    IMMIGRATIONDETENTIONFACILITIES:TheDepartmentofHomeland

    Security (DHS) is ultimately in chargeof immigrationdetention. The

    DHS subagency, Immigration and Customs Enforcement (ICE),

    manages enforcement actions, raids, arrests and the detention

    system.Eachfacilityhasdifferentvisitorandentrypolicies.

    While there are immigrationmanaged facilities,most immigrants are detained in county or

    localjailsorprivatecontractfacilities.

    Thedetentionfacilitiescanbe:

    TREATMENTOFDETAINEDPERSONSUNDERTHEDETENTIONSTANDARDS:

    LivingconditionsofdetaineesaregovernedbytheICEDetentionStandards.Theycovermedicalcare,accesstolegalcounsel,visitation,lawmaterials,telephoneaccessandothercriticalneedsofincarceratedpersons.

    PeoplearrestedbyICEwillfirstbeprocessedbyofficersinanICEDetentionandRemovalOffice

    toanotherplace fora longertermstay,oftenoutofstate.Somepeoplemaybe transferred

    severaltimesinthefirstfewweeks.

    Childrenmaybeplacedinchildprotectiveservicesifaparentisnotavailable.Thedetainedperson

    cangivelegalpowertosomeonetheytrusttomakeimportantdecisionsontheirbehalfwhilethey

    aredetained.Thisiscalledapowerofattorneyandvariesfromstatetostate.

    7. Iftheywanttohirealawyer,providethemwithreferralsoflawyersexperiencedindeportationdefense.Makesurethatthelawyerhasreviewedtheimmigrationchargingdocument,calleda

    1. ContacttheICEFieldDirectorofDetentionandRemoval:Ifyourorganizationwantstoadvocateonbehalfofcommunitymembersindetention,informtheFieldDirectorofyourorganizations

    involvementwithpersonsindetention.TheFieldDirectormanagesthelocalICEDetentionand

    Removaloffice(ICEDRO).

    Suggestedaction

    plan:

    MeetwiththeICEFieldDirectorandDROstafftoobtaindetailsofthearrestorraid RequestthatICEnottransferindividualstoanotherfacility.IfyoubelievethatICEplansa

    transfer,considercontactingattorneysandcivilrightsgroupstobringalawsuittostopthe

    Raisespecificmedical,humanitarianconcernsorabuseofdetainedpersonswiththeFieldDirectorandtheOfficerInCharge(deportationofficerinjail),ifOICexists.

    immigrationrunfacility,youwillhavetospeaktoanICEofficer.

    Afteryouaretransferred,telltheofficerthatyouneedtodiscussurgentpersonalmattersormattersrelatingtothatpersonscase.Dontlie. Iftheofficerrefuses,telltheofficertopassonamessagetotheappropriatepersonandthat

    he/sheneedstocontactyouimmediately.Dontforgettoprovideyourcontactinformation.
