Terms and Conditions

01. Rate : Rate of equipment along with Consumables for 1st year are on Ex-works KGF but

contractually its on FOR destination basis and Firm till execution of the order . Save delivery of the material at destination would be your responsibility . Rate of set of Spares and Consumables for 2nd & 3rd year to Mugma Area shall be on Ex-Depot BEML KGF basis and rate of set of Spares and Consumables for 2nd & 3rd year to

Pandaveswar , Kunustoria , Salanpur and Kajora Area shall be on ex-Depot BEML Asansol basis.

However, the above said rates are inclusive of packing and forwarding charges. Rates shall

not be subject to any escalation till completion of supply . You will furnish Lowest Price Certificate along with your bills . For the spares and consumables as per Annexure A2, the prices mentioned or the prices as

per the applicable Depot Agreement Price List at the time of delivery, whichever is lower,

shall be applicable. 02. Excise Duty: Shall be payable extra at actual against documentary evidence within

specified delivery period . Rate quoted by you is 12.36% (inclusive of Cess). Your self-

declared invoice shall be construed as the evidence of the Excise Duty paid by you. You will enclose a certificate from your Auditors at the time of billing that refund/credit, if any, obtained by you have been passed on to ECL.

The following additional information should be incorporated in your invoice as per Central Excise Act so that ECL may avail CENVAT Credit under rule 11(2) of Central Excise Rules.

(i) Concessional Sales Tax shall be paid extra as applicable for the equipments along with

Consumables for 1st year within specified delivery period . Rate quoted by you is 2%

against concessional form. (ii) For Spares and Consumables for two years operation (i.e. 2nd & 3rd year) for Mugma

Area , CST shall be payable extra as applicable within the specified delivery period . Rate

quoted by you is 2% against concessional form. (iii) For Spares and Consumables for two years operation( i.e. 2nd & 3rd year) for supply to

Pandaveswar , Kunustoria , Salanpur and Kajora Area , WBVAT shall be payable extra as

A) For Equipments and consumables for 1st 12 month’s operation

a) 80% value of each equipment and the consumables for 1st 12 month’s operation and

100% Excise duty and full concessional CST along with 100% transportation & Insurance charges will be payable only within 21 days after delivery of the

equipment along with Consumables for 1st 12 month at the project site and receipt and acceptance of required PBG by the Paying Authority. The equipment should be accompanied by relevant dispatch documents like challan, Makers Test-cum-

Inspection Certificate, CIL/ ECL’s Inspection Certificate etc.

b) Balance 20% payment will be payable within 21 days after successful completion of

erection, commissioning and final acceptance of each of the equipment and the consumables for 1st 12 months of operation at site upon presentation of a certificate from the Project Officer to the effect that the equipment has been erected and commissioned to their entire satisfaction.

No payment will be made for supply of incomplete equipment and consumables for 1st 12 months of operation.

B) For Spare Parts and Consumables for 2nd and 3rd 12 months operation :

100% payment shall be made within 21(twenty one) days of correct receipt and

acceptance of materials or submission of bills, whichever is later as per the delivery schedule. NOTE : (i) Payment towards supply of Spares & Consumables will be made at the order

price or applicable price list of M/s BEML at the time of delivery , whichever is lower .

(ii) An amount of Rs.6,00,000.00 (Rupees Six Lakh) on a/c of Special Discount from your

first bill will be deducted i.e. entire discount of Rs.6,00,000.00(offered on tendered / quoted 06 no. of Dozer) would be deducted / adjusted from your first bill of the ordered

/ supplied Dozer , submitted by you to the Bill Section for payment .

07. Transportation : Shall be done by you . Transportation charges shall be payable extra at

actual against documentary evidence subject to a maximum of Rs.2,22,500.00 (Rupees Two Lakh, Twenty Two Thousand Five Hundred Only) per Dozer. This rate is inclusive of Service Tax

@ 12.36% on 25% value of Freight per Dozer . No transportation charges are payable for spares

and consumables by ECL. 08. Transit Insurance : Shall be done by you. Transit Insurance Charges shall be payable extra

at actual against documentary evidence subject to maximum of Rs.3,220.46 (Rupees Three

Thousand Two Hundred Twenty and Paise Forty Six only) per Dozer (Inclusive of Service Tax) . No Transit Insurance charges are payable for spares and consumables by ECL .

09. Dispatch instruction: Notification of dispatch should be sent to the Consignee and copies to

GM(MM), ECL and GM(Excv),ECL immediately after dispatch giving the following

particulars:- a. Supply Order and date b. Machine Sr. No. c. Date of Inspection

d. Date of Dispatch e. Name of project to which dispatched f. No. of packages

g. Quantity and/or weight h. Description of Stores i. Consignment Note No. and Date

j. Name of Transporter/Trailer / Truck No.

