A Beeston law firm has welcomed new tax laws cutting the rate of Inheritance Taxpayable from 40% to 36% whenever a Will contains fairly modest gifts infavour of charities.

Karen Hayward, a Wills and Probate specialist atRothera Dowson, says that the tax rate on the first£325,000 left on death is normally nil. Anythingover this initial tax-free amount gets taxed at 40%.Widows and widowers can qualify for a double nilrate band of £650,000.

Gifts to churches, charities and certain otherworthy causes have always reduced the InheritanceTax payable on the rest of the estate. Now sinceApril 2012, if you leave at least 10% of the excessabove your NRB to charity, the taxman will furtherreduce your IHT bill by charging only 36% on thebalance instead of 40%. A double benefit. Notethat you don’t have to leave a full 10% of yourwhole estate to qualify for the reduced rate – it’s

just 10% of the excess, which can be quite a modestproportion of the whole.

As Karen says, none of us knows when we’ll die orwhat we’ll leave, so it’s best to draft this sort of Willusing a particular set of wording. “If you want to leave something to your favouritecharity and also help your family qualify for the newreduced tax rate, it’s worth getting professionalhelp as the rules are complicated.”

Strange but trueWhat if the Will leaves something to charity, but notenough to pass the new 10% test? Karen explains:“The beneficiaries could think about topping up thecharitable gifts by varying the Will within the twoyears after the death. They’ll not only benefit theirown favourite charities at the expense of thetaxman, but may even get a tax refund for doing so,and end up with even more than they started with.”Strange but true.

So apart from the poor old taxman, everyone’s awinner!

For more information and advice about makinga Will, giving to charity and tax planning, pleasecontact Karen Hayward at Rothera DowsonSolicitors on 0800 158 5316.

Have you planned for the future? The importance of making a Will

If you haven’t already made a Will, have youever considered how complicated it could befor your loved ones after your death if youdon’t? If you have made a Will, is it still whatyou would want if you were to die?

Ellis-Fermor and Negus solicitors in LongEaton can advise you on preparing for thefuture, including writing a Will.

Here are some points you may needto consider...

• Would your partner be protected financially if something happened to you?

• Would your children be protected financiallyif something happened to you? • Who would look after any children under the age of 18 should both you and your partner die?

• If you’ve been married more than once, have you made proper provision for the children of the first marriage?

• Do you want to protect your money in case your partner should remarry?• Do you want the Government to receive all your money? • Are you worried about Inheritance Tax?• What would happen if your partner were to be admitted to residential or Nursing care?

• Who would look after your pet(s) and would they be properly provided for?• Do you want to leave money to other family members such as grandchildren or to a charity which you support?

As well as making Wills, Ellis-Fermor & Negus also store clients’ Wills for free, review previous Wills that clients may have made (even if it was withanother solicitor) and can help with other probate matters such as estateadministration, Lasting Powers of Attorney and the provision of adviceabout Care Home Fees.If you would like to find out more about making a Will, or any of the

D GETTING A HELPING HAND.Leading local psychotherapist,

Martin J Smith PhD highlightsthe benefits and importance ofgetting help for stress andrelated issues and difficulties.Taking back control of our lives

can be very difficult if we aretrying to do it alone. The taskcan be far easier if we are willingto allow others to help. Familyand friends can assist, but morespecialist assistance can turnthings around faster thanpeople first realise.

Martin specialises inresourced based, solutionfocused therapy, which aims tohelp people look to the futureand work quickly on feeling better and moving on with their lives byutilising their strengths and resources with some help and guidance.

If people injure muscles or joints they think nothing of going to thePhysiotherapist to get help to aide recovery.

Unfortunately we can suffer strains to our mind just as easily as to ourbodies; the problem here is people are far more reluctant to seek helpin mending their mind through the assistance of a psychotherapist.

Martin has been qualified and in private practice since 2000 andfirmly believes that, stress, anxiety, depression and other relatedissues should not rule peoples lives. He has worked with many clients’to break the negative cycle that so often engulfs them and all aspectsof their lives.

Do not let the stress and strain of work, home or life in general, get you down, to see what he can do to help you or a familymember, call him on 07 973 410 010 to make an appointment;Martin does appointments at times to suit you including eveningsand weekends so call now and start to take control, you can alsoemail on [email protected] for more information.

The Autumn now beckonsand we start to fiddle withthe settings on ourcentral heating. Butwhat about the animalsthat live in and around

our garden? Let’s take alook at our garden foragers.

As we live in the various parts of the cityscape rather than in thecountryside it’s interesting to see how wildlife has adapted to ourartificial environment.

What constitutes an artificial environment as different to a naturalone anyway?

An Artificial ecosystem is one made by man to mimic a naturally-occurring ecosystem - a delverate attempt to recreate that which isheld to be good for biodiversity and life for animals of differing typesand sizes - even the bacterial life that we don’t see.

A natural ecosystem is occurs through biological laws and thechances that arise from these. In the wild predators catch prey, treeswill try to crowd out other competing types of plant life and bacteriaflourish invisibly and in many cases helping the larger stuff tofunction properly!Artificial ecosystems offer a different approach since they will havehad thought and planning put into them. This mean that some of thedynamics involved in an entirely ‘wild’ scenario simply do not exist. This doesn’t make them ‘wrong’ as such but does introduce theelement of care and responsibility upon us - the creators of artificialenvironments.

