1. INTRODUCTION

1.1 Background

SiVEST have been appointed as independent consultants to conduct a Basic Assessment for; The construction of a flyover to serve as an extension of the Western Freeway on the inbound

carriageway; The bulk transportation of sewage and water, including storm water, in pipelines; and Construction of a road that is wider than 4 metres or that has a reserve wider than 6 metres,

excluding roads that fall within the ambit of another listed activity or which are access roads of less than 30 metres long.

The eThekwini Municipality is proposing to construct an elevated flyover to serve as an extension of the Western Freeway on the inbound carriageway. The proposed activity forms part of the Municipality's two initiatives to improve transportation networks and roads across the CDB in preparation for the 2010 World cup and beyond. The Warwick Precinct is characterised by high volumes of traffic that cut through the area, adding no value to the area and indeed detracting from its attractiveness. The high levels of traffic create an unsafe environment for residents, pedestrians and commuters alike and are a barrier to redevelopment and growth of the area. In order to address this issue, the eThekwini Municipality is proposing to separate the through traffic from the activities of Warwick Junction through the construction of fly-overs that take all through traffic over the highly congested quadrant of Market, Leopold, Warwick and Johannes Nkosi Street. The proposed project will link the Western Freeway and Johannes Nkosi Street (terminating just before Russell Street), thus by-passing the highly congested Warwick/Old Dutch and Johannes Nkosi Street. /Market intersections on the inbound carriageway and thereby improving traffic flow through the area in a safe and efficient manner. The proposed design of the link is approximately 1000m long, of which the elevated section is approximately 300m long, and will consist of 3 x lanes (12-15m wide).

1.2 Purpose of the report

The principle purpose of this report is to: To summarise the methods and extent of the public participation process followed for the basic

assessment phase of this project; To convey the issues raised by all I&APs and stakeholders during the basic assessment phase;

and To ensure that concerns raised during the public participation process are sufficiently addressed in

the basic assessment report.

1.3 Legislation and Guidelines

National Environmental Management Act (Act No 107 of 1998) – NEMA The National Environmental Management Act (Act No 107 of 1998) was promulgated on the 27th of November 1998. This Act replaces parts of the Environment Conservation Act (Act No 73 of 1989) with exception to certain parts pertaining to the Integrated Environmental Management. The act intends to provide for co-operative environmental governance by establishing principles for decision-making on matters affecting the environment, institutions that will promote co-operative governance and procedures for coordinating environmental functions exercised by organs of state; to provide for the prohibition, restriction or control of activities which are likely to have a detrimental effect on the environment; and to provide for matters connected therewith. Activities that may significantly affect the environment must be considered, investigated and assessed prior to implementation. In order to give effect to the general objectives of integrated environmental management laid down, the potential impact on, the environment socio-economic conditions, and the cultural heritage activities that require authorisation or permission by law and which may significantly affect the environment, must be considered, investigated and assessed prior to their implementation and reported to the organ of state charged by law with authorising, permitting, or otherwise allowing the implementation of an activity. This report outlines the process followed in informing I &AP’s of the proposed projects, the comments received from I &AP’s and responses provided thereto as required in Section E of the Basic Assessment Report, and in accordance with Chapter 36 of the EIA Regulations, 2006 promulgated under Section 24(5) of NEMA, Act 107 of 1998 as amended. DEAT (2005) Guideline 4: Public Participation, in support of the EIA Regulations, 2005, Integrated Environmental Management Guideline Series, Department of Environmental Affairs and Tourism (DEAT) DEAT has produced a set of guidelines, to assist the various role-players in understanding what is required of them during the public participation process. The guidelines are to be used in conjunction with the NEMA regulations, to assist and provide information on the public participation requirements.

2. OVERVIEW OF PUBLIC PARTICIPATION PROCESS The main objectives of the public participation process are to: Identify Interested and Affected Parties (I&APs); Inform the I&APs of and provide sufficient background and technical information regarding the

proposed development; Create opportunities and mechanisms whereby I&APs can participate and raise their viewpoints

(issues, comments and concerns) with regard to the proposed development; Assist in identifying potential environmental (biophysical and social) impacts;

Give feedback to I&APs on process findings and recommendations; and Ensure compliance to process requirements with regards to the environmental and related

legislation.

