TERMS OF E-AUCTION IN BRIEF

1. For e-auction bidders are to deposit Caution Money Deposit (CMD) as mentioned in Appendix I & II for respective lots through electronic mode on or before 11.01.2018 before 4.00 PM for e-Auction in the auctioneer office, without which no one can enter the auction room.

2. Intending bidders can place their offers in e-auction i.e. www.tenderwizard.com on 12.01.2018 from 10.00 a.m. to 12.00 p.m. If not registered, bidders are requested to register their name/s on www.tenderwizard.com/cwc .

3. The bid/offers accepted on “SUBJECT TO CONFIRMATION” (STC) will be forwarded to Customs Department for Clearance so as to file Bill of Entry in the name of successful bidder/purchaser for approval/ assessment of Customs Duty.

4. The confirmation of bid of cargo shall be intimated to successful bidders after Bill of Entry is approved by Customs Department. The bidders shall deposit the balance amount along with GST within five (5) working days from the following date of issue of confirmation by CWC. However, delivery of auction goods shall be made after getting out of charge from Customs. If the bidder fails to deposit the balance amount and GST within stipulated period of five (5) working days from the following date of confirmation, their CMD/EMD shall be forfeited. Bidders will be allowed to take delivery of the goods within five (5) working days from the date of out of charge. Bidders should be in touch with CWC to know the information about out of charge, any excuse of non-receiving information will not be entertained by this office.

5. If the bidders fail to take delivery of the cargo within the stipulated time, as stated above, the Corporation, i.e., CWC may at its discretion extend the delivery period on request of the successful bidder for a maximum period of fifteen (15) days after the expiry of free period of five (5) days as mentioned at Sl. No. 4 on payment of Ground Rent by the purchasers as per tariff applicable.

6. If the purchaser fails to take delivery of the goods within the maximum period permitted by CWC on payment of rental warehousing charges as detailed above, the CMD/EMD deposited by them will be automatically forfeited and the cargo will be re-listed for the sale without any further notice.

7. The goods/ lots will be sold on “AS IS WHERE IS” basis. Neither Auctioneer nor CWC is responsible for its quality, size, quantity, measurement, etc., of the goods. Goods are sold on the assumption that the bidder/purchasers have inspected the lots prior to the bidding and are in full knowledge of what they are buying. The weights shown in the auction catalogue are given as per the IGM/ records available at the CFS and CWC does not guarantee for correctness of the weight. No request of any kind towards the quality, quantity, size etc. shall be entertained after the lot is once knocked down.

8. The delivery of auctioned goods shall be effected after completing Customs formalities and getting Out of Charge Order from Customs.

9. CWC reserves the right to accept or reject highest bid, if it is found to be less than the reserve price fixed for each lot.

10. The items put up for sale are imported un-cleared / un-claimed cargo under the custody of the seller. Any lot or part thereof may be withdrawn from sale at any time before it is actually sold / delivered without assigning any reason for such withdrawal.

11. Announcement, if any, during the auction on the website including announcement of any additional conditions or correction in the catalogue and / or additions or deletions of items being offered for sale are being done with the consent and knowledge of the CWC and it is binding on the bidder.

Important Note:

The items like Zinc/ Chromic Ash. /Lead Battery Scrap etc. covered under the restricted Import Policy and shall only be sold to those parties who shall be having valid licence to deal in such material from the Ministry of Environment & Forest (MoEF) or DGFT.

The consignment of Liquor / Wine etc. shall only be sold to those parties who shall holding valid STATE EXCISE LICENCE in their own name.

Bidders are advised in their own interest to read the detailed terms and conditions of sales enclosed herewith. All the goods are sold on LOT basis only and bids are to be placed for entire LOT.

GST as applicable & other examination charges etc. shall be charged extra at the time of the delivery.

Delivery will be affected subject to the final clearance from the Customs i.e. after receiving out of charge from Customs Department.

