incharge is convinced about the reasonableness of the rates on scrutiny of the analysis for such rates to be furnished by the tenderer on dem and.

13. The rates should be written both in figures and in words. In case of any difference between rates in figures and words, the rates in words will prevail.

ANNEXURE : B

TO RUN 50M3 /HR RO PLANT ON

BOOM (BUILD, OWN, OPERATE & MAINTAIN Gujarat Mineral Development Corporat ion Limited [GMDC], a Government of Gujarat

Enterprise has setup a 2x125 MW Akrimota Thermal Power St ation near Village: Chher Nani,

Taluka: Lakhpat, Dist: Kutch. The Site details are enclosed at Annexure: 1.

.

1.0 OVERVIEW OF 50 M3/Hr. SEA WATER BASED REVERSE OSMOSIS PLANT :

GMDC had set up 50m3/hr capacity Reverse Osmosis Plant at Akrimota Thermal Power Plant

(2x125MW) to meet service wat er requirement in the year of 2001-02. This plant is supplied by M /s.

S.R. Paryavaran Engineers (P) Ltd., Chandigarh-160002 (U.T.). This plant use sea wat er, which is

available at Kori Creck in Kutch district for feeding to the plant.

The water treatment scheme is broadly divided into four parts namely Primary Treatment,

Secondary Treatment, R.O. Unit and Post treatment. The process has been carefully selected keep ing

in view the high level of BOD, COD,TDS and Suspended Solids present in the feed wat er. The

plant takes into consideration the advantages of aerobic process for removal of BOD and COD, the

presence of which is highly undesirable in any water treatment plant.

Thus the sea water is collect ed in a collection sump where adequate buffer storage time is provided before being pumped for further treatment. The Primary treatment st arts with the water being taken

into a Clariflocculator which is provided with slow speed mixing agitators , stilling well and a s ludge

removal system at the bottom. The poly-electrolyte dosing is carried out by means of dosing pumps

prior to entry of sea water into the clariflocculator. The clariflocculator helps in removal of

suspended solids. It also reduces the BOD load by 15-20%. The clarified overflow is the n taken into

aeration chamber for aerobic biological oxidation of the remaining organics.

This elaborate treatment consists of biological oxidation process using ext ended aeration activated

sludge process where microorganisms help in oxidising the organics with oxy gen supplied by means

of diffused aeration system.

In the aeration chamber high MLSS (mixed liquor suspended solids) concentration representing

micro-organism population is maintained. Any deficiency in the Nutrient cont ent to support the

microorganism is generally made up with Urea and DAP addition. The overflow from the aerat ion

chamber passes on to a secondary clarifier where all the susp ended solids are settled and clear liquid

over flows the weir system int o a launder and is discharged into the outlet pipe for collection into a

buffer storage tank namely the Filter Feed Sump. The settled solids in t he clarifier are mostly

recycled back into the aeration chamber to maint ain the high MLSS concentration. A small amount

of excess s ludge is generat ed in beds are provided with a filter bed which consist of pebbles of various siz e. The semi dried sludge is disposed off as manure and the water from the bottom is

recirculat ed back to the collection sump.

The clarified wat er from the filt er feed sump is fed into a battery of pressure sand filters where

remaining suspended solids are remove. Prior to pressure sand filt er provision is made for

chlorination of the feed wat er for disinfection and removal of pathogenic bacteria etc. A battery of

activated carbon filters are provided after the sand filters for final removal of odour, BOD slipages

and removal of chlorine which is detrimental for the reverse osmosis membrances. Sodium

bisulphite dosing station is provided as a back up for chlorine removal.

This filt ered water is stored in a t ank for final treatment through reverse osmosis unit. A set of R.O.

feed pumps are provided to maintain adequate inlet pressure in the main high pressure R.O.

pressuriz ing pump group which consists of multi stage centrifugal pump, motor and energy recovery

turbine. Before the passage of wat er int o the pressurizing pump acid dosing and antiscalant dosing

for maintenance of pH inhibition of scaling is carried out. The inlet of pressuriz ing group is also

provided with a battery of security cartridge filt ers with absolutely clean wat er for desalination in the

reverse osmosis membrances. The pressurizing pump group feed the battery of R.O. membrances at

a very high pressure of approximat ely 70 bars thus ensuring production treat ed w ater i.e. permeat e of

desired quality. The reject water thus generated having high pressure and dissolved solids is fed in to the energy recovery turbine where reduction in motor power consumed is achieved before being

finally discharged int o sea. The post treatment consists of pH correction of the treat ed water before

being stored for use. If long term storage of water is envisaged t hen adequate chlorination as an

option may be used.

Time schedule for operationalizing the facility.

Within 120 days from the date of issue of LOI with the help of getting GMDC input (raw water at its outlet and electricity free of cost) you will produce treated water as described in the

Scope of Work.

Penalty for not achieving the time schedule:

In the event of your inability to commission and op erationalize the facility, you will have to

bear the cost of difference between the charges agreed to by you and actual cost incurred for

obtaining w ater by other means / sources.

Recovery of the Plant

You shall produce treated wat er at least 40 to 50 % of the raw water made available by us.

Penalty for less recovery of treated water

If the output of treated water is less than 40 % of the raw water in that case, we shall charge

you for the cost of electricity and raw water.

Contract Period:

The span of contract period shall be for a period of 10 years from the date of commencement

of the contract i.e. on delivery of the treated water.

Price Escalation:

. Maximum price escalat ion shall be to the extent of One Re.1 per m3 per y ear on the basic

price quoted by the Contract or for entire contract period

Production of Treated Water:

You shall produce Minimum 400 m3 /Day of treated portable w ater solely for end use by

GMDC. This is granted intake by GMDC. If necessary and advised by site .you need to produce 800m3/Day minimum.

