Ludwig van Beethoven’s 250th birthday will form the focus of the 2020 Baden-Baden Easter Festival with the Berliner Philharmoniker. As Artistic Director Designate, I would like to wel-come Kirill Petrenko, the new Chief Conductor of the Berliner Philharmoniker, in our midst for this edition of the Festival. His Fidelio, in the production by Mateja Koležnik, is certain to re-ceive worldwide attention. The fact that Kirill Petrenko has chosen the Missa solemnis as the second major vocal work by Beethoven this week underscores the message of this year’s Festival: we are celebrating Ludwig van Beet-hoven as a visionary and questioner – but also as a great European. This is not just a matter of music history but also, in my view, an im-

portant attitude.

Already in the nineteenth century, Europe found in Baden-Baden a place for thinking, question-ing, making music, and enjoying. All this will once again be possible during the 2020 Easter Festival. And if we take a closer look at the guest conductors of the Berliner Philharmoniker this year, we also find important links to past and future musical milestones in Baden-Baden.

Yannick Nézet-Séguin and Elīna Garanča will join the Berliner Philharmoniker in offering a new read-ing of Gustav Mahler’s Third Symphony. The new head of New York’s Metropolitan Opera has already fallen in love with Baden-Baden, and so this concert is also a promise of much to come.

Tugan Sokhiev, the principal conductor of Mos-cow’s Bolshoi Theater, will be celebrating his de-but in Baden-Baden – a city whose history shares so many points in common with both Russian

culture and the Russian soul.

I am also delighted that Herbert Blomstedt will once again be leading a concert with the Berliner Philharmoniker, in which he will devote him - self to Anton Bruckner’s Fourth Symphony, the

“Romantic.”

For the first time in the orchestra’s history, we will be hearing Ludwig van Beethoven’s complete string quartets in the context of a single festival – a

special gift in a special year.

When the Berliner Philharmoniker celebrate their eighth Easter Festival at the Festival Hall Baden-Baden, it will be anything but “more of the same.” This is because the new Chief Con-ductor Kirill Petrenko is now taking the reins, and so the orchestra is shed-ding its skin, as it were. We look back at past festivals as a precious heritage to be both maintained and renewed. Practically speaking, this will be high-lighted in Mahler’s Sixth Symphony, with which Sir Simon Rattle not only inaugurated his first Easter Festival, but also con cluded his last, and which Kirill Petrenko will now also be conducting during his first Easter Festival. On a side note, the hammer blow in this sympho-ny has its counterpart in the trumpet signal in Beethoven’s Fidelio. In both works, it is a signal from outside that heralds the turning point: for Beethoven, unlike for Mahler, it is a turning point for the better. From darkness to light: this central theme, which pervades Beethoven’s Fifth Symphony – Kirill Petrenko will be performing the work with the National Youth Orchestra of Germany – also forms the core of the dramaturgy of Fidelio.

Beethoven’s only opera, the centerpiece of this festival, is underpinned by a belief in the future that permeates the music from the very first measure. A rhythmic pulse that surges forward and at times nearly causes the orchestra to boil over – in this connection, we must mention Mateja Koležnik, the Slovenian theater producer who will be directing this Fidelio and who will also be staging productions soon at the Salzburg Festival and at Vienna’s Burgtheater. Koležnik’s trademark is the metronome, which she uses herself in her theater rehearsals to play with meters and their effect on the actors’ flow of speech. From here it is not a wide leap to Beethoven’s com-pact structures, characterized as they often are by mathematical precision: eight bars are followed by four, then two, then one ... We are expecting much from this director-conductor duo. And we are looking forward to Sokhiev’s debut, and naturally also to a reunion with a few of our beloved friends, including Herbert Blomstedt, Leif Ove Andsnes, and Yannick Nézet-Séguin.

IThe excitement is palpable

in anticipation of the first Easter Festival of the Berliner Philharmoniker with

its new Chief Conductor Kirill Petrenko. The focus will be on both continuity and

change, and certainly also invites comparisons (keyword Mahler).

Beethoven’s Fidelio directed by Slovenian theater producer Mateja Koležnik

promises to be especially compelling.