2.1 Notification of Potential Interested and Affected Parties Communication with I&APs was by telephone, faxes and e-mail in order to obtain the necessary background information to compile this report. The advertising process was followed in terms of the Regulation 56 of the Environment Impact Regulations published in Government Notice R385 in Government Gazette No. 28753 of 21 April 2006, Section 24(5) of the National Environmental Management Act (107 of 1998), as amended. 2.1.1 Preliminary Basic Assessment Process

Interested and Affected Parties where identified by visiting the proposed site and consulting landowners as well as business owners and municipal services. Additional I&APs were sourced form websites and databases from previous projects.

A public meeting was conducted on Thursday, 14 June 2007 at the ITRUMP Project Centre at 17h30. Comments and concerns were noted and can be viewed in Appendix 3, the Comments and Response Report.

2.1.2 Announcement of Project At the announcement of this project the following methods where used to inform possible I&APs: On-site notices were placed – 10 English, 10 Zulu Letters and telephonic correspondence with property owners in areas closest to the site of the

proposed development. Pamphlets Distribution (within 100m radius of project site) – 1000 pamphlets Background Information Document sent out to identified stakeholders by fax, email; hand delivery. Advertisement as follows;

o Mercury - 25th May 2007, o Isolezwe – 25th May 2007, o Kwana - 25th May 2007, o Berea Mail – 29th May 2007

Open day & Public Meeting: 14 June 2007 Notifications where placed on www.durban.gov.za/durban/services/services_news A database of key Interested and Affected Parties was compiled.

2.1.3 Notification of Change in Scope of Project Letters where sent out, via fax and email, to all Key Stakeholders and I&APs to inform them of the change in the scope of this project. Please see Appendix 1 for a copy of the letter.

2.1.4 Public Review of the Draft Basic Assessment Report The Draft Basic Assessment report was made available for public review at the following locations: Ethekwini Local Municipality – Old Fort Place, Durban The ITRUMP Project Centre - 22 Stradford Road, Durban The City Library As per the newspaper advertisements, a copy of the BA report can be made available on CD on

request. The availability of the report was advertised in the Mercury, Isolezwe, Kwana and Berea Mail. A copy of the report was available on the Municipality website: (www.durban.gov.za/durban/services/services_news). Once the comment period of 14 days ended, the comments received were incorporated into the report. The report has been finalised and the Final Basic Assessment Report submitted to DAEA for review and decision making.

SiVEST Environmental Division has been appointed by eThekwini Municipality as independent environmental consultants to undertake the Environmental Impact Process for the proposed construction of the Warwick Avenue inbound flyover. The purpose of this document is to provide Interested and/of Affected Parties with an opportunity to register, and to identify environmental issues and concerns associated with the proposed project. Project Locality

The proposed development occurs within the Warwick Precinct, bounded by Berea Road in the south, Mansfield/Carlisle in the north, Cross Street in the east and Botanic Gardens Road in the west. This precinct lies approximately 3.5 km from the Natal Bay and is relatively central in a north/south orientation. High capacity road based transport routes connect this area to the rest of city’s CBD as well as to the various residential, recreational, commercial and industrial areas within and bordering eThekwini. The proposed site is owned by the eThekwini Municipality in its entirety.

Description of the proposed activity

The eThekwini Municipality wishes to construct an elevated flyover to serve as an extension of the Western Freeway on the inbound carriageway.

The eThekwini Municipality are proposing that Carlyle and Cross Streets will be used as detours during construction. Relevant Environmental Legislation

On the 21 April 2006, the National Department of Environmental Affairs and Tourism (N DEAT) promulgated the new Environmental Impact Assessment (EIA) Regulations. This proposed project will form part of the Environmental Impact Assessment that is being undertaken in accordance with Regulations 28 in terms of the EIA Regulations published in Government Notice R385 of 21 April 2006 in terms of Chapter 5 of the National Environmental Management Act (No 107 of 1998). The EIA process is an effective planning and decision- making tool. It allows the environmental consequences of a proposed project to be identified, whether positive or negative, and these identified consequences to be managed through the environmental planning process. SiVEST Environmental Division has been appointed by eThekwini Municipality as independent environmental consultants to undertake the Environmental Impact Process for the proposed

construction of the Warwick Avenue inbound flyover. The purpose of this Background Information

Document (BID) is to provide Interested and Affected Parties with an opportunity to register, and to identify environmental issues and concerns associated with the proposed project. You are therefore invited to submit any comments and queries you may have to the details provided below.

