PREAMBLE

The Central Mountain Air Tariff outlines the terms and conditions under which the carrier operates its business as it relates to the transportation of passengers, baggage or goods.

The purpose of the Tariff is to protect both the carrier and the consumer against unexpected demands or conditions imposed upon it by the other party due to a misunderstanding.

The Tariff functions as a contract of carriage between the passenger and the carrier, and a current copy is maintained on file with the Canadian Transportation Agency.

At Central Mountain Air we hope to make your travel experience as comfortable, seamless and enjoyable as we can. We will use our best efforts to accommodate all passengers, their baggage and goods. The Company operates commuter and regional aircraft, and our network encompasses many communities, some remote and with varying degrees of passenger services. Some routings have long stage lengths and aircraft capacity may be limited. Further constraints can be assumed during adverse weather conditions. We appreciate your patience when irregular operations occur.

AMENDING PROCEDURES AND DISTRIBUTION LIST

AMENDING PROCEDURES – (for Central Mountain Air Personnel)

Manual amendments will be promulgated as required by the Accountable Executive. After approval they will be issued to manual holders. Each revised page will show the revision number and date, and correspond to the List of Effective Pages. Revised pages will be identified in the record of revisions and shall show a vertical line in the margin, to denote where changes have been made. Amendment instructions shall accompany the revision, and instruct the manual holder which pages to remove, and which to insert. All superseded pages shall be destroyed.

These procedures will be amended as necessary on an annual basis. The amendments will incorporate any new procedural changes. Managers are responsible for maintaining the base copy of the Tariff Manual. This includes inserting all amendments and bulletins and ensuring that the list of effective pages correlates with those existing in the manual.

Prior to submission of any amendment, all company policy manuals must be cross-referenced in accordance with the CMA Document Matrix, and CBAAC 0127 where applicable. The cross-reference shall ensure that any changes to this manual are reflected by similar policy in all other company manuals. The manual owner shall email a list of all proposed changes to the owners of other manuals which may be affected by those changes.

Any inconsistencies or suggestions for improvement should be reported to the Accountable Executive. Information shall then be processed and released in either the form of a new amendment or by Tariff Bulletin.

TARIFF BULLETINS

Tariff Bulletins are a means of disseminating information and procedural changes prior to a formal manual amendment. Bulletins shall be numbered in the sequence that they are released. Each Bulletin shall be entered into the manual as specified within the instructions of the Bulletin. A Bulletin Record Control page is provided at the front of this manual. It is the primary means of determining the status of each issued Bulletin. Once it has been read and entered, it shall be recorded on the Bulletin Record Control page along with the bulletin status and signature of the manual holder.

DISTRIBUTION AND CONTROL

The Accountable Executive will maintain the Domestic Tariff manual and control its distribution. A copy of the Domestic Tariff will be posted to the Central Mountain Air website. A copy of the Domestic Tariff will also reside with the Canadian Transportation Agency.

1.0 APPLICATION OF TARIFF: 1) This tariff is applicable to the transportation of Passengers and their Baggage, or Goods, using aircraft operated by the Carrier. 2) An air service will be furnished under the terms of this tariff only after an appropriate written air transportation contract, in the form prescribed by the Carrier, is executed by the Carrier. 3) Air transportation shall be subject to the rules, rates and charges published or referred to in this tariff in effect, by virtue of the effective date on each page, on the date of signing of the air transportation contract. 4) References to pages, rules, times and notes are continuous and include revisions, supplements thereto and reissues thereof. 5) The Carrier will be responsible for the furnishing of transportation only over its own lines. When any Carrier undertakes to issue a ticket, check baggage, or make any other arrangements for transportation over the lines of any other Carrier (whether or not such transportation is part of a through service), such Carrier will act only as agent for such other Carrier and will assume no responsibility for the acts or omissions of such other Carrier. a) No agent, employee or representative of the Carrier has authority to alter, modify or waive any provisions of the contract of carriage or of this tariff unless authorized in writing by an officer of the Carrier. 6) The Carrier will endeavor to transport the passenger and baggage with reasonable dispatch, but times shown in timetables or elsewhere are not guaranteed and form no part of this contract. 7) In the event the Carrier is required to make an unscheduled stop en-route, subject to re-routing, no compensation will be offered to the passengers. 8) Schedules are subject to change without prior notice. The Carrier is not responsible or liable for failure to make connections or for failure to operate any flight according to schedule, or for a change to the schedule of any flight. Under no circumstances shall the Carrier be liable for any special incidental or consequential damages arising from the foregoing (including the carriage of baggage) whether or not the Carrier had knowledge that such damage might be incurred.

1.0 APPLICATION OF TARIFF (continued):

9) Without limiting the generality of the foregoing, the Carrier cannot guarantee that the passenger’s baggage will be carried on the flight if sufficient space is not available as determined by the Carrier.

10) Ground Transportation:

The Carrier does not assume responsibility for the transportation of any passenger or his baggage between any airport and any other place in any area served through such airport. Ground transportation to and from any such airport is provided only by independent operators, who are not agents or servants of the Carrier, and at the passenger’s expense.

2.0 CURRENCY OF RATES AND CHARGES: Rates and charges appearing in this tariff are stated in terms of Canadian dollars (CAD). 3.0 PAYMENT OF RATES AND CHARGES: Rates and charges are payable in lawful currency of Canada at the time of acceptance by the Carrier.

DOMESTIC TARIFF Passenger Rules, Fares and Charges

2.1 DEFINITIONS:

In Rule 2 of this Tariff

a) “airport” includes any landing area or dock used to enplane or deplane passengers and baggage;

b) “animals,” in addition to the usual connotation, includes reptiles, birds, poultry and fish;

c) “baggage” means luggage or such articles, effects or other personal property of a passenger or passengers as are necessary or appropriate for wear, use, comfort or convenience in connection with the flight;

d) “Canada” means the ten provinces of Canada, the Yukon Territory, the Districts and Islands comprising the Northwest Territories of Canada and Nunavut;

e) “Carrier” means Central Mountain Air Ltd.;

f) “connecting flight” means onward travel on a subsequent flight contained on the same ticket;

g) “connecting point” means a point to which a passenger holds or held confirmed space on a flight;

h) “destination” means the point to which the passengers or goods to be transported on a flight are bound;

i) “goods” means anything that can be transported by air, including animals;

j) “involuntary” means a change in routing or failure to operate on schedule as decided by the company;

k) “misconnection” occurs at a connecting point when a passenger holding confirmed space is or will be unable to use the accommodation out of the connecting point due to late arrival of his flight at the connecting point, or cancellation of his flight at point of origin or en route;

l) “one way” means any trip, the ultimate destination in one direction;

2.1 DEFINITIONS (continued):

m) “origin” means the point from which a flight commences with payload to be transported;

n) “outbound flight” means a flight on which a passenger holds/held confirmed space beyond the connection point;

o) “passenger” means a person, other than a member of the air crew who uses the air Carrier’s domestic service by boarding the air Carrier’s aircraft pursuant to a valid contract;

p) “reroute” means to issue a new ticket covering transportation to the same destination as, but via a different routing, than that designated on the ticket or portion thereof, then held by the passenger, or to honor the ticket or portion thereof, then held by the passenger for transportation to the same destination as, but via a different routing, than that designated thereon;

q) “round trip” means any trip, the ultimate destination of which is the point of origin, and which is made in both directions;

r) “stopover” means a deliberate interruption of a journey by the passenger, agreed to in advance by the Carrier, at a point between the place of departure and the place of destination; It is not a stopover if a passenger:

i. leaves connecting city within four hours of arrival, or

ii. leaves connecting city on first available flight on the ticketed Carrier and class of service, or

iii. leaves connecting city on the flight which provides the earliest arrival at the next destination;

s) “ticket” means the electronic confirmation, or confirmation number, baggage check and accompanying notices that incorporate this contract of carriage;

t) “voluntary” means when a change in routing, surrender of a ticket or unused portion of a ticket or a Miscellaneous Changes Order (MCO) and/or the cancellation of carriage is initiated by a passenger of his own volition.

