This responds to your Freedom oflnformation Act request of August 23,2010 for information pertaining to the Washington Post Media Leak and supplements our response of September 7, 2010.

Coordination has been completed with an element of this command and the records have been returned to this office for our review and direct response to you.

We have completed a mandatory declassification review in accordance with Executive Order (EO) 13526. As a result of our review, information has been sanitized as the information is currently and properly classified SECRET according to Sections 1.2(a)(2) and 1.4(c), of EO 13526. This information is exempt from the public disclosure provisions ofthe FOIA pursuant to Title 5 U.S. Code 552 (b)(l). The records have been reviewed, determined to be partially releasable and are enclosed. A brief explanation ofthe applicable sections follows:

Section 1.2(a)(2) of EO 13526, provides that information shall be classified SECRET if its unauthorized disclosure reasonably could be expected to cause serious damage to the national security.

Section 1.4( c) of EO 13 526, provides that information pertaining to intelligence activities, intelligence sources or methods, and cryptologic information shall be considered for classification protection.

Information has been sanitized from the records that are predominantly internal in nature, the disclosure of which would significantly risk circumvention of agency regulations or statutes. This information is exempt from the public disclosure provisions of the FOIA pursuant to Title 5 U.S. Code 552 (b)(2).

Since the release of some ofthe information deleted from the record would result in an unwarranted invasion ofthe privacy rights of the individuals concerned, this information is exempt from the public disclosure provisions of the FOIA per Title 5 U.S. Code 552 (b)(6).

The withholding ofthe information described above is a partial denial of your request. This denial is made on behalfofMajor General Mary A. Legere, the Commanding General, U.S. Army Intelligence and Security Command, who is the Initial Denial Authority for Army intelligence investigative and security records under the FOIA. You have the right to appeal this decision to the Secretary of the Army. If you wish to file an appeal, you should forward it to this office. Your appeal must be post marked no later than 60 calendar days from the date of this letter. After the 60-day period, the case may be considered closed; however, such closure does not preclude you from filing litigation in the courts.

Office of the Chief of Public Affairs (QG.PA), Pentagon was interviewed regarding His knowledge of the 3 Octot;ler 2001 article in the Washington Post. stated the guidance the Public Affairs Officers received specifically prohibited the discussion of troop deployment information; I b6 also stated that all Public Affairs Officers were sensitive to Operations Security issues and trained in handling media tricks used to gather news information. Also, ~-~~ stated that the Public Affairs Officers did not have acces·s to troop deployment information and therefore could not have leaked the information to the publ·ic. ( 4)

(U) e. te//N¥-t From 13 to 16 October 2001, sixty-three

individuals from the ODCSOPS, .the OCPA, , the Office of the General Counsel, the Assistant Secretary of the Army for Manpower and Reserve Aff~irs Office, the ~hief of Chaplains Office, the~ Secretary of the Army Office, the Inspector General [IG} Office, the Judge Advocate General Office, Military Office of special Operations, and various other Army agencies inside the Pentagon were interviewed regarding Their knowledge of the 3 October 2001 Washington Post newspaper article. Each interview provided no relevant information regarding the. source of the media leak. (5-

(C//N~ On 16 October 2001, I b6 lwas re-interviewed regarding His knowledge of the 3 October 2001 Washington Post newspaper article. j b6 jprovided two websites where press releases were located and stated that in both press releases there was no mention of the ioth Mountain Division deployment to ""Ex-Sov~et Republics". 3. (U) CASE TERMINATED: This case was terminated on 30 October 2001 because the number of individuals who were knowledgeable of the deployment information apparently numbered in the thousands and are spread nation-wide to include Fort Drum, Fort McPherson, Fort Bragg, Fort Campbell, and McDill AF8. Also, included in this list are the Joint Staff and the DOD Secretariats. There is no indication.from the interviews conducted that the information was compromised by a DA Staff/AOC member.

NCR MID's intent for the initial interviews is to identify the specifics of the compromise. We will not rursui leads until investigative authority is authQrized. COL b6 stated that if we identify the individual who leaked the information the Army CID and the Department of JUstice would conduct a criminal, not espionage, investigation.

NCR MID will be able to better identify the number of agents needed after these initial meetings on the 12th and will request augmentation from A Company if required. A Company has been notified of this possibility and is prepared to act. Subsequent interv'iews will be scheduled as needed. This timeline was briefed to COLJ b6 Jand he was satisfied as it meets the intent of the intervie~s in a timely enough manner.

2. (U) Sources did provide the following suggestions to improve OPSEC: Personnel need to be aware of their surroundings, some people forget how open the Pentagon can be; more SIPRNET would be useful because too much information goes through the unclassified email system; there should be more COMSEC monitoring to ensure people are only discussing the appropri~te things on the phone; people need to adjust to a war time mentality and keep things close hold--just don't discuss it at all; even an innocent comment can be compiled into classified information and OPSEC is best learned from leaders not bland, untimely briefings so they need to set a good ·example .
