NOTICE OF ADOPTION OF OFFICIAL PLANAMENDMENT AND OF COMPLETION OFCLASS ENVIRONMENTAL ASSESSMENT

BY THE CITY OF HAMILTONIN THE MATTER OF:.

1. Official Plan Amendment No. 98 to the Town of Ancaster Official Plan;

The Council of the City of Hamilton has adopted and approved the abovenoted Official Plan Amendment by passing By-Law No. 04-035 on the 25th dayof February, 2004. The City of Hamilton hereby gives notice of adoptionpursuant to the Planning Act (1996).

The purpose of this Amendment is to introduce a Secondary Plan in order toestablish a policy framework to guide the development and/or redevelopmentof the land within the Meadowlands Neighbourhood IV.

The effect of this Amendment is to establish land uses, the basic transportationnetwork, community facilities, infrastructure requirements, and developmentstandards and to provide protection for the existing natural features andenvironmental resources on the subject lands.

2. Background Report: Meadowlands Neighborhoods 3, 4 and 5, ClassEnvironmental Assessment Master Plan

The City of Hamilton has chosen to integrate the planning process for theSecondary Plan for Meadowlands IV Official Plan Amendment No. 98 underthe Planning Act, with the Class Environmental Assessment process, inaccordance with Schedule A.2.9 of the Municipal Engineers Association ClassEnvironmental Assessment (June 2000). A master servicing plan has beenprepared for the Meadowlands III, IV and V Neighbourhoods, in conjunctionwith the Secondary Plan. The master servicing plan includes infrastructurerequirements necessary to service the planning area, including theestablishment of a road network and stormwater management plan. Thereare several projects contained within the Master Plan which require approvalunder the Municipal Class E.A. The Master Plan will fulfill Schedule Brequirements of the Municipal Engineers Association Class EnvironmentalAssessment (June 2000) for all projects. Accordingly, if no appeals are received,the transportation and stormwater management projects within the subjectlands, will be approved Schedule “A” projects under the Municipal Class EAand no further EA approvals would be required.

THE DECISION BY COUNCIL ON THE PROPOSED OFFICIAL PLAN AMENDMENTAND ENVIRONMENTAL MASTER PLAN IS NOT FINAL UNTIL THE 20 DAY APPEALPERIOD HAS EXPIRED. IF NO APPEAL IS FILED ON OR BEFORE THE DATE NOTEDBELOW, THE DECISION OF THE CITY IS FINAL.

THE LAST DAY OF APPEAL FOR THE ABOVE NOTED AMENDMENT ANDENVIRONMENTAL MASTER PLAN IS March 25, 2004.

Any person or agency who objects to Official Plan Amendment No. 98 and/orEnvironmental Master Plan may appeal the decision of Council to the OntarioMunicipal Board by filing with the Clerk of the City of Hamilton a cheque ormoney order in the amount of $125.00 for each appeal, payable to theMinister of Finance, Province of Ontario. A notice of appeal setting out thespecific part of the proposed Official Plan Amendment to which the appealapplies and the reasons for the appeal of the Official Plan Amendment isrequired to be accompanied with the Ontario Municipal Board fee.

Appeals should be submitted to: The City Clerk, City of Hamilton, 71 MainStreet West, Hamilton, ON L8P 4Y5. Setting Sail (West Harbour Planning Area) Study & Class Environmental Assessment

Draft Secondary Plan & Alternative Solutions for the Transportation Master Plan

THE STUDY

The City of Hamilton is preparing a planning study for theWest Harbour Planning Area which is bound by YorkBoulevard to the west, Wellington Street to the east andnorth from Cannon Street to the waterfront. (See map)The goal of this project is to create an integrated plan thatwill guide investment and development in the area incoming years, all within the context of a comprehensivevision. When the project is finished the result will be a newSecondary Plan, Urban Design Guidelines, a Transportationand Infrastructure Master Plan, revisions to the Zoning By-law, and a Class Environmental Assessment (EA) for futuremunicipal infrastructure projects in the study area.

BACKGROUND

Public Consultation has been a key factor of thisintegrated planning and environmental assessmentprocess. The following is an outline of the public eventsthat have occurred to date:

PUBLIC INFORMATION CENTRE

At this stage in the study, a Public Information Centre hasbeen arranged to provide residents and members of thepublic an opportunity to review and comment on thedraft Secondary Plan and alternative solutions for theTransportation Master Plan for the study area.

The draft Secondary Plan will include future land usedesignations for the study area.

The Transportation Master Plan study will review theanticipated transportation impacts as a result of theproposed land uses, road network and classificationalternatives and related roadway infrastructurerequirements within the study area. The TransportationMaster Plan is being conducted in accordance with therequirements of the Environmental Assessment Act.

The purpose of this notice is to invite you to attend thefourth Public Information Centre.

The Public Information Centre will be held on twodifferent days at three different locations:
