  • I. INTRODUCTION

    A. BACKGROUND 1 Government of Madhya Pradesh (GoMP) with a sector project loan funding from Asian

    Development Bank (ADB) has proposed to implement Madhya Pradesh Urban Services Improvement Project (MPUSIP), herein after referred as ‘The Project’. Madhya Pradesh Urban Development Company Limited (MPUDC) shall be the Implementing Agency (IA) and the State Urban Development and Housing Department (UDHD) shall be the executing agency for the Project. A project management unit (PMU) created under MPUDC is implementing MPUSIP.

    2. The Resettlement Framework (RF) for MPUSIP outlines the objectives, policy principles and procedures for land acquisition, if any, compensation and other assistance measures for Displaced Persons1 (DPs)/Affected Persons (APs), if any.

    3 An entitlement matrix, consistent with the existing norms and guidelines of the country and the state government, and ADB’s Safeguard Policy Statement has been prepared to cover losses identified in this Project. The matrix recognizes that the lack of title/customary rights recognized under law will not be a bar to entitlement and has special provisions for non-titled persons.

    4. Need of the Sub-project: At present, Nagar Parishad is somehow able to supply only 0.40

    MLD water to people of town with the help of 7 tube wells, 28 hand pumps and 3 open

    wells. Also there is no proper water supply infrastructure like treatment plant, 100%

    distribution network is also not available in the town. Water from the existing sources like

    tube wells and open wells are directly supplied to existing OHTs and the water is not

    treated. Around 7 Km of distribution network is being laid down years back and leads to a

    water loss of approximately more than 46%. Sometimes chlorine / bleaching power is

    being used for the purpose of treatment. Due to the regular extraction of water, ground

    water level is going down. Present ground water level in the Betul Bazar town is

    approximately 350 feet below the ground level. Since 85 Hp pumps are installed in 7 tube

    wells and 3 open wells, electricity consumption is also very high.

    5. As per the service level benchmarking, the water supply of the town is inadequate 4.0 Lacs

    Litres per day (0.4 MLD) i.e. 38 LPCD which is very less as compared to the service level

    benchmarking of CPHEEO i.e. 135 LPCD and 70 LPCD as per the Guidelines of MPUSIP

    for the town having population below 30000.Service Level Benchmarking as per the Ministry

    of Urban Development, Govt. of India and the present status of water supply in the Betul

    Bazar town is given in Table-1:

    6. Therefore new water supply scheme needs to be implemented to servea population of

    39300 for the design year 2048 (Ultimate Year of Design) considering 70 LPCD water supply and source as surface source to ensure adequate quantity, quality and desired pressure at doorstep of each household.

    B. PROJECT DESCRIPTION 7. The salient features of the subproject are as below:

    • Provision for supply of 1.15 MLD raw water will be trapped down by Betul WSS. • Construction of Raw Water Sump and Pump House at junction point. • Design, supply, construction, installation, testing, commissioning of 1.15 MLD WTP. • Reconditioning of existing 300 KL OHT in new scheme.Construction of one OHT of

    200 KL in Ward-8

    • Laying of Raw Water pumping/Gravity main from Raw Water Sump & Pump House to WTP of length 5.5 KM

    • Laying of clear water feeder main from WTP to OHT of total length 1275 m • Laying of distribution network of total length 16157m

    8. The main objectives of the project are as follows:

    • Supplying pure drinking water. • Promote sustainable measures to increase potable water supply to the population. • Water supply through future sustainable source developments. • Water supply through improvements of safe yield of existing water sources. • Water supply through improvements to water treatment works. • Drinking water supply contributes towards a sustainable regional development. • To improve the current state of the water cycle of Betul Bazar through improvements

    in the separate components of the water supply system in investment program.

  • C. SCOPE OF THIS REPORT 9. This land acquisition and resettlement due diligence report is prepared for the proposed

    Water Supply package for Betul Bazar Municipal Parishad, dist. Betul under which

    construction of water treatment plant, OHT, new pipe laying or pipe replacement (within

    public roads RoW or on government land). The proposed subproject will focus on metered

    water supply for domestic, institutional and commercial users, including water resource

    identification and treatment, water storage tanks, distribution pipes and metered connections

    to each household in the towns covering a population of 11200 in Betul Bazar (population as

    in 2018) and estimated population for which it is designed for the year 2048 is 13000.All the

    municipal wards of the town are covered in the project.

