DECISION AND ORDER

DIRECTING GRANT OF CERTIFICATION

These appeals arise under § 212(a)(5)(A) of the Immigration and Nationality Act, 8

U.S.C. § 1182(a)(5)(A) and the “PERM” labor certification regulations at 20 C.F.R. Part 656.2

Because they involve substantially similar facts on a common question of law, we are deciding

these appeals in a single Decision and Order. The following Statement of the Case is based on

the Appeal File for 2013-PER-01448, which is representative of each of the appeals. For the

reasons stated below, we reverse the CO‟s determinations and remand for certification all the

applications.

STATEMENT OF THE CASE

The Employer filed an Application for Permanent Employment Certification (“Form

9089”) sponsoring the Alien for permanent employment in the United States for the position of

“Software Developers, Applications.” (AF 541).3 The Certifying Officer (“CO”) audited the

application on August 9, 2012. (AF 535). The Employer responded to the audit notification on

September 10, 2012. (AF 29). The CO articulated nine denial reasons on March 26, 2013. (AF

22). The Employer asked for reconsideration on April 16, 2013, and the CO accepted most but

not all of the arguments made by the Employer. (AF 1-2).

The remaining denial grounds for decision on appeal relate to what the Employer calls

the “Cost of Labor Adjustment” or “COLA.”4 (AF 1-2). Included with the Employer‟s audit

response was an offer letter that was sent to a U.S. applicant. (AF 123-125). In that letter under

the heading “CASH COMPENSATION:” in the paragraph “Base salary,” $117,707.20 was

listed, while another paragraph provided an explanation of the COLA. The COLA was described

as follows:

As eligible, you may be paid a geographically based Cost of Labor Adjustment

(COLA) of $250.00 per pay period for Washington, D.C., which is an

annualized amount of $6,000. Your COLA on the 15th

and last day of each

month in accordance with the Company‟s current payroll policies and practices,

along with your regular base salary. [sic] If your work location changes, then

there will be an adjustment to COLA effective the first day of work in your new

work location. COLA is subject to regular review and may be increased or

decreased, or replaced by another compensation component upon certain

promotions.

Id.

In his decision on reconsideration, the CO asserted that the NOF failed to apprise U.S.

workers of the COLA and therefore did not accurately describe the job opportunity. The CO

acknowledged that the Employer need not list every wage and term of employment, but

explained that when the NOF advises that both long and short term travel is required for the

performance of the job and does not advise that a COLA adjustment of wages is available

depending on the assigned area of employment, the NOF does not appropriately apprise viewers

of the actual terms and conditions of employment, in violation of 20 C.F.R. § 656.17(f)(3).5

Section 656.17(f)(3) states the advertisement must “provide a description of the vacancy specific

enough to apprise the U.S. worker of the job opportunity for which certification is sought.”

Furthermore, the CO found that the NOF violated § 656.10(d)(4) because “the notice must

contain the information required for advertisements by § 656.17(f), must state the rate of pay

(which must equal or exceed the prevailing wage entered by the SWA on the prevailing wage

request form), and must contain the information required by paragraph (d)(3) of this section.”

The CO characterized this COLA as an “adjustment of wages.”

In addition to the NOF violations, the CO asserted that the job order, Sunday newspaper

advertisements, local newspaper advertisement, job search website advertisement, and private

employment firm advertisement failed to apprise U.S. workers of the COLA and thus did not

appropriately apprise U.S. workers of the job opportunity, in violation of § 656.17(f)(3).

According to the CO, “U.S. workers are not properly notified that they would be appropriately

compensated, based on the specific geographic area of assignment, which could impact whether

U.S. workers were willing to apply for the job opportunity.” (AF 2). As a result, the CO could

not conclusively determine that qualified U.S. workers were provided adequate information to

make an informed decision about whether to apply. See § 656.24(b)(2).

Neither the CO nor Employer filed briefs on appeal in the representative case, but the

Employer‟s “Request for Reconsideration/Request for Review” contained the Employer‟s

arguments regarding these denial grounds.

The Employer primarily argued that the COLA was a “per diem benefit payment” and

that BALCA has previously held that benefits need not be included in the PERM advertisements.

(AF 5); Emma Willard School, 2010-PER-01101 (Sept. 28, 2011). The Employer also

questioned whether a non-guaranteed benefit such as the COLA needs to be disclosed since the

wage is not required to be stated in the advertisements. The COLA, the Employer argued, is

something that is associated with required business travel and can be adjusted in the event that

the individual travels to a different location. It can even be increased, decreased, or replaced by

other compensation at any time. To hold that such a benefit needs to be disclosed would mean

that any benefit, for example parking or gym memberships, would need to be disclosed, and such

a level of disclosure is unsupported by the regulations.

