Communications Tower site Greetings, On behalf of the Gladwin County Historical Society and Beaverton Historical Society I submit antiquities information regarding the proposed site for a communications tower in Tobacco Township, Section 12, adjacent to VanDyke Road. The site is located more than two miles from any watercourses that could be used for transportation by orginal people. It is in an area that was not subject to regular habitation prior to logging operations and agricultural settlement that began after 1860. The property in question contains an elevated ridge but it did not provide any unique, useful or strategic elevation until the surrounding land was cleared of all trees. In addition, while aboriginal artifacts have been found adjacent to both the Tobacco and Tittabawassee rivers, no known artifacts have been discovered in the area in question. The subject property was clear-cut in the late 1870s, and adjacent properties were subsequently cleared for farming. The subject property, being a sandy ridge, does not appear to have been used for agricultural purposes. It has been used as a “school forest” for over 60 years. Students from Beaverton Rural Schools planted trees over a period of 10 years. During all of these times there are no reports of anything of archealogical or antiquarian interest being observed. I am the president of the Beaverton Historical Society and trustee and past vice-president of the Gladwin County Historical Society. I am the primary author and researcher of “Beaverton: A Century in the Making” – a 340 page illustrated history of the Beaverton area. I am also primary researcher and author of the forthcoming Gladwin County Sesquicentennial History, due for publication in mid-2011. I have spent much of the past 10 years researching Gladwin County history, and have collected reports from hundreds of long-time residents, as well as making hundreds of site visits to verify information about possible antiquities, early settlements, or other historical interests within Gladwin County. I have also been in contact and discussion with most of the other people who maintain an interest in the historical and archealogical concerns of our area. Specifically, I continue to research pre-european use of the county such as the apparent use of the Tobacco River to a point west of Beaverton identified on an early survey as the eastern terminus of the “Muskegon River Trail” which indicates that southern Gladwin County was used as part of a cross-state route connecting Saginaw Bay to the Muskegon area of Lake Michigan. Mr. Bringman It appears that you are initiating consultation with the State Historic Preservation Office (SHPO) under Section 106 of the National Historic Preservation Act of 1966, as amended. Section 106 requires federal agencies to take into account the effect of their undertakings on historic properties. The Section 106 regulations specify what is required for a Section 106 review [36 CFR § 800.11]. It is the responsibility of the federal agency, not the SHPO, to fulfill the requirements of Section 106. In some instances, the federal agency may delegate legal responsibility to a state, local, or tribal government. Consultants or designees contracted to prepare information, analyses, or recommendations, are not recognized as federally-delegated authorities. For your reference, a complete version of the Section 106 regulations can be found at www.achp.gov/regs.html.

Under the NPA, applicants are required to use new FCC Form 620 (new tower) and 621 (collocations) to submit Section 106 material to State Historic Preservation Officers (SHPO) or Tribal Historic Preservation Officers (THPO). The new forms appear more like an environmental compliance "project file" rather than a cultural resource review. This puts the burden on the SHPO staff to search through these large documents to extract the specific information needed to review the projects; which is time-consuming and unproductive.

The SHPO receives approximately 3,500 projects for review annually. This year, due to the federal funding for economic stimulus projects, that number has increased significantly. Consistency and accuracy in the information submitted is necessary to facilitate the timely review of each of these projects. For this reason, a mandatory application form was created to would ensure consistency and accuracy in all of the information submitted. As a result, the SHPO has decided to respond to these submissions with a notice that we are declining to consult, unless the Section 106 Application form is used, or historic properties have been identified.

Our letter declining to comment does not imply that the project information is deficient, rather that we have had to make a difficult business decision on how best to utilize our time. Given that the materials are not submitted using our application form, we will not comment on this undertaking. As you know, the 2004 Nationwide Programmatic Agreement (NPA) executed between the (FCC), the Advisory Council on Historic Preservation (ACHP) and the National Conference of State Historic Preservation Officers (NCSHPO) made changes to virtually every aspect of Section 106 review for communications towers. The purpose NPA, which supplements a Collocation Agreement implemented in March 2001, is to streamline the procedures for review of certain FCC undertakings, however in reality, certain stipulations written into the NPA are incongruous with the Michigan SHPO’s preferred review process.

Communications Tower site Greetings, On behalf of the Gladwin County Historical Society and Beaverton Historical Society I submit antiquities information regarding the proposed site for a communications tower in Tobacco Township, Section 12, adjacent to VanDyke Road. The site is located more than two miles from any watercourses that could be used for transportation by orginal people. It is in an area that was not subject to regular habitation prior to logging operations and agricultural settlement that began after 1860. The property in question contains an elevated ridge but it did not provide any unique, useful or strategic elevation until the surrounding land was cleared of all trees. In addition, while aboriginal artifacts have been found adjacent to both the Tobacco and Tittabawassee rivers, no known artifacts have been discovered in the area in question. The subject property was clear-cut in the late 1870s, and adjacent properties were subsequently cleared for farming. The subject property, being a sandy ridge, does not appear to have been used for agricultural purposes. It has been used as a “school forest” for over 60 years. Students from Beaverton Rural Schools planted trees over a period of 10 years. During all of these times there are no reports of anything of archealogical or antiquarian interest being observed. the State Historic Preservation Officer (SHPO) that no historic properties are affected within the area of potential effects

of this undertaking.

The views of the public are essential to informed decision making in the Section 106 process. Federal Agency Officials or

their delegated authorities must plan to involve the public in a manner that reflects the nature and complexity of the

undertaking, its effects on historic properties and other provisions per 36 CFR § 800.2(d). We remind you that Federal

Agency Officials or their delegated authorities are required to consult with the appropriate Indian tribe and/or Tribal

Any future construction or alteration , including increase to heights, power, or theaddition of other transmitters, requires separate notice to the FAA.

This determination does include temporary construction equipment such as cranes, derricks, etc., which may beused during actual construction of the structure. However, this equipment shall not exceed the overall heights asindicated above. Equipment which has a height greater than the studied structure requires separate notice to theFAA.

This determination concerns the effect of this structure on the safe and efficient use of navigable airspaceby aircraft and does not relieve the sponsor of compliance responsibilities relating to any law, ordinance, orregulation of any Federal, State, or local government body.

A copy of this determination will be forwarded to the Federal Communications Commission (FCC) because thestructure is subject to their licensing authority.

I was first contacted by Mike Brubaker in August of 2009, re: placing a communications tower on the property as this is an optimum location for their needs.
