SECTION - I

NNOOTTIICCEE IINNVVIITTIINNGG TTEENNDDEERR

1.1. Sealed, Superscribed tenders in two parts are invited by Oushadhi Research & Development Society, Oushadhi Compound, Kuttanellur P.O, Thrissur-680014 (herein after referred to as Client for brevity) from competent suppliers with sound technical & financial capabilities for Design, supply, erection, testing and commissioning of Air compressor with all accessories for Centre of Excellence at Oushadhi. In the case of the tenderer being agents, authorization letter from original equipment supplier to sell/service the equipment shall be furnished along with the bid.

1.2. No tender will be received after the date and time specified in 1.1 above.

1.3 Minimum Qualification Criteria

i. The Tenderer in the same name and style shall have completed at least one work (similar nature consisting of Design, supply, erection, testing and commissioning) of value not less than the amount Rs 6.5 lakh in a single contract or two works of similar nature of value not less than Rs 3.25 lakh in any one year during the last 5 years. The tenderer must give the list of

clients with address and contact numbers to whom he has supplied similar equipments.

ii. In case the tenderer participate in more than one tender, the documents submitted to prove the prequalification criteria along with the tender will be considered for other tenders only if the value of that work exceeds the limit of prequalification criteria of that particular tender.

iii. During evaluation of the tender, tenderer should arrange for the inspection/trial of the machine supplied to their client and if the performance is not satisfactory the tender will be rejected.

iv. Annual turnover of the Tenderer shall not be less than Rs 50 lakhs during any one of the three preceding years.

1.4 Tender documents (non-transferable) can be obtained from the office of The Pharmaceutical Corporation (I.M.) Kerala Ltd. (OUSHADHI), Kuttanellur P.O, Thrissur-680014 during office hours on payment of the price of document by cash / DD in favour of “Oushadhi Research & Development Society” payable at Thrissur. The tender document can also be downloaded from the website viz, www.oushadhi.org or www.kitco.in, and in that case the tender cost shall be furnished in the form of DD along with the tender.

1.5.1 The Tenderer is required to deposit as earnest money deposit (EMD) as specified in 1.1 by crossed demand draft on any scheduled bank in favour of “Oushadhi Research & Development Society” payable at Thrissur valid for a minimum period of 4 months. No interest shall be allowed on the earnest money deposit. Such earnest money will be refunded to the unsuccessful tenderers within 30 days from the date of awarding the contract to the successful tenderer. The earnest money will be forfeited if the tenderer withdraws or modifies his bid during the validity period or if the successful bidder fails to execute an agreement or if the successful bidder fails to remit the security deposit as specified within the time allowed. Any tender which is not accompanied by the EMD is liable for rejection.

Cash or Cheque will not be accepted towards earnest money deposit.

Small scale industries registered with the National Small Industries Corporation (NSIC) for similar supplies shall be exempted from payment of EMD. Bidders seeking exemption should enclose a photocopy of valid registration certificate attested by gazetted officer/magistrate 1st class, giving details such as validity, stores, monetary limit, etc. failing which they run the risk of their bids being considered as ineligible for this concession.

1.6 The tendered rates and amounts shall be written in ink and in English both in figures and in words in the appropriate columns in the bill of quantities. In the case of any discrepancy between the rate and amount, the rate will govern and between figures and words, words will prevail. Alterations or erasures shall be initialed by the tenderer.

1.7 The rates and amounts quoted in the tender shall be all-inclusive and shall cover all taxes and duties like Excise Duty, Sales-tax, Works Contract tax, KVAT and other taxes, octroi and any other duties as applicable. The rates quoted shall be fixed and firm and no escalation or variation shall be allowed during the pendency of the contract.

1.8 If a tenderer seeks to clarify his quotations or rates, this should only be done in a separate covering letter. Material modifications to the specifications, bill of quantities, contract clause, etc. will not be entertained. Other clarifications may be considered. If the contents of the covering letter are to be considered as part of the tender, this should be specifically mentioned by the Tenderer.

1.9 The Techno-Commercial bid of the Tender should be kept open for acceptance for a period of 90 days from the date of opening and the price bid shall be kept valid for a period of 30 days from opening the price bid.

1.10 Sealing and Marking of Bids

Tenders should be submitted in two separate sealed envelopes super scribing name of the work and Tender No.RE 01 KITCO/OUSHADHI/ME/014/2012. Cover – I containing the Techno - Commercial Bid (2 copies) and Cover – II the Price Bid.

Cover – I Techno Commercial Bid should include the following.

i. Tender document complete with all technical details duly signed and stamped on all pages

ii. Earnest Money Deposit as specified

iii. Copy of latest income-tax return

iv. List of previous contracts of similar nature executed by the tenderer along with completion certificates.

v. Certified copy of original partnership deed and certificate of Registration for partnership, Registration certificate in case of proprietary firms and Articles of Association in case of Companies.

vi. Audited Balance sheet and P & L account as proof of turnover.

vii. Documents to establish the qualification as per the eligibility criteria.

Cover – II Price bid shall contain

The Price bid part 1, 2 and bid form in the prescribed format duly filled signed and stamped on all pages.

The tenderers shall seal the two covers in an outer envelope with Cover - I and Cover - II duly marked. The due date of opening and the subject “Tender for Design, supply, testing, erection and commissioning of Air compressor with all accessories for Centre of Excellence at Oushadhi” shall be marked on the outer envelope.

The inner and outer envelopes shall be marked to the following address:

The envelope shall indicate the name and address of the tenderer to

enable the bid to be returned unopened in case it is declared “late”.

If the outer envelope is not properly sealed and marked as required, the Client/the Consultants will assume no responsibility for the tender’s misplacement or early opening. A tender opened prematurely for this cause may be rejected and returned to the Tenderer.

Tender offers received through Telegram or Fax and incomplete tenders are liable to be rejected.

1.11 Technical Bid will be opened in the presence of tenderers or their authorized representatives who are present at the time and date mentioned in the ‘Issue Letter’ Price bids received shall be opened only after evaluating the qualification criteria. The price bids of such tenderers who fulfill the pre-qualification criteria shall be opened after giving due intimation to such tenderers in advance.

1.12 The Client/the Consultants shall not be responsible for any loss, delay or non-receipt of tender document dispatched by post.

1.13 The Client reserves the right to reject or accept any tender either partially or wholly or cancel the tender and in that event invite fresh tenders for the same, without assigning any reasons thereof and the tenderers will not be eligible for any compensation in that event. Subject to the above, the Client will award the contract to the tenderer whose bid has been found to be substantially responsive to the tender requirements and has offered the lowest evaluated bid price

1.14 Letter of Acceptance and Security Deposit

Prior to the expiry of the validity period, the Client will notify the successful tenderer in writing by “Letter of Acceptance” that his tender has been accepted. The contract period will start from the date of receipt of the Letter of Acceptance by the bidder.

Upon acceptance of the tender, the successful tenderer shall within 10 days of receipt of Letter of acceptance of the tender, deposit with the Client 10% of the total contract value as security deposit (the earnest money deposit could be converted as part of the security deposit) in the form of a crossed demand draft in the favour of “Oushadhi Research & Development Society’’ payable at Thrissur. No interest shall be allowed on the security deposit. Any compensation or other sums of money payable by the Contractor to the Client under the terms of this contract shall be deducted from his security deposit or from any sums which may be due or may become due to the Contractor on any account whatsoever and in the event of his security deposit being reduced by reason of any such deductions, the Contractor shall within 10 days thereafter make good in cash or by crossed demand draft any sum or sums which may have been deducted from his security deposit or any part thereof. The security deposit will be refunded to the Contractor within 30 days after the provisional acceptance of the work.

1.15 If the Contractor abandons the work at any stage after commencement of the work, the Client shall have the right to forfeit the security deposit and also take necessary steps against the Contractor to recover from him any loss or damage as assessed by the Consultant/Client for such failure on the part of the Contractor.

1.16 Time of Completion:

Time is the essence of this Contract. The work shall be completed within the period specified in 1.1 after the award of the contract.

1.17 As per Section 194 C of Income-tax Act 1961, the Client will be recovering Income-tax at the rate specified by Government from payments that will be made to the Contractor.