Failure to submit the above details with constitute failure on the performance of the supplier. 10. Delivery : (a) For Equipment & Consumables for 1st Year Operation:

To be completed within 180 days from the date of receipt of Purchase order on FOR

destination (door delivery) basis. (b) For Spares & Consumables for 2nd and 3rd Year of operation: Shall be delivered periodically, and not less than twice annually through out the next

24 months period after warranty period . 11. Performance Bank Guarantee : You shall have to furnish Performance Bank Guarantee on

any Scheduled/Nationalized Bank in India valid for 42 (forty two) months from the date of commissioning for 10% landed value of the equipments as a coverage towards the Supplier’s

performance against the Contract, in the standard format enclosed (Annexure-B). The amount of PBG should remain 10% throughout the entire 42 months period. In case some amount of the PBG is encashed, in the event of non-payment of Liquidated damages as per Effect

and Duration of Guarantee of the order, you shall replenish the same, so that PBG amount does not fall below 10% of the landed value of the equipments at any point of time during the entire 42 months from the date of commissioning. In the event of failure to do so, ECL reserves the right to

encash any balance amount of the PBG, if required or to recover from any amount payable to the

supplier by ECL or by CIL/any subsidiary of CIL. The Performance Bank Guarantee must be submitted within three weeks of placement of formal order. The PBG should be furnished on a non-judicial stamp paper of Rs.100/- or more and should

be in the name of the Bank. No payment will be made without submission of Performance Bank

Guarantee. An amount of Rs.21,88,608.00(Rupees Twenty One Lakh, Eighty Eight Thousand Six Hundred Eight Only – rounded off) per Dozer shall be for the Dozer consigned to Mugma Area and

Rs.22,04,955.00(Rupees Twenty Two Lakh Four Thousand Nine Hundred Fifty Five only – rounded off) shall be for the Dozer consigned to Pandaveswar, Kunustoria , Salanpur and Kajora Area . The PBG shall be released after expiry of the validity period if no claim is pending with the approval of Competent Authority.

12. Guaranteed Availability : You shall guarantee that the availability of the equipment shall

not be less than 75% (seventy five percent) for a period of 36 months from the accepted date of commissioning .

The method of assessment applied shall be as follows:

The following calculation shall determine the availability of the Equipment: Scheduled Available Time-Downtime X 100%

% Availability = Scheduled Available Time Scheduled Available Time shall equate to 24 Hours for every mine working in a year.

Downtime shall mean all hours of work lost due to mechanical, electrical or other

failure, including:

a) Routine servicing and maintenance in accordance with the manufacturer’s published

recommendations, including:

Changing oils, oil filters and air filters; lubrication;

Changing identified consumable or wear parts.

b) Planned preventative maintenance programmes;

It shall not however include:

I. Damage due to abusive use or incorrect operation methods by the Purchaser;

II. Accidents;

III. Strikes or stoppage of work by the Purchaser’s personnel;

IV.Natural disaster;

V. Lack of Spare Parts not attributable to a failure of the Supplier, it’s Agents or

Representatives.

Downtime shall also specifically include all hours lost due to failures determined to be

guarantee failures. The supplier shall state the number of hours per day required to carry out (a) and (b) above.

The time stated shall, with the agreement of the Purchaser, form the basis of the assessment of the availability. The Purchaser will assist the Supplier, without relieving the Supplier of any other obligations under the Contract, to achieve the guaranteed availability by:

- Providing normal and proper maintenance, including preventative maintenance in accordance with the Supplier’s standard/published recommendations, and making all necessary repairs using only genuine manufacturer’s spares.

- Providing co-operation to all Supplier’s authorized representatives, complying with all reasonable procedural suggestions to improve efficiency of machine operation or reduce downtime.

- Where appropriate, providing and maintaining such conditions as:

Proper electrical Supply

Terrain Area

Bench preparation

Reasonable floor conditions

- Providing all Supplier’s authorized representatives access at all reasonable times to the

machine service and repair facilities.

- Maintaining a logbook for each shift wherein the working hours, breakdown times,

maintenance hours, idle time, etc. shall be recorded. This record will be available for examination and signature by the Supplier’s representative.

13. Effect and Duration of Guarantee

This Guarantee shall become effective on the day on which the Equipment is commissioned

at the Site. The issue of the Purchaser’s Acceptance Certificate shall evidence

commissioning.

This Guarantee shall remain effective for Thirty Six (36) months from the date of

commissioning, irrespective of the hours operated by the Equipment during the period of

the guarantee.

In the event that the Equipment fails to achieve the Availability herein provided, measured

over each twelve (12) month period, the Supplier shall be liable to pay to the Purchaser, as Liquidated Damages, a sum or sums equal to, as indicated hereunder for each equipment: -

a) 1% of the delivered price of the equipment for every percentage reduction from the

Guaranteed Availability for the first 5%

b) 10% of the delivered price of the equipment for reduction beyond 5% from the

Guaranteed Availability.

14. Deemed Breakdown : When the supplier is unable to supply the replacement of a failed

part during the guarantee period , and if the machine is commissioned by using the spare from the stock of the project, the period (after 21 days) till the supplier replaces the part

shall be treated as “Deemed Breakdown” (the credit for keeping machine available shall not be given to the supplier).

You shall not in any way be allowed to take out Spares Parts from other equipment , which

are under breakdown and covered under guarantee . Even if , the equipment is commissioned by taking out Spares Parts from any other break down equipment in the

interest of ECL , it shall be treated as deemed breakdown till you replace the Spare .