2.2 ACCEPTANCE OF PASSENGERS FOR TRANSPORTATION:

2.2.1 Carriage Of Persons With Disabilities:

Definitions: “Ambulatory” means a person who is able to move about within the aircraft

unassisted. “Non-Ambulatory” means a person who is not able to move about within the

aircraft unassisted. “Non-Self-Reliant” means a person who is not self-reliant, may still require

assistance boarding or deplaning. “Self-Reliant” means a person who is independent, self-sufficient and capable of

taking care of all personal needs during flight, and does not require assistance of a personal nature, such as assistance with eating, using the washroom facilities or administering medication, nor does not require services from the Carrier other than that which is normally offered by the Carrier.

a) The Carrier will accept the determination of a person with a disability as to

self-reliance. When a passenger has advised the Carrier of his or her self- reliance, the Carrier shall not refuse such passenger transportation on the basis that there is a lack of escort or that the passenger may require additional attention from the airline employees.

b) Passengers with a disability will be accepted for transportation as outlined

below:

* The maximum per flight may be limited subject to passenger safety limitations, aircraft specifications, and airport handling facilities available at departure or arrival airports. c) The Carrier reserves the right to require a medical clearance from proper

medical authorities if travel involves any unusual risk or hazard to the passenger or to other persons (including, in the case of pregnant passengers, unborn children).

d) Passengers with a disability will not be permitted to occupy seats in

designated emergency exit rows or over wing emergency exit rows.

e) In addition to the regular free baggage allowance, the Carrier will accept the following items as priority checked baggage without charge:

1) wheelchairs/scooters with non-spillable batteries, with terminals

disconnected and taped; 2) a manually operated folding wheelchair; 3) a walker, a cane, crutches or braces; 4) any device that assists the person to communicate better; and 5) any prosthesis or medical device.

2.2.1 Carriage of Persons with Disabilities (continued): f) Walkers, crutches and canes may be retained in the passenger’s custody

provided they are stowed in accordance with the Carrier’s safety regulations and provided they may be accommodated.

g) Reservations should be made at least 24 hours in advance of travel, advising

the Carrier as to the nature of the disability and assistance required, so that arrangements can be made. The Carrier will make every effort to accommodate passengers who fail to make reservations 24 hours in advance.

h) If requested at least 48 hours before the scheduled time of departure of the

person’s flight, the Carrier will provide the following assistance. If the request is not made within 48 hours, the Carrier will make a reasonable effort to provide the services.

Assistance will be provided with: 1. registration at check-in counter; 2. proceeding to the boarding area; 3. boarding and deplaning; 4. stowing and retrieving the person’s carry-on baggage; 5. retrieving the person’s checked baggage; 6. transferring the person: a. between the person’s own wheelchair, scooter or other mobility aid,

and a wheelchair, boarding chair or other mobility aid provided by the Carrier.

b. between a wheelchair, boarding chair or other mobility aid and the

person’s passenger seat. 7. assisting the person, other than by carrying the person, in moving to and

from an aircraft washroom;

2.2.1 Carriage of Persons with Disabilities (continued):

8. servicing special meals, where available, and providing limited assistance

with meals, such as opening packages, identifying items and cutting large food portions;

9. inquiring periodically about the person’s needs while awaiting a flight after

check-in, when in transit between flights and during the flight; 10. assembling and disassembling of mobility aids. The passenger should

carry assembly/disassembly instructions with them during travel; and 11. proceeding to the general public area or to a representative of another

Carrier. 2.2.2 Mobility Aids:

If a mobility aid is damaged for lost, the Carrier will immediately provide a suitable temporary replacement without charge. If a damaged aid can be repaired, the Carrier will arrange, at its expense, for the prompt and adequate repair of the aid and return it to the passenger as soon as possible. If a damaged aid cannot be repaired or is lost and cannot be located within 96 hours after the passenger’s arrival, the Carrier will, at its discretion, replace it with an identical aid satisfactory to the passenger, or reimburse the passenger for the replacement cost of the aid.

2.2.3 Expectant Mothers:

Expectant mothers in normal health are accepted up to the end of their 36th week of pregnancy. No written medical clearance is required.

Expectant mothers in normal health will be accepted within their ninth month or within four weeks of expected delivery with written medical clearance from the attending physician but if within seven days of expected delivery will only be accepted as a medivac with a qualified attendant.

2.2.4 Children:

1) Children under 12 years of age are accepted for transportation without restriction when accompanied by a passenger at least 12 years of age.

2) Children under 12 years of age not accompanied by a passenger 12 years of age or over are accepted for transportation only under the following conditions:

a) under 5 years of age, not accepted under any conditions;

b) the child is between the ages of five (5) and eleven (11). The child must travel on CMA from origin to destination without long connection times at connecting airports. CMA will not accept children who have to connect to another airline. There is a $60 CAD service charge each direction (plus tax), which is collected at the time of booking. Release forms must be completed prior to boarding the aircraft. CMA will require phone numbers and contact names in both the originating and destination cities. The person dropping the child off as well as the person picking the child up must have acceptable government issued photo ID. ID will be checked before the child is released. Persons dropping off the child must remain at the airport until 15 minutes after the flight has departed. You must call CMA Reservations for booking when making reservations of an Unaccompanied Minor. A maximum of two (2) unaccompanied minors will be allowed on the B1900, and four (4) on the D38/DH3 aircraft, per flight.

The Carrier will not assume any financial or guardianship responsibility for un- accompanied children beyond those applicable to an adult passenger.

2.2.5 Persons of Size:

It should be noted that CMA operates commuter-type aircraft, sometimes with minimal seating and headroom. CMA provides the following specifications in order that persons of size may be apprised at source for personal decision-making with regards to their personal onboard comfort and safety prior to making a reservation and traveling to the airport. A confirmed reservation will not negate a refusal to transport under Rule 2.3 (Refusal to Transport: Passengers).

2.2.6 Medical Clearance:

The Carrier reserves the right to require a medical clearance from the proper Medical Authorities if travel involves any unusual risk or hazard to the passenger or to other persons (including, in cases of pregnant passengers, unborn children.

2.3 REFUSAL TO TRANSPORT: PASSENGERS

Central Mountain Air may refuse to transport, or may remove at any point, any passenger when:

a) Such action is necessary for reasons of safety; b) Such action is necessary to prevent violation of any applicable law, regulation or

order of any country or possession to be flown over; c) A passenger’s actions or inactions prove to the Carrier that his/her mental or physical

condition is such as to render him/her incapable of caring for himself/herself without assistance, unless he/she is accompanied by an attendant who will be responsible for caring for him/her en route and, with the care of such attendant, he/she will not require attention or assistance from employees of the Carrier beyond the services normally provided by the Carrier.

d) If necessary, for reasons of the health, comfort and safety of that passenger as well

as other passengers; e) They appear to be intoxicated or significantly impaired by alcohol or drug

consumption; f) They engage in or have engaged in any conduct or behavior on the Carrier’s aircraft,

or to the knowledge or reasonable belief of the Carrier, on any airport property or other carrier’s aircraft, that the Carrier determines, in its reasonable judgment, may have a negative effect on safety, comfort or health of that person, other passengers, the Carrier’s employees or agents, aircrew or aircraft or the safe operations of the Carrier’s aircraft.

2.3.1 Recourse of the Passenger/Limitation of Liability:

Carrier’s liability in case of refusal to carry a passenger for a specific flight or removal of a passenger en route for any reason specified in the foregoing paragraphs or in any other rule in this tariff shall be limited to the recovery of the refund value of the unused portion of passenger’s ticket from the Carrier so refusing or removing.

2.3.1 Recourse of the Passenger/Limitation of Liability (continued):

A person who is refused carriage for an indefinite period of time, up to a lifetime ban, or to whom a probation notice is served, may provide to the Carrier, in writing, the reasons why he/she no longer poses a threat to the safety or comfort of passengers or crew, or to the safety of the aircraft. Such document may be sent to the address provided in the refusal to carry notice or the notice of probation.

Carrier will respond to the passenger within a reasonable period of time providing the Carrier’s assessment as to the need or not to prolong the ban or to maintain the probation period.

2.4 CONFIRMATION OF RESERVED SPACE:

A reservation of space on a given flight is valid when the Carrier offers to a person confirmed space subject to payment or other satisfactory credit arrangements and confirms the availability and allocation of such space. A passenger with a valid confirmation number reflecting reservations for a specific flight and date on the Carrier is considered confirmed, unless the reservation was cancelled due to one of the reasons indicated in Rule 2.5 (Cancellation). The Carrier does not guarantee to provide a particular seat on the aircraft.

2.5 CANCELLATION:

All reservations are subject to cancellation without notice:

1) If the passenger has not purchased a validated ticket indicating confirmed seat(s) at least two (2) hours prior to scheduled departure of the flight, or earlier if a specified time limit is required;

2) If the passenger fails to fulfill the requirements of the fare type of that reservation;

3) If the passenger is not present at the boarding gate at the time limit required prior to the original scheduled departure time of the flight;

4) If the passenger fails to occupy a seat reserved (eg. a no-show);

2.5 CANCELLATION (continued):

5) If such action is necessary to comply with any governmental regulations or to comply with governmental request for emergency transportation in connection with national defense, or whenever advisable by reason of weather or other conditions beyond the Carrier’s control.