1.18 Payment will be made by crossed and account payee cheques only.

SECTION - 2

GGEENNEERRAALL CCOONNDDIITTIIOONNSS OOFF CCOONNTTRRAACCTT

2.1.0 Definition of Terms

In construing these General Conditions of Contract and the annexedTechnical Specifications and Commercial Terms, the following words shallhave the meanings herein assigned to them unless there is something in thesubject or context inconsistent with such construction.

a. Client/Purchaser/Company

The ‘Client/Purchaser/Company’ shall mean Oushadhi Research &Development Society, Kuttanellur P.O, Thrissur-680014, Kerala or itsauthorized representatives.

b. Consultants

The ‘Consultants’ shall mean M/s.KITCO Ltd., Femith’s, P.B.No. 4407,Puthiya Road, N.H.Bypass, Vennala, Kochi- 682028

c. Tender

The Tender shall mean the tender submitted by the Contractor for acceptanceby the Purchaser.

d. Contractor/Supplier

The ‘Contractor/Supplier’ shall mean the person or company whose tender isaccepted by the Purchaser and shall be deemed to include the Contractor’ssuccessors, heirs, executors, administrators, representatives and assigneesapproved by the Purchaser.

e. Sub Contractor

The ‘Sub-contractor’ shall mean the person or company named in the contractfor any part of the work or any person to whom any part of the contract hasbeen sub-let by the Contractor with the consent in writing of the Purchaserand shall include his heirs, executors, administrators, representatives andassignees approved by the Purchaser.

f. Inspector

The Inspector shall mean any person or persons nominated by the Purchaserto inspect works or stores under the contract.

g. The Goods/Items

The Goods/Items means all the equipments, machinery and/or other materialswhich the supplier is required to supply to the purchaser under the contract.

h. Contract

The Contract shall mean and include the Notice Inviting Tender, Conditions ofContract, Technical Specifications, Commercial terms, Technical data,Schedules, Drawings, Tender offer of the Contractor with covering letter if any,Letter of Acceptance of the Purchaser, Schedule of Quantities, Prices, theFinal General Conditions, any Special conditions applying to the particularcontract, specifications and drawings, subsequent Amendments mutuallyagreed upon, and the Agreement to be entered into under these Conditions ofContract.

i. Contract Price

‘The Contract Price’ means the price payable to the Supplier under theContract for the full and proper performance of its contractual obligations.

j. Services

‘Services’ means services ancillary to the supply such as transportation andinsurance, and other incidental services, such as installation, commissioning,provision of technical assistance, training and other such obligations of theSupplier covered under the Contract.

k. Specifications

The Specifications shall mean the specification annexed to or issued withthese General Conditions \ technical specifications and Drawings attachedthereto, if any.

l. Site

The site shall mean the actual place or places to which themachines/equipments are to be delivered or where work is to be done by theContractor, together with the area surrounding the said place or places as theContractor shall with consent of the Purchaser actually use in connection withthe works, and shall include where applicable the lands and buildings upon orin which the works are to be executed.

m. Tests on Completion

Tests on Completion shall mean such tests which are to be made by theContractor before the Works are taken over by the Purchaser as are providedin the Contract and such other tests as may be agreed upon between thePurchaser and the Contractor.

n. Commercial Use

Commercial use shall mean use of the work or works which the Contractorcontemplates or of which it is to be commercially capable.

o. Dimensions

Dimensions shall mean the extent of a line, area, volume. All dimensionsshall be given in the metric system i.e. for length measurement in kilometres,metres, or millimetres, for surface measurement in square metres, for volumemeasurement in cubic metres, etc.

p. Weight

Weight of a body shall mean the measure of the force of gravity on the body.It shall be given in metric units i.e. in tons (1 ton = 1000kg.), kilograms, gramsand milligrams.

q. Time

Time shall be reckoned in months, days and hours, and the month shall meancalendar month.

r. Letter of Intent/Letter of Acceptance

Letter of Intent/Acceptance shall mean the Purchaser’s letter to the Contractorconveying his acceptance of the tender subject to such reservations as mayhave been stated therein.

s. Writing

Writing shall include any manuscript, type-written or printed statement, underor over signature or seal, as the case may be.

t. Person

Words importing person shall include firms, companies, corporations, andassociations or body of individuals, whether incorporated or not. Wordsimporting the singular only shall also include the plural and vice-versa wherethe context requires.

Terms and expressions not herein defined shall have the same meanings asare assigned to them in the Indian Sale of goods Act (No.III of 1930) failingthat in the Indian Contract Act (Act IX of 1872) and failing that the GeneralClauses Act 1987.

2.2.0 Packing and Marking

2.2.1 The Supplier shall provide such packing of the Goods as is required toprevent their damage or deterioration during transit to their final destination

as indicated in the Contract. The packing shall be sufficient to withstand,without limitation, rough handling during transit and exposure to severeclimatic conditions during transit and open storage. Packing case size andweights shall take into consideration, where appropriate, the remoteness ofthe Goods' final destination and the absence of heavy handling facilities at allpoints in transit

2.2.2 The packing, marking and documents within and outside the packages shallcomply strictly with such special requirements as shall be expressly providedfor in the contract and in any subsequent instruction ordered by thePurchaser.

2.2.3 Each package shall be marked outside to indicate:

Name of the Supplier Details of items in the packages Name of the Consignee Purchase Order Number Gross, net and tare weights of the item Destination address

2.3.0 Inspection of Site

The Contractor or his representative shall be deemed to have inspected andexamined the site and surroundings before submitting his tender and shallobtain the necessary information as to risks, contingencies and othercircumstances which may influence or affect his tender. Whether a tenderervisits the site or not, it will be assumed that a tenderer who submits his tenderis fully aware of the site conditions and difficulties in erecting the work and noclaims under this account will be entertained by the Purchaser at any futuredate.

2.4.0 Quantum of Work

2.4.1 A schedule of approximate quantities for various items accompanies thistender. It shall be definitely understood that the Consultants/Client do notaccept any responsibility for the correctness or completeness of this schedulein respect of items and quantities and this schedule is liable for alteration bydeletions, deductions or additions at the discretion of the Consultants/Clientwithout affecting the terms of the contract.

2.4.2 The Client/Consultants reserves the right to increase or decrease the quantumof work at site without assigning any reason.

2.4.3 Variations in the quantities put to tender will not be the basis of any claim ordisputes. The rates agreed by the contractor shall hold good for any amountof variation in the quantities and no claims whatsoever will be entertained on

this account. The contractor shall carry out all works as directed by theConsultants at the same agreed rates.

2.5.0 Contract

A formal agreement shall be entered into by the Contractor with the Purchaserfor the proper fulfillment of the Contract within 15 days of receipt of the Letterof Acceptance in the prescribed format of the Company.

2.6.0 Application

These General Conditions shall apply to the extent that they are notsuperseded by provisions in other parts of the Contract.

2.7.0 Standards

The items and Services supplied under this Contract shall conform to thestandards mentioned in the Technical Specifications and, when no applicablestandard is mentioned, to the latest current edition or revision of the relevantIndian Standards and Codes.

2.8.0 Security Deposit

If the Contractor is called upon by the Purchaser to deposit ‘Security’ and theContractor fails to provide the security within the period specified, such failureshall constitute a breach of the Contract and the Purchaser shall be entitled tomake other arrangements for the repurchase of the stores contracted for atthe risk and expense of the Contractor and/or to recover from the Contractordamages arising from such cancellation. No claim shall lie against thePurchaser either in respect of interest if any due on Security Deposits ordepreciation in value.

2.9.0 Sub-Letting of Contract

The Contractor shall not, without the consent in writing of the Purchaser/Consultants which shall not be unreasonably withheld, assign or sub-let hiscontract or any substantial part thereof, other than for raw materials, for minordetails, or for any part of the works of which the makers are named in thecontract, provided that any such consent shall not relieve the Contractor fromany obligation, duty or responsibility under the Contract.

2.10.0 Time Schedule

The Contractor shall deliver to the Purchaser a detailed time schedulecovering the various phases involved e.g. shop drawing, procurement,manufacture, assembly, inspection, test, delivery, etc. within 10 days ofacceptance of the order by the Contractor.

2.11.0 Mistakes in Drawing

The Contractor shall be responsible for any discrepancies, errors or omissionsin the drawings and other particulars supplied by him, whether suchparticulars and drawings have been approved by the Purchaser or not. TheContractor shall pay for any extra cost due to any alteration of the worksnecessitated by reason of any discrepancy, error or omission in the drawingsand particulars supplied by the Contractor.

2.12.0 Warranty/Guaranty

The work and items shall be of the best quality and workmanship and shallcomply with particulars of the contract and in all respect shall be to the entiresatisfaction of the Inspector and the Purchaser/Consultants.