The first opera with the new Chief ConductorDon’t let yourself get too comfortable! For Beethoven, only persistence, struggle, hope, and achievement seemed worthy of art. Overcoming the laxness of habit and forcing oneself to adopt form, the conscious life, to utter the tremendous “it can be otherwise”: this is what makes Fidelio so recogniz-ably – unmistakably – a work that could only have been written by Beethoven. The symphonic impulse that boldly drives Beethoven’s music forward would exert a decisive influence on Wagner. Fidelio has always been most performed and understood in times of transition when something important was involved. With this in mind, Kirill Petrenko will be inaugu-rating his operatic collaboration with the Berliner Philhar-moniker in Baden-Baden with Beethoven’s only opera. The production will also mark a new beginning in the hands of multi-award-winning Slovenian director Mateja Koležnik: the next step on a path taken with deliberation.

HANNA-ELISABETH MÜLLERMarcellinaThe soprano studied with Rudolf Piernay, Dietrich Fischer-Dieskau, Julia Varady, and Thomas Hampson. She gave her debut as Marzelline at the Met in New York and has been a guest at the Salzburg Festival and at Milan’s La Scala.

MATTHEW POLENZANIFlorestanThe American lyric tenor began his career at the opera studio of the Lyric Opera of Chicago. He has since conquered the opera stages of New York, Milan, Rome, Vienna, Berlin, Munich, and Salzburg, and has sung in over 300 performances at New York’s Met alone.

MATEJA KOLEŽNIKProductionThe Slovenian director won the Nestroy Award in 2018 for her production of Chekhov’s “Ivanov.” Since 2012 she has also enjoyed success in the German-speaking world with works at the Munich Residenztheater, Theater in der Josefstadt Wien, and Schau spiel Stuttgart.

RAIMUND ORFEO VOIGTSet DesignerAfter studying in the mas-ter class of Erich Wonder in Vienna, Raimund Orfeo Voigt worked as assistant to his former teacher as well as to Robert Wilson. He has designed sets for the Bayerische Staatsoper, Salzburg Festival, and Berliner Ensemble.

PETER ROSERoccoSince his debut at Glynde-bourne in 1986, the English bass has sung the great roles of his field on major stages throughout the world. At the Festival Hall Baden-Baden, he has ap-peared in Easter Festival productions as Messner in Puccini’s “Tosca” and as Ochs in Strauss’s “Rosenkavalier.”

WOLFGANG KOCHDon PizarroThe foundation of the baritone’s career is the great Wagner roles, includ-ing Hans Sachs, Telra-mund, and Wotan, which he has sung at the Wiener Staatsoper, Bayerische Staatsoper, and at Covent Garden. He has also cele-brated major successes at the Salzburg Festival and in Bayreuth.

MARLIS PETERSENLeonore

Her 2002 debut as Lulu in Vienna helped launch the versatile soprano’s

career. She has since been heard around the world in exciting music

theater productions. Petersen thrilled audiences at the Festival Hall

Baden-Baden in 2017 as Leonore in a performance of the original

version of Beethoven’s opera.

A Festival Hall debut among friendsHow an orchestra and conductor successfully come together is one of the unsolved mysteries of music. Tugan Sokhiev and the Berliner Philharmoniker are united by a musical friendship that is characterized by precisely this ease and facility. When it clicks, the audience can also feel it immediately – as can the professional critics. The latter were captivated when the music director of Moscow’s Bolshoi Theater, in his inimitable way, led the Philharmoniker in a performance of Pictures at an Exhibition. While most conductors perform Mendelssohn with a simple wink of the eye, Sokhiev paints entire cascades of sound, like a pantomime in the air. A Festival Hall debut!

Music for the futureEach Mahler symphony has its own physiognomy. The Sixth has always been called the “Tragic,” even by the composer himself, but this term diminishes the work. Here, as always with Mahler, we find ourselves before an entire cosmos. The first movement alone, with its pomp-filled marches, its cowbell idyll, and, of course, the famous theme that portrays Mahler’s wife Alma – not at all tragic by the way, but strong, sumptuous, forward-striving, and happy. How to encapsulate all of this? In Mahler’s music, it is possible. When the Berliner Philharmoniker performs this Sixth Symphony under its Chief Conductor, it will be with the awareness that the symphony held a special place for Sir Simon Rattle. It was with this work that Rattle began and concluded his tenure with the orches-tra – both times, incidentally, in Baden-Baden. The symphony thus comes with a history that will now be revived, carried further, and, by nature, overwritten by Kirill Petrenko.

