1. CALL TO ORDER
The Commission President called the meeting to order at 10:06 a.m.
2. PRESENTATION – “In Remembrance of Ben Safara”
Assistant General Manager Aram Kouyoumdjian and Public Safety Bureau Chief Raelynn
Napper lead a posthumous tribute to Ben Safara in recognition of his excellent service to the
Personnel Department and the City of Los Angeles in the realm of public safety hiring.
3. APPROVAL OF MINUTES
The Board unanimously approved the minutes of the regular meeting of Thursday, November
14, 2019 on a motion by Commissioner McClelland, seconded by Commissioner Perez.

6. GENERAL MANAGER’S REPORT
The General Manager reported on the Health and Wellness presentations made by the Personnel
Department Benefits Division across the City. This unique and innovative program designed to
help the City workforce improve their health and fitness level through worksite programs from
Zumba and on-site yoga classes. Also offered are stress reduction programs including financial
planning and individualized counseling to help the employee deal with issues they face.
The Department has also inaugurated Support Plus, a concierge program to help the employee
find needed services from financial planning to wedding planning, child care, elder care,
whatever service the employee may need that is available through City services. The Personnel
Department has made and will continue to make a conscientious effort to get the word out to the
City family.

a. Louisa GAUERKE, Administrative Clerk, Library Department. Discharge effective
November 30, 2018. Report and recommendations of the Board’s Hearing Examiner
Stephen Biersmith, following the conduct of hearings on April 2, 2019, April 3, 2019 and
June 5, 2019 into the appeal of Ms. Gauerke.
The Hearing Examiner recommends that the Board:
A. FIND that the City met its Skelly due process obligations.
1. SUSTAIN the cause of action of using abusive language toward or making inappropriate
statements to the public, supervisors or coworkers.
2. SUSTAIN the cause of action of making threats or engaging in a confrontation with
supervisors and coworkers.
3. SUSTAIN the cause of action of engaging in inappropriate behavior with supervisors or
coworkers.
4. NOT SUSTAIN the cause of action of demonstrating insensitivity to others by making
derogatory comments, epithets, jokes, teasing remarks or slurs, or making suggestive
gestures or displaying images or written material that derogatorily demean people.
5. NOT SUSTAIN the cause of action of violating the City of Los Angeles Workplace
Violence Policy.
B. FIND that the Discharge, effective November 30, 2018, is within penalty range and may be
sustained. [Hearing Examiner Note: Two of the causes of action were not supported by the
evidence and were not sustained. While the range of discipline recommended for the
remaining causes of action which were sustained include discharge, it should be noted that
in its original review of the charges, according to the record, the Department assessed a
fifteen (15) day suspension for these charges. In this case, the Hearing Examiner
recommends that the parties consider entering into settlement discussions for a penalty less
than Discharge.]
C. MAKE A DETERMINATION on findings and conclusions.

COMMISSION ACTION:
Discussion:
The Department expressed its qualified support for the Hearing Examiner’s report, but urged the Board
to sustain all five of the charges as well as the penalty of Discharge. It pointed out that the employee
has a long history of unacceptable behavior that has disrupted her work place and created a fearful and
hostile work environment at the library. She has been counseled and disciplined several times over her
seven-year City career; her most recent actions have made it clear to the Department that the situation
cannot be permitted to continue.
The Department again asked that the Board sustain all the charges and the Discharge. The Appellant
made insensitive race based remarks and suggested that the only way to get her transfer was to get a
gun. These statements are unacceptable and cannot be allowed to pass.
The Appellant’s Representative stated that the situation at the Library did indeed need to be addressed.
On nine separate occasions, the Appellant requested to be transferred out of the Central Library into a
branch, but was blocked each time by the Department. The Department failed to employ progress
discipline, instead moving directly to discharge when other options were available and warranted.