Penalty for shortfall in the output

If you produce less than 400 m3 per day then shortfall shall be made good by sourcing by us

the deficit quant ity from any other sources and in that case entire amount of deficit quantity of water

purchased from elsewhere shall be reimbursed by you to GMDC.

Special Note:

The t enderers are request ed to ensure personally vis iting the Site to acquaint and familiarize

themselves with the act ual site conditions and the equipments etc. Only after having p ersonally

visited and insp ect ed the conditions they may fill up the t ender or submit their bids based on their

own assessment of the existing and prevalent s ite conditions.

Other Terms and Conditions:

1. GMDC shall provide raw water and electricity free of cost during the entire contract

period to run the Plant and shall charge extra for supplying electricity and raw wat er for

any other purpose.

2. Before st art-up of regular production of treat ed wat er GMDC shall not be responsible for

any cost incurred by the contractor such as manpower, material, chemical and other

consumable items and shall be your sole responsibility to make all such arrangements.

3. Contractor shall not make any change in the reject water circuit. Contactor should

discharge the reject wat er in the sea as per instruction from the Engineer-in-Charge of

GMDC.

4. The Contractor shall be solely responsible to abide by any statutory requirements as

regards Pollution Control, compliance with labour laws and any other mandatory

requirement right from the date of commencement of regular production till sat isfactory

completion / expiry of the contract.

5. Pre-treatment of raw water will be necessary and it is in the scope of contractor to ensure

effective and essential pre-treatment of the raw water.

6. All dosing, cleaning, preservat ion chemicals, lubricants, oil and consumable items for

R.O. Plant shall be in t he scope of the Contractor.

7. The Contractor shall from time to time apply anti-corrosive paints etc. t o ensure

healthiness of the R.O. Plant and its accessories.

8. Electrical power other than for operation of t he Plant, service and other job works at Site for utilizing GMDC facilities like Workshop etc. shall be provided by GMDC on

chargeable basis which shall be reimbursed against invoice.

9. To provide Hydronomic Membranes for first t ime only is in the scope of t he GMDC.

10. Laboratory t esting facilities for wat er analysis of the treated water produced from the R.O.

Plant shall be made available by GMDC.

11. GMDC being a Government Organization, it is not possible to create any mortgage of

Plant, Machinery etc. 12. Contractor shall not raise any finance or funding by mort gaging any plant, machinery,

accessories of the R.O. Plant.

13. At the end of the Contractor, Contractor shall hand over the R.O. Plant to GMDC in

healthy and good working condition.

14. The Contractor shall furnish complet e list of man-power engaged by him.

15. The Contractor shall maintain and up date from time to time comprehensive details of the

man-power engaged by him and also shall get renewed labour licence, pollution control

etc. certificat es.

FORM OF TENDER (BID FORM)

Examined the Tender Documents compris ing of Tender Notice, Instructions to

Tenderers, Form of Tender, Articles of Agreement, I/We the undersigned, offer to execut e the

works specified in the aforesaid documents and shall complete the same within the time limit

specified therein, in conformity with the said tender documents.

Should this tender be accepted, I/We agree:

That I/We shall abide by and fulfil all the terms and provisions of the conditions

contained in the aforesaid documents which have been read by me/us and explained to me/us,

so far as applicable or in default thereof to forfeit and pay to the GMDC or their successors

the sums of money mentioned in the said documents.

I/We shall execute all the works referred to in the said documents upon the terms and

conditions cont ained or referred to therein at the rat es contained in the aforesaid documents or

at such other rates as may be fixed under the provis ions of these conditions and also to carry

out such other works or items of works, as may be ordered on me/us , which are not cont ained

in the aforesaid documents at the rat es cont ained in the aforesaid documents or at such other

That the amount which has been deposited by me/us as earnest money, the full value of

which is to be absolutely forfeited to the GMDC or their successors, should I/We fail to

commence the works specified or should I/We not deposit the full amount of security deposit specified in the aforesaid documents, in accordance with the said Condit ions of Contract,

otherwise the said amount shall be retained by the GMDC as on account of such security

deposit as provided for in the aforesaid documents.

We undertake, if our t ender is accepted, to commence the works within 15 days of

receipt of the GMDC's order to commence, and to complete and deliver the whole of the

works comprised in the contract within the time limits specified in the tender notice/LOI

calculated from t he date of issue of LOI/work order to commence the work/letter of intent plus

15 days mobilization period or from the date of handing over of the site, whichever is later.

We agree to abide by this tender for the period of 150 days from the last dat e fixed for

receiving the same and it shall remain binding upon us and may be accepted at any time

before the exp iration of that period. Unless and until a formal agreement is prepared and

STATUTORY COMPLIANCE OF LABOUR LAWS

Statutory compliance of the Labour Laws on the part of the Contractor is as under:

1.0 The contractor shall at his own cost comp ly with the provision of labour laws, rules, orders

and not ifications whether central or stat e or local as applicable to him or to this contract from

time to time. These Acts/Rules include wit hout limit ation of the following.

2.0 Contractor shall be solely responsible and shall fully comply with all the provis ions of all the

labour laws applicable such as the Minimum Wages Act, 1948, Payment of Bonus Act 1965,

Employees Provident Fund and Miscellaneous Provision Act 1952, Industrial Dispute Act

1947, Workmen Compensation Act 1923, Payment of Gratuity 1972, Int erst ate M igrant

Workmen Act 1979, Equal Remuneration A ct with Rules, Order and Notifications

issued/made there under from time t o time.

3.0 All other Acts, Rules / Byelaws, Orders, Notificat ions et c. present or future applicable to the

Contractor from time to time for performing the contract job.

3.1 The Contractor shall provide and be responsible for payment of Wages, Salaries,

Bonus, Social charges, Insurance, Food, Accommodation, Transport, Medical and

Canteen facilities and ot her statut ory privileges and facilities to his personnel per

law/rules/regulations and orders of the Central Government, St ate Government, Local

Authorit ies or other authorities as are in force from time to time. All employees of

the Contractor shall be employee of the Contractor.

