(hereinafterreferredto as “THE ASSOCIATION”)
ARTICLE 1.00 - PURPOSE
A. It is the intent and purpose of thePartiesto this Agreement(hereinafterreferredto as“THIS. AGREEMENT’)to provide a basis for both partiesto improvetheprofessionaland academic services rendered to the students and taxpayers of the Division and topromoteandimprovetheworking relationsbetweentheBoardandtheAssociation,toestablisha salaryscheduleas providedfor in Section 2 of the Individual StatutoryContractandto regulateconditionsofemploymentresultingfrom theoperationof saidAgreement.
B. The spirit of this Sectionis that themembersof theAssociationwill at all timesdo theirbest to live up to thebestprofessionalspirit for which theAssociationstands,while onits part, the Board does its best to provide the climate to permit them to operateefficaciously.
ARTICLE 1.01 - INTERPRETATION CLAUSE
Wherethe singularor the masculineexpressionsare usedin this Agreement,thesameshall beconstruedas meaningtheplural or the femininewherethecontextso admitsor requiresandtheconverseshall hold asapplicable.

ARTICLE 2.00 - EFFECTIVE PERIOD
A. This agreementshallbecomebinding andtakeeffect as from thefirst day of July, 2006andshall remainin effectto June30, 2009andshallautomaticallyrenewitself thereafterfrom yearto yearunlesseitherpartygivestheotherwritten notice,by registeredmail, ofa desireto amendtheAgreement. This noticeshallbe givennotmorethan90 daysandnot lessthan30 daysprior to thedateofexpiryof thetermof theAgreement.
B. The new amendedAgreement shall becomeeffective as and from the ~ of Julyfollowing thegiving of noticeof adesireto negotiateanew oramendedAgreement.
C. This Agreement shall take cognizanceof any other Agreementsenteredinto by thepartiesheretoandattachedto this Agreement.
ARTICLE 2.01 . OBLIGATION TO ACT FAIRLY
TheDivision, in administeringtheAgreement,shall actreasonably,fairly, in goodfaith, andin amannerconsistentwith theCollectiveAgreementasa whole.
ARTICLE 3.00 - EDUCATIONAL QUALIFICATIONS
A. Theteachers’classificationandexperiencefor placementon thesalaryscheduleshall beestablishedby this CollectiveAgreementand:
1. A valid teachingcertificateissuedby theMinister ofEducation.
2. The classification accorded the, teacherby the Administration and ProfessionalCertificationsectionof ManitobaEducation,Training andYouth pursuantto TableI“Classificationof Certificates”of Regulation515/88 and as amendedfrom time totime, shallbeusedto determinetheclassin theSalaryScheduleto which the teacherbelongs,exceptasprovidedin ClauseB below.
3. For the purpose of classification, teacherswith a diploma in Industrial ArtsTeacher Education or a certificate in Vocational/Industrial Teacher Educationor with a Bachelorof Education while teaching a vocational program in a non-indentured area shall be placed one full classabove the classdetermined in A.2abovefor eachof thefollowing to a maximum of two (2) classes:
a) First year of a related technicalandlor vocationalcollegeprogram notusedto earn the classification in A.2. approved by theSuperintendentofSchools.

b) Secondyear ofa related technical and/or vocational collegeprogram notusedto earn the A classification in A.2. approvedby the SuperintendentofSchools.
c) Seriesof practical coursesnot otherwise usedfor classification, approvedby the SuperintendentofSchools.
B. Notwithstandingtheabove,Louis Riel Teacherswho wereemployedprior to June30, 2002by theSt. Boniface or St. Vital SchoolDivisions will not sufferany lossofclassificationorsalaryasaresultofthis article.
C. Teacherson aLimited TeachingPermit
Teachershired to teachon a Limited TeachingPermitshallbe placedon thescheduleonefull

ARTICLE 4.01 - PLACEMENT
A. PreviousExperienceForthepurposeofinitial placementon theSalarySchedule,experienceacquiredpreviousto employmentin theSt. Vital SchoolDivision orSt. BonifaceSchoolDivision or theLouis Riel SchoolDivision, as thecasemaybe, shallbe recognizedatthe rateofone

incrementfor eachcompleteyearof experienceasrecognizedby theCertificationandRecordsBranchofManitobaEducation,exceptthatexperienceon aLimited TeachingPermitor Authoritywill notbecredited.In addition, teachersofVocational programsshall be recognizedat therate of oneincrement for everytwo years ofrelatedjourneymantrade experiencein indentured trades,or for every two years ofindustry experiencein non-indentured fields, to a maximum offive (5) increments.
B. Increments
Following ateacher’splacementon theSalarySchedulein accordancewith Article 4.00,a teachershall advanceto thenexthigherstepon the salaryscheduleat therateof oneincrementuponcompletionoftheequivalentoftenmonths’ full-time teachingserviceasrecognizedby the Certification and RecordsBranch of Manitoba Education,untilmaximumis reached. The due datefor incrementsshall be thefirst day of theteachingmonthnextfollowing thecompletionofthis tenmonths’ teachingservice.
C. IncreasedOualifications
1. Where increasedqualifications are securedwhich qualify a teacherfor anadvancein classon thesalaryschedule,theonusis on theteacherto forwardthenecessarydocumentationto theSuperintendent’sDepartment.
2. For thepurposeof SectionC-i “documentation”shall beeithera statementfromtheTeacherCertificationandRecordsBranchof ManitobaEducationconfirminga higher classificationor evidencefrom an educationalinstitution confirmingthatcoursework hasbeensuccessfullycompleted.
3. . The resulting increasein salaryshall be retroactiveto the first of the monthfollowing receiptof documentationsignifying that therehasbeenan increaseinqualifications. However,the resulting increaseshallbepaidonly afterTeacherCertification and RecordsBranch of ManitobaEducation has confirmed thehigher classificationwith the exception of an increase in qualifications inArticle 3.00 A. 3, a-c.
D. Placement
1. On or aboutthelast teachingday ofSeptemberof eachyear,eachteachershall beprovidedwith a Statementoutlining theplacementof theteacher,as per Article3.00 of this Agreement,effectiveat thecommencementof that schoolyear. Theteachershall have twenty (20) teachingdays from the dateof receipt of theStatementto inform the Division in writing of any errors in the StatementofPlacement.Failure to inform theDivision within the twenty (20) teachingdaysshall bedeemedto be acceptanceofthe placementfor that schoolyear. Includedon the statementof placementshall be a notification of the consequencesof afailure to replyto perceivederrors.

2. Membershired after September30th will receive the above notice within 30teachingdaysafter commencementof teachingdutiesandwill have20 teachingdaysafterreceiptofnoticeto respond.
ARTICLE 4.02 - ADMINISTRATORALLOWANCES
School - BasedAdministrative Positions
A. Teachersin administrativepositionsshallreceiveasalarycomposedoftwo elements:
1. A basesalaryandplacementaccordingto Article 4.01of thisAgreement.
2. An administrativeallowancebasedon a formula,which determinestheclassificationof the school. The Division will designateor changethe classificationof a. schoolunderits jurisdictionbasedon thefollowing formula:

a. Thesumgeneratedby thecalculationwill classifytheschoolas:ClassA If thesumis 1.20 or lessClassB If thesumis greaterthan 1.20 to 1.80ClassC If thesumis greaterthan L80
b. Pupil Count is the total numberof studentsenrolled as of September30
th eachyearasverifiedby ManitobaEducationandTraining (with Kindergartenstudentscountedat0.5).
c. Staff count shall be expressedas actualcount of FTE adultswho work in thatschool. Theadultsinclude: ProfessionalStaff, Non-teachingstaff consistingof:assistantlibrarian, educationalassistants,community liaison worker, volunteercoordinator,interpreter/tutor,work facilitator, teacheraide, secretary,custodianandlunchsupervisors(.18 FTE).
Additional countis asfollows:1. 1.0FTE for schoolswith specialprogramstaff,2. 1.0FTE for schoolswith daycaresandbeforeandafterschoolprograms3. 1.0 FTB for preschoolandparentingcentres,and4. 1.0 FTh for schoolswith supervisors.
d. Notwithstandingthe above,the Louis Riel Arts andTechnologyCentreshall beclassifieda“C” school.
e. The PrincipallVice-Principalwill be notified by theendof November,the statusof his/herschool’sclassificationincluding thedatausedin thecalculations.
f. Salaryadjustmentswill be effectiveNovember1st

g. An allowanceequalto one-twelfth(1/12) of theannualAdministrator’sallowanceor increasein allowancewill be paidin casesof appointmentsto administrativepositions. Thiswill not applyto lateraladministrativepositionmovements.

Division-BasedAdministrative Positions
Supervisor SecondmentPositions
A. A teacherappointedby theDivision to a supervisor position shall receiveanallowancein addition to his/her basesalary accordingto Article 4.02 of thisAgreement.
B. The allowancefor a supervisor position shallbe thesameastheallowancepaid to aVice-Principal ofa “C” school.
C. The secondmentshall be for a 3-yearterm.
Coordinator SecondrnentPositions
A. A teacherappointed by theDivision to a coordinator position shall receiveanallowancein addition to hisor her basesalary according to Article 4.02of thisAgreement.
B. The allowancefor a coordinator positionshall be the sameasthe allowancepaid to aVice-Principal of a “B” school.
C. The secondinentshall be for a 3-year term.
Director Positions
A. ‘ A teacherappointed by the Division to the positionofDirector of StudentServicesorDirectorofSchoolandCommunity Supportshall receivean allowancein addition tohis or her rate ofpay.
B. The allowancefor theposition ofDirectorof StudentServicesor Director ofSchooland CommunitySupportshallbe thesameas the allowancepaid to a Principal of a“C” schoolas provided for in Article 4.02ofthe CollectiveAgreement.

C. If theDivision decidesto discontinuethe positionDirector ofStudentServicesandlorDirector ofSchooland Community Support,the Director will have his or herallowancemaintained for period of one(1) year.
ARTICLE 4.03 - LEADERSHIP POSITIONS
A. A teacherappointedby theDivision to be a departmentheador aconsultantshallreceivethefollowing allowancein additionto his or herrateofpay.

ARTICLE 4.04 - ADMINISTRATIVE GUIDELINES
A. A teacher’s main responsibility in an administrative or supervisory role is that of aprofessionalleader.
B. The Division hasthe authority andmanagerialresponsibilityto consideradministrativecost,sizeandeffectivenesswhendeterminingtheappointmentofaPrincipal.
Notwithstandingtheabove,theDivision will ordinarily appointone (1) Principal to one(1) schoolbuilding.
C. Vice-Principalsmaybe appointedat thediscretionof theDivision. Thedutiesof aVice-Principal will be determinedby the Principal of the school in consultationwith theSuperintendent.
D. Special ‘considerationfor additional administrative support shall be given .by theSuperintendentto schoolswith specialsubject,programandadministrativeneeds.
E. If theDivision decidesto discontinuethe position of Vice-Principalin a school for thefollowing schoolyear, the Vice-Principalwill havehis/herallowancemaintainedfor aperiodof one(1) year.
F. If anAdministratoris transferredatthe requestof theDivision to anotherPrincipalshipora Vice-Principalshipwhich results in a lower allowanceunder Article 4.02, his/herallowanceshall not be reducedfor a periodof two (2) schoolyears following his/herassumptionof duties in thenew assignment. At theend of thetwo (2) yearperiodthesalarywill be adjustedin accordancewith thesalaryscheduleoutlinedin Article 4.02.

ARTICLE 4.05 - DESIGNATED TEACHERS
A. Foreachschool,a teachershall be designatedby theDivision to actasPrincipalduringthe absenceof the Principal (where there is no Vice-Principal), or when both thePrincipalandVice-Principal(s)are absent.
B. Effective the 1stday of theFall Term 2006,the designatedteachershall receiveeighthundred ($800)dollars per year to act as the designate.
C. In circumstanceswhere the Principal, Vice-Principal(whereappointed)and designatedteacherareall absentfrom the school for one-half(1/2) a schoolday or more, thenthePrincipalwill appointa teacherto actingPrincipalandsuchpersonwill receiveeffectivethe
1St day of theFall Term2006, seventy-five($75.00)dollars per occasionfor such
duty.
ARTICLE 4.06 - PART-TIME TEACHERS
A. Teachersemployedundercontracton a part-timebasis shall be paid accordingto theirqualificationsasestablishedin Article 3.00 andat aratebasedon thefraction ofthe timeemployed.
B. Part-timeteachersshall participatein school activities that occur during the regularschoolday whenrequestedby the Division. When the Division makessuchrequestspart-timeteachersshall receivea pro-ratashareof their annualsalaryratefor the timespentparticipatingin theactivitiesoverandabovetheregularlyscheduledteachingtime.
At theDivision’s discretiontime in lieu ofsalarypaymentmaybe given.
C. During eachschoolyeartheDivision shall requesteachpart-timeteacherto participateon a minimumof five (5) occasionsin parent-teacherconferences,in-serviceor otherprofessionaldevelopmentactivities. Theschedulingof theseoccasionsshall be arrangedby theprincipal.in consultationwith theteacher.
Under extenuatingcircumstancesthe Division and teachermay agreeto waive thisrequirement.
D. Part-timeteachersemployed for less than the full school year shall be requestedtoparticipateon thebasisofthepro-ratednumberofdesignateddaysduring their periodofemployment.
ARTICLE 4.07 - SUBSTITUTE TEACHERS
The Division, in administering Article 4.07,shall act reasonably,fairly, and in goodfaith.
The provisions of the Collective Agreement do not apply to substitute teachersexceptas
expresslyprovided for in Article 4.07 — Substitute Teachers.

B. A substitute teacheris employedby theDivision onan irregular, day to day basistoeither replacea regular teacheror fulfill an assignmentwhich is normally lessthantwenty (20) consecutiveworking daysin duration.
C. A period of substitute teaching ofat leastfive (5) consecutiveworking daysin thesameassignmentshall be termed extendedsubstitute teaching.
D. A substitute teacherwho assumestheteachingworkload of a teacherfor six (6)consecutiveschooldaysor more, shall be paid at the rate ofsuchfraction (calculatedto three decimalplaces)asone day out ofthenumber of teachingdays prescribedbytheMinister for the Schoolyear of his or her classification accordingto thequalifications and experienceunder Article 4.00, retroactive to thefirst day ofcommencementofsuch continuousservice.
Where a substitute teacher is authorized bythe Principal to be absentfrom workwithout pay, thesubstitute shall retain the saidrate ofsuchfraction asone day is thenumber ofteachingdaysprescribed by theMinister for theSchoolyear ofhis/herclassification provided that the substitute returns to the sameassignmentfollowingtheleaveand provided the number ofdaysofauthorized absencedoesnot exceedfive(5) teachingdays in any schoolyear.
E. Manitoba Teachers’Societyfeesshall be deductedfrom a substitute teacher’spay inaccordancewith theguidelinesestablishedby theManitoba Teachers’Society.
Louis Riel Teachers’Associationfeesshall be deducted and remitted from asubstitute’s pay monthly. Thesefeesshall be prorated on thebasisof the number ofdaysworked in a givenmonth.
The Associationshall indemnify and saveharmlesstheDivision from any and alllosses,costs,liabilities or expensessuffered or sustainedby the Division as a result ofany claim or legal action arising from the deductionof Manitoba Teachers’Societyfees.
F. A substitute teacherwho has beenemployedfor at leastnine (9) consecutivedays ofextendedsubstitute teaching in a schoolyear shall be entitled to one(1) day of sick
A. Effective the date of signing of this collective agreement,teachersshall be as follows:

leavewith pay for eachnine daystaught in that assignment.Sick leaveshall notaccumulatefrom assignmentto assignment.
G. The useofa sick leaveday with pay shall not constitutean interruption of theextendedsubstitute teachingassignment.

I. The only matters which maybe grieved under the SettlementofDifferencesarticle bya substitute teacheror theAssociationon behalf of a substitute teacherare theprovisions of this article, thoseOther provisions oftheCollectiveAgreementreferencedin Article 4.07and the substantiverights and obligations of employment-related and human rights statutesto the extent that they are incorporated into thiscollective agreement.
J. A substitute teacherwho is calledfor ahalf dayassignment,who reports, and whofinds that his or her servicesare not required shall be paid a half day’s pay forreporting for duty.
K. If thesubstitute teacherhas beencalled in for a full day assignment,he or sheshall bepaid afull day’s pay for reporting for duty.
L. In theevent ofan emergencyclosureof a schoolor early dismissalfor emergencyreasons,substitute teacherswill be paid full pay at theapplicable rate ofpay.
M. A substitute teacherwho has beenemployedfor at leasttwenty (20) daysin the sameassignmentshall, on the twenty-first (
21St) day, be signedto a Limited Term Teacher -
Generalcontract, unlessthe return of theregular teacheror the conclusion of thesubstitute assignmentwill occur within five (5) working days.
N. Unlessotherwise determined at the time of theassignment,or exceptin unforeseencircumstances,thetimetablefor a substitute teacherin any assignmentshall normallybe thesameas the timetableof theteacherwho is being replaced.

0. No substitute teachershall be assignedduty prior to thecommencementof classonthefirst morning ofan assignmentor prior to the afternoonclasson the first day, if itis a half-day afternoonassignment.
ARTICLE 4.08 - POSITIONS NOT COVERED BY TilE COLLECTIVE AGREEMENT
A. Shouldthe Division from time to time establishpositions for which job titles are notincluded in the Collective Agreement, the Division shall notify the Associationof itsintentionto employindividual(s) in suchposition(s)andshallenterinto negotiationswiththe Associationfor thepurposeof establishingtherate(s)ofpay prior to suchposition(s)beingfilled.
B. Wherethereis a disputebetweenthepartieswith respectto theratesof pay for suchposition(s),thedisputeshall be deemedto be adifferencebetweenthepartiespursuanttoArticle 20.00 of the Collective Agreement.
C. Wherethereis a disputebetween the parties as to whether the Division hasestablishedaposition for which a job title is not included in the Collective Agreement,the disputeshall be deemedto bea differencebetweenthepartiespursuantto Article 20.00of theCollectiveAgreement.
ARTICLE 5.00 - METHOD OF PAYMENT
Thesalaryof ateachershallbe paidaccordingto thefollowing:
A. Salarypaymentsshallbe mademonthly on a twelve(12)paymentbasis.
B. Theamountofpaymentshallbe determinedby dividing theannualsalaryratein effectby twelve(12).
C. When by reason of changes in the terms of this agreement the salary of a teacher ischanged,the new salaryshall be paid not later than the month following the dateofsigning of this agreement andany retroactiveadjustmentsshallbe includedin the salarychequefor thatmonth.
D. The July and August salary payments shall be deemed to have been earned in theimmediately preceding school year. Thus teachers shall have their total salaryentitlementsdeterminedon an equitablebasisfor theschoolyearin accordancewith thesalaryschedule(s)in effect duringthat schoolyearendingJune30th~
E. Thesalaryof a teachercommencingemploymentotherthan on thefirst teachingday oftheschoolyearshallbe calculatedasfollows:
1. In the first month of employment, the salary to be paid shall be such fraction(calculated to three (3) decimalpoints) ofthesalaryfor thewholeschoolyear,asthe