Title of the proposed activity

Proposed Warwick Avenue Inbound Flyover: between Botanical Gardens Road & Johannes Nkosi

Street (formally Alice Street).

Project Locality & Description

The proposed development occurs within the Warwick Precinct, bounded by Berea Road in the south,

Mansfield/Carlisle in the north, Cross Street in the east and Botanic Gardens Road in the west (see attached layout- please contact me for should you need a hardcopy delivered). This precinct lies

approximately 3.5 km from the sea and is relatively central in a north/south orientation. High capacity road based transport routes connect this area to the rest of city’s CBD as well as to the various

residential, recreational, commercial and industrial areas within and bordering eThekwini. The

proposed site is owned by the eThekwini Municipality in its entirety.

The Berea Railway Station is located at the centre of this precinct, and handles the greatest number of passengers of any railway station within the city. The areas to the west and north of the railway

station are characterised by a conglomeration of taxi and bus ranks that serve over 100 bus and 180

taxi destinations respectively, throughout the Municipality and further afield. The result is a large volume of public transport passengers traversing this precinct on foot to move between the various

transport modes. This in turn has resulted in a significant informal trade sector to serve this pedestrian movement. The situation exists where approximately 110 000 vehicles (including buses and

taxis), 400 000 pedestrians, as well as the large informal trade sector, compete for limited space on a daily basis.

Description of the proposed activity

The eThekwini Municipality wishes to construct an elevated flyover to serve as an extension of the Western Freeway on the inbound carriageway.

The Warwick Precinct is characterized by high volumes of traffic that cut through the area, adding no value to the area and indeed detracting from its attractiveness. The high levels of traffic create an

unsafe environment for residents, pedestrians and commuters alike and is a barrier to redevelopment and growth of the area. In order to address this issue, the eThekwini Municipality is proposing to

separate the through traffic from the activities of Warwick Junction through the construction of fly-

overs that take all through traffic over the highly congested quadrant of Market, Leopold, Warwick and

Johannes Nkosi Street.

The proposed project will link the Western Freeway and Johannes Nkosi Street (terminating just before

Russell Street), thus by-passing the highly congested Warwick/Old Dutch and Johannes Nkosi Street.

/Market intersections on the inbound carriageway, and thereby improving traffic flow through the area in a safe and efficient manner. The proposed design of the link is approximately 1000m long, of which the elevated section is approximately 300m long, and will consist of 3 x lanes (12-15m wide). Refer to

the attached layout for illustrations

The proposed development will not require demolishing of buildings. However, informal traders and

the public transport operators (under ETA) will be affected. It is expected that the proposed development will affect some of the exiting servitudes including the railway line and existing roads,

and taxi/bus ranks in the market towards Botanical Gardens road. The servitudes might require closure during construction activities. There are also residential buildings and businesses established adjacent to the proposed route that may be affected.

Tendering for construction is expected to begin in October

Relevant Environmental Legislation

Identification of the proposed activity identified in terms of Sections 24(2)(a) and 24(d) of the National Environmental Management Act 107 of 1998 (as amended) in GN R.385 (21 April 2006) and which

must follow the BASIC ASSESSMENT PROCEDURE as described in Regulations 22 to 26 of the

Environmental Impact Regulations, 2006 promulgated in terms of Section 24(5) NEMA (Act 107, 1998) and published in GN. R.386 (21 April 2006).

Activity 15: “The construction of a road that is wider than 4 meters or that has a road reserve wider than 6 meters…”

Environmental Impact Assessment Process

In line with environmental legislation, eThekwini Municipality has appointed SiVEST as independent

environmental consultants to coordinate and manage the environmental authorization process as contemplated in Sections 24(2)(a) and 24(d) of the National Environmental Management Act 107 of

1998 (as amended) in GN R.385 (21 April 2006). As part of the Basic Assessment process followed,

the following tasks will be completed:

1. An advertisement in a local and regional newspaper inviting written comments giving Interested and Affected Parties a fourteen (14) day period in which to register.

2. Submission of Background Information Document to identified Stakeholders including relevant Government Departments as well as local residents.