Bidding in the last minutes and seconds should be avoided in the bidders’ own interest. Neither the Service Provider nor CWC will be responsible for any lapses/failure on the part of the bidder, in such cases.

Bidding Currency: Bidding will be conducted in Indian Rupees (INR) only. Disclaimer: Bidders must read carefully all instructions in the auction document and submit / participate in e-auction accordingly. For any non-compliance CWC will not be responsible.

INSTRUCTIONS TO APPLICANTS DEFINITIONS

a) KSEDC(KEONICS): A service provider to develop and customize the software andfacilitate the process of e-auctioning on application service provider model.

b) Auction Wizard: An e-auctioning portal of Central Warehousing Corporation (“CWC”) introduced for the process of e-auctioning which can be accessed on www.tenderwizard.com/CWC.

Words in capital and not defined in this document shall have the same meaning as in the Auction document.

A. Registration of user and ACCESSING OF BID DOCUMENTS:

i. It is mandatory for all the Applicants to have class-III digital signature certificate (in the name of person who will sign the Application Form) from any of the licensed certifying agency (“CA”) *Applicants can see the list of licensed CAs from the link www.cca.gov.in to participate in e-auction.

ii. To participate in the auction, it is mandatory for the bidders to get registered

with e-auctioning portal www.tenderwizard.com/CWC by making annual registration charges of INR 5000/-+ applicable GST through online e-payment gateway only. The detailed registration process is placed at Annexure II. GST No. PAN No. and Bank details are mandatory for activation of registration.

iii. Documents can be viewed/downloaded, free of cost, till period of availability

of application on Tender Wizard. The amendments/clarifications to the Auction, if any, will be posted on the CWC website.

iv. If the Applicant has already registered with the Tender Wizard and validity of

registration has not expired, then such Applicant does not require fresh registration.

B. SUBMISSION OF ACCEPTANCE FORM AND CMD:

a. Detailed Auction Documents may be downloaded from Auction Wizard and the Scanned Copy of Acceptance Form & CMD may be submitted online before last date and time for submission. A Vendor manual containing the detailed guidelines for e-auctioning system is also available on Auction portal.

b. It may be noted that the scanned copies can be prepared in file format i.e. PDF and/or JEPG only. The Applicants can upload a single file of size of 5 MB only but can upload multiple files.

C. ADDENDUM TO THE AUCTION:

Any Addendum to the Auction shall be uploaded only on the e-auction portal. Online bidding process : Once the bidder submitted acceptance and CMD form upon registration , the bidder to follows vendor manual for bidding instruction which is available at e-auction portal.

ANNEXURE-I

GENERAL CONDITIONS OF SALE/AUCTION

The below mentioned conditions are applicable for e-auctions/tender-cum-e-auction/physical auction as well. Regarding e-auction the contents relating with physical auction, if any, shall not be applicable. The conditions are subject to change, as and when required to comply any statutory requirements.

A. DEFINITIONS

SELLER – Seller referred in these conditions of sale, is the Custodian, Central WarehousingCorporation, Regional Office, Chennai (hereinafter referred to as CWC) SERVICE PROVIDER/AUCTIONEER – M/s Karnataka State Electronics DevelopmentCorporation Ltd (KEONICS), an agency appointed as a Service Provider/auctioneer to facilitate auction on e-auction/ Internet by the Custodian on their website: www.tenderwizard.com/CWC.They are expected to facilitate organizing and conducting an auction and are considered as third party not particularly interested in the item being sold for and on behalf of the Central Warehousing Corporation

BIDDER – Any person representing as an individual OR as proprietor OR as a partner OR asan authorised representative of any company and who is Registering himself on the website www.tenderwizard.com/CWC and paying the stipulated amount of Earnest Money/CautionMoney to decide/ set their bidding Limits is considered as a Registered Bidder. One individual can represent as a bidder on his own behalf and on behalf of other persons/ companies provided he registers himself in those capacities separately i.e. for each representation he should pay separate stipulated caution money and set the Bidding Limits. But he can’t register separately for himself & company at the same time.

