IwasrecentlyaskedbyafriendandcolleaguehowIcametousetheword“Gratefully”inlieuof
“Sincerely”or“Faithfully”whenclosingcorrespondence.Asweapproachtheendofharvesttime,withfarmstandsdisplayingmountainsofpump-kinsandmarketsstockinguponturkeys,stuffing,andcranberrysauce,itseemsanappropriatetimetoreflectagainontheroleofgratitudeinourlives.
Beingthankfulchangesme.AswiththeSamaritanleper,ittakesmebacktothesourceofmygratitudeandconnectsmetothatpersonorevent,remindingmethatIaminnatelylinkedtoanddependentuponothers.Beingthankfulencourageshumilityandhelpsmeacceptwhateveristherealityofasituationandmyplaceinit.Itembracesalargercontextandopensmeupbothtothoseinitandtothegreatergoodwehavethepotentialtorealize.AndwhenItakethetimetogivethankstoGodonadisciplinedbasis,itmakesmemoreandmorecognizantofGod’sengagementinthatgood.Givingthanksrelievesmyyearningforself-confidenceanddeepensmyGod-confidence.Intheparlanceoftwelve-stepprograms,ithelpsme“letgoandletGod.”
Givingthanksisdisarming.WhenIrespondinthanks,particularlytosomeonewhoiscriticaloforunhappywithme,itcanhelpbreakdownwhateverdividesus.Itreachesoutinawaythatmaylowerthetension,sometimesprovidingthefirststepstowardreconciliation.Thisisnottosuggestthatgivingthanksshouldbeemployedmanipulatively,ratherthatgenu-inegratitude,firstandforemost,disarmsthegrateful.Itishardtobethankfulwithaclenchedfist.Givingthanksrelaxesmyjawandmyheart.Itlowersmydefensesandleavesmemorevulnerable.Itputsmeinaposturemorecapableofacceptingwhatisandwhatmightbe.
Sometwenty-fiveyearsago,adifficultseriesofeventsledmetoadeeperacceptanceofmylifeandself,andtoamoreintentionalgratitude.Iwasleftwantingtoengagelifemorethroughtheperspectiveofagratefulheart,throughthedisarmedconnected-nessthatinclinestowardthegood,perhapseventhe
godly.OnesymptomofthatchangeofheartwasthatIfoundmyselfsigningnotesandletters“Gratefully,Mark.”Iconfessthatsometimesitwasastretch,butIsoonlearnedthatinthosesituationsinwhichitwasdifficultformetofindsomethingforwhichIwasgrateful,theobstacleinevitablywasinme.Iwasstrug-glingtoletgo,toletdownmydefenses,todisarm.
Recoveryprogramsteachaboutpracticingan“attitudeofgratitude.”Forme,beingthankfulindeedtakespractice.Itisaspiritualdiscipline,likeprayer,service,andgiving.Aswithallspiritualmuscles,itneedstobeexercisedinorderforittomakeadif-ference.WhenIamintentionallygratefultoGod,itincreasesmyconnectiontoGod,myconfidenceinGod,andmyvulnerabilitytoallthatGoddreamsforus.SoitalsoiswhenIamexpressiveofmythankful-nesstoothers.Itchangesme.
AsIprepareforthistenthDiocesanConventionofmytenureservingwithyouintheDioceseofOhio,myprayersarefilledwithcountlessrecollectionsofthingsforwhichIhavebeenandamthankfultoGodandtoyou:formomentsofdelight,challenge,for-giveness,andcommonpurpose;forcompanionshipintimesofgreatsorrowandgreatjoy;forgenerousexpressionsofenthusiasmandcaution;forpatienceandprodding;forencouragementandrestraint.
WhenwegatherinToledoforthe197thConventionofthisDiocese,wewillhaveimportantdecisionstomakeaboutthefutureofourchurch,togetherexploringandrespondingtothenewthingGodisalwaysdoingwithusandforus.InthespiritoftheGreatThanksgiving,thatrichestexpressionofourEucharisticlifeinChristJesus,mayourpersonalandcorporategratitudemoredeeplyconnectustoGodandoneanother,andopenusmorefullytoallthatGodimagineswemightbeanddo.

