Welcometoournewschoolyear!Weareexcitedaboutthe2016-17academicyear.Dr.RichardIzquierdoHealth&ScienceCharterSchoolhasadedicatedandpassionatefaculty,supportiveparents,andcreative,energeticscholars.Wearegoingtodogreatthingstogether.Ourgoalistofreeourscholarsfromthebondsofpooreducation,poorhealth,andpoverty.Together,wewillguidethemontheroadtosuccessandself-fulfillment,helpingthembecomehappyandproductivemembersofoursociety.Itwillnotbeaneasyjourney,buttogetherwecandoit.WecanbeapartofadreamcometrueintheSouthBronx.

Wecareforeveryoneintheschoolandconsiderthemimportantstakeholders.Thisincludesscholars,parents,andprofessors(teachers)aswellasourBoardofTrustees.Wehopethatyourtimeatourschoolisarewardingexperiencethatwillmakeyouproud.Ourgoalistobefairandclearaboutwhatisexpectedofyouandyourscholarthisschoolyear.

WepromisetoprepareyourscholarforcollegeandmakeavailabletothemcertificationasanEMT,sotheyhaveanimmediateopportunityupongraduationforgainfulemploymentaswellasbecollegeprepared.

Wearea“CollegeNow”school,andour11thgradeand12thgradescholarsarepermittedtotakecollegecoursesforcollegecreditatHostosCommunityCollege,partoftheCityUniversityofNewYork.Aspartofthispartnership,ourscholarswillhaveopportunitiestointernwithHostosCommunityCollegeandtheirpartnersintheBronx.Theywillalsoreceivecareercounseling,resumespreparationassistance,financialaidandscholarshipguidance,andessayhelp.

Additionally,wewerethe13thhighschoolinNewYorkCitynamedasaGatewayPipelineSchoolpartneredwithCityCollegeandtheSophieDavisSchoolofBiomedicalEducation,nowCUNYSchoolofMedicine.Theywillassistusinimprovingourcurriculumandprovidementoringandinternshipstoourscholarswiththeopportunitytotakecredit-bearingcollegecourses.AspartofthisPartnership,theywillassistusbeginningwithour7thgradeonincreasingourcollegepreparationsandeffectivenessbyhelpingusreachourgoalofcollegeacceptancebyallourscholarsaswellascertificationasEMTs.

WealsoofferAdvancePlacementandHonorsclassestoprovideourscholarswitheveryopportunitytoexcelandgainentrancetocollege.Thisbeganin8thgrade,andover408thgraderstookhighschoolcoursesandsatfortheRegentsExaminations.

OurSpecialProgrammingisasimportantasourcorecontentcourses.Wehavefullartandmusicprogramsaswellashealth,sports,andphysicaleducationprograms,includingTaeKwonDo,whichall6th&7thgraderswillbetaking.Wehaveanextensiveafterschoolenrichmentandinterventionprogramthatincludesasuccessfulsportsprogramforwhichwewillprovidemoreinformationinthecomingweeks.

Withyoursupport,wewillcontinuetodeveloptheveryrealgiftsandtalentsofallofthescholarsatDRIHSCS.Weareenergizedandexcitedabouttheupcomingyearandlookforwardtoworkingwithyourchildren!Let’sworktogethertomakethisthebestyeareverandreachourgoalofbecomingthe#1schoolinNewYorkCity!

ABOUTTHISHANDBOOKThis handbook is intended to be a reference document that outlines some of theschool’s most important academic and discipline policies and is not meant to becomprehensive. Those policies not explicitly outlined in this document are left to thediscretionofschoolleadership.Pleasecontacttheschoolofficewithanyspecificpolicyquestions.Dr. Richard Izquierdo Health and Science Charter School’s rules and policies includethose listed throughout this handbook aswell as any changes throughout the schoolyear that areposted in the school and/ordistributed to scholars andparents, and/orany other rules communicated to scholars byDRIHSCS staff. Following the rules andprocedures outlined in this handbook is a necessary condition ofmembership in theDRIHSCScommunity.AMESSAGETOSCHOLARS,PARENTS,ANDGUARDIANSDr.RichardIzquierdoHealthandScienceCharterSchoolisconstantlyreviewingandrevisingthefamilyhandbook,asitisappropriateforadocumentthatseekstoprovideguidanceandsetstandardsfortheschoolcommunity.Therefore,therulesandregulationsofthisHandbookmayfromtimetotimechangeandscholarsandparents/guardiansareexpectedtoabidebythosechanges.ScholarResponsibilitiesThehandbookwillbepresentedandreviewwitheachscholarduringthefirstweekofschool.Allscholarsmustreadtheentirehandbookoncewiththeirprofessorandoncewiththeirparent.Parent/GuardiansResponsibilitiesParents/guardiansmustreadthehandbookandhavethescholarreturntheParentContractandtheTechnologyContractthatarelocatedattheendofthishandbook.TheseformsaredistributedonthefirstdayofschoolandshouldbereturnedtotheirCPRprofessorwithinfive(5)days.Failuretoreturnanyoftheformsrequiringtheparent/guardiantocompleteinformationwillresultindetentionandifnecessary,aparent/guardianconference.