DISCUSSION

For the reasons stated below, we find that: (1) the Employer‟s COLA is a wage

adjustment and not merely a per diem payment; (2) because the wage is not required to be stated

in newspaper advertisements and in additional professional recruitment steps, a denial for failure

to state a locality pay adjustment based on § 656.17(f)(3) or § 656.24(b)(2) is not supported by

the regulations; and (3) the regulations could be reasonably construed to require statement of a

locality pay adjustment on a notice of filing in order to sufficiently apprise interested persons

about the job opportunity, but the Employment and Training Administration‟s (“ETA‟s”)

regulations, forms and instructions provide no notice of such an interpretation of the regulations

(nor a means for reporting such a wage adjustment on the Form 9089). Accordingly, we find

that a denial based on a lack of statement of a locality pay adjustment in the NOF in this case

cannot be sustained.

Benefit or Wage Adjustment

The Employer has characterized this COLA as a “per diem benefit.” (AF 6). The CO

characterizes it as an “adjustment of wages” that is dependent on the location of employment, or

a “per diem salary adjustment.” (AF 1-2). In the offer letter to the U.S. applicant, while “Base

Salary” is listed in one paragraph, in a separate paragraph, the letter discusses the “COLA” and

states in conditional terms that “as eligible” the employee “may” receive an annualized amount

of $6,000 for Washington, D.C.6 and that this is “subject to regular review and may be increased

or decreased, or replaced by another compensation component upon certain promotions.” (AF

124).

First, we reject the characterization that this is a per diem benefit. According to the offer

letter, the COLA is a set amount “per pay period” and paid on the “15th

and last day of each

month . . . along with [the] regular base salary.” (AF 124). This characterization is not in line

with a typical “per diem” payment which generally refers to something paid on a daily basis, or

reimbursements for travel receipts or meals as they occur.7 A regular payment of money every

two weeks lumped together with a base salary is not a per diem benefit.

Second, despite the conditional nature of the COLA, we find that it is a wage adjustment,

and therefore is part of a wage offer. Even though the exact amount may change, this payment is

set at a certain amount per pay period and it is paid along with the base salary every two weeks.

Furthermore, this COLA is similar to the federal government‟s locality pay—where the general

schedule pay scale is adjusted according to where a federal worker lives so that workers in

certain areas of the country are paid more to adjust for their locations‟ cost of living. In a case

dealing with whether a plaintiff was entitled to interest on an award, the U.S. Court of Federal

Claims stated “the plain language and legislative history of [the Federal Law Enforcement Pay

Reform Act] indicate that the locality pay benefit is a „special pay adjustment‟ to be considered

part of „base pay.‟” Crowley v. U.S., 57 Fed. Cl. 376, 381 (2003). The court quoted a 1990

Conference Report discussing the Federal Law Enforcement Pay Reform Act which stated: “The

locality adjustment is considered part of base pay for the computation of overtime, life insurance

and retirement benefits and are [sic] subject to bi-weekly pay limitations.” Id. at 381 (quoting

H.R. Conf. Rep. No. 101-906, at 90-91 (1990)). We find that, just as the federal government

characterizes the locality pay benefit as part of “base pay,” the COLA in this case must be

considered as part of the job‟s wages.

Apprising Workers in the Advertisements

The CO does not dispute the Employer‟s contention that it was not required to list “every

term or condition of employment and listing none does not create an automatic assumption that

none exist.” Emma Willard School, at 4. Furthermore, the regulatory history of the PERM

regulations state that “[t]he regulation does not require employers to run advertisements

enumerating every job duty, job requirement, and condition of employment . . . As long as the

employer can demonstrate a logical nexus between the advertisement and the position listed on

the employer‟s application, the employer will meet the requirement of apprising applicants of the

job opportunity. . . .” 69 Fed. Reg. 77326, 77437 (Dec. 27, 2004).

However, as this COLA is not a benefit, but instead a wage, the Employer‟s contention is

immaterial to this case. The CO stated that the job order, newspaper advertisements, and

additional recruitment steps were deficient pursuant to § 656.17(f)(3). As § 656.17(f) only

applies to newspaper advertisements, citing § 656.17(f)(3) for a violation in the job order and in

the additional recruitment steps is not a valid denial ground and we reverse the CO in that regard.

