SARDAR VALLABH BHAI PATELSardar Vallabh Bhai Patel,the epitome of Integrity, was born in Gujarat. When India attained independence he became the Deputy Prime Minister and was responsible for the home, States and the Information and Broadcasting portfolios. It was in this capacity that he was called upon to tackle the most intricate and baffling problem of the States integration into the Union of India and it is here that his tact, his powers of persuasion and his statesmanship came into full play. The integration of the States could certainly be termed as the crowning achievement of Vallabh Bhai Patel’s life. But for him, this may not have been achieved easily and quickly. He accomplished this task with the ruthless efficiency of a great administrator. He sorted out the problems of partition, restored law and order and dealt with the rehabilitation of thousands of refugees with great courage and foresight. He reorganized our services and formed a new Indian Administrative Service, to provide a stable administrative base for our new democracy.

In pre-independence India, honesty was expected of the people. When a powerful man like Sardar Vallabh Bhai Patel died, all he had were two worn out suitcases, may be four or five dhotis and shirts. In pre-independence days, leaders had a sense of mission. The old ideas and values were supposed to be the steel frame of India that’s why we were able to win independence. We have to look far and wide for such honesty and virtues to keep India united.

As you know that Vigilance function is considered as an integral part of the management and it plays a vital role in strengthening the organisation in improving its performance. Oil India Limited has been doing e-tendering since 2006 through its e-tender portal https://etender.srm.oilindia.in/irj/portal. The threshold value of the e-tender has been now lowered to Rs.10 lakh and hence number of e-tenders is increased substantially. As a result, more and more user are involved in the e-tendering process.

While processing the e-Tendering, the tenderer as well as bidder should have a legally valid Class 3 digital certificate as per Indian IT Act 2000. In OIL, both tender & bidders need Class 3 digital certificate with organisation name.

As per Section 18 of The Information Technology Act, 2000 provides the required legal sanctity to the digital signatures based on asymmetric cryptosystems. The digital signatures are now accepted at par with handwritten signatures and the electronic documents that have been digitally signed are treated at par with paper documents.

The IT Act provides for the Controller of Certifying Authorities (CCA) to license and regulate the working of Certifying Authorities. The Certifying Authorities (CAs) issue digital signature certificates for electronic authentication of users.

The Controller of Certifying Authorities (CCA) has been appointed by the Central Government under section 17 of the Act for purposes of the IT Act. The Office of the CCA came into existence on November 1, 2000. It aims at promoting the growth of E-Commerce and E- Governance through the wide use of digital signatures.

The Controller of Certifying Authorities (CCA) has established the Root Certifying Authority (RCAI) of India under section 18(b) of the IT Act to digitally sign the public keys of Certifying Authorities (CA) in the country. The RCAI is operated as per the standards laid down under the Act.

Digital Signature

The CCA certifies the public keys of CAs using its own private key, which enables users in the cyberspace to verify that a given certificate is issued by a licensed CA. For this purpose it operates, the Root Certifying Authority of India(RCAI). The CCA also maintains the Repository of Digital Certificates, which contains all the certificates issued to the CAs in the country.

The following are the FAQs regarding Digital Signature Certificate (DSC):

Q. What is a Digital Signature Certificate (DSC)?

Ans. Digital Signature Certificate (DSC) is the electronic format of physical or paper certificate like a driving License, passport etc. Certificates serve as proof of identity of an individual or organization for a certain purpose on online / computer. Digital Signature Certificate (DSC) Certificate can be presented electronically to prove your identity, to access information or services on the Internet or to sign certain documents digitally manually.

Q. Why do I need a Digital Signature Certificate (DSC)?

Ans. A Digital Signature Certificate (DSC) Certificate authenticates your identity electronically. DSC also provides you with a high level of security for your online transactions by ensuring absolute privacy of the information exchanged using a Digital Signature Certificate (DSC). You can use certificates to sign / encrypt information such that only the intended recipient can read it. You can digitally sign information to assure the recipient that it has not been changed in transit, and also verify your identity as the sender of the message.