Convention-goersthisyearwillfocusonnewthingsastheydiscuss
thebusinessoftheDioceseofOhioNovember8and9inToledo.Topicsofdiscus-sionincludehowGodmaybecallingparishestonewthingsandhowthecampandretreatministrymightenableGodtodoanewthinginthelifeofourparishes.
WearehonoredtowelcometheBishopofBelize,theRt.Rev.PhilipS.Wright,whowilltelluswhathasbeenhappen-inginhisdioceseandgivehisperspectiveofourmutualcom-panionship.WewillcontinuewithupdatesonourBelizeandTangarelationships,St.John’s,Cleveland,theEpiscopalYouthEvent,theCommunityYouthGroupatHarcourtParish,andthetopicofadultformation.RepresentativesfromSt.Alban’sandSt.Paul’s,
ClevelandHeights,willsharehowtheirneighboringpar-ishesarecollaboratingonacommunityoutreachproject.BishopHollingsworthwillgivehisannualEpiscopalAddress,andthereistimesetasideforapresentationontheproposednewcampandretreatcenterandaninformativesessiononhowcapitalcampaignscanhaveapositiveimpactonacongregation’svitatlityandspiritualgrowth.Delegatesandattendeeswillagainparticipateintablediscussions,whichallowformorespecificprayeranddialogueaboutatopic,aspeopleareseatedaccordingtotheirmissionarea.

timeafter11:00amonFriday,November8,toregister,asthemeetingwillbeginpromptlyat1:00pm.TheEucharistwillbeheldatTrinityChurch,Toledo,whichislocateddirectlyacrossthestreetfromthehotel.Afterward,attendeeswillreturntotheballroomfortheannualconventionbanquetandreconveneonSaturdaymorningandadjournatapproximately3:00pm.
ResolutionsAsinyearspast,theannualResolutiononClergyCompensationwillbepresentedandvotedonatConvention.Thisyear,however,thenewthingontheballotproposestoraisefundsforanewCampandRetreatCenter.Theresolutionwoulddirectthediocesetobeginacapitalcampaigntofundanewcampandretreatministryattheproperty,cur-rentlyknownasHostileValleyParkinWakemanTownship,Ohio,andtoresolvetopurchasethe
propertyandbuildselectedfacilitiesoncesufficientfundsareinhand,whichwillbebasedonpledgesofcashgifts.Whileopinionsonthedetailsmaydiffer,anewcampandretreatcenteriswidelyrecognizedasbeingthecatalysttofurtherourcommitmenttoyouth,community,andimportantsocialandenvi-ronmentalissueswefacetodayandwillcontinuetoencounterinthefuture.
Changes to the Constitutions and CanonsOneamendmenthasbeenproposedtotheCanonsoftheEpiscopalDioceseofOhio,recommend-ingarevisionofthedutiesoftheMissionAreaCouncil.TherevisionremovesfromtheCanonswording,whichstatesthatthecouncilwillmeetbeforeConventiontodiscussnominations,changes,resolutions,andthebudget.Thischangeisproposedbecausemeetingshavebeenineffectiveandthereisconfusionaboutwhoshouldattend.Already-existingpre-conventionmeetingswouldremainopenforalltoattend.

ItishardtobelievethatithasbeenalmostthreeyearssinceIreceivedaphonecallfromtheRev.TomBrackett,theEpiscopalChurchCenter’s
MissionerforNewChurchStartsandMissionalInitiatives,invitingourchurchtobeapartofanewprojectcalledMissio:Engage.MissiogatheredagroupofEpiscopalChurchesfromacrossthecoun-trywhowereinterestedinstudyingandreflectingonchurchgrowthandusingtheinsightsfromtheirworktoimplementfreshexpressionsofchurchintheircommunities.Weweretobepartofthepilotgroup,whichwouldsharewhatwelearnedabouttheprocessandchurchgrowthwiththebroaderchurch.