B. PARTICIPATION (i) Only REGISTERED Bidders shall be allowed to participate in the on-line auctions. To

become REGISTERED Bidder one needs to register with the service provider/auctioneer website www.tenderwizard.com/CWC either on-line or in person at office of auctioneer.

(ii) Registered Bidders will be required to E-mail/Fax/Courier/Hand Delivered a duly

signed copy of the Form “Acceptance to Participate Form” given in Annexure –II to the office of the Auctioneer thereby giving their consent to terms and conditions of the Online Auction Sale. The Auctioneer will activate Identity and Passwords of the Registered Bidders in the Online Auction method of Bidding ONLY after receipt of the

signed Registration Form and On Payment of prescribed CMD. (iii) Bidder shall enter a valid e-mail ID in the Registration Form. All e-mail

communications will be forwarded to the e-mail ID entered in the Registration Form. (iv) Time Extension: If any market-leading bid (bid higher than the highest at the point in

time) is received within the last 5 minutes (“Time Extension” as mentioned in the Bidding Room will be in force & 5 Minutes is an example) of closing time, the time will be extended automatically by 5 minutes. If no further bid higher than the last quoted highest bid is received within the said extended five minutes then the auction sale will be automatically closed.

(v) Auto Bid:

a. Auto Bid facility is provided for bidders intending to place a maximum value for a lot/lots.

b. Auto bid is not a confirmed bid. It is only the maximum ceiling amount set by

the bidder to enable the auction engine to place bids on his behalf, whenever he is out-bided, upto the ceiling set by him.

c. Once auto bid is set, the auction engine will consider the ceiling amount for

the next possible Bid only, depending on the highest bid prevailing at that point of time and the increment amount prescribed for that particular lot.

d. Bidders may please note that in the event of a manual bid amount matching

that of auto bid, the manual bid will prevail and be considered

(vi) Training and Assistance Booth for the prospective Bidders: Prospective bidders can get the required information on e-auctioning process on working days during working hours. The representative of service provider will be available at CWC-Chennai on the date of auction.

(vii) Bids: Once the bid is placed, the bidder cannot reduce or withdraw the bid for

whatever reason. If done so, the CMD amount shall be forfeited. The bidders are required to quote for the rate with reference to the item(s) on e-auction over and above the start price mentioned in the Appendix-I&ll and as visible on the bidding screen. E-auction will start and end as per schedule mentioned in offer document. The bid for e-auction shall start with minimum one increment above the start sale rate. Minimum increment of bid in e-auction for all lots in Section -l shall be Rs.5000/- and for all lots in Section-ll shall be Rs.100/-or multiple thereof.

(viii) The bidder shall be solely responsible for all consequences arising out of the bid submitted by him (including any wrongful bidding) and no complaint/ representation will be entertained in this regard by the CWC/Service provider Hence bidders are cautioned to be careful to check the bid amount and alter/rectify their bid if required before confirming the bid submitted.

Note of caution for the Bidders: Bidders may encounter certain unforeseen

problems such as time lag, heavy traffic, and system / power failure at the Bidders end. To avoid losing out on bidding because of above-mentioned reasons, it is advised not to wait for the last moment for submitting their bids.

(ix) All bids placed by the bidder are legally valid bids and are to be considered as bids

from the bidders himself. Once the bid is placed, the bidders cannot reduce or withdraw the bid for whatever reason. If done so CWC will forfeit the CMD. The highest bid and the latest bid on the auction shall supersede all the previous bids of the bidder. The bidder with the highest offer / bid does not get any right to demand acceptance of his bid.