AcademicsAcademicPolicyTherearefivemarkingperiodsinouracademicyear.Thegradesyoureceiveforthefirstfour(4)termswilldetermineyouracademicscheduleduringthefifthterm.ThisaddedfifthtermwilltakeplaceduringthemonthofJulyandismandatory.Studieshaveshownhisextratermsduringthesummerhaveaprofoundeffectonscholar’sperformancethefollowingyear.Parentswillbenotifiedateachparent-professorconferenceiftheirscholarisindangeroffailureandfailureletterswillgooutinMay.ScholarGradingScholarsareDRIHSCSaregivennumericalgrades.Onthereportcard,scholarswillreceivetwoseparatebutequallyimportantgrades.

• Ongraderepresentsmasteryofrequiredgradelevelrequirements.• Thesecondgradeevaluatesscholarsonattitude,participation,conduct,and

livingbyourcreed.Allprofessorswilluseauniformrubricthatwillevaluateascholar’sworkethicintheclassroom.

GradingScaleRecognizingthathighachievingschoolshavecoursesthatarediverserequirementsthatmakeitdifficultforagradingpolicytohaveuniformgradingrequirementswewillusethefollowingcategoriesforevaluatingmasteryofrequiredgradelevelrequirements:

• Tests/Examinations-Examinations/testscovermaterialpresentedanddiscussedinclassaswellasinformationinthereadingsandhomeworkandwillusuallytakeanentireclassperiod.Intheeventthatascholarmissesatest/examinationfacultywillschedulethetimeforascholartotakeamissedexamination/test.Make-upexaminations/testsandsomeassignmentscanbetakenorcompletedonlywithanotefromparents/guardiansexplainingtheabsence.

• Classwork–assignmentsthataredoneintheclassthathelpsscholarspracticeandmasterthestandardsbeforeleadingtoaformalassessment.Scholarsshoulddotheirbestontheseassignmentsandusetheirprofessorsasaresourcetoearnthebestgrade.

• DoNow–Gradedasaquiz.• ExitTickets–Gradedasaquiz.• Quizzes-Quizzesmaybegivenwithorwithoutnotice.Quizzesmaybemultiple

choice,shortanswer,briefessayorinanotherform."DoNow"problemsaregradedandmayalsocountasaquiz.

• Homework-scholarsmayreceiveatleastonehourofhomeworkdaily,includingthe30minutesofindependentreading.Completedhomeworkassignmentsmustbeturnedinontheduedate.Scholarsmusthandinworkneatlyhandwritteninblueorblackinkortyped.PencilsareencouragedforMathematics.

• QuarterlyProjects-Eachclassisrequiredtoassignaquarterlyprojectthatisbasedonahealth-relatedessentialquestion.Theseprojectswillmakeupaminimumof20%ofascholar’sfinalgrade.

WorkEthic/ClassroomParticipationParticipationisoftenanindicationthathomeworkhasbeenthoroughlycompleted.Whenconsideringthisaspartofthegrade,professorswilltakeintoaccountthefollowingcriteria:

• theabilitytoparticipateactivelyinclassdiscussions,demonstratingthattheassignedworkwascompleted;

• theabilitytofollowdirections;and• preparednessforclass(havingallrequiredmaterialsforclass)

WorkEthicalsoencompasseshowwellscholarconductsthemselvesinclass.WhenconsideringthispartoftheWorkEthicgrade,thefacultywilltakeintoaccountthefollowingcriteria:

• behaviorthroughouttheentireclassperiod,howthescholarasksquestions,andhowthescholarmaintainstheclassroomroutinesandpracticesassetbyeachprofessor.

