Introduction

This supplement to Rice Solar Energy, LLC (RSE) Application for Certification (AFC) for the Rice Solar Energy Project (RSEP) (09-AFC-10), responds to comments that California Energy Commission (CEC) Staff have made as a result of their data adequacy review of the AFC. The intention of this supplement is to provide all additional information necessary for Staff to find that the AFC contains adequate data to begin a power plant site certification proceeding under Title 20, California Code of Regulations and the Warren-Alquist Energy Resources Conservation and Development Act.

The format for this supplement follows the order of the AFC and provides additional information in response to the eight remaining Data Adequacy items in the areas of efficiency, electric transmission, waste management, and worker health and safety. Appended material is identified by the prefix “DA” indicating an item submitted in response to a Staff Data Adequacy comment, a number referring to the applicable AFC chapter, and a sequential identifying number. For example, an attachment in response to a Transmission System Engineering comment would be Attachment DA3.0-1, because the AFC section describing electrical transmission is Section 3.0. Appended material is paginated separately from the remainder of the document.

Each subsection contains data adequacy questions or information requests, with numbers and summary titles and, in parentheses, the citation from Appendix B, Title 22, California Code of Regulations (Regulations Pertaining to the Rules of Practice and Procedure and Power Plant Site Certification) indicating a particular information requirement for the AFC. Each item follows with the CEC Staff comment on data adequacy for this item, under the heading “Information required to make AFC conform with regulations” followed by a response to the information request and the information requested.

1. Steam Cycle Heat Rate (Appendix B (h) (4) (A)) Heat and mass balance diagrams for design conditions for each mode of operation.

Information required to make AFC conform with regulations:

Please state the steam cycle’s heat rate in Btu/KWh or KJ/KWh.

Response: Based on a net steam cycle efficiency of 38.7 percent (annual/shoulder average), the equivalent heat rate would be 8,817 BTU/kW-HR.

3.0 Electric Transmission (2–5)

2. Electric Transmission Facility Descriptions (Appendix B (b) (2) (C)) A detailed description of the design, construction, and operation of any electric transmission facilities, such as power lines, substations, switchyards, or other transmissions equipment, which will be constructed or modified to transmit electrical power from the proposed power plant to the load centers to be served by the facility. Such description shall include the width of rights of way and the physical and electrical characteristics of electrical transmission facilities such as towers, conductors, and insulators.

Information required to make AFC conform with regulations:

a) Please submit a Pole design diagram for dead-end structures of the generator overhead 230 kV tie lines showing configuration of insulators and conductors with their respective position measurements on the pole. Provide tie line conductor size, type and ampere rating.

b) Please provide the generator voltage rating (13.8 kV or 18 kV), since a discrepancy is observed between the description and the Figure 2.2-4.

c) Resubmit Figures 2.2-4 with the following:

1. Revised voltage ratings of the generator and the generator step-up transformer both low and high sides (high side shown as a single 161 kV instead of a dual voltage), if necessary.

2. Revised ampere ratings of low voltage bus ducts and generator breaker, if necessary.

3. Sizes and/or ratings of the short overhead conductors and/or cables between the generator step-up transformer high side and the 230 kV generator tie line take-off structures via the230 kV switchyard breaker.

d) Please Resubmit Figure 3.1-2 with 230 kV bus size, type and ampere rating.

Response:

a) Attachment DA3.0-1 is a pole design diagram for the dead-end structures of the generator tie-line.

b) The correct generator voltage rating is 18 kV.

c) Regarding Figure 2.2-4:

1. It is not necessary to revise the voltage ratings of the generator and generator step-up transformer low and high sides. The figure is correct.

2. The low voltage bus ducts and generator breaker ratings have been revised and are reflected in Figure DA3.0-2, which is a revised version of Figure 2.2-4.

3. Figure DA3.0-2 is a revised version of Figure 2.2-4 that correctly rates the bus duct sizes and ampere ratings of the short overhead conductors between the generator step-up transformer high side and the generator tie-line take-off structures.

d) Figure DA3.0-3 is a revised and corrected version of AFC Figure 3.1-2.

3. Alternative Route Map (Appendix B (b) (2) (D)) A description of how the route and additional transmission facilities were selected, and the consideration given to engineering constraints, environmental impacts, resource conveyance constraints, and electric transmission constraints.

Information required to make AFC conform with regulations:

Please submit a drawing showing the alternate route(s) of the proposed 230 kV generator tie lines to the MWD line or others and terminating point of interconnection.

Response: Attachment DA3.0-4 shows the alternative route to the MWD line.

4. Agency Contact (Appendix B (i) (2)) The name, title, phone number, address (required), and email address (if known), of an official who was contacted within each agency, and also provide the name of the official who will serve as a contact person for Commission staff.

Please provide the names, phone number, address and email address of the official contact person of each agency responsible to issue necessary permits.

5. Schedule for Permits Outside CEC Authority (Appendix B (i) (3)) A schedule indicating when permits outside the authority of the commission will be obtained and the steps the applicant has taken or plans to take to obtain such permits.

Response: The Western Area Power Administration System Impact Study underway and is projected to take approximately 90 days to complete. Western’s Facility Study will be

6. Phase I Environmental Site Assessment (Appendix B (g) (12) (A)) A Phase I Environmental Site Assessment (ESA) for the proposed power plant site using methods prescribed by the American Society for Testing and Materials (ASTM) document entitles “Standard Practice for Environmental Assessment Process” (Designation E 1527-93, May 1993), which is incorporated by reference in its entirety: or an equivalent method agreed upon by the applicant and the CEC Staff that provides similar documentation of the potential level and extent of site contamination. The Phase I ESA shall have been complete no earlier than one year prior to the filing of the AFC.

Information required to make AFC conform with regulations:

Please provide a Phase I ESA. A Phase I ESA is required for the site, which includes the project linears. There is no Phase I ESA or equivalent included in the AFC for the 10-mile long transmission line.

Response: Attachment DA5.14-1 contains a Phase I ESA Environmental Data Resources database report for the project’s transmission line.

7. Permits Required by BLM (Appendix B (i) (1) (B)) Tables which identify each agency with jurisdiction to issue applicable permits, leases, and approvals or to enforce identified laws, regulations, standards, and adopted local, regional, state and federal land use plans, and agencies which would have permit approval or enforcement authority, but for the exclusive authority of the commission to certify sites and related facilities.

Please add a discussion of permits required by BLM.

Response: As discussed in Section 5.6 (Land Use) of the AFC, the project will require a right-of-way permit from the BLM for portions of the electrical transmission line. RSE has applied for this right-of-way by filing form SF 299 and a Plan of Development with the Palm Springs office of the BLM (see also Table 5.6-7).

Manufactured Gas Plants: EDR Proprietary Manufactured Gas PlantsThe EDR Proprietary Manufactured Gas Plant Database includes records of coal gas plants (manufactured gas plants)compiled by EDR’s researchers. Manufactured gas sites were used in the United States from the 1800’s to 1950’sto produce a gas that could be distributed and used as fuel. These plants used whale oil, rosin, coal, or a mixtureof coal, oil, and water that also produced a significant amount of waste. Many of the byproducts of the gas production,such as coal tar (oily waste containing volatile and non-volatile chemicals), sludges, oils and other compoundsare potentially hazardous to human health and the environment. The byproduct from this process was frequentlydisposed of directly at the plant site and can remain or spread slowly, serving as a continuous source of soiland groundwater contamination.
