NOTICE TO ALL USERS: PLEASE READ THIS CONTRACT CAREFULLY. BY CLICKING THE ACCEPTBUTTON OR INSTALLING THE SOFTWARE, YOU (EITHER AN INDIVIDUAL OR A SINGLE ENTITY)AGREE THAT THIS AGREEMENT IS ENFORCEABLE LIKE ANY WRITTEN CONTRACT SIGNED BYYOU. IF YOU PURCHASED THESOFTWARE ON TANGIBLE MEDIA (e.g., CD) WITHOUT THE OPPORTUNITY TO REVIEW THISLICENSE AND YOU DO NOT ACCEPT THIS CONTRACT, YOU MAY OBTAIN A REFUND OF THEAMOUNT YOU ORIGINALLY PAID IF YOU: (A) DO NOT USE THE SOFTWARE AND (B) RETURN IT,WITH PROOF OF PAYMENT, WITHIN THIRTY (30) DAYS OF THE PURCHASE DATE TO THELOCATION FROM WHICH IT WAS OBTAINED.

1. Definitions.a Software means (a) all of the contents of the files, disk(s), CD-ROM(s) or other media

(including electronic media) with which this Agreement is provided or such contents as arehosted by McAfee or its distributors, resellers, OEM/MSP partners, or other business partners(collectively Authorized Partner(s)), including but not limited to (i) McAfee or third partycomputer information or software; (ii) related explanatory materials in printed, electronic, oronline form (Documentation); and (b) upgrades, modified or subsequent versions and updates(collectively Updates), and Software, if any, licensed to you by McAfee or an AuthorizedPartner as part of a maintenance contract or service subscription.

b Use or Using means to access, install, download, copy or otherwise benefit from using theSoftware.

c Permitted Number means one (1) unless otherwise indicated under a valid license(e.g., volume license) granted by McAfee or an Authorized Partner.

d Computer means a device that accepts information in digital or similar form and manipulates itfor a specific result based upon a sequence of instructions.

e McAfee means (a) McAfee, Inc., a Delaware corporation, with offices located at 3965 FreedomCircle, Santa Clara, California 95054 if the Software is purchased in the United States, Mexico,Central America, South America, or the Caribbean; (b) McAfee Ireland Limited, with officeslocated at 11 Eastgate Business Park, Little Island, Cork, Ireland if the Software is purchased inCanada, Europe, the Middle East, Africa, Asia, or the Pacific Rim; (c) McAfee do Brasil Comrciode Software Ltda., with offices located at Rua General Flausino Gomes 78, conj. 51, Sao Paulo,SP, Brazil if the Software is purchased in Brazil; (d) McAfee Co., Ltd. with offices located atShibuya Mark City West Building 12-1, Dogenzaka 1-Chrome, Shibuya-ku, Tokyo 150-0043,Japan if the Software is purchased in Japan; and (e) McAfee (Shanghai) Software Co. Ltd., withoffices located at Room 601 AE-13, Bldg. 2, No. 351, Goushoujing Toad, Zhangliang High-techPark, Pudong, Shanghai China if the Software is purchased in China.

2. License Grant. Subject to the payment of the applicable license fees, and subject to the termsand conditions of this Agreement, McAfee hereby grants to you a non-exclusive, non-transferablelicense to Use the Software on computers owned or controlled by you for your own personal, non-commercial use subject to any restrictions or usage terms specified on the applicable productpackaging included as part of the Documentation. Some third party materials included in theSoftware may be subject to other terms and conditions, which are typically found in either a ReadMe file or an About file in the Software.

3. Term. Unless earlier terminated as set forth herein, this Agreement is effective for the term setforth in the Documentation. If no term is agreed, the default term shall be one (1) year frompurchase. If you have agreed to permit McAfee to automatically renew your subscription to theSoftware by charging a valid credit card number which you have provided to McAfee, yoursubscription will be automatically renewed thirty (30) days prior to the expiration of the term andeach anniversary thereafter for a fee no greater than McAfees then-current price, excluding

promotional and discount pricing. You must provide current, complete, and accurateinformation for your billing account. You must promptly update all information to keep yourbilling account current, complete, and accurate (such as a change in billing address, creditcard number, or credit card expiration date), and you must promptly notify McAfee if yourcredit card is canceled (for example, for loss or theft). Changes to such information can bemade at http://us.mcafee.com/root/myaccount.asp. If you fail to provide McAfee any of theforegoing information, you agree that McAfee may continue charging you for any subscriptionautomatically renewed unless you inform McAfees customer support department at (408)992-8599 or (866)622-3911 (or any other local number provided by the respective McAfee entity inyour region) not to renew your subscription to the Software at least thirty (30) days prior to theexpiration of your subscription to the Software and informing them of your desire not to havesuch subscription automatically renewed. This Agreement will terminate automatically if youfail to comply with any of the limitations or other requirements described herein. Upon anytermination or expiration of this Agreement, you must cease use of the Software and destroyall copies of the Software and the Documentation.

4. Updates. This license is limited to the version of the Software delivered by McAfee anddoes not include Updates, unless a separate maintenance contract is purchased or,alternatively, you have purchased a service subscription that entitles you to Updates asdescribed in the Documentation. After the specified maintenance period or servicesubscription period has expired, you have no further right to receive any Updates without thepurchase of a new maintenance contract or service subscription.

5. Ownership Rights. The Software is protected by United States and other copyright laws,international treaty provisions and other applicable laws in the country in which it is beingused. McAfee and its suppliers own and retain all right, title and interest in and to the Software,including all copyrights, patents, trade secret rights, trademarks and other intellectual propertyrights therein. Your possession, installation, or Use of the Software does not transfer to youany title to the intellectual property in the Software, and you will not acquire any rights to theSoftware except as expressly set forth in this Agreement. Any copy of the Software andDocumentation authorized to be made hereunder must contain the same proprietary noticesthat appear on and in the Software and Documentation.

6. Multiple Environment Software/Multiple Language Software/Dual Media Software/Multiple Copies/Bundles/Updates. If the Software supports multiple platforms or languages,if you receive the Software on multiple media, if you otherwise receive multiple copies of theSoftware, or if you receive the Software bundled with other software, the total number of yourComputers on which all versions of the Software are installed may not exceed the PermittedNumber. If the Software is an Update to a previous version of the Software, you must possessa valid license to such previous version in order to Use the Update. You may continue to Usethe previous version of the Software on your Computer after you receive the Update to assistyou in the transition to the Update, provided that the Update and the previous version areinstalled on the same Computer; the previous version or copies thereof are not transferred toanother Computer unless all copies of the Update are also transferred to such Computer, andyou acknowledge that any obligation McAfee may have to support the previous version of theSoftware ends upon availability of the Update.

7. Restrictions. You may not sell, lease, license, rent, loan, resell or otherwise transfer, withor without consideration, the Software. You may not reverse engineer, decompile, ordisassemble the Software, except to the extent the foregoing restriction is expressly prohibitedby applicable law. You may not modify, or create derivative works based upon, the Software inwhole or in part. You may not copy the Software or Documentation except as expresslypermitted in Section 1 above. You may not permit third parties to benefit from the use orfunctionality of the Software via a timesharing, service bureau or other arrangement. You maynot remove any proprietary notices or labels on the Software. All rights not expressly set forthhereunder are reserved by McAfee. You may not back up electronic/digital content for which

you do not have sufficient legal rights to the content being backed up. You may not: (a) use theSoftware for any illegal purposes; (b) use the Software to store, retrieve, transmit or view any file,data, image or program that contains: (i) any illegal pictures, materials or information; (ii) anyharassing, libelous, abusive, threatening, harmful, vulgar, pornographic, obscene or otherwiseobjectionable material of any kind or nature; (iii) any material that encourages conduct that couldconstitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state,national or international law or regulation; (iv) any code or material that violates the intellectualproperty rights of others; (v) any Windows temporary files of any kind (including, without limitation,any *.p or ~*.* files); or (vi) any viruses, worms, Trojan horses or any other similar contaminatingor destructive features.

8. Warranty and Disclaimer.a Limited Warranty. McAfee warrants (manufacturer warranty) that for sixty (60) days from the

date of original purchase the Software will operate substantially in accordance with theDocumentation and that the media (e.g., CD ROM), if any, on which the Software is containedand provided to you will be free from defects in materials and workmanship.

b Customer Remedies. McAfees and its suppliers' entire liability and your exclusive remedy forany breach of the foregoing warranty shall be, at McAfees option, either (i) return of thepurchase price you paid for the license, or (ii) replacement of the defective media in which theSoftware is contained. You must return the defective media to your place of purchase at yourexpense with a copy of your receipt. This limited warranty is void if the defect has resulted fromaccident, abuse, or misapplication. Any replacement media will be warranted for the remainderof the original warranty period. Outside the United States, this remedy is not available to theextent McAfee is subject to restrictions under United States export control laws and regulations.

c Warranty Disclaimer. Except for the limited warranty set forth herein, THE SOFTWARE ISPROVIDED "AS IS" AND MCAFEE MAKES NO WARRANTY AS TO ITS USE OR PERFORMANCE.EXCEPT FOR ANY WARRANTY, CONDITION, REPRESENTATION OR TERM THE EXTENT TOWHICH CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW, MCAFEE, ITS SUPPLIERS,AND AUTHORIZED PARTNERS MAKE NO WARRANTY, CONDITION, REPRESENTATION, ORTERM (EXPRESS OR IMPLIED, WHETHER BY STATUTE, COMMON LAW, CUSTOM, USAGE OROTHERWISE) AS TO ANY MATTER INCLUDING, WITHOUT LIMITATION, NONINFRINGEMENT OFTHIRD PARTY RIGHTS, MERCHANTABILITY, INTEGRATION, OR FITNESS FOR A PARTICULARPURPOSE. YOU ASSUME RESPONSIBILITY FOR SELECTING THE SOFTWARE TO ACHIEVEYOUR INTENDED RESULTS, AND FOR THE INSTALLATION OF, USE OF, AND RESULTSOBTAINED FROM THE SOFTWARE. WITHOUT LIMITING THE FOREGOING PROVISIONS,MCAFEE MAKES NO WARRANTY THAT THE SOFTWARE WILL BE ERROR-FREE OR FREE FROMINTERRUPTIONS OR OTHER FAILURES OR THAT THE SOFTWARE WILL MEET YOURREQUIREMENTS.

9. Limitation of Liability. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY,WHETHER IN TORT, CONTRACT, OR OTHERWISE, SHALL MCAFEE, OR ITS AUTHORIZEDPARTNERS OR SUPPLIERS BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR LOSS OFPROFITS, LOSS OF GOODWILL, OR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIALDAMAGES, OR DAMAGES FOR GROSS NEGLIGENCE OF ANY CHARACTER INCLUDING, WITHOUTLIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE ORMALFUNCTION, OR FOR ANY OTHER DAMAGE OR LOSS. IN NO EVENT SHALL MCAFEE, OR ITSAUTHORIZED PARTNERS OR SUPPLIERS BE LIABLE FOR ANY DAMAGES IN EXCESS OF THEPRICE PAID FOR THE SOFTWARE, IF ANY, EVEN IF MCAFEE, OR ITS AUTHORIZED PARTNERS ORSUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. This limitation shallnot apply to liability for death or personal injury to the extent that applicable law prohibits suchlimitation. Furthermore, some jurisdictions do not allow the exclusion or limitation of incidental orconsequential damages, so this limitation and exclusion may not apply to you. Nothing contained inthis Agreement limits McAfees liability to you for McAfees gross negligence or for the tort of fraud.McAfee is acting on behalf of its suppliers and Authorized Partners for the purpose of disclaiming,

excluding and/or limiting obligations, warranties and liability as provided in this Agreement,but in no other respects and for no other purpose. The foregoing provisions shall beenforceable to the maximum extent permitted by applicable law.

10. Notice to United States Government End Users. The Software and accompanyingDocumentation are deemed to be commercial computer software and commercial computersoftware documentation, respectively, pursuant to DFAR Section 227.7202 and FAR Section12.212, as applicable. Any use, modification, reproduction, release, performance, display ordisclosure of the Software and accompanying Documentation by the United StatesGovernment shall be governed solely by the terms of this Agreement and shall be prohibitedexcept to the extent expressly permitted by the terms of this Agreement.

11. Export Controls. You acknowledge that the Software is subject to the export control lawsand regulations of the Unites State of America (US), and any amendments thereof. You shallnot export or re-export the Software, directly or indirectly, to (i) any countries that are subjectto US export restrictions (currently including, but not necessarily limited to, Cuba, Iran, Libya,North Korea, Sudan, and Syria); (ii) any end user known, or having reason to be known, willutilize them in the design, development or production of nuclear, chemical or biologicalweapons; or (iii) any end user who has been prohibited from participating in the US exporttransactions by any federal agency of the US government. You further acknowledge thatSoftware may include technical data subject to export and re-export restrictions imposed byUS law.

12. High Risk Activities. The Software is not fault-tolerant and is not designed or intended foruse in hazardous environments requiring fail-safe performance, including without limitation, inthe operation of nuclear facilities, aircraft navigation or communication systems, air trafficcontrol, weapons systems, direct life-support machines, or any other application in which thefailure of the Software could lead directly to death, personal injury, or severe physical orproperty damage (collectively, High Risk Activities). MCAFEE EXPRESSLY DISCLAIMS ANYEXPRESS OR IMPLIED WARRANTY OF FITNESS FOR HIGH RISK ACTIVITIES.

13. Governing Law. This Agreement will be governed by and construed in accordance withthe substantive laws in force: (a) in the State of California, if you purchased the Software in theUnited States, Mexico, Central America, South America, or the Caribbean; (b) in the Republicof Ireland, if you purchased the Software in Canada, Europe, Middle East, Africa, Asia, or theregion commonly known as the Pacific Rim; (c) in Brazil if you purchased the Software inBrazil, (d) in Japan if you purchased the Software in Japan and (e) in China if you purchasedthe Software in China. If you purchased the Software in any other country, then the substantivelaws of the Republic of Ireland shall apply, unless another law is required to be applied. TheUnited States District Court for the Northern District of California and the Superior Court ofSanta Clara County, California, when California law applies, the courts of the Republic ofIreland, when the law of Ireland applies, the courts of Brazil when Brazilian law applies, thecourts of Japan when Japanese law applies, and the courts of China when Chinese law applies,shall each have non-exclusive jurisdiction over all disputes relating to this Agreement. ThisAgreement will not be governed by the conflict of laws rules of any jurisdiction or the UnitedNations Convention on Contracts for the International Sale of Goods, the application of whichis expressly excluded. If you are an individual consumer, this shall not affect any mandatoryright you may have to take action in your country of residence and under the laws of thatcountry.

14. Free Software. This product includes or may include some software programs that arelicensed (or sublicensed) to the user under the GNU General Public License (GPL) or othersimilar licenses which, among other rights, permit the user to copy, modify and redistributecertain programs, or portions thereof, and have access to the source code (Free Softwarelicenses). The GPL requires that for any software covered under the GPL, which is distributedto someone in an executable binary format, that the source code also be made available to

those users. For any such software, the source code is made available in a designated directorycreated by installation of the Software or designated internet page. If any Free Software licensesrequire that McAfee provide rights to use, copy or modify a software program that are broader thanthe rights granted in this agreement, then such rights shall take precedence over the rights andrestrictions herein.

15. Privacy. By entering into this Agreement, you agree that McAfee may collect, retain and useyour personal information, including your name, address, e-mail address, and payment details. Yourpersonal information will be used primarily to provide services and product functionality to you.McAfee may also use your personal information for additional communication with you, subject toyour decision not to accept such communication from McAfee and subject to applicable laws.McAfee engages other companies and individuals (subcontractors) to perform functions on itsbehalf, such as payment processing, order fulfillment, marketing programs and customer service.McAfee may share your information with such subcontractors in order to perform these and otherfunctions, but such subcontractors may not use your personal information for other purposes,unless you agree. By entering into this Agreement, you agree to the transfer of your personalinformation to McAfees offices in the United States, for the purposes stated above. For more detailedinformation on the collection, use and transfer of your personal information, and for information onhow to opt out of or unsubscribe from the communications described above, please read the McAfeeprivacy policy on the McAfee web-site (http://www.McAfee.com).

16. Audit for Volume Licenses. McAfee reserves the right to periodically audit you to ensure thatyou are not using any Software in violation of this Agreement. During standard business hours andupon prior written notice, McAfee may visit you and you will make available to McAfee or itsrepresentatives any records pertaining to the Software. The cost of any requested audit will be solelyborne by McAfee, unless such audit discloses an underpayment or amount due to McAfee in excessof five percent (5%) of the initial license fee for the Software or you are using the Software in anunauthorized manner, in which case you shall pay for the cost of the audit in addition to any otherfees due McAfee based on your violations.

17. Miscellaneous. This Agreement sets forth all rights for the user of the Software and is the entireagreement between the parties. This Agreement supersedes any other communications,representations or advertising relating to the Software and Documentation. This Agreement may notbe modified except by a written addendum issued by a duly authorized representative of McAfee. Noprovision hereof shall be deemed waived unless such waiver shall be in writing and signed byMcAfee. If any provision of this Agreement is held invalid, the remainder of this Agreement shallcontinue in full force and effect.

Vorbehaltlich der Zahlung der geltenden Lizenzgebhren und vorbehaltlichder Bestimmungen dieses Vertrags rumt McAfee Ihnen hiermit eine nicht ausschlieliche, nichtbertragbare Lizenz ein fr die Nutzung der Software auf Computern, die Ihr Eigentum sind oder vonIhnen genutzt werden fr Ihre eigenen persnlichen, nichtkommerziellen Zwecke vorbehaltlich allerEinschrnkungen oder Nutzungsbedingungen, die in der jeweiligen Produktverpackung als Teil derDokumentation enthalten sind. Fr bestimmte Materialien anderer Anbieter, die in der Softwareenthalten sind, knnen andere Bestimmungen gelten, die normalerweise entweder in einerReadme-Datei oder einer Informationsdatei ( Info, About) in der Software aufgefhrt werden.

3. Laufzeit. Sofern dieser Vertrag nicht frher gem den hierin aufgefhrten Bestimmungengekndigt wird, gilt er fr den in der Dokumentation aufgefhrten Zeitraum. Wurde keine Laufzeitvereinbart, so gilt als Standardlaufzeit ein Zeitraum von einem (1) Jahr ab dem Kaufdatum. Wenn Siezugestimmt haben, dass McAfee Ihr Abonnement der Software automatisch durch Belastung einergltigen Kreditkartennummer, die Sie McAfee genannt haben, verlngern darf, wird Ihr Abonnementautomatisch dreiig (30) Tage vor Ablauf der Laufzeit und an jedem nachfolgenden Jahrestag diesesDatums verlngert. Dafr fallen Gebhren in Hhe von hchstens den zu diesem Zeitpunkt geltendenPreisen von McAfee mit Ausnahme von Werbe- und Rabattpreisen an. Sie sind verpflichtet, aktuelle,vollstndige und genaue Angaben fr Ihr Abrechnungskonto zu machen. Sie sind verpflichtet,unverzglich alle Angaben auf den neuesten Stand zu bringen, um die Daten IhresAbrechnungskontos aktuell, vollstndig und genau zu halten (beispielsweise nderung derRechnungsadresse, Kreditkartennummer oder des Ablaufdatums der Kreditkarte), und Sie mssenMcAfee unverzglich unterrichten, wenn Ihre Kreditkarte gesperrt ist (beispielsweise wegen Verlustoder Diebstahl). nderungen dieser Daten knnen unter http://us.mcafee.com/ root/myaccount.aspmitgeteilt werden. Wenn Sie McAfee die oben genannten Informationen nicht liefern, stimmen Sie zu,dass McAfee Ihnen weiterhin alle automatischen Abonnement-Verlngerungen belasten darf, sofernSie nicht den Kundendienst von McAfee unter der Telefonnummer +1-(408)992-8599 oder+1 (866)622-3911 (oder einer anderen lokalen Telefonnummer, die von der jeweiligen McAfee-Niederlassung in Ihrer Region genannt wird) sptestens dreiig (30) Tage vor Auslaufen desAbonnements der Software darber informieren, dass Sie keine automatische Abonnement-Verlngerung wnschen. Dieser Vertrag ist automatisch beendigt, wenn Sie gegen eine derEinschrnkungen oder sonstigen Anforderungen in diesem Vertrag verstoen. Bei Kndigung oderAuslaufen dieses Vertrags sind Sie verpflichtet, die Nutzung der Software einzustellen und alleKopien der Software und der Dokumentation zu vernichten.

4. Aktualisierungen. Diese Lizenz ist auf die von McAfee gelieferte Version der Software beschrnktund umfasst keine Aktualisierungen, sofern nicht ein gesonderter Wartungsvertrag abgeschlossenwird oder Sie ein Service-Abonnement erworben haben, durch das Sie ein Anrecht aufAktualisierungen wie in der Dokumentation beschrieben bekommen. Nach Ablauf des angegebenenZeitraums fr die Wartung oder das Service-Abonnement haben Sie keine weiteren Anrechte aufAktualisierungen ohne den Erwerb eines neuen Wartungsvertrags oder Service-Abonnements.

5. Eigentumsrechte. Die Software ist durch das Urheberrecht der USA und das anderer Staaten, dieBestimmungen internationaler Vertrge und andere anwendbare Rechtsvorschriften in dem Landgeschtzt, in dem sie genutzt wird. McAfee und seine Lieferanten sind und bleiben Eigentmer allerRechte, Ansprche und Interessen an und bezglich der Software, einschlielich aller Urheberrechte,Patente, Geschftsgeheimnisrechte, Marken oder sonstigen geistigen Eigentumsrechte daran. Durchden Besitz, die Installation oder die Nutzung der Software durch Sie werden keine Rechtsansprcheauf das geistige Eigentum an der Software bertragen, und Sie erwerben keine Rechte an derSoftware mit Ausnahme der ausdrcklich in diesem Vertrag genannten Rechte. Auf jeder Kopie derSoftware und Dokumentation, deren Erstellung im Rahmen dieses Vertrags zulssig ist, mssendieselben eigentumsrechtlichen Hinweise erscheinen, die auf und in der Software undDokumentation erscheinen.

6. Verschiedene Umgebungs-Software/Verschiedene Sprach-Software/Duale Medien-Software/Verschiedene Kopien/ Bundles/Updates. Wenn die Software mehrere Plattformen oderSprachen untersttzt, wenn Sie die Software auf mehreren Medien bekommen oder in anderer Weise

Gmehrere Kopien der Software bekommen oder wenn Sie die Software im Paket mit andererSoftware bekommen, so darf die Gesamtanzahl Ihrer Computer, auf denen alle Versionen derSoftware installiert sind, die erlaubte Anzahl nicht bersteigen. Wenn es sich bei der Softwareum die Aktualisierung einer frheren Version der Software handelt, mssen Sie ber einegltige Lizenz fr diese frhere Version verfgen, um die Aktualisierung nutzen zu drfen. Sieknnen die frhere Version der Software auch nach Erhalt der Aktualisierung weiterhin aufIhrem Computer zu Ihrer Untersttzung beim bergang auf die Aktualisierung nutzen, unterder Voraussetzung, dass die Aktualisierung und die frhere Version auf demselben Computerinstalliert werden, die frhere Version oder Kopien davon nicht auf einen anderen Computertransferiert werden, sofern nicht alle Kopien der Aktualisierung ebenfalls auf diesen Computertransferiert werden, und Sie anerkennen, dass alle Verpflichtungen, die McAfeemglicherweise zur Untersttzung fr die frhere Version der Software hat, mit derVerfgbarkeit der Aktualisierung beendet sind.

7. Einschrnkungen. Sie sind nicht berechtigt, die Software an andere zu verkaufen, zuvermieten, zu verleihen, weiterzuverkaufen oder in anderer Weise weiterzugeben, ob mit oderohne Gegenleistung. Sie sind nicht berechtigt, die Software rckzuentwickeln, zudekompilieren oder zu disassemblieren, es sei denn, dass die oben genannte Einschrnkungdurch das geltende Recht ausdrcklich aufgehoben wird. Sie sind nicht berechtigt, dieSoftware ganz oder teilweise abzundern oder darauf basierende abgeleitete Arbeiten zuerstellen. Sie sind nicht berechtigt, die Software oder Dokumentation zu kopieren,ausgenommen soweit in Abschnitt 1 oben ausdrcklich erlaubt. Sie sind nicht berechtigt,Dritten die Nutzung der Software oder der Funktionen der Software auf Timesharing-Basis,ber ein Servicebro oder im Rahmen einer sonstigen Vereinbarung zu genehmigen. Es istIhnen nicht gestattet, Urheberrechtshinweise oder -etiketten auf der Software zu entfernen. Allenicht ausdrcklich in diesem Vertrag aufgefhrten Rechte sind McAfee vorbehalten. Sie sindnicht befugt, elektronische/digitale Inhalte zu sichern, sofern Sie nicht ber ausreichendeRechte im Zusammenhang mit dem gesicherten Inhalt verfgen. Folgendes ist nicht erlaubt:(a) die Software zu illegalen Zwecken zu verwenden; (b) die Software zu verwenden, umDateien, Daten, Bilder oder Programme zu speichern, abzurufen, zu bertragen oderanzuzeigen, die Folgendes enthalten: (i) illegale Bilder, Materialien oder Informationen;(ii) belstigende, beleidigende, missbruchliche, einschchternde, schdliche, vulgre,pornographische, obszne oder in sonstiger Weise unerwnschte Materialen beliebiger Art;(iii) Materialen, die zur Verbung einer kriminellen Straftat anleiten sowie zu Handlungen, dieunter die Haftbarkeit nach dem Zivilrecht fallen oder in sonstiger Weise geltende Gesetze oderVorschriften auf lokaler, nationaler oder internationaler Ebene, auf Ebene des Bundesstaatesverletzen; (iv) jeglicher Code oder Materialien, die die Rechte am geistigen Eigentum andererverletzen; (v) temporre Windows-Dateien jeglicher Art (einschlielich, aber ohneBeschrnkung auf smtliche *.p- und ~*.*-Dateien); oder (vi) smtliche Viren, Wrmer,Trojaner oder andere Programme mit hnlichen schdlichen Funktionen.

