Executive Summary

The Punjab Judicial Academy, under its governing law1, strives to bring its

programs at international level. In the recent past, the Academy has refocused

its curricula from imparting knowledge to enhancing skills and developing

attitudes and modified its training methodology from passive learning (lecture

mode) to active learning (workshop method).

Like other Judicial Academies of Pakistan, PJA follows the Judicial Trainers’

Toolkit2 for designing, delivering and evaluating training programs. It provides,

inter alia, the Kolb’s learner classification and Training Cycle which consists of

four phases viz identifying the learning needs (Training Needs Analysis) ⟶

Design ⟶ Delivery ⟶ Evaluation and the cycle goes on. It needs no emphasis

that judges, before taking a decision and writing a judgment, consider, and

when working as trial courts, record evidence and then analyze it to reach at a

conclusion. Designing a training program also needs evidence. It may include

the feedback received from trainees, data from district courts, questionnaires,

interviews and discussions with as many stakeholders of justice delivery

system as possible. It is on the foundation of such analysis that a justification

for designing a particular training program is reasoned out. We believe that

judicial training should reflect best practices in professional and adult training

design and it should employ a wide range of up-to-date methodologies. This

was clearly expounded in Declaration of Judicial Training Principles, 2017,

adopted by International Organization of Judicial Training3. The Punjab Judicial

Academy, being one of its esteemed members, takes pride in following such

principles.

I. Pre-Service Training for Newly Appointed AD&SJs

Besides considering the Senior Civil Judges and District & Sessions Judges (ex-

cadre) for future training, the PJA has commenced 06-month Pre-Service

Training Program for 08-newly appointed AD&SJs in Punjab. Their training

program, according to approval by Hon’ble Chairperson Board of Management,

includes 2 month on-job training. The Academy has, therefore, planned 04-

with District Courts at Lahore and one-month attachment with different courts

in Punjab. The Federal Judicial Academy, Sindh Judicial Academy & KP Judicial

Academy would also be taken in loop to collaborate with PJA to impart one-

week training each to the trainees. After practice sessions and court

attachments, the participants’ knowledge and skills would be evaluated as per

assessment policy, already devised in the program available in their handbook

for the purpose. The concluding of the 6-month pre-service training of AD&SJs

is planned in June. The following is the curricula designed for AD&SJs Pre-

Service Training:

II. Workshops for Senior Civil Judges

The Academy has designed this 06-month Academic Calendar on the basis of

Training Needs Analysis, mostly founded on the feedback received from judges

who got training last year and occasional instructions given by Hon’ble Judges,

Lahore High Court. It is pertinent to mention here that in 2016-17, a General

Training Program was designed for all the Judicial Officers in Punjab, about

1800 in number. The said judicial officers besides participating in evaluation,

also provided their input on the GTP. Resultantly, GTP-2018 was designed for

all the Civil Judges and AD&SJs in Punjab, from February 2018 to December

2018, in 20 programs (20 Batches of 25 AD&SJs and 41 Batches of Civil 25-30

Judges in each batch). This GTP was supplemented with synchronous e-

learning, in two modules covered in 20 live Webinars for all the Civil Judges and

AD&SJs. No Special Training Program (except a One-day Workshop on

Rationalization and Distribution of work for Senior Civil Judges) was designed

or delivered for 155 D&SJs or 109 Senior Civil Judges in 2018. They are,

therefore, the target for the next 06-month program of PJA.

The following areas would be covered in curricula of Senior Civil Judges

keeping in view their separate and distinct jurisdiction:

a) Family Division

ii. Visitation Rights;

iii. Preparation of Schedule;

iv. New legislation i.e. International Parental Child Abduction.

v. Mediation – Pre/Post Trial Conciliation.

b) Civil Division

i. Green Courts; Environmental laws; Climate Justice;

ii. Court Automation for Case Management;

iii. New amendments in Civil Procedure Code;

iv. Referral mechanism for Mediation.

c) Criminal Division

i. Amendments in Criminal Procedure Code;

ii. Gender Based Violence Cases;

iii. Sentencing Guidelines;

iv. Case Management.

v. Identification Test Parade – Rules & Procedure for Magistrates

IV. District Judiciary Court Staff Training: An important feature of the PJA Biannual Calendar is Court-Staff Training

through Webinars. In 2018, only a part of Court Staff Training (for 36

Superintendents in Punjab) was undertaken and being huge in number (more

than 21,000 working court personnel) distance-learning appears to be the only

option. The Academy has planned 10 webinars for Process Serving Agency (for

training of 6,000 officials in Punjab + 2 modules for each participant). Their

needs have been assessed and prioritized on the basis of feedback from D&SJs

and Case Management Reports* of Lahore High Court. They can play a pivotal

role in reduction of delay in decision of Civil and Criminal cases. The following

VI. Other Programs

In addition to the above trainings, the Academy may organize need-based

training programs for different stakeholders of justice sector. The Academy

may, for example, arrange special training programs for staff of Special Courts

under the administrative control of Ministry of Law. The Academy may also

conduct few Training of Trainers Workshops to develop pool of judicial

educators. The Asia Foundation also intends to organize Mediation Trainings in

its “Mainstreaming ADR for Equitable Access to Justice” Project. The Academy

is looking forward to a new experience and excellence in judicial training in the

new year.