Scholarswhoshowapoorattitudeareconsideredtobelackingtheappropriateclassroomworkethic.Poororinconsideratebehaviorisunacceptable.PromotionPolicyPromotiontothenextgradeisdependentonapassinggradeaverageoverthefourterms.Scholarswillbeheldtospecificpromotioncriteria:attendance;comprehensiveclassroomassessmentsthatmay include portfolios, Professor’sassessments,observations; and benchmark assessments. Theschoolreserves the righttomake adecision for promotionwhen standardized test scoresdonotmatchscholarachievementasseenthroughtheseclassroomassessments.Allcriteriaarefullyincludedinthefinaldecisionforpromotionasdefinedbelow:

RetentionParentsarenotifiediftheirchildisidentifiedatriskofretention.Aconferencewithyourscholar’sprofessorwillbearrangedtodiscusshowtoworktogethertopromotesuccessandwhetheradditionalinterventionopportunitiesincoreacademicareas.InMay,ifnecessary,aPROMOTIONINDOUBTletterwillgooutfollowedbyanadditionalconferencetodiscusswaystoavoidpossibleretention.However,scholars,whodonotmakegradelevelstandard,willberetainedthefollowingschoolyear.Theprincipalmakesthefinaldecisiononretention.

HonorRollAtDRIHSCS,scholarswillhavetheopportunitytoearnDoctor,Resident,andInternhonors!WorkhardandyournamewillappearontheHallofHonorBulletinBoardsthroughouttheschool!AllhonorsscholarsarecelebratedwithafuneventlikeaTownHall,tripsandpizzaparty!Inordertoeligibletobeonthehonorrollallscholarsmusthaveatleast:

• Passallclasseswithatleastan80%Thehonorrollgradecriteriaisasfollows:

• Doctor–overallaverageof95%orhigher• Resident–overallaverageof90%-94.4%• Intern–overallaverageof85%-89.4%

*ThereisaseparateAttendanceHonorRollandImprovementHonorRollthatcelebratestheexcellenceinattendanceandgrowthbyourscholars.

Theinstructionalmodelofourschoolisbuiltuponthefollowingapproachesthatwebelievearenecessarytoachieveexcellentresults:• College-AlignedAcademics:-TheSchool'spathwaytoacademicsuccesswillbe

basedontheskillfuluseofpreciseeducationalmethodsthatpromotebothhighexpectationsandcompassionforscholarsandtheirProfessors,andprovidestrategicsupportforscholarsandProfessorstocontinuallydeveloptheirefficacy.

AcademicsEthics&PlagiarismPolicyDRIHSCSexpectsitsscholarstomaintainthehighestdegreeofacademicethics.Thismeansputtingtheutmosteffortintoallclassworkandassignmentsandavoidingtheethicalpitfallsofplagiarismandcheating.PlagiarismdemonstratesalackofintegrityandcharacterthatisinconsistentwiththegoalsandvaluesofDRIHSCS.Excellentwrittenexpressionofwell-formulatedideasisafundamentalskillforacademicandcareersuccess.Plagiarisminterfereswiththeassessmentandfeedbackprocessthatisnecessaryinordertopromoteacademicgrowth.Plagiarismdefraudstheinstructorwithafalseviewofascholar’sstrengthsandweaknesses.Itmaypreventfurtherinstructioninareasofweaknessanddelaythescholarinreachinghisorherpotential.Plagiarismincludes:• Takingsomeoneelse’sassignmentoraportionofanassignmentandsubmittingit

HealthfulSnackPolicyHereatDr.RichardIzquierdoHealth&ScienceCharterSchool,wewanttoguidescholarsandparentstowardhealthierlifestyles.Onethingthatwillassistuswiththismissionisestablishingaschool-widehealthfulsnackpolicy.Thispolicyisnotmeanttoplacelimitationsonwhatscholarscaneat,butratherenrichtheirbodieswithhealthfulfoods,thereforeassistingtheirmentalcapacities,focuslevels,diet,andoverallhealththroughoutthecourseoftheschoolday.Nojuicesorsugardrinksarepermittedandwillbethrownout.Onlywater.(SeeAppendixBformoredetails).HealthMedicationPolicyAreviewofscholarimmunizationsrequirementsandthepropersupportingdocumentswillbecompletedforallnewscholars.TheSchoolstaffwillworkwiththeDepartmentofHealth andother appropriate authorities toprovide these services. StepThree:OutofSchoolSuspension(OSS)Whileweprefertohaveourscholarsinschoolandinclassatalltimes,onceascholarhasdemonstratedthatbeingremovedfromtheclassroomdoesnotreformtheirbehavior,theschoolisleftwithnootheroptionthantoremovethescholarfromschoolforalimitedtime.OnlythePrincipalcanissuesuspensions.Inthecasethattheschoolleadersarenotinthebuilding,anyPrincipal’sDesigneemayissueasuspension.Whenascholarissuspended,scholar’sfamilywillbecontactedimmediatelypickupthescholar.Beforethescholarcanreturntoclass,thefamilymusthaveaconferencewitheithertheDeanorthePrincipal.Thescholarwillnotbeadmittedtoclassuntilthisconferencehasoccurred.Itistheresponsibilityofthefamilytorescheduleanymissedconferences.

