The Foreign Language ChallengeIntegrated Foreign Language Review
Factors Driving Increased Language Variability in Collections:
● Growing ESI volumes statistically increase the likelihood of multiple languages in a collection
● Increasing foreign direct investment/involvement in American corporate environment
● Globalization = more transnational business transactions and arrangements
● Domestically, a growing population of non-english speakers with non-english native documents.
Integrated Foreign Language Document Review | eDiscovery Webinar Series | July 16, 2015
“In our global economy, collections now often include documents in several languages. This is something that corporate legal departments have to deal with more frequently than ever. As a result, foreign language review is likely to be at the top of the list for outside counsel, corporate counsel, and anyone dealing with discovery.”
- Amy Kang, Esq.Black Letter Discovery
The Foreign Language ChallengeIntegrated Foreign Language Review
Foreign Language Review Goals:
● Collect Foreign Language Documents
● Understand the scope of languages within the collection
● Determine a translation methodology
● Identify responsive, privileged, and key foreign language documents
● Support collaboration between internal and external litigation professionals
● Produce non-translated, redacted (if necessary) original document version

The Foreign Language ChallengeIntegrated Foreign Language Review
Foreign Language Review Traditional Challenges:
● Difficult to identify languages within a collection
● Foreign language translations are often uploaded in separate batches
● Cumbersome to move between viewing the original document and the translated version
● Separate document records can cause original and translation to become out of synch
● Searching across multiple languages is not always supported, i.e. English search may not return German result.

Foreign Language Review Options

Machine Translation
Fast, increasingly accurate, inexpensive
potential to miss idiomatic/nuanced language
Translated to and reviewed in English
Accurate, availability of translation professionals
Expensive, no legal expertise
Reviewed in Native Language
Very accurate, reviewers with understanding of legal principles
Very expensive, difficult to assemble teams

Maintaining a Single Document RecordIntegrated Foreign Language Review
Integrated Foreign Language Document Review | eDiscovery Webinar Series | July 16, 2015
The Risk of Multiple/Independent Document RecordsOriginal Translation1) A translated version of the original document is
uploaded into the review platform.
2) English only reviewers begin conducting keyword searches to identify responsive, privileged documents
3) Reviewers identify a translated version as privileged, will be withheld from production. Original has not been identified as privileged.
4) Unless the privilege review protocol is repeated in every language that appears in the collection, there is a chance that the original version is produced.
Out of synch review designations increase the risk of privilege waiver and/or withholding of responsive documents!
Maintaining a Single Document RecordIntegrated Foreign Language Review
Integrated Foreign Language Document Review | eDiscovery Webinar Series | July 16, 2015
Benefit of a Single Document Record Single Document Record (Original + Translated)
1) A translated version of the original document is uploaded and associated with original version
2) English only reviewers begin conducting keyword searches to identify responsive, privileged documents
3) Reviewers identify a translated version as privileged and that designation is automatically applied to all versions within the record
4) All versions of the privileged document are withheld from the production.
A single document record keeps designations in synch, reducing risk of privilege waiver and/or underproduction
Multi-language Search IndexIntegrated Foreign Language Review
Integrated Foreign Language Document Review | eDiscovery Webinar Series | July 16, 2015
● The contents of both the original document and the English translation are both indexed (made available for search)
● Search is supported in any of the languages that appear in your collection.
● Concept searches also work across languages
● Review teams can find all documents, no matter what language, discussing particular topics or issues by searching in English.

Scalability Integrated Foreign Language Review
Integrated Foreign Language Document Review | eDiscovery Webinar Series | July 16, 2015
● Machine translation methodologies can combine with scalable cloud architectures to automatically translate foreign language documents quickly and make them immediately available for search and review.
● An initial review of machine translated documents can then determine if key documents require more concentrated manual translations or foreign language review by a native speaker with legal training.
● This approach can significantly reduce the time it takes to make translated version available for review.
