b) Update from Three Rivers Park DistrictKelly Grissman from Three Rivers Park District (TRPD) overviewed their recentactivities and the proposed acquisition on Little Long Lake.

There will be a public engagement plan to be made with City Staff for LakeMinnetonka Regional Park & Carver Park Reserve Master Plan.

The Kingswood acquisition is in process. The next step will be presenting it to thePlanning Commission and then at the Council for final approval.

c) 2018 Financial Audit (CAFR) PresentationRepresentatives from Clifton Larson Allen overviewed the 2018 Comprehensive

Accounting Financial Report. Highlights included:

The general fund decreased by $52,226 at the end of 2018 from 2017. The City had budgeted to use $361,830 from the general fund 2018. There was a positive variance of about $309,604. Total general fund expenditures were $69,846 under budget.

Revenues were about 5% higher than what was budgeted. Most functions and departments came in pretty close to budget overall for

expenditures in the general fund for 2018. General fund balance at the end of 2018 is $2,845,022. $397,484 of that

balance is allocated in the 2019 general fund budget. Auditors’ opinion on the overall financial statements is an unqualified opinion

which is the best opinion a City can receive on its financial statements. This will be available on the City’s website Motion by Tschumperlin, seconded by Bruce to accept the 2018 Financial Audit Report as presented. Motion carried 5-0. Absent: None

RESOLUTION APPROVING JUST AND CORRECT CLAIMS AGAINST CITY FUNDS

WHEREAS, the City Council of the City of Minnetrista, pursuant to MS 412.241, shall have the full authority over the financial affairs of the City; and

WHEREAS, the City Council reviewed the Claims for payment, with checks numbered 63818 through 63871; electronic checks E1001471 through E1001479; Claims batch includes electronic transfers for payroll in the amount of $69,498.87.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MINNETRISTA, that the attached list of claims in the amount of $332,531.21 is hereby approved.

Issue This agenda item seeks Council approval of a Resolution accepting the cash donations of funds related to covering costs for the pig races that were a scheduled event this year at Trista Day.

Background

Sponsorship dollars were asked for to cover the event for 2019 for pig races at Trista Day. Multiple area and community organizations stepped up to contribute and helped sponsor the event.

We thank the individuals/businesses listed in the resolution for their generous donation/sponsorship, and note that they make this contribution without any return consideration of any kind by the City of Minnetrista, now or in the future. The entities listed received notation in Trista Day literature and brochures and on the City website.

Recommended City Council Action: City staff recommends approval of Resolution No. 62-19 Accepting the donations of $3,100 from multiple businesses/individuals that were collected for covering costs associated with the Trista Day pig races

RESOLUTION NO. 62-19

CITY OF MINNETRISTA

RESOLUTION ACCEPTING SPONSORSHIP MONEY FOR TRISTA DAY

WHEREAS, the attached list (Exhibit A) of “Donor(s)” wishes to make a cash donation/sponsorship to the City of Minnetrista in the amount of $3,100 to cover costs related to the City to sponsor an event of pig races at Trista Day; and

WHEREAS, the Donor(s) willingly gives this money to the City of Minnetrista without the expectation of any remuneration or any return consideration of any kind by the City of Minnetrista towards the Donor(s); and

THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF MINNETRISTA, to approve the Resolution, accepting the donation under the terms and conditions expressed above.

This resolution was adopted by the City Council of the City of Minnetrista on the 3rd day of June, 2019 by a vote of ____Ayes and ____Nays.

Ready Watt Electric Outdoor Warning Siren Service Agreement

Issue: The city currently has a network of 16 outdoor emergency warning sirens. Each siren has two basic parts: the controller and the siren. The controller is built by Healy Ruff and allows the unit to communicate with the Hennepin County Dispatch system. It is the controller that allows for monthly testing and emergency tripping of the siren. Embedded Systems Inc. has a proprietary maintenance agreement with Healy Ruff. Embedded Systems has been providing maintenance of these units since they were installed.

Ready Watt Electric works with Embedded Systems to provide preventive maintenance for the other components (other than the controller or radio) of the outdoor warning sirens. Ready Watt Electric has been providing this maintenance of these units since they were installed.

Fiscal Impact: The fiscal impact to the city is a cost of $7360.00 per year for four years (2020–2023). The total cost of the four year preventive maintenance agreement is $29,440.00.

A public hearing has been scheduled for June 3, 2019, to consider adopting the assessment for

the 2019 Street Improvement Project, City Project No. 01-19.

