Gabay sa Sapilitang Pagsaklaw ng SSS sa mga Kasambahay

Noong ika-1 ng Setyembre 1993, sa ilalim ng Republic Act (RA) No. 7655, sinimulang ipatupad ang sapilitang pagsaklaw ng Social Security System (SSS) sa mga kasambahay. Kasama ring inihahayag sa ilalim ng Section 9 “Coverage” ng RA No. 8282 o ang Social Security Act of 1997, ang sapilitang pagsaklaw sa mga kasambahay.

Lalo pang pinagtibay ang misyon ng SSS na makapagbigay ng proteksiyon sa mga kasambahay nang isabatas noong ika-18 ng Enero 2013 ang RA No. 10361 (An Act Instituting Policies for the Protection and Welfare of Domestic Workers) o ang mas kilalang “Batas Kasambahay.”

Nakasaad sa Implementing Rules and Regulations (IRR) ng “Batas Kasambahay” ang pagpapatupad ng tinatawag na “unified system of registration and enrollment” para sa mas madali at mas mabilis na pagrerehistro ng household employers at mga kasambahay sa SSS, sa Philippine Health Insurance Corporation (PhilHealth), at sa Home Development Mutual Fund (Pag-IBIG), kung saan ang mga kasambahay ay sakop ng tatlong ahensiyang ito ng gobyerno.

Sino ang tinatawag na “kasambahay”?

Ang kasambahay ay ang sinumang gumagawa ng trabahong pantahanan at tumatanggap ng sahod para sa naturang mga serbisyo.

Guidelines in Compulsory SSS Coverage of House Helpers

On September 1, 1993, Republic Act (RA) No. 7655 was enacted into law, making mandatory the coverage of house helpers under the Social Security System (SSS). Under RA No. 8282 or the Social Security Act of 1997, Section 9 on “Coverage” likewise stated the mandatory coverage of house helpers.

This goal of the SSS to provide social protection to house helpers was further boosted by the passage into law on January 18, 2013 of RA No. 10361 (An Act Instituting Policies for the Protection and Welfare of Domestic Workers) or more popularly known as the “Domestic Workers Act.”

Under the Implementing Rules and Regulations (IRR) of the “Domestic Workers Act,” a unified system of registration and enrollment was required to make easier and faster the registration of house helpers and their household employers with the SSS, the Philippine Health Insurance Corporation (PhilHealth), and the Home Development Mutual Fund (Pag-IBIG), under which house helpers are mandatorily covered by these three government agencies.

Who are called “house helpers”?

A house helper is any person who renders domestic or household services and receives compensation for such services.

Sino ang tinatawag na “household employer”?

Ang household employer ay ang sinumang gumagamit ng serbisyo ng isang kasambahay. Bilang patakaran, ang asawang lalaki o ang kanyang asawang babae, o ang sinumang nagbabayad ng sahod para sa naturang mga serbisyo, ang siyang itinuturing na household employer.

Ano ang “domestic” o “household services”?

Ang “domestic” o “household services” ay mga natatanging gawain sa bahay ng household employer na dapat gawin ng kasambahay, kasama ang iba pang mga gawaing maaaring iutos ng household employer para maging maayos ang tahanan at maging magaan ang pamumuhay ng miyembro ng kanyang pamilya, kagaya ng mga serbisyo ng babysitter/nursemaid o yaya, hardinero, tagaluto, labandera, at mga kahalintulad nito.

Ano ang “household”?

Ang “household” ay ang mga pangunahing miyembro ng pamilya ng household employer, kabilang ang mga naninirahan sa tahanan na direktang binibigyan ng serbisyo ng kasambahay.

Who are called “household employers”?

A household employer is any person who uses the services of a house helper. As a rule, the husband or wife or any other person who actually pays the compensation for such services shall be deemed the household employer.

What are domestic or household services?

Domestic or household services are specialized jobs or activities done in the home of a household employer by a house helper or domestic worker such as a maid, babysitter or nursemaid, gardener, cook, laundry woman, and similar workers. These include chores and services required by the household employer for the upkeep and maintenance of his or her home and for the comfort and convenience of his or her family and its members.

What is a household?

A household is composed of the primary family members of a household employer, including other people living in the same house, to which the house helper provides direct services.

What is the Kasambahay Unified Registration System or KURS?

Pursuant to the requirement under the IRR of the “Domestic Workers Act,” the Kasambahay Unified Registration System (KURS) is a program wherein the

Ano ang dapat gawin ng household employers at mga kasambahay sa pamamagitan ng KURS?

Ang household employers at mga kasambahay ay mamimili na lamang kung saang opisina ng SSS, PhilHealth, at Pag-IBIG nila gustong magpunta para mabigyan ng membership numbers. Sa pamamagitan ng KURS, ang household employers at mga kasambahay ay makakukuha ng membership numbers at masasakop ng tatlong ahensiya gamit lamang ang isang pormularyo.

