As we head into the final full month of summer, I hope everyone had a chance to take some time off from the office this past month and spend the time with family. I also hope that those who attended the annual picnic enjoyed the new venue. Personally, I just re-turned from a 10 day trip out west where we toured Yellowstone and the Tetons. Arriving back just before deadline didn’t give me much time to put together much of an article (especially returning to a desk full of work) so I figured I would take advantage of the con-tinued relaxed month and share some vacation photos. I hope you enjoy them and I look forward to hearing about your summer adventures!

CAMP CLOSING LUNCHEON
The closing luncheon for CAMP 2016 was held on July 22 at the DCBA. The two months flew by for the students but they all had an excellent experience in their placements. We thank Royce Morris and Devin Chwastyk, chair and co-chair of EPOC and all of our sponsor firms. HONORABLE WILLIAM W. LIPSITT
AMERICAN INN OF COURT On Tuesday, March 22, 2016 the Honorable Wil-liam W. Lipsitt American Inn of Court and James S. Bowman American Inn of Court in Harrisburg, Pennsylvania, held an information session for stu-dents interested in becoming members of either Inn at Widener University Commonwealth Law School. This was the first such event for either Inn. Stu-dents enjoyed lunch while representatives from each Inn discussed the American Inns of Court, the focus of their respective Inns, and the benefits of Inn membership. Students were invited to submit a letter of interest and resume for consideration to the Inn of their choice. The Lipsitt Inn was founded five years ago and focuses on general litigation. The Bowman Inn was founded 22 years ago and focuses on the practice of state administrative law .

This is a formal sitting and men are encouraged to wear a dark, solid-colored suit jacket and a favorite tie. Colored shirts do photograph better than white in digital but a white shirt is fine under a jacket. Women are encouraged to wear bold, bright colors with sleeves to the elbow or long sleeves. Please avoid plaid, herringbone and pinstripe on your jackets as they do not photograph well on digital. Solid dark jackets are recommended for men, with a favorite tie. Ladies, as we don't have the same collection of colorful ties our male counterparts have, please do wear some color even if it's only a bright collar under a dark jacket. Color is flattering on skin tones of both men and women.

A
Memorial Service in honor of Attorney Edgar J. Casper was held in the Capitol Rotunda on August 1st. Ed was the architect of State’s Civil Service Commission’s modernization. He lived a very interesting life and will be remembered in Dauphin County by many who worked with him and knew him well.

PRO BONO Q&A
Q: What should I do if my client lies to the court? A: Call Sandy! Remember, as a pro bono lawyer you are not alone. Sometimes it helps to talk through the options. All attorneys (whether working on a pro-bono case or not) are required to uphold our ethical responsibility for candor to the court. According to Rule 3.3(a)(1), a lawyer shall not knowingly “offer evidence that the lawyer knows to be false”. http://www.pacode.com/secure/data/204/chapter81/s3.3.html Upon learning that a client provided false information, Rule 3.3(b) addresses a lawyer’s responsibility to take reason-able remedial measures; including directing the client to correct, petitioning to withdraw, and/or disclosing to the court. Comment (10) clarifies the required reasonable remedial measures:
The advocate’s proper course is to
1. Remonstrate [i.e., to say or plead in protest, objection, or disapproval; or make a forcefully reproach-ful protest] with the client confidentially,
2. Advise the client of the lawyer’s duty of candor to the tribunal, and 3. Seek the client’s cooperation with respect to the withdrawal or correction of the false statements or
evidence. If that fails, the advocate must take further remedial action. If withdrawal from the representation is not per-mitted or will not undo the effect of the false evidence, the attorney must make such disclosure to the court as is reasonably necessary to remedy the situation, even if doing so requires the lawyer to reveal infor-mation that otherwise would be protected by Rule 1.6 (Client Confidentiality).
Comment (11) emphasizes that a lawyer’s duty of honesty to the court supersedes that of the lawyer’s duty to the client even when disclosure can “result in grave consequences to the client, including not only a sense of betrayal but also loss of the case and perhaps a prosecution for perjury.”
But the alternative is that the lawyer cooperates in deceiving the court, thereby subverting the truth-finding process which the adversary system is designed to implement. See Rule 1.2(d). Furthermore, unless it is clearly understood that the lawyer will act upon the duty to disclose the existence of false evidence, the cli-ent can simply reject the lawyer’s advice to reveal the false evidence and insist that the lawyer keep silent. Thus the client could in effect coerce the lawyer into being a party to fraud on the court.
Finally, Comment 8 reminds us that the lawyer must have actual knowledge of the false information for Rule 3.3 to apply. A reasonable belief that evidence is false is not enough. Sandy Ballard, Esquire, Public Services Coordinator
