Huffman, Cabinet Secretary dep.wv.gov RE: West Virginia Area Designations Under the June 2010 Sulfur Dioxide NAAQS In a letter dated March 29, 2011 to DEP's Division of Air Quality Director, John Benedict, the Air Protection Division Director of EPA Region 3 advised that initial state designations under the June 20 I 0 Sulfur Dioxide (S02) National Ambient Air Quality Standards (NAAQS) were required by June 3, 2011. The letter accompanied a related memo which provided detailed, but non-binding, guidance that states may consider in making their initial nonattainment and boundary designations. EPA suggests dispersion modeling as a tool for informing attainment decisions but acknowledges that it is not required, nor generally expected, for initial designations. DEP has primarily based its preliminary designations upon available monitoring and emissions data. Specifically, if a monitored county has data that indicates a violation during the period 2008-2010, it is listed as nonattainment, with the presumptive area boundary identical to the county boundary. Unmonitored counties that have cumulative major point source emissions below 100 tons per year are presumed to be attainment areas. The remaining counties are designated as unc1assifiable. The designations and related documentation are attached.