Saan maaaring kumuha ng unified forms?

Ang unified forms ay maaaring makuha sa alinmang sangay o opisina ng SSS, PhilHealth, at Pag-IBIG, o kaya i-download sa sumusunod na website: www.sss.gov.ph, www.philhealth.gov.ph, at www.pagibig.gov.ph. Ang unified forms ay ang sumusunod:

What should the household employers and house helpers do via KURS?

The SSS, PhilHealth, and Pag-IBIG shall provide registration services and membership numbers to household employers and their house helpers, regardless of which agency they choose to register with. Through KURS, household employers and house helpers will be issued their membership numbers and covered under the three agencies using just one form.

Where can one get the unified forms?

The unified forms are available in all the branches and service offices of SSS, PhilHealth, and Pag-IBIG or may be downloaded from the following websites: www.sss.gov.ph, www.philhealth.gov.ph, and www.pagibig.gov.ph. The unified forms are the following:

Sino ang mga saklaw ng programang ito?

Lahat ng mga kasambahay na hindi pa higit sa 60 taong gulang at tumatanggap ng buwanang sahod na hindi bababa sa P1,000.00 ay sapilitang saklaw ng SSS. Ito ay simula pa noong Setyembre 1, 1993 nang ipatupad ang RA No. 7655.

Who are covered under this program?

SSS coverage shall be compulsory upon all household helpers who are 60 years old and below and receiving a monthly compensation of at least P1,000.00. This has been in effect since September 1, 1993 with the enactment of RA No. 7655.

When is the effectivity date of the coverage of house helpers?

Anu-ano ang dokumentong dapat isumite kasama ng PPS-KUR Form?

Para sa SSS, kailangang isumite kasama ng PPS-KUR Form ang orihinal o certified true copy at photocopy ng isa (1) sa sumusunod na pangunahing dokumento, upang matiyak ang tamang pangalan at petsa ng kapanganakan ng kasambahay:

1. Birth certificate mula sa Philippine Statistics Authority (dating National Statistics Office)

2. Baptismal certificate mula sa simbahan

What are the documents to be submitted with the PPS-KURS Form?

For SSS, the forms to be submitted with the PPS-KURS Form are the original or certified true copy and photocopy of one (1) of the following primary documents to ensure the correct-ness of the name and birth date of the house helper:

1. Birth certificate issued by the Philippine Statistics Authority (formerly National Statistics Office)

2. Baptismal certificate issued by the parish church

3. Driver’s license4. Passport5. Professional Regulation Commission card6. Seaman’s book

In the absence of primary documents, any two (2) of the following secondary documents showing the house helper’s name and birth date may be submitted:

1. Birth or baptismal certificate of house helper’s child

2. ATM card bearing the cardholder’s name

3. ATM card and certification from the bank stating that the account number belongs to the cardholder, if name does not appear on the card

Kung walang pansuportang dokumento na maisumite ang kasambahay, maaari pa rin ba siyang mabigyan ng membership numbers kapag nagparehistro?

Oo. Siya ay mabibigyan pa rin ng SS Number subalit mamarkahan ng “No Document Submitted” ang naturang SS Number sa kompyuter rekord ng SSS.

Ano ang ibig sabihin ng markang “No Document Submitted” sa membership status?

Ang SS Number na may markang “No Document Submitted” sa membership status ay maaari lamang magamit upang ang kasambahay

In the absence of any supporting documents during registration, will the house helper still be given a membership number?

Yes. The house helper will still be given SS Number, but that number will be tagged in the SSS computer records as “No Document Submitted.”

What does a “No Document Submitted” mark in a membership status mean?

The SS Number marked with a “No Document Submitted” membership status can only be used for the household employer’s report

ay maireport sa SSS ng kanyang household employer bilang empleyado at para sa pagbabayad ng buwanang kontribusyon sa SSS. Ang markang ito ay mawawala lamang kapag ang kasambahay ay makapagsumite na ng kaukulang dokumento. Sa pagkakataong ito, siya ay maaari nang mapagkalooban ng kanyang Unified Multi-Purpose Identification (UMID) card o ng mga benepisyo at pribilehiyo bilang miyembro ng SSS, kung kuwalipikado na siya sa mga ito.

Paano makakapagparehistro ang isang household employer sa pamamagitan ng KURS?

Kailangan lamang punan ng household employer ang isang kopya ng Household Employer Unified Registration Form (PPS-HEUR1 Form) at isumite ito sa alinmang sangay o opisina ng SSS, PhilHealth, at Pag-IBIG para mabigyan ng tatlong Employer ID numbers: SS Number, PhilHealth PIN, at Pag-IBIG MID Number o RTN. Isa lamang sa mga ahensiyang nabanggit ang kailangang puntahan ng household employer upang siya ay mabigyan ng Employer ID numbers.