They create anunnecessarydistraction.Eventhoughsomeparentsbelievethattheirchildshouldhaveacellularphoneforsafetyreasons, theNYPDYouthOfficersof the42ndPrecincthavenotifiedusthatthemostcommonoccurrenceofcrimeinvolvingschoolchildreninourneighborhoodarerobberiesinvolvingcellphones.Possessionofacellulartelephonebyascholarisaprivilege,whichmaybeforfeitedbyanyscholarwhofailstoabidebytheterms of this policy. APPENDIXA–SchoolDisciplineCode

Toensurethatanenvironmentiscreatedwhereteachingandlearningcanthrive,theDr.RichardIzquierdoHealthandScienceCharterSchoolhasdevelopedaseriesofrulesthataddressproperscholarbehavior,maintenanceoforderwithintheschoolandwhilepeopleareengagedinschoolactivities,andastatementofscholarrightsandresponsibilities.

Schoolstaffwillensurethatparentsandscholarsarewellinformedofthesepoliciesbeforeenrollment,atthetimethatscholars’signupforentryintothecharterschool,andaschangesaremadethroughouttheschoolyear.Assuch,scholarswillnotbesurprisedaboutwhattypeofbehaviorisexpectedfromthem,andparentswillbereassuredaboutthetypeofclassroomenvironmentthatwillbemaintainedintheDr.RichardIzquierdoHealthandScienceCharterSchool.

Itiscriticalthatfacultyandstaffhaveafullunderstandingoftheschool’sdisciplinepolicy,areclearonrecognizingsituationsinwhichscholars’behaviorisinproperaccordancewiththepolicyandwhenthepolicyhasbeenviolated,andareversedinthevariousproceduresandpoliciessurroundingvaryingdegreesofinfractionsofthepolicy.Allstaffwillbeprovidedwithprofessionaldevelopmentonschooldisciplineissues,inparticularimplementingthedisciplinepolicyaswellasimplementingoverallconsistentandeffectivebehaviormanagementanddisciplinestrategiesintheclassroomandinthegreaterschoolcommunity.Staffwillbeprovidedwithtraininginthisareaasclosetothestartoftheschoolyearaspossibleorshortlyupontheirengagementwiththeschool,iftheyarehiredduringtheschoolyear.Follow-uptrainingthroughouttheyearwillbeprovidedifdeemednecessary.

SHORTTERMSUSPENSIONA short-term suspension refers to an in-school removal or out-of-school removal of ascholar fordisciplinary reasons for aperiodof fiveor fewerdays. A scholarwhohascommittedanyoftheinfractionslistedbelowshallbesubjectminimallytoashort-termsuspension, unless theHeadof School determines that an exception should bemadebased on the individual circumstances of the incident and the scholar’s disciplinaryrecord. Written notice of the decision to impose suspension shall be provided by personaldeliveryorexpressmaildeliverywithin24hoursat the last knownaddress(es)of theparentsorguardian. Wherepossible,notificationalsoshallbeprovidedbytelephone.Such notice shall provide a description of the incident(s) for which suspension isproposed and shall inform the parents or guardian of their right to request animmediate informal conference with the Head of School. Such notice and informalconferenceshallbe inthedominant languageormodeofcommunicationusedbytheparentsorguardians.Theparentsorguardianofthescholarandthescholarshallhavetheopportunitytopresentthescholar’sversionoftheincidentandtoaskquestionsofthe complaining witnesses. Such notice and opportunity for an informal conferenceshall takeplacepriortothesuspensionofthescholarunlessthescholar’spresence inthe school poses a continuing danger to persons or property or an ongoing threat ofdisruption to the academic process, in which case the notice and opportunity for aninformal conference shall take place as soon as possible after the suspension as isreasonablypracticable.TheHeadofSchool’sdecisiontoimposeashort-termsuspensionmaybechallengedbytheparent(s)orguardian inaccordancewithDr.Richard IzquierdoHealthandScienceCharterSchool’scomplaintprocess.LONGTERMSUSPENSION/EXPULSIONA long-termsuspensionrefers to the removalofa scholar fromschool fordisciplinaryreasonsforaperiodofmorethanfivedays.Expulsionreferstothepermanentremovalofascholarfromschoolfordisciplinaryreasons.Ascholarwhoisdeterminedtohavecommittedanyoftheinfractionslistedbelowshallbesubjectminimallytoalong-termsuspensionorexpulsion,unlesstheHeadofSchooldeterminesthatanexceptionshouldbemadebasedonthecircumstanceoftheincidentandthescholar’sdisciplinaryrecord.Such a scholar may also be subject to any of the disciplinary measures outlinedelsewhere in this document including a referral to the appropriate law enforcementauthorities.DisciplinaryInfractions• Possess,use,attempttouse,ortransferofanyfirearm,knife,razorblade,explosive,

