Drugs for Human Use Proposed Amendments to the Food and Drug Regulations (Labelling, Packaging and Brand Names of Drugs for Human Use) - Improving Drug Safety through Plain Language Labelling This proposal pertains to amendments to the Food and Drug Regulations that would improve the safe and effective use of prescription and non-prescription human drugs through targeted amendments for drug names, labels and packages. The proposal would align Canada with international best practices, and would be supported by additional interpretive guidance to industry and an appropriate and least burdensome transition period. In Canada and internationally, studies and health literacy research indicate that over-crowded and confusing drug labels, unclear instructions, and similarities between packages and names contribute to medication errors. Examples include accidental overdose, taking or giving the wrong drug, and not knowing how to take the drug properly. These errors can result in significant patient harm. In response to the high rate of medication errors observed in the health system, and recognizing the role of the label, significant work has been undertaken in Canada and internationally to identify opportunities to improve the clarity and accessibility of drug labels. The proposal aims to improve the safe use of drugs by making drug labelling easier to read and understand for users; it would advance key safeguards, such as requiring labels to be in plain language, standardizing the format of non-prescription drug labels such as a “Drug Facts” table to help users

locate important information, and requiring that companies include their contact information on labels so that users can report problems or adverse drug reactions. This proposal focuses on areas where gaps exist and provides flexibility for future innovation; specifically, it consists of five targeted amendments to the current Regulations: one general requirement for clear, understandable, plain language labels; and four pre-market requirements (i.e. submission of label and package mock-ups, look- alike/sound-alike (LASA) name assessment, contact information on labels to report problems to the manufacturer, and standard table format for non-prescription drug labels). Health Canada has conducted various consultations related to drug names, labels and packages, and stakeholders are anticipating this proposal. The proposed amendments are outcomes-focused so that guidance and operations can adjust to innovations over time. The proposal will not affect the way the sale, advertising or importation of drugs is managed in Canada. An appropriate transition period is being proposed to allow the industry to properly plan and adjust to the new regulatory requirements within the natural cycle of label revisions, as follows: - Two transition time frames are being proposed for these amendments. The amendments would come into force 6 months after registration to align with international obligations, and at that time would apply to prescription drugs, which are generally considered higher risk products. For non-prescription drugs, the amendments would not apply for a period of 3 years to allow companies time to meet requirements (e.g. Drug Facts table format) within their normal cycle of re-labelling. 3. Electrical Equipment in Hazardous Locations Electrical Equipment in Hazardous Locations The Coast Guard proposes to amend its regulations. This proposed subpart would be applicable to foreign Mobile Offshore Drilling Units (MODUs), floating facilities, and vessels that engage in OCS activities for the first time after the effective date of the regulations. The proposed subpart would also be applicable to newly constructed U.S. MODUs, floating facilities, and

vessels, excluding offshore supply vessels (OSVs). The proposed regulations would expand the list of national and international explosion protection standards deemed acceptable, as well as add the internationally accepted independent third-party certification system, the IEC System for Certification to Standards relating to Equipment for use in Explosive Atmospheres, as an accepted method of testing and certifying electrical equipment intended for use in hazardous locations. The proposed regulations would also provide owners and operators of existing U.S. MODUs, floating OCS facilities, and vessels, other than OSVs, that engage in OCS activities and U.S. tank vessels that carry flammable or combustible cargoes the option of choosing between the compliance regime contained in existing regulations. This proposal would support the U.S. Coast Guard's maritime safety mission. 4. Test Procedures for Electric Motors This notice proposes to clarify aspects of certain U.S. Department of Energy (DOE) energy efficiency regulations related to electric motors. DOE is considering establishing definitions, specifying testing set-up procedures necessary to test, and extending DOE's existing test procedures for electric motors to certain electric motor types that have not been regulated by DOE. These actions are being proposed to clarify the scope of regulatory coverage for electric motors and to ensure accurate and consistent measurements when determining the energy efficiency of various types of electric motors. This notice seeks comment on this proposal and requests comments, data, and other information to assist DOE in deciding whether to finalize or

Milk and milk products Increase in Fees for Voluntary Federal Dairy Grading and Inspection Services This final rule increases the fees for voluntary Federal dairy grading and inspection services. The fees will increase 10 percent effective August 2013 and an additional 10 percent effective February 2014. The fees applicable to European Union Health Certification Program derogation requests are unchanged. Dairy grading and inspection services are voluntary and are financed in their entirety through user fees assessed to participants using the program. Despite the adoption of technologies that have improved services, additional changes in operations that enhanced efficiencies, and reduced employee numbers, increases in salaries, technology investments, and general inflation have more than offset savings resulting in the need to increase fees. AMS estimates the fee increase will result in an overall cost increase to the industry of less than $0.0004 per pound of dairy product graded. 6. Tobacco, tobacco products Importer Permit Requirements for Tobacco Products and Processed Tobacco, and Other Requirements for Tobacco Products, Processed Tobacco and Cigarette Papers and Tubes Elsewhere in this issue of the Federal Register, by means of a temporary rule, the Alcohol and Tobacco Tax and Trade Bureau (TTB) is amending its regulations pertaining to permits for importers of

tobacco products and processed tobacco by extending the duration of new permits from three years to five years. Based on its experience in the administration and enforcement of importer permits over the past decade, TTB believes that it can gain administrative efficiencies and reduce the burden on industry members, while still meeting the purposes of the limited-duration permit, by extending the permit duration to five years. That temporary rule also makes several technical corrections by amending the definition of "Manufacturer of tobacco products" to reflect a recent statutory change, and by amending a reference to the sale price of large cigars to incorporate a clarification published in a prior TTB temporary rule. Finally, the temporary rule published elsewhere in this issue incorporates and reissues TTB regulations pertaining to importer permit requirements for tobacco products, and minimum manufacturing and marking requirements for tobacco products and cigarette papers and tubes, and, as a result, that temporary rule replaces temporary regulations originally published in 1999. 7. Alcohol Reclassification of Specially Denatured Spirits and Completely Denatured Alcohol Formulas and Related Amendments The Alcohol and Tobacco Tax and Trade Bureau (TTB) proposes to amend its regulations concerning denatured alcohol and products made with industrial alcohol. The proposed amendments would eliminate outdated specially denatured spirits formulas from the regulations, reclassify some specially denatured spirits formulas as

completely denatured alcohol formulas, and issue some new general-use formulas for manufacturing products with specially denatured spirits. The proposed amendments would remove unnecessary regulatory burdens on the industrial alcohol industry as well as TTB, and would align the regulations with current industry practice. The proposed amendments would also make other needed improvements and clarifications, as well as a number of minor technical changes and corrections to the regulations. 8. Refrigerators, Refrigerator-Freezers, and Freezers Energy Conservation Program for Consumer Products: Test Procedures for Refrigerators, Refrigerator-Freezers, and Freezers The U.S. Department of Energy (DOE) today is issuing a notice of proposed rulemaking to amend the test procedures for refrigerators, refrigerator-freezers, and freezers that will be required for the testing of products starting 15 September 2014. DOE is proposing to amend the test procedure to address products with multiple compressors and to allow an alternative method for measuring and calculating energy consumption for refrigerator-freezers and refrigerators with freezer compartments. DOE is also proposing to amend certain aspects of the test procedure in order to ensure better test accuracy and repeatability. Additionally, DOE is soliciting comment on a potential test procedure to measure the energy use associated with making ice with an automatic icemaker. If adopted, that procedure would become effective in conjunction with any parallel energy conservation standards rulemaking that DOE would need to conduct
