RSPCA Opening Day
The Draft Mackay Region Planning Scheme (Draft Scheme) was submitted to the Queensland Government to seek approval for adoption. This has been a significant project for Council's Development Services Department, reviewing a total of 404 submissions on the Draft Scheme raising 1,026 separate matters. It is anticipated that Council will receive notice from the State Government after the 'caretaker' period; put in place due to the State election to be held on 31 January 2015. We are also pleased to introduce new performance measuring tools within Development Engineering in accordance with Development Services' Client Service Charter resulting in positive feedback in relation to the way applications are managed. Average scores out of a maximum of 10 include 7.3 (time taken to decide an application), 8.1 (staff access and communication) and 9.3 (conditions meeting expectations). The number of development applications received in December increased approximately 40% compared to November 2014, however the overall December figure is less than the annual average. The number of engineering applications received are in line with November 2014 figures. Significant developments currently being assessed by Council include Evolution Estate State 3A (10 Industrial Lots, Paget), Allawah Estate (26 Residential Lots, Andergrove) and Everdream Estate Stage 1 (13 Lots, Rural View). The Health & Regulatory program successfully completed the feral pig control program over Christmas.

Performance against established performance goals is reviewed in the March, June, September and December (annual) issues of the Performance Management Report.
What is being measured?
The graph shows the number of attached dwellings approved in comparison to the number of detached dwellings approved. The number of attached dwellings approved to increase compared to detached by 2017/2018.
Management Commentary for current period
During the last quarter the number of dual occupancies/multiple dwellings dropped slightly. The trend is generally lower than the historical results. It is noted that the number of detached dwellings increased in the first two months of the quarter but has decreased in the last month of the quarter to be slightly less than the September quarter overall. This has resulted in an increase in multiple dwellings/dual occupancies as a proportion of housing stock compared to detached dwellings. However it is still a concern that the amount of housing stock trend line is continuing to decrease although the rate of decrease is slowing.

What is being measured? Local Law client requests are acknowledged to within 5 days, and completed within allocated timeframes by 2014/15. The above graph shows the number of requests responded to within 5 days. Management Commentary for current period The Local Law Team focuses on a wide range of services for both internal and external clients relating to animal management, overgrown properties, and abandoned vehicles. The results of the latest quarterly survey were positive and indicate a high response level to community complaints. The 85% response rate within 5 days has been maintained indicating that the dispatching process implemented over the last periods is seeing systematic improvements in response times.
What is being measured? All customers are moderately to extremely satisfied by 2014/15. The above graph shows the number of clients that are moderately to extremely satisfied with the service they have received. Management Commentary for current period Client satisfaction has remained steady at just over 80%. Compared to the same period for 2013 this demonstrates a significant increase in relation to client service satisfaction. Concerted efforts to further developing dedication to professionalism and responsiveness will see this satisfaction improvement trend continue in the future.

Development Engineering KPI Measures
Explanation
Development Engineering is requesting feedback from applicants after the Decision Notice is issued. The feedback sought, is aligned with Council’s Client Services Charter with the development industry and asks applicants to rate Council’s performance in three areas. These areas as follows:
1. Time taken to decide an application. 2. Staff being accessible and keeping the applicant informed and involved. 3. Conditions meeting applicant’s expectations.
What is being measured?
The graph shows the averages of the feedback responses for each month of the previous quarter as well as an overall average of all responses received for the quarter.
Management Commentary for current period
During the last quarter 22 feedback forms were sent out and 7 have been returned to Council.
The average score for applicants being happy with the time taken to decide an application was 7.3/10. The average score for staff being accessible and keeping the applicant informed and involved was 8.1/10.
The average score for conditions meeting expectations was 9.3/10.

Draft Mackay Region Planning Scheme
In December 2014 Council considered all properly made submissions made in response to the draft Mackay Region Planning Scheme (“Draft Scheme”) and advised submitters how Council has dealt with the submissions. The Draft Mackay Region Planning Scheme (‘Draft Scheme’) has now been submitted to the Deputy Premier and Minister for State Development, Infrastructure and Planning (DSDIP) to seek approval for adoption. A total of 404 submissions were received on the Draft Scheme, raising 1,026 separate issues. As the State Government entered the ‘caretaker’ period prior to the State elections, it is unknown when Council will receive notice from the State regarding the adoption of the Draft Scheme.

Status of Planning Bills and Ports Bill

FOCUS
Queensland Government elections On 7 January 2015, the Queensland Government announced an early election for 31 January 2015. The Queensland Government is now within ‘caretaker mode’, which prevents major decisions being made by the current government, including approval from the Minister to adopt the Draft Mackay Region Planning Scheme (Draft Scheme). Consideration of the Draft Scheme and outcome of its adoption will now be subject to the incoming Government. Consequently to the Queensland Government now entering caretaker mode, the Legislative Assembly has now dissolved with all current inquiries before Parliamentary Committees ceasing. This includes the ‘State Development, Infrastructure and Industry Committee’ (the ‘Parliamentary Committee’). On 25 November 2014 the following Planning Bills were introduced to Parliament:

The Planning and Environment Court Bill 2014 The Planning and Development (Consequential) and Other Legislation Amendment Bill 2014.
Prior to the election date for 2015 being confirmed, the Planning Bills were referred to the Parliamentary Committee for consideration. Public consultation on the Planning Bills was due to conclude on Monday 19 January 2015. The Planning Bills were set to replace the Sustainable Planning Act 2009 (SPA), which will directly influence Plan Making and Development Assessment across Queensland. The Port Bill 2014 was also referred to the Parliamentary Committee on 25 November 2014. The Committee invited public submissions on the Bill, which was due by 12 January 2015. As these inquiries have now ‘lapsed’ with the dissolving on of the Legislative Assembly, the continued inquiry of the Planning Bills and Ports Bill will be subject to a new committee.