    10. A due diligence process was conducted to examine the land acquisition and resettlement

    issues in detail, in line with ADB SPS 2009. This report describes the findings and provides

    copies of relevant documents, resolutions, minutes of meetings and photographs. This land

    acquisition and resettlement due diligence report needs to be read along with the

    Resettlement Framework prepared for MPUSIP.

    11. Upon project implementation, the Social Safeguards Personnel (Project Officer, Social and

    Gender) at PMU, MPUDC will be required to undertake a review of this due diligence report,

    prepare a confirmation letter or report documenting any modifications for the subproject and

    submit to ADB; and receive a 'no objection' confirmation from ADB prior to start of

    construction in the subproject.

    II. POLICY FRAMEWORK, AND INTITLEMENTS 12. The Resettlement Framework (RF) prepared for MPUSIP sets out the objectives, principles,

    eligibility criteria and entitlements for APs, based on ADB SPS, 2009 and LARR 2013 as well as national and state laws for protection of street vendors. Until recently, all activities related to rehabilitation and resettlement in the State of MP had been based on the Madhya Pradesh Resettlement and Rehabilitation Policy, 2002 (MPRR) and National Rehabilitation and Resettlement Policy, 2007 (NRRP-2007). GoMP adopted LARR 2013 on 3rd October, 2014 with some specifications for operationalizing its implementation in the state2. Details of policies are in the Resettlement Framework for MPUSIP.

    III. SUBPROJECT DESCRIPTION

    A. Existing Water Supply 13. Present water supply of the Betul Bazar town is mostly depend on ground water i.e. on 8

    tube wells (7 working), 36 nos. of hand pumps (28 working) and 3 open wells. Water

  • from the tube wells and open wells are pumped to two OHT’s. Total 85 Hp (10 Hp on

    each tube well and 7.5 Hp on each open well) capacity pumps are installed at 7 tube

    wells and 3 open wells. Both the OHTs are filled only once in a day. It takes

    approximately 12 hours to fill the 300 KL OHT and approximately 14 – 16 hours to fill

    500 KL OHT. Then the water is distributed with the help of 7 km of distribution system

    having ACP pipes from 100 to 300 mm diameter and GI pipes having diameter 50 mm to

    80 mm laid in the town. Thus the total water supplied to the Betul Bazar town at present

    is 0.40MLD i.e. 38 LPCD.

    14. Present water supply arrangements are not adequate and ground water source level is

    depleting day by day, therefore water scarcity conditions are arising. Water supply

    losses during transmission are also very high i.e. more than 46%, that leads to a high

    energy consumption and loss to ULB.

    15. Presently water will be supplied only for 45 min on alternate days. Details of present

    water supply infrastructure available in the Betul Bazar town are mentioned in the below

    table:

  • Note:- Propose in Section VI that existing water supply staff of ULB will be trained and utilized by the DBO contractor after required training for O&M, and no one’s livelihood will be affected as none will be retrenched.

    IV. FIELD WORK AND PUBLIC CONSULTATION

    16. The Resettlement Plan was prepared in consultation with stakeholders including affected persons, beneficiaries/local people, and ULB officials. Consultations and focus group discussions (FGDs) were conducted to seek feedback from local people and other important stakeholders on the proposed development interventions, perceived impacts and mitigation measures and their participation.

    A. Outline of Fieldwork

    17. During the visit, a field inspection of proposed subproject facility locations and pipeline

    alignments that had been identified was undertaken. These included field visit to the

    identified sites and alignments and stakeholder consultations. The entire land

    requirement for the proposed subproject component will be fulfilled by government

    lands. The details of selected lands for subproject components are given in the

    Appendix-1

    B. Field work Report

    • Discussion was held with ULB Officials, Public Representatives, Stake Holder and Prominent People of Betul Bazar Town. A List of officials from whom details of the town

    for preparation of water supply scheme is collected during site visit. Held various

    discussions during the meeting.

    • During the meeting and discussion, present situation of water supply in the town and the requirement of the stack holder was studied. Based on present water supply

    arrangements and gaps arrives are well documented.