St.Thomasassembledateamofevangelismveterans,plusafewnewfaces.WemettwiceamonthwiththeMissiogroupviaWebconference,
andcommittedto5hoursperweekofworkatSt.Thomastoaccomplishourgoals.Thefirstyearwasfilledwithalotoflearningandexamininganddiscussing.Howdowewelcomepeople?Howisourbuildingwelcoming?Whatdowedoinwor-shipthatcreatesasenseofwelcome?Welookedateverythingfromsignagetobulletinboardstogreeterministry.Wereadaboutplanningandadvertisingevents,usingthecalendareffectivelyandcoordinat-ingeventswiththebroadercommunity.Oftentheideaswerenotnew,butwehadtoadmitweneededtoworkbetterandsmartertousethemeffectively.
Fromthisexercisecamemyfavoritequestion:Whatwouldyourchurchdoif200visitorsshowedupnextweek?Ofcourse,ourresponsetothatwasthatwedidn’thavetoworrytoomuchaboutitbecausethatwouldneverhappen.Butthegeniusof

TomBrackettisthathethinksbigandheencour-agedustodothataswell.Weare,infact,totallyunpreparedfor200guests,notjustinvolumebutalsobecauseitwouldchangethecultureofourchurch.Thistruthforcedustoconfronttheresis-tancewehavetosignificantchange,whichkeepsusstuckinpracticesthatinhibitratherthanencouragegrowth.Itchangedusasachurchandasevangelists.
BelovednessThisgroupwasneverjustaboutgrowingthechurch.ItwasalwaysandemphaticallyaboutbringingtheloveofJesusChristintoourneighborhood.WhenTomtalkedaboutbelovedness,abouthowmuchGodwantsustoknowwearelovedandhowthatisthecriticalmessagewe,asGod-followers,mustcarryintotheworld,hemovedmetothecoreeverytime.Althoughtherearealotofchurchgrowthprogramsoutthere,thereisonlyonemessage:Godabsolutely,completely,withoutreservationandanylogicalexplanation,lovesus.Everyplanwemade,everyinitiativewetook,carriedthatmessage.
Aspartofthepilotgroup,thenationalchurchpaidforacomprehensiveanalysisofathreezipcodeareaaroundSt.Thomas,andforthreesetsofdirectmailingstonewresidentsinthosezipcodes.WealsoreceivedagenerousMissionEnhancementGrantfromtheDioceseofOhiotoplantheeventswe
wantedthesenewcomerstoattend.Wehadcommu-nitykiteflyingevents,freebabysittingforholidayshoppers,ananti-bullyingfairandarecyclingevent.Mostofthosethingsworkedwellandsomewerea
flop.Eachonetaughtusanewlessonaboutplan-ningorhospitalityorthesheerabundanceofGod.Eachoneimprovedoursenseofgraceandoursenseofhumor.
ItwasasourtwoyearMissiostintwascomingtoaclosethatIsaidtotheteam,“AsourfinalMissiohurrah,whatdoyouthinkabouthavingarevival?”Therewere5peoplearoundthetableandeachfacehadadifferentexpression,rangingfromjubilanttoterrified.Ireallyhadnoideaatthatpointwhatitallmightlooklike,butIknewIwantedacelebrationoftheloveofJesusChrist,andIwantedittobein
ourneighborhood.Sowestartedtoponderwhat
anEpiscopalRevivalmightlooklike.Wetalkedaboutthebaggagethetermrevivalcarriedandhowwemightredeemittoitstruestmessage—arevivalofthespiritthatwould,atatimewhenmanypeoplearelookingtoreconnectwithchurch,givepeopleachancetotrysomethingnewinasafesetting.Wewantedittobeintheneighborhood:publicworship.Wesuspectedthatourneighborswonderedwhatwentoninsidethechurchandthiswouldgivethemachancetosee.Mostly,wewantedeveryonetofeelwelcome.

This truth forced us to confront the resistance we have to significant change,
which keeps us stuck in practices that inhibit rather
than encourage growth.

