SAREC® Testifies at White House Conference on Aging Solutions

The Ninth Circuit Court of Appeal amended its decision in Holley v. Crank in early March, underscoring the importance of adhering to corporate formalities and avoiding situations where the corporate veil may be pierced. In October 2004, the court originally

decided that a designated broker of a California real estate corporation could be held personally liable for negligently supervising his salesperson who engaged in acts of racial discrimination. This decision defied the corporate principles that generally shield a corporate officer

from personal liability for the acts of others. In response to this adverse opinion, C.A.R. filed an amicus curiae or “friend of the court” brief for the Ninth Circuit to reconsider its decision. The court amended its opinion, eliminating language that held the designated broker

personally liable under a theory of negligent supervision. “The court’s decision does not change a designated broker’s duty, under California licensing laws, to properly supervise the activities of his or her salespersons,” said C.A.R. Spring is here! Our real estate market is flowing along nicely. We still could use many more listings and I’d like to see more opportunities for first-time homebuyers, but as interest rates gently rise there is perhaps a glimmer of balance coming to our market. We’ve all been so busy working this strong seller’s market that Spring arrived, my crop of Day Valley weeds is flourishing and my own garden preparation is a little tardy. Take a moment to enjoy these reflections on Springtime and the coming gardening frenzy. . . Weed ‘um and reap!

We are in the time of year where spring is everywhere and winter is fading fast. Spring always brings forth the hard work nature has provided since the onset of fall and winter. Everywhere we see blossoming fruit trees, wildflowers, roses and so much more. As with nature many of our plans become reality after months of planning and hard work. The first major event of the year is the ever popular Spring Fling scheduled for Wednesday, May 4th at the SCAOR office. This is a great opportunity to visit with fellow association members while enjoying a great lunch. Be sure to put this date in your calendars. Our focus continues on the 4 sub-committees within the Affiliate Committee. The 3rd sub-committee is chartered with Affiliate Membership and Recruiting. This committee has

the important task of attracting new members and communicating Affiliate value to prospective members as well as SCAOR members. The s t r onge r ou r Aff i l i a t e Membership is, the more powerful the entire Association becomes. Affiliate members encompass all individuals and organizations that participate in real estate related activities, but are not active REALTORS®. These can include companies such as title, lending, insurance, home inspection, roofing, construction, interior decorators, legal, appraisal, etc. The Membership and Recruiting sub-committee has established new Affiliate member recruiting goals for 2005. Events are being planned to introduce prospective members to the benefits of SCAOR membership. Additionally, new

programs aimed at increasing the value of participation are being developed. The final initiative is the development of programs and tools for better dissemination of Aff iliate member capabilities. The purpose of this is to provide SCAOR members an enhanced resource for real estate related services. This will include print and web based information tailored to the needs of the real estate community. The NATIONAL ASSOCIATION OF REALTORS® cheers the U.S. House of Representatives’ Committee on Education and the Workforce for approving the Small Business Health Fairness Act. The legislation (H.R. 525), one of NAR’s top priorities, would allow small businesses and self-employed workers to band together through a trade or professional association to negotiate lower health insurance costs for participants. Small business health plans would operate under the same rules as federally regulated, large corporate and union health plans that provide group health insurance to all participants regardless of where they live. The measure was introduced last month and is identical to legislation that passed the House twice last year with bipartisan support.

NAR President Al Mansell says, “Small business health plans will give small business and self-employed workers the same right to quality, affordable health insurance as corporate employees and union members. REALTORS® are committed to doing everything we can to help Congress enact small business health plan legislation this year.” According to a 2004 NAR survey, 28 percent of REALTORS® have no health insurance at all. Only 7 percent of real estate fi rms offer health care overage for independent contractors, who are the largest segment of real estate practitioners. It’s that time of year again, where you can put on your bowling shoes, grab a friend and make a difference! This year’s Big Brother Big Sister’s Bowl for Kids Sake fundraiser will be on Saturday April 9th at 10:30am at the Boardwalk Bowl.

This is a fun event, and a GREAT time for all of us to come together, in support to help make a difference for the children seeking mentors in our local community. Big Brother’s Big Sisters vision is “to provide a mentor for every child who needs or wants one.”

We should all be very proud to be part of a community that is responsible for organizing and raising more money locally than any other fundraiser for BBBS all year long. We continue to be the biggest fundraiser for BBBS, and this year we hope to continue our legacy. Most recently, Santa Cruz Title made a nice donation to BBBS via our fundraiser. Thank you Lori Doan, and thank you everyone for your continued support of this event! Bowl for Kids Sake April 9

In February, the Federal Commu-nications Commission (FCC) issued an Order addressing certain issues raised in NAR’s Petition for Recon-sideration of the Commission’s 2003 Telephone Consumer Protection Act (TCPA, a.k.a. Do-Not-Call) rules. Spe-cifi cally, NAR requested that the FCC clarify that calls to “For Sale By Owner” (FSBO) and expired listings fall outside the scope of the Do-Not-Call rules. The FCC did clarify that calls to FSBOs by real estate professionals rep-resenting a potential buyer are not a tele-phone solicitation, so long as the purpose of the calls are to discuss the potential sale of the property to the represented buyer. Unfortunately, the FCC declined to exempt from the Do-Not-Call rules calls to expired listings and to FSBOs for the purpose of offering services to residential subscribers (homeowners). CAR will be releasing 16 new or revised forms on April 25th. While most of your old forms will still work, as of the new revision date, use of the prior version of the form meets current legal requirements. However, C.A.R. will no longer monitor the legal validity of any prior form version and the C.A.R. User Protection Agreement only applies to the most current version of a form. (See http://www.car.org/index.php?id=OTQ1 for full text of the User Protection Agreement.)