If the Carrier refuses to transport the passenger for any of the reasons stated above, even if a reservation was confirmed, the reservation may not be accepted for the flight specified. Cancellation will apply to all segments in the itinerary.

2.6 PAYMENT REQUIREMENTS:

Depending on the payment condition attached to the particular fare, full payment may be required at time of booking.

2.7 TICKETS:

1) General:

a) No person shall be entitled to transportation except upon presentation of a valid ticket. Such ticket shall entitle the passenger to transportation only between points of origin and destination.

b) Tickets are not transferable and Carrier is not liable to the owner of a ticket for honoring or refunding such ticket when presented by another person.

c) Ticket value will be received into the general accounting revenue of the Carrier at the date of departure on the original ticket issued. A ticket shall have no value after this point in time.

d) All ticket purchases will be considered correct unless the Carrier is contacted within thirty (30) days of ticket purchase or prior to departure from origin, whichever occurs first.

2) Validity:

a) The period of validity for transportation will be one year from the original date of ticket issuance unless otherwise specified on the ticket, or under the rules of this tariff. All travel must be completed by midnight on date of ticket expiration.

2.8 APPLICATION OF FARES AND ROUTINGS:

1) General - The price of transportation shall be disclosed at the time of confirmation; however, fares are subject to change without notice.

2) Currency - All fares and charges are stated in the currency of the country from which the passenger will initiate travel.

3) Fare Changes - The Carrier’s fares are subject to change from time to time.

4) Connecting Flights - When more than one airport serves an area and a passenger arrives at one airport and departs from another airport, transportation between those airports must be arranged by and at the expense of the passenger.

5) Stopover

a) A stopover means a deliberate interruption of a journey by the passenger, agreed to in advance by the Carrier, at a point between the place of departure and the place of destination.

b) In no event will a stopover occur when the passenger departs from the intermediate city on a flight scheduled to depart within four (4) hours after the passenger’s arrival.

6) Routing - A fare applies only to:

a) Transportation via the routing specified by the Carrier in reference to that fare. Any other routing may subject the passenger to an additional charge.

b) Transportation between the airports. Tickets may not be issued or accepted for transportation that will either originate or terminate at an airport other than the airport for which the fares are published.

7) Infants - One infant under two (2) years of age not occupying a seat and accompanied by a passenger at least twelve (12) years of age will be transported without charge. Infants under two (2) years of age at the onset of travel, who reach two (2) years of age while in destination will be charged and required to pay the applicable one-way fare to secure a seat on the aircraft. A birth certificate is required for all infants under two (2) years of age.

8) Construction of Fares Not Published - When the fare between any two points is not specifically published, such fare will be constructed by combining those fares, applicable via the desired routing from the passenger’s point of origin, which produce the lowest fare, provided, however, that

a) if the fare so constructed exceeds the fare applicable to or from a more distant point via the same routing, the fare applicable to or from such more distant point will apply;

b) if a fare constructed for a trip is interrupted by travel other than via the Carrier, exceeds the applicable through fare for uninterrupted travel via the same routing, the applicable through fare will apply.

9) Fares for Round Trip - Fares for round trips will be twice the applicable one-way fares unless otherwise specified.

10) Specials - The Carrier reserves the right to offer “Specials” with specific terms of eligibility, validity, restrictions and refund conditions.

11) Capacity Limitations -The Carrier shall limit the number of passengers carried on any one flight at fares governed by rules making reference hereto and such fares will not necessarily be available on all flights operated by the Carrier. The number of seats, which the Carrier shall make available on a given flight, will be determined by the Carrier’s best judgment as to the anticipated total passenger load on each flight.

12) Advance Reservation, Ticketing, Penalty and Surcharge Rules Applicable to

Individual Fare Basis Tickets –

Fare Booking Code – Y:

- Passengers should hold a valid reservation and be ticketed at least two (2) hours prior to departure from origin.

- Ticket is refundable if cancelled up to 2 hours prior to departure from origin, to the original form of payment.

- Ticket is changeable with no charge should the reservation be changed at least two (2) hours prior to departure from origin.

- Name changes are allowed at no charge.

Downgrading is not permitted. If the new itinerary is of lower value, no refund or credit will apply. Changes charge is CAD $40.00, plus the upgrade in fare per person if applicable. 13) Accompanied Child 2-12 Years of Age - No discounts. 14) Notes: (1) Tickets are non-refundable, except in a situation wherein a passenger is

called to jury duty or subpoenaed. Full refund will apply upon presentation of jury summons or subpoena. In the event of death to the passenger or the passenger’s family, travelling or not, or to a travelling companion, the Carrier will waive the service charge applicable upon presentation of a copy of the Death Certificate, or Funeral Director’s statement at time of refund. Immediate family means spouse/parents/children/brothers/sisters/mothers and fathers-in-law/aunts/uncles/daughters and sons-in-law/grandchildren and grandparents.

(2) NavCanada surcharge, as applicable, will be charged on all routings.

(3) AIF and airport charges will be charged as applicable for individual airports.

15) Check-In:

For passengers over 18 years of age, government issued picture ID is required.

Passengers should be knowledgeable as to any documentation they may require for travel further on other airlines.

To assist with on-time departures it is the passenger’s responsibility to allow sufficient time for security processing at larger airports, where line- ups can be lengthy during busy times.

Passengers must obtain their boarding pass and check-in any baggage by the check-in deadline, and be available at the boarding gate by the boarding gate deadline. Passengers should be familiar with the check-in and boarding gate deadlines below. Failure to meet these deadlines may result in cancellation of a passenger’s reservations, and ineligibility for denied boarding compensation.

Recommended Check-In Time: 60 minutes

Check-In Deadline at Airport Counter: 45 minutes

Boarding Gate Deadline: 20 minutes

16) Acceptance of Baggage:

1) Carrier has the right to examine baggage tendered for transportation.

2) Carrier will accept for transportation as baggage such personal property as is necessary or appropriate for the wear, use, comfort, or convenience of the passenger for the purposes of his trip, subject to the following conditions:

a) Carrier has the right to refuse to accept baggage for transportation on any flight other than the one which the passenger is to be transported;

b) Carrier will refuse to accept any property for transportation if it cannot withstand ordinary handling, or its weight, size or character renders it unsuitable for transportation on the particular aircraft on which it is to be transported;

c) Carrier will refuse to transport, or will remove at any point, any baggage which the passenger refuses to allow the Carrier, upon the request of the Carrier, to examine;

d) Carrier will refuse to transport, or will remove at any point, any baggage, when such action is deemed necessary for reasons of safety;

e) Carrier will refuse to accept the following articles for transportation unless advance arrangements have been made:

i) assembled firearms or ammunition, except for the transportation of sporting firearms when not loaded and when in a suitable case and a small quantity of small arms ammunition for personal use when packed in the original package of the manufacturer without advance arrangements being made;

ii) any other articles which can cause annoyance to passengers, or which cannot be carried in the baggage or cargo compartments of the aircraft;

iii) any liquids, as baggage or otherwise, or any other articles not suitable, or suitably packed for transportation in aircraft. Carrier will not be liable for the losses of, or damage to, liquids or such other articles, or for the damage to other articles, or for the damage to other property occasioned thereby, in the event such liquids or other articles are packed in baggage or otherwise transported without the knowledge of the Carrier;

iv) any item listed in the Dangerous Goods Regulations or on the CATSA website.

f) Carrier will accept for transportation, without charge, a dog trained to lead the blind, properly harnessed, when it accompanies a passenger with impaired vision dependent upon such dog. The dog will be permitted to accompany such passenger into the cabin, but will not be permitted to occupy a seat.

g) Carrier will determine whether or not any property of a passenger because of its weight, size or character, may be carried in the passenger cabin of the aircraft.

17) Checking of Baggage:

Except as otherwise provided in Rule 2.8 (16) (Acceptance of Baggage), Carrier will, upon presentation by a fare-paying passenger of a valid voucher covering transportation over the lines of the Carrier, check personal property which is tendered at the city or airport office designated, and within the time prescribed by such Carrier. No Carrier will check property so tendered to a point,

a) not on the routing or beyond the destination as designated on such ticket; or

b) beyond a point of stopover; or c) beyond a point at which the passenger is to transfer to a connecting flight, and such flight is scheduled to depart from a different airport than that at which the passenger is scheduled to arrive at such point; or d) beyond a point at which the passenger desires to resume possession of such property or any portion thereof; or

e) beyond a point which all applicable charges have not been paid.

f) Baggage may be tagged to CMA destinations only. For other destinations passengers may be required to collect their baggage and check it in for the connecting flight.