Sotheplanningbegan.Wedecidedtodoathree-dayevent.Wewanteddifferentstylesofworship,excitingpreaching,andreallygoodmusic.Wehopedthatatwhateverpointpeopleconnectedwiththerevivaltheycouldgettoknowus.Wethoughtourfirstserviceshouldbetotallyoff-campus,inthepark,inthegazeboorpavilion,afavoritemeet-ingspotandwellknowntotheresidentsofBereaandthesur-roundingcommunities.Theothertwoservicesmightbeinthepark-inglotunderatent.Afterall,tentsandrevivalsgotogether.
God Pitches His TentGodintervenedatsomanypoints.Hereisoneexample:Whenwestartedpricingtents,werealizedtheyareexpensive,wehadnoconnectionsinthetentrentalbusiness,andthecostwouldlimitourabilitytospendwhatwewantedtoonthemusic.Thecitychargedusmoneyforrentingthepavilioninthepark.Whatwedidn’trealize,however,wasthatchurchesareentitledtoreservethespaceatnocost.WhenthemayorofBereadiscoveredtheerror,
hepersonallycalledtheofficetogiveusthegoodnewsthatourmoneywouldberefunded.And,bytheway,hewondered,didweneedatent?Becausethecityhadonewecoulduseforfreeandtheywouldsetitupandtearitdownforus.Wow!
TheFridaynightgatheringintheparkwasallabouttellingtheworldthatchurchmeanssomethingtous,thatitmattersinourlives.WecreatedanEveningPrayerservicethatincludedaChristianbandwithcontemporarymusic,andlotsoftestimony.Theservice
wascalled“LetterstotheChurchinBerea,”whichmimicsSt.Paul’sletterstocommunities.(IhadheardofapriestinMassachusettswhousedthisastheepistleinherserviceonceamonth,andIlovedtheidea.)Iaskedthreeofouryoungpeopletogivetestimonies,andtheyallagreed.IalsoaskedtheRev.CanonWillMebanefromTrinityCathedraltopreach.Aftertheservice,wehadfreefoodandthebandplayedaconcert.
SaturdaynightwasGospelnightunderthetentinourchurch’sparkinglot,usingourtypicalSaturdaynightserviceformat.TherewasaGospelchoir,

CanonMebanepreachedonceagain,andwefolloweditwithapotlucksupper.SundaywasatraditionalRiteIIservicewithajazzensembleandafancycoffeehour,alsounderthetentatthechurch.
Therewereglitchesalongtheway.Wehadahardtimenail-ingdownmusicians,weweren’tsurehowtheprojectionscreensweregoingtoworkattheparkorintheparkinglot,andwewereafraid,forawhile,thatwecouldn’tusetheparkinglotadja-centtothepaviliononFridaynight(Lesson:Alwaysask,“Doesaparkinglotcomewiththat?”).Buttheteamwasrelentlesslypositiveandtheparishmemberswerealwayshelpful.
Now for the ComplaintsSomepeoplesaidtheydidn’tunderstandwhytheeventhadtobeoutsidewhentherewasaperfectlygoodchurchinwhichtoworship.Othersworriedaboutfindingaparkingspacewithatentintheparkinglot.Peopleworriedthatthechairswould
beuncomfortable(towhichIreplied,youmeanasopposedtothecomfortofthepews???)Andsomejustfoundthewholeideaofarevivaldistasteful.IacceptedthatnoteveryonewouldbeasexcitedasIwas.Itcomeswithanychange.
Theresults,however,weresoworthit!Fridaynighttheweatherwasperfect,thesetupwentsmoothly,thetestimonieswereinspiring(checkthemoutonourWebsite:stthomas-berea.org).Peoplewhowereridingbyontheirbikesorwalkingpaststoppedandlistened.Thefoodaftertheservicewasperfectandtheparishmembersinvitedeverybreathingcreaturetocome,eat,andlistentomusic.Fourmemberswentoutintothe
surroundingareatoinvitefolkstojoinus,andthereststayedatthepaviliontowelcomethosethatcame.Noonesatalone.Noonewasexcluded.TheSpiritwastangible,andwewereonfire.Therewerecertainlypeoplewhodidn’tjoinus,buttheyhadnoquestionaboutwhethertheywerewelcome.
