Respected veteran leaders & sr colleagueson the Dias, leaders and representatives ofvarious Central Govt; State Govt. and PSUpensioners organizations , Brothers & sisters,

I thank you all to have invited me and to bewith you this morning.

I am aware you all are eager to know whattranspired in the BPS meetings with 7th CPC& what is the expected outcome. Friends,

Well before the constitution of 7th CPCBPS went over different parts of the country andafter consulting our stake holders identifiedcommon issues, dotted down clinchingjustification for each of the issues, musteredsupport of NCJCM (staff side) and submitted acomprehensive memorandum to the 7th CPC,BPS on the invitation of the 7th CPC has had 3opportunities to explain & to tender evidenceon the issues raised by it. We explained to CPC,that pensioners' only aspiration is to have apeaceful and healthy life with dignity. Dignityas guaranteed by the Constitution &pronounced by the Apex court as far back as17.12.1982. in D S Nakra vs UOI. i.e pension isa deferred wage & not a largesse, pension w/oany cutoff date/or discrimination based on dateof retirement should be sufficient to enablepensioner to live with the standard he/she hadbeen living while in service. We explained thathealthcare is a fundamental right of ex employeeas pronounced by the apex court on 27.10.1995in the case Consumer Education andResearch Centre Vs Union of India (AIR 1995Supreme Court 922) and that it is in the Nationalinterest to provide free adequate hassle freepreventive & curative medical attendance &treatment to Sr Citizens or else by 2050 Indiawill be a Nation of poor limping oldies as bythen 25% population will be 60+. But what weare getting? Discrimination ,disparities &neglect.

Every time, months before CPCrecommendations are out, media creates a

hype by publishing misleading information likeCG Employees/Pensioners will be richer afterPay Commission’s recommendations .Pension & salaries will go up 4 times, country'sfinances will be derailed etc etc. A wrongperception is created , as if alms are beingdoled out. This damages our interests & mustbe countered.

What we actually get as revised pension ?

Existing basic Pension+ DR+ fitment benefit= revised pension i.e.about 40% rise in pensionfor about 90% of pensioners after a long waitof 10yrs or so. The fitment benefit, in fact, ispart of squeezed DR . DR which govt. paysduring intervening period of two paycommissions is never sufficient as the verymethod of calculating ALL INDIA CONSUMERPRICE INDEX FOR INDUSTRIAL WORKERSis fraught with discrepancies. 100%neutralization is an illusion. This was acceptedby the then deputy chairman planning comm.Sardar Montek Singh Alluwaliah in hisstatement to PTI on27.2.2008(published inNational dailies on 28.2.2008).In short the Pay& Pension hike which Pay Commission gives,is just a compensation for all round price hikeduring the past 10yrs & nothing else. Pensionhas been our Service condition. We havecontributed for it by way of foregoing 8.33% ofour salary per month by way matchingcontribution by govt. to PF. Worked hard forthe development of the country accepting lowerpay scales which were intentionally designedto cater to pension to be paid after retirement.Pension is our deferred wage. It is definitelynot a defined benefit. 7th CPC, as weunderstand, has classified pensioners in twobroad categories i.e. Defense Pensioners &Civil Pensioners. For representing civilPensioners in final round of discussion Paycomm. had short listed Bharat PensionersSamaj.