Whether or not the items have been installed under his supervision, theContractor shall give the warranty/guaranty in respect of the work to besupplied by him for a period of 12 (twelve) months after the completematerials have been provisionally accepted, the Contractor shall beresponsible for any defects that may be discovered therein notwithstandingthat such defects could have been discovered at the time of inspection or anydefects therein are found to have developed under proper use, arising fromfaulty materials or workmanship or fails to fulfil the performance guarantee orother requirement of the contract and the Contractor shall remedy all suchdefects as aforesaid at his own cost. The Purchaser shall state in writing inwhat respect the goods are faulty and further if in the opinion of the Purchaserthe defects are of such a nature that it is necessary to replace or renew anydefective stores, such replacement or renewal shall be made by Contractorforthwith without any extra costs to the Purchaser provided notice informingthe Contractor of the defects is given by the Purchaser within the period of 12(twelve) months from the date of provisional acceptance. The decision of thePurchaser notwithstanding any prior approval or acceptance of the Inspectoras to whether or not the stores delivered are defective or any defect hasdeveloped within the said period of twelve months or as to whether the natureof defects require renewal or replacement shall be final, conclusive andbinding on the Contractor. For the items replaced, the contractor shall giveguarantee for another six (6) months.

Should the Contractor fail to rectify such defects to the full satisfaction of thePurchaser within a reasonable time, the Purchaser may reject and replace atthe cost of the Contractor the whole or any part of the work as the case maybe which is defective or fails to fulfil the requirements of the contract. Suchreplacement at the cost of the Contractor shall be carried out by the Purchaserwithin a reasonable time with items of the same particulars or when the itemsconforming to the stipulated particulars are, in the opinion of the Purchaser,not readily procurable, such opinion being final, then with the nearestsubstitutes. In the event of such rejection, the Purchaser shall be entitled touse the work in a reasonable manner for a time reasonably sufficient to enablehim to obtain replacement as herein before provided. The Purchaser mayengage any other contractor for carrying out such replacements.

2.13.0 Payment Terms

Payment will be made as per the following Terms:-

2.13.1 20% of the contract price shall be paid as advance within 30 days of signingthe contract and upon submission of a bank guarantee for an equal amountvalid till issue of provisional acceptance certificate.

2.13.2 70% of contract price shall be paid on successful installation andcommissioning and on issuing of provisional acceptance subject to the clause2.14.0 liquidated damages.

2.13.3 Remaining 10% of contract price shall be retained as ‘Retention Money’ tillcompletion of Warranty/Guarantee obligation. However, if the contractor sorequests, the retention money may be released on issue of provisionalacceptance certificate and upon submission of Bank Guarantee acceptable tothe purchaser, for an equal amount valid till the completion of warranty /guarantee obligation.

2.14.0 Liquidated Damages for Late Delivery

If the Contractor fails to fulfill his contractual obligations within the time fixed,he shall be liable at the discretion of the Purchaser to an unconditional andagreed liquidated damages of 1% (one per cent) of contract value per week orpart thereof reckoned on the contract value based on the final bill. TheContractor's liability for delay shall not in any case exceed 10% (ten per cent)of the total contract value. Upon the liquidated damages attaining themaximum value, the Purchaser shall have the right to source the item fromelsewhere at the risk and cost of the contractor.

2.15.0 Inspection and Rejection

The stores shall be offered by the Contractor for inspection at such places asmay be specified by the Inspector, at the Contractor’s own risk, expenses andcosts and shall lie at such places of inspection at the risk of the Contractorand the stores will be subjected to inspection and test as may be considerednecessary by the Inspector and his decision as regards rejection of goodsshall be final and binding on the Contractor.

2.16.0 Deductions from Contract Price

All costs, damages or expenses which the Purchaser may have paid for whichunder the contract the Contractor is liable, may be deducted by the Purchaserfrom any money due or becoming due to the Contractor from the Purchaserunder this contract or may be recovered by action of law or otherwise from theContractor.

2.17.0 Time of Completion and Force Majeure

Should progress of work be delayed by strikes, lockouts, fire, accidents, actsof god, or any cause whatsoever beyond the reasonable control of theContractor, a reasonable extension of time of completion shall be granted.Should one or both parties be prevented from fulfilling their contractualobligations by a state of force majeure lasting continuously for a period of atleast one month, the two parties shall consult each other regarding the furtherimplementation of the contract with the provision that if no mutuallysatisfactory arrangement is arrived at within a period of one month from theexpiry of the one month referred to above, the contract shall be deemed tohave expired at the end of the said one month referred to above. The abovementioned expiry of the contract will imply that both the parties have theobligation to reach agreement regarding the winding up and financialsettlement of the contract.

2.18.0 Death, Bankruptcy, etc.

If the Contractor shall die or dissolve or go into bankruptcy, or being acorporation cause to be wound up except for reconstruction purposes or carryon its business under a receiver, the executors, successors or otherrepresentatives in law of the estate of the Contractor or any such receiver,liquidator, or any person in whom the contract may become vested, shallforthwith give notice thereof in writing to the Purchaser and shall remain liablefor the successful performance of the contract, and nothing aforesaid shall bedeemed to relieve the Contractor or his successors of his or their obligationsunder the contract under any circumstances. The Contract may however be

terminated by the Purchaser at his discretion by notice in writing to theContractor.

2.19.0 Failure and Termination

If the Contractor fails to deliver the stores or any installment thereof within theperiod fixed for such delivery or at any time repudiates the contract before theexpiry of such period, the Purchaser may without prejudice to the right of thePurchaser to recover damages for breach of the Contract.

2.19.1 Purchase or authorize the purchase from elsewhere without notice to theContractor, on the account and at the risk of the Contractor of the stores notso delivered or others of a similar description (where stores exactly complyingwith particulars are not in the opinion of the Purchaser, which shall be final,readily procurable) without canceling the contract in respect of the installmentsnot yet due for delivery, or

2.19.2 Cancel the contract or a portion thereof and if so desired purchase orauthorize the purchase of the stores not so delivered or other of a similardescription (where stores exactly complying with particulars are not in theopinion of the Purchaser, which shall be final, readily procurable) at the riskand cost of the Contractor, if the Contractor had defaulted in the performanceof the original contract, the Purchaser shall have the right to ignore his tenderfor risk purchase even though the lowest.

Where action is taken under sub-clause (i) or sub-clause (ii) above, theContractor shall be liable for any loss which the Purchaser may sustain on thataccount provided the purchase or, if there is an agreement to purchase, suchagreement is made, in case of failure to deliver the stores within the periodfixed for such delivery within two months from the date of such failure and incase of repudiation of the contract before the expiry of the aforesaid period ofdelivery, within two months from the date of cancellation of the contract. TheContractor shall not be entitled to any gain on such purchase and the mannerand method of such purchase shall be in the entire discretion of thePurchaser. It shall not be necessary for the Purchaser to serve a notice ofsuch purchase on the Contractor.

2.20.0 Arbitration

2.20.1 All disputes or difference whatsoever arising between the parties out of orrelating to the construction, meaning and operation or effect of this contract orthe breach thereof shall be settled by the sole Arbitrator appointed by theChief Executive Officer of the Purchaser and the award of such Arbitrator shallbe final and conclusive and binding on all parties to the contract.

2.20.2 The Contractor shall not in any way delay or default or cause to delay ordefault the carrying out of the Works by reasons of the fact that any matterhas been agreed to be referred to and/or referred to Arbitration.

2.20.3 The seat of Arbitration shall be Thrissur and only the appropriate court comingunder the High Court of Kerala will have jurisdiction to entertain all matters oflitigation to the exclusion of all other courts.

2.21.0 Amendments

No variation to the contract shall be valid unless made in writing and dulysigned by both the parties. The Purchaser shall not, in the absence of writtenacceptance, be bound by any provision in the Contractor’s quotation, offers,form of acknowledgement of the contract, invoices, packing lists and otherdocuments which purport to impose any condition at variance with orsupplemental to the Contract.

2.22.0 Law Governing the Contract

This Contract shall be governed by the laws of India for the time being inforce. The marking of all stores supplied must comply with the requirementsof Indian Acts relating to Merchandise marks and all the rules under such acts.

2.23.0 Exercising the Rights and Powers of the Purchaser

All the rights and discretions and powers of the Purchaser under the contractshall be exercisable by and all notices on behalf of the Purchaser shall begiven by the Chief Executive Officer or any person or persons authorized toenter into contracts on behalf of the Purchaser and any reference to theopinion of the Purchaser in the terms and conditions contained in the contractshall mean and be construed as reference to the opinion of any of the personsmentioned in the clause.

2.24.0 Notices

2.24.1 Any notice to be given to the Contractor under the terms of the contract shallbe served by sending the same by post, fax or telegram to or leaving thesame at the Contractor’s principal place of business (or in the event of theContractor being a company to or at its registered office) or at the site.

2.24.2 Any notice to be given to the Purchaser under the terms of the contract shallbe served by sending the same by post to or leaving the same at thePurchaser’s last known address.

2.25.0 Secrecy

The Contractor shall not at any time during the pendency of the contract orthereafter disclose any information furnished to them by the Purchaser or anydrawings, designs, reports and other documents and information prepared bythe Contractor for this contract, without the prior written approval of thePurchaser/Consultants except in so far as such disclosure is necessary for theperformance of the Contractor’s work and service hereunder.