numberof teachingdaysemployedin that monthis of thenumberof teachingdaysprescribedby theMinister for thatschoolyear.
2. Thereafter,the monthly installmentsshall be suchfraction (calculatedto three(3)decimalpoints)ofthesalaryfor thewholeschoolyearas thenumberof teachingdaysemployed for the balanceof the school year is of the numberof teachingdaysprescribedby the Minister for the school year,divided by the numberof monthsremainingto June
30th next, or the terminationof the teacher’sindividual contract,
whichevercomesfirst.
F. Whereateacherleavestheemployof the Division during thecourseof theyear,thefinalpaymentshall be so adjustedthat theteachershall receive,for thepartof theschoolyearemployed,suchfraction (calculatedto three(3) decimalpoints)of thesalaryfor thewholeschoolyearas the numberof teachingdaysemployedis of thenumberof daysprescribedby theMinister for thatyear.
G. Monthly salarypaymentsshall be madenot later thanthe third (3
rd) day prior to the lastday of themonthor on the last teachingday, whichevercomesfirst. Paymentsin respectto July and Augustshall bedepositedin theteacher’saccounton thelast teachingday ofJune.
H. DirectDepositof Salaries
1. The Division shall only be requiredto depositthe salary funds to one designatedfinancialinstitutionperteacher. For purposesof clarity, a teacherwill notbe allowedto designatea certainportionof their fundsto bepaid to onefinancialinstitution andthebalanceto another.
2. Any administrativecosts due to a changein g designatedfinancial institution, inexcessof one(1) peryear,shallbe borneby theteacherwhorequestssucha change.
3. Individual teachersshall not havethe right to requestexemptionsfrom havingtheirsalariessodeposited.
ARTICLE 5.01 - EMPLOYMENT INSURANCEREBATE
WhentheDivision is receivinga premiumreductionundertheEmploymentInsuranceAct then,whereapplicable,thefollowing will apply:
A. TheDivision shallrefundto theAssociationtheteachers’portionof thepremiumrebateallowableundertheEmploymentInsuranceAct twice ayear,at theendof Decemberandtheendof June. TheJunerebateshall includethepremiumrebatefor themonthsofJulyandAugustof thatyear.
B. Further,the Division shall refundto theAssociation,the whole of theadditional rebateallowableundertheEmploymentInsuranceAct, to theShort TermDisability Plan.

ARTICLE 5.02 - INTERESTON RETROACTIVE PAY
A. TheDivision shall pay the teachersof the Association,interest on thegrossamountofany retroactive pay which may be paid to such teachers less the amount of any statutorydeduction for Canada Pension, Employment Insurance and Income Tax due with respectto that pay. The interest is to be calculated from the dates which the monieswould havebeendueon a monthly basis, to the date of the actual payment.
B. Theinterestshall be computedat the lesserof 9% per annumortheaveragerateatwhichtheDivision borrowsfundsduringthe twelve(12) monthperiodprecedingthecalculationdate.
C. If theDivision hasnotborrowedfunds during theprecedingtwelve (12) monthperiod,then interest shall be calculatedat the ratepaid by the CharteredBanks of CanadainWinnipegon theirpremiumratesavingsaccounts.
ARTICLE 5.03 - PAYROLL DEDUCTIONS
A. One-tenthof annualfeesdue to theManitobaTeachers’Societyby theteachersof theLouis Riel Teachers’Associationshall be deductedfrom eachof thesalarychequesfromSeptemberto Juneinclusive, in accordancewith the currentscaleof fees andshall beremittedto theManitobaTeachers’Societyoffice eachmonth.
B. One-halfof the annualfeesdue to the ManitobaTeachers’Society Council of SchoolLeadersshallbe deductedfrom eachofthesalarychequesof participatingadministratorsin SeptemberandOctoberin accordancewith thescaleof feesandshall be remittedtotheManitobaTeachers’Societyin eachofthemonths.
C. The annualfeesdueto theLouis Riel Teachers’Association(LRTA) shall be deductedfrom theOctoberandNovemberchequesin two equalportionsandforwardedin careofthe Association’s Treasurer.The Association will, prior to June
30th, inform the
Secretary-Treasurerasto theamountofthededuction.
D. The annualfees due to theLouis Riel Associationof SchoolAdministrators(LRASA)shall be deductedoncein Octoberfrom thesalarychequesofparticipatingadministratorsand forwardedin careof theLRASA Treasurer. LRASA will, prior to September
30th
inform theSecretary-Treasurerasto theamountof thededuction.Administratorswishingto write themselvesout of theLRASA will notify theDivision in writing by September
15th ofeachyear.
E. TheAssociationshallindemnify andsaveharmlesstheDivision from any andall losses,costs,liabilities or expensessufferedor sustainedby theDivision as aresultof anylegalaction arising from the deductionof .the LRASA fees provided;however, should theAssociationso require,it shall be permittedto takeover and conductsuchlegal actionandmakesuchsettlementthereofasit shall seefit.

ARTICLE 6.00 - SICK LEAVE
A. It is agreedby thepartiesthatsick leaveentitlementshall onlybe grantedby theDivisionwhereateacheris unableto beatwork andperformhis orher regulardutiesas a resultofillnessor injury.
B. Sick leaveis not payableto a teacherwho is engagedin any employmentfor a wageorprofit during any period for which he or sheclaims benefitsunder the Division’s sickleaveplan.
C. Sick leaveis notpayableto ateacherwhoseillnessor injury resultsfrom amotorvehicleaccidentandis receivingwagelossreplacementbenefitsfrom ManitobaPublic Insurance(MP1) to the extentthat suchbenefitsand paid sick leaveexceedthe, teacher’snormalsalary. In suchcasesthe teachershall reimbursethe Division the amountof benefitreceivedfrom MPI.
D. A full-time teacherwho is undercontractto theDivision as ofthefirst (1st)day ofthefallterm shall be credited with twenty (20) days sick leave (subject to a maximumaccumulationof 124 days)on that dateexceptthat anewemployeemustactuallyteachforat leastone day beforeany sick leavedaysarecreditedto this.teacher.A full-time teachercoming undercontractat a later datein the schoolyearshall be creditedwith a pro-ratashareof twenty(20) days,calculatedto theclosestwhole day. A regularpart-timeteacheris entitled to apro-ratashareof twenty(20) dayssick leaveper yearandtheprincipleofaccumulation,andthe total to be accumulated,appliesasto afull-time teacher.
Notwithstanding the above, a teacher who reduces his or her contract time andsubsequently accessesthe Disability Benefits Plan and is penalized by suffering areduction in pay that she or he would not have suffered had his or her sick leavecredits not been converted,will be treated asif’ his or her sick leavecredits were notconverted.The maximum conversionshall not exceedthe required dayssetout in theDisability Benefits Plan.
E. Unusedsick leaveshall accumulateto amaximumofonehundredandtwenty-four(124)days. In eachyearofemployment(i.e. schoolyear)thenumberofsick daysusedshall bededucted from the total accumulation. The first day of the fall term, twenty (20) daysshall be addedto that total, to a maximumof onehundredandtwenty-four(124)days.
F. Teachersemployedon afixed termcontractshallbe entitledto sick leaveduringthetermof thecontractunderthesametermsandconditionsas a teacherregularlyemployedbythe Division. Sick leaveshall accrueto a maximumof one hundredand twenty-four(124) days,whena teacheris employedby the Division on successivetermcontracts.Contractsshallbe deemedto be successivewhen:
1. A teacheris employedundermorethanonetermcontractin a schoolyear;
2. Theinterruptionbetweentermcontractsis lessthanaschoolyear.

G. Teachersemployed on a part-timebasis who have a Form 2, Teacher General, orLimited Term Teacher-Generalcontract, with theDivision shall be grantedsick leavewith paypro-ratedbasedon full-time equivalence.
H. Sick leaveshall not continueto accruewhile on any leaveof absencewithout paywith the
exceptionofArticle 6.05 B.3.
Each teachershall benotifiedat theNovemberpay periodof his orher totalaccumulation.
In thecaseof a lengthyorrecurringillness,a teachermayapply for specialconsiderationwherebytheDivision maypay that teacher’ssalaryuntil he or sheis eligible for benefitsunderEmployment Insuranceor Disability Benefits Plan or’ such lesserperiod astheDivision maydecide.
K. On-The-Job-Injury. Whenateachersuffersan on-the-job-injuryandis absentfrom workasaresultofthatinjury, theDivision shall continueto paythesalaryof that teacherduringsuchabsence,limited to theextentof the accumulatedsick leavebalanceat the time ofsufferingthe on-the-job-injury. Theperiodof time absentfrom work as a consequenceofan on-the-job-injuryshall notbe chargedagainsttheaccumulatedsick leavebalance.
The Division mayreimburse out ofpocketexpensesincurred by theteacheras aresult ofan on-thejob injury to a maximumof onethousand dollars ($1000)perschoolyear wherethat teacherhas certain expensesbeyond themaximum coverageprovided for in the ExtendedHealth Plan or incurs certain expensesrelated tomedical itemsnot coveredby theExtendedHealth Plan and wheresuchexpensesarenot coveredby another Party or Plan.
In accordancewith administrative guidelinesthe Division shall reimburse teachersfor the above-mentionedexpenses(e.g.drug costs,physiotherapy, etc.)for a period ofup to twelve (12) months following the injury or accident.
“On-the-job-injury” meanSadisability resultingfrom an accidentor injury occurringin thecourseofperformingdutiesarising out of employment under contract with the Division.
L. TheDivision shall providefull sick leaveentitlementto apregnantteacherwho, asa resultof her condition either beforeor after delivery, is unableto beat work andperformherregular duties for a valid health-related reason(s). The pregnantteachershall followcurrentproof of claim proceduresfor sick leave entitlement as may be required by theDivision.
M. TheDivision shall indemnify and saveharmlessthe Association from any and all losses,costs,liabilities or expensessufferedor sustainedby the Associationas a result of anylegal action arising from the wage loss replacementbenefit from MPI (Article 6.00 C);however, shouldtheDivision so require,it shall be permittedto takeoverandconductsuchlegal actionand makesuchsettlementthereofasit shall see fit.