3.2 The Contractor shall have a valid licence obtained from Licensing Authority under the

Contract Labour (Regulation & Abolition) Act 1970 at the time of execution of the

contract covering all his employees working at ATPS sit e and furnish the same, failing which GMDC may terminate the contract at its sole discretion.

3.3 The Contractor shall at the time of execut ion of the contract have an EPF Code

Number obtained from the Authorities concerned under the Employees Provident &

M iscellaneous Provis ions Act, 1972 and remit contributions in respect of the

employees employ ed by him at ATPS Sit e to the P.F. office concerned every month,

failing which GMDC will recover from the outstanding p ayment to the contractor from

GMDC.

3.4 The Contractor shall maintain all records/registers required to be maintained by him

under various Labour Laws mentioned above and produce the same before the

St atutory Authorit ies whenever required.

3.5 The Contractor shall also submit periodical reports / returns to the various stat utory

authorities such as the Contract Labour (Regulation and Abolit ion) Act, 1970,

Employees Provident Fund Act etc. under intimation to P&A Deptt.

3.6 The Contractor shall not pay less than the Minimum Wages notified by the

Government from time to t ime to his employees of corresponding categories.

3.7 The Contractor shall be responsible for payment of overtime wages to his workmen, if

any, in case they are required to work beyond the prescribed hours under law as per

applicable rates.

3.8 The contractor shall take Workmen Compensation Insurance Policy for all his employees working at ATPS. The contractor shall indemnify the company against any

liability due to any work injury or accident to any of its employ ees.

3.9 The Contractor shall in t he event any of his workmen / employ ees sustains any injury

or disablement due to an accident aris ing out of and in the course of his employment,

provide necessary medical treatment and pay compensation as applicable, required

under the Workmen’s Compensat ion Act, 1923.

3.10 If any of the persons engaged by the Contractor misbehave with any of the officials or

the Company or commit any misconduct with regard to the property of the Company

or suffer from any serious communicable disease, the Contractor shall replace them

immediat ely.

3.11 The Contractor shall not engage / employ persons below the age of 18 years.

Employment of women shall be strictly according to applicable laws.

3.12 GMDC will have right to deduct and disburse the claims of the individual / part ies

being a princip al employ er on any account whatsoever in relation to their employment

with the contractor. The Security deposit will be released to t he contractor at the end of

the contractual t enure subject to an undertaking by the contractor that in the event any

of his workmen or the heirs of workmen puts up a claim for recovery of money due to

him from the contractor before the appropriat e authority under the I.D. Act 1947 or

under any other labour laws or for compensation under the Workmen’s Compensat ion

Act, 1923 and the appropriate authority has given a direction for making payment the

contractor will meet the same or indemnify GMDC if in the event GMDC pays it as

Principal Employer.

3.13 The contractor shall make payment of wages to his employees on fixed date within the

period specified under the applicable Law, in presence of representative of the

3.14 The Contractor shall provide Safety items / kits to his employees such as safety shoes,

goggles , ear plug, hand gloves, safety belts et c., if any, required under t he law.

3.15 The contractor shall conduct pre-induct ion and periodic medical check up of his

workmen as per applicable laws.

This list is indicat ive in nature and not an exhaustive one. Any

amendment/alteration/Notifications or addit ion to the existing Law or a new statute shall

automatically become applicable.

TAX LAWS

CONTRACTOR TO ABIDE BY FOLLOWING TAX LAWS:

(a) General Taxes: The Contractor shall be responsible for and shall pay out of his own,

moneys, all taxes, dues, fees, ceases, octroi and charges payable to Central or State

Governments or dues payable on material purchased by him or constructional plant provided

by him for the works, and on all materials brought by him on the s ite and used for the works

and shall indemnify the purchaser against any liability on account of any such taxes , dues,

fees, cess, octroi and charges.

(b) Income-Tax: The Contractor and his employ ees shall bear and pay all Income-Taxes,

corporate and p ersonnel, super tax or any other Indian tax as may be pay able by him on the

amounts payable to him under the contract. If for any reason whatsoever the purchaser is

called upon to pay in respect of the Contractor’s or his employees income, any income-t ax,

supert ax, or any tax under Income-t ax Act or any tax under any other law in force in India,

then the Contractor shall be bound and liable to reimburse and pay to the Purchaser the

amount of such tax so paid by the purchaser and the Contractor shall further agrees that the

Purchaser will also be entitled to recover and reimburse to himself the amount of such tax out

of the fees, remunerat ion or any other sum pay able by him to the Contractor under the

Contract.

(c) Taxes in respect of Workmen:

The Contractor shall provide and maintain workmen’s compensation insurance coverage to

provide compensation benefits in the event of injury of employ ees in the course of work

under the contract. Liability under the Workmen’s Comp ensation Act :

(I) The Contractor shall at all times identify the Purchaser against any claims which may be

made under the Workmen’s Compensat ion Act, 1923 or any statutory modificat ion thereof or

otherwise for or in respect of any damages or compensation payable in consequence of any

accident or injury sustained by any workman or other person whether in the employment of

the Contractor or not.

(II) Liability under the employee’s Stat e Insurance Act 1948: Where t he Contract is in connect ion

with the Purchaser’s work office coming under the purview of the Employee’s State

Insurance Act, 1948, the Contractor shall make necessary deduct ion from the monthly

emoluments of his staff employed on the Contract at the prescribed rat e and remit the

aggregat e amount monthly to the Purchaser together with t he Employ er’s (Contractor’s) contribut ion as required under the Act and toget her with the st andard form duly filled in as

required under t he Act.