8. Garantie und Haftungsausschluss.a Eingeschrnkte Garantie. McAfee garantiert (Herstellergarantie) fr einen Zeitraum von

sechzig (60) Tagen ab dem Datum des ursprnglichen Kaufs, dass die Software imWesentlichen gem der Dokumentation arbeitet und dass gegebenenfalls die Medien(z. B. CD-ROM), auf denen die Software fr Sie bereitgestellt wird, frei von Material- undVerarbeitungsfehlern sind.

b Rechtsmittel des Kunden. Die gesamte Haftung von McAfee und seinen Lieferanten undIhr ausschlieliches Rechtsmittel bei einer Verletzung der oben genannten Garantie bestehtnach der Entscheidung von McAfee entweder (1) in der Rckerstattung des gegebenenfallsfr die Lizenz bezahlten Kaufpreises oder (ii) im Ersatz der fehlerhaften Medien, auf denendie Software enthalten ist. Sie sind verpflichtet, die fehlerhaften Medien auf Ihre Kosten amOrt des Kaufs zusammen mit einer Kopie des Kaufbelegs zurckzugeben. Dieseeingeschrnkte Garantie ist nichtig, wenn der Mangel aus einem Unfall, einermissbruchlichen Nutzung oder fehlerhaften Anwendung resultiert. Fr alle Ersatzmedien

Mit Ausnahme der in diesem Vertrag dargelegten eingeschrnktenGarantie WIRD DIESE SOFTWARE WIE VORHANDEN BEREITGESTELLT, UND MCAFEE GIBTKEINE GARANTIE BEZGLICH IHRER NUTZUNG ODER LEISTUNG. 9. Haftungsbeschrnkung. Diese Einschrnkung gilt nicht fr die Haftung imTodesfall oder im Fall von Personenverletzungen, soweit das geltende Recht eine solcheEinschrnkung nicht zulsst. In einigen Lndern sind darber hinaus der Ausschluss oder dieEinschrnkung von zuflligen oder Folgeschden nicht zulssig, so dass der oben genannteAusschluss oder die oben genannte Einschrnkung mglicherweise nicht fr Sie gelten. Mit keinerAussage in diesem Vertrag wird die Haftung von McAfee gegenber Ihnen fr den Fall von groberFahrlssigkeit oder Betrug durch McAfee eingeschrnkt. McAfee handelt im Namen seinerLieferanten und autorisierten Partner hinsichtlich der Zurckweisung, des Ausschlusses und/ oderder Einschrnkung von Pflichten, Garantie und Haftung wie in diesem Vertrag dargelegt, jedoch nichtin anderer Hinsicht oder fr andere Zwecke. Die vorstehenden Bestimmungen sind imhchstmglichen Umfang durchsetzbar, den das geltende Recht zulsst.

10. Hinweis fr Endbenutzer der US-Regierung. Die Software und die begleitende Dokumentationsind als kommerzielle Computersoftware und kommerzielle Computersoftware-Dokumentationgem den US-Vorschriften DFAR, Abschnitt 227.7202 und FAR, Abschnitt 12.212 zu betrachten.Jede Nutzung, Abnderung, Reproduktion, Freigabe, Leistung, Anzeige oder Offenlegung derSoftware und der begleitenden Dokumentation durch die Regierungsbehrden der USA unterliegtausschlielich den Bestimmungen dieses Vertrags und ist mit Ausnahme des in dem durch dieBestimmungen dieses Vertrags ausdrcklich zulssigen Umfangs verboten.

G11. Exportvorschriften. Sie erkennen an, dass die Software den Exportgesetzen und -beschrnkungen der USA und den entsprechenden Zustzen unterliegt. Sie sind nichtberechtigt, die Software direkt oder indirekt zu exportieren oder zu reexportieren (i) in Lnder,die den US-Exportbeschrnkungen unterliegen (derzeit unter anderem Kuba, Iran, Libyen,Nordkorea, Sudan und Syrien); (ii) an Endbenutzer, von denen bekannt ist, dass sie dieSoftware fr das Entwerfen, Entwickeln oder die Herstellung von nuklearen, chemischen oderbiologischen Waffen verwenden oder verwenden knnten; oder (iii) an smtliche Endbenutzer,denen die Beteiligung an den US-Exportaktivitten durch eine Regierungsstelle der US-Regierung untersagt wurde. Sie erkennen auerdem an, dass die Software technische Datenenthalten kann, die den Beschrnkungen fr den Export- und Reexport durch US-Gesetzeunterliegen.

12. Aktivitten mit hohem Risiko. Die Software ist nicht fehlertolerant und nicht zur Nutzungin gefhrlichen Umgebungen konzipiert oder gedacht, die einen absolut fehlerfreien Betrieb(Fail-Safe) erfordern, einschlielich, ohne Beschrnkung darauf, der Betrieb inNuklearanlagen, bei der Flugzeugnavigation oder in Kommunikationssystemen, in derLuftraumkontrolle, in Waffensystemen, lebenserhaltenden Maschinen oder anderenAnwendungen, in denen ein Versagen der Software unmittelbare Gefahren fr Leib oder Lebenoder erhebliche Sach- und Umweltschden nach sich ziehen kann (zusammen Aktivitten mithohem Risiko). 13. Magebliches Recht. Magebliches Recht fr diesen Vertrag, nach dem er auszulegenist, sind die geltenden materiellen Gesetzesvorschriften: (a) des US-Bundesstaates Kalifornien,wenn Sie die Software in den USA, Mexiko, Zentralamerika, Sdamerika oder der Karibikerworben haben, (b) der Republik Irland, wenn Sie die Software in Kanada, Europa, dem NahenOsten, Afrika, Asien oder dem allgemein als pazifischer Raum bezeichneten Gebiet erworbenhaben, (c) von Brasilien, wenn Sie die Software in Brasilien erworben haben, (d) von Japan,wenn Sie die Software in Japan erworben haben, und (e) von China, wenn Sie die Software inChina erworben haben. Wenn Sie die Software in einem anderen Land erworben haben, geltendie materiellen Gesetzesvorschriften der Republik Irland, sofern nicht die Anwendung andererRechtsvorschriften erforderlich ist. Der United States District Court for the Northern District ofCalifornia und der Superior Court of Santa Clara County, Kalifornien, sofern das kalifornischeRecht mageblich ist, die Gerichte der Republik Irland, sofern das irische Recht mageblichist, die Gerichte von Brasilien, sofern das brasilianische Recht mageblich ist, die Gerichte vonJapan, sofern das japanische Recht mageblich ist, und die Gerichte von China, sofern daschinesische Recht mageblich ist, verfgen ber die nicht ausschlieliche Gerichtsbarkeit imHinblick auf alle Streitigkeiten aus diesem Vertrag. Die Anwendung der Kollisionsnormen und -grundstze eines Hoheitsgebiets sowie des bereinkommens der Vereinten Nationen ber deninternationalen Warenverkauf wird ausdrcklich ausgeschlossen. Wenn Sie ein einzelnerVerbraucher sind, beeintrchtigt dies nicht Ihre gesetzlich verankerten Rechte zur Einleitungjuristischer Schritte in dem Land Ihrer Niederlassung gem dem Recht dieses Landes.

14. Kostenlose Software. Dieses Produkt kann bestimmte Softwareprogramme enthalten, dieim Rahmen der GNU General Public License (GPL) oder hnlichen Lizenzen lizenziert sind,gem denen es dem Benutzer gestattet ist, bestimmte Programme oder Teile davon zukopieren, zu verndern und weiterzugeben und auf den Quellcode der Software zuzugreifen(Freie Software-Lizenzen). Die GPL fordert, dass mit jeder durch die GPL abgedecktenSoftware, die an einen anderen Benutzer im ausfhrbaren Binrformat weitergegeben wird,gleichzeitig auch der Quellcode diesem Benutzer verfgbar gemacht wird. Fr derartigeSoftware steht der Quellcode in einem Verzeichnis, das bei Installation der Software erstelltwird, oder auf der angegebenen Webseite zur Verfgung. Wenn Lizenzen fr freie Software eserforderlich machen, dass McAfee Rechte zur Nutzung, Kopie oder Abnderung einesSoftwareprogramms bereitstellt, die ber die in diesem Vertrag eingerumten Rechte

hinausgehen, so haben diese Rechte Vorrang vor den Rechten und Einschrnkungen aus diesemVertrag.

15. Datenschutz. Durch Abschluss dieses Vertrags erklren Sie sich damit einverstanden, dassMcAfee Ihre persnlichen Daten, zu denen Name, Adresse, E-Mail-Adresse und Zahlungsdetailsgehren, erfassen, speichern und nutzen darf. Ihre persnlichen Daten werden in erster Linie zurBereitstellung von Serviceleistungen und Produktfunktionen fr Sie genutzt. McAfee darf Ihrepersnlichen Daten auch fr die zustzliche Kommunikation mit Ihnen nutzen, vorbehaltlich IhrerEntscheidung, eine solche Kommunikation von McAfee nicht anzunehmen und vorbehaltlich desgeltenden Rechts. McAfee beauftragt andere Unternehmen und Einzelpersonen (Auftragnehmer)mit der Ausfhrung von Aufgaben im Namen von McAfee, beispielsweise Verarbeitung vonZahlungen, Auftragsbearbeitung, Marketing-programme und Kundendienst. McAfee kann Ihre Datenan solche Auftragnehmer zur Erfllung dieser und anderer Aufgaben weitergeben, aber dieseAuftragnehmer sind nicht berechtigt, Ihre persnlichen Daten fr andere Zwecke zu nutzen, sofernSie einer solchen Nutzung nicht zustimmen. Durch Abschluss dieses Vertrags erklren Sie sich mitder Weitergabe Ihrer persnlichen Daten fr die oben genannten Zwecke an die Niederlassungen vonMcAfee in den USA einverstanden. Ausfhrliche Informationen zur Erfassung, Nutzung undWeitergabe Ihrer persnlichen Informationen und Informationen dazu, wie Sie aus der obengenannten Kommunikation aussteigen oder sich davon abmelden knnen, finden Sie in derDatenschutzerklrung von McAfee auf der Website von McAfee (http://www.McAfee.com).

