Ramadan Food FestivalCumberland Council's Ramadan Food Festival returns in 2020, offering a range of authentic food.

Council is seeking mobile food vendors and food stalls specialising in authentic cuisines (preferrably halal).

HOW TO APPLYCumberland Council runs an expression of interest (EOI) period for stallholders and food vendors interested in participating.

All applicants must read this EOI information pack in detail, including the Terms and Conditions. Once satisfied that you meet the criteria please complete the application form.

IMPORTANT INFORMATION

• Submission of a stallholder application doesnot guarantee selection. You will be notifiedthe outcome at least two weeks after theapplication closing date.

• The application form is final once submittedand changes to stall requirements andequipment will not be accepted.

• The application must be completed in full withthe required supporting documentation.

• A copy of the applicant's Public LiabilityInsurance must be submitted. If the applicant'sPublic Liability Insurance expires prior tothe event, the stallholder must provide anupdated copy to the Senior Events Coordinatorprior to the event.

• Cumberland Council reserves the rightto prohibit trade by any stallholder notcomplying with the Terms and Conditions andmay also bar the stallholder from trading atfuture events.

• Payment will be required from successfulstallholders and is due two weeks prior to theevent to confirm your stall. Please note thatpayment should be made once receiving aninvoice from Council.

• Payment of stallholder fees constitutesagreement by the stallholder to accept andcomply with Terms and Conditions outlined inthis application pack and attend the event onthe agreed date(s).

Stallholders are asked to provide high-quality images of your stall and products for the opportunity to be featured in online advertising.

Food stallholders and mobile food vendors• Professionally presented and packaged• Suitable for the target market• Good value for money• Culturally appropriate• Unique selling point• Catering for various dietary requirements (including halal, vegetarian, gluten free)

When selecting stallholders the following considerations will be made:• The number of stalls with a similar product• Uniqueness of the product and how many other retailers there are in a particular category• Space, power and other stallholder requirements that may be restricted due to venue• Other factors including the quality of images supplied and the amount of information provided in

the application all play a part in helping us to assess individual applications

The sale of the following items will not be permitted:• Objects and publications containing offensive language, images or information• Real or replica weapons• Laser pointers• Animals or live produce• Adults only products• Helium and foil balloons• Silly string• Air horns• Articles that could be dangerous to event patrons

Other considerations:

• Selection of stallholders is at the discretion of Cumberland Council• Council reserves the right to refuse stallholder applications based on prior infringements of public

health and event safety standards. A stallholder will be notified in the instance an infringement hasoccurred

• All stallholders must have their own Public Liability Insurance• Political parties are not eligible for participation as a stallholder• Stall name, description and any images submitted as part of your application may be utilised for the

purposes of event promotion. Personal contact information will not be published• Council may ask you to incorporate event theming into your retail operations• Council will charge upfront for food inspections. A refund will be provided should an inspection not

be carried out at the event

1. Inspection of SitesIt is the responsibility of the stallholder totrade in accordance with any applicableFederal, State and Local Government lawsand where applicable, comply with theprovisions of the Food Act 2008 and theAustralia New Zealand Food StandardsCode. Council Environmental Health Officerswill inspect stalls prior to the event. If you areunable to provide your Food SafetySupervisor Certificate during the foodinspection, please know that our team arewithin their rights to shut down operations.

2. Structural safetyStallholders using their own structures arerequired to secure such infrastructure toAustralian Safety Standards. Council is withinits rights to reject a stallholders involvementin an event due unsafe or inappropriateinfrastructure.

3. Electrical safetyStallholders using power are required tobring their own electrical cables which mustbe tagged and tested. Council will onlysupply the number of outlets as requested inthe completed application. Electrical cordsshould not cross public access ways and mustbe fully secured. A qualified electrician willbe on site to inspect electricals prior to eventcommencement.

4. Sale of FoodFood vendors are required to conformto minimum safety standards. All foodstallholders are required to pay a healthinspection fee and ensure the stall complieswith NSW Food Authority: Guidelines forBusinesses at Temporary Events, NSW FoodAct 2003 and AS/NZS Electrical Standards.Council also requires a copy of a recentinspection report from the relevant LGA.Food Trucks must include a copy of theirlocal vehicle registration and most recentCouncil Health Inspection report (within thelast 12 months) or a health inspection feeis applicable. Food vendors are requiredto pass an inspection on site to ensureoperation meets Council’s standards.

5. Use of LP gasFood vendors using LPG at Council eventsshould ensure gas cylinders are:• Not damaged or rusty• Secured on a level, noncombustible surface• Stored externally and not blocking and

exits or accessible by the public• Ensure supply hoses, joints and other

connections are in good condition

• Placed away from heat and flames

6. Use of charcoalFood vendors using charcoal at Councilevents should ensure:

• Used coal is disposed of in allocated binsas directed by Council staff

7. Accidents, incidents and risk managementIt is the responsibility of each stallholder topromptly report any incident to the on-sitesupervisor outlined in your event briefing,including:• Property damage• Illness, accident or injury• Anti-social behaviour• Lost children• Any observed disruptive behaviour• Any other issues raising concern for the

health, safety or security of food vendorsor the public

• Hazards and near misses

8. Personal safety and securityStallholders are required to maintain anappropriate level of personal safety andsecurity. Council will not be liable for theloss of goods, cash or personal items,merchandise or damage to any goodsincluding loss or damage as a result ofon-site power failure.