(III) Liability under the Employees Provident Fund Act, 1951: Where the contract is in connect ion

with the purchaser’s works office coming under purview of the employees provident Fund

Act, 1951, the Contractor shall make necessary deduction from the monthly emoluments of

his staff employed on t he Contract at the prescribed rate and remit the aggregat e amount

monthly to the purchaser together with the Employ er’s (Contractor’s) Contribution as

ANNEXURE : I

Instructions to Bidder and General Terms & Conditions of Contract

1. SYNOPSIS

GUJARAT M INERAL DEVELOPMENT CORPORATION LIM ITED (GMDC) is having 2 x

125 MW Lignit e based power p lant located near Village Nani Chher, Taluka Lakhpat, and

District Kutch. GMDC has its own lignite mines for t he power plant. The plant is based on

Circulating Fluidized Bed combustion technology for the boilers where lignite is burnt along with limestone in the furnace of the boiler and turbine is based on KN series machine. The raw

water for various processes is obtained from sea and treated to get wat er of different qualit ies

suit able for different services including CW system, De-salination plant, Fire hydrant system,

DM Plant etc.

2.0 APPROACH TO SITE

2.1 AKRIMOTA THERMAL POWER STATION (ATPS) is accessible by road from Lakhpat and

Dayapar on the Bhuj-Lakhpat Coastal Highway. The sit e is located 2 kms away on the west side

of Lakhp at-Narayan Sarovar road. From Lakhpat, the sit e is around 15 km away while from

Dayapar the same is around 40 kms. The nearest broad gauge railway station is at Bhuj, which is

around 150 kms. From the power plant. Bhuj is also the nearest airport which is presently

connect ed t o M umbai by air. The nearest sea port is Kandla which is around 220 km away from

the plant s ite.

2.2 The site is 15.0 mt. Above MSL.

The weather is hot & humid. Corrosive oxides of Sulphur & Chlorides are present in the coastal

saline atmosphere. The average rainfall is 350 mm only.

Water scarcity is generally exp erienced in this area from June to August. The area is also prone

to draughts for sustained time up to 4 to 5 years.

2.3 ACKNOWLEDGEMENT OF NOTICE INVITING TENDER AND CLARIFICATION:

1. Bidder is requested to intimat e GMDC as soon as possible their willingness t o bid.

2. In case of any clarification on Tender, the BIDDER shall approach GMDC in writing by fax,

email or by letter and GMDC will provide the information required in writing. However,

failure to receive any addendum or clarification shall not relieve the BIDDER of any of

the obligat ions stipulated in the Tender. Any amendments made to TENDER shall be

intimated to the bidder by E-mail or post/fax.

3. The BIDDER will acquaint himself with the conditions / limitations and official

regulations under which or conforming to which the services are to be performed and

should carefully examine all the informat ion as may be furnished to them in writ ing

from time to time. Failure to comply with above requirement will not relieve the

BIDDER of his obligations in the event of his BID being accepted. Unless otherwise

specifically stated in the BID, it will be assumed that all terms and conditions of TENDER

are accepted by the BIDDER without any reservat ions.

3.0 GENERAL INSTRUCTIONS

3.1 The bid shall be submitted electronically only.

3.2 The owner may, at its discretion, extend the deadline for the submission of the bids by

amending the Bidding Documents in accordance with Clause 5.3 in which case all rights

and obligations of the owner and bidder previously subject to the deadline will thereafter be

subject ed to deadline as ext ended.

3.3 Bidder shall bear all costs associated with the prep aration and delivery of its bid, and the

owner will, in no case, be responsible or liable for these costs.

3.4 In the event that the successful bidder is a joint venture formed of two or more companies,

the Owner will require that all the parties to the joint venture accept joint and several

liabilit ies for all the obligations under the contract.

3.5 Modificat ion & Withdrawal of Bids

3.5.1 The Bidder may modify or withdraw its bid after Bid’s submission, provided that such

modification or withdrawal is received in writing by the owner, prior to the deadline for

submission of bids.

3.5.2 The Bidder’s modification or withdraw al notice shall be prepared, sealed, marked and

dispat ched so as to reach to the owner before the deadline prescribed for submission of bid.

A withdrawal notice may also be sent by fax but must be followed by a s igned confirmat ion

copy.

3.5.3 No Bid shall be modified subsequent to the deadline for submission of bids .

3.5.4 No Bid may be withdrawn in the int erval between the deadline for submission of bids and

expirat ion of the period of bid validity specified by the bidder on the bid form.

4. ELIGIBILITY CRITERIA

Eligibility criteria, prescribed for the specific tender, are mentioned in the t ender not ice and

also in the t ender documents. Bids of the Tenderer satisfying the prequalificat ion

requirement, shall only be considered and processed further.

Certain essential requirements of pre-qualification bid are as under:

1. The Bidder should submit EMD in the form of D/D, as specified for the tender, by

post/courier.

2. The bidder should submit solvency certificate for the amount prescribed in the Tender

document.

3. The bidder should possess valid P.F. Number. Without PF Number, bid shall be rejected.

4. The Bidder should enclose P.F. code allotment letter along with Labour Licenses and W.C.

Policy copies of previous order.

5. The Bidder has to submit PAN Number of the firm. Copy of the same t o be submitted.

6. The Bidder has to submit Service tax registrat ion number. Copy of the same to be submitted.

7. The bidder should have exp erience of Operation and maint enance(O&M ) to run RO plant

of minimum cap acity of 50M3 /HR round the clock (continuous) for a period of one year. .

8. Bidder should have Exp erience staff in varies skills with minimum two year exp erience. .

9. Must visit the site before quoting the tender for site familiarization.

5. BID DOCUMENTS

5.1 The Bidder is expected to visit the Power Plant sit e and make his own assessment

regarding the quantum of work and facilities available at sit e and satisfy himself

about all the uncert ainties prior t o submitting his offer.

5.1.1 The Bidder is exp ected to examine all instructions, forms, t erms and specificat ion in the Bid

Document. Failure to furnish all information required in the Bid Document or submission of a

Bid not substantially responsive to the Bid Documents in every respect may result in reject ion

of the Bid.