3. Public participation processes which will include written notice of the proposed project to Interested and Affected Parties I&AP’s located in the vicinity of the proposed project route.

4. Initiation of the Basic Assessment of all issued identified for incorporation into a Basic

Assessment Report to be submitted with an Application form to DAEA. A copy of the Basic Assessment Report will be made available for public comment prior to being submitted to DAEA.

Issues for consideration will be raised by the following means:

• Inputs from I&AP’s during the public participation process.

• Compilation of the information relevant to the proposed development, including reference to

existing specialist studies in area. • Site visit and assessment by the consultants and relevant specialists.

• Evaluation of proposed design scope and potential impacts.

Issues raised by I&AP’s will be incorporated into the Basic Assessment Report, which will be submitted to DAEA for consideration.

1. INTRODUCTION An open day was held between 10h00 and 16h30 during which members of the public were invited to come to the venue to learn more about the proposed activity and to submit their comments/concerns. A public meeting was also scheduled for 17h30 during which a presentation on the proposed activity was be made to the attendants which would then be follwed by a discussion session. The public meeting was however cancelled due to poor attendance. The following people attended the public open day/meeting,and were attended to on a one to one basis: 2. DELIBERATIONS

ITEM ISSUE ACTION 1. Relocations of Taxi and informal Traders 1.1 • There will be a need for the re-location of taxis that utilise a portion of Johaness

Nkosi Street as a taxi rank located south-west of Johannes Nkosi Street/Warwick Junction intersection.

• Details are required about where these taxis will be relocated. • A more comprehensive taxi relocation plan is required for the greater CBD area to

ensure taxi operators are placed on more permanent areas and most conducive for public transport users.

fact that these traders have been previously located in areas away from formal bussiness and have therefore been excluded from government development initiatives.

2. Endpoint Flyover on Johannes Nkosi Street It was noted that the proposed flyover will terminate just after Johannes Nkosi

Street/Russell Street intersection. For this reason no disruption of traffic coming off Russell Street on to Johannes Nkosi Street is anticipated. It was queried how vehicles from the flyover would join Johannes Nkosi Street without creating congestion problems at the intersection. It was indicated that two more lanes are proposed in addition to the existing two lanes to allow a swift incorporation of vehicles from the flyover without any disruption of traffic already on Johannes Nkosi Street.

3. How is the Flyover expected to alleviate current traffic congestion on Warwick

Junction? ETA

It is expected that only traffic going towards the coast will utilize the flyover and only vehicles, mainly public transport and businesses within the Warwick Junction will utilize the existing N3 -Johannes Nkosi Street route

4. Design of elevated Flyover The proposed flyover is approximately 1000m long, approximately 300m of which will

be elevated. As explained to the attendants, the descending portion of the flyover towards Russell Street will be supported by solid concrete structure, while the rest of the flyover will be supported on pillars.

A suggestion was made to support the flyover entirely on pillar structures instead of solid concrete structure and use the area underneath for either parking, home for street children, or other alternative uses that could be investigated further. From an engineering design perspective, it will not a feasible alternative to have the flyover resting on pillars where is descends towards ground level.

The design of the flyover has been changed a number of times to come up with the most feasible design. Consultation process took place internally between role players in the eThekwini Municipality during the formulation of the Warwick Precinct Development Plan. A concern was that the current design (or route) of the flyover differs from what appears in the above-mentioned plan. It response, it was indicated that the plan was modified as a realization that the old design would require demolition of a number of buildings. As a way forward it was agreed this matter would to be resolved internally with concerned role players.

5. Johannes Nkosi Street users to be affected by the construction process It was noted that traffic from the N3 moving towards Warwick Junction and beyond will

be re-routed to Carlyle and Cross Streets during construction. Noted

It was further noted that to cater for businesses directly off Johannes Nkosi Street and for public transport that will not be able to access alternative routes, at least one lane will remain open during construction to allow access.

6. Will the proposed development affect residents on Botanic Gardens Road? The proposed flyover will start east of Old Dutch Road-Botanic Garden Intersection.

Residents on Botanic Gardens will therefore not be directly affected by the proposed activity. Only traffic going passing through Johannes Nkosi Street and adjacent road will be affected by development. Impacts on traffic will be negative, but temporary during construction. Positive and long-term impacts will be seen when the flyover is fully operational as it will alleviate traffic congestion on Warwick junction.