(x) VALIDITY: The online auction bidders will have to keep their bids valid till the

confirmation of acceptance or non-acceptance of bids by Central Warehousing Corporation. By submitting Registration/Acceptance form, the bidder will agree to keep open their bid till decision of acceptance or non-acceptance of bids is conveyed to them by Central Warehousing Corporation.

(xi) DEMO / MOCK AUCTION: For bidders who have indicated non familiarity with e-

auction,training on a DEMO / MOCK AUCTION will be arranged by KEONICS with prior appointment. Only those bidders who have registered themselves for the auction by submitting the “acceptance form” and have paid the CMD can participate in this auction. No training will be given during the day of actual e-auction.

(xii) DISPUTE / ARBITRATION: All disputes and differences arising out of this e-auction

process or any way touching or concerning this e-auction process whatsoever the matter shall be refer to the sole arbitration of any person so appointed by the Managing Director, Central Warehousing Corporation, New Delhi. The award of such Arbitrator shall final and binding on the participants / bidders to this e-auction process.

C. TERMS & CONDITIONS OF SALE/AUCTION: 1. The highest bid for each lot shall be subject to the confirmation hereinafter

mentioned as STC. In the event of any dispute as to last or highest bid, the same shall be decided by the CWC representative present at the sale & the lot or lots in question may be re-auctioned at his discretion.

2. The goods will be sold on lot basis and the delivery will be given as lot only. Goods

may be sold in one or more lots as found suitable and convenient and / or advantageous in the opinion of the CWC representative present at the Auction Sale.

3. Any lot or part thereof may be withdrawn from sale at any time before it is actually

sold / delivered without assigning any reason for such withdrawal. 4. The Auctioneers may, in consultation with the CWC representative present at the

sale, refuse to accept the bid of any person or persons without giving any reason whatsoever.

5. All bids invited/quoted are for the net amount accruable to Central Warehousing

Corporation and GST applicable on the date of delivery shall be payable by the bidderbefore taking delivery of cargo.

6. CONDITIONS OF PAYMENT:

i) The bidder who wants to participate in online Auction shall pay lot-wise Caution Money Deposit(CMD) as fixed by the Regional Manager,CWC,RO, Chennai and as shown at Appendix I & II .CMD/EMD will be accepted in the form of account payee DD/Pay order favouring Central Warehousing Corporation payable at Chennai or through RTGs payment only. The Bank details for payment of CMD through online/RTG payment, are as under:

ii) In respect of e-auction, on acceptance of Rate/Offer by the Central Warehousing Corporation, the bidder will have to pay 20% of purchase price as EMD with CWC within 3(Three) working days from the date of intimation, failing which the CMD liable to be forfeited. The amount of Caution Money Deposit paid by the bidder can be adjusted against the EMD payable.

iii) In respect of lots for which bid / offers accepted on STC/Confirm basis, “Bill of Entry for uncleared goods” shall be filed with Customs by Custodian for assessment of Customs Duty and clearance.

iv) The confirmation for delivery of cargo shall be intimated after getting the approved

Bill of Entry in the name of the successful bidders from the Customs Department. The bidders shall have option to collect the approved/Processed Bill of Entry from CWC, arrange payment of Customs Duty to Customs, get Out of Charge Order from Disposal Section at Custom House and submit the same to CWC along with payment of Balance Bid amount and GST as applicable and take delivery of the auctioned goods / cargo within five (5) days from the date following the date of approval of Bill of Entry. Otherwise, purchasers shall bear the interest levied on duty by Customs.

v) If the bidders fail to take delivery of the cargo within the stipulated time. as stated

above, the Corporation, i.e. CWC may at its discretion extend the delivery period on request of the successful bidder for a maximum period of fifteen (15) days after the expiry of free period of five (5) as mentioned at Sl. No. iv on payment of Ground Rent by the purchasers as per tariff fixed in this regard.

vi) If the purchaser fails to take the delivery of the goods within the maximum period permitted by CWC on payment of rental warehousing charges as detailed above, the earnest moneydeposited by them will be automatically forfeited and the Cargo will be re-listed for the salewithout any further notice.

vii) The payment will be accepted on all CWC working days from 10.00 hrs. to 16.00 hrs.