Q. Where can I use Digital Signature Certificate (DSC)?

Ans. For sending and receiving digitally signed and encrypted emails/ documents. For carrying out secure web-based transactions. In e-Tendering,

e-Procurement, for Registrar of Companies e-filing, Income Tax for e-filing income tax returns and also in many other applications. For signing documents like MS Word, MS Excel and PDFs.

Q. Where can I purchase a Digital Signature Certificate (DSC)?

Ans. Legally valid Digital Signature Certificate (DSC) Certificates are issued only through a Controller of Certifying Authorities (CCA), Govt. of India, licensed Registration Authorities (RA), such as e-Solutions. e-Solutions, a Registration Authorities (RA) licensed by (n)Code Solutions-CA, offers secure Digital Signature Certificate (DSC)s through various options tailored to suit individual as well as organizational needs.

Q. How does a Digital Signature Certificate (DSC) work?

Ans. A Digital Signature Certificate (DSC) explicitly associates the identity of an individual/device with a two keys - public and private keys. The certificate contains information about a user’s identity (for example, their name, pincode, country, email address, the date the certificate was issued and the name of the CA. These keys will not work in the absence of the other. They are used by browsers and servers to encrypt and decrypt information regarding the identity of the certificate user.

The private key is stored on the user’s computer hard disk or on an external device such as a USB token. The user retains control of the private key; it can only be used with the issued password. The public key is disseminated with the encrypted information. The authentication process fails if either one of these keys in not available or do not match. This means that the encrypted data cannot be decrypted and therefore, is inaccessible to unauthorized parties.

Q. Are Digital Signature Certificate (DSC)s legally valid in India?

Ans. Yes, as per Information Technology Act 2000 in India, Digital Signature Certificate (DSC) are legally valid in India. Digital Signature Certificate (DSC) are issued by licensed Certifying Authorities under the Ministry of Information Technology, Government of India as per the Information Technology Act.

Q. What type of Digital Signature Certificate is required for e-Tendering, e-Procurement, Trademark / Patent filing?

Ans. Class 3 Company / Organization User certificate is required for e-Tendering, e-Procurement , Trademark / Patent filing. Class 3 is the highest type of Digital Signature Certificate. It can be issued for 1 years or 2 years. After the valid period , user need to renew class 3 digital signature certificates.

Q. What type of Digital Signature Certificate is required for Income Tax filing, ROC and MCA filing?

Ans. Class 2 Digital Signature Certificate is required for Income Tax filing, ROC and MCA filing. Class 2 Digital Signature Certificate can be issued for 1 year or 2 years. After the valid period, user need to renew class 2 digital signature certificates. Class 2 Digital Signature certificate can be issued to individual / organization.

Q. What type of Digital Signature Certificate is required for Importers-Exporters?

Class 3 DGFT Digital Signature Certificate is required for DGFT website to communicate. DGFT Digital Signature is valid for 1 years or 2 years. User can save time and money by using DGFT Digital Signature Certificate.

Q. What type of Digital Signature Certificate (DSC) is to be obtained for filing on the MCA Portal ?

DSC of Class 2 and Class 3 category issued by a licensed Certifying Authority (CA) needs to be obtained for e-filing on the MCA Portal.

Q. What does X509 refer to as it relates to digital certificates?

Ans. X509 is the industry standard for digital certificate format. It defined the various mandatory and optional attributes that can be defined within the certificate.

Q. Why does a digital signature certificate have a limited validity period?

Ans. Digital signature certificates have an explicit start date and an explicit expiration date. Most applications check the validity period of a certificate when the digital certificate is used. The signature certificate expiration date is also used for managing the certificate revocation

list (CRL). A certificate is removed from the revocation list when its natural expiration date arrives. As such, generally the shorter the certificate validity period, the shorter the CRL.

Q. What is a root certificate, and why do I need one?

Ans. A root certificate is one of two things: Either an unsigned public key certificate or a self-signed certificate used to identify the Root Certificate Authority (CA). The root certificate is in fact the anchor of trust in a digital certificate and is used for validating the entire certification tree.