ARTICLE 6.01 - MATERNITY. ADOPTIVE AND PARENTAL LEAVE
The effectivedateofparental leaveprovisions is January 1, 2007.
A. Every female teachershall be entitled to maternity leave and every teachershall be
entitledto adoptiveand parentalleavein accordancewith this article.
B. Everyteachershallbe entitledto unpaidparentalleave.
C. Exceptas otherwiseprovidedherein the Manitoba EmploymentStandardsCode willapply.
D. The teacherand the Division maymutually agreeto extendthe lengthof leaveif theteacherso desires.Any sucharrangementsshall beconfirmedin writing by theDivision.
E. A teachertakingmaternityleavepursuantto this article shall be entitledto receivepayfor theperiod,of leaveup to seventeen(17) weeksin theamountof ninety percent(90%)of thesalarybeingreceivedat thetime leavewastaken,this payto include any benefitsreceivedfrom HumanResourcesDevelopmentCanadato aSupplementalUnemploymentBenefits (SUB) Plan. The implementationof this clauseis subjectto the successfularrangementof a SupplementalUnemploymentBenefits Plan with Human ResourcesDevelopmentCanada.
F. In respectof theperiodof maternityleave,paymentsmadeaccordingto theSUB Planwill consistofthefollowing:
1. For thefirst two (2) weeks,paymentequivalentto 90%percentof her grosssalary,and
2. Up to fifteen (15) additionalweekspaymentequivalentto thedifferencebetweentheEmploymentInsurancebenefit theteacheris eligible to receiveand90% ofher grosssalary.
0. A teachertaking parental or adoptive leaveshall receivepay for the period ofleaveup to ten (10) weeksofpayment, equivalent to the difference betweenthepaymentfrom HRDC and 90% of his/her salary. The tenweeksincludes any waiting periodrequired for employmentinsurancebenefits.
H. Thepartiesagreeto the following applicationrules,termsandconditions:
1. The maternity leave periodwhich is eligible forpaymentunderthisArticle is the firstseventeen (17) weeks (the two (2) week waiting periodand thenextimmediatefifteen(15) weeks).
2. Whereany portionof theseventeen(17) weeksreferencedin (1) abovefalls duringthe SummerBreak, ChristmasBreak, Spring Break, or any other period when the

teacher is not earning her salary, that portion of the maternityleaveperioddoesnotqualify the teacher to receive maternity leave top up benefits.
3. A specific application or registration for a Supplemental Unemployment BenefitsPlan’ is not required. The only requirementfrom Human ResourcesDevelopmentCanadais that the commentssectionof theRecordof Employmentconfirming thatSection38 oftheEmploymentInsuranceRegulationsaremet.
4. Teachersmust be under contractto theDivision during the period whenmaternityleave top up benefitsmaybe paidby theDivision in orderto be eligible to receivethosepayments.
5. Thequalifying periodof seventeachingmonths mustbe sevenconsecutiveteachingmonths in the employ of the Louis Riel School Division, as per the ManitobaEmploymentStandardsCode. The full seven(7) monthsqualifying periodmustbeservedin order to qualify for any maternityleavepayment. For greatercertainty,should a teacherfail to serve the full qualifying period prior to the start of thematernityleave, then that teachershall be eligible to receivematernityleavetop upbenefitsonly for that portion of the seventeen(17) weeksreferencedin (1) abovewhich occursafterthecompletionoftheseven(7)monthqualifyingperiod.
.6. The Division requires,from eachof theteacherson maternityleave, a copy of theStatementof Finalized Employment InsuranceBenefits in order to accuratelycalculateher entitlement. This is a documentwhich theteachershouldhavereceived(orwill receive)from EmploymentInsurancefour to six weeksfrom thedatethat sheappliedfor EmploymentInsuranceBenefits. Shouldpaymentsto teachersberequiredprior to receiptof the Statement,anestimateof thecorrectentitlementwill be madewith an adjustmentmadefollowing receiptoftheStatement.
ARTICLE 6.02 - RELIGIOUS LEAVE
A. A teacherundercontractshall be given leaveof absenceup to a maximumof three(3),daysper schoolyearwithout loss of pay for majorreligiousholy daysobservedby theteacheranddesignatedas a dayof obligationby theteacher’sreligion.
Teachersshallnot absentthemselvesfrom duty for reasonsofreligiousholy dayswithoutfirst notifying theSuperintendentor designate.
Thefollowing notificationperiodshall apply:
1. Teacherson staff requiringreligious holy leavesduring theschoolyearshall providenotice in writing on the prescribedform as soonas possibleafter the start of theschoolyearhowevernot laterthanSeptember
30th~
2. In instanceswherereligious holy leave is requiredprior to September30
th in theschoolyearnotice shall be given within ten (10) working days after thestartof the

schoolyear,unless the holy day falls within the first ten (10) working daysof theschoolyearwherethenoticeshall notbe lessthanfive (5) working days.
3. Wherethe appropriatenotice has not been given, religious holy day leavewill beprovidedandthesubstituteteacherratewill be deductedfrom theteacher’sregularsalaryin the teacher’ssalaryclassification.
B. Thepartiesagreethat thisarticleconstitutesreasonableaccommodationfor religiousholyleave.
ARTICLE 6.03 - RELEASE TIME FOR MANITOBA TEACHERS’ SOCIETY BUSINESS
A. A teacher, being a member of the Manitoba Teachers’SocietyExecutiveCommittee,orof the Executive Committee of the Louis Riel Teachers’ Association, or of any specialcommitteeof theSociety,orbeingappointedrepresentativeor delegateof theSocietyorof the’Association,andbeing authorizedby theExecutiveCommitteeof theSociety toattenda meetingof the Committeeof which the teacheris a member,or to act as arepresentativeor delegateof the Society or of theAssociationin a matterof SocietyBusinessrequiring absencefrom school,shall havetheright to attendsuchmeetingsor toact as suchrepresentativeor delegateand shall be excusedfrom schooldutiesfor suchpurposeson not morethan a total of five (5) teachingdaysin any schoolyear,providedthat a substitutesatisfactoryto theDivision canbe securedandthat thecost of providingsaid substituteis assumedby the Society and shall not be a chargeuponthe Division.Maximum daysallowedtheAssociationlSociety,in combinedtotal shall not exceed.25 xthenumberof full-time equivalentteachersin theemployof theDivision asat September30th in eachschoolyear.
B. ‘No additional leave of absencebeyondfive (5) days shall be takenfor the purposesmentioned above except with the consent and approval of the Division or theSuperintendent.
C. Within theaggregatecap in (A), therewill bea pooi of fifteen (15) teacher days whichmay be allocatedby the Associationfor the purposeoutlined in this article. For eachday’s leave of absencetaken pursuant to this sub-paragraph,the Association shallreimbursethe Division the costs of the substitute. No membershall be allowedmorethan eleven(11) daysabsencein total in any one schoolyear for thepurposeoutlinedherein.
D. TheAssociationshall, upon giving noticeon or beforeApril30
th,,be entitled up to twofull-time releasepositions (to a maximum of three(3) persons)as determinedby theAssociationto attendto Associationbusinessfor thefollowing schoolyear. Thereshallbe no loss of benefitsandtheAssociationshall reimbursethe Division for eachreleasetime teacher’ssalary,allowancewhereapplicable,benefitsandothercostsrelatedto eachreleasetime teacher’ssecondment.

On or beforeApril 30th in the year of the secon’dmenteachrelease time teachershalladvisethe Superintendentof Schoolsin writing of theteacher’sintentionto return at thecommencementof thenextschoolyear. Failureto do so will relievetheDivision of theonusofreemployingthat teacher.
A teacheremployedby theDivision who is electedto a releasetimeposition shall attheterminationoftheteacher’ssecondmentreturnto thesamepositionthe teacherheldpriorto theleave,orsimilar.
ARTICLE 6.04 - JURYAND WITNESS DUTY
A. All teachersundercontractshall be grantedleavewithout deductionof salaryfor courtappearancesif theemployeeis:
1. Subpoenaedto be awitnessin acourtactionexceptingthoseactionsarisingfrom theemployee’spersonalaffairs;or ,
2. Summonedforjury duty.
B. Theteachershall remit to theDivision.anyremuneration,lessexpensesincurred (uponprovision of receipt(s)), which the teachermay receivebecauseof an appearanceincourtas awitnessorjuror.
C. A teacher subpoenaedas a witness in a Court of Law must notify his/herPrincipal/Supervisoras soonasthenoticeis received.
D.- All information regardingthe known times and length of absencesshould be madeknownto theteacher’sPrincipal/Supervisorassoonaspossible.
B. The teachershallmakeherselforhimselfavailableather or his schoolwhennot requiredat court.
ARTICLE 6.05 - LEAVE OF ABSENCE
A. Teacherswho havebeenemployedfor four (4) or moreyearson their presentForm 2and/or Teacher General contractand who meet the following operationalguidelinesshall be granted,uponwrittenrequest,a one (1) yearleaveof absencewithoutpay. If intheopinion of theDivision, theabsenceof that teacherwouldadverselyaffectthequalityof educationin theDivision, the leavemaybe deferred. Deferralsshall not be for longerthan one (1) year except in exceptionalcircumstances.For purposesof this article,“guaranteedreturn” means:teachersupon returnshallbe placedin apositionappropriateto their qualificationsandas closeas possibleto theone which theyhadat thetime theleave was granted. The conceptof “guaranteedreturn” doesnot abrogateany of theprovisionsof terminationof contractor lay-off which applyto teachers.