15. Special Condition: The machines under supply against this order should have the same

major assemblies / sub-assemblies which were fitted on the machines supplied against CIL/ECL’s last supply order. In case any change is contemplated, prior clearance of ECL will be necessary.

For close monitoring of the performance of the equipment, the Project Authorities must

furnish the following information as per enclosed Proforma (Annexure C) on monthly basis to ECL Hqrs. On completion of the Guaranteed Availability period, a consolidated statement in the said proforma must be sent to GM(Excv),ECL Hqrs. for judgment regarding performance of the equipment. The Project authorities must not give performance certificate

directly to the equipment supplier. 16. Packaging for Transit:

The Supplier shall provide such packing of the Goods as is required to prevent their

damage or deterioration during transit to their final The Supplier shall provide such packing of the Goods as is required to prevent their damage or deterioration during transit

to their final destination, as indicated in the Contract. The packing shall be sufficient to withstand, without limitation, rough handling during transit and exposure to extreme

temperatures, salt and precipitation during transit, and open storage.

Packing case size and weights shall take into consideration, where appropriate, the remoteness of the Goods' final destination and the absence of heavy handling facilities at all points in transit.

The packing, marking and documentation within and outside the packages shall comply

strictly with such special requirements as shall be expressly provided for in the Contract, including additional requirements, if any, and in any subsequent instructions ordered by

the Purchaser.

Packing instructions: The Supplier will be required to make separate packages for each

consignee. Each package will be marked on three sides with proper paint with the following:

i. Project;

ii. Contract No;

iii. Country of origin of Goods;

iv. Supplier's name;

v. Packing list ref. number;

vi. The gross weight, net weight and cubic measurement;

vii. Consignee Name and Address;

NB: One copy of the package list shall be inserted inside the package.

Identification of Equipment: Within 3 (three) months of the date of the Contract, the Purchaser shall provide to the supplier details of identification requirements for each item of equipment to be supplied

under the Contract. Equipment identification will be in the form of a code number unique to each piece of equipment. The Code number will be made up of three number groups that will identify:

The package that the equipment is part of “Package Code”

The group of equipment that the equipment belongs to

“Equipment Type”

Unique serial number “Serial Number”

Example: 023A_190T_1284

The Supplier shall ensure that the identification numbers:

a) Are stamped or indelibly marked on each piece of equipment in an easily accessible/visible place

b) Appear in all documentation pertaining to the equipment c) Are painted or stenciled on all boxes, crates or packaging used for transportation of the

equipment. 17. Inspection : Initial Inspection shall be carried out at your works by the authorized

representative of CIL, Bangalore office and final inspection shall be carried out at

Consignee’s end by the Consignee’s representative after receipt of materials at site 18. Erection and Commissioning : The Supplier shall be responsible for the erection and

commissioning at no extra cost to the purchaser at site. However, the purchaser will assist in providing necessary erection tools & tackles etc. and unskilled manpower for this purpose.

The Supplier shall provide the services of specialist technicians to supervised the installation / erection / assembly , commissioning and any performance testing of the Plant , equipment and accessories supplied .

The Technicians shall remain at site following commissioning until all necessary personnel

are fully conversant with the maintenance and operation of the Equipment.

19. Training : The Supplier in consultation with the GM(Excavation) of ECL-HQ as well as the

respective project shall make available, manufacturer’s works or elsewhere outside India or site, experience personnel to conduct training of ECL’s operators, technical and supervisory personnel for suitable period from the date of issue of certificate of acceptance of the

equipment. Training should be conducted free of cost. The supplier shall contact GM(Excavation), ECL-HQ before and after conducting the training.

The training shall cover the following :-

a) The machine system and safety.

b) Equipment operation and maintenance.

c) Trouble shooting localization of fault and their remedies covering

- Electrical and electronics

- Mechanical

- Hydraulic System

- Air System

- Lubrication System

Comprehensive training manuals with clear illustration shall be provided to each

participant.

Training courses shall be conducted in both English and Hindi Languages as required. 20. Follow up Visits : The supplier shall provide follow-up visits at site of a Regional

Manager/Senior Technical Person competent to take decision on the spot to settle any

dispute /problems associated with the machine and to render his expert advise to the Project personnel in operation and maintenance.

21. After Sales Service : You will depute your Service Engineers for periodical

inspection/checking and performance monitoring of the equipment during its warranty period and to advise the projects on action to be taken for obtaining maximum availability

of the equipment.

22. Spare Parts Provisions

a) Availability of Spare Parts.

All items and Equipment proposed shall be of current design and manufacture. The Supplier shall warrant that sufficient spares and servicing facilities will be available to

maintain the Equipment in use throughout its life.

b) Provision of Spare Parts

- In the event that the Spare Parts and Consumables, as recommended by the Supplier, in any way fall short of actual requirements during the period for which they are said to be adequate, the Supplier shall provide such additional Spare Parts and Consumables as are necessary at

the final destination. Such additional Spare Parts and Consumables shall be provided by the Supplier to the Purchaser free of all cost and shall be transported to Site by air freight internationally and by air, rail or fast road transport within India.

