ENDUSERLICENSEAGREEMENTYoushouldcarefullyreadthefollowingtermsandconditionsbeforeusingthissoftware.YouruseofthissoftwareindicatesyouracceptanceofthisLicenseAgreementandwarranty.EasyScreenCaptureVideoisCopyright2004OptimumPerformanceLimited.Allrightsreserved.Allimages,software,componentsandsupportfilescontainedhereinarecopywriteandtrademarkoftheirrespectiveowners.EasyScreenCaptureVideo,itslogosandinternalimagesarethepropertyandtrademarkofOptimumPerformanceLimited.Duplication,distributionand

alterationoftheenclosedsoftwareoritsresourcesarestrictlyprohibited.DEFINITIONSThefollowingdefinitionsshallapplyinthisdocument:"EasyScreenCaptureVideo":thissoftwarepackagebeingallitemsattachedwithinthisdeliverableand/orsubsequentsupportfilesobtainedonline,propertyofOptimumPerformanceLimited."CLIENT":AclientwhohaspaidtheregistrationfeetoOptimumPerformanceLimited,foruseofthesoftwareonthecomputeritwasregisteredwith.Aclientwhohasdownloadedasharewareversionofthesoftware.DISTRIBUTION1.EasyScreenCaptureVideomaynotbefreelydistributedinanyformwithoutpermissionfromOptimumPerformanceLimited.2.NocomponentpartofEasyScreenCaptureVideomaybedistributedindividually,disassembled,copied,reverseengineered,or

alteredinanyform.REGISTRATIONCLIENTsarerequiredtoregistertheirsoftwareforcontinueduse.ClientswhowishtoregisterarerequiredtopayaregistrationfeetoOptimumPerformanceLimited,anduponpaymentofthefeebecomeregisteredCLIENTs.Theexactamountofthefeemayvaryfromtimetotime.Intheeventofpaymentbeingrefused,cancelled,fraudulentorcharged-back,theregistrationshallnotbeconsideredvalidandtheusershallremainanunregisteredclient.RegisteredCLIENTsmayusethesoftwareunderthislicensewithoutroyaltyforaslongastheywish.Thislicensemaynotberented,sold,leasedorotherwisetransferred.NOLIABILITY,NOWARRANTIES1.InnoeventwillOptimumPerformanceLimitedbeliabletoanypartyforanydirect,indirect,punitive,special,incidentalorotherconsequentialdamagesarisingdirectlyorindirectlyfromanyuseofEasyScreenCaptureVideo,evenifOptimumPerformanceLimitedisexpresslyadvisedofthepossibilityofsuchdamages.2.EasyScreenCaptureVideoandtheaccompanyingfilesareprovided"asis"andwithoutwarrantiesastoperformanceof,

merchantabilityoranyotherwarrantieswhetherexpressedorimplied.TheCLIENTassumestheentireriskofusingEasyScreenCaptureVideo.PRODUCTSUPPORTNoformalproductsupportisprovided,butCLIENTsareencouragedtosendquestions,commentsorsuggestionstoEasyScreenCaptureVideobye-mailorbywriting.COMMENTAnycommentsormaterialssenttoOptimumPerformanceLimitedregardingtheOptimumPerformanceLimited'swebsites,EasyScreenCaptureVideooranyofOptimumPerformanceLimited'sproductsorservicesmaybeusedbyOptimumPerformanceLimitedwithoutliability,andwithoutcompensationorattributiontothesender.OptimumPerformanceLimitedmayreproduce,use,disclose,exhibit,display,transform,createderivativeworksanddistributesuchcontentormaterialstootherswithoutlimitation.LINKSTOOTHERWEBSITES

1.InformationonOptimumPerformanceLimited'sorEasyScreenCaptureVideo'swebsitesmaycontainlinksorreferencestoothersites.OthersitesmaycontainlinksorreferencestoOptimumPerformanceLimited'swebsites,productsorservices.OptimumPerformanceLimiteddoesnotendorse,andisnotresponsiblefor,anyproductorserviceofferedbyanyentityotherthanitself.UNSOLICITEDE-MAILANDMESSAGINGCLIENTagreesnottomakeanyreferencetoEasyScreenCaptureVideo,OptimumPerformanceLimited,oranyofOptimumPerformanceLimited'sproductsorservices,inanyformofunsolicitede-mailorunsolicitedmessaging.INTERNETNEWSGROUPS(USENET)

1.CLIENTagreesnottomakeinappropriate,oroff-topic,postingstoInternetnewsgroups(Usenet)orpeer-to-peerfacilitiesandmakeanyreferencetoEasyScreenCaptureVideo,OptimumPerformanceLimited,oranyofOptimumPerformanceLimited'sproductsorservicesinanyformofunsolicitede-mailorunsolicitedmessaging.2.AUsenetnewsarticleshallbeconsideredinappropriateifdoesnotfullycomplywiththewrittencharter/FAQofthenewsgrouptowhichitisposted.TheCLIENTisresponsiblefordeterminingtherulesofanewsgroupbeforepostingtoit.3.EstablishedUsenetconventionsprohibitadvertisinginmostUsenetnewsgroups.CLIENTmaypostadvertisementsonlyinthose

newsgroupsthatspecificallypermittheminthecharterorFAQ.Somenewsgroupsmaypermit"classifiedads"forsingletransactionsbetweenprivateindividuals,butnotcommercialadvertisements.CLIENTisresponsiblefordeterminingwhetherornotanewsgrouppermitsadvertisementsbeforeposting.TERMThisAgreementiseffectivefromthedayonwhichtheCLIENTreceivestheSoftwareandwillremainineffectperpetually.OWNERSHIPANDINTELLECTUALPROPERTYRIGHTSTheseconditionsshallbegovernedbyandconstruedinaccordancewiththelawsofEnglandandyouagreetosubmittothenon-exclusivejurisdictionoftheEnglishcourts.ThisAgreementgivesyoulimitedrightstousetheSoftware.OptimumPerformanceLimitedretainsanyandallrights,titleandinterestinandtotheSoftwareandallcopiesthereof,includingcopyrights,patents,tradesecretrights,trademarksandotherintellectualpropertyrights.AllrightsnotspecificallygrantedinthisAgreement,includingFederalandInternationalCopyrights,arereservedbyOptimumPerformanceLimited.Thestructure,organizationandcodeoftheSoftware

arevaluabletradesecretsandconfidentialinformationofOptimumPerformanceLimited.ThisEndUserLicenseAgreementmaybechangedatanytimewithoutnotice.OptimumPerformanceLimitedholdsnoliabilitytotheuse,misuseorabuseofanysoftwareproductpublished.OptimumPerformanceLimitedreservestherighttorevokelicensingtoanyCLIENTfoundtobeinviolationofthisEndUserLicenseAgreement.