mace, tear gas, or other dangerous object of no reasonable use to the scholar inschool;

described under “short-term suspension”, which school officials reasonablyconcludewarrantsalong-termsuspension.

ProceduresandDueProcessforLongTermSuspensionTheHead of Schoolmay impose a long-term suspension. Such a suspensionmay beimposedonlyafterthescholarhasbeenfoundguiltyataformalsuspensionhearing.Inextremecircumstances, theHeadofSchoolmayexpel thescholar fromschool. Upondeterminingthatascholar’sactionwarrantsapossiblelong-termsuspension,theHeadofSchoolshallverballyinformthescholarthatheorsheisbeingsuspendedandisbeingconsidered for a long-term suspension (or expulsion) and state the reasons for suchactions. The Head of School also shall immediately notify the scholar’s parent(s) orguardian(s) inwriting. Writtennotice shall be providedby personal delivery, expressmaildelivery,orequivalentmeansreasonablycalculatedtoassurereceiptofsuchnoticewithin24hoursofsuspensionatthelastknownaddress. Wherepossible,notificationalso shall be provided by telephone if the school has been provided with a contacttelephone number for the parent(s) or guardian(s). Such notice shall provide adescriptionoftheincidentorincidentsthatresultedinthesuspensionandshallindicatethat a formal hearing will be held on the matter, which may result in a long-termsuspension(orexpulsion).Thenotificationprovidedshallbe inthedominant languageusedbytheparent(s)orguardian(s).At the formalhearing, thescholarshallhavetherighttoberepresentedbycounsel,questionwitnesses,andpresentevidence.IftheHeadofSchoolinitiatesthesuspensionproceeding,heorsheshallpersonallyhearand determine the proceeding or may, in his or her discretion, designate a hearingofficer toconduct thehearing. Thehearingofficer’s reportshallbeadvisoryonlyandtheHeadofSchoolmayacceptorrejectallorpartofit.TheHeadofSchool’sdecisionto impose a long-term suspension or expulsion may be challenged by the parent orguardianthroughanappealprocesstotheBoardofTrusteesthedetailsofwhichshallbedetermined.NOTE:InanyinstancewheretheHeadofSchoolisdirectlyinvolvedintheinstance(s)atissueforasuspensionorexpulsion,theHeadofSchoolshallappointadesigneetohandleanyinvestigation,hearinganddetermination.ProvisionofInstructionDuringRemovalHH will ensure that alternative educational services are provided to a child who hasbeen suspended or removed to help that child progress in the school’s generalcurriculum. For a scholar who has been suspended, alternative instruction will beprovidedtotheextentrequiredbyapplicablelaw.Forascholarwhohasbeenexpelled,alternativeinstructionwillbeprovidedinlikemannerasasuspendedscholaruntilthescholarenrolls inanotherschoolforareasonableperiodthereafteroruntiltheendoftheschoolyear.Alternativeinstructionwillbeprovidedtoscholarssuspendedorexpelledinawaythatbestsuits theneedsof thescholar. Instruction forsuchscholarsshallbesufficient toenable the scholar tomake adequate academic progress, and shall provide them theopportunity to complete the assignments, learn the curriculum and participate inassessments. Instructionwill take place in one of the following locations: the child’shome,acontractedfacility(e.g.,intheschooldistrictoflocation),orasuspensionroomor other room at the school. During any removal for drug or weapon offenses,additional services shall include strategies designed to prevent such behavior fromrecurring.Instructionwillbeprovidedbyoneormoreofthefollowingindividualswho

