AN ORDINANCE AMENDING THE BUDGET BY REDUCING AND LIMITING
MUNICIPAL COURT REVENUE TO BE APPROPRIATED AS PART OF THE GENERALBUDGET AND ESTABLISHING A SPECIAL LINE ITEM FOR CERTAIN MUNICIPAL
COURT REVENUE TO BE USED FOR PROJECTS TO BENEFIT THE COMMUNITY
Whereas, given the various revenue sources for the City, the revenue derived from finesand costs imposed as a result of municipal ordinance violations comprises less than one-sixth of
the Citys revenue; and
Whereas, the City does not rely upon municipal court revenue to provide essential
services to its residents; and
Whereas, the City Council firmly believes that fines and costs imposed in the municipalcourt should not be viewed as a source of revenue, but solely as punishment for offenders and to
deter similar offenses in the future; and
Whereas, to that end, the City Council desires to amend its budget for the current fiscal
year by reducing and limiting the municipal court revenue to be appropriated as part of the
general budget and establishing a special line item for certain municipal court revenue to be usedfor projects to benefit the community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OFFERGUSON, MISSOURI, AS FOLLOWS:
Section 1. The Budget for the 2014-2015 fiscal year is hereby amended and the CityManager is hereby directed to prepare the necessary documentation to reflect the following
amendments:
(a) The Municipal Court Revenue reflected in the general budget shall be reduced toan amount equal to only fifteen percent (15%) of the total estimated revenue for the City. If the
current budgeted amount is already less than that, then the budget shall remain at the lesser
amount.
(b) There shall be established a new line item whereby certain revenue from the
municipal court (that revenue which is above the amount reflected in the general revenue portionof the budget) may be recorded and accounted for. It is anticipated that the Council will
appropriate such revenue for work or projects to benefit the community as decided by the City
Council from time to time.
Section 2. This Ordinance shall be in full force effect from and after the date of its passage
by the City Council.
