July 19, 2016
A meeting of the Grand Rapids Charier Township Board was called to order at 7:00 pm by Supervisor Michael DeVries. The meeting was held in the Township Hall . The following were present: Supervisor Michael DeVries, Clerk Edward Robinette, Treasurer David Van Dyke, and Trustees David Pierangeli, Lee Van Papering, and Beverly Wall . Trustee Rusty Merchant joined the meeting at 7:05 . There were two people in the audience.

3. APPROVE MINUTES OF THE REGULAR TOWNSHIP BOARD MEETING OF JULY 5, 2016.
Lee Van Papering, seconded by David Pierange li , moved approval ofthe minutes as presented. The motion passed unanimously.
4. CONSIDER BILLS TO BE PAID.
Lee Van Papering, seconded by Beverly Wall , moved payment of the bills as presented . The motion passed unanimously.
5. CONSIDER APPROVAL OF SCHOOL HOUSE PAINTING PROPOSAL.
Lee Van Papering, seconded by Beverly Wall, moved approval of the bid in the amount of $3150.00 with Vanderwey Painting. The motion passed unanimously.
6. CONSIDER APPROVAL OF THE CRAHEN VALLEY PARK IRRIGATION PROPOSAL.
Lee Van Papering, seconded by David Pierangeli , moved approval of the irrigat ion proposal for the amount of$11 ,975.00. The motion passed unanimously.
7. CONSIDER APPROVAL OF ASSESSING SERVICES AGREEMENT WITH THE CITY OF CEDAR SPRINGS.

Supervisor DeVries presented the 2016 2"ct Quarter Budget Report. The one area of note is the downturn in building permit fees.

11. BOARD COMMENTS. There were none.
12. PUBLIC COMMENTS. Walter Allen , of2300 Dunnigan Ave. NE, commented regarding the high levels of chloride found in his well water. He thanked Supervisor DeVries for his efforts to find a solution and pointed out the negative impact this issue will have on his property value.
13. EXECUTIVE SESSION TO DISCUSS LEGAL ISSUE.
Rusty Merchant, seconded by Lee Van Popering, moved to go into executive session to discuss a legal issue and the potential purchase of property. The motion passed unanimously. Following the executive session, Rusty Merchant, seconded by Lee Van Popering, moved to return to public session. The motion passed unanimously.
14. ADJOURNMENT. The meeting was adjourned at 8:17 pm.

ORDINANCE NO. 512
AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CHARTER TOWNSHIP OF GRAND RAPIDS
[Amendment No.2 of Cook Valley Estates Green House Planned Unit Development]
WHEREAS, on March 21 , 2006, the Township Board adopted Township Ordinance No. 445,
approving the Cook Valley Estates Green House Planned Unit Development (PUD);
WHEREAS, on February 19, 2008, the Township Board adopted Township Ordinance No.
462, approving Amendment No. 1 of the Cook Valley Estates PUD;
WHEREAS, Porter Hills Presbyterian Village, Inc. has submitted an application and a
preliminary PUD plan for a major amendment in the PUD, to permit the installation and use of a
ground sign for identification purposes, as more fully described in the application and other materials
submitted; and
WHEREAS, the Planning Commission has held a public hearing on proposed Amendment
No.2 and has recommended that the Township Board adopt the Amendment.
THE CHARTER TOWNSHIP OF GRAND RAPIDS ORDAINS:

Section 1. Amendment No. 2 of PUD. Township Ordinance No. 445 and Township
Ordinance No. 462, together establishing and amending the Cook Valley Estates Green House PUD,
are hereby amended by the amendment of Section 2(m) ofTownship Ordinance No. 462, to read in
its entirety as follows:
Section 2. Terms and Conditions of this Ordinance . ..
(m) Signage. In addition to traffic directional signs and other small signs for traffic control purposes, the PUD may include one ground sign, for identification purposes only. Such sign shall conform exactly to Drawing No. 158, 276A-2, dated March 29, 2016, and submitted by the applicant, including the sign message and configuration, structure, height, width and other dimensions, and generally the colors indicated. The sign shall be illuminated internally only; the appearance of the sign when illuminated shall be generally as shown on the abovestated drawing. The sign shall be located as shown on the revised aerial photograph submitted on or about May 24, 2016, whereby the sign is shown to be located in front of the building at 1015 East Paris A venue SE, south of the driveway just north of the building and located at least five feet west of the East Paris Avenue right-of-way line and at least 1 112 feet west of the sidewalk along the frontage of the property.
Section 2. Effect of this Amendment Ordinance. This ordinance amends Township
Ordinance No. 445 and Township Ordinance No. 462 only as stated in Section 1 hereof. All other
terms and provisions of such ordinances remain in full force and effect.
Section 3. Township Board Findings. The Township Board determines that this
Amendment No. 2 satisfies the purposes of the office/residential (OR-PUD) Planned Unit
Development District (formerly PUD-3), as stated in Section 17.1 of the Township zoning
ordinance, and the standards for approval of PUDs, including, but not limited to, the following:
(a) Amendment No. 2 would result in a recognizable and substantial benefit to the
users ofthe PUD and the Township.
(b) Amendment No. 2 would not result in a material increase in the need for
public services or facilities, nor place a material burden upon the PUD lands or adjacent or nearby
lands.