B. Operational Guidelines:
1. Applicationsshall be submittedto the Superintendentof Schoolsby April 1st if the
leave is to commenceon September ~ of the same year.
2. Thepurposeoftheleavemustbe statedby theapplicant. Gainful employmentduringthe leaveis acceptable.
3. During leavesof morethanone(1) year,accumulationof sick leaveandotherfringebenefitsareonly availableto teachersparticipatingin out-of-the-countryor exchangeteachingasapprovedby theBoard.
4. Teaching experience gained during such leave shall be recognized on the same basisas otherexperiencegainedoutsidetheDivision.
5. Teacherswhoseapplicationsare approved will receive a leave with a “guaranteedreturn” as defined above.
6. Teachers will sign a memorandumcovering the details of their leave and thememorandum will specify that teachers on leave of absence without. pay will bedeemed to have tendered their resignation if they do not give five (5) months notice inwriting of theirintention to return and/or do not return by the date specified.
7. A teacher is entitled to no more than three (3) leaves of absence without pay duringemploymentjn theDivision. Additional leavemaybegrantedatthediscretionof theBoard. For thepurposeof this clause“employmen.tin the Division” shallbe deemedto meanthat employmentwith the Louis Riel School Division will commencethebeginningof the2004/2005schoolyear.
8. The Division reservesthe right to limit the numberof teacherson leaveof absencewithout pay to three percent (3%) of thenumberofteacherson staff.
9. A leave may be on a full or part-time basis provided such leave is taken for a fullschoolyear.
10. In exceptionalcircumstances,and whenmutually agreedupon by the Division andtheteacher,aleavefor lessthanaschoolyearmaybe granted.
ARTICLE 6.06 - TEMPORARYREDUCTIONIN CONTRACT TIME
In exceptionalcircumstancesanddependingon staffingconfigurationsthat maybe approvedbythe Superintendentof Schools or Designate,the teacherand theDivision may mutually agreeupon a reductionof teachingtime. In thosecases,and unless agreementto the contrary, theteacherwill returnto employmentandbe re-instatedthefollowing schoolyearto thepercentageof time being worked prior to the leave being granted.

ARTICLE 6.07 - BEREAVEMENT LEAVE
A. For bereavement leave, the full salary of the teacher will be paid during the absence as
follows:
1. Death of a spouse or common-law
spouseorsame-genderpartner 5 days
2. Deathof a child or grandchild 5 days
3. Deathof an immediatefamilymemberliving in thehousehold 5 days
4. Deathof a parentorparent-in-law 5 days
5. Deathof a grandparent 2 days
6. Deathof abrotheror sister ‘ 3 days
7. Deathofabrother-in-lawor
a sister-in-law 2 days8. For other close relatives not listed in 1 — 7 above,theSuperintendentof Schoolsmay
grant up to one (1) day paid leave of absence. Application for such leave must bemadeon theDivisional applicationform providedfor thispurpose.
B. Wheretravel is necessaryin attendingto abereavement,the Superintendentof Schoolsmay grant additional time. Application for such an extensionshould be madeto theSuperintendent’sOffice.
C. For thepurposeof this clause:Wherea teacherestablishesthat he/shehasbeenresidingwith apersonof the sameoroppositegenderandhaslived with thatpersonin amarriage-likerelationshipfor at leasttwelve (12) monthsandhaspublicly representedthat personas’ his or her spouse,thatpersonshallbe deemedto thesamegenderpartner,orcommon-lawspouseof theteacher.
D. Where circumstances warrant and where additional leave may be grantedby theSuperintendent,then theteacher’ssalarymay, at thediscretionof the SuperintendentofSchoolsbe reducedby no morethantheactualcostof thereplacementsubstituteteacher.
ARTICLE 6.08 - COMPASSIONATE LEAVE
In the event of a serious illness in the immediate family of a teacher as set out in theBereavementLeaveprovision (numbers 1 through7), thefull salaryof a teacherwill be paidduring theabsence’forup to two (2) teachingdays.

ARTICLE 6.09 - DEFERRED COMPENSATION PLAN
Teachersare eligible to apply for a deferredcompensationplan (also known as the Deferred
SalaryLeavePlan)asoutlinedin the termsandconditionsoftheplan.
ARTICLE 6.10 - DISCRETIONARY LEAVE
(effectivedateof signingofthe collectiveagreement)
Discretionary leavemaybe granted up to a maximum oftwo (2) days per schoolyear for afull-time teacher(pro-rated for part-time teachers),toattend to personalbusiness,providedthat suchleaveis not usedto extendthe Decemberholidays,spring break or summervacation. Leavemayoccur in incrementsof half-days to maximum two (2) days.
Teachersmust submit their requestfor discretionary leavea minimum of five (5) workingdays beforethedateofthedesired leaveto theSuperintendentofSchools. The first day ofsuch leaveshall be at no costto the teacher. Irrespective ofthe needfor a substitute, theDivision shall deduct the costofa substitute from the teacher’ssalary for the secondday ofthis leave.
ARTICLE 6.11 - EARLY NOTICE OF RETIREMENT LEAVE
(effectivedate ofsigning oftheCollective Agreement)
A. Upon submissionof a written notice of retirement, a teacher on a Form 2 or GeneralTeachercontract may accessa leaveof absencewith salary of oneweek (five workingdays). This five day leavemay be taken on any schedulemutually agreeableto theprospectiveretiree and the schooladministrator.
B. To be eligible for this benefit, a teachermust submit a written notice of retirement, byFebruary
1st if the retirement occurs effective June 30th of that teaching year; by
September30th if theretirement occurs effectiveDecember3l~~of that teachingyear.
C. Leavesof absencesfor early notice of retirement are not dependenton a minimumnumber ofyears ofservice.
ARTICLE 6.12 - RECOGNITION OF EXTRA-CURRICULAR ACTIVITIES
“Extra-curricular activities” meansstudent-relatedathletic, social,recreational andcultural activities, occurring outsidethe normal schoolday,but does include activitiesrelated to academicor instructional matters or curriculum subjectsoutsidethe normalschoolday, whethersuchoccur alone or with students,parentsor administrative staff,suchas(without limitation) staff meetings,parent/teachermeetings,committee work, in-servicesessions,marking and settingexaminations,or marking schoolassignments.

The parties acknowledgetheimportanceof extra-curricular activities as an integral part ofeachstudent’seducationalexperience.
An eligible extra-curricular activity is an activity which hasreceivedprior approval fromtheschoolprincipal.
Commencingin September2007,and thereafter, in any schoolyear (asper theMinister ofEducation, Citizenship and Youth’s definition), a teacherwill be entitled to paid leaveofabsenceof one day maximum per schoolyear,provided that:
1., The teacherperforms 50 hours of eligibleextra-curricular dutiesduring a schoolyear.
2. The’ datefor suchleaveshall be mutually agreedupon betweentheprincipal and theteacher.
3. Teachersmust submit their requestfor leavea minimum offive (5) working daysbefore thedateof thedesiredleaveto theSuperintendentof Schools.
4. This leavemaybe usedup to Decemberofthefollowing schoolyear excluding oneday prior to the winter break.
5. Such leaveis not to be used to extendthe Decemberholidays,spring break orsummervacation.
6. Accumulatedextra-curricular activity hours can not be carried over from oneschoolyear to the next.
7. The leavemaynot be taken in conjunction with any other leaveunlessauthorizedby the Superintendent ofSchools.
8. A part time teachershall be entitled to theequivalent time off as a full time teacher.Leavemay occur in incrementsofhalfdaysto a maximum of two daysfor part timeteachers.
ARTICLE 7.00 - COMPLAINTS
Should the Division receivea seriouscomplaint, in writing, regardinga teacher,the Divisionshall communicate,in writing, thecomplaintreceivedto the teacherconcerned.Prior to makingany judgmentregardingthe complaint, theDivision shall afford theteacheran opportunity toappearandanswerto thatcomplaint,eitherpersonallyorby representative.
ARTICLE 7.01 - WORK PLACE HARASSMENT , ‘A. The Division and the Association recognizethe right of all individuals within the
Division to an environmentfree from sexualor other harassmentand the right to betreatedfairly.
B. Allegations andinvestigationsofharassmentshallbe dealtwith in confidence.

ARTICLE 7.02 - FREEDOMFROM VIOLENCE
A. TheDivision andAssociationrecognizethe importanceof a caringschoolenvironment
that is orderly,supportiveandnon-violent.
B. Theworking andlearningenvironmentshouldbe freefrom physicalor emotionalabuse.Physicalabuseshallmeanactsof violenceagainsta person,theperson’sfamily andtheperson’spossessions.Emotionalabuseconsistsofobscenegestures,verbalabuse,threatsofphysicalabuseandharassment.Incidentsof abusewill be treatedwith confidenceanddealtwith throughDivisional Policy.
C. This section is subject to The Public Schools Act and regulationsthereto and is notintendedto abrogateany managementrights with respectto the studentdisciplinaryprocess.
D. Teachersshall not havethe right to grieveindividual studentdisciplinarydecisionsmadeby theDivision.
ARTICLE 8.00 -‘ STAFF REDUCTION’
A. Whereit is determinedby the Division that a lay-off is necessaryand wherenaturalattrition, transfers,sabbaticalsandleavesof absencedo not effectthenecessaryreductionin staff, theDivision shall give first considerationto retainingteachershavingthegreatestlengthof servicewith theDivision.
B. Notwithstandingthe foregoing,theDivision shall havetheright to disregardthelengthofservice of any teacherin the event of a lay-off, if suchteacherdoes not have thenecessarytraining,academicqualifications,experienceandability for aspecificteachingassignment.
C. Definitions:
1. Training: Instruction receivedaspreparationfor theprofessionof teaching,whichinstructionleadsto thedevelopmentof a particularskill or proficiencywith respecttoaparticularsubjector subjects.
2. AcademicQualifications: Refers to theclassificationin which ateacheris placedbythe Administration and ProfessionalCertification section of Manitoba Education,TrainingandYouth.
3. Experience: The practical application of the training over a period of time withrespectto theparticularsubjector subjects.
4. Length of Teaching Service: The teacher’slength of continuousservicewith the
Division commencesthe first teachingday after themostrecentdayof hiring with the