7. Warwick Outbound Flyover • The eThekwini Municipality is also proposing to construct an elevated flyover to

serve as an extension of the Western Freeway on the outbound carriageway. It was noted that this project will form another phase in eThekwini Municipality’s initiative in their plan to alleviate traffic congestion problem within the Warwick Precinct and its surrounds.

• The proposed project will link the Leopold Street directly with the Western

Freeway, by-passing the highly congested Leopold/Market and Leopold/Warwick intersections. This project is more likely to affect additional business including Metro Rail and CEDA- eThekwini.

8. A Broader Perspective of the Greater Warwick Precinct • It was explained that the proposed flyovers form part of the broader plan for the

Warwick precinct to help alleviate traffic congestion. Other plans that could also benefit the precinct include broadening of Russell Street, a major taxi rank, and design routes for trucks going to the harbour.

• Longterm planning for traffic management and road improvemtns should look into extending the flyover to Old Fort Place.

• It was generally accepted that a change/improvement is required within the precinct. As noted, care should be taken to ensure that plans made are environmentally, socially and economically implementable. A master plan was recommended.

9. Other Recommendations made for the environmental authorization process • All role players, including those who participated in the planning stages of the

proposal, should be consulted throughout the EIA process until a Record of SiVEST

10 eThekwini Municipality Internal Consultation Process The open day and the subsequent public meeting saw a generally poor turn out of

invited role payers and affected parties identified. Possible reasons noted was the ongoing civil servant strike that affected a broad spectrum of the public. Another reason quoted was that eThekwini Municipality has been in contact with various Municipal bodies that represent informal traders, public transport services including buses and taxis. These role players have therefore been consulted with in regard to the proposed project. It was noted that eThekwini Roads Department has held meetings with the above-mentioned role players. SiVEST requested minutes of these meetings for their information with regard to any concerns that may have been raised.

This letter serves to notify all Interested and Affected Parties (I&AP’s) and Stakeholders of a scope change to the existing proposal of the Warwick Avenue inbound flyover.

Project Background

The eThekwini Municipality wishes to construct an elevated flyover to serve as an extension of the Western Freeway on the inbound carriageway. The proposed development occurs within the Warwick Precinct, bounded by Berea Road in the south, Mansfield/Carlisle in the north, Cross Street in the east and Botanic Gardens Road in the west.

The Warwick Precinct is characterised by high volumes of traffic that cut through the area, adding no value to the area and indeed detracting from its attractiveness. The high levels of traffic create an unsafe environment for residents, pedestrians and commuters alike and are a barrier to redevelopment and growth of the area. In order to address this issue, the eThekwini Municipality is proposing to separate the through traffic from the activities of Warwick Junction through the construction of fly-overs that take all through traffic over the highly congested quadrant of Market, Leopold, Warwick and Johannes Nkosi Street.

The proposed project will link the Western Freeway and Johannes Nkosi Street (terminating just before Russell Street), thus by-passing the highly congested Warwick/Old Dutch and Johannes Nkosi Street. /Market intersections on the inbound carriageway and thereby improving traffic flow through the area in a safe and efficient manner. The proposed design of the link is approximately 1000m long, of which the elevated section is approximately 300m long, and will consist of 3 x lanes (12-15m wide).

Activity 1(K): the bulk transportation of sewage and water, including storm water, in

pipelines with -

Activity 15: The construction of a road that is wider than 4 metres or that has a reserve

After consultation with the various members of the project team it has come to light that the following activities, as per the Environmental Impact Regulations, 2006 promulgated in terms of Section 24(5) NEMA (Act 107, 1998), will need to be included in the scope of this project:

(i) an internal diameter of 0,36 metres or more; or

(ii) a peak throughput of 120 litres per second or more

wider than 6 metres, excluding roads that fall within the ambit of another listed activity

or which are access roads of less than 30 metres long.

Reason for Scope Change

As part of the proposed project the Municipality will have to realign a 450 diameter sewer and a 350 diameter water pipeline. The trench will be 2m deep by 2.5m wide. This activity will need to be undertaken prior to construction of the flyover commencing.