5.2 Clarification of bidding Documents

5.2.1 Prospective bidders requiring any further information or clarificat ion of the bidding

documents may notify the owner in writing or by telex or email or by fax at the owners

mailing address indicated in the invitation to bids. The owner will respond in writ ing to

request for information or clarification of the bidding documents which it receives not later

than fifteen (07) days prior t o the deadline for the submission of bids prescribed by the owner.

The owner’s response (including an explanat ion of the query) will be sent in writing or by

telex or cable to all prosp ect ive bidders who have received the bidding documents.

5.3 Amendments of bidding documents

5.3.1 At any time prior to the deadline for submission of bids , the owner may, for any reason,

whether at its own initiative or in response to a clarification requested by prospective

bidder, modify the bidding documents by amendment.

5.3.2 In order to afford prospective bidders reasonable time in which to take the amendment into

account in preparing their bids, the owner may, at its discretion, extend the deadline for the

submission of bids.

6. LANGUAGE OF BID

The bid prep ared by the bidder, and all correspondence and documents relating to the bid

exchanged by the bidder and the owner, shall be written in the English language. Any

printed lit erature furnished by the bidder may be written in another language provided that this lit erature is accompanied by an English translation, in which case, for purpose of

interpretation of the bid, the English translat ion shall govern.

7. TIME SCHEDULE

7.1 The basic considerations and the essence of the contract shall be the strict adherence to the

time schedule for performing the specified ‘works’.

8. EARNEST MONEY DEPOSIT (EMD)

An EMD of Rs. 5,00,000/-- (Rs. Five Lac only ) as prescribed in the tender document shall

accompany with bid. The EMD shall be in the form of:-

An A/C payee Demand Draft in favour of M/s GUJARAT MINERAL DEVELOPMENT

CORPORATION LTD.- Ahmedabad of any Nat ionalized Bank or AXIS, IDBI, HDFC,

and ICIC Bank in favours of GMDC Limit ed.

8.1 SECURITY DEPOSIT CUM PERFORMANCE BOND

The successful BIDDER shall have to submit security deposit of 10% of contract value in the

form of Bank Guarantee to GMDC within 10 days of issue of letter of intent and said Bank Guarant ee will retuned on demand after successful completion of contract.

9. SUBMISSION OF BIDS

The bids shall be submitted electronically only.

10. SIGNATURE OF BIDS

10.1 The bid must contain the name, residence and place of business of the person or persons

name of t he all persons signing should also be typed or printed below the signature.

10.2 Bid by a p artnership firm must be furnished with full names of all partners and be s igned the

partnership name, followed by the s ignature and designation of one of the authoriz ed

partners or other aut horized represent ative(s).

10.3 Bids by a corporation/ company must be signed with the legal name of the corporation /

company by the president, Managing Director or by the Secretary or other person or persons

authorized to bid on behalf of such corporation / company in the matter.

10.4 The bidder’s name stat ed on the proposal shall be the exact legal name of the firm.

Bidder should clearly indicate along wit h details called in the bid, the plant where he has

undertaken s imilar work as also certificat es from clients.

12. UNDERSTANDING AND CLARIFICATION ON DOCUMENTS AND

SPECIFICATION

The Bidder is required to carefully examine the specifications and documents and fully

confirm himself as to all the condit ions and matters, which may in any way, affect the

“works” or the cost thereof. If any Bidder finds any discrepancies in the sp ecifications and

documents or is in doubt as to the true meaning of any part, he shall at once request in

writing for any interpretation/clarification to the Techno-commercial bid or seek

clarification during the techno commercial discussion. Bidders are advised to vis it the

power plant, ascertain the quantum of work – before preparing and submitting the Bid.

All such interpretations and clarificat ions shall form a part of the specification and

documents and accompany the Bidder’s proposal.

13. PAYMENTS

The payment to the Bidder shall be released in Indian Rupees by A/c payee cheque only.

14. PO LICY FOR BIDS UNDER CONSIDERATION

14.1 Bids shall be deemed to be under considerat ion immediately after they are opened and until

such time official intimation of award/rejection is made by the owner to the Bidders. While

the Bids are under consideration, Bidders and/ or their representative or other interested

parties are advised to refrain from contacting by any means, the Owner and/ or his

employ ees. The Engineer, if necessary, will obtain clarification on Bids by request ing for

such information from any or all the Bidders, in writing as may be necessary. The bidder

will not be permitted to change the price or substance of the Bid after the deadline

prescribed for submission of the bids .

14.2 Evaluation of technical Bids

14.2.1 All responses to requests for clarifications shall be in writing and shall be present ed to the

owner in a sealed envelope on or before the due date requested by the owner. If the

Technical clarification sought by the owner do not reach the Owner on or before the due

dat e, the bid will be rejected.

14.2.2 After all the technical bids have been evaluated, the bidder will be called for techno-

commercial discussion if required. Based on technical discussion, if required, those bidders

whose Technical Bids have been accepted wit h some modifications may be given some t ime

to submit their revised price bids in a sealed envelope (solely at the discretion of GMDC) to

reflect the change agreed/made to their technical bids.

14.2.3 The original price envelopes (bids) will not be returned if the revised bids are called.

Whenever Bidder deviates from the specificat ions the same shall be listed out in the

“Schedule of deviation” attached. Only those deviations, which are list ed in this Annexure,

shall be considered. Deviation indicat ed elsewhere will be rejected.

16. INSURANCE

The Bidders insurance liabilit ies pert aining to the scop e of “Works” are detailed in Clause

title Workmen’s Compensation Insurance in General Conditions of Contract (GCC). The

Bidder’s attention is specifically invited to these clauses. Bid price shall include all the cost

in pursuance of fulfilling all the insurance liabilities under the ‘Contract’.