A Bold and Graceful Witness
Saturdaynight,underthetentintheparkinglotwithagoodcrowdinattendance,Iwasprofoundlystruckbythefactthatwewereprayinginfrontofourneighbors.AswesaidtheLord’sPrayertogether,Ifeltthestrengthofawitnessthatshowedthatwewerereasonable,passion-ate,andworthpayingattentionto,worthjoining.NoonecouldquestionwhoorWhoseweare.Weprayedourheartsout,anditwasalovelysighttobehold.Sundaymorningwasthesame,aboldandgracefulwitnessofbeautifulandmeaningfulwor-shipforalltosee.
Someofourmemberscameupafterwardandsaid,“Weweren’tsureaboutthis,butitturnedoutOK.”Othersweremoreenthusiastic.EveryonewhocamefelttouchedbytheSpirit.Somenewcomershavecomeback,andafewarestillcoming.Iamconfi-dentwewillseetheresultsofthisrevivalformonthstocome.AndthenameSt.ThomasEpiscopalChurchwillbeassociatedwithwelcome,hospitality,andbeing“notyourGrandfather’sEpiscopalChurch.”

OnNovember9thinToledo,DiocesanConventionwillconsideraresolu-tiontobeginacapitalcampaignfor
buildinganewcampandretreatcenterinWakemanTownship,Ohio.Delegatestocon-ventionshouldbeabletomakeaninformeddecisiononarevisedmasterplanforthenewcenter.Passingtheresolutionwouldputinmotionsomeimportantnextstepsforthediocese.
Ifthecapitalcampaignissuccessful,DiocesanCouncilwillthendeterminewhetherthedioceseshouldpurchasetheprop-ertyandwhentostartconstruction.
Therevisedmasterplan,withapricetagof$8million,includescampcabinsthat
wouldhouseupto96campers,30counselors,anurseanda

space,whileanentrypavilionnexttoanewparkinglotwouldincluderestroomsandadditionalstoragespace.Thiswouldbeparticularlyimportantforschoolgroupsandothervisitorswhoareparticipatinginfarmactivities.
Theplanalsoincludesmanyland-scapingfeaturesandanumberoffacilitiesthatmembersofthediocesecouldbuildtogether:fromthechang-ingroomsbytheswimmingpond,tothewetlandthatwouldfilterthepondwater,tothecampcabins,tothetreesthatwouldlinethewalkwaysanddrivesthroughouttheproperty.
Therecreationalareawouldnotneedmanychangesbeyondnewchangingroomsandrestroomswithcompost-ingtoilets.ThispartofthepropertysitswithintheVermillionRiverfloodplain,andsoisnotappropriateforbuilding.Thecampandretreatcenterfacilitieswouldsitonhighergroundabovetherivervalley,andtheyear-roundfacilitieswouldbecompactenoughforeasynavigationinthecolderweather.
The Business PlanThecampandretreatministryprojectteamalsodevelopedaproposedbusinessplanwithfive-yearoperatingbudgetprojectionstodeterminehowthediocesecansustaintheministryonceitisupandrunning.Inaddition,avideoandothermaterialsexplainthedetailsoftheproposalandprovideaforumforfeedbackfrommembersofthediocese.Theinformationincludesapossiblestructureforthecapitalcampaignandhowparishescanbeinvolved.
ThedesignteamfromGOLogicandAnnKearsleyDesignspentmuchoftheirtimecarefullyanalyz-ingtheproperty,sothatthediocesewouldknowexactlyhowthecampandretreatprogramsmightfunctiononthesite.Detailsaddresshowthediocesecanimprovethelandscapebymitigatingerosionissues,makingthepondwatercleaner,protectingthewoodland,andenrichingthefarmland.