See Symantec Corp., 2011-PER-01856 (July 30, 2014) (en banc); Fidelus Technologies, 2011-

PER-01635 (June 11, 2015).

In regards to the newspaper advertisements, § 656.17(f)(3) requires that the Employer

“[p]rovide a description of the vacancy specific enough to apprise the U.S. workers of the job

opportunity for which certification is sought.” However, it has been established that a wage need

not be listed in the advertisements. 69 Fed. Reg. at 77348 (“ . . .we have revised this final rule to

eliminate the requirement that the wage offer must be included in the advertisement”).

Therefore, if the wage, which includes the COLA, is not listed in the advertisements, there is no

violation of the regulations, and it is not a failure to provide a specific enough description of the

vacancy. If the Employer had listed a wage less than that offered to the alien then it is possible

that the CO may find a deficiency. Id.; see also § 656.17(f)(7). Because the Employer did not

list the wage in the advertisements, however, § 656.17(f)(3) is not a valid denial ground. The

CO also cited § 656.24(b)(2) in relation to the fact that he was unable to determine if there was a

U.S. worker able, willing, qualified and available for the job opportunity. Since the

advertisements were not deficient, § 656.24(b)(2) is not a valid denial ground because the

advertisements did sufficiently recruit for a U.S. worker. We therefore reverse the CO‟s denial

as to the newspaper advertisements.

The Notice of Filing

The CO also states that the NOF is deficient because, pursuant to § 656.10(d)(4) and

§ 656.17(f)(3), the NOF needed to contain all the requirements of § 656.17(f) in addition to

stating the rate of pay and other information as required by § 656.10(d)(3). The CO explained

that not disclosing the COLA adjustment of wages in the NOF did not fully apprise viewers of

the NOF of the actual terms and conditions of employment. While the CO may not have taken

the most direct route in articulating his problem with the NOF, this much is clear—the CO

believed that the COLA should have been disclosed. The NOF, unlike the advertisements, is not

only a recruitment tool, but is an implementation of a statutory notice requirement designed to

assist interested persons in providing relevant information to the CO about an employer‟s labor

certification application. Voodoo Contracting Corp., 2007-PER-00001 (May 21, 2007). The

NOF must state the wage rate with enough specificity to actually apprise any interested persons

as to whether they wish to report relevant information to the Department of Labor. When an

employer has a base wage and salary structure which includes a locality adjustment offer, failing

to list the locality adjustment could reasonably be found to be a failure to properly state the wage

in contravention of § 656.10(d)(4).8 The CO‟s cited deficiency is a reasonable interpretation of

the regulations. However, we decline to find a violation in this case.

PERM is an attestation based program “intended to streamline the application process

and allow the CO to grant or deny an application based solely on the application.” Michigan

Technological University, 2011-PER-00790, slip op. at 6 (May 21, 2012) (internal citations

omitted). This attestation-based program “places [a] heavy burden on employers to be careful in

preparing their applications, [but it also] puts a related burden on the CO to ensure that

employers have adequate guidance on what will be demanded of them.” Infosys Ltd., 2016-PER-

00074, slip op. at 10 (May 12, 2016). Although we conclude that the regulations could

reasonably be interpreted to require an employer to state a locality wage adjustment on a NOF,

consistent with our finding in Infosys, supra, we find that “ETA has issued no guidance

whatsoever alerting employers to the CO‟s position that [this type of wage adjustment] needed to

be specifically disclosed in the application and advertising. Thus, even assuming that the CO

could reasonably demand [the disclosure of the COLA], the need for such a disclosure is hardly

self-evident and nothing would have informed this Employer of its responsibility in [this]

regard.” Infosys Ltd., 2016-PER-00074, slip op. at 11 (May 12, 2016) (footnote omitted). We

also note that there is neither an instruction nor a current mechanism by which an Employer may

enter this information on the Form 9089.

Therefore, despite the CO‟s identification of a valid issue and his reasonable

interpretation of the regulations, absent ETA having provided employers notice of its regulatory

interpretation concerning the requirement that COLAs be disclosed and a mechanism by which it

can be accommodated, we decline to affirm a denial based on failure to state a locality pay

adjustment on a NOF, in advertisements, or on the Form 9089. See Federal Insurance Co.,

2008-PER-00037 (Feb. 20, 2009) (Board declines to enforce a regulatory requirement where

there was lack of effective notice to the public on how to comply with the requirement).

ORDER

Based on the foregoing, IT IS ORDERED that the denials of labor certification in these

matters are REVERSED and that they are REMANDED for certification pursuant to 20 C.F.R.

§ 656.27(c)(2).