17. OPENING OF BIDS

17.1 Bids will be opened electronically in 2 stages.

17.2 Preliminary Examination

17.2.1 The Owner will examine the Bids to determine whether they are complet e, whether any

comput ational errors have been made, whether required sureties have been furnished, whether

the documents have been properly signed and whether Bids are generally in order.

17.2.2 Arithmet ical errors will be rectified on the following basis. If there is difference between the

unit price and the total price that is obtained by multiplying the unit price and quantity, the

unit price shall prevail and the tot al price will be corrected. If there is discrepancy between

the Total Bid amount and the sum total, the sum total prices shall prevail and the Tot al Bid

Amount will be correct ed.

17.3 Policy for Price Bid Under Consideration

Price bids shall be deemed to be under considerat ion immediat ely aft er they are op ened and

until such time official intimation of award/rejection is made by the owner to the bidders.

While the price bids are under considerat ion, Bidders and/or their representatives or other

interested part ies are advised t o refrain from contacting by any means, “Employ ees of the

Owner” on matter related to the bid. GMDC will obtain clarification on the price bid by

requesting for such information from any or all t he bidders, in writing as may be necessary.

The bidders will not be permitted t o change t he subst ance of the price bid after the price bid

has been opened.

18. EFFECT AND VALIDITY OF BID

18.1 The submission of any bid connected with these documents and specifications shall constitute

an agreement that the bidder shall have no cause or act ion or claim, against Owner for

rejection of his bid. The Owner shall always be at liberty for reject or accept any bid or Bids

at his sole discretion and any action will not be called into action and Bidder shall have no

claim in t his regard against the Owner.

18.2 The Bid shall be kept valid for acceptance for a period of One Hundred and Fifty days (150)

calendar Days from the date set for opening of the Bids.

In case any Bidder quotes a lower validity period than called for above, his offer shall be

liable for rejection.

19. EVALUATION AND COMPARISON OF BIDS

19.1 General

19.1.1 The Bids received and technically accepted will be evaluat ed by the Owner to ascertain the

lowest evaluated bid in the int erest of the Owner, for the complete ‘Order’ covered under

these specifications.

19.1.2 The comparison of all the Bids shall be carried out with reference to similar scope of work as

per the technical specification. Any deviation/omission shall be evaluat ed at highest quoted

price of the deviation/omission quoted by any of the Bidder. In case a separate price (for

omission) is not given by any other Bidder, a reasonable price of the same shall be

considered.

19.2 Definition and Meanings

For the purpose of t he evaluat ion and comparison of bids the following meaning and

definitions will apply:

(a) “Bid Price” shall mean the price quot ed by each Bidder in his proposal for the complete

scope of order.

(b) “Differential Price” shall mean the summation of the equalizing elements of price while

evaluating the Bids for deviat ion and deficiencies in the Bidders proposed equipment as

per the guidelines mentioned in this “Instruct ion to Bidders” and the relevant “Technical

Sp ecificat ion”.

(c) “Evaluated Bid Price” shall be summation of Bid Price and Differential Price.

20. AWARD OF CONTRACT

20.1 Letter of Intent/Letter of Award will be sent in form of Fax/ Mail/ Speed Post to the

successful Bidder by the Owner and the date of issue of any of these communications will be

treat ed as date of commencement of the Order unless otherwise mentioned.

20.2 The order will be awarded to the technically and commercially best qualified and responsive

Bidder offering the lowest evaluated bid in conformity of the requirement of the

specifications of the document. A responsive Bid is one which accepts all the t erms and

conditions of the specificat ions and documents without any major modifications. A major

modification is one which affects in anyway the prices, quality, quantity or which limits in

any way the responsibilit ies or liabilities of the Bidder or any right of the owner as required

under specifications of documents. However, the Owner may waive any minor informalit ies

or irregularities in the Bid. Where there are item rates to be quoted by the Bidders for the

unforeseen works which are not t aken into consideration for evaluat ion, the lowest responsive

Bidder will be required to accept the lowest rates offered by other Bidders. This will be pre-

condition for award of the work to the lowest responsive Bidder.

20.3 CONTRACT PERFORMANCE GUARANTEE

� As a contract Security, the successful Bidder, to whom the work is awarded, shall be required

to furnish a security Bank Guarantee from any nationaliz ed Bank acceptable to GMDC in the

form attached in tender in favour of the Owner or alt ernat ively by D.D. in favor of GMDC, ATPS within 7 days from dat e of award of contract. The guarantee amount shall be equal to

ten percent (10%) of the ‘Contract Price’ and it shall guarant ee the faithful performance of the

‘Contract’ in accordance with the terms and conditions specified in these documents and

specifications. The guarant ee shall be valid for the entire period of the ‘Contract’. The

Guarant ee amount shall be payable to the Owner in Bidder’s home currency without any

condition whatsoever.

� The Security Bank Guarantee / cash security deposit will be returned / refunded to the

Vendor/Contractor wit hout any interest on complet ion of work order period and complet ion

of defect liability period.

II. GENERAL TERMS AND CONDITIONS OF CONTRACT

1. CONTRACT PERIOD

The total duration will be Ten years from the commencement of ATPS site.

2 QUOTING THE RATES

Rate quoted shall be inclusive of all current taxes /duties, service tax, VAT, Royalty and

levies . If rat es of current taxes, Sales Tax /dut ies , service t ax, VAT etc undergo any revis ion during contractual completion date, the same shall be allowed as statutory variation. However

if any variation takes place after contractual date of completion, the same shall be allowed, if

it is accepted by GMDC. No statutory variation shall be admitted, if current taxes, sales

tax/duties, sales t ax service tax, VAT etc become payable because of exceeding the

prescribed limit for turnover of the tenders after the date of offer.

3. TERMS OF PAYMENT

GMDC shall make payment as under.

R. A. bill will have t o be submitted on claim by every month along with check list as p er

Annexure – I and thereafter the payment shall be made from GMDC, ATPS within 30 days as

per following.