Theproposedbusinessplanincludesthefollowingelements:
•SummerCamp:Theyouthcampprogramwouldrunforfourweeksinthefirsttwoyearsandgrowtosixweeksbythefifthyear.Thecostofcampwouldstartatanestimated$450perweek(basedonacomparisonwithothercampsintheregion),andthecenterwouldalsooffertwofamilycampsessionseachseason.Thefarmandfoodprogramforparticipantswouldalsostartthatfirstyear.
•Dayretreatsandotherprograms:Thecenterwouldofferdayandeveningeventsinthemaindining/meetingbuildingstartinginthesecondyearofoperations,anditsusageisexpectedtogrowmodestly.
•Overnightretreats:Bythefifthyear,thecenterwouldinclude40roomsforovernightaccom-modationsthatcanbesingleordoubleoccu-pancywithaprivatebath.Someroomswouldbeconnectedtothemaindining/meetingbuildingforeasyaccess.Theroomrateswouldstartat$100pernight,includingthreemeals,forsingleoccupancy.
•FarmProgram:Thecenterwouldarrangewiththefarmersthatareleasingthefarmpropertytomaintainthecentergroundsandthefarmbuild-ings,aswellasassistinprovidingprogramming.Thiswouldincludepreparingchildren’sandkitchengardensinthefirstyear,sothatthecamp-erscangrowfoodthefirstseason.

Thecenterwouldoperateasapartofthediocese,sothatitcouldshareadministrativeresponsibilities,includinginsur-ance,payrollandfundraising.
Tomatchthecarefulgrowthoftheprogram,staffingwouldalsostartrelativelysmallandgrowastheprogramandusagegrow.Thisstrategywouldallowthecentertoaddhoursandadditionalstaffwhentheusagewarrantsanincrease.Thespecificstaffposi-tionswouldinclude:
Center Director: Full-timestartingthefirstyear.Responsibilitieswouldincluderunningthecampprogram,anddevelopingtheretreatandotherprogramsastheoperationexpands.

Inthefirstyear,effortswouldfocusondiocesanuseofthesummercamp,althoughthecenterwouldalsoadvertisetootherfamiliesbyusingconnec-tionswithpartnerorganizations.
FollowingthemodelofSheldonCalvaryCamp,theCenterDirectorwouldtrainstaffextensivelytoofferpartici-pantsanexperiencethatwouldbringthembackyearafteryear.Althoughthenoveltyofthecentermightbetheinitialdraw,agreatcampexperiencewouldensuregoodusagerates.
Asitdevelopstheprogramforthesecondyear,thecenterstaffwouldworkwithareaschoolsandcollegestooffereducationalprograms,usingthecenterasafieldtripdestinationforlearningaboutsustainability.Thecampfacilitiescouldthenbeavailableduringthe“shoulder”seasonstoschoolsandcollegesthateitherhaveorareinterestedin

About$6millionoftheneededfundsareexpectedtocomefromindividualdonors,familiesandfoundations.Theremainingmonieswouldcomefromparishesthatareinterestedinhelpingwiththeeffort—eitherthroughholdingpartnercampaignsorthroughotherparishinvolvement.CCS,thefirmthatrantheplanningstudylastwinter,estimatedthatparishesmightbeabletoraiseanadditional$4milliontofundtheirownparishprojectsandministries,iftheypartnerwiththedioceseinthebroadercam-paign.Ofcourse,participationwouldbevoluntary,butthebenefitstoworkingwiththedioceseincludehavingthediocesecovermostofthecostsandadministrativedutiesofmanagingacapitalcampaign.Theenergybehindthediocesancampaignwouldalsoinvigorateparishefforts.
The Next StepsIfConventionapprovestheresolution,thediocesewouldformacampaigncommit-teethatdecidesthestrategyforfundrais-ing.Asubcommitteewouldfocusonthemajorgiftsportionofthecampaign,whileasecondgroupwouldworkwithinterestedparishesindetermininghowtoparticipateinthecampaign.