2.26.0 Ownership of Drawings and Specifications

All drawings, specifications, materials and designs furnished by thePurchaser/Consultants or his representatives shall be treated strictly asconfidential property of the Purchaser. All such drawings, specifications,manuals and other materials shall be returned to the Purchaser upon thecompletion of the work under this contract. No copies, duplications orPhotostats shall be retained by the Contractor without the consent of thePurchaser/Consultants.

2.27.0 Jurisdiction

Any legal dispute arising out of or in any way connected with this contractshall be deemed to have arisen at site and shall be settled in court ofcompetent jurisdiction located in Thrissur.

2.28.0 Performance Tests and Provisional Acceptance

2.28.1 On completion of the work, the Purchaser will carry out performance tests onthe items supplied by the Contractor, in the presence of the Contractor.

2.28.2 On the completion of a satisfactory start-up operation, the Purchaser willproceed with the performance tests. The duration of the performance test shallbe one (1) month.

2.28.3 On successful completion of the performance test, the Purchaser will issue theProvisional acceptance certificate to the Contractor. If the system fails toqualify the performance test, the duration will be extended for one month fromthe date of failure of the system and if the Contractor is unable to prove theperformance within this period, the Client shall have the right to procuresimilar equipment from another source at the risk and cost of the Contractor.

2.28.4 The final acceptance certificate will be issued on successful completion of theWarranty/Guarantee period.

2.29.0 Accident or Injury to Workmen

2.29.1 The Contractor shall be solely liable for any accident or injury that mayhappen to any of his personnel engaged in connection with the erection workaccording to the Contract. The Purchaser/Consultant shall not be liable for, orin respect of, any damage or compensation payable at law in respect of, or inconsequence of, any accident or injury to any personnel in the employment ofthe Contractor and the Contractor shall indemnify and keep indemnified thePurchaser/Consultant against all such claims, damages, compensations andproceedings.

2.29.2 The Contractor is the employer of all the worker’s engaged for this work andshould therefore take all required registrations, insurance cover, etc. and paypremium correctly to labour welfare funds constituted by the UnionGovernment and Government of Kerala from time to time.

2.30.0 Compliance with Statutory and Other Regulations

The Contractor shall, in all matters arising in the performance of the Contract,conform at his own expense with the provisions of all Central or State statutes,ordinances or laws and the rules, regulations, or bye-laws of any local or otherduly constituted authority and shall keep the Purchaser/Consultantindemnified against all penalties and liabilities of every kind for breach of anysuch statute, ordinance, law, rule regulations or bye-law.

The Contractor shall give all notices and pay all fees and taxes required to begiven or paid under any Central or State statutes, ordinances or other laws orany regulations including KVAT (Kerala Value Added Tax) regulation or bye-laws of any local or other duly constituted authority in relation to the erectionwork.

2.31.0 Labour Rules

2.31.1 Provisions of Contract Labour Act

In respect of all labour, directly or indirectly, employed by the Contractor forthe erection work, the Contractor shall comply with the provisions of theContract Labour (Regulation and Abolition) Act, 1970, or any amendmentthereof, and all legislations and rules of the State and/or Central Governmentor other local authority, framed from time to time governing the protection ofhealth, sanitary arrangements, wages, welfare and safety for labour employedon the erection work. The rules and other statutory obligations with regard tofair wages, welfare and safety measures, maintenance of registers, etc. will bedeemed to be part of the Contract.

2.31.2 Provisions of Minimum Wages and Payment of Wages Act

The Contractor shall comply with the provisions of the Minimum Wages Act,1948, and the Payment of Wages Act, 1936, and any amendment thereof inrespect of all employees employed by him for the purpose of carrying out theerection work. The Contractor shall supply to the Purchaser any labourrequired to work wholly or partly under the direct order and control of thePurchaser, whether in connection with any work being executed by theContractor or otherwise for the purpose of the Purchaser and such labourshall for the purpose of this clause still be deemded to be persons employedby the Contractor.

If any money shall, as a result of any claim or application made under the saidActs, be directed to be paid by the Purchaser, such money shall be deemed tobe money payable to the Purchaser by the Contractor, and, on failure by theContractor to repay the Purchaser, any money paid by the Purchaser asaforesaid, within seven days after the same, shall have been demanded formthe Contractor, the Purchaser shall be entitled to recover the same from anymoney due or accruing to the Contractor under this or any other contract withthe Purchaser.

In the event of the retrenchment of workers by the Contractor or sub-contractors employed by the Contractor during or after the completion of thework, the retrenchment compensation and other benefits will be paid by theContractor to the workers as per the Industrial Disputes Act.

2.32.0 Provisions of Workmen’s Compensation Act

The Contractor shall at all times indemnify and keep indemnified thePurchaser against all claims for compensation under the provisions of theWorkmen’s Compensation Act, 1923 (VIII of 1923), or any other law for thetime being in force by, or in respect of, any workman employed by theContractor in carrying out of the Contract and against all costs and expensesor penalties incurred by the Purchaser in connection therewith. In every casein which, by virtue of the provisions of Section 12, sub-section (1) of theWorkmen’s Compensation Act, 1923 the Purchaser is obliged to paycompensation to a workman employed by the Contractor in executing thecontract, the Purchaser shall recover from the Contractor the amount of thecompensation so said and, without prejudice to the rights of the Purchaserunder Section 12, sub-section (2) of the said Act, the Purchaser shall be atliberty to recover such amount or any part thereof deducting it from thesecurity deposit or from any sum due by the Purchaser to the Contractor,whether under this contract or otherwise. The Purchaser shall not be boundto contest any claim made against him under Section 12, sub-section (1) ofthe said Act, except on the written request of the Contractor and upon his

giving to the Purchaser full security for all costs for which the Purchaser mightbecome liable in consequence of contesting such claim.

2.33.0 Damage to Persons or Property

The Contractor shall indemnify and keep indemnified the purchaser against alllosses and claims for injuries or damages to any property whatsoever whichmay arise out of, or in consequence of, the work at site carried out by theContractor and against all claims, demands, proceedings, damages, costs,charges and expenses whatsoever in respect thereof or in relation thereto.

2.34.0 Work in or around an Operating Plant

When the work is being carried out in or around an operating plant, where theplant must run uninterrupted, the Contractor shall only work at specifiedplaces and times as mutually arranged between the Contractor and thePurchaser. The Contractor shall take sufficient care in moving hisconstructional / erection plant and equipment from one place to another in anoperating plant so that they may not cause any damage to the property of thePurchaser, like roads, overhead and underground cables, pipes and/or anyother service or equipment or building, and, in the event of the Contractor’sfailure to do so, the cost of such damages, including eventual loss of workinghours as estimated by the Purchaser, shall be borne by the Contractor.

SECTION - 3

SSPPEECCIIAALL CCOONNDDIITTIIOONNSS OOFF CCOONNTTRRAACCTT

3.1.0 General3.1.1 The following special conditions shall be read in conjunction with General

terms and conditions of Contract (GCC) and amendments/correctionsthereto. Where any portion of the GCC are repugnant to or at variance withany provisions of the SCC, then, unless a different intention appears, theprovision of the SCC shall be deemed to override the provisions of the GCC.

3.1.2 Works to be done by ContractorUnless and otherwise mentioned in the tender document, the following worksshall be done by the contractor (whichever applicable), and therefore theircost shall be deemed to be included in their tendered cost.

a) Foundation bolts, components etc wherever required or specified.

b) Supports and brackets for suspending/supporting cables as required.

c) Supports for cable trays for laying the cables, where required.

d) Excavation and refilling of trenches in soil wherever the pipes/cables areto be laid directly in ground, including necessary base treatment andsupports for pipes, bricks, etc, as specified.

e) Sealing of all opening provided for pipes and cables, from fire safetypoint of view, after laying of the same.

f) Painting of all exposed metal surfaces of equipment and components.

g) Fixing of danger notice boards wherever required.

h) Making good all damages caused to the structure, walls, floors, slabs,etc., during installation and restoring the same to their original finish.

i) Consumables, fuels, cement, etc. required for the work, testing, trial runsand commissioning.

j) Testing and commissioning of the completed installation.

3.2.0 General Requirements and Arrangement of Materials3.2.1 All sundry fittings, assemblies, accessories, hardware items, foundation

bolts, termination lugs for equipments as required, and all other sundry itemswhich are useful and necessary for proper assembly and efficient working ofthe various components of the work shall be deemed to have been included

in the tender, whether such items are specifically mentioned in the tenderdocument or not.