Furthermore four out of five of the lanes coming into town will need to be closed during construction to allow the contractors to build the flyover (this will require building the centre of the bridge first for stability reasons, and then extending outwards on either side). The municipality proposes to detour traffic through Centenary Road to Carlisle and Cross. This will require the expansion of Centenary Road by 3,5m in addition to construction of a side walk to Mansfield Road.

The municipality proposes to temporary detour traffic through Centenary Road to Carlisle and Cross Streets. This will require the following activities:

· Closure of Johannes Nkosi Street between Warwick Avenue and Russell Street;

· Divert traffic along Centenary Road to Carlise Street, to Cross Street and to Johannes Nkosi Street;

· Upgrade Centenary Road to accommodate one additional northbound lane;

· Upgrade Carlise Street to three eastbound lanes and one westbound lane; and

· Convert Cross Street that is currently one-way northbound to two-way between Carlise and Beatrice Streets and one-way southbound between Beatrice and Johannes Nkosi Streets.

It is expected that construction will take approximately 6 weeks to complete. These road works would need to complete prior to commencing the main contract.

Relocations of Taxis Anonymous at Public Meeting

There will be a need for the re-location of taxis that utilise a portion of Johaness Nkosi Street as a taxi rank located south-west of Alice Street (Johannes Nkosi)/Warwick Junction intersection.

Details are required about where these taxis will be relocated. A more comprehensive taxi relocation plan is required for the greater CBD area to ensure

taxi operators are placed on more permanent areas and most conducive for public transport users.

The eThekwini Transport Authority (ETA) are in consultation with the Taxi Associations regarding the relocation of taxi operations affected by the project. Meetings have been held with the following Taxi Associations: Kwamashu, Inner City Circle and the Pietermaritzburg TA to inform them of the City's Development on Alice Street (Johannes Nkosi), which will affect Taxi Operations between Market and Grey Street (Dr Yusuf Dadoo) permanently. The following has been suggested:- PMB Taxi Operators – The taxi operators have a rank on Grey Street (Dr Yusuf Dadoo),

west side, between Alice and Fountain Lane, this rank could be extended to compensate for the loss in bays on Alice Street (Johannes Nkosi), or an additional rank provided on the east side of Grey Street (Dr Yusuf Dadoo) opposite their existing rank.

KWAMASHU Taxi Operators - The taxi operators have a Rank in Soldiers' Way, but indicated that they cater for a large number of passengers from the Market Area, and would like to keep a facility in the Market area. An alternative will be to squeeze them in Etna Lane Holding area, or if there is a possibility of flattening the Park area in the vicinity of Mansfield Bus Rank, they would prefer to be accommodated at that corner (if this is possible).

INNER CIRCLE Taxi Operators - Alice Street (Johannes Nkosi) at Market is their major Rank, and they would like to be kept in the nearby vicinity. A suggestion was to look at the Centenary Road area, provided that there will be some kerb space available, as they also have Umhlanga taxi operators ranking on Centenary Road (Clarity needed). They would also like to be accommodated in the area indicated on the corner of Old

Notwithstanding the above, it was clearly pointed out that there will be no facility on Alice Street (Johannes Nkosi), and the move will have to take place during the November/December 2007 period, to prepare for the start of the work next year.

Relocations of informal Traders Anonymous at Public Meeting

Informal traders along Johaness Nkosi Street will need to be re-located. In a broader perspective, placement of informal traders should take into account the fact

that these traders have been previously located in areas away from formal business and have therefore been excluded from government development initiatives.

There is a need to incorporate all sectors of business in any way possible to enable both formal and informal business to benefit from any government development initiatives.

It was noted that consultation with members of the public is a crucial component of the planning phase in terms of relocations that may be deemed necessary. Details to be communicated to the public should include the following; A description of who is to be relocated Identification of relocations areas Impact of relocation on the public Necessary timeframes

The eThekwini Roads Provision Department has corresponded with the Informal Trade Department regarding this matter. Affected street traders have been notified in writing about above development. The Informal Trade Department has requested that the removal of existing trading structure be part of the contract, and that if possible some shelter be relocated to the front of Stables theatre. The Business Support Unit fully backs the proposed development and has indicated that it should proceed as planned.

Endpoint Flyover on Alice Street (Johannes Nkosi)

It was noted that the proposed flyover will terminate just after Johannes Nkosi Street/Russell Street intersection. For this reason no disruption of traffic coming off Russell Street on to Alice Street (Johannes Nkosi) is anticipated. It was queried how vehicles from the flyover would join Alice Street (Johannes Nkosi) without creating congestion problems at the intersection.