The Appellant expressed her frustration to a friend, who also happened to be her supervisor. She did
not yell it in the workplace, or create a confrontation in sight of the public; rather she expressed herself
to a friend in private.
Her behavior may have been ill advised, but it was not a threat and should not be treated as such.
Perhaps a lengthy suspension is warranted, but so too is a transfer out of the toxic environment of the
Central Library.
Commissioner Perez questioned the Department on the comments the Appellant made regarding race
preference; she is certainly not the first City employee to make that statement that certain minorities
receive preferential treatment. Is holding such an opinion and her statements sufficient to warrant
sustaining the fourth and fifth charges?
The record seems to show that while her co-worker felt her remarks were a threat, professionals who
interviewed the Appellant did not find that he posed a threat in the workplace.
Commissioner Fugate asked the Department to focus the discussion on the City’s workplace violence
policy and the proper steps to take when a threat is perceived.
Commissioner McClelland noted that the Hearing Examiner found that the workplace violence
professional stated on the record that the Appellant’s statements were disruptive to the workplace and
could be perceived as a legitimate threat instilling fear and anxiety among her co-workers. That the
City was originally considering a lesser penalty for charges one, two and three, the Appellant’s
continued misbehavior after being served with her Skelly package on these charges compelled the
Department in reconsider its position, add the additional charges and impose the penalty of Discharge.
While the Hearing Examiner did not find that the Department made its case as to the additional charge
four and five, there was sufficient evidence in the record to sustain a discharge based on the original
three charges.
The Department stated that it followed the procedures established in the Workplace Violence Policy,
contacting the City Attorney Workplace Violence Treat Assessment Coordinator and following his
advice.
Commissioner Perez noted that the Department did not take the specific step of contacting the LAPD as
required. Additional information as to steps taken or not was not in the case record.
Commissioner Fugate questioned that the threatening statement was made, according to the Appellant,
to a friend, in private and should not be perceived as a threat, rather a statement of frustration. The
Department Representative stated that the two women had a working relationship not a personal one.
She testified that she felt fear at the statement.
The Appellant stated that they were not contesting the recommendations the Hearing Examiner made in
the first three causes of action. Rather, they believe that the penalty of Discharge for these charges is
excessive and unwarranted. A suspension and transfer to a different workplace would resolve all the
issues in this case.
After the discussion concluded, the Board asked the Department if it felt it could reduce the penalty to
something less than Discharge. The Department stated that based on the Appellant’s long record, that
Discharge was the only penalty that was appropriate response to her behavior.

On a series of motions by Commissioner McClelland, the Board voted unanimously to:

SUSTINED. Motion seconded by Commissioner Perez.
On a motion by Commissioner Perez, seconded by Commissioner Gould, the Board voted unanimously
to FIND that the events and comments by the Appellant on September 4, 2018 are to be included in the
record and become part of counts one, two and three sustained by the Board.
The Board felt that its reasoning for its actions differed enough from the Hearing Examiner’s in his
report that the Board should create its own finding Report. The matter was continued to the meeting of
January 23, 2020 when a draft Findings Report and Conclusions of Law will be presented to the Board
for its consideration. The parties will be provided with the draft Report in advance of the meeting.

7. APPEAL UNDER CHARTER SECTION 1016
b. Felecia WARREN, Administrative Clerk, Library Department. Suspension effective June
18, 2018 to August 24, 2018 (30 working days) to be served as agreed. Report and
recommendations of the Board’s Hearing Examiner Christopher Cameron, following the
conduct of hearings on March 12, 2019 and July 8, 2019 into the appeal of Ms. Warren.
The Hearing Examiner recommends that the Board:
A. FIND that the Skelly due process obligations were NOT met.
1. NOT SUSTAIN the cause of action of frequent or unexcused tardiness.
2. NOT SUSTAIN the cause of action of violation of settlement agreement signed June 5,
2017.
B. FIND that the Suspension effective June 18, 2018 to August 24, 2018 (30 working days)
served as agreed was NOT appropriate and is NOT SUSTAINED. The employee should be
made whole for any lost wages, benefits and seniority.
C. MAKE A DETERMINATION on findings and conclusions.

COMMISSION ACTION:
Discussion:
The Department expressed its strong disagreement with the findings and recommendations of the
Hearing Examiner. It provided the Appellant with her full Skelly due process rights and worked
consistently with the Appellant to enter into the interactive process, however, she consistently kept
withdrawing from the process asserting that she had no disability or restrictions.
Commissioner Perez and McClelland both stated that the interactive process by its very name requires
both parties to be fully involved and attentive. It is not inherent on the City to find ways and means to
accommodate an employee when the employee will not assist the City by identifying what issues is
present that required accommodation.
The Appellant’s Representative asserted that the Appellant did engage with the City but that the City
refused to consider her needs. It did not help her to understand the process
Commissioner McClelland noted that the record indicates that the Appellant refused to cooperate with
the Department, saying she did not have a problem arriving on time. She refused even when the
Department offered to alter her schedule to help her address her issues.
Commissioner Fugate stated that the interactive process requires both parties be fully engaged. She
asked if the parties were amicable to entering into settlement discussions to resolve the case. When both
parties indicated their willingness, the matter was continued.
Commission Action:
The parties were instructed to enter into settlement discussions to conclude no later than January 31,
2020. If by that date, no settlement had been reached the parties are to inform the Commission Office
and the matter returned to the Board for final consideration at the Board’s meeting on February 27,
2020.

8. UNFINISHED CLASSIFICATION ITEM
The General Manager recommends that the Board of Civil Service Commissioners, after giving
a 10-day notice of its intention on November 14, 2019, the Board now:
1. Create the new classifications of Communications Information Representative
Trainee, 1478 and Communications Information Representative Assistant, 1479.
and
2. Adopt the new duties statements for Communications Information Representative
Trainee, 1478 and Communications Information Representative Assistant, 1479.

9. RESIGNATION, SETTLEMENT AND WITHDRAWAL OF APPEAL UNDER
CHARTER SECTION 1016 TO BE MADE A MATTER OF RECORD
a. AIRPORT POLICE SERGEANT, Department of Airports. Suspension effective May 23,
2019 to May 31, 2019, inclusive (8 working days).
Settlement agreement between the City and an Airport Police Sergeant (employee) whereby
the Department agreed to replace the penalty of an eight working day unpaid suspension to a
one (1) working day period recorded as Disciplinary Pay Status. The employee agreed to
withdraw his appeal from Suspension now pending before the Civil Service Commission.
The parties agreed to other terms and conditions. A signed copy of the agreement was
received at the Civil Service Commission office on November 18, 2019.

b. Marc HESS, Mechanical Repairer, Department of Recreation and Parks. Discharge
effective November 8, 2019.
Settlement agreement between the City and the Marc Hess (employee), whereby the
Department agreed to rescind the penalty of discharge while the employee filed for
retirement. Upon notice of the pending retirement, the employee will be returned to the
payroll noted as on vacation until December 21, 2019 when his retirement becomes
effective. If notice of the pending retirement is not received by the Department by
December 21, 2019, a signed resignation in lieu of discharge form will be processed. The
employee also agreed to withdraw his appeal now pending before the Civil Service
Commission. The parties agreed to other terms and conditions. A signed copy of the
agreement and employee’s withdrawal from discharge form was received at the Civil
Service Commission office on November 25, 2019.

c. James K. JOHNSON, Construction Inspector, Department of Airports. Discharge
effective August 22, 2019.
Settlement agreement between the City and James K. Johnson (employee), whereby the
Department agreed to rescind the penalty of Discharge and accept the employee’s
resignation from City service effective August 22, 2019. The employee agreed to withdraw
his appeal from Discharge now pending before the Civil Service Commission. The parties
agreed to other terms and conditions. A signed copy of the agreement and the employee’s
signed Withdrawal from Appeal form was received at the Civil Service Commission office
on December 12, 2019.

d. Spencer MYLES, Traffic Officer, Department of Transportation. Discharge effective
September 18, 2019.
Settlement agreement between the City and Spencer Myles (employee) whereby the
Department agreed to rescind the penalty of Discharge effective September 30, 2019 and
substitute a 30-working day suspension. The employee agreed to make every effort in future
to notify supervisors of any inability to report for work. Should the employee fail to live up
to this agreement he will face additional discipline up to and including discharge. The
employee agreed to withdraw his appeal from Discharge now pending before the Civil
Service Commission. The parties agreed to other terms and conditions. A signed copy of
the agreement was received at the Civil Service Commission office on December 16, 2019.

Withdrawal of Appeal. On November 19, 2019, the Stephen Emmett Reed (employee) sent
an email to the Department, which was forwarded to the Commission Office, informing the
Board of the employee’s desire to withdraw and end his Appeal from Discharge.

f. Gerardo VILLALOBOS, Custodian, Department of General Services. Discharge effective
September 30, 2019.
Settlement agreement between the City and Gerardo Villalobos (employee) whereby the
Department agreed to rescind the penalty of Discharge effective September 30, 2019 and
place the employee for record keeping purposes on unpaid leave. The employee agreed to
file for a regular retirement to become effective November 11, 2019. The employee agreed
to withdraw his appeal from Discharge now pending before the Civil Service Commission.
The parties agreed to other terms and conditions. A signed copy of the agreement was
received at the Civil Service Commission office on November 18, 2019.

g. Aaron YAMAMOTO, Airport Superintendent of Operations I, Department of Airports.
Suspension effective May 15, 2019 to June 19, 2019, inclusive.
Settlement agreement between the City and Aaron Yamamoto (employee) whereby the
Department agreed to reduce the penalty of a 20-working day unpaid suspension to an eight
(8) working day unpaid suspension and a 12-working day Disciplinary Pay Status. The
employee acknowledged his violation of Department Rules as detailed on the revised
General Form 77. The employee agreed to commit himself to comply with all Departmental
rules from this date forward. The employee agreed that his personnel record would show a
20-working day suspension imposed for the purpose of any future discipline. The employee
agreed to withdraw his appeal from Suspension now pending before the Civil Service
Commission. The parties agreed to other terms and conditions. A signed copy of the
agreement was received at the Civil Service Commission office on November 13, 2019.