Ano-ano ang dokumentong dapat isumite kasama ng PPS-HEUR1 Form?

Kung mismong ang household employer ang magsusumite ng PPS-HEUR1 Form, wala nang hihingin pang anumang pansuportang dokumento.

Subalit kung ang pagpaparehistro ay sa pamamagitan ng authorized

What documents should be submitted with the PPS-HEUR1 Form?

No supporting documents are needed to be submitted with the PPS-HEUR1 Form if the household employer will personally submit the form.

However, if the household employer will send a representative

Anu-ano ang mga dokumentong dapat ilakip sa SS Form R-1A at SS Form L-501?

What supporting documents should be submitted with SS Forms R-1A and L-501?

No supporting documents need to be submitted with the SS Forms R-1A and L-501 if the household employer will personally submit them at any SSS branch or service office.

Maaari bang sabay-sabay na isumite ng household employer ang SSS Forms R-1A, L-501, at PPS-HEUR1?

Oo. Maaaring isumite ng household employer ang SS Forms R-1A, L-501, at PPS-HEUR1 nang sabay-sabay kapag nagparehistro ito sa alinmang sangay o opisina ng SSS.

Subalit kung nagparehistro na siya sa PhilHealth o Pag-IBIG, kailangan pa ring magtungo ng household employer sa SSS upang isumite ang SS Forms R-1A at L-501 kung saan nakasaad ang SSS Household Employer ID Number.

Magkano ang kontribusyong dapat bayaran ng household employer at ng kasambahay sa ilalim ng “Batas Kasambahay”?

Sa ilalim ng “Batas Kasambahay,” kung ang kasambahay ay kumikita sa isang buwan ng mas mababa sa P5,000.00, sasagutin ng household employer ang buong buwanang kontribusyon sa SSS.

Subalit kung ang kanyang buwanang sahod ay P5,000.00 o higit pa, ibabawas dito ang kaukulang bahagi ng kasambahay sa kontribusyon sa SSS. Ito ay buwanan ding ibabayad sa SSS ng household employer kasabay ng kanyang kaukulang bahagi sa kontribusyon.

How much is the contribution to be paid by the household employer and house helper under the “Domestic Workers Act”?

Under the “Domestic Workers Act,” if the house helper is earning a monthly salary of less than P5,000.00, the household employer will shoulder the entire SSS monthly contribution.

But if he/she is earning a monthly salary of P5,000.00 or more, the house helper’s share will be deducted from the salary. The household employer will remit this to SSS together with the employer share for the monthly contribution.

Bukod sa SSS, kailangan ding bayaran ng household employer ang kontribusyon para sa Employees’ Compensation, na ang kasalukuyang halaga ay P10.00 kada buwan para sa mga sumasahod ng mas mababa sa P14,750.00, at P30.00 para sa sumasahod ng P14,750.00 o higit pa.

Ilang porsiyento ng sahod ang dapat ihulog bilang kontribusyon sa SSS?

Simula Enero 2014, ang bahagi ng isang kasambahay sa kontribusyon sa SSS ay katumbas ng 3.63% ng MSC, samantalang ang kaukulang bahagi ng kanyang household employer ay 7.37%, para sa kabuuang 11% ng MSC.

Paano at kailan dapat bayaran ang buwanang kontribusyon sa SSS ng kasambahay?

Ang kontribusyon ay buwanang ibabayad ng household employer sa SSS o sa anumang akreditadong collection partners (bank o non-bank) sa pamamagitan ng pagsumite ng electronic Contribution Collection List (e-CCL) na nagtataglay ng Payment Reference Number (PRN). Ito ay maaaring ma-generate sa pamamagitan ng pag-log-in sa My.SSS ng SSS Website. Ang deadline sa pagbabayad ng kontribusyon ay ayon sa sumusunod:

Aside from SSS, the household employer must also pay the Employees’ Compensation contribution, which is currently set at P10.00 per month for those earning a salary below P14,750.00 and P30.00 for those earning above P14,750.00.

What percentage of the monthly salary is the SSS contribution based on?

Starting January 2014, the SSS contribution rate is 11% of the MSC. The house helper’s share for the SSS contribution is equivalent to 3.63% of the MSC, while the household employer’s share is 7.37%.

When and how to pay the house helper’s SSS monthly contribution?

To pay the monthly contribution, the household employer must submit to the SSS or any accredited collection partners (bank or non-bank) the electronic Contribution Collection List (e-CCL) containing the Payment Reference Number (PRN). This may be generated by logging-in to the My.SSS facility of the SSS facility of the SSS website. The contribution payment deadlines are as follows:

Halimbawa: Kung ang Household Employer ID Number ay 80-12345678-000, ang deadline sa pagbabayad ng kontribusyon at maging ng mga pautang para sa naaangkop na buwan ng Marso ay sa ika-25 ng Abril.

