Firstly, as of August 20 th the DPIE submission on salts waste was incomplete on page 25 – it ends with: The CSG companies Figure 1 DPIE submission is missing words on page 25. We will never know what DPIE intended to write here but we would like to finish the sentence. “The CSG companies in Queensland including Santos have spent 10 years and millions of dollars trying to find a non-existent solution to the copious volumes of toxic salts waste that the CSG industry produces. The Queensland framework for Beneficial Reuse is not fit for purpose in NSW. Drilling mud (one of the more common waste streams) has recently been removed from being considered as a regulated waste in Queensland and now can be reused and made into

•groundwater•landaccessandlandvalues•agriculturalproduce•theenvironment(forexample,thelong-termmanagementofsafedisposalofsaltandbrinewaste)•uncontrolledorunintendedreleaseofgas(referredtoasfugitiveemissions).

Thelong-termmanagementofsaltandbrinewasteisanunresolvedissue.Intheshortterm,therearerisksassociatedwiththemanagementofsaltywaterheldinevaporationdams.Inthemediumandlongterm,thegovernmentandindustryhavenotreachedasolutionforthesafedisposalormanagementofthissaltandbrinewaste.TheAustralianPetroleumProductionandExplorationAssociationcommissionedresearchintothisissuein2018.Itsreportidentifiedfouroptionsallwithvaryingenvironmentalimpacts.DESisconsideringtheoptionsandwillprovideadvicetogovernmentontheissue.

4.1Secretary’sEnvironmentalAssessmentRequirements

TheSecretary’sEnvironmentalAssessmentRequirementsfortheNGPsaidEnvironmentalPlanningInstruments,GuidelinesandPoliciesshouldbecompliedwith,andasaGeneralRequirement“awastemanagementstrategy,havingregardtotheNSWEnvironmentProtectionAuthority’s(EPA)requirements”.

1. Proposedstorage,managementanddisposalofCSGproducedwaterandwasteproducts,including,butnotlimitedto:

i.beneficialreuseii.re-injectionintogroundwateraquifersiii.irrigationiv.transfertoalicensedwastemanagementfacility.

TheenvironmentalimpactstatementmustaddressalltheenvironmentalassessmentrequirementsoftheSecretary,butitdoesnot.Re-injectionseemstohavefallenofftheagenda,butmanagedreleaseintoBohenaCreek,amagnificentpristineephemeralsandywaterwayisenvisagedwherenootheroptionsseemfeasible?

DPIEhasmentionedreinjectionintheirreferencetoQueenslandbutweobjecttothismanagementoptionbeingincludedasnostudyhasbeendoneonitsefficacy.

DPIEsay:TheDepartmenthasrecommendedconditionsconsistentwithQueensland’sapproachtothemanagementofwasteandthewastemanagementhierarchyoutlinedintheNSWGovernment’sWasteAvoidanceandResourceRecoveryAct2001whichpromotesavoidance,followedbyresourcerecovery,followedbydisposaloptions.AproblemwiththeconditionsisthattheyseemtogiveapprovalforPhase1andthenSantoshavetogetlotsofmanagementplansinplacebeforetheycanstartPhase2.Webelievethatthiswarrantsrejectionoftheproject.Theseplansshouldhavebeenprovidedatthisstageoftheapprovalprocess.Communitywillnothaveanopportunitytocommentlaterandtransparencyisessential,furthermoreSantoshasinrealitybeenoperatingagasfieldinNarrabrinowfor8yearsunderguiseofanexplorationlicence,andafter8yearsofextractinggas,pipinggas,separatinggasfromthewateranddoingeverythingbutcrystalisingthewastetheyhavestillnotbeenabletodeveloptherequiredplanstotherequirements.PuttingforwardQueenslandasamodelforhowtheNarrabriGasProjectshouldberegulatedinregardstoBeneficialUseandWasteManagementseemstoignorethemanyproblemsthathaveariseninQueenslandasaresultofarapidlyexpandingindustrythathasrequirednumerousapplicationsofadaptivemanagementandpolicymadeontherunto

Seriousconcernsarestillnotbeingaddressedabouthowmuchofthiswasteendsupwashedintolocalcreeks,thenriversandeventuallytheMurrayDarlingBasin.ItisimperativebeforethisprojectisapprovedthattheIPCaskseriousquestionshowtheindustryhasmanagedtogetfullyestablishedinAustraliawithoutprovidingasustainablesolutionforitswastestream.