My greatest workBeethoven called it his “greatest work,” and the listener truly needs to bring along a good set of equipment in order to con-front the Missa solemnis. This includes enthusiasm for the bold and rigorous – even with all the overcoming of obstacles one is accustomed to with Beethoven. The Missa is one of those works that require you to raise yourself to their height. Here the air is very thin – a fitting image, incidentally, to give an idea of the demands that Beethoven makes of his singers. Here the composer created music for the mankind of the future. Interesting parallels with architecture can be found during the same period: monumental “cathedrals of humanity” on paper that could not yet be technically realized at the time around 1800. Perhaps now, 200 years later, we have progressed enough so that we are ready for the Missa? Its difficulties (breakneck fugues) are as feared as its beauties (the violin solo that portrays the coming of the Holy Spirit) are famous.

Mahler’s monumental symphony with a star castThose who talk about “less is more” aren’t familiar with Gustav Mahler. With his Third, he wrote not only the world’s longest symphony (aside from monuments of undiscovered geniuses lying dormant in archives), but also supplied it with a decidedly confident program: the origin of the world. A primordial be-ginning is followed by a portrayal of plants, animals, humans, and angels – and at the end love prevails. Simply put, this symphony is about … everything. A rich and fascinating work that also provides a wonderful introduction to Mahler’s uni-verse – especially with the “more is more” cast with which we are presenting it today. The alto solo that announces, in the words of Friedrich Nietzsche, the presence of man will be sung by none other than Elīna Garanča. And the fact that the Berliner Philharmoniker will be performing under Yannick Nézet-Séguin testifies to the artist’s exceptional status among the younger generation of conductors.

Avowal of faithConductor Sergiu Celibidache trained in meditation in order to help him with Bruckner’s long symphonic lines. His colleague Günter Wand immersed himself throughout his whole life in questions of tempo – and we must also add a third, Herbert Blomstedt, who in Bruckner’s melodies (like the horn call of the Fourth Symphony) always seeks an additional, a metaphysi-cal dimension. Blomstedt describes himself as religious, which becomes something like an artistic credo with regard to Bruck-ner. And for the conductor it is not a matter of dogma, but of cherished custom to combine Bruckner with Mozart in concert programs. Mozart’s Piano Concerto, K. 482 and Bruckner’s Fourth Symphony are both in the same key of E-flat major, and they both feature C minor slow movements of great depth. Leif Ove Andsnes shares Blomstedt’s spiritual approach to music. With nothing left to chance, everything is an avowal of faith.

In the Baden town of Renchen, Baroque poet Johann Jacob Christoph von Grim-melshausen wrote one of the most important novels of his era: Simplicius Simplicissimus. The adventures of the eponymous hero during the time of the Thirty Years’ War make us reflect on such themes as humanity and oppression. In 1948, when Germany was reinventing itself, Karl Amadeus Hartmann’s opera of the same name was heard for the first time. For the Easter Festival, the “three scenes from his youth” – the work’s subtitle – will be presented in a new production in which young people themselves will be seen on the stage. After all, questions about human dig-nity can never be answered too early.

One of the Easter Festival’s long-standing traditions is the collaboration between the Berliner Philharmoniker and the National Youth Orchestra of Germany. Here the young musicians are mentored by members of the Berliner Philhar-moniker and have the opportunity at the end to present themselves to the Baden- Baden audience – under the baton of none other than Chief Conductor Kirill Petrenko himself. For his premiere with the young artists, Petrenko has chosen a piece in keeping with the other high-lights of this year’s festival program: the most famous classical orchestral work of them all, Beethoven’s revolu -tio nary Fifth Symphony.

Information form for the traveler regarding package tour according to § 651a of the German Civil Code (BGB)

Dear Guest,The combination of travel services offered to you are considered a package tour within the meaning of Directive (EU) 2015/2302. You can thus claim all EU rights that apply to package tours. The Festival Hall gGmbH bears full responsibility for the proper execution of the entire package tour.