7. The purchaser of each lot shall give his name, address, fax number, e-mail, phone /

mobile number to the auctioneers. If the purchaser fails to pay the earnest money after the lot is knocked down to him, the bid shall forthwith be cancelled and the lot re-auctioned on account and at the risk of defaulting purchaser who shall be responsible for the deficit, if any, in the price but shall not be entitled to any increase, if any arising from such resale, CWC shall reserves the right to take such action against the defaulting bidder as may be authorized by the law.

8. No sale shall be invalidated by reason of any defect or faults in any of the lots being

in-correctly described and no compensation shall be paid in respect of any such faults or errors of description.

9. The goods are sold “AS & WHERE THEY LIE” condition. The lot or lots shall be

removed in full from the site with all faults and flaws in description or otherwise and no selection or sorting of the material will be allowed. Quality, quantity, size, measurement, number and weight stated are approximate. Goods are sold on the assumption that the bidders have inspected the lot prior to the bidding and know what they are bidding for. No complaint shall be entertained after the lot is once knocked down / highest bid accepted.

10. The goods shall lie at the sole risk and responsibility of the Purchaser in all respects from the time of sale and must be taken away by the Purchaser at his own expenses within stipulated time.

11. If the goods are not removed within the specified period, the CMD/EMD and the other payment made by the Purchaser will be forfeited. Similarly, in case, CWC Administration could not deliver the goods within the specified time due to unanticipated administrative reasons, suitable extension of period shall be granted to the purchaser and he will not be liable to pay ground rent or any other charges, till the expiry of such extended period of date of intimation whichever is earlier.

12. When CWC’s unserviceable items/scrap goods are sold on basis of lots and the

purchaser fails to obtained the delivery of the whole or portion of the goods sold, he

shall not be entitled to make any claim other than for the proportionate refund of the value of the undelivered quantity. He shall not be entitled to claim any damage, loss or profit, interest on compensation or any other account, access quantity, if any, will be paid for in advance before the material is removed.

13. All bidders/ purchasers shall be deemed to have read and acquainted themselves

with these conditions of sale and agree to give their bids subject to these conditions. The bidder shall be deemed to have self-satisfied regarding eligibility for a particular lot. No claim from any bidders regarding their eligibility shall be entertained at any later stage. In case of physical auction, in the event of any dispute regarding amount of highest bid, the decision of the auction committee present at sale will be final and binding to the bidders. The bid sheet shall be signed only by the highest bidder i.e authorised signatory of the firm giving the offer along with all auction committee Members of the auction Committee.

14. The delivery of the goods either in part or in full would be subject to being withheld, if

required, by CWC at any stage before actual delivery, without assigning any reason and delivery will be taken by the bidder/ after permission by the CWC.

15. CWC shall not be responsible for any loss or liabilities of the bidders if the purchased

lots could not be delivered due to circumstances beyond control. 16. If the goods other than mentioned are found at the time of delivery, the sale may be

cancelled by the CWC administration. In such case the refund of CMD/EMD or any other payments made by the purchaser shall be given by the CWC without any interest unless it is forfeited as above.

SPECIAL CONDITIONS:

17. The offers acceptable to CWC on “Subject to Confirmation” (STC), will be sent to

respective Customs for final acceptance. The confirm sale will also be sent to Customs for BOE processing etc. The decision will be announced within a period of 60 (sixty) days from the date of closing of e-Auction or extended time of up to one month thereafter by CWC considering the processing of bids by Customs, which will be binding to the bidder. The Confirmation of Sale will be issued after getting clearance from Customs. If bidder wants to withdraw offer after expiry of stipulated period, a fortnight notice is to be issued by bidder to CWC.