- In the event that the Spare Parts and Consumables, as recommended by the Supplier, are in

excess of actual requirements. The Purchaser may at its option: (i) retain such excess Spare Parts and Consumables as, in it's discretion, it may elect to do so;

(ii) require the Supplier to repossess or repatriate or otherwise dispose of such

excess Spare Parts in exchange for payment to the Purchaser of the Contract Price of the Spare Parts and Consumables concerned.

The Purchaser shall notify the Supplier, in writing of it's requirements under this Clause within

thirty (30) days of completion of the period referred to above (i.e. 36 months from the date of the Purchaser’s Acceptance Certificate).

- In the event that operation of the Plant is inhibited or frustrated as a direct result of lack of

Spare Parts and Consumables, pursuant to clause mentioned above, then the period of 36 months from the date of Purchaser’s Acceptance Certificate shall be extended by a period of not less than the period during which operation as aforesaid was inhibited or frustrated.

The Supplier shall not be liable for the supply of additional Spare Parts or Consumables, nor to

extend the period referred to in clause above i.e. 36 months from the date of Purchaser Acceptance Certificate, if and to the extent that, additional Spare Parts and Consumables are required by reason of unforeseen accidents, negligence or misuse on the part of the

Purchaser. The assessment of the bidder of the spare parts requirements shall be based upon the

expected but not limited to the number of working hours per year as defined in the individual Equipment Specifications included as the Attachment to the Technical

Specifications of the NIT (i.e. the expected scheduled working hours of the equipments per year are 4000 (four thousand) hours. This is only. approx. hours and there may be variation in the range of +/- 500 hours).

c) Emergency Spare Parts Emergency Spare Parts required by the Purchaser to repair breakdowns shall be dispatched

to the Site by the Supplier by the fastest, practicable, means as directed from time to time by

the Purchaser. “Emergency Spare Parts” shall mean those spare parts or components required by the

Purchaser to repair any item of Plant supplied pursuant to the Contract in the event of a breakdown not attributable to a failure covered by guarantee or a failure of the Supplier to

provide adequate Spare Parts, or Consumables. Payment in respect of the supply and delivery of such Emergency Spare Parts shall be made

promptly, retrospectively, by the Purchaser, in a manner consistent with the Terms of Payment described in the Contract.

d) Lifetime Spare Parts

The Supplier undertakes and guarantees to produce and maintain stocks, to be available for

purchase by the Purchaser under separate agreement, of all Spare Parts and Consumables as may be required for maintenance and repair of the Plant throughout its working life. In

the event that the Supplier wishes to terminate production of such Spare Parts, the Supplier shall:

(i) Give not less than six months notice in writing of it's intention to terminate production in order to permit the Purchaser reasonable time in which to procure needed requirements; and

(ii) Immediately following termination, provide to the Purchaser at no cost, manufacturing drawings material specifications and all necessary permissions to facilitate manufacture of the Spare Parts elsewhere.

In any event, the Supplier shall not seek to terminate manufacture of spare parts for a period

of not less than ten (10) years from Taking-Over.

e) Oils, Lubricants and Fluids

Not less than one (1) month before the scheduled date for Acceptance, the Supplier shall

provide to the Purchaser a detailed schedule of all necessary oils, lubricants, fluids and the

like for the operation and maintenance of Equipment. The schedule shall indicate estimated annual consumption and specify the appropriate international standard number or the name and reference number of an equivalent available in India considered to be acceptable by the Supplier.

f) General

Nothing in this Clause shall relieve the Supplier of any Guarantee, Availability, Performance

or other obligations or liabilities under the Contract.

23. Price fall Clause :

a) Prices charges for the stores to be supplied under the supply/purchase order by the

suppliers shall in no event exceed the lowest price at which suppliers sell the stores or offer to sell the stores of identical description to any customer during the pendency of the supply

order. b) If any time during the said period, the supplier reduce the sale price, sell or offers to sell

such stores to any other customer at a price lower than the price chargeable under this

contract, they shall forthwith notify such reduction of sale or offer to sell to the GM(MM), ECL and the price payable under the contract for the stores supplied after the date of

coming into force of such reduction or sale, shall stand correspondingly reduced. c) The contractor shall furnish to the consignee/paying authority concerned with a copy to

GM(MM), ECL at intervals mentioned below :- i) Within a month of the commencement of the contract, a certificate as to the price

prevailing at the commencement of the contract.

ii) Within a month of the expiry of every six months, a certificate as to the price prevailing during the preceding six months and iii) At the end of the contractual delivery period, within one month of the completion of

supply of the full ordered quantity, a certificate in the following form:- “I/We certify that the stores of description identical to the stores supplied to the consignee concerned under the contract herein have not been sold by me/us to any other organization at the commencement of the contract up to the period of completion of delivery at the price

lower than the price charged to the consignee concerned of the contract”.

Failure in submission of the aforesaid certificate by the contractor within one month of

expiry of the period to which the certificate relates , may result in withholding of payment of their bills against supply of the last machine and accessories, if any, in the case where ordered quantities exceed one number. Where the ordered quantity is for one number, payment will be released only after submission of the certificate as mentioned herein above.

