Date and Remarks Orders of the Tribunal Item No. 9 April 17, 2013 Vide our order dated 22 nd March, 2013, we had directed the issuance of Notice to the industries listed in Annexure 3 to the Affidavit filed by the State Pollution Control Board, Uttar Pradesh. In all Notice to 275 Units have been issued. This includes the 23 Units which are being dealt by the Tribunal separately as they have filed Applications and are affected by the interim directions issued by the Tribunal dated 15 th January, 2013. Their cases would be taken up on the respective dates already fixed. The remaining-252 Units shall be controlled by the following order/directions:- 1. Major steel, textile dyeing and chemical including pharmaceuticals industries operating in the District Ghaziabad and which are specified in the Annexure 3- that is from page 183 to 203, shall be inspected by the Joint Inspection Team and a Report shall be submitted to the Tribunal of site inspection, working

Orders of the Tribunal

Item No. 9 April 17, 2013

Vide our order dated 22nd March, 2013, we had

directed the issuance of Notice to the industries listed in

Annexure 3 to the Affidavit filed by the State Pollution

Control Board, Uttar Pradesh. In all Notice to 275 Units

have been issued. This includes the 23 Units which are

being dealt by the Tribunal separately as they have filed

Applications and are affected by the interim directions

issued by the Tribunal dated 15th January, 2013. Their

cases would be taken up on the respective dates already

fixed. The remaining-252 Units shall be controlled by the

following order/directions:-

1. Major steel, textile dyeing and chemical including

pharmaceuticals industries operating in the District

Ghaziabad and which are specified in the Annexure

3- that is from page 183 to 203, shall be inspected

by the Joint Inspection Team and a Report shall be

submitted to the Tribunal of site inspection, working

of the plant, functioning of the treatment plant as

well as the analyst reports. It shall be more

particularly in relation to the industries-that is M/s

Bhushan Steel, M/s Goodluck Steel, M/s Jindal

Steel, M/s Steel Strip Ltd., M/s Ghaziabad Forgings

and M/s Aditya Steel Industry.

2. The Member Secretary of the Uttar Pradesh Pollution

Control Board and Member Secretary of the Central

Pollution Control Board shall constitute more Joint

Inspection Teams in order to seek compliance of the

directions contained in this order.

3. The Industries, who are covered in the list of

Annexure 3 and upon whom the Notice have been

served, are granted liberty to file Applications-cum-

Affidavits stating the following:-

a. What business are such Units carrying on

b. What is their manufacturing process

c. Whether they have the treatment equipment plant

installed in their premises or not, if so, details

thereof.

d. Whether they have consent of the State Pollution

Control Board to operate, if so, they must annex

the consent order with their Application

e. When last inspection of their premises was

conducted by the representative of the Uttar

Pradesh Pollution Control Board and the test

Report.

f. If there is any sludge/hazardous waste by these

Units including its quantification, if so, whether

they have authorization under the Hazardous

Waste (Management, Handling and

Transboundary Movement) Rules, 2008.

Let these Applications/ Affidavits be filed within two

weeks from today.

Copy of all these Applications-cum-Affidavits shall

be provided to the learned counsel appearing for the

Pollution Control Board of Uttar Pradesh who shall take

instructions and ensure that the Senior Officer of the

Board who is familiar with all these cases be present in

Court with original records.

The original records of these Applications shall be

produced before the Tribunal for perusal.

We direct the State Pollution Control Board to put

the Annexure 3 on the website of the Board within two

days from today along with the copy of the order.