18) Baggage Allowance:

Carry-On Baggage: Carry-on baggage size and weight is regulated by the airline and Transport Canada and must be adhered to at ALL bases. The restrictions apply to all carry-on baggage (including items the passenger wants to sky check). Passengers are allowed one “Standard Article,” such as a carry-on bag and one “Personal Article,” which could be a briefcase, backpack or purse. The dimensions for the standard article are 23cm x 40cm x 55 cm or 9” x 16” x 22” and for the personal article are 16cm x 33cm x 43cm or 6” x 13” x 17”. Both must not weigh more than 22 lbs each. If the carry-on does not meet these standards it MUST be checked. These restrictions DO NOT apply to baby items such as car seats and strollers.

Checked Baggage: 1) Upon presentation by a fare-paying passenger of a valid ticket covering transportation between points on its routes, Carrier may accept bags up to 158 centimeters (62 inches) in combined dimension (length + width + height) and , singular or total combined pieces, 23 kilograms (50 pounds). The fee and amount charged will be based upon the fare level purchased, where you are travelling to and from, and on the marketing carrier (the airline selling the seat). Any piece(s) of baggage exceeding the size or weight allowance is subject to all applicable over size and weight restrictions and fees.

ECON branded fare (U, G, S, K, L, M, W, X, & O) - 1st Bag: $26.25 CAD per direction including taxes.

FLEX branded fare (C, N, D, T, I, V, Z, B, E, H, R, & Q) – 1ST Bag: Complimentary.

2) Where two or more passengers, traveling together to a common destination by the same flight, present themselves and their baggage, at the same time and place, they shall be permitted a total free baggage allowance equal to the combination of their individual free baggage allowances. Baggage weight in excess of the combined free baggage allowance will be subject to excess weight charges.

3) In addition to the free baggage allowance provided herein, each passenger may carry, without additional charges, the following articles of baggage only when retained in the passenger’s custody: a) lady’s handbag or pocketbook; b) an overcoat or wrap; c) an umbrella or walking stick; d) a small camera and a pair of binoculars; e) a reasonable amount of reading material for the flight; f) an infant’s food for consumption en route; and g) an infant’s carrying basket or bassinet.

4) Passengers rerouted in accordance with Rule 2.8 (24) (Failure to Operate a Service) shall be entitled to the free baggage allowance applicable to the revised routing or Carrier.

19) Charges for Excess Weight of Baggage:

Any piece baggage exceeding the first bag, size, or weight allowance is subject to all applicable weight and size restrictions and fees for Domestic travel with-in Canada on Central Mountain Air. The Carrier may accept bags up to 158 centimeters (62 inches) in combined dimension (length + width + height) and 23 kilograms (50 pounds), singular or combined pieces. The following excess baggage fees shall apply to all fares:

2nd Bag: $26.25 CAD per direction including taxes. Each Additional Bag: $105 CAD per direction including taxes. Overweight Bag(s): $78.75 CAD per direction including taxes. Oversized Bag(s): $78.75 CAD per direction including taxes.

* If a Bag is both overweight and oversized, the $78.75 fee is charge only once. No overweight or oversized fees apply, when the Additional Bag fee is paid.

20) Liability of Carrier for Baggage:

Passengers should inspect their baggage at pickup. Should a passenger discover damage to their baggage they should notify CMA personnel within one (1) hour of its arrival, in person at the airport of arrival.

Carrier will not be liable for:

a) the loss of, or any damage to or delay in the delivery of, any property which is not acceptable for transportation pursuant to Rule 2.8 (16) (Acceptance of Baggage), or for any other loss or damage of whatever nature resulting from any such loss or damage or from transportation of such property;

b) loss, damage to, or delay in the delivery of fragile or perishable articles, computers, money, jewelry, silverware, negotiable papers, securities, or other valuable, business documents, or samples which are included in the passenger’s checked baggage, whether with or without the knowledge of the Carrier.

c) nicks, scratches, missing pullstraps, zipper damage, scuff marks, damage to wheels, soiling, manufacturing defects and damage resulting from over- packing or spillage of packet items.

21) Delayed Baggage:

Central Mountain Air may pay compensation for delayed baggage in the amount of $25.00 CAD per day to a maximum of $50.00 CAD. Receipts will be required to be submitted for compensation. Compensation will not apply after arrival of at the destination airport indicated on the ticket. CMA will only be responsible for delivery of baggage to the destination airport.

22) Denied Boarding Compensation: a) Applies to customer(s) denied boarding from a 9M flight in Canada. b) Customer(s) must have had HK space. c) Employee ID, Travel Agency AD, OAL employees are NOT entitled to compensation. d) Customers should be booked on next available flight. Further compensation may need to be put forward (meals, taxi, hotels) should the situation require. OR Arrange for Involuntary Refund with no refund fees applied. e) Compensation Levels – Voluntary/Involuntary

The following credit/cash compensation shall be applied in addition to the next flight or refund as detailed above. Customer(s) is entitled to one (1) form of compensation, but not both. Credit Voucher/MCO valued at $200 CAD towards another flight of their choice within the 9M scheduled system ONLY OR Cash valued at $100 CAD in the form of a cheque which will be issued out of head office. Advise customer that cheque will be mailed and will take up to two weeks. 23) Failure to Operate on Schedule: In situations where there is a delay caused by Central Mountain Air due to an aircraft mechanical, delayed equipment, enroute delays/cancellations, etc., CMA will offer passengers compensation/allowance for having to wait for their flight. This can be in the form of a voucher, cash, allowance, or on the account of the company. This allowance will not be forthcoming for delays due to weather or Government regulations. Below are guidelines for the use of this policy. If a flight is delayed more than two hours (unreasonable delay), the guidelines below will be observed: The meal voucher/allowance amounts are:

Morning - $10.00 Afternoon - $12.00 Evening - $17.00

Should the allowance option be utilized, it will be necessary for the passenger to submit receipts to CMA for reimbursement. Overnight hotel stay required

Utilize a combination of the voucher/allowance $ amounts based on the above time periods from the time of overnight hotel initiation to proposed departure time of rescheduled flight, not to exceed $49 CAD per day.

Hotel Accommodation

In the case of an unplanned overnight stay caused by Central Mountain Air, CMA will provide out-of-town customers with meal vouchers, hotel accommodations and transportation to and from the airport. When a passenger elects to stay at a hotel not of the Company’s choice, CMA will reimburse only up to $60 CAD. Taxi

CMA will pay for a taxi to and from the hotel. Either the Company will have an account with the taxi supplier or the customer will be required to submit receipts and be reimbursed by CMA. A standard taxi fare from the airport to the hotel will be allowed for each one way trip to/from the hotel. Phone Allowance

In the case of an overnight stay, an $8.00 CAD allowance will be allowed for customers to advise family or business associates of their delay. Receipts are required to be submitted for this allowance. 24) Failure to Operate a Service:

1) The following circumstance shall justify an “involuntary change” of Carrier, routing, class, or type of fare: a) the Carrier cancels a flight; b) the Carrier fails to operate a flight reasonably in accordance with schedule (120 minutes); c) the Carrier fails to stop at a point to which the passenger is destined or is ticketed to stop over; d) the Carrier is unable to provide previously confirmed space; and e) the Carrier causes a passenger to miss a connecting flight on which he holds a reservation. The connecting flight must be included on the same ticket as the delayed/cancelled CMA flight to be considered for compensation, otherwise CMA will not be responsible for connecting flights.