several important issues such as ratio betweenmin & max. paid to be brought back to 1:8;upward revision of pension to 67/65% of lastdrawn; full parity in pension/ carrying forwardw/o break the modified parity formula enunciatedby 5th CPC; common multiplication factor toapply uniformly to all; need for downward revisionof age for additional pension; additionalpension to start from the age of 65 yrs; removalof discrimination with those who retire on 31.12& 30.06; modification of NPS to ensure thatminimum pension shall not be less than 50%;of last drawn, DR merger with pensionwhenever it goes above 50%;7th CPCrecommendations should apply to all w/o cutof date; 7th CPC recommendations shouldapply to BSNL pensioners since governed byCCS(pension rules); Defense civilianpensioners should get ex-service men status;full pension for 20yrs QS to pre 2006 retireesalso; commuted portion of pension to berestored in 12yrs; gratuity w/o any restrictionof max limit; full pension to family pensionersfor 10 yrs w/o any cutoff date &discrimination;pension to be tax free; pooling together thehealth facilities/schemes of differentdepartments; uniform application & wideningthe spread-over of CGHS without discriminationsuch as CGHS/non CGHS areas/CSMA rules;removal of discrimination against pensionersof postal & other departments; periodicalrevision of CGHS rates to match marketconditions; regulatory authority for healthcarefacilities; issuing smart cards to all pensionersfor hassle free cashless treatment in medicalemergencies with all India validity in allempanelled hospitals of CGHS,ECHS,RELHS,State govt. as well as in super specialtyhospitals which have been allotted land onconcession rates; Upward revision of FMA toRs 2000 pm & improvement in grievanceredressal mechanism etc.etc.

Friends, 7th CPC has finished recordingevidence & is now drafting itsrecommendations. We have done our duty wellby representing our issues in a forceful

manner, Chairman CPC approach has beenpositive & we expect positive outcome.

But Government of India’s Policy is explicitas seen from the Budget documents. ThisGovernment is anti employee and pro-employer.Freight charges on Coal, Petroleum productetc. have been increased,health care budgetis slashed, service tax enhanced &SwatchBharat cess introduced, prices of essentialcommodities increasing .The Interest rates arecoming down. We Pensioners’ will pay excessprice on essential commodities, receive lessinterest on savings, will pay more taxes andwill not get any tax relief, interim relief or DRmerger . On the other hand,Wealth Taxabolished, Income tax rates for corporateassessees reduced . Already Estate duty &Gift Tax stand abolished benefiting the rich. Butno provision has been made for implementationof VII Central Pay Commissionrecommendations though the Government ofIndia has promised implementation from1.1.2016.

The Fourteenth Finance Commissionprojected an increase in Pension Payment by30% in 2016 -17 & annual increase rate of 8%thereafter. Thus we may not be getting desiredrelief through 7th CPC. Middle class shouldtake care of itself says the Finance minister.We should be able to understand the writingon the wall- "Bad days ahead". Indiaconsidered to be a bright spot in Globaleconomy but is pushing its Pensioners topoverty through anti middle class attitude. GOIhas spent 100s of crores on Administrativereforms, e governance and is now striving fordigital India. But in reality our grievances onCPENGRAMS are being closed withoutresolving. Concerned officers do not read oure.mail. Ministers & even Secretaries have notime to listen to our representations. It takeweeks & weeks to get few minutesappointment.

for over 33 million voters & who are part of largercommunity of over 120 million Sr citizens arenot helpless? With their vast knowledge &experience they are a large section of intelligentvoters among 120 million Sr citizens voters andare spread in every nook and corner of thecountry. They can very well be the opinionformers. Pensioners are Sr Citizen first. Issuesi.e. financial security, healthcare & socialsecurity are common to entire community ofSr. Citizens. We are transforming into aninstitution. Hence, horizon is expanding; reachis widening; vision, though far, is visible andmuch clearer. This is the time to consolidateourselves to ensure that no injustice is done tous.

BPS suggests 3Cs formula i.e. “Communi-cate,Co-ordinate & Consolidate”

1. Communicate: World has changed & isconstantly changing. We too need to changeourselves. Even developed countries haverealized that moving alone is not possibleanymore and have started communicating withother countries. Same is true for pensionersorganizations. Instead of wasting time & energyin raising new or reviving dormant organizationswe need to form strong conglomerate of existinglive Federations and Associations. As mainaspirations i.e. Financial, Social security &Healthcare are common, this is possible. Toachieve it, communication is the basic tool .So communicate amongst yourself , with yourmembers, affiliates, associates, MOU partners,with Civil Society , National / local leaders ,withMedia and with the employees retiring in nextsix months. Spread awareness about whatpensioners did for the country & are still doingfor the civil Society. Apprise Civil Society abouttheir service conditions, entitlements as perConstitution, Supreme court pronouncements.Empower Pensioners & Pensioners to be withinformation, knowledge & network tointerconnect. Aggressively use Social Media &modern digital technology to interact amongyourself & with the civil society to enable them

to understand pensioners/family pensioner’sissues & the deficient areas.