24. Manuals: At least one month before the scheduled installation date, the Supplier shall

provide with each equipment :

(a)Suitably illustrated copy of Operating, Repair and Maintenance Instructions for all the

equipment, written in the English language, substantially bound in book form;

01(one) copy along with soft copy to each project site, and

01(one) copy along with soft copy to the Gr.GM(Excv) ECL/HQ.

(b) Suitably illustrated copy of detailed spares parts manuals for each type/model of equipment and accessories written in English language substantially bound in book form.

25. Tools : Tools as mentioned in the Annexure A1 should be provided free of cost . 26. One set of dispatch documents of each consignment should invariably be sent to the office of

the GM(MM), ECL 27. Road Permits./ Way Bills if required should be obtained directly from the Consignees. 28. Penalty for failure to supply in time : The time and date of delivery of stores stipulated in the

Purchase Order shall be deemed to be the essence of the contract and delivery must be completed by the date specified. No materials should be supplied beyond the specified

delivery period, unless specific approval has been obtained from the purchaser. In case of failure to deliver or dispatch the stores, within the stipulated date/period in accordance with the samples and /or specifications mentioned in the supply order and in

event of breach of any of the terms and conditions mentioned in the supply order, ECL reserves the right to any or all of the following :- a) to recover from the successful tenderer as agreed, Liquidated damages @ ½% (half

percent) of the price of any stores , which the successful tenderer has not been able to supply for each week or part of the week during which the delivery of such stores may be in arrears limited to 10% (ten percent). Where felt necessary the limit of 10% (ten percent) can be increased to 15% (fifteen percent).

b) to purchase elsewhere after due notice to the successful tenderer on their account and at the risk of the defaulting supplier, the stores not supplied or other materials of a similar description without canceling the supply order in respect of the consignment not yet due

for supply. OR

c) To extend the delivery period with or without penalty, as may be considered fit and proper. The penalty, if imposed, shall not be more than the agreed liquidated damages

referred to as clause (a) above

OR d) To cancel the supply order or a portion thereof if ECL decides purchase of stores at the

risk and cost of the defaulting supplier and also.

e) To forfeit the security deposit received in full or in part.

OR f) Whenever under this contract any sum of money is recoverable from any payable by the supplier, ECL shall be entitled to recover such sum by appropriating, in part or in whole by deducting any sum or which at any time thereafter may be due to the successful tenderer in

this or any other contract. Should this sum be not sufficient to cover full amount recoverable, the successful tenderer shall have to pay to ECL on its demand the remaining balance. The successful tenderer shall however not be entitled to any gain on any such purchase.

29. Test and Guarantee certificates: Manufacturer’s Test and Guarantee certificates should be

provided along with the supplies. 30. Security Deposit : Exempted since you are a PSU.

31. Quality Assurance : As given by you in your offer. 32. Submission of Bill :

(a) Supplier shall have to submit bills (five copies) to the consignee along with the consignment

and challan along with the requisite document, if any.

A. Scope of Supply

A.1 Equipment Package :

The supplier is required to supply as per the equipment package detailed in the Tender

Document/your offer.

A.2 Supplementary Items :

I. One set of standard tools for normal maintenance and operation will be supplied along with

the equipment.

II. First fill of all oils, grease and lubricants, except diesel, needed for test and commissioning of

each equipment.

A.3 Information and Drawings :

At least one month before the scheduled installation date, the Supplier shall provide with each

A.4 Erection/Assembly, Commissioning and Performance Testing

The supplier shall provide the services of specialist technicians to supervise the

installation/erection/assembly, commissioning and any performance testing of the plant,

equipment and accessories supplied.

The technicians shall remain at site following commissioning until all necessary personnel

are fully conversant with the maintenance and operation of the equipment.

A.5 Training

The Supplier in consultation with the HOD (Excavation) of ECL-HQ as well as the respective project shall make available, manufacturer’s works or elsewhere outside India or

site, experience personnel to conduct training of ECL’s operators, technical and supervisory personnel for suitable period from the date of issue of certificate of acceptance of the equipment. Training should be conducted free of cost. The supplier shall contact HOD

(Excavation), ECL-HQ before and after conducting the training.

Designed and constructed to handle without overload and for the working hours stated, the maximum volumes/rates specified;

Designed to facilitate ready access, cleaning, inspection, maintenance and repair of

component parts.

Designed to facilitate rapid changeover of consumable items.

The component parts of all items shall, wherever possible, be selected from the standard ranges of

reputable manufacturers.

The Equipment and accessories shall be physically robust and where necessary capable of

dismantling for transportation and ready re-assembly using simple tools. All Equipment items provided shall be designed to be compatible within the proposed overall Scope of Supply.

Electrical Equipment shall provide all protection devices, controls and interfaces for the Equipment

to operate safely and efficiently.

All workmanship and materials shall be of first class quality in every respect.

All parts and surfaces, which are exposed to corrosive environments, shall be suitably protected to

prevent any effects of corrosion or erosion. B.3 Services

The supplier shall be responsible for the erection and commissioning of the equipment at site. The supplier shall depute qualified and competent Engineer(s) and specialist technicians to supervise the entire assembly, erection and commissioning of equipment free of cost. The Technicians shall be responsible for ensuring and certifying that each item of Equipment is

installed entirely to the Supplier's and Purchaser’s satisfaction. The Technicians shall remain at site following commissioning until all necessary personnel are fully conversant with the maintenance and operation of the Equipment.