Ascholarand/orthescholar'sbelongingsmaybesearchedbyaschoolofficialiftheofficialhasareasonablesuspiciontobelievethatasearchofthatscholarwillresultinevidencethatthescholarviolatedthelaworaschoolrule.Itemswhichareprohibitedonschoolproperty,orwhichmaybeusedtodisruptorinterferewiththeeducationalprocess,mayberemovedfromthescholarbyschoolauthoritiesandreturnedtoparentsattheschoolorturnedovertolawenforcementasappropriate.Allschool-relatedpropertyalwaysremainsunderthecontroloftheSchoolandissubjecttosearchatanytime.School-relatedpropertyincludesbutisnotlimitedtocomputers,lockers,cabinets,desks,bookcases,busesandothervehiclesanditemscontrolledordirectedbyschoolofficialsinthesupportofeducational-relatedprogramsoractivities.Theschoolisnotresponsibleforbooks,clothing,orvaluablesleftinlockersordesks.Ascholarshallnotplaceorkeepinalocker,deskorotherschool-relatedpropertyanyarticleormaterialwhichisofanon-schoolnatureandmaycauseortendtocausethedisruptionofthemissionoftheschool.Thefollowingruleswillapplytothesearchofschoolpropertyassignedtoaspecificscholarandtheseizureofillegalitemsfoundtherein:

• Schoolauthoritieswillmakeanreasonablesearchofascholar’slocker,desk,orotherschool-relatedpropertyonlywhenthereisreasonablesuspicionthatascholarisinpossessionofanitemwhichisprohibitedonschoolpropertyorwhichmaybeusedtodisruptorinterferewiththeeducationalprocess

• SearchesshallbeconductedundertheauthorizationofthePrincipalorhis/herdesignee

FREEDOMOFEXPRESSION

Scholarsareentitledtoexpresstheirpersonalopinionsverbally,inwriting,orbysymbolicspeech.Theexpressionofsuchopinions,however,shallnotinterferewiththefreedomofotherstoexpressthemselves,andwrittenexpressionofopinionmustbesignedbytheauthor.Anyformofexpressionthatinvolveslibel,slander,theuseofobscenity,orpersonalattacks,orthatotherwisedisruptstheeducationalprocess,isprohibited.Allformsofexpressionalsomustbeincompliancewiththescholardisciplinarypolicyandtheschooldresscode,violationsofwhicharepunishableasstatedinthedisciplinarypolicy.

Scholarparticipationinthepublicationofschool-sponsoredscholarnewsletters,yearbooks,literarymagazinesandsimilarpublicationsisencouragedasalearningandeducationalexperience.Thesepublications,ifany,shallbesupervisedbyqualifiedfacultyadvisorsandshallstrivetomeethighstandardsofjournalism.Inordertomaintainconsistencywiththeschool'sbasiceducationalmission,thecontentofsuchpublicationsiscontrolledbyschoolauthorities.

NopersonshalldistributeanyprintedorwrittenmaterialsonschoolpropertywithoutthepriorpermissionoftheHeadofSchool.TheHeadofSchoolmayregulatethecontentofmaterialstobedistributedonschoolpropertytotheextentnecessarytoavoidmaterialandsubstantialinterferencewiththerequirementsofappropriatedisciplineintheoperationoftheschool.TheHeadofSchoolmayalsoregulatethetime,place,manneranddurationofsuchdistribution.OFF-CAMPUSEVENTS

Scholarsatschool-sponsoredoff-campuseventsshallbegovernedbyalltheguidelinesoftheschoolandaresubjecttotheauthorityofschoolofficials.Failuretoobeythelawfulinstructionsofschoolofficialsshallresultinalossofeligibilitytoattendschool-sponsoredoff-campuseventsandmayresultinadditionaldisciplinarymeasuresinaccordancewiththescholardisciplinarypolicy.Scholarsinuniformoffcampusrepresenttheschoolandwillbeheldtothesamerulesandregulationsasiftheyareoncampus.SCHOLARRECORDSDr.RichardIzquierdoHealthandScienceCharterSchoolwillmaintainwrittenrecordsofall suspensionsandexpulsions including thenameof the scholar, adescriptionof thebehaviorengagedin,thedisciplinaryactiontaken,andarecordofthenumberofdaysascholarhasbeensuspendedorremovedfordisciplinaryreasons.Dr.RichardIzquierdoHealth and Science Charter School will comply with NYSED’s VADIR data collectionrequirementsanddisciplinarydataandsubmit that information toNYSEDby requireddeadlines.