3.2.2 Quality of materials

All the materials and equipment supplied by the contractor for this work shallbe new and should conform to relevant BIS Specifications. They shall be ofsuch design, size and material as to function satisfactorily under the ratedconditions of operation and to withstand the environmental conditions at site.The copies of purchase vouchers & gate passes should be produced alongwith the materials.

3.2.3 Inspection of material and Equipment

The materials should be inspected/tested by Purchaser/Consultant prior tothe despatch from the manufacturer. The inspection call should be given atleast fifteen days in advance so as to depute the officials ofPurchaser/Consultant for the inspection.

Such inspection will be of the following categories:

1. Inspection of materials/equipment to be witnessed at the manufacturerspremises in accordance with relevant BIS/Agreement InspectionProcedure.

2. To receive materials at site with manufacturers Test Certificate(s).

3. To receive materials after physical inspection at site.

Similarly, for fabricated equipment, the contractor will first submitdimensional detailed drawings for approval before fabrication is taken up inthe factory. Suitable stage inspection at factory also will be made to ensureproper use of materials, workmanship and quality control.

3.3.0 Supply of Tools, Tackles and MaterialsThe Supplier shall, at his own expense, provide all the necessary equipment,tools and tackles, haulage power, consumables, etc. necessary for effectiveexecution and completion of the works during site fabrication, erection andcommissioning.

3.4.0 Protection of Plant3.4.1 All works completed or in progress as well as machinery and equipment that

are liable to be damaged by the Supplier's work shall be protected by theSupplier and protection shall remain and be maintained until its removal isdirected by the Purchaser.

3.4.2 The Supplier shall effectively protect from the effects of weather and fromdamages or defacement and shall cover appropriately, wherever required, allthe works carried out by him.

3.4.3 Adequate lighting, guarding and watching at and near all the storage,handling, fabrication, pre-assembly and erection sites for properly carryingout the work and for safety and security shall be provided by the Supplier atSupplier's cost. The Supplier should adequately light the work area duringnight time also.

3.4.4 The Supplier shall take full responsibility for the care of the works or anysection or portions thereof until taking over of the plant by the Purchaser andin case any damage or loss shall happen to any portion of the works nottaken over as aforesaid, from any cause whatsoever, the same shall bemade good by and at the sole cost of the Supplier and to the satisfaction ofthe Purchaser. The Supplier shall also be liable for any loss of or damage tothe works including works carried out by others, caused by the Supplier orhis sub-supplier in the course of any operations carried out by them for thepurpose of completing any outstanding work or complying with hisobligations.

3.5.0 Training of PersonnelThe Supervisory and operating personnel of the Purchaser shall be providedwith adequate training by the Supplier during the installation, testing, start-upand commissioning of the system free of cost and the training shall becontinued during the entire guarantee run period

3.6.0 Consumption of Materials

Proper record of daily consumption of materials shall be maintained at thesite of work for each item (if necessary) as directed by the Engineer-in-charge. This is required to be done even if the contractor arranges thesematerials.

3.7.0 Testing and Measuring Equipments

Equipment for measurement of work and testing the installation shall beprocured by the Contractor for his use at his own cost. The same shall alsobe made available to the Engineer-in-charge without any charges for use ofthis work.

3.8.0 Inspectorate Approval

3.8.1 All the equipment to be supplied and works to be executed shall conform tothe provision of statutory and other regulations in force such as the IndianBoiler Regulations, Indian Factories Act, Indian Explosives Regulations,Kerala State Pollution Control Board, etc. Approval of drawings if requiredshall be arranged by the successful contractor at no extra cost to thePurchaser.

3.8.2 All testing are to be carried out as per the requirements of statutoryauthorities concerned.

3.8.3 On completion of work, the contractor has to submit necessary completioncertificate, drawings, equipment details, load details, test results etc. toelectrical contractor for getting approval from inspectorate.

3.8.4 All costs incurred in obtaining any approval/certificates are to be borne bythe contractor.

3.9.0 Structural Alterations to Building

No structural member in the building shall be damaged/altered, without priorapproval from the Engineer-in-charge.

Structural provisions like openings, if any, provided by Purchaser for thework, shall be used. Where these require modifications, such contingentworks shall be carried out by the contractor, at his cost.

All cut out openings in floors provided by Purchaser shall be closed, afterinstallation, in accordance with the schedule of work.

All cuttings made by the contractor in connection with the works shall befilled by him at his cost to the original finish.

3.10.0 Detailed Working Drawings

The detailed fabrication drawings are to be prepared by the contractor asper the relevant BIS specifications and the State / Central ElectricalInspectorate standards /specifications / guidelines and should obtainnecessary statutory approvals/sanctions (if necessary) prior to execution.Drawings provided by the Purchaser, if any, shall at all times be properlycorrelated before execution. In case of any discrepancy, the same shouldbe brought to the notice of Engineer-in-charge immediately. However, thediscrepancy in the item given in the Schedule of Requirements appendedwith the tender drawings relating to the relevant item, the former shall prevailunless and otherwise given in writing by the Engineer-in-charge.

3.11.0 Virtual Completion

The work shall not be considered as completed until the Engineer-in-chargehas certified in writing that the work has been virtually completed and theDefects Liability period shall commence from the date of such certificate.

Should it become necessary to occupy any portion of the building or to useany part of any equipment, before the contract is completed, the same shallnot constitute an acceptance of any part of the work unless so stated inwriting by the Engineer-in-charge.

3.12.0 Completion Drawings and Certificate

For all work completion report as given in the pro-forma for test results shallbe submitted to the Engineer-in-charge, after completion of work.

3.13.0 Handing over the site

The site shall be handed over in Phases, if warranted. Contractor shall planthe work as per the phasing decided by the Purchaser and no claim will beentertained for not handing over the entire area in one stretch. In case thereare small patches, which could not be handed over due to legal andtechnical reasons, this will not be considered as obstructions and no claimwill be entertained for delays for such reasons.

The Contractor shall clear the site thoroughly of all shuttering materials andrubbish etc., left out of his work and dress the site around the area to thesatisfaction of Engineer-in-charge upon completion of the work and beforerelease of payment of the last running bill. He will remove the labour huts oncompletion of the work. The payment of final bill will be subject to thecompliance of this condition by the contractor.

3.14.0 Deviations from Purchaser’s Specification

Deviations from the purchaser’s specification, if any, proposed by the bidderwill be considered, provided they meet with the purchaser’s requirementsand are necessary to improve utility, performance and efficiency. Thedeviations proposed by the bidder shall include the technical merits and thefinancial implications.

3.15.0 Conformity to IE Act, IE Rules and Standards

3.15.1 The work shall be carried out in the best workmanlike manner in conformitywith this specification, the relevant specification/codes of practice of theBureau of Indian Standards or IEC recommendations (Except wherespecified otherwise) and other relevant standards with latest amendments,

approved drawings and the instructions issued by the Engineer-in-charge orhis authorised representative, from time to time. Equipment meeting anyother authoritative standard, which ensures an equal or better quality thanthe above standards, will also be acceptable.

3.15.2 In addition to the standards, all works shall also conform to the requirementsof the followings:

a. The works shall also conform to relevant Bureau of Indian Standards’Codes of practice (COP) for the type of work involved.

b. Materials to be used in work shall be ISI marked wherever applicable.

c. In all electrical installation works, relevant Safety codes of practices shallbe followed.

d. Fire Insurance Regulations/Tariff Advisory Committee.

e. Regulations laid down by the Factory Inspector of the State.

f. Any other regulations laid down by the local authorities.

g. Installation & operating manuals of original manufacturers of equipment.

3.16.0 Extra items

If the Contractor has been asked to execute any such item/work in course ofconstruction for which the tender rates have not been quoted by him, hemust undertake such work. The rates for which additional work shall bedetermined by the Purchaser on the following lines, in the order ofpreference.

1. The rate to be derived from any one of the quoted rates for similair itemsof work in the tender.

2. In the case of extra items, whether altered or substituted, for whichsimilar items do not exist in the contract, the rates shall be derived at onthe basis of provisions of standard data book and latest schedule ofrates of Kerala Public Works Department by adding profit and overheadof 15% and applying the Contractor’s quoted percentage above orbelow.

3. Rates based on actual observation and/or analysis of labour andmaterials involved in such items. For this purpose the Contractor shallsubmit to the Engineer-in-charge detailed analysis of the rate proposedby the Contractor supported by relevant vouchers. While fixing rates forextra items an allowance of 15% of the cost will be provided towardscontractors profit and overhead charges taken over.