Kung ang deadline sa pagbabayad ay natapat sa Sabado, Linggo, o national holiday, maaaring magbayad sa susunod na araw na may pasok. Kung hindi makapagbabayad sa nakatakdang petsa, papatawan ng kaukulang multa ang kontribusyon at pautang ng household employer.

Saan maaaring magbayad ng kontribusyon?

Maaaring magbayad ng kontribusyon ng kanilang kasambahay ang mga household employer gamit ang kanilang PRN sa alinman sa sumusunod na payment channels: SSS Tellering Counters, Bank Collection Partners, at Non-bank Collection Partners.

For example: If the Household Employer ID Number is 80-12345678-000, the payment deadline for both the contribution and even loan payments for the applicable month of March is on the 25th of April.

In case the payment deadline falls on a Saturday, Sunday, or a national holiday, payment may be made on the next working day. Otherwise, penalties shall be imposed on late contribution and member loan payments.

Where to make payments?

Household employers may pay the SSS contributions of their house helpers using their PRN through any of the following payment channels: SSS Tellering Counters, Bank Collection Partners, and Non-bank Collection Partners.

Kailan at paano irereport sa SSS ang mga ibinayad na kontribusyon?

Sa implementasyon ng Real-Time Processing of Contributions (RTPC) simula ika-16 ng Enero 2018 ay sabay na sa pagbabayad ng kontribusyon ang pagrereport nito.

Pagkabayad ng kontribusyon gamit ang e-CCL na nagtataglay ng PRN, maaari nang makita agad-agad ang kahuhulog lamang na kontribusyon.

Kapag umalis na ang kasam-bahay sa kanyang household employer, maaari ba niyang ipagpatuloy ang pagbabayad ng kontribusyon sa SSS?

Oo. Ang kasambahay na umalis na sa kanyang household employer ay maaaring ipagpatuloy ang pagbabayad ng kanyang kontribusyon sa SSS bilang boluntaryong miyembro, sa halagang katumbas ng 11% ng MSC.

Mahalaga ring ipaalam ng household employer sa SSS sa pamamagitan ng pagpuno ng SS Form R-1A, ang petsa kung kailan umalis ang kasambahay sa paninilbihan. Ito ay para masiguro na hindi na niya pananagutan ang mga kontribusyon ng kasambahay sa hinaharap.

When and how to report SSS contribution payments?

With the implementation of the Real-Time Processing of Contributions (RTPC) starting January 16, 2018, contribution payment is already simultaneous with its reporting.

Upon payment of contribution using the e-CCL containing the PRN, the contribution can now be viewed as it posted instantly.

If the house helper’s employment has been terminated, can he/she continue paying for his/her SSS contributions?

Yes. If the house helper’s employment has been terminated, he/she can continue paying for the monthly SSS contributions as a voluntary member at a total rate of 11% of the MSC.

It is also important that the household employer inform SSS, by indicating in the SS Form R-1A the separation date or when the house helper left his/her employ. This will ensure that the household employer is no longer made liable for future SSS contributions on behalf of the house helper.

What actions can be taken if an employer failed to fulfill his/her obligations?

The household employer can be sued for violating two laws—one under the “Domestic Workers Act” and the other under the Social Security Act of 1997.

What is the status of family drivers?

Although family drivers are not covered under the IRR of the “Domestic Workers Act,” they are still covered by the SSS as household employees, pursuant to the provisions of the Labor Code of the Philippines, RA No. 7655, RA No. 8282, and SSS Circular No. 21-V.

What SSS form should a family driver use?

For initial SSS membership, the family driver should use the

Ang mga household employer na dating nagbayad ng kontribusyon ng kanilang kasambahay gamit ang personal nilang SS Number ay binigyan na ng mga Employer ID Number upang makatiyak na ang bayad sa mga kontribusyon at utang ay mailalagay sa tamang rekord. Ang Employer ID Number na ibinigay ng SSS ang siyang dapat gamitin ng household employer sa lahat ng transaksiyon na may kinalaman sa kasambahay.

Personal Record Form (SS Form E-1) to register and get an SS Number.

If the household employer has not registered yet (without Household Employer ID Number) and there is no other household employee other than the family driver, the form to be used is the Employer Registration (SS Form R-1).

However, if the household employer is already registered, the SSS-issued Household Employer ID Number will be used in reporting the family driver as an employee by filling up the SS Forms R-1A and L-501.

What ID Number will the household employer use to remit contributions of the house helper?

Household employers who previously paid contributions for their house helpers using their personal SS Numbers were provided with Employer ID Numbers to ensure proper posting of contribution and loan payments. This SSS-issued Employer ID Number is to be used by the household employer in all transactions involving the house helper.
