3. SPECIAL CONDITIONS

3.1. Quoted pricesPrices quoted are to be on a lump sum basis.

All prices for goods and/or services offered are to be fixed for the term of the Contract. Quoted prices must include Goods and Services Tax (GST).

Unless otherwise indicated, prices quoted must include delivery to and unloading at the site specified in the Specification. Any charge not stated in the Quotation as being additional will not be allowed as a charge for any transaction under any resultant Contract.

3.2. Lodgement of QuotationsThe Respondent must submit:

a) the original of the Form of Quotation;

b) completed schedules and any drawings; and

c) written statements and other information (if required).

Quotations must be submitted duly signed and in a sealed package clearly endorsed with the Quotation Title and Reference Number and must be addressed to:

3.3. Quotation Closing TimeQuotations close at 12 noon Wednesday, 6 November, 2013.Only those quotations received by the closing time will be considered.

Quotations that are mailed will be dated and time stamped when received.

The Local Government will accept no responsibility in the event that a quotation is not received by the closing time.

3.4. Informal QuotationAny Quotation may be rejected if it:

a) does not comply with the requirements of the specification or this Request for Quotation; or

b) contains any provisions not required by this Request for Quotation.

3.5. Acceptance of QuotationsThe Local Government is not bound to accept the lowest or any quotation.

The Local Government may accept part of a quotation.

This Request for Quotation together with the Local Government’s written acceptance of the quotation shall constitute the contract between the Local Government and the successful respondent.

The respondent agrees that the quotation will remain open for acceptance for a minimum period of 30 days after the closing time, notwithstanding that there may have been negotiations in respect of any quotation in the meantime.

A respondent may withdraw its quotation at any time after the expiration of 30 days from the closing time, but must not withdraw their Quotation prior to the expiration of 30 days from the closing time.

3.6. Contract DurationSUPPLY CONTRACT

The contract is to be completed on supply of the goods as negotiated and agreed by the Local Government.

However, in the event of the successful respondent failing in any manner to carry out the contract to the Local Government’s satisfaction, the Local Government may forthwith determine the contract by written notice to the successful respondent.

3.7. Canvassing of Elected Members and Council OfficersCanvassing of elected members or Council officers will automatically lead to disqualification.

3.8. IndemnityThe successful respondent must indemnify and keep indemnified the Local Government against:

a) any liability under the Workers’ Compensation and Rehabilitation Act 2003 as amended from time to time; and

b) any other law in force or which during the term of this contract may come into force, under which any person is entitled to claim or sue for compensation or recover any damages from the Local Government.

4. SPECIFICATION

4.1. Extent

4.1.1 This quotation will consist of the supply and delivery of six (6) vehicles as follows:Vehicle 1 2WD Dual Cab Drop Side Body Utility – 4 cylinder diesel

Vehicle 2 2WD 1000kg Utility (includes canopy transfer) – 4 cylinder diesel

Vehicle 3 2WD 1000kg Utility (includes canopy transfer) – 4 cylinder diesel or 6 cylinder petrol

Vehicle 4 4WD Dual Cab Utility (includes canopy transfer) – 4 cylinder diesel

Vehicle 5 4WD Dual Cab Drop Sides Utility – 4 cylinder diesel

Vehicle 6 4WD Dual Cab Drop Sides Utility – 4 cylinder diesel

4.1.2 The Principal reserves the right to accept any part or all of a vehicle’s quotation. The Supplier shall have no claim against the Principal for loss of anticipated profit should part only of their quotation be accepted.

4.2. Technical information

4.2.1 Suppliers are to submit full specifications, performance data etc., accompanied by photographs and/or illustrated literature in respect of the plant offered and all other information considered necessary to prove their quotation.

4.3. Warranty period

4.3.1 The Supplier must state the full period, terms and conditions of the warranty of the vehicles offered.

4.4. Registration

4.4.1 All vehicles shall be delivered registered in the name of the Council of the Shire of Burdekin. All costs for registration of the vehicles shall be by separate order to the successful Supplier and for the comparison of quotations the price quoted shall not have registration costs included.

4.4.2 Registration shall be on Council’s common due date of 1 December.

4.4.3 Council is exempt from paying Stamp Duty under Exemption No. 6 of the Queensland Transport Vehicle Registration Application and shall not be included in the registration charges.

4.4.4 Motor vehicle fees shall be those fees applicable for a Local Authority.

4.4.5 Compulsory Third Party Insurance shall be through Suncorp Metway and at the rate applicable to a Local Authority.

4.4.6 All documentation showing proof of registration and Compulsory Third Party (CTP) shall be supplied to Council upon delivery of the vehicles. Documents for each vehicle should include a Tax Invoice, CTP break down and New Business Application. Please note that concession applies for all vehicles in this quotation.