TTEECCHHNNIICCAALL SSPPEECCIIFFIICCAATTIIOONN

4.1.0 Scope of Work

This specification covers the technical requirements for design, supply,loading, unloading, erection, testing & commissioning at site and providingguarantee for Air Compressor with all accessories. The system shall beof proven design and capable of actual field operation for the desiredmaterials without any difficulty or problem whatsoever. As such, the qualityand performance guarantee for compliance with this specification shall bethe prime responsibility of the successful tenderer.

The tenderer shall be thoroughly conversant with the specifiedrequirements, standards, quality and workmanship for trouble freeoperation of the equipment. The contractor shall furnish and install fullyintegrated Chilling Plant incorporating Microprocessor based controller forequipment monitoring and control, energy management, and temperaturecontrol for the system.

4.2.0 Standards

4.2.1 The design, manufacture and testing of the equipment shall comply withthe latest editions of appropriate standards.

IS: 5111 Testing of Refrigerant Compressor

IS: 7938 & IS 2825 Air Receiver for compressed air installation

IS: 4758 Methods of measurement of Noise emitted by

machines

4.2.2 Unless mentioned otherwise, all applicable codes and standards in theirlatest editions as published by the Bureau of Indian Standards shall governin respect of design, workmanship and properties of materials and methodsof testing. In case where suitable Indian Standards are not available,generally accepted codes and practices shall be adopted.

4.2.3 All equipment shall comply with the statutory requirements of the Govt. ofIndia and Government of Kerala. The equipment constructions andinstallation shall conform to the provision of statutory and other regulationsin force such as the Indian Boiler Regulations, Indian Factories Act, IndianExplosives Regulations, Kerala State Pollution Control Board, etc. Approvalof drawings if required shall be arranged by the successful contractor at noextra cost to the Purchaser.

4.2.4 In cases where the offer deviates from the specified standards, thetenderer shall indicate clearly in his offer the reasons for deviation,standards proposed to be adopted by him and the details thereof.

4.3.0 Technical Requirements

4.3.1 The plant shall comprise of electric screw type compressor which shallhave a rated capacity of 65 cfm free air delivery on wet basis at a workingpressure of 5 bar.

4.3.2 Compressor shall be connected to an air dryer. Air dryer shall have a ratedcapacity of 65 cfm at 5 bar working pressure. An air receiver of 500 literscapacity shall be connected to the system. If the tenderer finds that thesizes are not adequate to, the same shall be indicated in the offer.

4.3.3 The salient technical particulars are as below:

Capacity of each compressor - 65 cfm

4.3.4 The Compressors, driers and receivers areproposed to be located is indicated in the equipment layout (DRG No – DP525 DRG MH 01 007 Sheet 1 of 2 & 2 of 2).

4.3.5 The contractor should indicate the space requirement in their offer.

4.3.6 The contractor shall submit a properly dimensioned drawing indicating thelayout of their equipment in consonance with the general schematicdetailed in building layout drawing.

4.3.7 The size/capacity of the different pipes and ancillary fittings such as valvesetc shall also be indicated clearly by the contractor in the drawing.

4.3.8 Foundation details shall be shown in a separate drawing.

4.4.0 Constructional Features of the Compressor

4.4.1 The compressor shall be rigid, robust and of sturdy construction. It shall beelectric screw type. Details of this arrangement shall be explained in theoffer.

4.4.2 Construction of the compressor shall be such that parts of the compressorwhich are required to be maintained regularly shall be located as to beconveniently accessible.

4.4.3 Cooling system is to be specified. Air cooled system is preferred.

4.4.4 Safety Devices, Indicators and Gauges

4.4.4.1 The compressor plant shall be complete with discharge air pressure &temperature gauges and other indicators & gauges as required. Details ofall safety devices provided on the compressor shall be explained in theoffer.

4.4.4.2 Pressure gauges shall be calibrated to indicate simultaneously in bar andpsi.

4.4.5 Component Details

4.4.5.1 Acoustic Canopy.

Compressor package shall be enclosed in a powder coated acousticcanopy with sound absorbing material for limiting the noise level. Canopyshall be under positive pressure to ensure that there is no pressure drop atSuction Filter. The installation shall be complete with anti vibration mountsfor Electric Motor & Compressor unit. Cogged belts and pulley drive issuggested.

4.4.5.2 Air Intake/Fine/Carbon Filter

Suitable filters, capable of filtering airborne particles shall be provided. Thefilter shall possess high separation efficiency, good accumulation capacity,low air resistance and mechanically strong. The filter elements shall becapable of being easily cleaned for re-use. The method and criterion forcleaning of filter elements shall be clearly specified by the contractor in hisdesign.

4.4.5.3 Valves

Suction and delivery valves shall be of high durability and suitable for screwcompressors. The details of the safety arrangement shall be spelt out in theoffer. The valves shall be easily accessible for maintenance. Special designfeatures of the valves shall also be furnished in the design.

In addition to the above, other valves as considered necessary by themanufacturer for efficient, continuous and safe working of the compressorshall be provided. Function of these valves shall be explained in detail.

4.4.5.4 Air Receiver

The air receiver shall be built and tested in accordance with IS: 7938 andIS: 2825. It shall be of the vertical cylindrical, all welded design. The airreceiver shall be supplied complete with self-supporting mountingarrangement, manhole, safety valve, pressure gauge, automatic drain trap,tapping and connection for air control regulation and inlet and dischargeconnections. Details of anti-corrosion protection provided on the inside andoutside of the air receiver shall be furnished.

4.4.5.5 Motor Starter and Control Panel

The control panel for compressor shall be located at a suitable placeoutside the enclosure of the compressor.

4.4.5.6 Air Dryer

The electrically heated air dryer shall be of refrigeration type capable ofautomatic continuous operation. The unit shall be compactly designed andcabinet enclosed to occupy minimum floor space, indoors.

4.4.5.7 Dryer Capability

The dryer shall receive oil free compressed air from the air receiver via aninline filter at specified pressure and flow. It shall deliver completelymoisture-free air with minimum pressure loss and at a constant dew point.

4.4.5.8 Insulation

The pre-cooler, evaporator, water separator, interconnected piping andliquid refrigerant piping shall be insulated with polyurethane foam orequivalent durable material.

4.4.5.9 Safety Features

The dryer shall incorporate, but not necessarily be limited to, the followingprotective functions.

i) Excessive fluctuations of refrigerant pressure for the refrigerationcompressor.

ii) Condensate over pressureiii) Automatic turn off of power on air pressure loss in system with

automatic restart on repressurisation.

4.5.0 Electricals, Instrumentation and Controls

4.5.1 Instrumentation and Controls

4.5.1.1 The dryer shall be provided with sufficient controls and indicators to ensureproper operation. These shall include, but not necessarily be limited to:-a) Power on indication.b) Compressor on indication.c) Compressor loaded/unloaded.d) Inlet air temperature.e) Air pressure.f) Dry air dew point.g) Outlet air temperature.h) Refrigerant pressure (high).i) Refrigerant pressure (low).

4.5.1.2 The dryer shall undergo refrigeration system evacuation and charging priorto shipment, including leak checks.

The unit shall also be given a running test and all instruments shall becalibrated prior to dispatch. A copy of the running test report shall besubmitted along with the unit.

4.5.2 Equipments

Contractor shall furnish the type and make of the equipments proposed tobe supplied along with necessary technical particulars for the same.

4.5.3 Noise Level

Noise level of the compressor shall not exceed 85 db (A) (measured underfield conditions at 1 m with a tolerance of + 3 db (A) when tested inaccordance with IS: 4758 or CAGI-PNEUROP/ANSI S1.13-1971.Contractor shall furnish a certificate to this effect.

4.7.0 Battery Limits

4.7.1 Power

Power at 415 V 50 Hz will be made available at single point at the incomingterminals of the Motor starter control panel separately for each compressoras well as a Air drier unit. All further power distribution including Panels,Power control cables, Motors, air drier heaters, earthing system etc.complete shall be under the scope of the Compressor supplier.

4.7.2 Piping

All interconnecting piping with all accessories between the compressor,dryer and receiver shall be in the scope of the Contractor.

4.8.0 Shop Inspection and Testing

4.8.1 The unit will be inspected at Supplier’s premises and the Supplier shallcarry out any change or modifications as pointed out by the Purchaser/Consultants during inspection at no extra cost. The Supplier shall dispatchthe equipment only after obtaining clearance from the Purchaser/Consultants. However, the Purchaser/Consultant inspection andcertification does not absolve the supplier of his responsibilities towards thesatisfactory operation and the guarantee/warranty of the system.

4.8.2 The manufacturer shall calibrate the equipments and conduct all testsrequired to ensure that the equipment furnished shall conform to therequirements of the applicable codes in presence of Purchaser/Consultant.All tests and test procedures proposed by the manufacturer shall besubmitted to the Purchaser/Consultant for his approval.