Division. Approvedleavesof absenceup to two yearsof consecutiveleave at anyonetime shall not constitutea breakin continuity of service. Approvedleavesofabsencelongerthan two consecutiveyearsshall result in that individual’s retainingbut not accruingcredit for service. Leavesfor compassionatereasonsasmay bemutually agreedupon by the Associationand the Superintendentof Schools andleavescoveredby Article 6.07 shallnot constituteabreakin continuityofservice.
(i) The “Length of Service” list shall be providedto the teachersand Association.Any teacherand/ortheAssociationwill be permittedthirty-five (35) teachingdaystoprotestanyallegedomissionor incorrectlisting.
5. Regular Contract: Means thestatutorycontract(as maybe amendedfrom time totime) Form 2 and/orTeacherGeneral Contract or any othersimilar or subsequentform approvedby the Minister of Educationfor the continuousemploymentofteachers.
6. SpecificTerm Contract: A contract,eitherverbalor written, wherebyateacherishired to teachaspecificsubjectorsubjectsfor a specifictermduring all oranypartofaschoolyear.
7. SchoolYear: The period of time from thecommencementof a school termon oraboutthe
1st dayof Septemberof a particularyearto theendof thetermin themonth
ofJunenextfollowing.
8. Ability: Refers to a teacher’sability to perform a particularteachingassignmentsatisfactorily and proficiently after having acquired the necessary training,qualificationsandexperience.
D. 1. In theeventof an impendinglay-off, theDivision or its designateshallmeetwith theExecutiveof the Association to discuss the implications of the lay-off and shallprovidethe Associationwith a list of teachersto be laid off. Themeetingshall beheldno later thanMay l5~in anyschoolyearorat suchotherdateas thepartiesmayotherwisemutuallyagreeupon.
2. The Division shall maintain a seniority list showing the date upon which eachemployee’sservicecommencedand the total length of servicefor the purposeofdeterminingseniority. Suchlist shall bepostedin eachschoolby March
1st of each
schoolyearand a copy sentto theAssociation. TheAssociationand/orthe teachershallbepermittedto protestany allegedomissionor incorrectlisting until March
15th
of that year. In the eventof an omissionor incorrect listing being broughtto theDivision’s attentionafterMarch
15th, the teachershall havethe right to correctthelist
atthenextscheduledpostingofthelist.

E. Lengthofteachingserviceshallbe determinedon thebasisofthefollowing:
1. Theteacher’slengthof continuousemploymentwith theDivision commencingwith
thefirst teachingday afterone’smostrecentdayofhiring with theDivision.
2. Whereteachershavethesamelengthof continuousemploymentwith the Division,the length of teachingservice shall be determinedon the basis of total teachingexperiencein theDivision.
3. Where teachershave the samelength of serviceas in E(2) the length of teachingexperienceshallbe determinedon thebasisof total recognizedteachingexperienceinManitoba.
4. Whereteachershavethe samelength of serviceas in E(3), the length of teachingserviceshallbe determinedon thebasisoftotal recognizedteachingexperience.
5. If the lengthof teachingservice,asin E(4) is equal,theteacherto be laid-off shallbedeterminedby theDivision.
F. Noticeof any lay-off shall be given to theteachersno laterthanJune10
th~ Theteachershall beplacedon therecall list until June30th of theschool yearin which he/shewaslaid off. To remain on the recall list beyond such date the teachershall indicate inwriting, by RegisteredMail to the Division his/herwish to remainon the recall list.Failureto providea writtenindication to theDivision by June30th shallrelievetheonuson theDivision for that teacher’scontinuedplacementon therecalllist.
G. If, after lay-offs have occurredand for a period of one (1) calendaryear after theSeptember
30th following the dateof lay-off, positionsbecomeavailable,teacherswho
havebeenlaid off andhavegivenwritten noticethat theywish to be recalled,shall beoffered the positions first, providing such teachers have the necessarytraining,qualifications,experienceand ability for theposition available. Lengthof servicewiththeDivision will beusedto determinetheorderin whichlaid-offteachersareofferedtheavailable positions, provided that the said teachers have the necessarytraining,qualifications,experienceandability.
H. TeachersshallkeeptheDivision informedas to theircurrentaddress.
Teachers shallbe recalledby registeredletteror letterdeliveredby hand and mustreplyby registeredletteror maydeliver suchletterin personto theSuperintendentofSchoolsor Designatewithin seven(7) days of receivingtheLetter of Recall. Failureto replyshall result in the loss of all recall rights. If a teacherrefusesa positionfor which thatteacheris qualified,suchteachershall loseall rights to recall.
J. if a teacheris recalledasprovidedin G above,thefollowing will notbe affected:
1. Accumulatedsick leavegainedprior to being laid-off, but sick leaveshall not be

2. Seniority gainedprior to being laid-off, but seniority shall not be accruedfor the
periodoftime ofthe lay-off.
K. A teachershall loseseniorityfor anyof thefollowing reasons:
.1. Theteacherresigns.’
2. The teacherbecomesemployed by another school board except in the case ofemploymentunderaLimited Term Teacher-Generalcontract.
3. Theteacherfails to returnto work after theterminationof any leavegrantedby theDivision.
4. The teacheris not re-employedwithin one (1) calendaryear after September30th
following thedateoflay-off.
5. Theteacher’scontractis t~rrninatedfor cause.
6. Any teacheron therecall list who refusesto accepta position for which theteacherhasthenecessarytraining, academicqualificationsandability to performthework intheofferedposition, shallforfeit all rights ofseniorityandre-employment.
A teacherwhohaslosthis or herrightof recallasa resultof theapplicationof thisclauseshallbenotified assoonaspossiblethathis or herteachingcontracthasbeenterminated.
L. Notwithstandingany otherprovisionof this Agreement,theforegoinglay-off provisionsshall not apply to a teachercontinuouslyemployedby the Division underan approvedform of agreementfor a full schoolyearor lessas definedby theMinisterby Regulation,or to ateacheremployedfor afixed termwhereduring that termtheteacheris employedon theexpress-writtenunderstandingthat theteacher’semploymentwith theDivision willceaseat the end of suchterm; providedhowever, no teachershall be laid off who hasbeenemployedby theDivision underan approvedform of agreementfor morethanonefull schoolyear asdefinedby theMinister by Regulation,,wherea teacherwith a fullschool yearor less of employmentunderan approvedform of agreementor a specificterm contracthas not beenlaid off, having regardto the necessarytraining, academicqualifications,experienceand ability requiredfor a specificteachingassignmentof suchteacheremployedundera specificteachingassignmentof suchteacheremployedunderaspecificterm contract(as definedin SectionC (6) above)or of a teachercontinuouslyemployedby theDivision underan approvedform of agreementfor a full schoolyear orless asdefinedby theMinister by Regulation.

ARTICLE 9.00 - PERSONAL PROFESSIONAL DEVELOPMENT FUND
A. Effective thefirst day offall term of2007A PersonalProfessionalDevelopmentFundadministeredjointly by theDivision andtheAssociationshall existandtheDivision’s annualcontributionshall equalfour (4) timesthe maximum rate of payof ClassVII.
B. The Personal ProfessionalDevelopment Fund shall be allocated by the PersonalProfessional Development Fund Committee according to the guidelines of theProfessionalDevelopmentModel.
C. Effective thefirst day offall term 2007TheAssociationwill contributeone-third(1/3)of a maximumClassVII salary.
ARTICLE 10.00 - MEAL PERIOD
A. Exceptin casesof emergencyor unforeseensimilar circumstances,everyteachershallbeentitled to an uninterruptedmealperiodof fifty-five (55)minutesdurationbetween11:00am and 2:00 pm daily. Designatedprofessionalstaff will be on call during the lunchperiodto dealwith emergenciesandunforeseensimilarcircumstances.
B. It is understoodby both the Board and the Association that teachersmay, on anindividualandvoluntarybasis,agreeto holdmeetingsduringthe lunchbreak.
ARTICLE 11.00 - EXCEPTIONAL STUDENTS
A. An exceptionalstudentshallbe definedasany child needingspecialprogrammingand/ora speciallearningenvironmentbecauseofphysical,intellectual,emotional,behavioralorsocial handicap,or becauseof giftedness. Teacherswho are assignedto teach anexceptional student have, the right to relevant information concerning the child’scircumstancesand needsand, to the extent feasible,-consultationprior to the time anexceptionalstudentis placedin theclass.
B. Subject to the Division’s available resources,as determinedin the discretion of theDivision, teacherswho areassignedto teachan exceptionalstudenthavetheright:
1. To requestandreceiveappropriateprofessionaldevelopment;
2. To requestandreceiveadequatematerialand auxiliaryresourcesrequiredfor proper
integrationof an exceptionalstudentinto theclassroom.

ARTICLE 12.00 - NON-CONTACT TIME
Non-contacttime (non-teachingand/ornon-supervisory)for full-time classroomteachersshallbeat leasttwo hundredand sixteen(216) minutesper cycle, exclusiveof recess. A part-timeteacheris entitled to a’ proratedshareof non-contacttime. This minimum time is subject tovariationwith the agreementof the teacheror where,dueto urgentcircumstanceswhich wereunforeseenwhenschooltimetableswereestablished,theDivision is requiredto providelessnon-contact time on a temporary basis.
ARTICLE 13.00 - WORK ENVIRONMENT
The Parties agreethat insteadof schoolbased Safety and HealthCommittees,a DivisionalWorkplaceSafetyandHealthCommitteeshall existwhich shallmeetat leastquarterly. Thereshall betwo (2) co-chairpersons,one of whom shall be theAssociationPresidentor Designateand the other chosen by the Division, four (4) Associationteachers,atleasttwo (2) supportstaffand two (2) membersfrom the Division Administration. This Committee shall follow theWorkplaceHealth and SafetyAct requirementsand replacesany local or school committees.Minutesof all meetingsshall be recordedanda copy given to eachmemberof the Committeeandpostedon thestaffroombulletin board.
ARTICLE 14.00 - TRAVEL ALLOWANCE
All teachersundercontractwho arerequiredto usetheir private vehiclesin orderto completetheir teaching assignmentas assignedby the Division shall receive a travel allowance asprovidedfor in Division policy.
ARTICLE 15.00- CONSULTATION
A. An Association/DivisionRelations Committee shall be appointedconsisting of up tothree(3) representativesfrom theAssociationandup to three(3) representativesfrom theDivision.
B. TheCommitteeshallmeetat a time mutuallyagreeable,attherequestof eitherparty,forthepurposeof discussingmattersrelatedto theworkplacethat affecttheparties.
C. The Committeemaydiscussbut shallnot havejurisdiction to interpretand/oramendanyofthetermsandconditionscontainedin theCollectiveAgreement.
D. Minutes of all meetings that occur shall be kept and a copy shall be given to eachmemberof theCommitteeand, as well, a copy shallbe postedon thebulletin boardorotherwisemadeavailablefor all teachersto see.