Thesestatutorydefinitionsandexampleswouldappearstraightforward.Butinreallifetherearemanytwistsandturns.Howdoweknowifsomeoneisanemployeeandiftheworkcreatedwaswithinthescopeofemployment?Isaparttimeemployeestillanemployeeforpurposesofcopyright?Avolunteerwouldnotseemtobeanemployeebutcouldhebedeemedan“employee”forpurposesofcopyrightlaw?Mostimportantly,isaclergypersonanemployee?Isthewritingofsermonswithinthescopeofemploymentandifso,doesshe,ordoesherchurchownthecopyrighttohersermons?
TheCopyrightActdoesnotexpresslydefine“employee”or“scopeofemployment,”andfollow-ingenactmentoftheActin1976,multipleinter-pretationsdevelopedastohowtoapplytheworkmadeforhireprovision.In1989,theU.S.SupremeCourtclarifiedtheprovisionbyrecognizingthatCongressintendedtheterms“employee”and“scopeofemployment”tobeunderstoodinlightofthecommonlawofagency.Cmty.forCreativeNon-Violencev.Reid,490U.S.730,740-743(U.S.1989).
Factors Considered Todeterminewhetherahiredpartyisconsidered
anemployeeunderthecommonlawofagency,theSupremeCourtlookstotheRestatement(Second)ofAgency§220(1958)andconsiders“thehiringparty’srighttocontrolthemannerandmeansbywhichtheproductisaccomplished”alongwiththefollowingfactors,nooneofwhichisdeterminative:
...theskillrequired;thesourceoftheinstru-mentalitiesandtools;thelocationofthework;the
durationoftherelationshipbetweentheparties;whetherthehiringpartyhastherighttoassignadditionalprojectstothehiredparty;theextentofthehiredparty’sdiscretionoverwhenandhowlongtowork;themethodofpayment;thehiredparty’sroleinhiringandpayingassistants;whethertheworkispartoftheregularbusinessofthehiringparty;whetherthehiringpartyisinbusiness;theprovisionofemployeebenefits;andthetaxtreat-mentofthehiredparty..
Thesefactorsarenotnecessarilyofequalsig-nificanceandshouldbeweighedrelativetotheirimportanceinanindividualcase.However,certainfactorswillberelevantinnearlyeverysituationandshouldbegivenmoreweightbecausetheyarehighlyprobativeofthetruenatureoftheemploymentrelationship.Thosefactorsare:(1)thehiringparty’srighttocontrolthemannerandmeansofcreation;(2)theskillrequired;(3)theprovisionofemployeebenefits;(4)thetaxtreatmentofthehiredparty;and(5)whetherthehiringpartyhastherighttoassignadditionalprojectstothehiredparty.
Nineyearsago,theapplicationofthesefactorsresultedinadeterminationthatdancescreatedafter1978byChoreographerMarthaGrahamwerepreparedbyanemployeewithinthescopeofemploymentsuchthatGraham’semployer,andnotherestate,ownedthecopyright.MarthaGrahamSch.andDanceFound.,Inc.v.MarthaGrahamCtr.ofContemporaryDance,224F.Supp.2d567(S.D.N.Y.2002),aff’d380F.3d624(2dCir.2004).Thefirstfactor—therightofcontrol—weighedinfavoroftheemployerbecauseeventhoughtheboardofdirectorsneverexerciseditspowertocontrolthecreationofthedances,itstillpossessedtherighttodoso.Graham’ssignificantartistictalentandskilldidnotprecludetheemployeerelation-shipthatcreatesaworkforhire;itsimplyexplainedwhyheremployerchosenottoexerciseitsrightofcontroloverherwork.Infact,aworkcanstillbemadeforhireeveniftheartisthas“completeartisticfreedom.”SeeCarterv.Helmsley-Spear,Inc.,71F.3d77(2dCir.1995).
Grahamreceivedaregularsalary,benefits,reim-bursementofexpenses,andhadtaxeswithheldfromhersalary.Shecreatedherdancesonemployerpremiseswithemployerresources,andcreatingdanceswasaregularactivityoftheemployer.Thus,

thedancesweredeemedworksforhire.
