Private Golf Cars Club management receives questions on privately owned golf cars regularly. Here are some basic rules about HOA use and golf course use. 1. All golf cars must be registered with the HOA

TREES AND BRANCHES The tree project on the golf course is intended to be a two year project. Our focus in the first year is to create higher canopies on the golf course side of holes to create air and sun for the golf course and restoring playability of the design. There are many trees that will not be touched. Many dead trees will be removed but not all this year. Since Monday when the project started we have had numerous calls and emails about trees overhanging onto resident’s property. These are not part of the project or planned in work for the future.

THE SKIVVY The club has overhanging limbs towards resident’s properties and they drop all sorts of branches, pine straw and leaves. This is a great opportunity to talk a little bit about Florida’s overhanging tree law. Overhanging tree law has been a subject of a Florida Supreme Court case and the result of that ruling is summarized herein.

Here is the answer on that which is when a limb crosses your property from your neighbor’s side (see shade yellow area below); those limbs belong to the resident. A tree on your neighbor's side of the property may cross the property line and overhang your property which makes that part of the tree your property. You own the rights to the property line and anything inside that line. You don't own it any further than the property line. As limbs cross the property line it becomes the resident’s property and their choice to trim the tree at their cost. There is no requirement of your neighbor to cut limbs that belong to the property owner.

Certainly a resident can trim anything that is on their property under potential guidelines of the HOA. Please know and understand that a tree company or you cannot enter upon another private property without permission. In the case of a golf course tree, the HOA requires anyone doing work upon the HOA property to gain authorization and provide a certificate of insurance. Prior to doing any work; it is highly recommended that you hire a licensed and certified arborist and contractor to perform the work on your behalf as to protect your safety, property, liabilities and the health of the tree. The club is trimming hundreds of trees to which there are only a very few that will require permitting. That is step 2 of this initial phase as some Grand Oaks need to be trimmed or in some cases cut down for safety, health and damages to the course.