. 18. Any information regarding acceptance under STC, other information such as notices,

extension of time etc. will be communicated to the respective bidders through Post/E-Mail / Fax. Bidder also should be in touch with the auctioneer to have exact information will not be entertained by this office.

19. For delivery of the lots particularly for those sold on weight basis, the purchasers are

requested not to wait for the last date of free period to effect delivery as no extension of time will be allowed for any reason whatsoever for extra payment of price or additional quantities as ascertained at all the time of weighment. The purchaser will

be required to make his own arrangement for providing weighment equipment, labour etc if facility is not available at the unit or if facility available at unit the bidder shall pay charges accordingly.

20. Balance amount to be paid to CWC should be either by account payee Pay Order or

Demand Draft drawn in favour of CENTRAL WAREHOUSING CORPORATION, payable at Chennai, before start of delivery.

21. Purchasers are required to complete all the formalities connected with ADC/ PHO/

Custom/ PPQ/Any Statutory Authority at their own, before goods are delivered to them.

22. For all the goods sold on subject to mutilation and fumigation and allied Custom/

Assistant Drug Controller / Port Health Officer / Pollution Control Board formalities, free period of 30 Calendar days only will be allowed for completing all formalities from the date of confirmation of offer. If the concerned authority does not certify the approval within the time specified, the purchaser will have the option to come forward and withdraw the offer within 15 days i.e. before the expiry of 45 calendar days not apply for cancellation of sale, the warehouse rental charges as notified in the CWC Tariff will be recovered from the 31st day following the date of confirmation of offer. The earnest money deposit / Purchaser’s Price will be forfeited and the sale will be cancelled if the purchaser does not withdraw the offer between 31st day and the 45 the days following the date of confirmation of the sale. Goods shall be mutilated only under Custom’s Supervision to avoid misuse of Trade Mark, Name etc.

23. While bidding for the lots, the bidders are advised to take note in their own interest

that the bids for such restricted items for example plastic scrap, metal scrap etc. should be quoted if they are so eligible. They should submit license/certificate as required under Customs Act/Policy to the Customs/CWC before taking out of charge from Customs. Further, to ensure that consignments of bulk drugs are sold only to actual users i.e. manufactures holding valid manufacturing license under Form 25 and 28 with valid permission for the usages of the said bulk drugs in its formulation, the bidder should attach the following documents to their offer forms.

i] Counterfoil of the application form along with a Xerox copy, submitted by the

actual user holding license to the bank for obtaining Demand Draft / Pay Order should be attached to the offer form along with the DD / PO.

ii] Likewise, the purchaser while bidding in auction should produce the documents (i) in

original or copy duly certified by the Asst. Drug Controller. Initial verification of requisite documents will be done by the officer of Sales branch attending tender. Only the authorized representative of the manufacturing firm is permitted to bid in the auction. He should produce authority letter from his firm for inspection before acceptance of the offer. The CMD/EMD amount may be paid in DD / PO along with the counter foil of the form submitted by the actual manufacturer holding license for obtaining DD / PO. The balance sale price should also be paid by the purchaser by CC / PO as specified under Special Condition No.5 only.

24. In case of Drugs etc. such as Citric Acid, Potassium Permanganate, Phenyl etc.

which may be found fit for medical or non-medical use as advised by the Asst. Drug Controller from time to time, offers will be entertained from the actual users only and while giving the offers at the time of Auction, they should fulfil condition No.8 otherwise their CMD/EMD stand forfeited. However, in case where Asst. Drug Controller has already certified the drug for non-medical use only, the actual user condition is not applicable. The delivery of such lots, which are certified for non-medical use, will be given after making as “NON-MEDICAL USE’ on the packing in presence of Asst. Drug Controller. In such cases, it is the responsibility of the bidder to bring ADC.