B.4 Standards

The design, supply, erection, testing and commissioning of all Equipment under this Contract shall

in all respects comply with the requirements of this Specification and with the appropriate current Indian standards and codes, or relevant Standards issued by the International Standards

Organisation (ISO).

The Equipment shall be to the approval of the Statutory Government Authorities including Director General of Mines Safety (DGMS) having jurisdiction over the Equipment and its use. The system of units for all measurements shall be the Système International d’Unités (S.I.).

B.5 Suppliers Responsibility

The Purchaser requires that the Supplier shall accept responsibility for the provision of complete

operable and compatible Equipment and systems within the Scope of Supply. This document identifies only the major items required for the installation and the Supplier shall ensure that the

total supply includes all necessary Equipment for it to function effectively and safely. Any additional items the Supplier considers necessary to ensure compliance with such a requirement shall be identified and included.

If the supplier observe that this Specification document contains any anomalies, ambiguities, flaws,

errors or omissions, the Supplier shall immediately bring these to the attention of the Purchaser.

The Supplier shall be responsible for the testing and commissioning of the Equipment and ensure that it meets the requirements as specified. The commissioning and setting to work of the whole

Equipment Supply package shall be carried out under the supervision of the Supplier in

conjunction with the Purchaser’s nominated personnel

B.6 Spare Parts Provisions

B.6.2.3 In the event that operation of the Plant is inhibited or frustrated as a direct result of lack of Spare Parts and Consumables, pursuant to Clause B.6.2.1 hereof, then the period referred

hereof shall be extended by a period of not less than the period during which operation as aforesaid was inhibited or frustrated.

B.6.2.4 The supplier shall not be liable for the supply of additional Spare Parts or Consumables, nor

to extend the period referred to in Clause B.6.2.1 hereof, if and to the extent that, additional Spare Parts and Consumables are required by reason of unforeseen accidents, negligence or misuse on the part of the Purchaser.

B.6.3 Emergency Spare Parts

B.6.3.1 Emergency Spare Parts required by the Purchaser to repair breakdowns shall be dispatched

to the Site by the Supplier by the fastest, practicable, means as directed from time to time by the Purchaser.

B.6.3.2 “Emergency Spare Parts” shall mean those spare parts or components required by the

Purchaser to repair any item of Plant supplied pursuant to the Contract in the event of a breakdown not attributable to a failure covered by guarantee or a failure of the Supplier to provide adequate Spare Parts, or Consumables.

B.6.3.3 Payment in respect of the supply and delivery of such Emergency Spare Parts shall be made

promptly, retrospectively, by the Purchaser, in a manner consistent with the Terms of Payment described in the Contract.

B.6.4 Lifetime Spare Parts

The Supplier shall undertake and guarantee to produce and maintain stocks, to be available for purchase by the Purchaser under separate agreement, of all Spare Parts and

Consumables as may be required for maintenance and repair of the Plant throughout its

working life. In the event that the Supplier wishes to terminate production of such Spare Parts, the Supplier shall:

(a) Give not less than six months notice in writing of it's intention to terminate production in order to permit the Purchaser reasonable time in which to procure needed requirements; and

(b) Immediately following termination, provide to the Purchaser at no cost,

manufacturing drawings material specifications and all necessary permissions to facilitate manufacture of the Spare Parts elsewhere.

In any event, the Supplier shall not seek to terminate manufacture of spare parts for a period

of not less than ten (10) years from Taking-Over.

B.6.5 Oils, Lubricants and Fluids

Not less than One (1) month before the scheduled date for Acceptance, the Supplier shall

provide to the Purchaser a detailed schedule of all necessary oils, lubricants, fluids and the like for the operation and maintenance of Equipment. The schedule shall indicate estimated annual consumption and specify the appropriate international standard number or the name

and reference number of an equivalent available in India considered to be acceptable by the Supplier.

B.6.6 General

Nothing in this Clause B.6 shall relieve the Supplier of any Guarantee, Availability,

Performance or other obligations or liabilities under the Contract.

B.7 Performance Guarantee

B.7.1 Introduction

B.7.1.1 The supplier shall guarantee that the Equipment supplied pursuant to this Contract shall be

available for use by the Purchaser and shall meet the performance criteria specifications at

the level and in accordance with the terms and conditions of the Availability Guarantee herein contained.

B.7.1.2 Where Equipment supplied under the Contract fails to meet the criteria of the

Availability Guarantee, the Supplier shall, at it's own cost, provide suitably qualified and experienced personnel at Site to demonstrate to the Purchaser's satisfaction that the

required level of availability can be achieved and maintained.

B.7.1.3 The Supplier shall provide the Services of such personnel at Site within seven (7)

days of notification by the Purchaser that the availability criteria have not been met in any one (1) month.