-80% p ayment will be released from GMDC, ATPS within 15 days.

-20 % Payment will be released from ATPS after approval from HO within 15 days.

4. RECOVERY CLAUSE

i) In case of any damage of equipments/machinery due to negligence of contractor or any

other reasons attributed to contractor the decision of Engineer-In-Charge regarding the

amount of recovery shall be final and binding. Recovery will be affect ed from monthly

bills and/or retention money/security deposit. The recovery will at the look value plus

20%.

5. ASSIGNMENT AND SUBLETTING OF THE CONTRACT

The contractor shall not assign or sublet any part of the contract to any other party or agency.

With written consent of GMDC HO. Ahmedabad

6. DEDUCTION FROM CONTRACT PRICE

All costs, charges or an expense, which GMDC may have paid for which, under the contract

the Contractor, is liable, will be claimed by GMDC. All such claims shall be paid by the

contractor within 15 days failing which the same shall be deduct ed from the contract or’s bills.

7. TERMINATION OF THE CONTRACT

GMDC may terminate the contract aft er due recoveries of pending jobs/damages after giving

15 days not ice to the Contractor, if any of the following event occurs.

i. Contractor is adjudged as insolvent.

ii. Contractor has abandoned the contract.

iii. Contractor fails to proceed with t he work with due diligence as per the requirements of

the contract. iv. Contractor has neglected or failed persist ently to observe or perform any of the acts,

matters or things, which as per the contract are to be observed and performed by the

contractor.

v. Any major contradiction of applicable labour laws.

8. SETTLEMENT OF DISPUTES

Any dispute or difference between parties arising out of the contract to the ext ent possible

shall be amicably settled between the parties. If amicable settlement cannot be reached, all

disput ed issues shall be resolved t hrough arbitration, according to the provisions of Indian

Arbitration Act, 1996. The place of arbitration and jurdiction shall be at Ahmedabad.

Work under the contract shall be continued by the contractor during arbitration proceedings

unless GMDC shall order suspension thereof or any part thereof in writing or unless the

matter in such work cannot possibly be continued unless the decis ion of the Arbitrat ion

proceedings is obtained.

FORCE MAJEURE CONDITIONS

Neither you nor GMDC shall be considered in default if execut ion of order is

prevent ed or delayed because of force majeure conditions which include flood, earth

quake, natural calamity, lightning, war, hostility, terrorism, rebellion, civil mutiny,

commotion, riots, accidents, fire, exp losion, epidemic, change in law / permits,

revolution, act of Government, Court Orders, Civil commotion, strike, embargo on

export to India, acts of God, strikes, lock outs or difficulties which have mass impact

etc. Should one or both the parties be prevent ed from fulfilling their act ual obligat ion

by a state of force majeure lasting cont inuously for six weeks, the two part ies should

consult each other regarding further execution of Contract and confirm the same in writing.

The contractor shall not be responsible for any loss or damages of Plant and Equipment including

entire facility due to force majeure conditions during the operation p eriod of the Contract.

INTERPRETATIION OF CLAUSE

In case of disputes as regards int erpretation of any of the clause or specificat ion, the decis ion

of General Manager (Power Project), GMDC will be final and binding on the contractor.

9. WORKMEN’S COMPENSATION INSURANCE

The Contractor shall take all Risk Insurance Policy to cover all his workmen, staff applicable

under the Workmen’s Comp ensation Act, 1923 or any amendment thereof, as also insurance

cover for t hird party liability. The Contractor shall keep GMDC indemnified from all

liabilities arising out of his act ion in pursuance in this contract. The W.C. Policy should be

obtained from Kutch region Jurisdict ion and shall be ass igned to GMDC.

10. STATUTORY REQUIREMENTS

The Contractor has to fulfill the statutory compliance of labour laws as Prescribe in

tender

a) The contractor shall be solely responsible for any accident to his workers and should

adhere to all the rules / regulations as per Labour law of Government and other stat utory

laws as applicable.

b) The Contractor should regist er himself under the Contract labour Act, Workmen’s

compensation Act and PF Act (Code No. to be mentioned) and submit the copy of

registration certificate and should possess the same from the dat e of commencement of

work, failing which the contract is liable to be cancelled. The W.C. Policy copy should

be submitted to GMDC prior to commencement of work and labour license should be

obtained within One week from the dat e of issue of Form-V. a copy of Labour license

shall be submitted to GMDC, P&A Department.

c) Contractor will have to insure his workmen/ supervisor under the group insurance

scheme, so that there will not be any problem aft er any accident and it may also cover

the liability under the Workman Comp ensation Act.

d) The Contractor will be responsible for compliance of all statutory rules , regulation, act

enforced from time t o time framed by the Government, Such as factory Act, Workmen

Comp ensation Act, Payment of ‘Wage Act’, minimum Wages Act, Provident Fund Act ,

Payment of Bonus Act, Labour Law Act in respect of employ ees engaged by him for the

work and shall have to maintain necessary records. In case any amount becomes due to

be payable by him or his employees or to the Government under the above rules,

regulat ions, acts, GMDC reserves the right to recover the same from him and pay to the

concerned employee.

e) Documentary evidence of deposit of PF paid in preceding month shall have to be

produced by the contractor along with the monthly RA Bill of succeeding month.

f) Records as per the provisions of various statutory acts will have to be maintained by the

contractor and submitted as and when required.

g) All Contract ors’ employees should maintain due discipline and resp ect local sentiments.

GMDC reserves the right to direct the Contractor in respect of such persons who do not

comply above requirement.

11. Other Terms and Conditions:

1. GMDC shall provide raw water and electricity free of cost during the entire contract

period to run the Plant and shall charge extra for supplying electricity and raw wat er for

any other purpose.

2. Before st art-up of regular production of treat ed wat er GMDC shall not be responsible for

any cost incurred by the contractor such as manpower, material, chemical and other

consumable items and shall be your sole responsibility to make all such arrangements.