    • With the ULB Authorities, visit was done for all the possible water supply sources and identified locations for all other the components of water supply scheme.

    • Study of the all the options of possible water supply source, its dependability, quality assurance of source available and the distance from the town.

    • Water from the selected source was collected and tested from the Laboratory of Bhopal Municipal Corporation Laboratory, Bhopal. Also test report is obtained for designing

    purpose.

    • Water security from the concerned department like WRD etc. was ensured such that best chosen water source is made available to ULB for the purpose of water supply

    scheme.

    • Revenue authorities were contacted to ensure the land acquisition, secured in the ownership of ULB or Revenue Department Govt. of Madhya Pradesh for WTP and

    Service Reservoirs.

  • • After getting all the required data for the preparation of DPR, mobilization of the survey team for the survey work was done. Focusing road survey for water supply distribution

    system. Based on elevation differences in individual command areas and required

    pressure conditions at lines near households.

    C. Public Consultation

    18. Extensive consultations were undertaken with key stakeholders in line with ADB's

    requirements pertaining to environment and social considerations. Focus group

    discussion (FGD) conducted at nearby locations of Water Treatment Plant sites,

    construction of Over Head Tank proposed. The following outcomes of consultations:

    (i) The consultations helped to identify the felt needs /concerns and apprehensions of the

    communities related to the project and priorities of concerned stakeholders.

    (ii) Consultations revealed that people are aware of the problems of the existing water supply

    system in the town and are willing to cooperate in the proposed project.

    (iii) Consultations with the key stakeholders revealed that drinking water supply system if a

    problem area for the town and they will fully accept the project.

    19. The major stakeholders targeted during consultations are:

    (a) The municipalities, its elected members and staff who will be required to oversee the

    construction of the distribution networks and WTP as well as be directly responsible for the

    maintenance of the installations

    (b) Local residents who will take initiative to connect their houses with the water distribution line.

    (c)Local business people and traders

    (d)School Students and College Students

    (f)The opinion makers are intimately acquainted to and well regarded by the community. They

    need to be enlisted in spreading environmental awareness within the community as

    well as in conveying the benefits of the project.

    V. LAND AVAILABILITY AND INVOLUNTARY RESETTLEMENT IMPACTS

    A. Water Supply

    20. No land acquisition or resettlement impacts are anticipated for any of the proposed civil

    works for Betul Bazar water supply subproject.

    21. WTP capacity is of 1.15 MLD is proposed to be constructed Khasra No – 84/1 in Ward

    No – 1 on Betul Road. The ownership of land is verified and is in possession of Revenue

    Department, Govt. of Madhya Pradesh and considered land is ensured for the purposed

    of water supply scheme. The process has being initiated for the allocation land for

    construction of WTP.

    22. Presently two OHTs are available in Betul Bazar having capacities 300 KL in Ward No 3

    and 500 KL in Ward No 7. The 500 KL OHT was constructed in 1990. The present

    condition of 500 KL is not good and hence proposed not to use this OHT in new scheme.

    The 300 KL was constructed in 2004 and proposed to be used in new scheme. In

  • addition to this 200 KL OHT is proposed to be constructed in Ward No 8 at Khasra No

    475 to cater the water demand of Betul Bazar town till year 2033. Note: - All Land belongs to Govt. Land and There is neither any Encroachment nor any informal users is available for all proposed components

    23. Clear Water from CW Sump of WTP will feed to two OHTs. A Combine Clear Water Feeder Main

    is proposed to be laid from Clear Water Sump at WTP to proposed 200 KL OHT – I located at

    Shaskiya Navin Prathmik Shala Campus in Ward No 8 and to existing 300 KL OHT – II located at

    Old Nagar Parishad Office Campus of diameters 150 mm DI K9 and 100 mm DI K9 having

    combined length 1275 m.

    Note:- All Land belongs to Govt. Land And There is neither any Encroachment nor any informal users is available for all proposed components

    24. The entire Betul Bazar town was divided in to two District Metering Areas (Zones). Zone

    A will be feed through 200 KL OHT - I and Zone B will be feed through 300 KL OHT - II.