B.7.2 Guarantee

B.7.2.1 The supplier shall guarantee that the Equipment supplied pursuant to the Contract

shall be available to the Purchaser at the level hereinafter defined to perform to criteria of not less than that defined in the Technical Specifications incorporated in the Contract. The

guarantee shall cover for total equipment so that ultimate responsibility lies only with the equipment bidder although components may be supplied to the bidder

B.7.2.2 The supplier shall guarantee that the Equipment shall be available to perform its

duty to minimum criteria and to the minimum availability percentage level as defined in the individual Equipment Specifications included as the Attachment to the Technical Specifications. The method of assessment applied shall be as follows:

Method of Assessment:

The following calculation shall determine the availability of the Equipment: Scheduled Available Time-Downtime X 100

% Availability = Scheduled Available Time

Scheduled Available Time shall equate to 24 Hours for every mine working day in a

year.

Downtime shall mean all hours of work lost due to mechanical, electrical or other failure,

including :

a) Routine servicing and maintenance in accordance with the manufacturer's published recommendations, including:

Changing oils, oil filters and air filters; lubrication;

Changing identified consumable or wear parts.

b) Planned preventative maintenance programmes;

It shall not however include:

I. Damage due to abusive use or incorrect operation methods by the Purchaser;

II. Accidents;

III. Strikes or stoppage of work by the Purchaser's personnel;

IV. Natural disaster;

V. Lack of Spare Parts not attributable to a failure of the Supplier, it's Agents or

Representatives.

Downtime shall also specifically include all hours lost due to failures determined to be

guarantee failures.

The Supplier shall state the number of hours per day required to carry out (a) and (b) above.

The time stated shall, with the agreement of the Purchaser, form the basis of the assessment of the availability. Details of the maintenance schedule is attached.

The Purchaser will assist the Supplier, without relieving the Supplier of any other obligations

under the Contract, to achieve the guaranteed availability by:

1. Providing normal and proper maintenance, including preventative maintenance in

accordance with the Supplier’s standard/published recommendations, and making all necessary repairs using only spare parts provided by the Supplier in accordance

with the requirements specified in Section: B.6.

2. Providing co-operation to all Supplier’s authorized representatives, complying with all reasonable procedural suggestions to improve efficiency of machine operation or reduce downtime.

3. Where appropriate, providing and maintaining such conditions as:

Proper electrical Supply

Terrain Area

Bench preparation

Reasonable floor conditions

4. Providing all Supplier’s authorized representatives access at all reasonable times to

the machine service and repair facilities.

Maintaining a logbook for each shift wherein the working hours, breakdown times,

maintenance hours, idle time, etc. shall be recorded. This record will be available for examination and signature by the Supplier’s representative.

B.7.3 Effect and Duration of Guarantee

B.7.3.1 This Guarantee shall become effective on the day on which the Equipment

is commissioned at the Site. The issue of Purchasers Acceptance Certificate

shall evidence commissioning.

B.7.3.2 This Guarantee shall remain effective for thirty six (36) months from the date

of commissioning, irrespective of the hours operated by the Equipment during

the period of the guarantee.

B.7.3.3 In the event that the Equipment fails to achieve the Availability herein

provided, measured over each twelve (12) month period, the Supplier shall be

liable for and pay to the Purchaser, as penalty, a sum equal to as indicated

hereunder for each equipment: -

a) 1% of the delivered price of the equipment for every percentage reduction from the

Guaranteed Availability for the first 5%

b) 10% of the delivered price of the equipment for reduction beyond 5% from the Guaranteed Availability.

B7.3.4 When the Supplier is unable to supply the replacement of a failed part under warranty

within 21 days of giving intimation by the consignee and if the machine is commissioned by

using the spare from the stock of the project the period (after 21 days) till the supplier replaces the part under warranty shall be treated as “Deemed Breakdown” (the credit for

keeping machine available shall not be given to the supplier).

B7.3.5 SPECIAL CONDITION: The machines under supply against this tender should have the

same major assemblies / sub-assemblies, which were fitted on the machines supplied

against CIL/ECL’s last supply order. In case any change is contemplated prior clearance of

ECL will be necessary.

B.8 -Deemed Breakdown

When the Supplier is unable to supply the replacement of a failed part during the guarantee

period, and if the machine is commissioned by using the spares from the stock of the project, the period (after 21 days) till the supplier replaces the part shall be treated as ‘deemed breakdown’ (the credit for keeping machine available shall not be given to the

supplier.)

The Supplier shall not in any way be allowed to take out spare parts from other equipment,

which are under breakdown and covered under guarantee. Even if the equipment is commissioned by taking out spare parts from any other breakdown equipment in the interest of ECL, it shall be treated as ‘deemed breakdown’ till the supplier replaces the

spare parts.

B.9- Composite-warranty/guarantee

The supplier shall warrant that the equipment supplied under this contract is:

a) In accordance with the contract specifications.

b) The equipment shall have no defects arising out of design, material or workmanship & the

complete equipment shall be warranted for 12 months from the accepted date of commissioning. Any defect arising observed on this account will have to be attended

immediately.

c) The Supplier must ensure that there is no major breakdown due to manufacturing / design

defects during the warranty period. In case such breakdown occurs the purchaser reserves the right to extend the warranty period suitably. The warranty shall cover for total equipment so that comprehensive responsibility lies only with the equipment supplier

although components may be supplied by different suppliers to you.