3. Contractor shall not make any change in the reject water circuit. Contactor should

discharge the reject wat er in the sea as per instruction from the Engineer-in-Charge of GMDC.

4. The Contractor shall be solely responsible to abide by any statutory requirements as

regards Pollution Control, compliance with labour laws and any other mandatory

requirement right from the date of commencement of regular production till sat isfactory

completion / expiry of the contract.

5. Pre-treatment of raw water will be necessary and it is in the scope of contractor to ensure

effective and essential pre-treatment of the raw water.

6. All dosing, cleaning, preservat ion chemicals, lubricants, oil and consumable items for

R.O. Plant shall be in t he scope of the Contractor.

7. The Contractor shall from time to time apply anti-corrosive paints etc. t o ensure

healthiness of the R.O. Plant and its accessories.

8. Electrical power other than for operation of t he Plant, service and other job works at Site for utilizing GMDC facilities like Workshop etc. shall be provided by GMDC on

chargeable basis which shall be reimbursed against invoice.

9. To provide Hydronomic Membranes is in the scope of the GMDC.

10. Laboratory t esting facilities for wat er analysis of the treated water produced from the R.O.

Plant shall be made available by GMDC.

11. GMDC being a Government Organization, it is not possible to create any mortgage of

Plant, Machinery etc.

12. Contractor shall not raise any finance or funding by mort gaging any plant, machinery,

accessories of the R.O. Plant.

13. At the end of the Contractor, Contractor shall hand over the R.O. Plant to GMDC in

healthy and good working condition. 14. The Contractor shall furnish complet e list of man-power engaged by him.

15. The Contractor shall maintain and up date from time to time comprehensive details of the

man-power engaged by him and also shall get renewed labour licence, pollution control

etc. certificat es.

12 Time schedule for operationalizing the facility.

Within 120 days with the help of getting GMDC input (raw water at its outlet and electricity

free of cost) you will produce treated water as described in the Scope of Work.

13 Penalty for not achieving the time schedule:

In the event of your inability to commission and operationalize the facility, you will have to

bear the cost of difference between the charges agreed to by you and act ual cost incurred for

obtaining water by other means / sources.

14 Recovery of the Plant

You shall produce treated water at least 40 to 50 % of the raw water made available by us.

15 Penalty for less recovery of treated water

If the output of treated water is less than 40 % of the raw water in that case, we shall charge

you for the cost of electricity and raw water.

16. Contract Period:

The span of contract period shall be for a period of 10 years from the date of commencement of the contract i.e. on delivery of the treated water.

17. Price Escalation:

M aximum price escalat ion shall be to the extent of One Rs. per m3 per year on the

basic price quoted by the Contractor for entire contract period

18. Production of Treated Water:

You shall produce Minimum 400 m3 /Day of treated portable w ater solely for end use by

GMDC. This is granted intake by GMDC. If necessary and advised by site .you need to produce

800m3/Day minimum.

19. Penalty for shortfall in the output If you produce less than 400 m

3 per day then shortfall shall be made good by sourcing by us

the deficit quantity from any other sources and in that case entire amount of deficit quantity of

water purchased from elsewhere shall be reimbursed by you to GMDC.

20 GENERAL CONDITIONS

1) Contract or shall deposit 10% of contract value towards Security Deposit (non interest-

bearing) within 15 days on getting LOI.

2) EMD may be adjusted into Security Deposit (non-int erest bearing). Balance amount of Security

Deposit to be paid by Demand Draft. The Security Deposit also can be submitted in form of

Bank Guarantee as given.

3) Contractor will observe all safety and security Rules & Regulations of GMDC which are

presently in force and which may come into force during the t enancy of the contract. Any

violation of these rules & regulations will ent ail immediate t ermination of the contract.

4) No property of the GMDC in the area belonging to GMDC shall be tempered with. In case of default, the damage as assessed by the authoriz ed officer whose assessment shall be final and

binding to the contractor, shall be payable by the contractor

5) The contractor has to t ake group insurance policy for their workmen. The contract or has to submit

labour license and PF account number t o the Engineer In Charge before st art the work.

6) All the scrap generated should be disposed off at the scrap yard or any other designated place as

instructed by Engineer In Charge.

7) Contractor shall have to follow all the safety requirements / rules & regulations / norms and legal

provisions laid down in various statutes . Particularly the provis ions of the Factories Act-1948 &

Gujarat Stat e Fact ories Rules-1963 (Amended up to date) shall be followed strictly. The

contractor shall also obey the rules / regulat ions / instructions of the local competent Authority for

safety requirements. You shall be responsible for any injuries , damages, of accidents that may

cause to you / your persons or materials during execution of the work inside or outside the power

house premises . Contractor has to arrange sufficient quantity of PPE’s like safety helmets, Safety

belts, Safety shoes, safety goggles, dust mask, ear plug/ ear M uffs, hand gloves, Safety Dress ,

Aluminium suit et c. Failing this the Engineer In Charge is authoriz ed to remove any person(s) or

machinery(s) if felt as safety hazard. If the contractor repeatedly violates safety rules / regulations

Engineer In Charge may take necessary action against the contractor.

21 Contract Price:

The rates shall be valid for entire contract for ten years and firm throughout the contract

period. The quoted rates shall be firm and Maximum price escalat ion shall be to the ext ent of

One Re. per m3 per year on the basic price quoted by the Contractor for entire contract period.

Price and rat es quoted shall include cost of all consumables (except free issue of electric supply

to run plant and Raw Water by GMDC) labour, sup ervis ion, tools and tackles, transport, taxes,

octroi, local taxes and levies if any et c. and such other cost as are not sp ecifically mentioned

herein but will be incurred by the contractor for the sat isfactory and timely completion the

work.

30.The contract period will be 10 years. if the performance is not found satisfactory then the

contract may be terminated at any time.