In addition, the Festival Hall gGmbH possesses the legally required coverage for the reim-bursement of your payments and, if transport is included in the package tour, to ensure your return transport in the event of insolvency.

The following are the principal rights under Directive (EU) 2015/2302Travelers will receive all the essential infor-mation about the package tour prior to the conclusion of the package tour contract.

At least one operator shall always be liable for the proper provision of all travel services included in the contract.

Travelers will receive an emergency tele-phone number by which they can contact the tour operator or travel agency.

If the price increase exceeds 8% of the package tour price, the traveler can withdraw from the contract. While a travel operator reser-ves the right to increase the price, the trave-ler has the right to a price reduction if the corresponding costs are reduced.

Travelers are entitled, without payment of a cancellation fee according to D 14.2 tour pack-age form § 651 BGB Version 1 11.06.2018 JK, to withdraw from the contract and receive a full refund of all payments if one of the essential components of the package tour, with the exception of the price, is substan-tially altered. If the operator responsible for the package tour cancels the package tour before the start of the package tour, travelers are entitled to reimbursement and possibly to compensation.

In the case of the occurrence of unusual cir-cumstances, travelers are entitled to withdraw from the contract prior to the start of the package tour without payment of a cancel-lation fee, for example if there are serious security problems at the destination that are likely to affect the package tour.

In addition, travelers can withdraw from the contract at any time prior to the start of the package tour upon payment of an appropriate and reasonable cancellation fee.

If, after the start of the package tour, essen-tial components of the package tour cannot be carried out as agreed, other appropriate arrangements shall be offered to the traveler at no additional cost. The traveler can with-draw from the contract without payment of a cancellation fee (in the Federal Republic of Germany this right is called “termination”) if services are not provided in accordance with the contract and this has considerable effect on the provision of the package tour services stipulated by the contract and the tour operator fails to remedy the situation.

The traveler is entitled to a price reduction and/or compensation if the travel services are not provided or not properly provided.

The travel operator shall provide assistance to the traveler in the event of difficulties.

In the event of insolvency of the tour operator or, in some Member States, of the travel agent, payments will be refunded. If insolvency of the tour operator or, if applicable, the travel agent occurs after the start of the package tour and if transport is part of the package tour, the traveler’s return transport is guaran-teed. The Festival Hall gGmbH has insolvency insurance with R+V Allgemeine Versiche-rung AG, Raiffeisenplatz 1, 65189 Wiesbaden. Accessibility/suitability for persons with reduced mobilityOn a Festival Hall cultural tour, we use various means of transport such as buses or taxis and stay overnight in different hotels of varying standards. PaymentUpon conclusion of the contract, a deposit of 20% of the invoice amount is due. The balance is due four weeks before the start of the tour. For contracts concluded less than four weeks

before the start of the tour, the total price is to be paid immediately.

Withdrawal/termination and change in booking by the customer/representativeThe customer can withdraw from the tour at any time prior to the start of the tour. If the customer withdraws from the travel contract or does not join the tour, the operator may demand lump-sum cancellation costs as a reasonable compensation for the travel arrangements made as well as the expenses. This does not apply to termination due to force majeure within the meaning of § 651h par. 3 of the German Civil Code (BGB). The cus-tomer must declare the withdrawal to the operator in writing. These lump-sum cancel-lation costs are, per registered participant:

up to the 30th day before start of the tour 15% of the tour price, from the 29th to the 15th day before start of the tour 40% of the tour price, from the 14th to the 7th day before start of the tour 50% of the tour price, from the 6th to the last day before start of the tour 80% of the tour price, from the day of the tour 95% of the tour price.

The calculation of the lump-sum cancellation costs shall be determined with reference to the time of receipt by the operator of the customer’s cancellation notice. The operator shall have a claim to compensation exceeding that agreed in the lump-sum cancellation costs if the operator provides evidence sub-stantiating such claim.

The traveler can declare, within a reasonable period before the start of the tour on a durable medium, that instead of him/herself, a third party enters into the rights and obligations under the package tour contract. The decla-ration is in any case timely if it reaches the operator not later than seven days before the start of the tour. The operator may object to the entry of the third party if the latter does not fulfill the travel requirements specified in the contract. If a third party enters into the

contract, he/she and the traveler are jointly and severally liable to the operator for the tour price and for the additional costs incurred by the entry of the third party. The operator may demand reimbursement of additional costs only if and to the extent that they are reasonable and actually incurred. The operator must provide the traveler with proof of the amount of additional costs incurred by the third party.