Stallholder Terms and Conditions of TradeThe following Terms and Conditions apply to all stallholders who have received approval from Cumberland Council to participate in the event.

9. Trade requirementsPayment of the stallholder fees constitutesagreement by the stallholder to attend theevent on the agreed dates. If unable to attend,stallholders must notify Council’s Events Team aminimum of two weeks prior to the event day.All stallholders are responsible for anyequipment, displays, publications andcatering equipment.All stalls must be set up and ready to tradeby no later than 30 minutes prior to thecommencement of the event. Stallholdersmust trade for the duration of the event.Pack down is not permitted until the eventhas concluded and the site has been cleared.Stalls must be supervised by an adult at alltimes for the duration of the event.Stallholders must confine their equipment,displays and signs to the site area and keepall pathways and thoroughfares clear andunobstructed. All signage must directlyrelate to the products being sold. Nocommercial signs will be permitted.Stallholders are not permitted to share,sub-lease or assign site position withoutprior approval from Council.

10. Site locationApplicants will be assigned infrastructureand/or requirements as per completedapplication.Stallholders will be advised of their sitepositioning one week before the event.Positioning is final.Stallholders with genuine practical or logisticalreasons for requesting a particular locationmay contact Council to discuss their request,however, please be advised that there is noguarantee of the position being allocated.

11. Power and lightingStallholders must provide powerrequirements in completed application.Stallholders using their own infrastructure willbe required to bring lighting where required.

12. Waste management and sustainabilityStallholders are required to use vendor binssupplied at the event for all rubbish.A cleaning fee will be issued to stallholderswho leave waste in stalls or beside bins.This includes oil spills, food scraps and anygeneral waste.

13. Amplified music and soundPublic address systems, amplified music orsound will not be permitted without writtenapproval from Cumberland Council prior tothe event being held.

14. CompetitionsRaffle and competitions may not be runat the event without written consent fromCumberland Council.

15. TrafficTraffic management measures, such as roadclosures or reduced speed limits will beimplemented at the discretion of Council.Stallholders are required to comply withrequests and instructions as per directionfrom Council event staff.

16. Event set-up and pack-upSuccessful applicants will be providedwith detailed bump in/out instructions. Stallholders must not pack up until the advertisedclosing time of the event.

17. PromotionCouncil may engage event photographers torecord activities at the event. Eventstallholders consent to the use of any photostaken to be used for promotional purposes.

18. SalesWe are committed to the successfulpromotion and delivery of all eventdays. Cumberland Council does not takeresponsibility for the level of sales that astallholder may achieve.

19. Stall cancellationCumberland Council reserves the right tocancel the approval of any stall withoutrefund and/or ban the stallholder fromparticipation where the stallholder hasbreached Terms and Conditions or the stall isselling goods other than those specified in itsapplication without written approval.

20. Liability and indemnityCouncil requires all stallholders to hold acurrent public liability insurance policy with aminimum of $20,000,000 cover. Councilis not liable for any injury, loss or damageincurred by a stallholder who trades at anevent unless such injury, loss or damageis caused by negligence of CumberlandCouncil. The stallholder agrees to indemnifyCouncil against any liability for injury, loss ordamage which may be incurred as a result ofthe stallholder trading at an event day.

21. Stallholder FeesPayment will be required from successfulstallholders and is due one week prior to theevent to confirm your stall. Please note thatpayment is only required once you havereceived notice from Council of a successfulapplication. Payment of stallholder feesconstitutes agreement by the stallholder toattend the event on the agreed date(s). Fees areset each financial year and may vary per event.

22. Event CancellationCouncil reserves the right to cancel the eventin case of inclement weather and event safetyconditions. Such cancellation is at Council’sdiscretion. Proactive cancellation would occur8 hours prior to the event being held in whichcase stallholders would receive relevantrefund of fees. Reactive cancellation mayoccur under extenuating circumstancesduring the event as a risk mitigation measure.No financial compensation is offered ornegotiable under these circumstances. Allcancellations by stallholders must be made inwriting to Council’s Senior EventsCoordinator. Council will not issue refundswhere notice has not been provided twoweeks prior to the event.

23. Refund PolicyThe stallholder agrees that they participate inthe event at their own financial risk. Council’sestimate on attendance is provided based onprevious events. Any loss of income due topoor sales is not a basis for refund on fees.

24. AmendmentsCouncil reserves the right to amendthe Terms and Conditions and will notifystallholders of changes prior to them cominginto effect.