Background/Discussion/Conclusion:

The assessable portion of the 2019 Street Improvement Project, City Project No. 01-19, is

proposed to be funded by the street reconstruction fund, supported, in part, by special

assessments. On May 6, 2019, Council ordered the preparation of the proposed assessments and

called for the hearing on the assessments. The amount to be assessed was declared to be

$222,210.83.

The City’s existing assessment policy states that the benefiting property owners be assessed for

50% of the total street and storm sewer improvement costs. The amount proposed for

assessment is 50% of the total project costs.

The proposed assessments are for the improvements to D’Chene Lane, D’Chene Circle, and Ox

Yoke Circle, with all property assessments equal to 1 REU (residential Equivalent Unit). One

REU is $8,546.57 per parcel. The total amount to be assessed as recommended by staff is

$222,210.83.

A list of the properties to be assessed with proposed assessment amounts is attached.

Fiscal Impact:

The as-bid project cost for the assessable portion of the 2019 Street Improvement Project, City

Project No. 01-19, is $444,421.66, and is proposed to be funded by the street reconstruction

fund, supported, in part, by special assessments in the amount of $222,210.83 to benefiting

property owners. The assessments will be levied for a 20-year period at an interest rate of 5.00%

CITY OF MINNETRISTA HENNEPIN COUNTY, MINNESOTA

A RESOLUTION ADOPTING ASSESSMENT FOR

2019 STREET IMPROVEMENT PROJECT (CITY PROJECT NO. 01-19)

WHEREAS, pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessment for the assessable portion of Improvement No. 01-19, which includes improvements to D’Chene Circle, D’Chene Lane, and Ox Yoke Circle. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MINNETRISTA, MINNESOTA:

1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it.

2. Such assessment shall be payable in equal annual installments extending over a period

of 20 years, the first of the installments to be payable on or before the first Monday in January 2020, and shall bear interest at the rate of 5.00 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from November 1, 2019 until December 31, 2020. To each subsequent installment, when due, shall be added interest for one year on all unpaid installments.

3. The owner of any property so assessed may, at any time prior to certification of the

assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid any time on or before November 1, 2019; and he/she may, at any time thereafter, pay to the City Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year.

4. The owner of any property so assessed may, at any time prior to certification of the

assessment of the first installment to the County Auditor, pay to the City Treasurer any portion of the assessment. The remaining unpaid balance shall be spread over the period of time established by the Council for installment payment of the assessment.

5. The clerk shall forthwith transmit a certified duplicate of this assessment to the County

Auditor to be extended on the property tax lists of the County. Such assessments shall be collected and paid over in the same manner as other municipal taxes.

Subject: Satisfaction of Contingencies Related to Purchase of Property

at 9400 T.H. 7

Issue: The city council is being asked to consider a number of items related to the city’s purchase of property at 9400 T.H. 7 for a water tower and possible related uses in the future.

Background: On April 1, 2019 the city council authorized execution of an agreement to purchase two acres of land (now 2.3 acres) at 9400 T.H. 7. That land is being subdivided from a larger parcel of slightly more than 70 acres. The purchase agreement was subsequently signed by the property owners and is now a binding agreement, subject to contingencies. This agenda item addresses and resolves some of the outstanding contingencies. Closing is scheduled for June 14, 2019.

Discussion: Soil Conditions. A major contingency in the purchase agreement is that the city find that there are “no conditions that would interfere with the [city’s] proposed use” of the site. This is a broadly worded contingency relating to whether the soils and other environmental or physical conditions on site are suitable for construction of a water tower and, potentially, other related uses.

Attached hereto as Exhibit A is a report from SEH dated May 21, 2019 entitled “Preliminary Geotechnical Investigation for 9400 Highway 7 Site.” The report concludes that limited soil correction (estimated cost of $40,000 - $45,000) will likely be necessary to support a water tower. The report concludes that “the site would be suitable to construct the proposed water tower in conjunction with the assumptions described” in the report. The report includes a Soil Bearing Report prepared by Braun Intertec dated May 17, 2019. The city council is asked to accept the SEH report as satisfaction of this contingency.