16. Prfung fr Volumenlizenzen. McAfee behlt sich das Recht vor, in regelmigen Abstndeneine Prfung bei Ihnen vorzunehmen, um sicherzustellen, dass Sie keine Software unter Verletzungdieses Vertrags nutzen. Whrend der normalen Geschftszeiten und nach vorheriger schriftlicherMitteilung kann McAfee Sie besuchen. Sie machen bei einem solchen Besuch McAfee oder seinenVertretern alle Unterlagen bezglich der Software zugnglich. Die Kosten fr die erbetene Prfungtrgt ausschlielich McAfee, sofern bei einer solchen Prfung nicht eine Unterzahlung oder eine anMcAfee fllige Summe festgestellt wird, die fnf Prozent (5%) der anfnglichen Lizenzgebhren frdie Software bersteigt, oder wenn festgestellt wird, dass Sie die Software in nicht genehmigterWeise nutzen. In diesen Fllen bezahlen Sie die Kosten der Prfung sowie alle zustzlichenGebhren, die in diesem Zusammenhang anfallen.

17. Verschiedenes. In diesem Vertrag werden alle Rechte fr den Benutzer der Software dargelegt.Es handelt sich dabei um die gesamte Vereinbarung zwischen den Parteien. 1. Dfinitions.a Le Logiciel comprend (a) l'ensemble du contenu des fichiers, disques, CD-ROM ou

autres supports (y compris les supports lectroniques) fournis avec le prsent Accord,ainsi que tout autre contenu propos par McAfee ou ses distributeurs, revendeurs,partenaires OEM/MSP ou commerciaux (rassembls sous la mention Partenaire(s)autoris(s) ), y compris, mais sans restriction : (i) les documentations ou logicielsinformatiques de McAfee ou d'un tiers ; (ii) toute explication sous forme imprime,lectronique ou en ligne ( Documentation ) ; (b) les mises niveau, les versionsmodifies ou ultrieures et les mises jour (rassembles sous la mention Mises jour ) ainsi que les logiciels faisant l'objet d'un accord de licence entre vous et McAfee(ou tout Partenaire autoris ) dans le cadre d'une souscription un accord demaintenance ou un service.

b Les termes Utiliser et Utilisation se rfrent l'accs, l'installation, autlchargement, la copie ou toute autre mise profit du Logiciel.

c L'expression Nombre autoris se rapporte au chiffre (1), sauf indication contrairestipule dans une licence valide (licence de volume, par exemple) accorde par McAfee oupar un de ses Partenaires autoriss.

Sous rserve du paiement des droits de licence applicables, des termesdfinis et de toutes les mentions de restrictions ou conditions de l'emballage du produitincluses dans le cadre de la Documentation, McAfee vous accorde par le prsent Accord undroit incessible et non exclusif d'utilisation du Logiciel sur des ordinateurs en votre possessionou sous votre contrle, pour votre usage personnel l'exclusion de tout usage commercial.Certains matriaux tiers incorpors au Logiciel peuvent tre soumis d'autres modalits,gnralement stipules dans le fichier Read Me ou A propos de.

3. Dure. Le prsent Accord restera en vigueur jusqu' ce qu'il y soit mis fin, conformment auxdispositions de la Documentation, sauf mention contraire dans les prsentes. Si aucune dure n'estmentionne, l'Accord restera en vigueur un (1) an compter de la date d'achat. Si vous autorisezMcAfee proroger automatiquement votre abonnement au Logiciel par le biais d'un numro de cartede crdit valide, ledit abonnement sera renouvel trente (30) jours avant expiration de la duredfinie et ce, chaque anne, pour un montant gal au tarif alors applicable de McAfee (hormis en casd'offre promotionnelle et de rduction). Vous devez fournir des informations de facturationcorrectes, prcises et compltes. Vous devez rgulirement mettre ces informations jour, afinqu'elles restent compltes, correctes et prcises (notamment l'adresse de facturation, le numro decarte de crdit ainsi que sa date d'expiration). En outre, vous devez signaler McAfee touteannulation de votre carte de crdit ( la suite d'un vol ou d'une perte, par exemple). Ces informationspeuvent tre modifies l'adresse suivante : http://us.mcafee.com/root/myaccount.asp. En nefournissant pas lesdites informations, vous autorisez McAfee poursuivre les prlvementsautomatiques effectus titre de renouvellement de l'abonnement. Pour y mettre fin, contactez lesupport client de McAfee (au 408992-8599 ou au 866622-3911 ou tout autre numro fourni parl'entit McAfee de votre pays) au minimum trente (30) jours avant la fin de votre abonnement. Leprsent Accord prend automatiquement fin si vous ne vous conformez pas l'une des restrictions ouaux autres exigences dcrites dans ce document. En cas de rsiliation ou d'expiration du prsentAccord, vous devez dtruire toutes les copies du Logiciel et de la Documentation.

4. Mises jour. Cette licence se limite la version du Logiciel fournie par McAfee et n'inclut pas lesMises jour, sauf si vous avez acquis sparment un accord de maintenance ou si vous vous tesabonn un service vous permettant d'accder aux Mises jour, conformment aux termes de laDocumentation. A la fin de la priode spcifie de maintenance ou d'abonnement aux services, vousn'tes plus autoris recevoir des Mises jour, moins de souscrire un nouvel accord demaintenance ou de vous abonner un service.

5. Droits de proprit. Le Logiciel est protg par les lois sur le droit d'auteur et le copyright, ainsique par certains articles de traits internationaux et autres lois applicables dans le pays concern parson utilisation. McAfee et ses distributeurs sont les dtenteurs exclusifs de l'ensemble des droits,titres et intrts associs au Logiciel, y compris les droits d'auteur, les brevets, les droits deconfidentialit, les marques commerciales et les autres droits de proprit intellectuelle mentionnsdans le prsent Accord. Vous acceptez que le fait de possder, d'installer ou d'utiliser le Logiciel nevous concde en aucun cas les droits de proprit intellectuelle du Logiciel et les droits lis auLogiciel, l'exception des cas expressment mentionns dans le prsent Accord. Vous acceptezgalement que toutes les copies du Logiciel et de la Documentation doivent contenir les mmesindications de droits de proprit que sur le Logiciel et la Documentation.

6. Logiciels environnements multiples/Logiciels langues multiples/Logiciels doublesupport/Copies multiples/Offres groupes/Mises jour. Si le Logiciel prend en charge plusieursplates-formes ou langues, si vous disposez de plusieurs supports de ce Logiciel, si vous disposez deplusieurs copies de ce Logiciel ou si ce Logiciel fait partie d'une offre groupe, toutes les versions duLogiciel ne doivent pas tre installes sur un nombre total d'Ordinateurs suprieur au Nombreautoris. Si le Logiciel est la Mise jour d'une version prcdente, vous devez disposer d'une licencevalide de cette dernire pour pouvoir utiliser la Mise jour. Vous pouvez utiliser la versionprcdente du Logiciel dans le but de procder la Mise jour sur votre Ordinateur, tant que laditeversion et la Mise jour se trouvent sur le mme Ordinateur. Vous ne pouvez pas installer la versionprcdente du Logiciel (ou une copie de cette dernire) sur un autre Ordinateur, sauf si voustransfrez galement l'ensemble des copies de la Mise jour sur ce mme Ordinateur. Vousreconnaissez galement que les obligations contractes par McAfee concernant le support produit dela version prcdente prennent fin ds l'application de la Mise jour.

7. Restrictions. Vous ne pouvez pas vendre, cder titre d'un crdit-bail, concder sous licence,louer, prter, revendre ou transfrer de quelque manire que ce soit, titre gratuit ou onreux, leLogiciel. Vous n'tes pas non plus autoris dcompiler ou dsassembler le Logiciel, ni enrechercher le secret de fabrication, sauf si la prsente limitation est expressment interdite par la loi

en vigueur. Vous ne pouvez pas modifier ou crer de travaux drivs en totalit ou en partie duLogiciel. Vous ne pouvez pas copier le Logiciel ou la Documentation, sauf indication expressedans la section 1 ci-avant. Il est interdit d'autoriser un tiers bnficier de l'utilisation ou desfonctionnalits du Logiciel par l'intermdiaire d'une exploitation en temps partag, d'un bureaude services ou de toute autre disposition. Vous ne pouvez pas supprimer les notes ou libellsde proprit du Logiciel. Tous les droits non expressment mentionns dans le prsent Accordsont des droits rservs de McAfee. Vous ne pouvez pas effectuer une copie de sauvegarde ducontenu lectronique/numrique si vous ne possdez pas les droits juridiques ncessairespour le faire. Vous ne pouvez pas : (a) utiliser le Logiciel des fins illgales ; (b) utiliser lelogiciel pour enregistrer, extraire, transmettre ou visualiser des fichiers, donnes, images ouprogrammes contenant (i) des images, documents ou informations non autoris(e)s ; (ii) desdocuments, quels qu'en soient le type et la nature, caractre vexatoire, calomnieux, injurieux,menaant, malfaisant, vulgaire, pornographique, obscne ou choquant de toute autre manire ;(iii) des documents encourageant des conduites pouvant constituer un dlit, engager laresponsabilit civile ou enfreindre de toute autre manire une loi ou rglementation locale,nationale ou internationale ; (iv) des codes ou documents en violation des droits de propritintellectuelle de tiers ; (v) des fichiers temporaires Windows de tout type (y compris, mais sansrestriction, les fichiers *.p ou ~*.*) ; (vi) des virus, vers, chevaux de Troie et autresprogrammes contaminants ou destructeurs.