(c) Amendment No.2 is consistent with the Township Comprehensive Land Use
Plan.
(d) The proposed identification sign would not result in significant adverse effects
on adjacent or nearby lands, nor would it change the essential character of the sun·ounding area.
(e) In general, this Amendment and the proposed identification sign would be
consistent with the public health, safety and general welfare. The conditions set f01ih herein
concerning the proposed sign are determined to be those conditions which are necessary in achieving
appropriate and readily visible identification signage for commercial, office and institutional land
uses.
Section 4. Enforcement.
(a) The Township may enforce the provisions of this ordinance and applicable
provisions of the zoning ordinance, building code and other ordinances, laws and regulations to the
extent and in any manner provided by law. In the event that the applicant shall fail to carry out,
either at all or on a timely basis, any provision or requirement of this ordinance or other applicable
law, ordinance or regulation, the Township may through its building inspector or other Township
agency issue and post a stop work order at the site of any improper or non-complying work or
construction, directing that all further work or construction be ceased forthwith , pending the
compliance with any applicable provisions of this ordinance or of other Township ordinances,
regulations or state laws.
(b) Upon the issuance of any stop work order, the applicant shall comply fully
therewith without delay. Upon the correction of any matters as to which the stop work order was
issued, the Township shall promptly rescind and remove the stop work order, whereupon the
applicant may again proceed with construction or other petmissible activity on the site. The issuance

and posting of any stop work order shall not be an exclusive remedy, but may be undertaken by the
Township in addition to all other lawful means of enforcement.
Section 5. Publication/Effective Date. This Ordinance shall become effective seven
days after its publication or seven days after the publication of a summary of its provisions in a local
newspaper of general circulation.

Michigan Adventure Racing has submitted a request fo r temporary road closure for the Dirty Duel Trail Race on November 12, 2016, 8:00am to 11:30am. The start/finish will be at Robinette's Apple Ha us. The temporary road closure will be at the intersection of 4 Mile & Bird Avenue. The following documents have been submitted for approval.
• Map of the race route identifying road closure location and points for traffic control personnel.
• Grand Rapids Charter Township Hold Harmless Agreement.
• Liability Insurance policy in the amount of $2,000,000.00 listing GRT as an add itional insured.
• Email of permission from Robinette's Apple Haus granting approval for the use of thei r private property.
• Approval from the Kent County Sheriff Department acknowledging their assistance with road closure.
• Payment of $125.00 for the Temporary Road Closure permit.
RECOMMENDATION
It is recommended that the Grand Rapids Charter Township Board approve the M ich igan Advent ure Racing Dirty Duel Trail Race scheduled for November 12, 2016.

The Michael J. Bast Chapter 18 of the Vietnam Veterans of America will observe Prisoner of War/Missing
in Action Recognition Day on Friday, September 16, 2016. We will have a brief ceremony at 2:00PM in
the chapel of the Michigan Home for Veterans in Grand Rapids.
We would like the Township of Grand Rapids, with other communities, issue a proclamation declaring
September 16,2016 as Prisoner of War/Missing in Action Day. This resolution would then be presented
to the Michael J. Bast Chapter of the Vietnam Veterans . A sample is included for your convenience.
Your presence is requested at this ceremony to make the presentation to the Vietnam Veterans of
America Chapter 18. Out of respect for those who are present, we would appreciate dignitaries being
present for the entire ceremony.

RESOLUTION TO PROVIDE FOR THE DESIGNATION OF
SEPTEMBER 16, 2016 AS
11PRISONER OF WAR/MISSING IN ACTION RECOGNITION DAY"
WHEREAS, the United States has fought in many wars, one of the longest was
the Vietnamese Conflict; and,
WHEREAS, Friday, September 16, 2016 is a day of remembrance for those who
suffered as prisoners of war or are still missing as a result of any conflict; and,
WHEREAS, although cooperation has increased within the past few years,
there are still nearly 1700 American servicemen and civilians including 49 from
the State of Michigan missing and unaccounted for in Indochina. The uncertainty
surrounding their fates has caused their families to suffer great hardship; and,
WHEREAS, increasing public awareness and focusing public attention on this
issue is one way to help achieve this goal;
NOW, THEREFORE BE IT RESOLVED. By the Trustees of the Township of Grand
Rapids, that Friday, September 16, 2016 shall be designated as:
11PRISONER OF WAR/MISSING IN ACTION RECOGNTION DAY."
We urge all of our citizens to take note of this important issue and remember
those servicemen and civilians who were prisoners of war and those who are still
missing and to commemorate the day with appropriate activities.