2) In the foregoing circumstances the forwarding Carrier, with due consideration of the passenger’s reasonable interest shall: a) arrange for involuntary refund with no refund fees applied; or b) provide onward carriage with the least possible delay or inconvenience to the destination or point of stopover named on the ticket, if necessary at a higher cost and without additional charge to the passenger, as follows: i) on the same or another of “its” own aircraft; or ii) on transportation services including another Carrier other than those of the forwarding Carrier. c) not be responsible for a passenger’s/employer’s lost time and wages. 25) Voluntary Change of Carrier, Routing, Class, or Type of Fare:

1) The Carrier shall NOT effect a change of Carrier, routing, class or type of fare unless it is involuntary. 2) At a passenger’s request the Carrier may receive a change (other than the point of origin) provided: a) the passenger has received written authority to do so from a Carrier entitled to effect the change; b) that the ticket held by the passenger is transferable and does not have restrictions; c) that the passenger holds a full fare Y class ticket; d) that where their recalculated fare for the revised routing is higher than the fare specified in the endorsed ticket, shall collect any excess fare from the passenger; e) where the recalculated fare for the revised routing is lower than the fare specified on the endorsed ticket, the passenger shall arrange for the difference to be refunded from the forwarding Carrier to the passenger in accordance with and subject to any refund restrictions on the ticket(s);

f) the above conditions are met and that space is available and secured for onward leg of travel. 26) Refunds: 1) Involuntary refunds may be made: a) following circumstances listed in Rule 2.8 (24); and b) if no portion of the ticket has been used, the amount of refund will be equal to the fare paid; c) if a portion of the ticket has been used, the refund will be either in an amount equal to the one way fare and charges applicable to the unused transportation to the destination or stopover point named on the ticket or to the point at which transportation is to be resumed; and d) service charges will not be imposed and reasonable communication expenses of the passenger will be assumed provided that in case of cancellations required for safety or legal reasons or caused by the condition or conduct of the passenger, such charges may be imposed and such expenses may be refunded. 2) Voluntary refunds mean a refund of an unused ticket or portion thereof or an unused Miscellaneous Charges Order (MCO) other than an involuntary refund. Voluntary refunds will only be computed for unused portions of full Y class tickets. 27) Notices: CMA offers scheduled services to a wide variety of communities utilizing commuter and regional aircraft. Some communities are remote, have long stage lengths, and receive limited service. Aircraft capacity can be limited on certain routings and further constraints can be assumed in adverse weather conditions. We appreciate your patience when irregular operations occur.

28) Exemption from Liability: Subject to the limits of liability contained in this tariff, the Carrier will be exempted

from liability due to any failure to perform any of its obligations under the Carrier’s charter agreement arising from:

1) Labour disputes or strikes, whether of the Carrier’s employees or of others

upon whom the Carrier relies for the fulfillment of the flight agreement, and 2) “Force Majeure” or any other causes not attributable to the willful misconduct

of the Carrier including accidents to, or failure of, aircraft or any part thereof, of any machinery or apparatus used in connection therewith. Refusal of a Government or public body, on whatever grounds, to grant the Carrier any clearance, licence, right or other permission necessary for the performance of the Carrier’s operation is deemed to be included in the term “Force Majeure,”

provided, always, that in the event of such failure, the Carrier will use its best efforts to fulfill its obligations including the provision of alternate means of transport.

29) Limitation of Liability – Passengers: 1) The liability of the Carrier in respect of the death of, or injury to, a passenger

is limited to the sum of $100,000 CAD per passenger, per incident, exclusive of legal fees, costs and expenses.

2) In no cases shall the Carrier’s liability exceed the actual loss suffered by the

passenger. All claims are subject to proof of amount of loss. 3) The Carrier is not liable: a) In the case of any passenger whose age or mental or physical condition,

including pregnancy, is such as to involve an unusual risk or hazard, for any damages sustained by that passenger that would not have been sustained but for his/her age or mental or physical condition; or

b) In the case of a pregnant passenger, for any damages in respect of the

unborn child of that passenger.

30) Limitation of Liability – Baggage: 1) Subject to subsection (2), the liability of the Carrier in respect of loss, or

damage to, baggage, whether caused directly or indirectly by the act, neglect or default of the Carrier or not, is limited to the sum of $250.00 CAD per passenger.

2) No action shall be maintained by any loss, or partial loss of, or damage to

baggage or for any delay in the carriage thereof unless notice of a claim is presented in writing to the head office of the Carrier within 30 days from the date the baggage should have been delivered.

3) In no cases shall the Carrier’s liability exceed the actual loss of the

passenger. All claims are subject to proof of amount of loss. 31) Notice of Limitation for Carriage of Pets: CMA will not be responsible in the event of loss, delay, injury, sickness or death of

any pet animal accepted for transportation. 32) Overbooking Notice: Some scheduled flights may become overbooked, and there is a slight chance that a seat may not be available on a flight for which a person has a confirmed reservation. If a flight is overbooked, no one will be denied a seat until airline personnel first ask for volunteers willing to give up their reservation in exchange for compensation of the airline’s choosing. If there are not enough volunteers, the airline will deny boarding to other persons in accordance with its particular boarding priority. With few exceptions, persons denied boarding involuntarily are entitled to compensation.

DOMESTIC TARIFF Goods Rules, Rates and Charges

3.1 DEFINITIONS:

a) “advance arrangement” means that the shipper is required to first contact the Carrier to determine if a particular shipment is acceptable for carriage;

b) “advance charge” means a charge paid by a Carrier to an agent or another Carrier,

which the delivering Carrier then collects from the consignee. These charges could be incidental expenses paid out of pocket by an agent or another Carrier;

c) “air waybill” means waybill, airbill or other shipping document, issued by the Carrier

upon tender of shipment, made out by, or on behalf of the shipper and is evidence of the contract between the shipper and the Carrier for the carriage of goods on Carrier’s routes. It is the cargo Carrier’s prime document;

d) “AOG” means “Aircraft on Ground” and holds the highest priority (after minimum fuel)

when needed aircraft parts are loaded onto the aircraft for transportation from one station to another. Applicable to CMA. Hawkair and NTAir aircraft parts.

e) “Carrier” means Central Mountain Air LTD., its subsidiary or its representatives working within the scope of their employment or the airline issuing the Air Waybill or the airline carrying the tendered shipment;

f) “collect” means charges entered on the Air Waybill to be collected from the consignee;

g) “consignee” means the entity to whom something is consigned or shipped or

addressed to at the destination airport (same as receiver);

h) “consignor” means the person or company that ships goods (same as shipper); i) “declared value” means a declaration made by the shipper to the Carrier of the value

of the shipment which establishes the limit of the Carrier’s liability for damage, delay or loss;

j) “goods” means anything that can be transported by air, including animals, but

excluding mail other than in planeload lots, and excluding baggage; k) “interline” means carriage of goods over the routes of two or more Carriers; l) “live animals” shall include, but not be confined to dogs, cats, birds, fish, insects,

reptiles and worms; m) “manifest” means list of goods or shipments carried between stations on a specific

flight;

3.1 DEFINITIONS (continued): n) “notification” means a phone call, fax or e-mail;

o) “not negotiable” (or “non-negotiable”) means that the document (Air Waybill) is a

straight non-transferable bill of lading and cannot be surrendered to a third party under any circumstance;

p) “prepaid” means charges entered on the Air Waybill payable by the shipper; q) “shipment” means a single consignment of one or more pieces, from one shipper at

one time at one address, receipted for in one lot and moving on one air waybill to one consignee at one destination airport;

r) “shipper” means the shipping company or its representative; the same as consignor; s) “specific commodity rate” means rate applicable to specific classes of commodities,

usually in volume shipments. These rates could be lower than general freight rates; t) “tariff” means, as applied to air cargo, a document filed with the appropriate

government authorities setting forth applicable rules, rates and charges for the transportation of goods. The tariff is the contract of carriage legally binding the shipper, consignee and Carrier;

u) “tender” occurs when shipper presents a properly addressed, packaged and labeled

shipment to Carrier for acceptance after the Air Waybill has been completed;

v) “waybill” means an Air Waybill or other shipping document.

3.2 DISPOSITION OF FRACTIONS:

a) fractions of one-half kilogram will be assessed at the charge for the next kilogram ;

b) in computing rates or charges, fraction of less than one-half cent will be dropped, and fraction of one centimeter (one-half inch or more) will be considered as one centimeter (one inch)

3.3 COMPUTATION OF DAYS:

In computing time in days, full calendar days will be used and Sundays and legal holidays will be included, except when the last day falls on a Sunday or legal holiday, in which event the next following calendar day (other than a Sunday or legal holiday) will be included.

3.4 PACKING AND MARKING REQUIREMENTS:

a) shipment must be so prepared or packaged as to ensure safe transportation with ordinary care in handling;

b) any article susceptible to damage as a result of any condition must be adequately

protected by proper packaging and must be marked or bear appropriate labels;

c) any article susceptible to damage as a result of any condition which may be encountered in air transportation, such as high or low temperatures, high or low atmospheric pressures, or sudden changes in either, must be adequately protected by proper packaging and any other necessary measures;

d) each piece of a shipment must be legibly and durably marked with the name, address

and phone number of the shipper and consignee (receiver);

e) articles with a floor-bearing weight in excess of that which may be handled by the Carrier (488 kg/sq.m. or 100 lbs/sq.ft.) must be provided with a suitable skid or base, which will distribute the weight to that measure which the Carrier may accept. These articles are subject to advance arrangements.

