Additional vegetation has grown in some areas around the site acting as a temporary cover for underlying waste. Corrective Actions: Until such time remediation actions are implemented by USFWS under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), the final cover shall function with minimum maintenance and provide waste containment to protect public health and safety by controlling at a minimum vectors, litter and waste migration into California State waters for public health, safety and the environment. The property owners shall continue to work with the LEA on a response plan with implementation timelines to bring the site into compliance with state regulations for a closed solid waste disposal site. Continue to provide the LEA with updates on the status of the USFWS Engineering Evaluation and Cost Analysis (EE/CA) being conducted at the Sweetwater Marsh Unit (Operable Unit 1). X 20820 - Drainage and Erosion Control Comments: The coconut fiber logs installed along the connector marsh embankment appears to be aiding in reducing eroding burn ash migration into the salt water due to tidal flushing. The lower fiber logs did appeared to be encrusted with soil (Photo #1). A chunk of eroding burn ash had accumulated on the west side of one of the lower fiber logs. The tide was raising during the inspection and expected to rise to 4.1 feet which would cover the lower fiber logs (Photo #2). The wooden stakes holding up some of upper fiber logs were becoming unearthed and leaning over. Soil above the upper fiber logs was observed wet and may have been from the previous day s high tide of 6.1 (Photo #3). Corrective Actions: USFWS shall provide updates on the quarterly reports submitted to the LEA with the conditions and effectiveness of the fiber rolls installed at the site as part of erosion controls, secure and replace the fiber rolls as necessary to minimize eroding burn ash for public health and safety hazards. Prior to disposal, the fiber logs shall be analytically tested to determine if soil absorbing on the fiber logs is hazardous. Inspection Report Comments:

General Comments: Two employees with the City of Chula Vista were painting over the graffiti along the bike path at the south eastern perimeter (Photo #4).

The hole in the fence along the southeast perimeter of the site that had been previously repaired was once again open allowing for the potential unauthorized access to the neighboring under-brush (Photo #5).

A wildlife camera was observed to have been installed to monitor on-site activities. No unauthorized encampment were observed during this inspection.

Dense vegetation has grown along the southern open access point across the railroad tracks but a small path had been made along the east side of the tracks.

The USFWS signs posted on-site were in place but some continue to be defaced with graffiti.

On May 10, 2017, USFWS provided the LEA with the results of their first quarter site patrols and corrective action to be taken within the next 12 months. Except for trespass, no report of unauthorized activity. No change in the physical condition of the Gunpowder Point/Paradise Marsh Burnsite was noted. Long-term corrective actions are pending results of the EE/CA for burn as deposits. The draft EE/CA is being reviewed by the Solicitor, Regional and field offices.

The LEA has not received the quarterly reports from the California Department of Transportation, Metropolitan Transit System or the San Diego Gas and Electric for the first quarter of 2017. Site inspections shall be summarized and provided to the LEA on the following frequency: Site patrols for January, February, and March are due May 1, records for April, May and June are due August 1, records for July, August and September are due November 1, and records for October, November and December are due February 1.