Q. Can a person have two digital signatures say one for official use and other one for personal use?

Ans. Yes

Q. What are the different classes of Digital Signature Certificates?

Ans. In addition to four classes of certificates given below, the Certifying Authority may issue more classes of Public Key Certificates, but these must be explicitly defined including the purpose for which each class is used and the verification methods underlying the

issuance of the certificate. The suggested four classes are the following :-

Class 0 Certificate: This certificate shall be issued only for demonstration/ test purposes.

Class 1 Certificate: Class 1 certificates shall be issued to individuals/private subscribers. These certificates will confirm that user’s name (or alias) and E-mail address form an unambiguous subject within the Certifying Authorities database.

Class 2 Certificate: These certificates will be issued for both business personnel and private individuals use. These certificates will confirm that the information in the application provided by the subscriber does not conflict with the information in well-recognized consumer databases.

Class 3 Certificate: This certificate will be issued to individuals as well as organizations. As these are high assurance certificates, primarily intended for e-commerce applications, they shall be issued to individuals only on their personal (physical) appearance before the Certifying Authorities.

It was evening of Friday, 1st April, 2016 and I found my son deeply engaged in reading the first page of the Newspaper. The big headline was “Under-construction Vivekananda Flyover collapses in Kolkata; 21 Dead, 70 injured”. Seeing me, he asked me why this happened. I tried to explain him by saying that it is too early to give a proper reason for collapse of the fly-over, but in general, one or more of following may be probable reasons- Flaw in Design, use of inferior materials, lack of Inspection etc. and actual reason(s) could be found after proper enquiry only. His curiosity grew and asked me, “That means people who are responsible are not doing their job properly and honestly…this is corruption”. He is a 10th Standard student and is aware of what is corruption. On my asking, he could give me a definition of corruption which is more of less correct. My little daughter came to me and said (with big eyes and some degree of fear) that while going to GIP Mall, we had to cross a Flyover….. I tried to assure her that if people are honest in their work and do what they are supposed to do, such kinds of things will never take place except for reasons beyond control of mankind.

Home, Society and Schools- there are three institutions that are responsible for embedding moral values into a children. Home is the basic learning ground for all moral values and behavioural traits. It is very well said that environment at home seeds the basic moral values in the children. The kids see their parents as role models and try to copy them. There cannot be any second thought on this and I also think that primary responsibility lies with parents for imparting moral values to their children. In a similar way, society or the surrounding is also an important factor on embedding moral value into a children. School is a big part of a person’s life and children spend a large portion of the day with the teachers and at school. In schools moral stories are taught from very beginning, that is from Nursery level, in a systematic way. Nowadays, in

schools, importance is given on Co-scholastic areas apart from the Scholastic subjects. Co-scholastic areas include life skills, attitudes and values, co-curricular activities and health and physical education. There are individual / group projects which the students are required to make and present. In schools, there are different groups where students have to be compulsorily participate. There are visits organized by schools. All there are part of curriculum.

Coming back to my story, I asked my son where from he learnt the definition of corruption. He replied that there were chapters in Economics about People and Resources, public money etc., but he googled corruption while preparing for Essay Competition in last year’s Vigilance Awareness Week Celebration. My little daughter also took part in the discussion saying that in TV Cartoon “ Chota Bheem”, honesty and good works always win.

The famous Chinese proverb says, ”Tell me, I’ll forget. Show me I’ll remember. Involve me I’ll understand”. My point of writing this article is to share that spreading the Vigilance Awareness to the children helped in their understanding of the subject. A lot on this area more can be done under co-scholastic areas in schools and home as well. In summer vacation homework, project work can be given under Economics on Public Resources, Public Money etc. Students to be taken on tour to places such as Metro, Bridges, Dams to appreciate what public services they serve and also to imagine what disasters would take place if any mishap is there. Apart from organizing Debating, Quiz, Poster competition etc. at schools, talks by eminent personalities can be arranged. A small learning may be a basic building block for building the moral of a student. If we (parent, school and society) systematically implant these values into them, there will be hardly any place and scope left where seeds of corruption could grow.