ARTICLE 16.00 - DISCIPLINE
No teacher bound by this agreement shall be disciplined except for just cause. Theimpositionof discipline ‘without just causeby theDivision or any agentthereofin the form ofwritten warning(s)and/orsuspension(s)with or without pay, shall be subjectto the followingprovisions: -
A. WheretheDivision orperson(s)acting on behalfof theDivision so disciplinesanypersoncoveredby this Collective Agreementand where the affectedpersonis not satisfiedthatthe discipline is for just cause,the Division’s action shall be deemedto be a differencebetweenthepartiesto orpersonsboundby this CollectiveAgreementunderArticle 20.00,Provisionfor Settlementof DisputesDuring Currencyof Agreement.
B. When sucha differenceis referredto aBoardof Arbitration underArticle 20.00,theBoardof Arbitration shall havethepowerto:
1. Upholdthediscipline. -
2. Rescindthediscipline.3. Varyormodify thediscipline.4. OrdertheDivision to pay all orpartof anylossof pay and/orbenefitsin respectof the
discipline.5. Do oneor more ofthe things setout in sub-clause(1), (2), (3) and(4) above.
C. The written warning(s) shall not include teacherassessmentandevaluationdonepursuantto division policy and any regulationsandamendmentsthereto (hereinafterreferredto asthe policy), except-where the implementationof saidpolicy againstapersoncoveredbythis CollectiveAgreementis forthepurposeof disciplining saidperson.
D. TheAssociationagreesthat theDivision hastheright, to suspendateacherwith or withoutpay for justcause. -
ARTICLE 17.00- USE OF TERM CONTRACTS
A. Except as hereinafterprovided, every teacheremployed by the Division shall beemployedunder a written form ofcontractknownasForm 2 an’d/or TeacherGeneral ofScheduleA ofthePublicSchoolsAct.
B. Theexceptionto (A) aboveshall be thosetermteachersemployedfor a termcertainofone(1) schoolyearor less. Every suchtermteachershall be employedby theDivisionunderaform of contractapprovedby theMinisterknown as a Limited Term Teacher-General.
C. A teacher who hasbeen employedfull- or part-time in the Division undera LimitedTerm Teacher-Generalcontract for two (2) successiveentire schoolyearsshall,uponemploymentfor the third consecutiveyear,be signedto a Teacher General (Form 2)contractandshall beentitled retroactivelyto seniority arid sick leave. An “entire schoolyear” meansemploymentfor 180ormoreschooldaysin thecontractyear.

ARTICLE 18.00 - TRANSFER OF TEAChERS
A. TheAssociationrecognizestheright oftheDivision to transferteachersemployedby the
Division to schoolsunderthejurisdictionoftheDivision.
B. The Division shall consult with teacherswho are transferredprior to making a final
decision.
C. In making transferdecisions,the Division shall considerthe educationalneedsof the -
students,the concernsraisedby theteacher,andtheadministrativeneedsof theDivisionpriorto makingadecision.
D. Whenateacheris transferredto anotherschool,theDivision shallmakearrangementsforthat teacherto receivea day to preparefor the new assignment.- Such preparationdaywill be scheduledprior to thetransferoccurring. -- -
B. In thecaseof anyteacherwho hasbeengivennotice of transferfollowing May31
st andwho wishes to resignbefore June
30th of that year, the Division agreesto acceptthe
resignationprovidedit is offeredin writing within seven(7) daysofthenoticeoftransfer.
F. , The Division will notify the Association Presidentof the namesof the Associationmembersand their work locations.
ARTICLE 19.00 - POSTING OF VACANCIES
The Division ‘will place teachersreturning from leave, teachersdeclaredsurpluswithin theschool, Division or Principal initiated transfers and consider teachertransfer requests;theremainingvacantpositionswill be posted.
ARTICLE 20.00 - PROVISION FOR SETTLEMENT OF DISPUTES DURINGCURRENCY OF AGREEMENT
A. Wherea violation of this Agreementis allegedby a Party to or personsboundby theAgreementor on whosebehalf it was enteredinto, or differencebetweenthe Partiesarisesrelating to the content,meaning,applicationor violation of this Agreement,eitherParty shall,within thirty-five (35) teachingdaysof the eventgiving rise to the allegedviolation or difference,or within thirty-five (35) teachingdays from the dateon whichthegrievorbecameawareof theeventgiving rise to theallegedviolation or difference,notify the other Party in writing, stating the alleged violation or difference and thesolution(s)sought.
B. Any differencewhich is not settled to the satisfactionof the Partieswithin ten (10)teachingdaysfrom the datewheneitherParty notifies the otherParty in writing of its

desireto havethedifferencenegotiatedshall,uponfurtherwrittenrequestofeitherParty,be submittedto an arbitrationboardconsistingofthree(3) members.EachofthePartiesto the disputeshall, within seven(7) days of the dateof the written requestfor thearbitration,appointan arbitratorandshallnotify theotherPartyof theappointment.
C. Those two (2) arbitrators within a further period of seven (7) days after theirappointment,shall meetand selecta chairpersonmutually satisfactoryto both. Shouldthearbitratorsfail to agreeupon a chairpersonwithin therequiredseven(7) days,eitherPartymayrequesttheManitobaLabourBoardto maketheappointmentof achairperson.Thecostsof thearbitrationshallbe sharedequallybybothPartiesto thisAgreement.
D. Any dispute arising from the thirty-five (35) daysnotification period shall be the firstitemto be resolvedby thearbitrationboard.
B. Exceptashereinprovided,theLabourRelationsAct shall apply.
ARTICLE 21.00 - DISABILITY BENEFITSPLAN
A. The Division shall deduct from the teachers’ salaries,monthly premiums for theManitoba Teachers’Society Disability Benefits Plan and shall forward the premiumsdeductedwithin fifteen (15) days of the deductionhavingbeenmadeto the ManitobaTeachers’Society.
B. TheDivision agreesto provide,on requestof thePlan,a listing of all teacherswho havehadpremiumsdeductedandtheamountofpremiumsdeducted.
C. A teacheremployedby theDivision mustenroll in thePlanon thedateoffirst becomingeligible, in accordancewith the termsandconditionsofthePlan.
D. TheDivision agreesto providetheManitobaTeachers’SocietyDisability BenefitsPlan,on themutuallyagreedprescribedform, informationregardingteacherswhohavebeeninreceiptof Employerpaid sick leave(or short termdisability benefits)for morethan ten(10)teachingdays.
B. For this and otherbenefitplans that requirea deductionfrom source,the onus is on theteacher to ensure such coverage is in place anddeductions are being made.

ARTICLE 22.00 - GROUPLIFE INSURANCE
A. TheDivision will continueto administerTheManitobaPublicSchoolEmployeesGroup,Life InsurancePlanaccordingto thetermsandconditionsof theMasterPolicy of thesaidplan.
B. Unlessotherwiseexcluded,the teachers’shareof annualpremiumsshall be deductedinasnearequalamountsaspossiblefrom eachsalarychequefor all.participantsin theplan.One-half(1/2) of thepremiumfor the’ basiclump sum benefit of two hundred(200 %)percentof annualearningsfor eligible teachersshallbe paidby theDivision andone-half(1/2) shallbepaidby theemployee.
Eligible teacherswho were’ insured for the survivor income benefit as at March 3 JSt
2001, will be insuredfor an additional two hundred(200%) percentof annualearningswith one-half(1/2) of thepremiumfor this amountbeingpaidby theDivision andone-half (1/2) being paid by the teacher. The premium for any other additional optionamountsof coverageunderthePlanshall befully paidfor by the teacher.
C. All teachersshall be requiredto participatein theplan, unlessgrantedexclusionby theTrusteesof TheManitobaPublicSchoolEmployeesGroupLife InsurancePlan.
D. Notwithstandingthe above,teachersemployedby theformer St. Vital SchoolDivisionand continuing to be employedin theLouis Riel SchoolDivision and coveredby theGroupLife InsurancePlanshall continueto receivethedeathbenefitunderthis plan ofone hundredthousand($100,000)dollars. TheDivision shall pay the total costof thisgroup insuranceplan for theseteachersuntil suchtime as theyleavetheemploy of theLouis Riel SchoolDivision.
ARTICLE 23.00 - EXTENDED hEALTH BENEFITS PLAN
A. TheBoard shalladministertheManitobaTeachers’SocietyExtendedHealthBenefitsPlanunderwrittenby ManitobaBlue Crossin accordancewith the termsandconditionsof thatplan subjectto the provisions of the Collateral Agreementbetweenthe Parties to the
- CollectiveAgreement.
B. Exceptasprovidedin “C” below, all teacherscoveredby this agreementthat areeligibleunderthetermsof theplanshall be requiredto participatein theplan.
C. Wherea teachercoveredby this’ Agreementprovidesevidenceof coveragefor ExtendedHealthBenefitsthrough a spouse,suchmembershall be eligible to opt out of this plansubjectto the termsof theplan. Such option shall be exercisedwithin sixty (60) daysofreceivingcoveragethrough a spouseby providing written proofof suchcoverageto theDivision in theform ofa letterfrom thenon memberspouse’semployer. Whenthisoptionis exercisedthe membershall only be able to opt back into the plan when evidenceis,producedthat spousalcoveragehas lapsed. The decisionto opt back in shall be madewithin sixty (60) daysofthelossofspousalcoverage.