Booking modification requests by the customer with regard to travel dates, accommodation, meal type, or type of transport are considered up to 30 days before the start of the tour, if feasible, for a processing fee of € 25 per person and any additional costs incurred. After expiry of this period, booking modifi-cation requests by the customer can only be processed after withdrawal from the tour contract in accordance with the above-mentioned conditions and simultaneous new booking. Exceptions to this are the type of transport and meal type, for which the stipu-lated processing fee continues to apply.

We recommend that you obtain travel cancellation insurance.

Cancellation by the operatorThe operator may withdraw from the contract prior to the start of the contract in the following cases(I) For the package tour, fewer persons have registered than the minimum number of par-ticipants specified in the contract: in this case, the operator must declare the withdrawal at least 20 days prior to the start of the tour for a travel duration of more than six days, seven days prior to the start of the tour for a travel duration of at least two and not more than six days, and 48 hours prior to the start of the tour for a travel duration of less than two days.

(II) The operator is prevented from fulfilling the contract due to unavoidable, extraordinary circumstances: in this case, he must declare the withdrawal immediately after learning of the reason for withdrawal. If the operator withdraws from the contract, the operator forfeits the claim to the agreed tour price. If the operator is liable to refund the tour price as a result of withdrawal, the operator must issue the refund within 14 days after the withdrawal.

General Terms and Conditions of Travel of Festspielhaus und Festspiele Baden-Baden gGmbH for travel events

In cases in which Festspielhaus und Fest-spiele Baden-Baden gGmbH (hereinafter “Organizer”) operates a package tour within the meaning of Section 651 a BGB (German Civil Code) on its own responsibility and offers it in its own name, the legal relationship between the customer and the Organizer is regulated in accordance with the General Terms and Conditions of Travel below and Sections 651 a ff. BGB (German Civil Code).

1. Conclusion of the travel contractBy registering in writing, in person, or by phone, the customer makes a binding offer to the Organizer to conclude a travel contract. The receipt of the customer’s registration shall immediately be confirmed electronically. Registration by the customer shall also take place for all the participants listed in the reg-istration, and the customer shall be respon-sible for their contractual obligations as well as for his or her own obligations insofar as he or she has assumed a separate obligation to this effect in the form of an express separate declaration. The contract shall be concluded when the Organizer accepts the registration. Such acceptance does not require any parti-cular form. On or immediately after the con-clusion of contract, the customer shall receive the confirmation of travel, which can be issued in writing or electronically on a durable me-dium. If the details of the travel confirmation differ from the registration, the travel confir-mation shall constitute a new offer from the Organizer, by which the Organizer shall be bound for ten days and which the customer can accept within this period by means of an express declaration, the payment of a deposit, the payment of the balance, or by commencing the trip. After the contract has been concluded, the text of the contract will be stored by the Organizer and will be handed over to the customer on request. The con-tractual language is German. The Organizer shall inform the customer, before the custom-er confirms his or her agreement with the terms, pursuant to Article 250 Sections 1 to 3 of the Introductory Law to the German Civil Code (EGBGB).

2. PaymentPayments of the price of travel before the package tour has ended are to be made only when there is a valid contract of guarantee for the customer’s money and when the name and bank details of the guarantor were pro-vided to the customer clearly, understandably, and in a prominent manner. The financial guarantee certificate will be sent to the custo m-er together with the confirmation of travel. A deposit of 20% of the invoice amount is due for payment on the conclusion of contract and the handover of the financial guarantee certificate. The balance of payment is due

four weeks before the departure date. If con-tracts are concluded less than four weeks before the departure date, the full price is payable immediately. After receipt of payment, we will send the customer the travel docu-ments (vouchers, tickets, etc.) around two weeks before the departure date. The custom-er must check all the documents received for correctness regarding those details which are within the sphere of the customer con-cerned and of the participants listed in the registration. The customer must assert any complaints to the Organizer immediately. No account can be taken of later complaints. If for reasons of time it should no longer be possible to send the travel documents out, they will be kept at the box office of the Festival Hall Baden-Baden.

