Requested Action
Background September 9, 2014 BCC requested review of existing
regulations regarding concrete plant type uses. Existing code allows as permitted use in I-1/I-5 September 23, 2014 BCC approved a moratorium on
new permits for concrete plant type uses(SIC Group 14). November 20, 2014 LPA approved and found the
ordinance to be consistent with the Comprehensive Plan.
BCC conducted 1st public hearing on December 2, 2014 BCC continued 2nd public hearing on December 16, 2014
to January 27, 2015
Background
The following uses listed in the Zoning Use Table are affected by the proposed regulations: SIC #1422-Cement, rock, limestone, crushing and
grinding of asphalt, concrete & cement Cement, concrete, asphalt plants SIC #1442-Operation of sand & gravel pits for
construction, sand & gravel mining SIC #1446-Operation of sand & gravel pits for
glassmaking, molding, & abrasives SIC #1475-Preparation of phosphate rock
Background
Current Code: Permitted by Special Exception in A-1 and A-2
without specified standards. Permitted by right in I-1/5, I-2/3, and I-4 with
minimal buffer and screening requirements.
Background
EvaluationAs part of staff analysis, fieldwork was conducted to ascertain appropriate distance separations for similar activities at three active sites.
Based on the noise readings staff recommends a 1,000 ft. distance separation from residential and educational uses to deter/limit noise issues.

In A-1 & A-2 Zoning Districts the subject uses shall be reviewed by special exception based on meeting the following standards: Separation distance from residential uses and schools
of 1,000 feet Separation distance applies to mobile crusher,
stockpiles, and loading/unloading activity Emissions of particular matter need to be controlled by
water suppression system as approved by EPD Must meet vibration standards of section 38-1454
Draft Regulations Type A Buffer requirements per Ch.24 Stockpiles shall be limited to 35 feet above finished
grade elevation Hours of operation shall be limited to –Monday thru Friday 7am-7pm–Saturday 8am-3pm

In the I-2/I-3 and I-4 zoning districts, the use shall be a permitted use which shall meet the same standards as A-1 & A-2, with the exception of the following: Hours of Operation - Edit pg. 4, line 134,135• Delete “and an I-1/5 zoned district described in in
subsection 38-79(77)b”• Add “..in an A-1, A-2, I-2/3, I-4 district”
Stock piles shall not exceed 50 feet
Draft Regulations
Uses shall be prohibited in I-1/5, however:Expansion of existing facilities to I-1/I-5 shall be considered for a limited time, if the facility meets the following standards: Section 38-79(c)(1,2 & 5) as proposed Buffers, including 8 ft. wall and Bamboo Stockpiles limited to 35 ft. Limited hours of operation, M-F 7-5 & Sat 8-3, closed Sundays Limited to 1 concrete crusher per facility Sound attenuation device on 3 sides Equipment shall be located as far away from residential/schools as practical or feasible.

Adoption of the ordinance as amended, amending Ch. 38 related to concrete & asphalt plants.
