EXECUTIVE SUMMARY

Bayshore Commons is a unique opportunity for a builder/developer to acquire 72 vacant developed townhome lots, ready to be built on straightaway, further leaving a future supply of 62 partially developed lots. This leaves a total of 134 townhomes that are approved and per-mitted to be built on this site.

The Bayshore Commons townhome community was originally devel-oped and started in 2006 at which time the development allowed for a total of 214 townhomes. Initially, 11 buildings consisting of 56 lots were constructed and sold, which left 158 lots remaining for comple-tion of the community

Of the total 158 remaining lots, 24 are unable to be built on due to a neighboring bald eagle nest. A formal Bald Eagle Management Plan (BEMP) has been submitted, with expected approval in early August. While the remaining 134 lots may be built upon, 60 of these lots must follow certain exterior building requirements that ensure the eagle’s nest remains protected. BALD EAGLE RADIUS PLAN

In 2016, a bald eagle relocated its nest to the south preserve area of Bayshore Commons. This has become known as Eagle Nest LE-006. Bald eagles are a protected species by the fed-eral government and, as such, certain precautions must be met when constructing new homes in the presence of an ac-tive nest site. To resolve this issue, the sellers have engaged an environmental consultant to draft a Bald Eagle Management Plan (BEMP) that not only protects the nest but also allows for construction to continue. The BEMP is expected to be approved and in place by mid-August.

The following items summarize the main points of the BEMP:

• Within 350’ of the nest: No construction can occur so long as the nest is active (24 lots)

• Within 350’ - 660’ of the nest: Exterior construction is al-lowed on all lots only during the non-nesting season. The non-nesting season is May 16 – September 30 (47 Lots)

• Beyond 660’ of the nest: No special construction require-ments for lots located beyond 660’ of the nest

• Interior construction can be completed any time through-out the year

• Exterior lighting must be positioned in a way that protects the nest from illumination