Introduction: A very simple meaning of vigilance is watchfulness or to bring awareness among people depending on a particular situation. When we talk about vigilance, it means we are talking about how to fight against corruption, drug addiction, unhealthy social environment, etc. As we know, corruption includes misuse of power, money government property, etc. Vigilance is required because we want to bring corruption to a zero level. As one slogan has been raised that – “Corruption, corruption go away this is what I used to pay”.

It is the responsibility of each and every person in society to concern about these things. Because, if we are not the part of solution then we are concern to the problem. Because if we don’t take a part to improve our society then no one can help us. It is the duty of everyone to take part in this. Drug addiction is also one of the harmful and severely common situation among teenagers, youngsters. This situation should also be removed and for this vigilance which means awareness among people is required. This can also be ensured by effective participation and corruption less function of the private, public or government organisation / group / individuals. This all can be ensured by awareness among people or vigilance which also means total concern of the society about what is happening around our surroundings. When we talk about vigilance, people always have a wrong approach as they perceive vigilance as enquiry, fixing responsibility, etc. But it is not an investigation because it is the prevention towards which all people of the society should concern. For e.g. – To punish, not to prevent is just like pumping water through the pump without arresting leakages which result in loss of water, time and energy.

Need for vigilance in the society:-

Vigilance is the very important of society. Because,

when we neglect our society, it means we are neglecting our future. We should always be aware and take steps against unrightful things. An organisation can protect itself from external threats through conducting safety and posting manpower to guard against such dangers. But the role of vigilance in that is they not only preserve the external threats but also look after the internal threat as they concern internal threats are more serious than external threats. Vigilance also inspire us to take the responsibility towards the nation, to help the organisation to discharge vigilance functions effectively by bringing out a notice to organisation to bring out there dishonest employees. Just because of the participation of the employee’s vigilance, the organisation was saved. So like this, if everyone will perform vigilance in society, corruption, drug addiction, unhealthy environment will not get any space to stay in the society.

So, now we can say that vigilance is the responsibility of everyone in the society. Till human will not himself aware and take step towards no one can improve the society because vigilance is not confined to an individual or a group of people it is confined to all the people of the society as they are a part of these. As it said – Eternal vigilance is the price of liberty, so at last I will just like to say that – Be vigilant, guide mind against negative thoughts.

So, it is the responsibility of each and every member of the society to be vigilant and guide people to go beyond unhealthy situations that are continuing in the country. No country is perfect, we need to make our country the perfect one. So, vigilance is said to be the responsibility of everyone in the society.

Important Feature of the “Whistle-Blowers” Resolution

The CVC shall as the Designated Agency, receive written complaints or disclosure on any •

allegation of corruption or of mis-use of office by any employee of the Central Government

or of any corporation established under any Central Act, government companies, societies or

local authorities owned or controlled by the Central Government.

The designated agency will ascertain the identity of the complainant; if the complainant is •

anonymous, it shall not take any action in the matter.

The identity of the complainant will not be revealed unless the complainant himself has •

made either the details of the complaint public or disclosed his identity to any other office or

authority.

While calling for further report/investigation, the Commission shall not disclose the identity of •

the informant and also shall request the concerned head of the organisation to keep the identity

of the informant a secret, if for any reason the head comes to know the identity.

The Commission shall be authorised to call upon the CBI or the police authorities, as considered •

necessary, to render all assistance to complete the investigation pursuant to the complaint

received.

If any person is aggrieved by any action on the ground that he is being victimised due to the fact •

that he had filed a complaint or disclosure, he may file an application before the Commission

seeking redress in the matter, wherein the Commission may give suitable directions to the

concerned person or the authority.

If the Commission is of the opinion that either the complainant or the witnesses need protection, •

it shall issue appropriate directions to the concerned government authorities.

In case the Commission finds the complaint to be motivated or vexatious, it shall be at liberty •

to take appropriate steps.

The Commission shall not entertain or inquire into any disclosure in respect of which a formal •

and public inquiry has been ordered under the Public Servants Inquiries Act, 1850, or a matter

that has been referred for inquiry under the Commissions of Inquiry Act, 1952.

In the event of the identity of the informant being disclosed in spite of the Commission’s •

directions to the contrary, it is authorised to initiate appropriate action as per extant regulations

against the person or agency making such disclosure.