4.8.3 The Purchaser’s/ Consultant’s representative shall be given full access tothe shop in which the equipment is being manufactured or tested. ThePurchaser/ Consultants shall be notified well in advance of the fabricationand major tests for the purpose of general inspection and witnessing thetests.

4.8.4 All material used shall be of tested quality. The test certificate shall bemade available to the Purchaser’s/ Consultants’ representative. In case ofnon-availability of test certificates, material shall be tested by the supplier athis own cost, to establish conformance to the relevant standards.

4.8.5 The quality of fabrication work and welding shall be of the highest order inaccordance with the requirements of Indian standards.

4.8.6 Visual inspection for general workmanship and smoothness.

4.9.0 Painting and Shipment

4.9.1 All external surfaces shall be cleaned of loose substance and foreignmaterial, e.g. dirt, rust, scale, oil, grease, welding flux, etc. so that the zincphosphate primer coat adheres to the original metal surface. The work shallbe carried out generally in accordance with IS:1477 (Part I) amended up toDecemeber2010. The surface shall be cleaned either by sand blast tograde S.A.2.5 using graded sand or by acid pickling using dilute sulphuricor hydrochloric acid followed by thorough rinsing with fresh water. Theprime coat shall be applied immediately after the surface preparation.

4.9.2 Paint shall be applied in accordance with manufacturer’s recommendationsas supplemented by this specification.

4.9.3 The prime coats shall consist of two coat of Zinc phosphate` primer.

4.9.4 Finish painting shall consist of three coats of epoxy paint as permanufacturer’s specification.

4.9.5 Dry film thickness for each coat shall be about 25 microns and total dry filmthickness shall not be lower than 125 microns.

4.9.6 No shipment shall be made unless clear dispatch instructions are obtainedfrom purchaser’s representative.

4.9.7 All projected parts shall be properly protected to avoid damage duringtransit.

4.9.8 Touch up painting for damaged coats doing transit / erection should bedone by the contractor .Prior painting proper cleaning of the damagedportions to be done.

4.10.0 Site Facilities

4.10.1 The bidder shall indicate clearly the work to be carried out at site and theprocedure to be followed at Purchaser’s site.

4.10.2 For the work to be executed at site, electricity will be made available nearthe work site. The Contractor shall ensure that the facilities are notmisused or wasted.

4.10.3 Accommodation/transport of workmen and supervisors of the Contractorshall be the responsibility of the contractor.

4.11.0 Erection and Commissioning

All equipments shall be erected by the contractor on the locations given onthe equipment layout drawing (Drg No.- DP – 525 MH 01 001 Sheet 1 of 2& 2 of 2).

Installation and commissioning of the complete system will be done by thesupplier. The Contractor must ensure that the system shall be workingproperly.

4.12.0 Time of Completion

The period of the Contract shall commence from the date of receipt ofLetter of Intent (LOI/Notification of Award). The whole work under thisContract including commissioning shall be completed in all respects withinthe time of completion specified in the notice inviting tender from the dateof commencement of the contract.

4.13.0 Performance Guarantee and Warranty

4.13.1 Contractor shall guarantee that all materials used for the equipment havebeen submitted to regular acceptance procedure and free from any defectregarding quality, form and appearance.

4.13.2 Any equipment, or its part not having been submitted to wrong operatingservice or faulty manipulation and found defective during erection, test orduring operation, shall be repaired / replaced by the Contractor withoutdelay and free of cost within the guarantee period.

4.13.3 In case of defective equipment Purchaser / Consultant shall have theoption to repair/replace the equipment after intimating to the manufacturer,in order to avoid time delay. In such an event, Purchaser / Consultant shallbe entitled to recover the cost of such repair / replacement from theContractor.

4.13.4 The Contractor shall guarantee that upon completion of the satisfactorycommissioning and acceptance of the equipment by the purchaser, allportions thereof will be in accordance with requirement of the contract andwill be perfect as to design, materials, workmanship etc. for a minimumperiod of one year from the date of provisional acceptance of theequipment as per general conditions of contract.

4.13.5 The contractor shall further guarantee that during the guarantee period, hewill repair all defective equipments and replace all defective materialsfurnished or installed under this contract, free of cost to the purchaser.

4.13.6 The performance of the systems as per the above requirement shall beguaranteed for a minimum period of 12 months from the date ofcommissioning or 18 months from the date of supply whichever is earlier.

4.13.7 The contractor shall ensure provision of sufficient quantity ofcommissioning spares required for proper erection and commissioning ofthe equipment until final acceptance following demonstration ofperformance guarantee.

4.13.8 Contractor shall furnish detailed specifications of the recommendedlubricants, their brand names and the quantity required for one-yearconsumption. The first fill of lubricant as per the manufacturer’srecommendations shall be provided by the contractor.

4.14.0 Safety and Environmental Aspects

4.14.1 The total system should have adequate built-in precautions to prevent anyfire or explosive hazards.

4.14.2 Safety systems should be as per relevant IS codes.

4.14.3 The entire unit shall be fully enclosed and provision shall be given for easyrepair and maintenance of the machinery.

4.14.4 Emergency push button station shall be provided on the front side of thecabinet, which can shut down all the operation of the compressor unit incase of any emergency.

4.15.0 Data to be furnished by the Tenderer

The tenderer shall submit all catalogues, leaflets, detailed technicalspecification, etc. for the equipment. Drawings showing all the design,operational and maintenance features, major dimensions, details offoundations including layout etc., shall be submitted along with the offer.Technical data for individual items of equipment as per data sheet inaddition to details of all equipment within the battery limit shall be submittedalong with the tender. The tenderer shall also submit a generalarrangement drawing and approximate layout showing the spacerequirement etc.

TTEECCHHNNIICCAALL SSPPEECCIIFFIICCAATTIIOONN -- EELLEECCTTRRIICCAALL

5.1.0 Scope of Work / Battery LimitThe contractor’s scope shall cover the entire electrical equipment / system design,supply, install, test, commission and put in operation the equipments and servicesrequired for the satisfactory performance of the Air Compressor.

5.1.1 Supply, installation, testing and commissioning of Electrical panels and controlpanels required for Air Compressor.

5.1.2 Supplying, cable laying in trays as per the requirement, termination at both ends,testing and commissioning of LT power, control and instrumentation cables.

5.1.3 Earthing system for the Air Compressor, all its accessories and its interconnectionto the main earthing grid available at the site.

5.1.4 Civil work includes grouting of electrical equipment, fixing of cable trays, panelboards with all necessary supports, bolts etc.

5.1.5 The rates quoted for installation should include painted MS cable tray and itsaccessories (if any required) of suitable size and strength. The chargesincluded for painting MS supports provided for cable trays, push button stations,cable termination kits, straight through joints, glands, lugs, ferrules/sleeves etc. asdirected by Engineer-In-Charge.

5.1.6 The client shall provide 415V, 50Hz, 3phase 4 wire power supply through requiredsize power cable up to the circuit breaker provided by the client near theequipment (within 5 m distance). The contractor shall provide the required cablefrom circuit breaker to his main control panel. All other necessary power andcontrol cable from contractor’s main panel to control panel/equipment/push buttonstation is in the scope of contractor.

5.1.7 Scope of work shall include all items of work / equipments as required forsuccessful operation of Air Compressor whether specifically mentioned in thissection or not.

5.1.8 All drawings and details required for the liaison work for electrical inspectorapproval and obtaining safety certificate shall be given to the Electrical contractor.The equipment Contractor will be responsible for providing all the requisiteIS/IEC/IEE standards referred by him during detailed engineering.

5.1.9 The contractor shall submit the electrical panel GA drawing, SLD, componentdetails, cable routing, earthing details for approval before starting the work. Thework shall be started only after the approval of relevant drawings.

5.2.0 StandardsAll electrical equipment/installations shall fully comply with the requirements laiddown in the relevant rules/regulations/acts/standards/codes (I.E.R. and IS) asamended up-to-date and Standards/regulations of statutory bodies applicable forthe place of installation.

5.3.0 MCC/Control Panel

5.3.1 The designs of the control panel should meet the relevant standards.5.3.2 Necessary Input/output provision and relays shall be provided for the MCC

incomer and outgoing feeders for measurement and controlling.

5.3.3 Required numbers of spare NO/NC contacts of MCCBs / contactors etc.shall be wired to terminal blocks for the purpose of instrumentation andautomation systems.

5.3.4 The components (over load relays and contactors) inside the motor feeder shallbe selected to meet Type-2 co-ordination. The contactors shall be of AC-3 duty.Starters required for motors of rating up to 5kW shall be direct on line type.

5.3.5 Motor On/Off and Trip indication lamps (LED type) shall be provided.5.3.6 R,Y,B indication lamp shall be provided for incomer cubicle.5.3.7 If motors to be controlled locally, then local/remote push button shall be provided

in the panel with On/Off Push Button station near the motor. Emergencylockable type OFF push button shall be provided as per the statutory requirementfor the motors.