For suspensions of five school days or less, the scholar’sparent(s)orguardianmustbeprovidedwithawrittennotice,andafollowuptelephonecall if possible, within 24 hours of the incident leading up to the suspension whichdescribesthebasisforthesuspensionandexplainsthattheparentorguardianhastherighttorequestaninformalconferencewiththeHeadofSchoolandappropriatestafftodiscuss the incident and question any complaining witness against the scholar. Forsuspensionsinexcessoffiveconsecutiveschooldays,thescholar’sparent(s)orguardianmust be providedwith a written notice which indicates that the district proposes tosuspendthescholarfromschoolinexcessoffiveconsecutiveschooldays,describesthebasisfortheproposedsuspension,explainsthatthescholarhasanopportunityforafairhearingconductedbytheHeadofSchoolorhisorherdesigneeatwhichthescholarwillhavearighttoquestionanywitnessesaccusinghim/herofcommittingthemisconductchargeandtopresentwitnessesonhis/herbehalf. Wherepossible,notificationmustalso be provided by telephone. In addition, the School must provide alternativeeducationtothescholarduringthesuspensionassetforthbelow,includinganyspecialservices required by the Individualized Education Program (IEP) prepared by thescholar’sCommitteeonSpecialEducation(CSE)oftheirdistrictofresidence.TheHeadof School shall make final determination on a suspension or removal of a scholar,followingdueprocess.HHshallmaintainwritten recordsofall suspensionsandexpulsionsof scholarswithadisability including thenameof the scholar,adescriptionof thebehaviorengaged in,the disciplinary action taken, and a record of the number of days a scholar has beensuspendedorremovedfordisciplinaryreasons.ScholarsforwhomtheIEPincludesaBehaviorInterventionPlan(BIP)willbedisciplinedinaccordancewiththeBIP.IftheBIPappearsnottobeeffectiveorifthereisaconcernforthehealthandsafetyofthescholarorothersiftheBIPisfollowedwithrespecttotheinfraction,thematterwillbeimmediatelyreferredtotheCSEofthescholar’sdistrictofresidenceforconsiderationofachangeintheguidelines.Ifascholaridentifiedashavingadisabilityissuspendedduringthecourseoftheschoolyearfortotalofeightdays,suchscholarwillimmediatelybereferredtotheCSEofthescholar’s district of residence for reconsideration of the scholar’s educationalplacement. Such a scholar shall not be suspended for a total ofmore than ten daysduring the school year without the specific involvement of the CSE of the scholar’sdistrictofresidencepriortotheeleventhdayofsuspension,becausesuchsuspensionsmay be considered to be a change in placement. In considering the placement ofscholars referredbecauseof disciplinaryproblems, theCSEof the scholar’s district of

residenceisexpectedtofollowitsordinarypolicieswithrespecttoparentalnotificationandinvolvement.HH shall work with the district to ensure that the CSE of the scholar’s district ofresidence meets within 7 days of notification of any of the following: (1) Thecommission of an infraction by a scholar with a disability who has previously beensuspended for the maximum allowable number of days; (2) The commission of anyinfractionresultingfromthescholar’sdisability;(3)Thecommissionofanyinfractionbya disabled scholar, regardless of whether the scholar has previously been suspendedduringtheschoolyearif,hadsuchinfractionbeencommittedbyanon-disabledscholar,theHeadofSchoolwouldseektoimposeasuspensioninexcessof5days.Also,Dr.RichardIzquierdoHealthandScienceCharterSchoolwillensurethatwhenthesuspensionorremovalofascholarwithadisabilitywillconstituteadisciplinarychangeofplacement,theCSEwillbeimmediatelynotifiedsothattheCSEcanmeetitsrequiredobligationsto:

1) Convene a CSE meeting within 10 school days to make a manifestationdetermination.

2) ConveneaCSEmeetingwithin10businessdaystodevelopaplantoconducta functional behavioral assessment or review an existing functionalbehavioralassessmentorbehavioralinterventionplan.

3) Provide the scholar’s parent with a copy of their procedural due processrights.

4) WorkcloselywiththeCSEofthescholars’districtofresidenceindeterminingeducation services or the interim alternative educational settingconsistentwiththeFAPErequirements.