4.5. Goods and Services Tax

4.5.1 Goods and Services Tax (GST) is applicable for all vehicles and attachments and is to be included in this quotation as a separate item as per the schedule of prices for both the new vehicles and the vehicles offered for trade.

4.5.2 If the applicant is registered for GST, the invoice price relating to “taxable supplies” made to Council will have to include the GST payable on those supplies. In respect of all “taxable supplies” made to Council, a Tax Invoice will be required in order for Council to claim input tax credits from the Australian Tax Office and also to process the payment.

4.5.3 If goods or services are provided to Council, and an Australian Business Number (ABN) is not quoted on invoices, Council will be required by law to withhold tax at a rate equivalent to the top marginal rate of tax applicable to individuals plus Medicare levy (currently 48.5%), from any payment Council makes. This withholding will be remitted to the Australian Tax Office on the applicant’s behalf.

4.6. Department of Transport

4.6.1 The vehicles and their attachments shall conform in all respects with current Department of Transport and Traffic Regulations, and have all necessary certifications and approvals for the vehicles and attachments as specified.

4.7. Delivery

4.7.1 Delivery shall be made free of charge to the Council’s Workshop, Jones Street, Ayr. Time of delivery shall be within four (4) weeks from the date of order.

4.8. Trade-in

4.8.1 The quotation shall be submitted on the following basis:a) For the vehicles specified: without trade-in; and b) allowing for trade-in.

4.8.2 The vehicles allowed to be traded-in shall be traded-in in an unregistered and “as is” condition at the time of delivery of the replacement vehicles. The vehicles will be available for inspection between the hours of 10.00am and 2.00pm on Friday,   1   November, 2013 at Council’s Jones Street Depot, Ayr.

4.8.3 Any persons making inspections of the plant must report to the Workshop Superintendent or his representative and comply with Council’s Workplace, Health and Safety Standards, and in particular, wearing of closed in footwear.

4.8.4 The principal reserves the right to trade-in the existing vehicles or otherwise and the contractor shall have no claim against the Principal for loss of anticipated profit.

4.8.5 The vehicles allowed to be traded are also being offered for private sale in a separate quotation. However, when a vehicle is accepted for trade a “Tax Recipient Invoice” will need to be lodged at time of delivery of replacement vehicle.

4.8.6 The vehicles allowed to be traded in shall not be released until the replacement vehicles are fully in service.

4.8.8 The two-way radios and fire extinguishers and some ancillary equipment in the vehicles allowed to be traded-in are not included in the trade-in and will be removed by the Council or its nominated contractor.

4.9. Technical requirements

4.9.1 All vehicles shall be fitted with the following accessories:a) Front and rear mudflaps;b) AM/FM radio (minimum);c) Fully integrated air conditioning unit, using R134a gas for each vehicle;d) Power assisted steering;e) Factory fitted “Bluetooth”;f) 3M window tinting to all windows of the darkest legal tinting;g) Supply quantity of engine oil and fuel filters – to meet the maintenance service

intervals to 80,000km;h) A full tank of fuel

4.9.2 All vehicles quoted shall be current 2013 models and the successful Supplier shall supply vehicles fitted with 2013 compliance plates with the month of manufacture within six (6) months of date of official order by Council.

4.9.3 All petrol engine vehicles shall be compatible with use of ethanol blend fuel to a maximum blend of 10% (EI0) ethanol with unleaded petrol (ULP). Suppliers shall submit documentary evidence of this, together with vehicle warranties.

4.9.4 All vehicles shall be white.

4.9.5 Vehicle 1 – shall comply with the following:2WD Dual Cab Drop Side Body Utility – 4 cylinder diesel

a) Two (2) wheel drive;b) Diesel engine – turbo charged inter-cooled ;c) Nominal engine capacity – 4 cylinders;d) Vehicle shall have high clearance;e) Seating capacity for five (5) persons with bucket seat to front;f) Manual transmission;g) Steel radial ply tyres;h) Side steps as approved by Council’s Workshop Superintendent;i) Canvas type seat covers to all seats;j) Cab chassis type body with steel drop sides manufactured to a suitable standard as

approved by Principal. Paint shall be enamel with hardener. Tray floor shall be timber and suitably treated with oil. Body shall have a mesh type protection on the head board to protect the rear window. Clear tray length shall be the maximum allowable for the chassis and to meet Department of Main Roads regulations with a minimum internal clearance of tray width 1800mm;

k) Vehicle shall be fitted with the maximum rated “Hayman Reese” style tow bar suitable to the vehicle being supplied, also being a 50mm tow ball and 7 pin round trailer electrics with the tow ball to extend a minimum of 75mm past the rear tail gate;

l) Shall be fitted with two (2) rotating LED Roadvision flashing amber light (part number RB39VY 10v-30v), suitably fitted with protection to the highest point of the vehicle above the cab, power supply for flashing light to be connected directly to battery. The flashing lights shall be controlled by an illuminated switch in the cabin visible to driver;

m) Vehicle shall be fitted with hand wash water tank as approved by Council’s Workshop Superintendent.