3.5 SHIPMENTS ACCEPTABLE AND LEVEL OF SERVICE:

Except as otherwise provided in this tariff, all shipments are acceptable for transportation only when the rules and regulations of the tariff and all laws, ordinances, and other governmental rules and regulations governing the transportation thereof have been complied with by the shipper, consignee or owner. Level of Service: All rates are subject to any applicable taxes, fees and fuel surcharges. Minimum charges will apply. All three types of air freight (as described below) are carried in accordance with the Carrier’s rates, charges or regulations. This service is offered “airport to airport” and available on Carrier’s routes only. It is also subject to schedule and space availability, irregular operations and force majeure, etc..

a) General Air Freight or air cargo is described and defined in this Tariff. General air freight will be handled according to CMA “Aircraft Loading Priority

Order”. Maximum weight 45 kilograms or 100 lbs.; maximum dimensions 56 x 61 x 102 centimeters; 22 x 24 x 40 inches.

These shipments are not guaranteed on ‘next available flight’.

b) Rapid Pak is an envelope or small packet not exceeding 5cm x 30cm x 40cm ( 2” x 12” x 151/2” ) or 3 kg ( 6.5 lbs. ) in size.

Rapid Pak shipments require delivery to the Carrier’s cargo agent a minimum of 90 minutes prior to the intended flight’s departure time. Will be carried on ‘next available flight’. c) First Class Freight is the same as general air freight except it will be handled on a “next available flight”-basis and according to CMA “Aircraft Loading Priority Order”. CMA dispatch must be notified and consulted prior to accepting First Class Freight. The shipments require delivery to Carrier’s cargo agent minimum 90 minutes prior to the intended flight’s departure time. (Note: First Class Freight is not available at this time).

3.6 SHIPMENTS SUBJECT TO ADVANCE ARRANGEMENTS:

The following will be acceptable for carriage only by advance arrangements: a) shipments liable to impregnate or otherwise damage other equipment or other

shipments;

b) shipments requiring special attention, protection or care en route; c) shipments of gold and other precious articles;

d) shipment of live animals; e) perishable goods or similarly sensitive items;

f) shipments of human remains (other than cremated remains); g) shipments with pieces of unusual weight, shape, size or

i) in excess of 45 kilograms (100 lbs) ii) in excess of 56 x 61 x 102 centimeters (22 x 24 x 40 inches) iii) with floor bearing weights in excess of 488 kg per square meter (100 lbs

per square foot);

h) shipments which require accompanying personnel; i) Dangerous Goods (if applicable); and

j) any other shipments with unusual characteristics.

3.7 SHIPMENTS NOT ACCEPTABLE:

a) Shipments, which require the Carrier to obtain a Federal, Provincial, or Local Licence for their transportation, will not be accepted when the Carrier has elected not to comply with such licence requirements.

b) Shipments requiring special devices for safe handling will not be accepted unless such special devices are provided and operated by and at the risk of the shipper or consignee (receiver).

c) Shipments, not expressly covered by the rules of this tariff or which could cause injury to crew or passengers, damage equipment or carriage of which is prohibited by law, will not be accepted. Shipments, which, in Carrier’s judgment, are not suitable for carriage, will not be accepted.

3.8 CONDITIONAL ACCEPTANCE OF SHIPMENTS:

The Carrier retains the right to reject a shipment prior to the initiation of any transportation by air from the airport of origin when it reasonably appears to the Carrier that such shipment is:

a) improperly packed or packaged; b) subject to damage if exposed to extreme temperatures; c) inherently defective in such a way that the transportation could not be furnished by the Carrier without risk of loss or damage to the goods or to equipment or to the Carrier; d) not accompanied by proper documentation and necessary information as required by any convention, statute or tariff applicable to such shipment; or tendered by shipper without proper identification;

e) subject to advance arrangements unless such arrangements have been satisfactorily completed.

3.9 INSPECTION OF SHIPMENTS:

Shipments are subject to inspection by Carrier to determine their acceptability and to assess proper charges thereon. Carrier or its representative shall not allow inspection of any shipment until all transportation charges are paid, consignee has signed the air waybill and consignee has taken possession of the shipment.

3.10 AIR WAYBILL AND SHIPPING DOCUMENTS:

a) The shipper is required to prepare and present a non-negotiable air waybill with each

shipment tendered for transportation subject to this Tariff.

If the shipper fails to present such air waybill to the Carrier at the time of tendering the shipment, the Carrier may accept such shipment if accompanied by a non- negotiable shipping document, or memorandum. This document or memorandum is non-negotiable irrespective of the wording on the document.

Each such shipment will be subject to the Carrier’s tariff in effect on the date of acceptance of such shipment by the Carrier.

b) The air waybill, and the tariff applicable to the shipment shall apply to the benefit of and be binding upon the shipper, consignee and the Carrier by whom transportation is undertaken between the origin and destination, including destination on reconsignment or return of the shipment.

c) The air waybill and the tariff applicable to the shipment will apply at all times when the shipment is being handled by the Carrier. Pick-up, delivery or ground services in connection with the shipment when handled for the Carrier is the responsibility of the connecting Carrier.

d) No agent, servant or representative of the Carrier has the authority to alter, modify or waive any provisions of the contract of carriage or of this tariff.

e) The contents of shipments must be indicated by accurate and specific descriptions on the air waybill.

f) The number of pieces included in a shipment must be specified on the air waybill.

3.11 EXCLUSIONS FROM LIABILITY:

a) The Carrier will not be liable for loss, damage, delay or other results caused by:

i) acts of God, perils of air, public enemies, public authorities acting with actual or apparent authority in the premises, authority of lay, quarantine, riots, strikes, civil commotions, or hazards or danger incident to a state of war;

ii) the act or default of the shipper, consignee (receiver), or owner;

iii) the nature of the shipment, or any defect, characteristic or inherent vice

thereof;

iv) violation by the shipper, consignee, or any other party claiming an interest in the shipment or any of the rules contained in this tariff or other applicable tariffs, including, but not confined to, improper addressing, and failure to observe any of the rules relating to shipments not acceptable for transportation or shipments acceptable only under certain conditions;

v) acts or omissions of warehousemen, customs or quarantine officials or

other persons, other than the Carrier or its agents, gaining lawful or unlawful possessions of the shipment; or

vi) compliance with delivery instructions from the shipper or consignee or

non-compliance with special instructions from the shipper not authorized by applicable tariffs.

b) The Carrier will not be liable for loss, damage, deterioration, destruction, theft, pilferage, delay, default, misdelivery, non-delivery, or any other result not caused by the actual negligence of itself, its agents, or representatives, acting within the scope of their authority, or not occurring on its own line or in its own service, or for any act, default, negligence, failure or omission of any other Carrier or any other transportation organization.

c) The Carrier will not be liable for any loss of money, bullion, bonds, coupons, jeweler, precious stones, valuable papers or other articles of extraordinary value unless such articles are specifically described, listed and their value is declared on the Air waybill.

d) The Carrier will not be liable in any event for any consequential or special damages arising from transportation subject to these tariff rules, whether or not the Carrier had knowledge that such damages might be incurred.

e) The Carrier will not be liable for any loss, death or damage to live animals, reptiles, birds, poultry, insects and fish while in transit.

3.12 LIMIT OF LIABILITY:

a) In consideration of Carrier’s rate for the transportation of any shipment, which rate, in part, is dependent upon the value of the shipment as determined pursuant, the shipper and all other parties having an interest in the shipment agree, that the value of the shipment shall be determined in accordance with the provisions and, that the total liability of the Carrier will in no event exceed the value of the shipment as so determined, subject to the limitations.

b) By tendering the shipment to Carrier for transportation, the shipper, for himself and all other parties having an interest in the shipment, waives all claims for damages beyond the limitations set forth in these rules and affirms the descriptions of the shipment as recited on the air waybill, and the fact that the shipment is not of a nature unsuitable for carriage by air or hazardous thereto.

c) The total liability of the Carrier will in no event exceed:

i) the value of the shipment as determined or declared; or

ii) the actual value of the shipment; or

iii) the amount of any damages actually sustained whichever is the least.

3.13 INDEMNIFICATION: The shipper and consignee shall be liable, jointly and severally, to hold harmless or indemnify the Carrier for all claims, fines, penalties, damages, costs, expenses, legal fees or other sums incurred, suffered or disbursed by the Carrier as a result of any violation by shipper or consignee of any of the provisions contained in this tariff or any other default of the shipper or consignee with respect to any shipment.