ARTICLE 24.00 - DENTAL INSURANCE
1. Effective July 1, 2006, theDivision will continueparticipationin theadministrationof theMAST/MTS DentalPlan (the “Dental Plan”) in accordancewith thetermsand conditionsof the Agreemententeredinto by the Division’ and the AssociationattachedheretoasScheduleA (theAuxiliary Agreement).
2. All teacherscoveredby this Collective Agreementthat are eligible underthe tennsof theDentalPlanshallbe requiredto participatein theDentalPlan unlessentitled to electoutoftheDentalPlanas maybe permittedunderthetermsthereof.
3. Thecost of the DentalPlan will be paidby the Division in accordancewith thetermsandconditionsof theDentalPlanAgreement.
4. TheDivision agreesthat theDivision’s monthly contributionto theDentalPlanon behalfofeachteacherwill be themonthlyrate for family coverage(thatis, entitlementto coveragefora teacher,his or her spouse,and his or her dependentchildren, having regard to thedefinition of spouseand dependentchildrenin theDentalPlan). Providedthat prior to thebeginningof theplanyeara teachermayelect in prescribedform for reducedcoverageaspermittedunder the terms of theDentalPlan in which casetheDivision agrees-to makemonthly paymentsto the teacherasfollows:
a) A teacherwith only onedependent(spouseor child) who is entitled to anddoesso dulyelectto opt down from family coverageundertheDentalPlan;to coveragefor Employeeandoneotherfamily memberonly, shall receivean amountequalto thedifferencein themonthly ratebetweenfamily coverageand coveragefor a teacherand one dependentonly; or -
b) A teacherwith neitherspousenor dependentchildrenwho is entitled to anddoesso dulyelect to opt down from family coverageunder the Dental Plan to coveragefor anEmployee only, shall receivean amount equal to the difference in the monthly ratebetweenfamily coverageandcoveragefor a teacheronly;.or -
c) A teacherwho is entitledto anddoesso duly electto optout of all coverageon thebasisthat theteacher’sspousehasdentalplan coverage,shall receivean amountequalto themonthlyratefor family coverage.

WhEREAS pursuantto a- certain collective agreementeffectiveJuly 1, 2006, madebètweentheDivision andtheAssociation,theDivision has agreedto participatein theadministrationof theMAST/MTS DentalPlan(the “Dental Plan”) for all of theeligibleemployees(the “Teachers”), as describedby the MAST/MTS. Dental Plan MasterContract(the “Contract”).
WHEREAStheDivision andtheAssociationdesireto set forth the termsandconditionsunderwhich theDivision shall-soparticipatein theadministrationoftheDentalPlan;and
NOW THEREFORETHIS AGREEMENTWITNESSETHthat in considerationofthepremisesandthemutualcovenantshereincontained,thepartiesheretoherebyagreeas follows: -
1. Thepreambleheretoshall form anintegralparthereof.
2. ThetermsandconditionsoftheDentalPlanshall beasdescribedby theContract.
3. Subject to the terms of the Agreement,the Division and the Associationshallcomply with any administrativeor underwriting requirementsin respectto theDentalPlanstipulatedby theContractand/orby ManitobaBlue Cross. -
4. TheDivision shallmakethefollowing payments:
- a) Subject to paragraph(b) which follows, for the school year 2006-07theDivision shall pay monthly$111.25on behalfof eachTeacherin respectof
- ‘the DentalPlan, said $111.25being the monthly rate for family coverage.Suchpaymentsshallbe madeto ManitobaBlue Cross.

b) Where,theTeacheris entitled to andhasso electedfor reducedcoverage,aspermittedunderthetermsof theDentalPlan,that is, coveragefor Teacherandonedependent(spouseor child) only, or for Teacheronly, or for no coveragein theeventoftheTeacher’sspousehavingadentalplan,as thecasemaybe,the Division shall pay to the Teacherthe difference in the monthly ratebetweenfamily coverageandthecoverageelectedby theTeacher.
c) For eachyear thereafter,the-Division shall pay monthly on behalfof eachTeacheran amountnot to exceedtheamountpayableby theDivision for eachTeacherin the precedingyear (taking into accountpaymentsreferredto inboth sub-paragraphs(a) and(b) of thisparagraph4) increasedor decreasedbya percentageequivalentto thepercentagenegotiatedor, awardedon averagefor thesalaryscheduleofthe.Teachersin thecurrentyear.
5. It is understoodand agreedby theAssociationthat all eligible Teachersshall berequiredto participatein theDentalPlanunless‘entitled to electout of theDentalPlanasmaybe permittedunderthe termsthereof.
6. This Agreementmay be terminatedby either of the partiesheretoeffective thefirst. day of Septemberof a particularcalendaryearprovidedthat not less thantwelve (12) months written notice of such termination is given by the partyterminatingthis Agreementto theotherpartyhereto.
7. Any notice requiredor permittedto be given hereundershall be deemedto beeffectively given if mailed by registeredmail, postageprepaidor deliveredbybondedcarrierto thepartiesatthefollowing addresses:

4. IT IS HEREBY FURTHER ACKNOWLEDGEDby theAssociationthat‘thereforethe salarypaid to theTeachers,by the Division andthepaymentsby the Division inrespectof the DentalPlan in eachyear must be viewed in the aggregatewhen theremunerationtheTeachersreceiveis viewed relativeto the remunerationreceivedby
- theteachersofotherschooldivisions in theProvinceofManitoba.
5. IT IS HEREBY FURTHERACKNOWLEDGEDby theDivision that in theeventeither party to this Agreementwishesto exercisethe right of terminationof a certainagreementbetweenthepartiesheretoknown asTheCollateralDentalPlanAgreement(asstipulatedin Section6 thereof),it is recognizedthat the salaryscheduleas outlinedin the collective agreementbetween the parties hereto in force at the time ofterminationof the‘Dental Planwill requirean adjustment.
Said adjustmentshall be an amount not to exceedthe September1, 2006 Divisionpaymentsin respectof theDentalPlanper Teacher,that is $111.25; compoundedby
- theequivalentpercentageincreaseor decreasenegotiatedor awardedon averageforthe salary schedulein eachsubsequentyear up to and including the yearof actualterminationof the DentalPlan, plus any interim increasesor decreasesto the salaryscalefor claimsexperience.
6. Any surplus funds that may be available as determinedby the insurer as at thetermination date of the Collateral Dental Plan Agreement will be paid to theAssociation‘by theinsurer.

RE: ADMINISTRATOR ALLOWANCES
School-basedAdministrativePositions
TheDivision believesthat thefirst tworoundsofcollectivebargainingafteramalgamationin 2002transpiredin goodfaith. Accordingly,theDivision believesthat it cannotreversedecisionsthatresultedat thebargainingtablesince2002.
Accordingly, theDivisionwill not enterinto anyagreementon aretroactivebasis.However,theDivision will considerthe requestoftheAssociationon a “go-forward” basisfor principalsandvice-principalscurrentlyin its employ.
Therefore,schooladministratorswill receivesalaryadjustmentsin keepingwith the classificationthatappliedin theirrespectivelegacydivision. This adjustmentwill beeffectiveSeptember1,2006. Respectingprivacyoftheindividuals thespecificnameswill beidentifiedon a list for theinformationoftheDivision andAssociationonly.
This salaryadjustmentshall seethemreceivethesalariesthatwould haveapplied,hadamalgamationnot occurred,andto includethe 3%salaryincreasesachievedannuallyby theAssociation.Theseschooladministratorswill alsobenefitfrom negotiatedincreasesduring thecurrentroundof collectivebargaining. Thesalaryadjustmentmustnot exceedthe sumofthemaximumlevel ofaSalaryScheduleClass6 andthe Principal’sSalaryAllowanceClassC.
Furthermore,this salaryadjustmentshallapplyfor aperiodofthreeschoolyears,September1, 2006to June30, 2009, at whichtime theLouis Riel SchoolDivision salaryschedulesshallapplytotheseschooladministrators’salaries.TheDivision believesthat this will permittheschooladministratorssufficienttime to upgradetheirqualifications,if theyso wish,to maintainacomparablelevelofsalary.

ThePartiesto this MemorandumagreethattheLengthof TeachingServicefor thoseemployeesformerly employedby WinnipegSchoolDivision (Child GuidanceClinic) andprovidingserviceto theformerNorwoodSchoolDivision No. 8 andtheformerSt. BonifaceSchoolDivision No.4, prior to July 1, 1993, shallfor thepurposeof Article 8 — StaffReductionbedeemedto haveastartdateof employmentasthesamedateasthebeginningoftheircontinuousemploymentwith theChild GuidanceClinic in theWinnipegSchoolDivision. TheDivision agreesto providetheAssociationwith an annuallist oftheeligibleemployees.
After thedateof this MemorandumofAgreement,the lengthofteachingservicewill beaccruedaccordingto thetermsand conditionsoftheCollectiveAgreementbetweentheDivision andtheAssociation.
This Memorandumof Agreementpertainssolelyto Article 8 — StaffReductionandtheemployeesmentionedabove,anddoesnot in anymanneralteror amendanyotherportionoftheCollectiveAgreement.

theCollectiveAgreementandcon’n-nencesthefirst teachingdayafterthemostrecentdayof hiringwith WinnipegSchoolDivision. After this date,the lengthofteachingservicewill beaccruedbaseduponthetermsandconditionsoftheLouis Riel CollectiveAgreement.

ThePartiesto this Memorandumagreethat thoseemployeeswho werepreviouslyemployedby TheWinnipegSchoolDivision, Child GuidanceClinic, andwho chosetobe employedby TheLouis Riel SchoolDivision effectiveJuly 1st, 2007, shallbe creditedwith thesick leaveaccumulationtheyhadat TheWinnipegSchoolDivision, effectiveJune
30th 2007.
Itis’further agreedthat if anyindividual employee,,mentionedabove,hadaccumulatedsick leavegreaterthanthemaximumstatedin thecollectiveagreementArticle 6 (B)betweenTheLouisRiel SchoolDivision andTheLouis Riel Teachers’Association,theyshallbeentitled to thoseexcessdaysandshall notbe affectedby themaximumaccumulationin the collectiveagreementuntil eithertheusageof sickdaysdropstheiraccumulationbelow themaximumor themaximumin thecollectiveagreementexceedstheiraccumulation.