8. Garantie et limitation de garantie.a Garantie limite dans le temps. McAfee se porte garant du bon fonctionnement du

Logiciel, pendant soixante (60) jours compter de la date d'achat, selon les dispositionsde la Documentation, et garantit que le support sur lequel le Logiciel est distribu (CD-ROM, par exemple) est exempt de dfauts, tant au niveau des matriaux que de lafabrication.

b Recours de l'utilisateur. En cas de non-conformit aux termes de la garantie limite, lesresponsabilits de McAfee et de ses distributeurs et les droits de l'utilisateur se limiteront, la discrtion de McAfee, soit au (i) remboursement du prix d'achat pay pour les droitsde licence, soit au (ii) remplacement du support dfectueux sur lequel le Logiciel estdistribu. Vous devez retourner le support dfectueux votre distributeur, vos frais, enjoignant la copie d'un justificatif d'achat. Cette garantie limite n'est pas applicable si ladfectuosit rsulte d'un accident, d'un abus ou d'une utilisation non conforme l'usageprvu. Tout support de remplacement sera garanti pendant le reste de la priode degarantie originale. En dehors des Etats-Unis, ce recours n'est pas applicable dans lamesure o McAfee fait l'objet de restrictions conformment aux lois et aux rglementsrelatifs l'exportation en vigueur aux Etats-Unis.

c Limitation de garantie. Except pour la garantie limite stipule dans le prsentdocument, LE LOGICIEL EST FOURNI EN L'ETAT . MCAFEE N'OFFRE AUCUNEGARANTIE QUANT A SON UTILISATION OU A SES PERFORMANCES. A L'EXCEPTION DESGARANTIES, CONDITIONS, REPRESENTATIONS OU DUREES NE POUVANT ETREEXCLUES OU LIMITEES PAR LA LOI APPLICABLE, MCAFEE, SES FOURNISSEURS ET SESPARTENAIRES AUTORISES N'OFFRENT AUCUNE GARANTIE, CONDITION,REPRESENTATION OU DUREE (EXPRESSE OU IMPLICITE, TANT PAR STATUT QUE PARDROIT COMMUN, COUTUME, USAGE OU AUTRE) CONCERNANT ENTRE AUTRES LERESPECT DES DROITS DE TIERCES PARTIES, LA QUALITE COMMERCIALE,L'INTEGRATION OU L'ADEQUATION DU PRODUIT A UN USAGE PARTICULIER. VOUSETES RESPONSABLE DU CHOIX DU LOGICIEL EN FONCTION DES OBJECTIFS PREVUS,DE L'INSTALLATION ET DE L'UTILISATION DU LOGICIEL AINSI QUE DES RESULTATSOBTENUS PAR SON INTERMEDIAIRE. SANS LIMITATION DES PRESENTESDISPOSITIONS, MCAFEE NE GARANTIT PAS L'ABSENCE DE VICE DE FORME,D'INTERRUPTIONS OU D'AUTRES PROBLEMES, NI LA REPONSE DU LOGICIEL A VOSBESOINS.

EN AUCUN CAS, LARESPONSABILITE DE MCAFEE OU DE SES PARTENAIRES AUTORISES/FOURNISSEURS NEPOURRA EXCEDER LE PRIX D'ACHAT DU LOGICIEL, LE CAS ECHEANT, MME SI MCAFEE, SESPARTENAIRES AUTORISES OU SES FOURNISSEURS ONT ETE PREVENUS DE L'EVENTUALITE DETELS DOMMAGES. Cette limitation de responsabilit ne s'applique pas la responsabilit deblessure corporelle ou mortelle, dans la mesure o la lgislation en vigueur interdit une tellelimitation. En outre, certaines juridictions n'autorisant pas l'exclusion ou la limitation desresponsabilits pour les dommages accidentels ou conscutifs, il se peut que cette limitation et cetteexclusion ne s'appliquent pas votre cas. Aucun lment prvu dans le prsent Accord ne limite laresponsabilit de McAfee en cas de faute lourde ou de dlit civil occasionn par McAfee. McAfee agitau nom de ses fournisseurs/Partenaires autoriss uniquement dans le cadre de la limitation et/ou del'exclusion des obligations, garanties et responsabilits stipules dans le prsent Accord. Lesprsentes dispositions seront appliques dans les limites maximales autorises par la lgislation envigueur.

10. A l'attention des utilisateurs finaux faisant partie du gouvernement des Etats-Unis. LeLogiciel et la Documentation qui l'accompagne sont appels respectivement logiciel informatiquecommercial et documentation de logiciel informatique commercial , conformment auxparagraphes DFAR 227.7202 et FAR 12.212 en vigueur. Toute utilisation, modification, reproduction,diffusion, excution, prsentation ou divulgation du Logiciel et de la Documentation quil'accompagne par le gouvernement des Etats-Unis sera uniquement rgie par les termes du prsentAccord et sera interdite en dehors des limites expressment autorises par les termes du prsentAccord.

11. Contrle des exportations. Vous reconnaissez que le Logiciel est soumis la lgislation et larglementation (y compris les amendements affrents) des Etats-Unis d'Amrique ( USA ) surl'exportation. Vous vous engagez ne pas exporter ou rexporter le Logiciel, directement ouindirectement, vers (i) tout pays soumis des restrictions d'exportations de la part des Etats-Unis(notamment l'heure actuelle, mais de faon non limitative, Cuba, l'Iran, la Libye, la Core du Nord,le Soudan et la Syrie) ; (ii) tout utilisateur final voulant ou suspect de vouloir l'utiliser pourconcevoir, dvelopper ou produire des armes nuclaires, chimiques ou biologiques ; (iii) toututilisateur final faisant l'objet d'une interdiction de participer aux transactions d'exportationamricaines de la part d'une agence fdrale ou du gouvernement amricain. En outre, vousreconnaissez que le Logiciel peut inclure des donnes techniques soumises des restrictionsd'exportation et de rexportation imposes par la lgislation des Etats-Unis.

12. Activits haut risque. Le logiciel n'est pas exempt de dfaillances et n'est pas conu pour treutilis dans des environnements dangereux ncessitant des performances sres (usines nuclaires,systmes de navigation ou de communication arienne, contrle du trafic arien, systmesd'armement, machines directement lies la vie) ou toute autre application dans laquelle ladfaillance du logiciel pourrait directement entraner la mort, une blessure corporelle, de gravessquelles physiques ou des dgts matriels importants (activits appeles collectivement Activits hauts risques ). MCAFEE EXCLUT EXPRESSEMENT TOUTE GARANTIE EXPRESSE OUIMPLICITE D'ADEQUATION DE SON PRODUIT AUX ACTIVITES A HAUTS RISQUES.

13. Loi en vigueur. Le prsent Accord sera rgi par les lois applicables dans les pays/Etatssuivants : (a) Etat de Californie, si vous avez achet le Logiciel aux Etats-Unis, au Mexique, enAmrique centrale, en Amrique du Sud ou dans un pays des Carabes ; (b) Rpublique d'Irlande, si

Si vous avez achet le Logicieldans un autre pays/Etat, les lois en vigueur en Rpublique d'Irlande s'appliquent (sauf si uneautre lgislation doit s'appliquer). Les litiges se rapportant au prsent Accord entrent dans lajuridiction non exclusive des cours suivantes : United States District Court for the NorthernDistrict of California et Superior Court of Santa Clara County, Californie (lorsque la lgislationcalifornienne s'applique) ; Cours de Rpublique d'Irlande (lorsque la lgislation irlandaises'applique) ; Cours brsiliennes (lorsque la lgislation brsilienne s'applique) ; Cours du Japon(lorsque la lgislation japonaise s'applique) ; Cours de Chine (lorsque la lgislation chinoises'applique). Le prsent Accord ne sera pas rgi par le conflit des principes de lgislation den'importe quelle juridiction, ni par la Convention de contrats des Nations Unies pour la venteinternationale de marchandises (application expressment exclue). Si vous tes unconsommateur individuel, vous conservez le droit inalinable de prendre les mesures quis'imposent dans votre pays de rsidence, tout en restant soumis aux lois de ce pays.

14. Logiciels gratuits. Ce produit intgre ou peut intgrer certains logiciels couverts par unaccord de licence (ou de sous-licence) conclu avec l'utilisateur dans le cadre de la Licencepublique gnrale (GPL) GNU ou d'autres licences similaires autorisant l'utilisateur , entreautres, copier, modifier et redistribuer certains programmes ou certaines parties deprogramme, et accder au code source ( Licences de logiciels gratuits ). La Licencepublique gnrale exige, pour tous les logiciels qu'elle couvre et qui sont distribus au formatbinaire excutable, que le code source soit galement mis la disposition des utilisateurs.Pour tout logiciel de ce type, le code source est mis disposition dans un rpertoire dsigncr lors de l'installation du Logiciel ou sur une page Internet dsigne. Si des Licences delogiciels gratuits requirent que McAfee accorde un droit d'utilisation, de copie ou demodification d'un logiciel plus tendu que celui octroy dans le prsent Accord, ce droit primesur les droits et restrictions du prsent Accord.d in this agreement, then such rights shall takeprecedence over the rights and restrictions herein.