DPIEsay:Therecommendedconditionsinclude:ConditionB35–WaterManagementPerformanceMeasuresforSaltManagementrequiringtheproponentto:•maximisebeneficialreuseofproducedsalt,asfarasreasonableandfeasible;•disposesaltwastenotabletobebeneficiallyreusedtoappropriatelylicencedwastefacilityCansomeonepleasedetailwheretheseappropriatelylicencedwastefacilitiesareascommunityhastherighttoknow.ThisisthedetailtheDPIEshouldbeaskingSantostodisclosebeforerecommendingtheprojectforapproval.TheremainderofconditionB35whilstoutofscopeforthissubmission(Watermanagementperformancemeasures)aregoingtoproveimpossibleforSantostoadhereto.DPIEtheninvokeConditionB38–WaterManagementPlanincluding:•SaltManagementPlanincludingaprogramforinvestigatingandimplementingbeneficialreuseoptionsforthesaltproduct,inaccordancewiththeProducedSaltBeneficialReuseandDisposalStudy;Thisconditioniscompletelyprohibitive.EverysingleManagementPlanlistedbelowshouldhavebeensuppliedforassessmentandbeenavailableforperusalbythePublic.

Theseplansformthebarebonesoftheproject.Theyareformativeforsafeoperations.Santoshasbeentheoperatorforagood8yearsinthePilligaandthisworkshouldhavebeencompletedforreview.Santoshasagreatdealofexperiencebuildinggasfieldsandshouldhavethein-houseexpertisewithwhichtohaveprovidedisdetail.DPIEmentionConditionB63–WasteOperatingConditionsincludingrequirementsto:•implementallreasonableandfeasiblemeasurestomaximisebeneficialreuseofwaste;•minimisetheresidualwastegeneratedbythedevelopment•disposeofallwasteatappropriatelylicensedwastefacilities;•monitorandreportontheeffectivenessofwasteavoidance,minimisationandmanagementmeasures;WhydidSantosnotprovidedetailtotheDepartmentabouttheirattemptedMurrawombieHeapLeachTrialordetailabouthowthebicarbonatetechisbeingusedinChina?ConditionB65–ProducedSaltBeneficialReuseandDisposalStudyincluding:•anassessmentofreasonableandfeasiblebeneficialreuseoptions;•strategyformaximisingbeneficialreuseforidentifiedreasonableandfeasiblereuseoptions;and•astrategyfordisposalofanyproducedsaltthatisnotabletobebeneficiallyreused,includingdemonstratingthatoccupiersofwastefacilitiescanlawfullyacceptandwillpermitthevolumeandcompositionofsaltwaste.DoesDPIEmean“operators”ofwastefacilitiesnotoccupiers?WilltheIPCpleaseactinregardstowhatisnowclearlyasignificanterrorintherepresentationofthisproject.Santoscannotbepermittedtoproceedwhenitisnotclearthatwastefacilitiesarereasonablyandfeasiblyadequateinbothcapacity,contentandindeedexistence.PagexivoftheDPIEAssessmentReportstates“thesaltislikelytobeclassifiedasgeneralsolidwastewhichcanroutinelybedisposedofatoneofthe11licencedwastefacilitieswithin150kilometresofthesite”[6].Wherearethesefacilities?Thecommunityhastherighttoknow.BuildingnewlandfillstoaccommodateCSGisoutofthequestion.Thisisadirectquotefromourearliersubmission:“InNSWwearefacedwithasituationwherebythecompanySantos,andtheGovernmentrefertothe“QueenslandExperience”asbeingapositiveone.Whensomethingisnegativeandbearsfurtherinvestigation

governmentagenciesinNSW,liketheEPA,say“That’sQueensland,thatwon’thappeninNSW”.FromourexperiencethoughSantoswilloperateinexactlythesamewayandDPIEseemstobegivingthempermissiontodoso.

Furthermore,"Beneficialreuse"appearstobeAustralia'sversionoftheU.S."HalliburtonLoophole"–whichrepresentsasignificantreductionoffederaloversightinfrackingoperations–andcitizenswouldberighttobeconcernedaboutthefoodandwatersecurityoftheeastcoastofAustralia.

NWPAfeelabsolutelyjustifiedinreiteratingouroppositiontothisprojectjustontheissueofwastealoneaswestronglyfeelthelatestsubmissionsofbothDPIE&Santoshavefailedtoaddresstheconcernsofthecommunity.
