    Dear Kyle Bristow:

    The above request has been received and reviewed. Our office has made a diligent search to locate the records you have requested. Unfortunately we must deny your request for records on Francis Parker Yockey because our office could not locate anything in our files or our database on Francis Parker Yockey.

    If you are dissatisfied with the resolution of your request, you have the right to do either of the following:

    (1) Submit a written appeal to the County Executive, which specifically states the word "appeal" and states the reason, or reasons the denial should be reversed. Send your appeal to Mary Rose MacMillan, Wayne County Corporation Counsel, 500 Griswold, Suite 3127, Detroit, Ml 48226,

    (2) Commence an action in the circuit court to compel disclosure. Should you prevail, you will be entitled to have reasonable attorneys' fees, costs and disbursements assessed against the County by the court. If you or the County prevails in part, the court may, in its discretion, award you all or an appropriate portion of reasonable attorneys' fees, costs, and disbursements. If the court determines that the County has been arbitrary and capricious in its denial, you will also be entitled to punitive damages in the amount of $500.00.

    Dear Mr. Bristow:

    This responds to your Freedom of Information Act (FOIA) request of9 September 2Ol4 , which was received by this office on 9 September 2OL4, forcopies of any and all documents that this Agency maintains in its possessionthat pertains to Francis Parker Yockey. Your letter has been assigned CaseNumber 79074. Please refer to this case number when contacting us aboutyour request. For purposes of this request and based on the information youprovided in your letter, you are considered an "all other" requester. There areno assessable fees for this request; therefore, we did not address your requestfor a fee waiver. Your request has been processed under the provisions of theFOIA.

    You may be aware that one of the NSA/CSS missions is to collect,process, and disseminate communications or signals intelligence informationfor intelligence and counter intelligence purposes. NSA collects information onunspecified persons and entities to prevent and protect against terroristattacks, the proliferation of weapons of mass destruction, intelligence activitiesdirected against the United States, international criminal drug activities, andother hostile activities directed against the United States. The roles andresponsibilities that NSA exercises are delineated in Executive Order 12333, asamended.

    The classified nature of the National Security Agency's efforts prevents usfrom either confirming or denying the existence of intelligence recordsresponsive to your request, or whether any specific technique or method isemployed in those efforts. The fact of the existence or non-existence ofresponsive records is a currently and properly classified matter in accordancewith Executive Order 13526, as set forth in Subparagraph (c) of Section 1.4.Thus, your request is denied pursuant to the first exemption of the FOIA,which provides that the FOIA does not apply to matters that are specifically

    authorized under criteria established by an Executive Order to be kept secretin the interest of national defense or foreign relations and are properlyclassified pursuant to such Executive Order.

    Moreover, the third exemption of the FOIA provides for the withholding ofinformation specifically protected from disclosure by statute. Thus, yourrequest is also denied because the fact of the existence or non-existence of theinformation is exempted from disclosure pursuant to the third exemption. Thespecific statutes applicable in this case are Title 18 U.S. Code 798; Title 50 U.S.code 3o2a$l; and section 6, Public Law 86-36 (5o u.S. code 36o5).

    The Initial Denial Authority for NSA information is the Associate Directorfor Policy and Records, David J. Sherman. As your request is being denied,- you afe hereby adviSed ofAhis A,geRcy'S apFeaf procedurS. -Any person deniedaccess to information may lile an appeal to the NSA/CSS Freedom ofInformation Act Appeat Authority. The appeal must be postmarked no laterthan 6O calendar days of the date of tJle initial denial letter. The appeal shallbe in writing addressed to the NSA/CSS FOIA Appeal Authority (DJ4), Nationalsecurity Agency, 98oo savage Road srE 6248, Fort George G. Meade, MD20755-6248. The appeal shall reference the adverse determination and shallcontain, in sufficient detail and particularit5r, the grounds upon which therequester believes that the determination is unwarranted. The NSA/CSS FOIAAppeal Authority will endeavor to respond to the appeal within 20 working daysafter receipt, absent any unusual circumstances.