Planning
The number of applications received in December increased about 40% compared to November. However the overall December figure is less than the annual average. The applications received in December were for one Dual Occupancies, two Multiple Dwelling developments totalling seven units, eight requests to amend conditions/extend currency periods, one Rural Sub-division, one Rural Boundary Realignment ( two lots per application) and three Urban Sub-divisions (two lots per application) as well as seven setback requests and two Dwelling House Overlay applications. In addition two gym applications and one Extractive Industry (Sand Extraction) were lodged in response to Show Cause actions. It should be noted that two of the Urban Subdivisions were lodged as fast-track applications in the Lagoon Estate area, West Mackay and were processed in better than the accelerated time frame of five business days. Applications of note finalised in December comprised two Extractive Industry Quarries, two Duplexes, a Gym at 17 Milton Street and the extension to Souths Suburban Bowls Club.

Value of Development The total value of approved construction work for December was $10,761,115 which is significantly lower than for December 2013 which was $15,237,550. The December 2014 total value was also slightly lower than the previous month which was $10,895,277.

Engineering
In December six Operational Works applications were received for December which was the same as the previous month. Development Engineering issued 8 approvals in December with 100% meeting the target timeframes. 19 Operational Works applications have been carried forward; these applications may be in an applicant’s information request response period, or a Council’s decision making period. The number of Survey Plans sealed in the month of December was 16 which is slightly lower from the previous month of November. 11 new Plan Sealing applications were received in December, those that have not have been approved for sealing are under assessment or awaiting the applicant’s response to Council’s Action Notice (Information Request). 28 Minor Works applications were lodged in December. During the month, 50 applications were approved with 12 carried forward.

Development Services performance against legislative timeframes
MCU Code & Impact The KPI’s for approval of Material Change of Use applications have been generally met except for Impact assessable applications for the month of December, with the following results:
MCU Code applications – 100% of applications were decided within 40 days, with the average timeframe being 16 days.
MCU Impact applications – 33% of applications were decided within 40 days, with an average timeframe being 62 days. The impact application performance was affected by two applications for Extractive Industries which were subject to the Submitter Presentation to Councillors process which impacted the statistics.

Reconfiguration of a Lot The KPI’s for Reconfiguration of a Lot applications have not been met for December, with the following results:
RoL applications – 100% of applications were decided within 40 days, with the average timeframe being 21 days.
It should be noted that two of the Urban Subdivisions were lodged as fast-track applications in the Lagoon Estate area, West Mackay and were processed in better than the accelerated time frame of five business days. This was one of the measures identified in the Focus on Development Project which has been implemented in December.

Operational Works The number of new Operational Works application received for December was 6. Out of the 6 new applications, 1 application is in the Decision Making Period, 4 applications are in Not Properly Made and 1 application is in the assessment stage. Overall timeframes for the month of December were or are going to be met.

Plan Sealing 16 plans were endorsed in the month of December with 11 new Plan Sealing applications being received. 100% of plans that were sealed were done so in the target 20 day timeframes.

Client Requests
The month of December saw a decrease of 12% in the number of new customer requests lodged when compared to the previous month. The decrease was noted across all teams in the Program. The numbers of customer requests lodged was below average across all service areas except for Environmental Services who received an above average number of customer requests. The number of completed requests within December remained steady at 532; this is the same as November. Local Laws Officers maintained the completion rate for abandoned vehicles customer requests for the month at 86% while Vector Control Officers achieved a 100% completion rate for vermin/fly control related customer requests. Pest Control Officers worked over the Christmas period to complete a feral pig control program. 101 pigs were destroyed and 1 feral dog. This is a major reduction in numbers and shows the program is having an impact on feral pig breeding numbers.

Monthly Infringements Activity
Total Infringements issued from 01 December to 31 December 2014 was 293.
This is a 58% decrease on the amount of infringements issued compared with the previous month. The entirety of this decrease occurred in the regulated parking area with Local Laws and Environmental Services infringements increasing in the month of December.
The reduction in regulated parking infringements is mainly due to disruption caused by City Centre Revitalisation works taking place with Officers using their judgement over the Christmas period to manage this.

Infringements Activity – Financial Year 2013/14 to date
Total Infringements issued from 01 July 2013 to 31 December 2014 is 10,112.
Total Infringements issued YTD 01 July 2014 to 31 December 2014 is 4,499.
A more rigorous enforcement process has seen the upward trend on infringements continue related to overgrown properties, dogs, nuisances and in particular regulated parking. This has resulted in the number of infringements issued for this period in 2014 more than doubling compared the same period last year.