There is a great deal morecontrol in artificialecosystems. as theplacement of plant life simore ordained, and thechoice of which animalsare allowed in,even thecontent of the soil can bechanged (and think aboutthe smaller animals thatlive in the soil itself - howthey are affected by thevery medium they need toexist).

All these points are agood indicator of how much we simply take for granted as ‘plant andmaintain’ our gardens.

We have covered this subject in previous issues but it is alwaysworth taking a look at your garden and asking yourself ‘what can I doto make my garden more friendly, more responsive to the needs ofnature’?

Why does it matter? Well, whilst globally speaking, bio-diversity is indecline, gardeners can really help in the fight to slow this as much aspossible. This makes sense if you consider that a large part of naturaldecline is due to homes being built on land where nature was; placesome of the elements back that were lost and we have a muchimproved prospect for life in all its diversity from the clearly visibleand beautiful (birds, dragonflies, voles etc) down to the not sobeautiful (at least to our eyes) such as worms, beetles, moths etc andeven the invisible (but essential) micro bacteria that breaks downgarden waste products and contributes to the food chain. Why notleave a few hanging fruits for the birds, hedgehogs and other animalsfor instance. (continues...)

(continued from p34)... So how much of a difference can you make? This all depends on your location but even thesmallest space can help some sort of natural life in some way - it is never a wasted effort!

For a smaller garden, why not try this:• Why not build a ‘bee hotel’?You may have seen this in visitor attractions. They help attract and shelter Red Mason Bees.

Unlike the more familiar bumblebee, mason bees are solitary. After hatching in spring, thefemale spends most of her life searching for hollow stems in which to lay her eggs and if you canprovide something suitable, that is a welcome nest for her and a chance to flourish. How to build:Make a simple box structure from untreated timber who’s sides are about four inches wide(simply screw it together so each side is butted up to the next). Then get some larger diameter canes or bramble, hogweed, reed, bamboo for example

Cut the stems into four inch lengths, discarding any bent or knobbly ones. Include some reallybig stems - using a fine saw to cut - even though they’re no use to the bees, they speed up theassembly stage, look attractive and help shelter lacewings and ladybirds over winter.

Lay your frame on a tilted surface and start to pack it with your stems. The whole thing will onlyfirm up and lock together as you put the final stems in.Where to locate it:Hang it on a sunny wall, sheltered from rain, and wait for the bees to investigate in spring.Female bees selects a stem and lay an egg inside with a store of pollen for the grub to eat whenit hatches. She will then seal up the cell with a plug of mud, and start again. A stem can end upwith several cells. The young bees won’t emerge until next year. The reason this is good for your garden and nature is that Mason bees are much more effective

pollinators than bumble bees, so they’ll help pollinate your fruit and veg. They also offer afantastic opportunity for children to watch and learn as they scurry and buzz to fill a nest you puttogether for them at virtually no cost to you.

Let’s return to this subject as we wander through Winter and make it part of our grand scheme to not only add colour and beauty to our‘little patch of paradise’ but to know that the beauty is not merely ‘skin deep’. So come on - pick up those few tools you need and getcracking on the first project! Enjoy your garden hobby!

FIREWORKS NIGHT- ADVICE AND

DEMONSTRATION OF HOW TOHELP YOUR DOG OR CATIt’s coming up to Guy Fawkes Night and many ofus will be looking forward to a colourfulfireworks show. In fact, what used to beFireworks Night is becoming more of aFireworks Season, lasting for all of Novemberand a few days either side. This is great news forthose who love their fireworks but bad news forany pet which is terrified by the noise and the flashes.

George and the team at Churchcroft Vets are trying to raise publicawareness of all the measures that can be taken to help your pet copethrough this tricky season. These days, there are many effective strategiesand medications that have been developed which can make a majordifference. For pets that are only slightly bothered by the bangs andcrashes there are simple, safe and cheap medicines which can be used, the right one depending on the exact case in question. To discuss theseyou can call Churchcroft on 0115 922 4855 and they will be very happy tohelp. For those pets who are more upset, rearranging the house and,

sometimes, some more powerful medicine can work really well. However,in all cases, as always with pet behaviour, a key part of successfullyimproving matters involves training for the owners! To show everyone what to do to provide the ideal fireworks environment

for dogs and cats, Churchcroft Vets are holding a free meeting todemonstrate the correct approach. They will set up an example of how tomake a safe and calming refuge for your pet and George and the staff willbe on hand to discuss individual cases and offer advice.

If you know that your precious pet is unhappy during fireworks season,or if you’re not sure what signs to look for, why not go along on SaturdayOctober 27th between 2 and 4 pm at Churchcroft Veterinary Centre tofind out more? Churchcroft Vets are at 111 High Road, Chilwell, NG9 4AT oppositeCollege House School. If you can’t make that time or you need moreinformation, give Churchcroft a call on 0115 922 4855.

The posters and programmes are ready, the plans forthe set are nearing completion and the cast are‘limbering up their memories’ for their lines - we hope!

The play is very funny and poignant too, being a ‘playwithin a play’; with the portrayal of both seasonedactors and young hopefuls all vying for a bit oflimelight, and inevitably arguments and jealousiescome to the fore. The plot unfolds further when itbecomes apparent that two of the actors in the ‘play’are married but their marriage is in difficulties - andsubsequently this affects their portrayal of the ‘play’!This is a well-written play which has many memorablelines - whether sarcastic, tragic or rib-ticklingly funny!