5.3.8 Ammeters, voltmeters shall be provided at the incomer.5.3.9 Any other Auxiliary Relays required for closing, tripping, annunciation

etc., required for the satisfactory operation of the Root washing machine shall beprovided.

5.3.10 The panel board shall be provided with overload, short circuit and earthfault protection relays.

5.3.11 The panel shall be fabricated out of 14 SWG CRCA sheet steel with cubicle typedesign and powder coated.

5.3.12 Gland plates shall be provided at the bottom and top of the panel for cable entry,suitable for the termination of cables with single/double compression glands to thesizes as required. The enclosure shall be provided with lifting hooks, supportinglegs and double earth terminals with double washers.

5.3.13 All metal sheets shall undergo 7 tank metal treatment, thorough de rusting rinsing-degreasing-rinsing- phosphating-rinsing and then passivation. The powder coatingshall meet the relevant standards.

5.3.14 The bus bars and supports shall be capable of withstanding the rated current andshort circuit current as per the required feeder rating.

5.3.15 Wiring for all controls, protection, metering, signaling, etc. inside the controlpanel shall be done with 1100 volts grey FR (fire retardant) copper conductorcables. Minimum size of these conductors shall be 1.5 Sq.mm.

5.3.16 All inter panel control wiring should be provided with necessary cable Sockets/lugs at both ends. Conductors shall be terminated using Compression type lugs.Each termination shall be identified at both the ends by PVC ferrules. Theidentification termination numbers should match with those on the drawings.

5.3.17 The panel shall be provided with MCCBs, MCBs, measuring & indicating meters,relays and instruments etc. of suitable size, capacity as per the requirement. Thecomponents should be positioned inside the panel board as per manufacturersstandards.

5.3.18 Two independent earthing points shall be provided outside the panel near bottomand these shall be inter-connected with suitable size earthing bus bars. The sizeof Earthing Strips shall be according to the earth fault current/KA ratings and meeting the statutory authority rules and regulations.

5.3.19 Danger notice plates conforming to IS 2551 and other statutory requirements shallbe affixed on equipment wherever required.

5.4.0 Push Button Station

5.4.1 The material of construction of push button enclosure shall be thermo setting orthermo plastic or cast aluminium and degree of protection shall be IP 65 weatherproof when used outdoor and IP42 when used indoor.

5.4.2 Mounting: Emergency push button station shall be suitable for wall mounting orplate mounting or mounted on fabricated, angular stand near the motor.

5.4.3 Push button enclosure shall be earthed and terminated to earthing terminal induplicate with 10SWG Cu wire to the nearest earth strip.

5.5.0 Power and Control Cable

5.5.1 The cable shall confirm to the latest editions of the IS Standards.5.5.2 Power cables shall be of 1100 volt grade, aluminium/copper conductor, XLPE

insulated, PVC sheathed, armored and overall PVC sheathed, strictly as per ISstandards

5.5.3 External Control cables for use on 415 V system shall be FR type 1100 voltsgrade, copper conductor, PVC insulated, PVC sheathed, armored and strictly asper IS: 1554 (Part I).

5.5.4 The size of control cables shall be as per the requirement. No cable of size lessthan 1.5 Sq.mm. copper cable shall be used.

5.5.5 Cable connectors, lugs/sockets, shall be of copper/aluminium alloy, suitablytinned, soldering less, crimping type.

5.5.6 For laying of cables above floor ladder type MS painted cable tray shall be used.Contractor shall size the cable tray as per the requirement of number of cables.The route & size of the cable tray shall be got approved before executing thesame at site. The supports shall be suitable size angle or channel for withstandingthe weight of tray and cables. The MS tray & support shall be painted by 2 coatprimer and 2 coat enamel paint as per relevant standard.

5.5.7 The complete installation work shall be conforming to complying with the IndianElectricity Rules and to meet the approval of the statutory authority.

5.5.8 For laying of cables under floor, G.I. ‘B’ class pipes shall be used. MS conduitsare not acceptable for this purpose. All accessories of pipes shall be threadedtypes. Size of pipe shall depend upon the overall outer diameter of cable to bedrawn through pipe. No G.I pipe less than 40 mm dia. shall be used for thispurpose. To determine the size of pipe, assume that 40% area of pipe shall befree after drawing of cable.

5.5.9 Suitable size of power cable shall be used for the motors and feeders based onthe current carrying capacity, voltage drop and other relevant factors of thecables. The sizing of cables shall also meet the requirement of the statutoryauthorities.

5.6.0 Driving Motors (Squirrel Cage Induction Motor/ Slip Ringinduction motor)

5.6.1 The induction motors as required for the Root washing machine shall bedesigned, constructed and tested in accordance with following parameters and besuitable for continuous operation at the ambient temperature of 400C Max. All ACmotors shall be energy efficient type (EFF1) category or higher as per IS /IEC)with IP54 or higher protection. All the protective, controlling devices required forthe Root washing machine shall be provided.

5.6.2 Technical Parameters

System voltage : 415V +/- 5% 3 phase, 3 wire effectivelyearthed. (With 2% unbalance in voltage)

5.6.3 Construction5.6.1 The motors shall be so constructed that efficient cooling is achieved to keep the

temp. rise within permissible limits, as well as withstand the effect of abnormaloperating conditions for a short period on in-frequent basis without any damageon the life and performance.

5.6.2 The design and manufacture shall be coordinated and appropriately matched withthe requirements of the driven equipment both mechanically and electrically. Themotor frame shall be either fabricated or casting of approved quality.

5.7.0 Installation and Commissioning5.7.1 Scope5.7.1.1 The intent of this specification is to define the requirements for the installation,

testing and commissioning of the electrical items as per the requirements. Thework shall, however at all times carried out strictly as per the instructions of theEngineer-in-Charge. The complete installation work shall be conforming with theIndian Electricity Rules and to meet the approval of the statutory authority.

5.7.1.2 The contractor shall bring all tools, welding equipment, rigging materials, testingequipment, test connections and kits etc. required for complete installation, testingand commissioning of the items included in the scope of work.

5.7.1.3 Foundation channel for panels shall be fixed to the flooring by the contractor ormounted to wall as required. The contractor shall fix the cable glands after drillingthe bottom/top gland plates of all panels with suitable size holes. The contractorshall arrange testing and calibrations of all relays using suitable equipments.

5.7.1.4 Cable network shall include power, control cables, which shall be laid under floor,cable trays, GI pipes, or on building structure surfaces as per the requirement.Installation of all cables should be as per the relevant IS standards. Cables shouldbe graded properly and should be selected based on the rating of the feeders.

5.7.1.5 All XLPE/PVC, 1.1 kV grade, armored or un-armored cable shall be terminated atthe equipment/junction box/ isolators/push buttons/control accessories, etc. bymeans of suitable size single/double compression type cable glands. The cablegland shall be earthed with suitable size copper earth clip to the nearest earthpoint.

5.7.1.6 All the pre-commissioning & commissioning test such as insulation resistance ofcables, motors, trip setting etc shall be done before energizing the system.

5.7.1.7 Any additional earth pit if required, shall be intimated initially itself so thatnecessary arrangement can be made. The earth strip required for connecting tothe additional earth pit is in the scope of the contractor.

5.7.1.8 Before connecting power cables to motors the insulation resistance of all motorwindings shall be measured. Motors shall be operationally tested together with thestarting gear and auxiliary apparatus such as push button stations, the contactors,controls, signal and alarm apparatus, power and control circuits etc. The setting ofthe thermal overload protection/single phase prevention shall be done based onthe rating & operational characteristics of the motor. Testing of these devices is tobe done wherever required as per the instructions of the Engineer-in-charge.

5.8.0 Drawings/Documents & ApprovalsThe drawing showing general arrangements and detailed wiring diagram for thepanels shall be submitted to the Engineer-in-charge for approval, prior tomanufacture and the same shall be got inspected, prior to despatch to project site.The complete switchboard and its component shall conform to Indian ElectricityRules, Relevant IS/IEC and meeting the regulations of statutory authority.The following minimum drawings and documents shall be submitted:1. General Arrangement with dimension details, bus bar sizes, construction

details of the panel.2. Single line schematic with electrical load details.3. Detailed Control schematic, metering & protection details.4. All cable schedules/interconnection charts/layout drawings, power

layout, earthing layout, trench/rack layout.5. Test reports/ Test certificates/Operational & Maintenance manuals.6. Drawings/documentation required for getting approval from statutory

authority.

All the above mentioned drawings and documents shall be submitted as As-builtduring the handing over of the equipment.