B.10 Quality Assurance

B.10.1 The Supplier should furnish in detail its quality assurance plan for various stages of

manufacture. The Quality Assurance plan shall comply with an internationally recognized quality assurance standard such as ISO 9000.

B.10.2 The Supplier shall provide facilities to Purchaser or their authorized representatives for

progress inspection during manufacture at his works and furnish all test data available in this regard for quality control, both for bought out items and his own manufactured items.

B.10.3 The Purchaser or his agent, when so required by him, shall also be provided with samples of

“bought-out” materials for the purposes of undertaking independent tests, which shall be at the expense of the Purchaser.

B.11 After Sales Service/Product Support

The Supplier must have adequate facility for product support for such machines in India

with nearest Depot/Warehouse, Service facility and Personnel. Details of such facilities are

to be mentioned as at Clause 8 of Equipment Specification. C : Equipment Specification :

1. Scope Of Specification

BEML model BD155 Crawler Dozer, powered by BEML model BS6D170-1, turbocharged, water cooled, diesel engine developing 242 Kw (324 hp) net power at 2000 RPM. 2. References :

The equipment shall conform to relevant ISO standards referred in the NIT.

3. Design Criteria

The dozer shall be capable of continuous operation for protracted periods on a system of 3 shifts each of 8 hours duration per day throughout the year in hard, highly abrasive, blasted

sandstone/rock having a density after blasting of 1,800 kg/m3.

The dozer has following maximum drawbar pull, measured according to ISO 7464. Usable drawbar pull depends on weight and traction of equipped tractor/dozer. Drawbar pull range at 1 kmph speed : 170 to 490 kN

Drawbar pull range at zero speed : 200 to 650 kN 4. Technical Requirements

4.1 Engine:

BEML BD155 Dozer is powered by BEML engine model with BS6D170-1, 6 inline, Diesel, 4 Stroke, water cooled, turbocharged, direct injection, engine developing 242 kW (324 hp) @ 2000 rpm measured according to ISO 9249.

The engine will be provided with 24V electric starting, dry type 2-stage air cleaner with automatic dust evacuator and dust level indicator and 2-stage fuel filter with water separator. The engine will have a water jacket cooling system, thermostatically controlled, using an engine driven water pump, with the cooling water re-circulated through a heavy duty radiator. The system

is capable of providing sufficient cooling to allow the dozer to continuously operate at the full rated output at the maximum ambient temperature. The moving parts of the engine will be lubricated by an engine driven oil pump, with full flow oil

filtration and cooling. The engine will be equipped with an over-speed governor. The engine will be provided with a heavy-duty removable pan guard. 4.2Drive System

Power transmission from the engine to the crawler drive sprocket is through conventional means

i.e. torqueflow transmission, final drive, steering and brakes. 4.2.1Conventional Drive System

4.2.1.1Transmission

Torque-flow transmission consists of a 3 element, single stage single phase torque converter, planetary gear drives and hydraulically operated multiple disc type clutches equipped with

suitable valves for developing 3 forward and 3 reverse speeds. Heavy duty removable belly guard, designed such that it does not allow accumulation of dirt, is provided.

All hoses shall be grouped as far as possible and suitably clipped to reduce damage from scuffing. Fire resistant /retarder hydraulic hoses in place of ordinary hoses to decrease the chance fire. All hoses and piping shall be protected from damage. 4.4 Brake System :

Braking force and pedal effort for the service and parking brake comply with ISO 10265. 4.5Undercarriage

Undercarriage is a heavy duty rugged design suitably suspended with oscillating type equalizer

bar to reduce shock loads transmitted to the dozer. Track frames and track rollers are of sufficient strength that can withstand high loads which are encountered during operation of the equipment in various ground conditions. The structure is of

welded type construction and stress relieved as required. The sprocket is segmented bolt-on type. Idler and rollers are sealed type and lifetime lubricated. Reliable track tensioning arrangement is provided. Extreme service single grouser shoes of 560 mm width are provided. 4.6Dozer Attachment

The dozer is fitted with hydraulically controlled Straight Tilt Dozer attachment. The dozer blade is of heavy duty type with steel wear plate and heavy duty end bits. Heavy duty hardened steel wear

resistant cutting edges, which comply with ISO 7129 are provided. 4.7Fuel Tank

The fuel tank is of sufficient capacity for 16 hours operation without re-fuelling, and is provided with

a fuel level indicator. Its cap is screwed and lockable.

Construction of the tank is such that it provides for easy accumulation and drainage of water with minimum loss of fuel. 4.8Operator’s Cab

Insulated, sound suppressed, air conditioned walk-through operator’s cab with safety glass,

windshield wiper and washer is provided. The operator’s seat is fully adjustable & comfortable with foam rubber cushion and best quality upholstery. Heavy duty rubber floor mats and a cooling

fan are provided. All doors, windows and vents shall have dust and weatherproof seals. Both a ROPS and FOPS which comply with ISO 3471 and ISO 3449 respectively are provided. All operating controls, monitoring and working signals are conveniently located in consoles within easy reach of the operator and comply with ISO 6405-1, ISO 6405-2 and ISO 7095.

Non-slip type walkways which comply with ISO 2867 shall be provided for access. 4.9Gauges and Indicators