Four of these forms are brand new:Cancellation of Listing (COL): The Cancellation of Listing documents the agreement between a seller and a listing broker when a property will not be marketed anymore during the remaining term of an unexpired listing agreement or

CAR Forms Revisedwhen a seller and a listing broker decide that they are unable to continue to work together. Options exist whereby (i) a listing broker agrees to accept a sum certain in exchange for giving up the right to market and sell the property, (ii) the listing broker will release the seller without any immediate financial obligation unless the seller in fact sells the property during the listing term and (iii) the

broker and client will depart without any continuing financial or other obligations flowing from one to the other.

Lease/Rental Mold and Ventilation Addendum (LRM): This form advises a tenant of the potential health hazards of mold and of the tenant’s obligation to keep the property well ventilated and to report suspected mold conditions promptly.

Seller Property Questionnaire (SPQ): The Seller Property Questionnaire is a form to be completed by a seller in an effort to give a buyer a more comprehensive understanding of the property to be acquired. The SPQ does not replace the Real Estate Transfer Disclosure Statement but supplements it. The SPQ is not mandated by statute or contract but may serve as a helpful

tool in a transaction. The three pages of questions can often prompt a seller to remember something about the property that the seller otherwise would not have remembered or may not have considered important enough to disclose. The questions ask for the seller’s actual knowledge not a warranty regarding the property’s condition.

Home Equity Explanation and Agency Agreement/Notice of Default Purchase Agreement/Notice of Cancellation of Notice of Default Purchase Agreement (HEAA/ NODPA/ HENC): This tri-partite package of forms is only used when an owner-occupant of residential property, against which a Notice of Default has been recorded, is selling the property to an investor purchaser. The HEAA describes the law regarding this particular type of transaction, the consequences for violating the law, and the withdrawal of the buyer’s agent from the transaction. The NODPA is the actual purchase agreement printed in the statutorily required format. The HENC is the form the seller uses if the seller desires to rescind the sale within the statutory period.

SAREC® is owned by Real Estate Business Services Inc. (REBS), a subsidiary of the California Association of REALTORS® (C.A.R.).

When you really need to know the true market value of real

property, any type of real property, call us.

Real estate is a reputation business. Here are ways you can bolster your reputation -- as well as everyone you represent, including your company, association, and industry -- by showing respect for the public, the properties you show, and your peers. Respect for the public1. Respond promptly to inquiries and

requests for information. 2. When showing an occupied home,

always ring the doorbell or knock. If there’s no answer, announce yourself loudly before entering. Do the same before entering any closed room.

3. Present a professional appearance at all times. Dress appropriately and drive a clean car.

4. Be aware of and meet all deadlines. 5. Promise only what you can deliver—

and keep your promises. 6. Don’t tell people what you think. Tell

them what you know. Respect for property 7. Be responsible for everyone you allow

to enter listed property. 8. Never allow unaccompanied access

to property without permission. 9. Enter property only with permission,

even if you have a lockbox key or combination.

10. When the occupant is absent, leave the property as you found it (lights, heating, cooling, drapes, and so on). If you think something is amiss (for example, you see signs of

14. Be aware that large electronic files with attachments or lengthy faxes may be a burden on recipients.

15. When showing a property, notify the listing broker if there appears to be inaccurate information on the listing.

16. If you’re the listing agent, share important information about the property, including the presence of pets, security systems, and whether sellers will be present during showings.

17. Avoid the inappropriate use of endearments or other denigrating language.

18. Don’t prospect at other practitioners’ open houses or similar events.

Thanks to the Santa Cruz Association of REALTORS® Housing Foundation Board of Trustees and the many fine volunteer committee members, we are progressing ahead rapidly. Much work has been done and we are getting set to announce a signature event to be held later this year. Marketing and promotional materials are being completed and allocation and distribution programs are being designed. We are coordinating an educational symposium and have many other ideas being developed. We are also working on a very nice thank you to all those Charter contributors from 2004. We also have recently voted on setting aside some funds to be distributed this year. We are still looking for additional volunteers on our Marketing and Public Relations, Allocations & Distributions and Fundraising committees.

described earlier in this guide. • Make sure all the connections

between the DisplayKEY, Cradle, power source, and phone line are secure. Make sure the DisplayKEY is seated firmly in the Cradle.

• Perform a reset on the DisplayKEY Cradle by unplugging the Cradle from the power outlet for 10 seconds.

• If your DisplayKEY is not updated, perform a manual eSYNC to update your DisplayKEY.

• If a function fails, verify you are entering the correct code and try the function again.

• If you cannot access the KeyBox, check with the listing agent to ensure you are within the timed access hours or if the Call Before Showing feature is activated.

If Your Key Is ExpiredThere are several ways to update your DisplayKEY: • Place your DisplayKEY on the Cradle

each night. The Key automatically dials the KIM network each night at a designated time between midnight and 6 am to perform an eSYNC. eSYNC is the process where your DisplayKEY connects to the KIM network through the modem in the Cradle, information is exchanged, and your Key is updated.