Whetherapastororpriestisanemployeeactingwithinthescopeofemploymentinwrit-inganddeliveringsermonsisanalogoustotheMarthaGrahamcase.Thoughtheymaybepartofthegoverningstructureoftheirchurch,pastorsandpriestsgenerallymustreportupwithinthehierarchicalstructureofthechurchbeitavestry,coun-cil,sessionorothercanonicalstructure.Pastorsaregenerallychurch-employedsuchthattheyreceivebenefitsanddirectsalarywithtaxeswithdrawn.Finally,evenifthesermonsarewrittenawayfromchurchpremises,theyaredeliveredatthechurch,andofferingsermonsiscertainlyapartoftheregular“business”ofthechurch.
Inadditiontobalancingthefactorsdiscussedabove,aworkmadeforhireiscreatedwithinthescopeofemployment“onlyif:(a)itisofthekindheisemployedtoperform;(b)itoccurssubstantiallywithintheauthorizedtimeandspacelimits;[and](c)itisactuated,atleastinpart,byapurposetoservethe[employer].”SeeAvtecSys.v.Peiffer,21F.3d568,571-72(4thCir.1994).Ifthefirstele-mentismet,courtsgenerallydonotgrantauthorshiprighttoemployeesbasedsolelyonthefactthattheemployeecreatedtheworkathomeorduringoff-hours.And,tosatisfythethirdelement,theemployeemustbe“atleast‘appreciablymotivated’byadesiretofurthertheemployer’sgoals.”Id.See
alsoRestatement(Second)ofAgency§236(employeeworkfallsbeyondscopeofemploy-mentif“donewithnointention”toservemaster).Inotherwords,themotivationtofurthertheemployer’sgoalsneednotbethesolemotivation.
Asanexample,applyingtheseelementstoacopyrightdisputebetweenanemployerandemployeeoveracomputersoftwareprogram,theemployeeownedthecopyrightbecausecomputerprogrammingwasnotthekindofworkhewasemployedtoperformandhedidnotconducttheworkontheemployer’stimeortofurthertheemployer’sgoals.Roeslinv.DistrictofColumbia,921F.Supp.793(D.D.C.1995).Rather,theemployeewashiredasalaboreconomistandhissuper-visordidnotknowofhispro-grammingskillsuponhiring,hespent3,000hoursathomeout-sideofworkinghoursconductingtheworkonacomputerhepur-chasedwithpersonalfunds,andeventhoughtheworkbenefitedhisemployer,theemployee’schiefmotivationwastocreatenewjobopportunitiesforhimself.
Applyingtheelementsofthescopeofemploymenttest,writ-inganddeliveringsermonsargu-ablysatisfiesallthreerequiredelementsandfallswithinapas-tor’sscopeofemployment.First,sermonsarethekindofworkapastorisemployedtoperformduringworshipservicesastheleaderofthechurch.Evenifthesermonisbasedonpersonalspiritualexperiences,deliveringsermonsisapartofapastor’s
employmentrelationshipwiththechurch.Second,evenifmuchofthepastor’sworkincreatingthesermonisdoneoffofchurchpremisesorwithoutchurchresources,thesermonsaredeliv-eredatthechurch.Furthermore,becausethefirstelementismet,courtsgenerallydonotvestcopy-rightbasedsolelyonthefactthattheemployeecreatedtheworkathome.Third,inwritingandconductingsermons,apastorismotivatedbyadesiretofurtherchurchgoalsandthatmotivationneedsonlytobepartial.
Itlikelywouldcomeasasurprisetomostpastorsthatthecopyrightintheirsermonsisownedbytheiremployer/church.Astheownerofthecopyright,thechurchandnottheclergypersonhastheexclusiverighttocontrolthepublicationorbroadcastofthesermon.Thiscanbecomeacontentiousissueifthepastorleavesthechurchorifthepastor’sheirsbelievethatthey,andnotthechurch,aretheownersoftheirparent’swork.Asubsequentagreementbetweenthechurchandtheclergypersontotransferthecopyrightmayviolatecertaintaxrules.Abetterapproachistoaddressthecopy-rightownershipissueatthetimeofemploymentandtodevelopacopyrightpolicythatcoversallemployeesaspartoftheemployeehandbook.