3.14 LIABILITY FOR CHARGES:

The shipper and consignee shall be liable, jointly and severally, for all unpaid charges, declared or undeclared, payable on account of any shipment pursuant to this tariff including, but not confined to, sums advanced or disbursed by the Carrier on account of such shipment.

3.15 CARRIER’S LIEN:

The Carrier will have a lien on a shipment for all sums due and payable to Carrier.

3.16 NOTICE AND DISPOSITION OF PROPERTY – UNCLAIMED / REFUSED:

a) When perishable property, or property which by its very nature requires expeditious handling, is accepted for shipment, and delay at point of origin thereafter develops or is reasonably anticipated, the Carrier, upon receipt of such knowledge, will promptly attempt to notify shipper thereof, requesting instructions. Once received, Carrier reserves the right to reroute the shipment by other means of transportation, or to dispose of it, in accordance with the provisions of paragraph (c).

b) Carrier will promptly notify consignee upon arrival of shipment. If after notice of arrival has been given to consignee, pick-up has not been affected and the shipment is unclaimed at the expiration of the free storage time, the Carrier will notify the shipper and consignee at the address shown on shipment of Carrier’s inability to affect delivery. Any undelivered shipment will, upon written request from shipper received within 10 days after the date shipper was notified of non-delivery, be returned to the shipper, forwarded, or otherwise disposed of; all at shipper’s expense.

c) When a shipment containing perishable articles is delayed in the possession of the Carrier, or is unclaimed, refused, or threatened with deterioration, the Carrier will have the right immediately to take such steps as it sees fit for the protection of the Carrier and other parties in interest including collect communications for instructions, or sale or other disposition of such perishable articles without instructions.

d) When a shipment containing non-perishable property remains unclaimed or is

refused after notice of arrival and notice of non-delivery as herein provided, Carrier will have the right to store and the additional right to dispose of the shipment or any part thereof at public or private sale after 30 days of written notice to shipper and consignee at the addresses shown on the shipment.

e) In the event of non-payment of any sums payable the Carrier will have the right to hold the shipment subject to storage and to dispose of the shipment at public or private sale without notice to shipper or consignee, paying itself out of the proceeds of such sale all sums due and payable, including storage charges.

f) No sale or disposal pursuant to Chapter 2.31 shall discharge any liability or lien to any greater extent than the proceeds thereof less selling expenses if any, and the shipper and consignee shall remain liable, jointly and severally, for any deficiency.

3.17 ROUTING AND REROUTING:

a) The Carrier in the exercise of due diligence and in order to protect all property accepted for transportation, will determine the routing of any shipment

b) The Carrier reserves the right to deviate from any route shown on the air waybill, when necessary, in its opinion, to expedite delivery via any route or any air Carrier or other mode of transportation or agency at the rate prescribed by such agency; provided that when either of the foregoing rights is exercised, the transportation charges shall be no greater than the air freight charges from origin to destination via the route shown on the air waybill.

3.18 SCHEDULES:

Carrier shall attempt to carry shipments with due diligence, but all flight schedules are subject to change without prior notice. Carrier shall make every effort to ensure, but shall not be responsible for, continuation of carriage or successful transfer of shipments onto connecting flights of Carrier or of another air Carrier.

3.19 AVAILABILITY OF EQUIPMENT AND SPACE:

a) Carrier undertakes to transport, consistent with its capacity to carry, all property accepted for transportation. All shipments are subject to the availability of suitable aircraft or equipment, and with respect to Carrier transporting passengers, air mail and air express, and Carrier will determine the priority of carriage (as per Carrier’s Aircraft Loading Priority Order) between shipments that will not be carried on a particular flight and which will be removed at any time or place and when a flight will proceed without all or any part of any shipment.

b) Any shipment or commodity will be subject to refusal, delay or embargo by Carrier, if such shipment or commodity cannot be transported with reasonable dispatch by reason of any governmental rules, regulations, or orders, or because of unavailability of suitable aircraft or for other conditions beyond the control of the Carrier.

3.20 RIGHT TO REFUSE TO TRANSPORT:

Carrier has the right to refuse to transport any articles which it has reasonable grounds for believing would endanger the safety or security of the aircraft, crew, passengers or other property, or are shipped contrary to any governmental regulations or are liable to cause damage or goods on board the aircraft. Attempt to tender any prohibited materials or items for carriage by the shipper will be reported to the authorities.

3.21 APPLICATIONS OF RATES AND CHARGES:

a) Charges will be assessed at the rates in effect on the day of acceptance of the shipment by the Carrier or its agents.

b) Specific commodity rates remove the application of the general commodity rates on the same quantity of the same article or commodity from and to the same points over the same route.

c) Whenever and for such periods as direct services are suspended or discontinued between points named in this tariff, rates published between such points via such direct suspended or discontinued service, will be inapplicable (except for combination or intermediate application) during such period as the service may be suspended or discontinued.

3.22 CHARGES FOR WEIGHT:

a) Transportation charges will be assessed on either:

i) the actual (gross) weight (in kg); or ii) the cubic dimensional weight of a shipment, whichever is the greater of

the two; or iii) specific commodity rate

b) Cubic measurement will be based on the greatest dimensions (length, width and height) of (1) the shipment or (2) of each part therein in the event of mixed shipments containing differently rated parts.

c) Chargeable cubic dimensional weight will be derived from the cubic measurement of shipments in a following manner:

d) Length x Width x Height (in inches) divided by 366 = kilograms; or,

e) Length x Width x Height (in centimeters) divided by 6000 = kilograms. [Note: The actual (or gross) weight may exceed the dimensional weight.]

3.23 CHARGES FOR DECLARED VALUES:

a) A shipment shall be deemed to have a declared value not exceeding $1.10 per kilogram (but it may not be less than $50.00) unless a higher value is declared on the air waybill at the time of receipt of the shipment from the shipper.

b) If a value is declared, an additional transportation charge of:

$ 7.50 per every $100.00 (or fractions thereof) up to $5,000 declared value is

added. $ 11.00 per every $100.00 (or fractions thereof) over $5,000 declared value is

added. The shipment having a declared value in excess of $25,000 will not be

accepted. The aggregate value of all shipments carried in any one aircraft will not exceed $50,000 declared value.

c) The base cargo rate assessed for a declared value shipment will be the same as

those of similar size and weight in Rapid Pak, General Freight or First Class Freight (if available) categories as applicable.

d) A shipment consisting of a commodity and/or article named in paragraphs (e) and (f)

of this paragraph, moving on one air waybill over the lines of two or more Carriers, will be deemed to have for its entire movement the lowest declared value established by any one of such Carriers, unless a higher value is declared on the air waybill at the time of receipt of the shipment from the shipper, in which event the highest additional transportation charge established by any one of such Carriers will be applicable to the shipment for its entire movement.

e) Shipment of gold, silver, platinum and dore bullion will be accepted only if the actual

value is declared on the air waybill at the time of receipt of the shipment from the shipper. Charges will be assessed on the weight and actual value of the shipment. Gold, silver and dore bullion is deemed to include gold and silver in mass, gold and silver specie and/or in the form of ingot bars, grain, sheet, foil, powder, sponge, rods, wire, tubes, circles, mouldings and castings. Platinum is deemed to include platinum as bullion, platinum, iridium, ruthenium, osmium, rhodium and platinum alloys in the form of grain, sponge, bar, ingot, sheet, rod, wire, tube and strip.

f) C.O.D. shipments (only by advance arrangement) – the C.O.D. amount to be

collected will be deemed to be the declared value of the shipment and charges assessed accordingly, unless a higher or lower value is declared on the air waybill at the time of receipt of the shipment from the shipper.

3.24 CHARGES ON MIXED SHIPMENTS:

a) When articles taking different rates are packaged together, charges will be assessed on the weight of the entire package at the highest rate or rating applicable to any article therein.

b) When articles taking different rates are packaged separately in the same shipment,

charges will be assessed on an individual article basis.

c) Part of a shipment, will consist of one package, piece, or bundle, or two or more packages, pieces or bundles having the same applicable airport-to-airport rate.

3.25 CHARGES PREPAID OR COLLECT:

Shipments will be accepted either with charges to be prepaid by the shipper or to be collected (only by prior arrangement) from the consignee except that the following shipments must be prepaid:

a) shipments addressed to persons restrained of their liberty;

b) shipments not equal in commercial value to the charges thereon;

c) shipments addressed to Canadian Government agencies unless shipped by government agents presenting proper bills of lading;

d) shipments of second-hand household effects;

e) shipments addressed to consignees temporarily at a transient address;

f) shipments of baggage and sample cases addressed to Customs, and;

g) shipments of live animals;

h) shipments of perishable goods; i) Shipments interlining to another Carrier (if available).