Simple Subdivision. In order to create a parcel for the city to purchase, the land needs to be subdivided. This type of land division qualifies as a simple subdivision under city code. The city council is asked to approve the simple subdivision resolution in the form attached hereto as Exhibit B. Release of Open Space & Agricultural Preservation Easement. In connection with a prior lot division on the larger parcel, the city required the owner to enter into an Open Space & Agricultural Preservation Easement. That easement restricts use of the property. The sellers required as a condition of the deal that the city release the easement over the entire property. The city council is asked to approve a release of that easement in the form attached hereto as Exhibit C. Reimbursement Resolution. The city intends to finance construction of the water tower with tax exempt bonds. The city is spending money now (land acquisition and related costs) for which it will want to be reimbursed from bond proceeds. Federal tax law requires that the city adopt a reimbursement resolution to preserve its ability to do so. The city council is asked to adopt a reimbursement resolution in the form attached hereto as Exhibit D. Adoption of the reimbursement resolution does not commit the city to the use of bonds to finance the water tower. It merely allows the city to reimburse itself for these early costs if it ultimately chooses to bond for the project. Xcel Easement. The property is subject to a power line easement. The easement was recorded in the 1950s and is undefined, meaning it technically covers the entire site. This is not uncommon in rural areas. The city is working to have Xcel define (specify its location), which is believed to be adjacent to the highway. Leases. Another contingency in the purchase agreement is that there be no leasehold or other interests affecting the property which would prevent the city from using the site as proposed. In 2018 the fee owner entered into a lease with U.S. Solar Development for the location of a solar garden on the property. The lease covers all of the seller’s property, including the site being purchased by the City. U.S. Solar Development has agreed to amend their lease to exclude the city’s parcel. That document has not yet been presented to the city but is a requirement before closing. Site Plan. Attached as Exhibit E is a conceptual site plan showing a water tower, well and water treatment plant located on the site. The only purpose of the site plan is to demonstrate that the parcel is large enough to accommodate the water tower and the other uses if the city decides to add them in the future. The city council is not asked to take any action regarding the site plan. Conclusion: The actions outlined in this report are ones that city council should take to satisfy various contingencies in the purchase agreement for the water tower site at 9400 T.H. 7.

RESOLUTION APPROVING A SIMPLE SUBDIVISION OF

PROPERTY LOCATED AT 9400 T.H. 7 FOR

S & RB INVESTMENTS, L.P.

WHEREAS, the city of Minnetrista (the “City”) is a municipal corporation,

organized and existing under the laws of Minnesota; and

WHEREAS, the City has adopted a zoning ordinance and subdivision regulations, which are codified in chapter 5 of the city code, to promote the orderly, economic and safe development and utilization of land within the community; and

WHEREAS, S & RB Investments, L.P. DECLARING THE OFFICIAL INTENT OF THE

CITY OF MINNETRISTA TO REIMBURSE

CERTAIN EXPENDITURES FROM THE PROCEEDS

OF BONDS TO BE ISSUED BY THE CITY WHEREAS, the Internal Revenue Service has issued Treas. Reg. § 1.150-2 (the “Reimbursement Regulations”) providing that proceeds of tax-exempt bonds used to reimburse prior expenditures will not be deemed spent unless certain requirements are met; and WHEREAS, the City of Minnetrista, Minnesota (the “City”) expects to incur certain expenditures that may be financed temporarily from sources other than bonds, and reimbursed from the proceeds of a tax-exempt bond; WHEREAS, the City has determined to make this declaration of official intent (the “Declaration”) to reimburse certain costs from proceeds of bonds in accordance with the Reimbursement Regulations. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MINNETRISTA, MINNESOTA AS FOLLOWS: 1. The City proposes to undertake the acquisition of property related to the construction of a water tower in the City (the “Project”). 2. Accept professional services proposal for construction engineering services for the 2019

Street Improvement Project.

Background:

The City approved plans and specifications and authorized the advertisement for bids for

the 2019 Street Improvement Project, City Project 01-19, on March 18, 2019. The

project includes mill and overlay of the roadway pavement along Burl Oaks Drive, Burl

Oaks Court, Glacier Court, Hunters Court, and Pheasant Crossing; the reclamation of the

existing bituminous pavement along D’chene Lane, D’Chene Circle, and Ox Yoke

Circle; the reconstruction the City Hall Parking lot; and paving 100’ of Ingerson Road.

The City received bids on April 16, 2019, and awarded the contract on May 6, 2019.

Discussion:

As part of the engineering services for the project, staff requested a professional services

proposal from WSB to perform the construction engineering. Construction engineering

services include, construction observation, construction staking, engineering construction

management, meetings, construction administration and documentation, and construction

materials sampling and testing. Full-time construction observation is not anticipated due

to the scope of the work. The fee estimate assumes that a construction observer will only

be present for five hours per day while construction is occurring. WSB has provided the

scope of services and estimated fees in the amount not to exceed $59,119 without prior

Council authorization.

Conclusion:

Staff is recommending Council approve the proposal for professional services from WSB

and Associates, Inc. for the 2019 Street Improvement Project, City Project 01-19.