15. Confidentialit. En acceptant le prsent Accord, vous autorisez McAfee utiliser vosdonnes personnelles, y compris vos nom, adresse, adresse lectronique et informationsbancaires. Ces informations seront utilises pour fournir des services et garantir lafonctionnalit de votre produit. McAfee peut galement utiliser vos donnes personnelles pourvous envoyer des messages supplmentaires, condition que vous ayez exprim votre accord,dans le respect de la lgislation applicable. McAfee engage d'autres entreprises et des sous-traitants pour effectuer en son nom des oprations telles que la mise en paiement, letraitement des commandes, la commercialisation des programmes et le service client. McAfeese rserve le droit de transmettre vos donnes personnelles auxdits sous-traitants, afin queceux-ci effectuent ces oprations. Toutefois, ils ne seront pas autoriss utiliser cesinformations d'autres fins sans votre accord. En acceptant le prsent Accord, vous autorisezMcAfee transmettre vos donnes personnelles ses bureaux situs aux Etats-Unis, pour lesraisons susmentionnes. 1. Definiciones.a Software hace referencia a (a) todos los contenidos de los archivos, disco(s), CD-

ROM(s) o cualquier otro soporte (incluidos los soportes electrnicos) con los que seotorga el presente Contrato o aquellos contenidos que ofrezca McAfee o susdistribuidores, vendedores, socios OEM/MSP o cualquier otro socio comercial (de formacolectiva, el/los Socio(s) autorizado(s) incluidos, pero sin limitarse a ellos: (i) lainformacin de equipos de McAfee u otros proveedores; (ii) los materiales explicativosrelacionados, ya sea impresos, electrnicos o en lnea (la Documentacin) y (b) lasmejoras, versiones posteriores o modificadas y actualizaciones (de forma colectiva, lasActualizaciones) y el Software, si lo hubiera, que McAfee o un Socio autorizado le hayaotorgado con una licencia como parte de un contrato de mantenimiento o suscripcin deservicio.

b Uso o Utilizar hace referencia a tener acceso a instalar, descargar, copiar o, de otromodo, beneficiarse del uso del Software.

c Nmero permitido hace referencia a uno (1) salvo disposicin en contra en una licenciavlida (por ejemplo, licencia de volumen) otorgada por McAfee o un Socio autorizado.

d Equipo hace referencia a un dispositivo que acepta informacin en formato digital osimilar, y que manipula dicha informacin para obtener un resultado especfico basado enuna secuencia de instrucciones.

e McAfee hace referencia a (a) McAfee, Inc., una sociedad comercial de Delaware, conoficinas ubicadas en 3965 Freedom Circle, Santa Clara, California 95054 en caso deadquirir el Software en los Estados Unidos, Mxico, Amrica Central, Sudamrica o elCaribe; (b) McAfee Ireland Limited, con oficinas ubicadas en 11 Eastgate Business Park,Little Island, Cork, Ireland en caso de adquirir el Software en Canad, Europa, el MedioOriente, frica, Asia o los pases de la costa del Pacfico; (c) McAfee do Brasil Comrcio deSoftware Ltda., con oficinas ubicadas en Rua General Flausino Gomes 78, conj. 51, SaoPaulo, SP, Brazil en caso de adquirir el Software en Brasil; (d) McAfee Co., Ltd. con oficinasubicadas en Shibuya Mark City West Building 12-1, Dogenzaka 1-Chrome, Shibuya-ku,Tokyo 150-0043, Japan en caso de adquirir el Software en Japn y (e) McAfee (Shanghai)Software Co. Ltd., con oficinas ubicadas en Room 601 AE-13, Bldg. 2, No. 351,Goushoujing Toad, Zhangliang High-tech Park, Pudong, Shanghai China en caso deadquirir el Software en China.

2. Concesin de licencia. Sujeta al pago de las tasas de licencia aplicables y de conformidadcon los trminos y condiciones de este Contrato, por el presente, McAfee le concede unalicencia no transferible y no exclusiva para Utilizar el Software en Equipos de su propiedad o

bajo su control para su Uso personal y no comercial conforme a cualquier restriccin o trminos ycondiciones de Uso especificados en el paquete de productos aplicable que forma parte de laDocumentacin. Algunos materiales de otros proveedores que se incluyen en el Software podrnestar sujetos a otros trminos y condiciones, que se suelen encontrar en los archivos Read Me(Lame) o About (Acerca de) del Software.

3. Plazo. A menos que se resuelva un vencimiento anterior a lo establecido en el presentedocumento, este Contrato estar en vigor durante el plazo establecido en la Documentacin. En casode no acordarse ningn plazo, el plazo predeterminado ser de un (1) ao a partir de la adquisicin.Si est de acuerdo en permitir que McAfee renueve automticamente su suscripcin del Software alcargar el nmero de tarjeta de crdito vlido que le ha suministrado a McAfee, su suscripcin serenovar automticamente con treinta (30) das de antelacin a la fecha de vencimiento del plazo yde forma anual por una tasa que no exceder el precio actual en ese momento de McAfee, sin incluirlos descuentos y promociones. Deber proporcionar informacin precisa, completa y actual para sucuenta de facturacin. Deber actualizar con la mayor brevedad posible toda la informacin a efectosde mantener su cuenta de facturacin precisa, completa y actual (como un cambio del domicilio dela facturacin, del nmero de tarjeta de crdito o de la fecha de vencimiento de la tarjeta de crdito)y, asimismo, deber notificar de inmediato a McAfee si su tarjeta de crdito se encuentra cancelada(por ejemplo, por prdida o robo). Los cambios de dicha informacin se pueden realizar enhttp://us.mcafee.com/root/myaccount.asp. En caso de no proporcionar la informacin anterior aMcAfee, acuerda que McAfee podr continuar cobrndole en concepto de cualquier suscripcin quese renovara automticamente a menos que usted informe al Departamento de Atencin al Cliente deMcAfee en el telfono (408)992-8599, o bien en el (866)622-3911 (o cualquier nmero localproporcionado por la entidad de McAfee que corresponda a su regin), de la no renovacin de sususcripcin al Software en un plazo mnimo de treinta (30) das previo al vencimiento de sususcripcin al Software, y de su intencin de no contar con la renovacin automtica de dichasuscripcin. Este Contrato se resolver automticamente en el supuesto de que usted no cumpla conalguna de las restricciones u otros requisitos descritos en el presente documento. Tras la resolucino vencimiento de este Contrato, deber dejar de Utilizar el Software y destruir todas las copias delSoftware y la Documentacin.

4. Actualizaciones. Esta licencia est limitada a la versin del Software suministrada por McAfee yno incluye Actualizaciones, a menos que se suscriba a un contrato de mantenimiento independienteo que haya adquirido una suscripcin de servicio que le permita realizar Actualizaciones segn loestipulado en la Documentacin. Una vez finalizado el periodo de mantenimiento o la suscripcin deservicio especificada, no tendr derecho a recibir Actualizaciones sin la suscripcin de un contratode mantenimiento nuevo o de servicio.

5. Derechos de titularidad. El Software se encuentra protegido por las leyes de copyright de losEstados Unidos o por cualquier otra ley similar, por disposiciones de tratados internacionales y porcualquier otra ley aplicable en el pas en donde se utilice. McAfee y sus proveedores se reservan latitularidad y la propiedad del Software, as como todos los derechos del mismo, incluidos todos losderechos de copyright, patentes, derechos de secretos comerciales, marcas comerciales y cualquierotro derecho de propiedad intelectual relacionado con dicho Software. La posesin, la instalacin oel Uso del Software no le transfiere ninguna titularidad sobre la propiedad intelectual del Software.Asimismo, no podr adquirir ningn derecho sobre el Software excepto los expresamente descritosen el presente Contrato. Se compromete a incluir en todas las copias autorizadas del Software y de laDocumentacin la misma notificacin de propiedad intelectual que aparece en el Software y laDocumentacin.

6. Software de varios entornos/Software multilinge/Software de soporte dual/Copias/Paquetes/Actualizaciones mltiples. Si el Software es compatible con varias plataformas o idiomas; si ustedrecibe el Software en varios soportes; si, de otro modo, recibe varias copias del Software; o si recibeel Software integrado con otro software, el nmero total de Equipos en los que se instalan todas lasversiones del Software no podr exceder el Nmero permitido. Si el Software es una Actualizacin deuna versin anterior, usted deber poseer una licencia vlida de dicha versin anterior para poder

Utilizar la Actualizacin. Podr Utilizar la versin anterior del Software en su Equipo tras recibirla Actualizacin para ayudarle en la transicin a la Actualizacin, siempre y cuando laActualizacin y la versin anterior se instalen en el mismo Equipo; la versin anterior o lascopias del Software no se transferirn a otro Equipo a menos que todas las copias de laActualizacin tambin se transfieran a dicho Equipo; y usted reconozca que cualquierobligacin que McAfee pudiera tener para admitir la versin anterior del Software se extinguecon la disponibilidad de la Actualizacin.