3.26 CURRENCY OF RATES AND CHARGES:

Rates and charges appearing in this tariff are stated in terms of Canadian dollars (CAD). 3.27 PAYMENT OF RATES AND CHARGES:

Rates and charges are payable in lawful currency of Canada at the time of acceptance by the Carrier on prepaid shipments, or at the time of delivery on collect shipments.

3.28 CLAIM PROCEDURES, ASSIGNMENT, SUBROGATION:

a) The originating shipper (or consignee) must notify the Carrier of apparent loss or damages immediately and file “Intent to Claim”-document in writing to the originating or delivering Carrier within 7 days after the date of acceptance of a shipment. A formal claim must be filed within 30 days.

b) Claims for concealed loss or damages not discovered upon reasonable inspection at

the time of delivery and after a clear receipt has been given to the Carrier must be reported in writing to the delivering Carrier at destination airport within forty eight (48) hours after delivery of the shipment.

c) The Carrier reserves the right to inspect the shipment and container prior to honoring

the claim. d) No claim for loss of or damage to any shipment will be entertained until all

transportation charges for such shipment have been paid. The amount claimed may not be deducted from transportation charges.

d) The Carrier’s liability may not exceed $ 1.10 per kilo, but may not be less than $ 50.00, if the goods were not insured (if applicable) or if the value of the Shipment was not declared. e) In the event Carrier is liable to shipper for any claim, upon discharge of such liability, Carrier shall be subrogated to any rights shipper, consignee or any other party with an interest in the shipment may have to proceed against any other person or party which is, or may be, liable. Shipper hereby expressly assigns such rights to Carrier, which rights shall include, but not limited to, the right to make claim against any insurance policy that may have provided coverage for the liability to shipper.

3.29 LIMITATION OF ACTIONS REGARDING CLAIMS:

The Carrier will not be liable in any action brought to enforce any claim unless the claimant has complied with all applicable provisions, and unless such action is brought within one year after the date written notice is given to the claimant that the Carrier has disallowed the claim in whole or in part.

3.30 COLLECT ON DELIVERY (C.O.D.) SHIPMENTS:

a) It will be the sole responsibility of the shipper to enter the amount of the C.O.D. on the air waybill and the Carrier shall not be liable for failure to collect the C.O.D. amount when it is not so entered by the shipper. The shipper must also have the letters “C.O.D.” and the total amount to be collected on delivery, legibly and durably marked on each piece for C.O.D. The C.O.D. amount is deemed to be the declared value of the shipment unless a higher or lower value is declared. At this time, C.O.D. shipments will only be accepted by advance arrangement.

b) The following shipments will not be accepted C.O.D:

i) shipments requiring prepayment or the guarantee of transportation charges;

ii) shipments on which the total amount to be collected on delivery exceeds

$10,000.00;

iii) C.O.D. pieces will not be accepted on the same air waybill with pieces not carried as C.O.D. Only pieces covered by one C.O.D. amount will be accepted on the air waybill; and

iv) shipments of perishables and animals will not be accepted unless prior

approval of Carrier has been obtained.

c) The amount of the C.O.D. is payable in cash; no privilege of examination or trial will be given prior to the collection thereof; no partial collection of the amount of the C.O.D. will be accepted; no partial delivery of a C.O.D. shipment will be made unless the full amount of the C.O.D. has been collected.

d) The disposition of refused or unclaimed C.O.D. shipments, including re-consignment

to a new C.O.D. amount, may be arranged for by the shipper only in the following manner,

i) by instructions placed on the air waybill at the time of shipment; or by written

order to the Carrier at origin, who will transmit the instructions to the Carrier at destination at the expense of the shipper.

e) C.O.D. shipments containing perishable articles and refused or unclaimed at

destination. Other C.O.D. shipments refused or unclaimed at destination will be held subject to storage and, if disposition is not arranged as prescribed in paragraph (d) of this rule within 30 days after notice has been given to the shipper.

f) For collecting and remitting the amount of the C.O.D. a service charge will be made

of 20% of the amount of the C.O.D. subject to a minimum charge of $50.00. g) Pick-up and delivery charges will be added to the total amount.

3.31 STORAGE:

a) Shipments will be held by the Carrier without charge for 48 hours (excluding Sundays and legal holidays) for freight other than perishables or animals after arrival and tender of delivery at destination, or notification of arrival, whichever is applicable. Such free time will be computed from the first 8:00AM after the arrival.

b) After the expiration of such free time, the Carrier will, if practicable, continue to hold

such shipment as agent for the shipper and consignee, subject to a charge of ten dollars ($10.00) per day or any fraction thereof, or, if such continued holding is not practicable, Carrier, as such agent, will place the shipment in a public warehouse subject to a lien for all transportation, storage, delivery, warehousing and other charges, including handling charge of $10.00, storage charges or minimum charge of $20.00 per shipment.

c) When the shipment is held by the Carrier, the Carrier’s liability will be reduced to that

of a warehouseman, and when the shipment is placed in a public warehouse, Carrier’s liability for the shipment will terminate.

d) Outbound shipments delivered to the Carrier’s premises, which are not acceptable

for any reason will be subject to storage charges as prescribed in this Rule (without any free time) from the first business day after the delivery until such shipment is made acceptable for carriage or removed.

e) The provisions (Carrier’s lien) shall apply to all shipments which are stored.

f) The Carrier does not provide refrigerated cargo storage facilities. g) The Carrier does not provide animal care facilities.

3.32 ADVANCEMENT OF CHARGES:

a) Upon request, the Carrier may advance charges for transportation, cartage, storage, loading, unloading and Government duties and customs fees.

b) Charges will not be advanced on any shipment requiring prepayment or guarantee of charges.

c) A fifteen percent (15%) “Handling Charge” will be added to the regular rate for this service.

4.1 CHARTER SERVICE RATES AND CHARGES: The rates and charges shall be agreed upon by the Charterer and Carrier, and will vary on a case by case basis based on the requirements of the Carrier and the respective Charterers. 4.2 PAYMENT TERMS: The charter fee shall be paid by the Charterer to the Carrier (or to any person whom the Carrier, directly or indirectly, has paid a commission or has agreed to pay a commission with respect to such Charter) as follows: a) A deposit of 10% of the Charter Fee is required to secure the Charter, and shall be paid upon execution of the relevant contract. All charters are subject to aircraft availability and are not guaranteed until the deposit has been received. b) The balance of the Charter Fee is due a minimum of three (3) days prior to departure. Charter service will not be provided unless payment is received in full. c) Extraordinary terms may be agreed upon between Carrier and respective Charterer.

4.3 CHARTERER CANCELLATION, CHANGE AND REFUND TERMS: Other than a written agreement by both parties, the following terms and conditions will apply to changes, cancellations and refunds: A. Cancellations If a Charter Service is cancelled within fourteen (14) days of the planned departure, the 10% deposit fee will be non-refundable. If the cancellation occurs within three (3) days of the planned departure, a 25% cancellation fee will apply. B. Changes The Carrier will make all reasonable efforts to accommodate any changes to the Charter Service contract provided the Charterer shall be liable to the Carrier for any excess charges incurred by the Carrier as a result of such changes. The Carrier shall not be liable for any losses the Charterer may suffer, should the Carrier be unable to accommodate the requested changes.

4.4 CARRIER CANCELLATION, CHANGE AND REFUND TERMS: A. Substitution of Aircraft When, due to causes beyond the control of the Carrier, the aircraft contracted for is unavailable at the time the air transportation commences or becomes unavailable while carrying out such transportation, the Carrier may furnish another aircraft of the same type, or with the consent of the party contracting for the use of the aircraft, substitute any other type of aircraft if the rates and charges for the new aircraft are the same as for the original aircraft, except as provided in paragraphs i and ii. i. When the substituted aircraft is capable of a larger payload than the original aircraft contracted, the payload carried in the substituted aircraft will not be greater than the payload which would have been available in the aircraft originally contracted, unless the party contracting for the use of the aircraft agrees to pay the rates and charges applicable to the substituted aircraft. ii. When the maximum payload of the substituted aircraft is smaller than the maximum payload of the original aircraft contracted, charges will be base on the rates and charges applicable to the type of substituted aircraft. B. Changes and Cancellations The Carrier reserves the right to cancel or change the planned departure, route or schedule, at any time, for any reason, on notice to the Charterer. The liability of the Carrier will be limited by the terms and conditions of the Charter Services Contract.