4.9.6 Vehicle 2 – shall comply with the following:

2WD 1000kg Utility (includes canopy transfer) – 4 cylinder diesel

a) Two (2) wheel drive;b) Diesel engine;c) Nominal engine capacity – 4 cylinders;d) Seating capacity for 2 persons;e) Canvas type seat covers to all seats;f) Manual transmission;g) Steel radial ply tyres;h) The cab chassis type vehicle shall be fitted with the existing vehicle’s canopy. The

successful supplier shall remove and reinstall the existing canopy to the new vehicle that shall include: “Door Open’’ warning system; canopy central locking system; internal lights, external work light and LED flashing lights be connected directly to the battery. The flood light and flashing lights shall be controlled by separate illuminated switches in the cabin visible to driver. The successful supplier shall liaise with Workshop Supervisor as to the exact requirements of this canopy. The existing vehicle shall be left in a condition acceptable to Council after removal of the canopy;

i) Vehicle shall be fitted with the maximum rated “Hayman Reese” style tow bar suitable to the vehicle being supplied, with a 50mm tow ball and 7 pin round trailer electrics with the tow ball to extend a minimum of 75mm past the rear of the canopy.

j) Shall be fitted with a single rotating LED Roadvision flashing amber light (part number RB39VY 10v-30v), suitably fitted with protection to the highest point of the vehicle above the cab, power supply for flashing light to be connected directly to battery. The flashing lights shall be controlled by an illuminated switch in the cabin visible to driver;

k) Extra leaf/helper springs to rear springs;l) The successful supplier shall remove and reinstall the existing hand wash water tank

to the new vehicle under drop side body. The existing vehicle shall be left in a condition acceptable to Council after removal of the hand wash water tank.

4.9.7 Vehicle 3 – separate schedules are provided for diesel & petrol options and shall comply with the following:

successful supplier shall remove and reinstall the existing canopy to the new vehicle that shall include: “Door Open’’ warning system; canopy central locking system;

The flood light and flashing lights shall be controlled by separate illuminated switches in the cabin visible to driver. The successful supplier shall liaise with Workshop Supervisor as to the exact requirements of this canopy. The existing vehicle shall be left in a condition acceptable to Council after removal of the canopy;

m) Vehicle shall be fitted with the maximum rated “Hayman Reese” style tow bar suitable to the vehicle being supplied, with a 50mm tow ball and 7 pin round trailer electrics with the tow ball to extend a minimum of 75mm past the rear of the canopy;

n) Vehicle shall be fitted with hand wash water tank as approved by Council’s Workshop Superintendent.

4.9.8 Vehicle 4 – shall comply with the following:

4WD Dual Cab Utility (includes canopy transfer) – 4 cylinder diesel

a) Four (4) wheel drive;b) Diesel engine – turbo charged inter-cooled;c) Nominal engine capacity – 4 cylinders;d) Seating capacity of a minimum of five (5) persons with bucket seats for front;e) Canvas type seat covers to all seats;f) Manual transmission;g) Factory fitted cruise control;h) Option of fitment of a reversing camera, price shall be shown separately and to be

excluded from vehicle purchase price quoted;i) Long range fuel tank;j) Minimum 7.0” wide wheels with all terrain tyres;k) The cab chassis type vehicle shall be fitted with the existing vehicle’s canopy. The

a) Four (4) wheel drive;b) Diesel engine – turbo charged inter-cooled;c) Nominal engine capacity – 4 cylinders;d) Seating capacity of a minimum of five (5) persons with bucket seats for front;e) Canvas type seat covers to all seats;f) Manual transmission;g) Minimum 7.0” wide wheels with all terrain tyres;h) Cab chassis type body with steel drop sides manufactured to a suitable standard as

approved by Principal. Paint shall be enamel with hardener. Tray floor shall be timber and suitably treated with oil. Body shall have a mesh type protection on the head board to protect the rear window. Clear tray length shall be the maximum allowable

i) Side steps as approved by Council’s Workshop Superintendent;j) Extra leaf/helper springs to rear springs;k) Vehicle shall be fitted with the maximum rated “Hayman Reese” style tow bar

suitable to the vehicle being supplied, also being a 50mm tow ball and 7 pin round trailer electrics with the tow ball to extend a minimum of 75mm past the rear tail gate;

l) Shall be fitted with two (2) rotating LED Roadvision flashing amber light (part number RB39VY 10v-30v), suitably fitted with protection to the highest point of the vehicle above the cab, power supply for flashing light to be connected directly to battery. The flashing lights shall be controlled by an illuminated switch in the cabin visible to driver;

m) The successful supplier shall remove and reinstall the hand wash water tank to the new vehicle under canopy. The existing vehicle shall be left in a condition acceptable to Council after removal of the hand wash water tank.