3. ServicesThe contractual scope of services derives from the details in the confirmation of travel. If the Organizer uses brochures, the scope of services derives from the travel descriptions in the respective brochure. The details con-tained in the corresponding publication are binding upon the Organizer. However, the Organizer expressly reserves the right to de-clare a change to the details in the brochure before the conclusion of contract; the custom-er will be informed of this before booking.

4. Dispatch of travel documentsThe travel documents will be sent to the address provided by the customer. Partial deliveries are permissible provided these are reasonable for the customer. The Organizer should be informed immediately if the cus-tomer has not received the travel documents by seven days before the departure date at the latest.

5. Changes to the service and price after the conclusion of contractChanges to individual travel services and departures from the agreed content of the travel contract which become necessary after the conclusion of contract and are not introduced by the Organizer contrary to good faith are permitted, provided they are insig-nificant and do not adversely affect the over-all nature of the trip booked. The Organizer must immediately inform the customer of changes in the terms of contract on a durable medium and clearly, understandably, and in a prominent manner. A change is only valid when it meets these conditions and is declared prior to the commencement of the contract. In the event of insignificant changes to the program and the cast after the conclusion of contract, the booked trip shall remain in place with the changed cast or the changed program. In this case, the customer does not have any right of withdrawal from the trip. When due to circumstances occurring after the conclusion of the contract, the Organizer can only provide the travel service to the client by altering one of the essential characteristics of the travel service, or by departing from special provisions of the customer that form part of the contract, the Organizer can offer a corresponding price increase and require for the customer, within an appropriate time frame, to (i) accept the price increase or (ii) withdraw from the contract. Optionally, the Organizer can also offer a different package tour (replacement tour). After the expiry of the time period determined by the Organizer, the offer of a price increase or other changes in the contract is deemed to be accepted.

6. Withdrawal/termination and change of booking by the customer/substitute personThe customer can withdraw from the trip at any time before the departure date. If the customer withdraws from the travel contract, or if he or she does not commence the trip, the Organizer can demand a flat-rate with-drawal fee as appropriate compensation for the travel arrangements made and the Organizer’s expenses. This does not apply to termination due to force majeure within the meaning of Section 651 h Para. 3 BHB. The customer must declare his or her with-drawal to the Organizer in writing. These flat-rate withdrawal costs per registered participant are:

up to the 30th day before start of the tour 15% of the tour price, from the 29th to the 15th day before start of the tour 40% of the tour price, from the 14th to the 7th day before start of the tour 50% of the tour price, from the 6th to the last day before start of the tour 80% of the tour price, from the day of the tour 95% of the tour price.

The effective date for the calculation of the flat-rate withdrawal fee is the date on which the customer’s declaration of withdrawal is received by the Organizer. The Organizer can assert higher damages than those agreed in the flat-rate withdrawal fee if it provides evi-dence of these. Within an appropriate time frame before the departure date, the customer can declare on a durable medium that instead of him or her, a third party shall succeed to the rights and obligations flowing from the package travel contract. In each case the dec-laration is in due time when it reaches the Organizer no later than seven days before the departure date. The Organizer can refuse entry of the third party if he or she does not meet the demands stipulated in the travel contract. When a third party enters into the contract, he/she and the customer are jointly and severally liable to the Organizer for the price of the trip and for the additional costs incurred by the entry of the third party. The Organizer can claim reimbursement of addi-

tional charges only if, and to the extent that, they are actually and reasonably incurred. The Organizer must provide proof to the customer of the amount of additional charges incurred through the entry of the third party. If the customer wishes to change his or her booking in respect of the date of travel, accommoda-tion, form of catering, or method of transport, provided it is feasible, account will be taken of this up to 30 days before the departure date in return for a processing fee of € 25 per person and any additional costs arising. After this period has expired, the customer’s wishes to change his or her booking can only be dealt with after he or she has withdrawn from the travel contract in accordance with the aforementioned conditions and simulta-neously made a new booking. Exceptions from this are the means of transport and the form of catering. The agreed processing fee will continue to apply here.