    The total length of Distribution System is 16151 m. HDPE PE 100 PN 10 pipes are used

    to distribute the water.

    25. Water supply distribution system for command area of both OHT’s are considered after

    verifying design requirement to ensure adequate minimum 10 m residual head at door

    step of each house hold. All households are proposed to be given with water supply

    service connection ensuring quantity, quality and adequate pressure.

    26. House Service connections : Providing house service connection tapping from a

    distribution main/ sub-main including one tapping saddles, elbows, service pipe from tapping

    point to the chamber near property boundary or inside the property boundary as per the

    direction with U-ball valve, using 20mm Medium Density Polyethylene pipes (MDPE) pipe 5

    m long. The work shall include excavation, road restoration, etc. complete. The

    connection shall have:-

    i. Electro fusion Tapping Ferrule shall be provided with a SS-304 Brass cutter with cutting edges

    for making hole / tapping on the Mains and Fusion joint in such a manner that the 20-

    63mm diameter outlet depending on requirement of the house service connections

    rotatable 3600 to the axis of pipeline. The town is having total number of household’s2418 .So

    all the connections are considered in this project.

    ii. Domestic water meters: Supply and installation of AMR compatible water meters for each

    house service water connections 2418 nos. 15 mm size, brass body, horizontal inferential

    multi jet type, magnetic drive with anti-fraud shield and dry dial with IP 68. Meter shall be

    made of copper or any other suitable anti corrosive metallic.

    27. Site inspections and transect walk was carried all along the proposed laying of clear

    water feeder mains (150mm &250mm).The proposed pipeline for clear water feeder mains will

    be laid along the tow of the existing town road RoW: the clear water feeder mains to be laid in

    Betul Bazar will be along the Nagar Parishad roads. The 16151 m distribution network

    pipelines in Betul Bazar will be laid along the roads of the respective Nagar Parishads.

    Details of land ownership for each water works component to be constructed are given in

    Appendix 1 and Appendix 2there is no existing water distribution supply line in Betul Bazar

    town

  • 28. Civil works in the project include linear excavation for laying pipes along the roads,

    placing pipes in the trench and refilling with the excavated soil. The trenches will be of 0.4 m

    — 0.7 m wide and 0.8 to 1 m depth. Subsequent to completion of works, road reinstatement

    will be undertaken by the contractor as part of the civil works. The roads in the core city area

    of both the towns are very narrow and congested with pedestrians and vehicles, while the

    roads in outer areas are wide. No necessity for full closure of roads is identified. Proposed

    distribution pipe-laying on roads in most part of the town will not have any permanent or

    temporary IR impact. Hawkers and vendors have been witnessed along the road side for most

    part of the distribution network pipe-laying.

    29. Laying of transmission mains and distribution network pipelines and provision of metered house service connections in the project area has been carefully planned to minimize disturbance to pedestrians and traffic and avoid income loss to businesses. Potential temporary impacts to traffic/access to shops and residence due to digging and excavation for pipe laying are possible during construction; however, these will be mitigated by ensuring access to properties through provision of pedestrian planks, provision of adequate signage, and careful traffic management. Though there are no mobile hawkers along the internal roads where the water works will be implemented, if any such cases are reported, they will be assisted to move to nearby location to ensure that their business remains uninterrupted. No income loss is anticipated and there is no informal users is available for all proposed components

    VI. CONCLUSIONS

    A. Summary and Conclusions

    30. No significant IR impacts are assessed at identified sites for sub-project components, as

    adequate vacant land is available for the proposed facilities, within the compounds of

    government lands. The proposed sites for new WTP and OHT at Betul Bazar are owned by

    Revenue Department, for which NOC is under process. The sites for 200 KL OHT are

    proposed on government land for construction of Betul Bazar water supply facilities; land

    records and details of acquisition if any, of these sites, shall be appended to the updated

    DDR. For linear components (pipe laying) or those proposed along government road ROWs,

    temporary disruption to road users, pedestrians and community members will be avoided.

    Safety measures will be taken during construction and access impacts will be mitigated during

    construction by the contractor through simple measures such as provision of planks for

    pedestrian access to shops and residences, and traffic management.

    31. A budgetary provision is made for costs likely to be incurred for updating and implementation of

    this DDR.