It was indicated that two more lanes are proposed in addition to the existing two lanes to allow a swift incorporation of vehicles from the flyover without any disruption of traffic already on Alice Street (Johannes Nkosi).

How is the Flyover expected to alleviate current traffic congestion on Warwick Junction?

It is expected that only traffic going towards the coast will utilize the flyover and only vehicles, mainly public transport and businesses within the Warwick Junction will utilize the existing N3 -Alice Street (Johannes Nkosi) route.

Design of elevated Flyover

Anonymous at Public Meeting

The proposed flyover is approximately 1000m long, approximately 300m of which will be elevated. As explained to the attendants, the descending portion of the flyover towards Russell Street will be supported by solid concrete structure, while the rest of the flyover will be supported on pillars. A suggestion was made to support the flyover entirely on pillar structures instead of solid concrete structure and use the area underneath for either parking, home for street children, or other alternative uses that could be investigated further. From an engineering design perspective, it will not a feasible alternative to have the flyover resting on pillars where is descends towards ground level. The design of the flyover has been changed a number of times to come up with the most feasible design. Consultation process took place internally between role players in the eThekwini Municipality during the formulation of the Warwick Precinct Development Plan. A concern was that the current design (or route) of the flyover differs from what appears in the above-mentioned plan. It response, it was indicated that the plan was modified as a realization that the old design would require demolition of a number of buildings. As a way forward it was agreed this matter would to be resolved internally with concerned role players.

Alice Street (Johannes Nkosi) users to be affected by the construction process

It was noted that traffic from the N3 moving towards Warwick Junction and beyond will be re-routed to Carlyle and Cross Streets during construction. It was further noted that to cater for businesses directly off Alice Street (Johannes Nkosi) and for public transport that will not be able to access alternative routes, at least one lane will remain open during construction to allow access.

Will the proposed development affect residents on Botanic Gardens Road?

The proposed flyover will start east of Old Dutch Road-Botanic Garden Intersection. Residents on Botanic Gardens will therefore not be directly affected by the proposed activity. Only traffic going passing through Alice Street (Johannes Nkosi) and adjacent road will be affected by development. Impacts on traffic will be negative, but temporary during construction. Positive and long-term impacts will be seen when the flyover is fully operational as it will alleviate traffic congestion on Warwick junction.

A Broader Perspective of the Greater Warwick Precinct

• It was explained that the proposed flyovers form part of the broader plan for the Warwick precinct to help alleviate traffic congestion. Other plans that could also benefit the precinct include broadening of Russell Street, a major taxi rank, and design routes for trucks going to the harbour.

• Long term planning for traffic management and road improvements should look into extending the flyover to Old Fort Place.

• It was generally accepted that a change/improvement is required within the precinct. As noted, care should be taken to ensure that plans made are environmentally, socially and economically implementable. A master plan was recommended.

Other Recommendations made for the environmental authorization process

• All role players, including those who participated in the planning stages of the proposal, should be consulted throughout the EIA process.

• Clearly defined procedures/plans for the relocation of taxis and informal trader should be formalized. It should clearly state where people will be relocated to and who will be responsible for the entire process.

• Details of how pedestrian will be catered for along upgraded road are required. • The final design of the flyover and upgrading of Alice Street (Johannes Nkosi) should

ensure it caters for existing businesses.

eThekwini Municipality Internal Consultation Process

The open day and the subsequent public meeting saw a generally poor turn out of invited role payers and affected parties identified. Possible reasons noted was the ongoing civil servant strike that affected a broad spectrum of the public. Another reason quoted was that eThekwini Municipality has been in contact with various Municipal bodies that represent informal traders, public transport services including buses and taxis. These role players have therefore been consulted with in regard to the proposed project. It was noted that eThekwini Roads Department has held meetings with the abovementioned role players. SiVEST requested minutes of these meetings for their information with regard to any concerns that may have been raised.

At this meeting it was agreed that in order to accommodate this public transport route, the proposed road detour plan would be revised to include a single lane for this movement described as follows: Beatrice Street right turn movement into Cross Street Northbound into Carlisle Street Westbound and then into Centenary Road Southbound. The road detour proposal has been revised to include the accommodation of the public transport movement. Based on the proposed road detour it was established that the Durban Transport operations would not be adversely affected.