7. Withdrawal by the OrganizerThe Organizer can withdraw from the contract before the departure date in the following cases: (i) When fewer people have registered for the travel package than the minimum number of participants specified in the con-tract; in this case the Organizer shall declare withdrawal at the latest 20 days before the departure date for a trip duration of more than six days, seven days before the departure date for a trip duration of at least two and at most six days, and 48 hours before the departure date for a trip duration of fewer than two days. (ii) The Organizer is prevented from comply-ing with the contract due to unavoidable and exceptional circumstances; in this case the Organizer shall declare withdrawal imme-diately upon learning of the reason for with-drawal. If the Organizer withdraws from the contract, he loses any claim to the agreed-upon trip fee. If due to withdrawal, the Organizer is liable to reimburse the trip fee, he shall do so within 14 days after the withdrawal.

8. Guarantee/redress/withdrawalIf it is not possible or reasonable for the customer for redress for a deficiency to be provided via the respective service provider, the customer shall be obliged to immediately

inform the Organizer of any deficiencies occurring and request redress. The Organizer can refuse to provide such redress if this is impossible or requires disproportionate ex-pense. Insofar as the deficiencies relate to a substantial portion of the travel services and the Organizer is not obliged to provide redress, the Organizer shall provide redress in the form of appropriate compensation in accordance with Section 651 k Para. 3 BGB. A withdrawal by the customer from the travel contract on account of a deficiency in the trip which has a substantial adverse effect on the trip is only permissible if the Organizer does not provide any reasonable redress after being given an appropriate period to do so by the customer. No such period is required if redress is im-possible, is refused by the Organizer, or if immediate termination has been received, unless the customer has been prevented from complying with the time limit through no fault of his or her own. Apart from claims in his or her own name, the aforementioned claims can also be registered by the customer for family members traveling with him or her, or in the name of travel participants who were represented by the customer when registering for the trip. The traveler’s contractual claims on account of deficiencies in the trip according to Section 651 i Para. 3 BGB shall expire in accordance with the statutory authorization (Section 651 i BGB) in two years, calculated from the day the travel package is to end according to the contract. If the last day of this period falls on a Sunday, on a nationally recognized, general public holiday at the place of declaration, or on a Saturday, the next working day shall be deemed to be the end of the period. If the customer has asserted such claims, their expiry is blocked until the day on which the Organizer definitively rejects the claims in writing. The cession of claims against the Organizer is excluded.

9. Limitation of liabilityThe Organizer’s contractual liability for damages that are not physical injuries is limited to three times the price of travel insofar as damage to the customer is not culpably caused. No claim to compensation can be made insofar as the deficiency is caused by the customer or a third party who is neither the service provider nor involved in any other way in providing the travel service stipulated in the package travel contract,

and was not foreseeable or was unavoidable for the Organizer or was caused by unavoid-able and exceptional circumstances. Liability for fault and personal injury remains unaffected.

10. Events at the Festival Hall Baden-BadenCustomers are forbidden to make sound, photo, film, or video recordings. Once the event has started, customers can only enter the hall as appropriate during a break for late admissions. The instructions of the personnel must be followed. If a customer leaves the room or site of the event after being admitted or during a break, or if the tear-off section of the ticket is removed by a third party in-structed by the Organizer, the ticket shall lose its validity.

11. Place of jurisdiction/applicable lawThe Organizer’s registered office is the com-petent place of jurisdiction, and this contract shall be governed by German law, though in both cases only insofar as the customer is a merchant.

12. Passport, visa, customs, foreign currency, and health regulationsThe Organizer shall inform citizens of the EU member state in which the trip is offered about the provisions of the regulations con-cerning passports, visas, and health before the departure date, as well as any changes to these. Nationals of other states should obtain information from the embassies/consulates responsible for them. It is assumed that no special circumstances (e.g. dual citizenship, statelessness) apply to the customer and other participants. The Organizer is not liable for the necessary visas being issued by the respec-tive diplomatic representation and received in good time. The Organizer is not responsible for compliance with customs and foreign currency regulations.

13. Information about possible insurance policiesThe Organizer wishes to point out that it is possible to take out travel cancellation and luggage insurance and also travel health insurance.

14. Severability clauseThe ineffectiveness of individual provisions of the travel contract does not affect the ef-fectiveness of the travel contract otherwise.The same applies to these General Terms and Conditions of Travel. Version of March 2018