ProvisionofServicesDuringRemovalThose scholars removed for a period fewer than ten days will receive all classroomassignmentsandascheduletocompletesuchassignmentsduringthetimeofhisorhersuspension. Provisions will be made to permit a suspended scholar to make upassignmentsortestsmissedasaresultofsuchsuspension.Dr.RichardIzquierdoHealthandScienceCharterSchoolalsoshallprovideadditionalalternativeinstructionwiththereasonable promptness and by appropriate means to assist the scholar, so that thescholar is given full opportunity to complete assignments and master curriculum,includingadditional instructions,phoneassistance, computer instructionand/orhomevisitsandone-on-onetutoring.During any subsequent removal that, combinedwithprevious removals equals tenormoreschooldaysduringtheschoolyear,butdoesnotconstituteachangeinplacement,servicesmust be provided to the extent determinednecessary to enable the child toappropriatelyprogressinthegeneralcurriculumandinachievingthegoalsofhisorherIEP. Inthesecases,schoolpersonnel, inconsultationwiththechild'sspecialeducationprofessor,shallmaketheservicedetermination.During any removal fordrugorweaponoffenses [pursuant to34CFR§300.520(a)(2)]serviceswill beprovided to the extent necessary to enable the child to appropriatelyprogress in the general curriculumand in achieving the goals of his or her IEP. TheseservicedeterminationswillbemadebytheCSEofthescholar'sdistrictofresidence.The

schoolwillplacescholarsininterimalternativeeducationalsettingsasappropriateandmandatedby34CFR§300.520(a)(2).Duringanysubsequentremovalthatdoesconstituteachangeinplacement,butwherethebehavior isnotamanifestationof thedisability, theservicesmustbeprovided tothe extent necessary to enable the scholar to appropriately progress in the generalcurriculumandinachievingthegoalsofhisorherIEP.TheCSEofthescholar'sdistrictofresidencewillmaketheservicedetermination.CSEMeetingsMeetingsoftheCSEofthescholar'sdistrictofresidencetoeitherdevelopabehavioralassessmentplanor,ifthechildhasone,toreviewsuchplanarerequiredwhen:(1)thechildisfirstremovedfromhisorhercurrentplacementformorethantenschooldaysina school year; and (2) when commencing a removal which constitutes a change inplacement. The scholar’s special educationprofessor (or coordinator) and thegeneralclassroomprofessorwillattendallmeetingsregardingthescholar initiatedbytheCSEfromthescholar’shomedistrict.Subsequently, ifotherremovalsoccurwhichdonotconstituteachange inplacement,the Schoolwill workwith the CSE of the scholar's district of residence to review thechild's assessment plan and its implementation to determine if modifications arenecessary. If one or more members of the CSE of the scholar's district of residencebelievethatmodificationsareneeded,thentheCSEisexpectedtomeettomodifytheplanand/oritsimplementation.DueProcessIf discipline which would constitute a change in placement is contemplated for anyscholar, the following steps shall be taken: (1) not later than the date on which thedecisiontotakesuchactionismade,theparentsofthescholarwithadisabilityshallbenotifiedofthatdecisionandprovidedtheproceduralsafeguardsnoticedescribedin34CFR§300.504;and(2)immediately,ifpossible,butinnocaselaterthantenschooldaysafter the date on which such decision is made, the CSE of the scholar’s district ofresidenceandotherqualifiedpersonnelshallmeetandreviewtherelationshipbetweenthechild’sdisabilityandthebehaviorsubjecttothedisciplinaryaction.If,uponreview,itisdeterminedthatthechild'sbehaviorwasnotamanifestationofhisorherdisability,thenthechildmaybedisciplinedinthesamemannerasachildwithoutadisability,exceptasprovidedin34CFR§300.121(d),whichrelatestotheprovisionofservicestoscholarswithdisabilitiesduringperiodsofremoval.Parentsmayrequestahearingtochallengethemanifestationdetermination.Exceptasprovided below, the child will remain in his or her current educational placementpendingthedeterminationofthehearing.If a parent requests a hearing or an appeal to challenge the interim alternativeeducational setting or the manifestation determination resulting from a disciplinaryaction relating toweapons or drugs, the child shall remain in any interim alternativeeducationalsettingpendingthedecisionofthehearingofficeroruntiltheexpirationofthetimeperiodprovidedforinthedisciplinaryaction,whicheveroccursfirst,unlessthe