Registered as a stakeholder. Main interest is accessibility of both foot and vehicular traffic to and from the Victoria Street Market and its environs. Concerned that vehicles to and from Warwick Avenue will be impeded when entering Grey and Queen Street or exiting via Russell Street.

Traffic Department addressed the alignment issues taking into consideration existing buildings, existing services, horizontal alignment design criteria, positioning of abutments and support structures and other aspects and agreed upon the current proposal that has been designed and which will be constructed. Item 2 - Traffic Department has finalised the Lane marking Drawing. The design has been finalised in conjunction with the final Traffic Layout Drawing produced. All aspects have been looked at with regards lane configuration and layout. The configuration is as follows : 2 lanes from Berea Road and 2 lanes from N3 merging into 4 lanes along Old Dutch. 1 additional right turning lane will be created for movement to Etna Lane Taxi / Bus Rank. 4 lanes reduce to 1 dedicated left turn to Centenary splitting into 2 lanes at the slip and 3 lanes passing through the Warwick junction. Of the 3 lanes there will then be 1 dedicated Right turn and 1 shared straight and Right Turn to Market Road - southbound traffic. 2 lanes towards Russell. All lanes will be marked accordingly, together with the associated signage. The N3 has 6 lanes - new overpass 3 lanes merging just before Russell forming the 5 lanes at Russell Street intersection. Ex overpass (Eliat Viaduct) - number of existing lanes will remain the same. Item 3 - with regards an arrestor bed - this has not be catered for in the current design. There may be a possibility to create one as the extension of the slip lane to Etna Taxi Rank on the Right side of Old Dutch. This is only a possibility and needs to be discussed with Traffic Department. The project will be going ahead irrespective if an arrestor bed is included or not. Item 4 - Carlisle Street will revert back to normal on completion of the project. The extension of Beatrice Street through DTMB and may still on the cards for the long term. The connectivity at this stage has not direct bearing on the Warwick Flyover Project. Item 5 - Proposed modification to Commercial Road Inbound - This road will remain the same from the existing Eliat Viaduct Western Abutment, however improvements will be made the horizontal alignment to cater for the additional lanes of the new flyover, the new structure from the start of the Warwick Project on the N3.This modification is considered minor in relation to the complete project. The reports should be read in conjunction with the available drawings.

considered: a. Roads Provision to provide funds for the relocation of palms and trees that are

No Glyphosate to be used. d. After completion of the project, any open ground must be ready for planting. A list

of chemicals used for soil poisoning and their chemical data sheet to be provided to the Area Horticulturist.

e. Where possible endemic trees are to be used, otherwise indigenous trees must be planted.

Item 1 - Funds provided for the relocation of the Palm Trees that are affected in Departmental Works and also have been included in the Tender Document for pricing. Item 2 - Funds provided for the landscaping Departmental Works and also include for Urban Design intervention / signage / street furniture to new works and existing works. About 11 million has been allocated for this purpose. Sufficient allowances have also been made in the priced contract document. Item 3 - With regards soil poisoning - we have standard clauses and specifications that have already been communicated and approved by Parks Department used on all projects where landscaping, tree planting and grass planting has been previously done and the same will be used on this project. Item 4 - The department will work closely in conjunction with Parks and Gardens / Architecture with regards landscaping, tree planting, grassing etc. Item 5 - See comment 4 4. The Environmental Management Department has no objection to the development. The

following must be considered: a. The EMP must include any contravention of the conditions of the environmental

authorisation, with an appropriate fine/penalty under Section 3.3. Penalty Clause. b. The EMP must include specific mitigation measures for, amongst others, the

following impacts: i. Impacts of road closures during the construction and operation phases on

vehicle and pedestrian traffic. ii. Impacts on air quality iii. Impacts on sensitive receptors. iv. Impacts as details by the Architect Department

Please could you provide the following information: 1. how this flyover will effect access to and from our business operations situated at 126 Berea Road 2. what servitudes will be closed during construction and would they effect our business operations (access, loading and movement of trucks and 40 ft shipping containers) 3. you state that there are residential and business establishments adjacent to the proposed route that will be effected - are we one of the businesses that will be effected.