7. Restricciones. No podr vender, arrendar, otorgar bajo licencia, alquilar, prestar, revenderni de cualquier otro modo transferir, con o sin contraprestacin, el Software. No podr realizaringeniera inversa, descompilacin o desensamblaje del Software, excepto en la medida en quelo permita la restriccin anterior, a menos que est expresamente prohibido por la leyaplicable. No podr modificar ni crear trabajos derivados basados en todo o en una parte delSoftware. No podr copiar el Software ni la Documentacin excepto en la medida en que lopermita la Seccin 1 anterior. No podr permitir que terceros se beneficien del uso ofuncionalidad del Software mediante contratos de tiempo compartido, con sociedades deservicio y consulta informtica o mediante cualquier otro acuerdo. No podr quitar ningunanotificacin ni etiqueta de propiedad intelectual del Software. Todos los derechos que no estnexpresamente indicados en el presente documento se reservan a McAfee. No podr realizarcopias de seguridad de los contenidos digitales o electrnicos para los que no tiene suficientesderechos legales de realizacin de copias de seguridad. No podr: (a) Utilizar el Software parafines ilegales; (b) Utilizar el Software para guardar, recuperar, transmitir o ver cualquierarchivo, dato, imagen o programa que contenga: (i) informacin, material o imgenes ilegales;(ii) material hostigante, difamatorio, abusivo, ofensivo, peligroso, vulgar, pornogrfico,obsceno o cualquier otro material censurable de cualquier tipo o naturaleza; (iii) material quefomente una conducta que se pudiera constituir como criminal, que pudiera dimanar enresponsabilidad civil o que, de otra forma, pudiera violar cualquier disposicin o ley municipal,estatal, nacional o internacional; (iv) cdigo o material que viole los derechos de propiedadintelectual de terceros; (v) archivos temporales de Windows independientemente de sunaturaleza (incluyendo, pero sin limitarse a ellos, los archivos *.p o ~*.*); o (vi) virus,gusanos, caballos troyanos o toda funcin de caractersticas contaminantes y destructivassimilares.

8. Garanta y Exencin de responsabilidad de garanta.a Garanta limitada. McAfee garantiza (garanta del fabricante) que, durante un plazo de

sesenta (60) das a partir de la fecha de adquisicin original, el Software funcionarsustancialmente de conformidad con la Documentacin, y que los soportes (por ejemplo,CD ROM), si los hubiera, que contienen el Software y por los cuales se le proporciona,estarn libres de cualquier defecto en los materiales y la manufactura.

b Recursos de los clientes. Toda la responsabilidad de McAfee y de sus proveedores y surecurso exclusivo respecto a cualquier incumplimiento de la garanta antedicha implicar,a discrecin de McAfee: (i) la devolucin del importe abonado en concepto de precio deadquisicin de la licencia, si la hubiera, o (ii) la sustitucin de los soportes defectuososque contienen el Software. Deber devolver, y correr a su cargo, la devolucin de lossoportes defectuosos a su lugar de adquisicin junto con una copia de su recibo. Estagaranta limitada se considera nula si el defecto ha resultado de un accidente, abuso oaplicacin incorrecta. Queda garantizado cualquier soporte de sustitucin durante el restodel periodo de garanta original. Fuera de los Estados Unidos, este recurso no se encuentradisponible en la medida en que McAfee est sujeto a las restricciones estipuladas en lasdisposiciones legales y reglamentarias de control de exportacin de los Estados Unidos.

LA MEDIDA EN QUE NO SE PUEDA EXCLUIR O LIMITAR POR LA LEY APLICABLE, MCAFEE,SUS PROVEEDORES Y SOCIOS AUTORIZADOS NO OTORGAN NINGUNA GARANTA,CONDICIN, REPRESENTACIN NI TRMINO (EXPRESO O IMPLCITO, YA SEA MEDIANTE LEYPARLAMENTARIA, O DE JURISPRUDENCIA, COMMON LAW, COSTUMBRE, USO O DECUALQUIER OTRO MODO) EN RELACIN A CUESTIONES QUE INCLUYAN, SIN LIMITARSE AELLAS, LA NO VULNERACIN DE DERECHOS DE TERCEROS, LA COMERCIABILIDAD, LAINTEGRACIN O LA ADAPTACIN PARA UN FIN DETERMINADO. USTED ASUME LARESPONSABILIDAD DE SELECCIONAR EL SOFTWARE PARA ALCANZAR LOS RESULTADOSQUE PRETENDE, Y PARA LA INSTALACIN, USO Y RESULTADOS OBTENIDOS DEL SOFTWARE.SIN LIMITACIN A LAS DISPOSICIONES ANTEDICHAS, MCAFEE NO GARANTIZA QUE ELSOFTWARE EST LIBRE DE ERRORES, INTERRUPCIONES O CUALQUIER OTRO FALLO, NI QUEEL SOFTWARE CUMPLA SUS REQUISITOS.

9. Limitacin de responsabilidad. BAJO NINGUNA CIRCUNSTANCIA NI DOCTRINA, YA SEAMEDIANTE RESPONSABILIDAD EXTRACONTRACTUAL, CONTRACTUAL O DE CUALQUIER OTROMODO, MCAFEE O SUS SOCIOS AUTORIZADOS O PROVEEDORES SERN RESPONSABLES ANTEUSTED O CUALQUIER OTRA PERSONA DE NINGN LUCRO CESANTE, PRDIDA DE FONDOS DECOMERCIO, NI DE DAOS INDIRECTOS, ESPECIALES, INCIDENTALES O CONSECUENTES, NI DEDAOS CAUSADOS POR NEGLIGENCIA GRAVE INDEPENDIENTEMENTE DE SU NATURALEZAINCLUYENDO, PERO SIN LIMITARSE A ELLOS, DAOS POR PRDIDA DE FONDOS DE COMERCIO,INTERRUPCIN DE TRABAJO, FALLO O FUNCIONAMIENTO DEFECTUOSO DEL EQUIPO, NI DECUALQUIER OTRO DAO O PRDIDA. EN NINGN CASO SER MCAFEE O SUS SOCIOSAUTORIZADOS O PROVEEDORES RESPONSABLES DE NINGN DAO QUE EXCEDA EL IMPORTEABONADO EN CONCEPTO DE PRECIO DE ADQUISICIN DEL SOFTWARE, SI LO HUBIERA, INCLUSOCUANDO SE HAYA NOTIFICADO A MCAFEE O A SUS SOCIOS AUTORIZADOS O PROVEEDORES LAPOSIBILIDAD DE DICHOS DAOS. Esta limitacin no se aplicar a la responsabilidad por muerte olesiones personales en la medida en que la ley aplicable prohba dicha limitacin. Asimismo, algunasjurisdicciones no permiten la exclusin ni la limitacin de los daos incidentales o consecuentes, porlo que puede que esta limitacin y exclusin no le sea aplicable. Ninguna de las disposicionesestipuladas en el presente Contrato limita la responsabilidad de McAfee ante usted por cualquiernegligencia grave o acto ilcito doloso por parte de McAfee. McAfee acta en nombre de susproveedores y Socios autorizados en cuanto a las obligaciones, garantas y responsabilidades deexencin, exclusin y/o limitacin conforme se estipulan en el presente Contrato, pero no en cuantoa otra cuestin ni para otro propsito. Las disposiciones antedichas sern exigibles en la medida enque lo permite la ley aplicable.

10. Notificacin a los Usuarios finales del gobierno de los Estados Unidos. El Software y laDocumentacin adjunta se consideran software informtico comercial y documentacin desoftware informtico comercial, respectivamente, de conformidad con la Seccin 227.7202 deDFAR (del ingls Defense Federal Acquisition Regulation, Reglamento de defensa para lasadquisiciones federales) y la Seccin 12.212 de FAR (del ingls, Federal Acquisition Regulation,Reglamento de adquisiciones federales) segn sean aplicables. Cualquier uso, modificacin,reproduccin, publicacin, funcionamiento, exhibicin o divulgacin del Software y de laDocumentacin adjunta por parte del gobierno de los Estados Unidos se regir nicamente por lostrminos y condiciones del presente Contrato y se prohibir excepto en la medida en que estexpresamente permitido por los trminos y condiciones de este Contrato.

11. Controles de exportacin. Reconoce que el Software est sujeto a las disposiciones legales yreglamentarias de control de exportacin de los Estados Unidos y a cualquier enmienda de lasmismas. No exportar o reexportar el Software, ya sea directa o indirectamente, a (i) pases queestn sujetos a las restricciones de exportacin de los Estados Unidos (incluyendo actualmente,pero sin limitarse a ellos necesariamente, Cuba, Irn, Libia, Corea del Norte, Sudn, y Siria); (ii)ningn usuario final conocido, o que tenga razones para que se le conozca, que lo utilice en eldiseo, desarrollo o produccin de armas nucleares, qumicas o biolgicas; o (iii) ningn usuariofinal al que un organismo federal del Estado de los Estados Unidos le haya prohibido participar en las

transacciones de exportacin estadounidenses. Asimismo, reconoce que el Software debeincluir los datos tcnicos sujetos a las restricciones de exportacin y reexportacin impuestaspor la legislacin estadounidense.

12. Actividades de alto riesgo. El Software no es tolerante a fallos y no se ha diseado ni suuso est previsto en entornos peligrosos que requieran el