Fiscal Impact:

The 2019 Street Improvement Project, City Project No. 01-19, base bid costs are funded

by the street reconstruction fund and assessments to benefitting properties identified in

the feasibility report. The bid alternate costs are funded by the Building Maintenance

Fund. The construction bid amount is $739,659.25 and proposed indirect costs are within

the indirect costs identified in the resolution declaring costs.

Project Understanding

• Construction fees are based upon the proposed construction schedule beginning themiddle of June through September 27, 2019, for major construction and the punch listand final pavement course work completion by October 15, 2019.

We are proposing to complete the work on a cost-reimbursable basis in accordance with our current fee schedule.

Issue Mr. Robert Goodman began as Building Inspector on June 5, 2018 and was required to successfully complete a probation period of one year in order to move from probationary status to full-time status consistent with the personnel handbook.

Background Mr. Robert Goodman bested 3 other applicants and began his employment with the City of Minnetrista on June 5, 2018; and as a new hire, is required to spend one year as a probationary employee. After receiving an excellent performance review from Mr. David Abel, Community Development Director and Robert’s immediate supervisor, it is recommended that Mr. Goodman move from probationary status to full-time status. A rate of pay increase was agreed upon at hire of 2% but is no longer valid as Robert has applied for an internal promotion with the City to Building Official and this comes with an independent pay grade change and pay adjustment.

Summary The Council action is to move Mr. Robert Goodman from probationary to full-time status, effective June 5, 2019.

Recommended City Council Action: Recommend approval of Resolution No. 68-19 moving Mr. Robert Goodman from probationary status to full-time status, effective June 5, 2019, the one year anniversary from his date of hire, based on an excellent performance review and staff recommendation.

CITY OF MINETRISTA

RESOLUTION APPROVING A STATUS CHANGE FROM PROBATIONARY TO FULL-TIME FOR ROBERT GOODMAN, BUILDING INSPECTOR

EFFECTIVE JUNE 5, 2019

WHEREAS, Mr. Robert Goodman was hired on June 5, 2018, and served the required one year as a probationary employee, consistent with the city’s Personnel Handbook; and

WHEREAS, Mr. Robert Goodman received an excellent performance review by his direct supervisor, Community Development Director David Abel, on his performance during his initial 12 months of employment; and

THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF MINNETRISTA, to approve the change from probationary status to full-time status for Mr. Robert Goodman, Building Inspector, effective June 5, 2019, the anniversary date of his hire.

Approval for Promotion of Robert Goodman from Building Inspector to Building Official

Issue The Personnel Committee met on May 29, 2019 and is recommending the Council accept a recommendation for promotion of Robert Goodman from Building Inspector to Building Official effective June 5, 2019. Robert has served as Building Inspector since hired on June 5, 2018. The goal at the time of Robert’s hire was to bring in an entry level employee to allow for future staffing changes, growth, and development.

Robert Goodman has done an excellent job over the last year, and with the increase in responsibilities that include plan review and additional licensure, the growth in our City inspections and permitting needs, and within the building department, Robert is currently demonstrating competency in the Building Official job description and is ready for this role. This promotion also allows us to retain talent, backfill Robert’s position with an inspector, and support the continuity needed for continued quality customer service. Robert receives praise from residents and builders in the area for his personability, knowledge, and customer service.

Summary

The Building Inspector position is graded at Grade 10 in the city’s job hierarchy, and the Building Official position is graded at Grade 13. Robert’s pay is currently at grade for the Building Inspector position in our pay grading system and will need to be adjusted to the entry point of the Building Official pay grade. This promotion maintains the bottom pay level listed in our advertisement to fill the Building Official position when vacated by Jesse Szykulski and Robert demonstrates equal, if not greater, industry experience than the other two applicants for this posted position. Robert’s initial pay rate will go from $27.23 per hour to $33.50 per hour.

RESOLUTION PROMOTING ROBERT GOODMAN TO BUILDING OFFICIAL

WHEREAS, Robert Goodman began employment for the City of Minnetrista on June 5, 2018, as Building Inspector; and

WHEREAS, Robert Goodman has successfully worked in the Inspector position since his time of hire, and, based on his performance and additional certifications over this past year, along with the growth of the City inspections and permitting and his increased responsibilities with plan review, is now ready to move into the Building Official position; and

NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF MINNETRISTA, that Robert Goodman be promoted to Building Official at a new rate of $33.50 per hour as recommended in the action item before the City Council for approval, effective date of the promotion to be June 5, 2019.