25. In case of non-approval of the lots by the ADC / PHO/PPQ, the sale of lots will be

cancelled and CMD/EMD refunded to the successful purchaser. The approval of the Authority concerned shall have to be obtained by bidder within a maximum period of 30 days failing which CMD/EMD will be forfeited.

26. All the goods sold at the Auction sale shall lie at the sole risk of the purchaser until

the goods are removed. 27. The Regional Manager, CWC, Chennai reserves the right to withdraw any lot or part

thereof including those sold on subject to confirmation even though only confirmation of ADC / PHO/PPQ or Fumigation will be pending at any time without assigning any reasons.

28. Sale of uncleared & unclaimed goods shall be subject to other conditions as may be

specified from time to time as accordance with prevalent rules, regulations applicable to the CWC and Customs.

29. Lots should be inspected by the intending purchaser before making an offer and lots

will be sold on “AS IS WHERE IS” and “NO COMPLAINT” basis. Neither the Auctioneer nor CWC is responsible for its quantity, quality, size, and measurement etc. of the goods. Goods are sold on the assumption that the bidder has inspected the lots prior to bidding and know what they are buying. Once an offer is accepted purchaser will have to take delivery of the goods not withstanding all the faults and flaws, if any, in the condition or description etc. of the goods irrespective of whether it was actually inspected or not. No selection or sorting or whatsoever of the goods will be allowed. Quantity, quality, size, measurement etc. are approximate. No sale shall be invalidated by reasons of any defects or faults in any of the lots or on account of the lots being incorrectly described and no compensation shall be paid in respect of any such faults or errors in the description. No inspection of lot, which are sold and subsequently confirmed, shall be permitted under any circumstances unless full purchase price is paid. No compensation shall be entertained after the lot is knocked down.

30. Resale will not be recognized & delivery orders will be made in the same name of

actual bidders only.The original purchaser, whose offer has been accepted, wish to take delivery of the goods through a representative, he must authorize by a letter of authority which shall be presented to the Regional Manager, CWC. Delivery by proxy will be at the purchaser’s own responsibility and risk and no claim lie against CWC on any account whatsoever if the delivery is taken by the wrong person. No claim or damage or losses of any kind will be entertained on any account whatsoever.

31. Purchasers offering for Cotton Yarn will be required to submit Certificates from the

Textile Commissioner or any other Competent Authority to the effect that they are the actual users. Failures to produce the certificate will result in cancellation of the sale and forfeit the CMD. Since other yarn consignments are under OGL actual users condition will not be insisted upon the purchaser.

32. CWC and / or Customs reserve the right of acceptance or rejection of the offer in part

or full without assigning any reasons to the auctioneer at any stage. 33. In addition, special condition, if any, will be uploaded by the CWC/Service provider

and shall be bound for acceptance to bidders. 34. In case the importer of goods under auction presents are out of charge BOE from

Customs and clears CWC dues before goods are physically lifted by the bidder from the CFS, the importer shall be given preference in delivery.

35. The Regional Manager, Chennai, shall have exclusive right to amend/ add/ delete

any conditions to ensure compliance of Customs/CWC guidelines. The successful bidders shall ensure to furnish required information/documents as & when asked by the Customs/CWC before clearance.

36. CWC/KEONICS will not be held responsible for any failure of power, network, server,

[hosting server], internet connectivity, ISP or otherwise at Bidder’s end or at CWC/KEONICS directly or indirectly affecting online method of Bidding.

37. The online bidders are advised to exercise caution while bidding for the lots and

satisfy themselves that the bids placed are for the correct lot before submission of the online bids. Subsequent claims by the bidders that they had placed wrong bids for any reason would not be entertained and the full CMD amount will be forfeited without any further reference.

38. In case of waste paper, duly authorised qualified companies by hazardous and other wastes (Management & trans boundary)Rules 2016 shall be permitted to participate in auction.

39. In case of cargo of Plant Origin, delivery shall be made only after obtaining PQ clearance by customs.