2. Co ordinate : Coordinate not only toseek govt. support in deficient areas but todevelop systems which may enable all of usto act as one family with mutual confidence,support and growing interdependence. Toexplain it further, I narrate a real life small story" one day at about 9.30 in the night I receiveda call from a family pensioner from Dimapur in'Nagaland' .The lady pleaded for help. She washaving health problem with no body to look afterher, I took her. details & contacted Genl. Secy,NFRPA at Guwahati in 'Assam', giving thedetails & assistance required. Comrades atDimapur were informed accordingly, helpreached, lady in medical distress was shiftedto Lumding Rly Hospital (Nagaland) from whereshe was referred to Perambur Rly hospitalChennai in 'TN'. I passed on the details toSecy. Genl. AIFPA at Chennai who attendedon the patient , contacted doctors & pursuedtreatment. Though due to legal hurdles wewere not obliged with 100% success but thelady today is alive, wkg for family pensioners&realises that she is not alone, she has alarge family of Pensioner Brothers and Sisters.Comrades, if we have to survive with dignitythen such should be our system of mutualconfidence, interdependence & coordinationthat none of us feel lonely & helpless. Shareinformation, technology and resources withAffiliates/Associates/MOU partners/sisterorganizations &members .Coordinate andprovide support to members, affiliates andassociate associations. Coordinate & standshoulder to shoulder with the administration &fellow citizens during National emergencies andnatural calamities. Launch and participate inwelfare activities such as organ donation forthe good of civil society.

3.Consolidate : Inspire more & morepensioners/Associations/Federations to cometogether. Strive to bring all C.G; State, PSUs,EPS95 pensioners/family pensioners together.Inspire sister organizations to sign MOUs to

jointly & severally struggle for resolvingcommon issues. BPS, AIFPA,NFRP Palghat& AISCCON have been successfully wkg withsuch an agreement. I invite other likemindedpensioners organizations to join. BPS todayhas over 15 lac audience on social mediaplatform. Let us utilize the facility for pensioners'cause. We throw it open to all likemindedorganizations. Add more & more friends, viewers& followers on Social media pages . Sharepensioner's related posts as much as possible.Due to age & ailments, traditional agitationalmethods like Dharnas, Demonstrations etc arelosing sheen for pensioners . Let us blend old& new techniques, strengthen presence onsocial media to highlight pensioners issues &deficient areas . Streamline & inter- linkavailable resources like publications, websites,Blogs, Groups, Face book, Twitter, You Tubeetc. BPS has launched a pilot project'PENSIONERS OWN MEDIA' under whichpublications of likeminded Pensionersorganizations who willingly provide us theirpublications in pdf format upto 5MB are beinguploaded on BPS website, Blog, Face book,Twitter & BPS 1955 yahoo group. Let us makebest use of modern technology /opportunitiescombined with traditional methods toconsolidate ‘Elderly Vote Power’, the ultimateweapon & panacea for all our ills.Comrades,we are not a helpless or a useless lot. Neitherwe are a liability to the society or a burden onthe exchequer. We are an asset for the civilsociety & the Govt. We can still turn the TIDES.With 'elderly vote power' we have the ability tochange Govt. Even in our death we have thecapacity to give life to 5 persons (by organdonation ) We may not live to see the endresults but it is our responsibility to give correctdirection & a road map to pensioners oftomorrow.

Sub: Grant of increment for those whohave completed one year on the dayof superannuation

We solicit your kind reference to item No.14of the 43rd Meeting of the National Council,demanding grant of one increment in the caseof those persons who complete one year onthe day of their superannuation. The issue wasdiscussed several occasions, but was notagreed upon by the Official Side. The OfficialSide took the stand that the completion of thestipulated one year being the day on whichthe official retires, he cannot be granted oneincrement for having completed one year onlythe next day and for doing so, one has to beon duty. The fact that the official has completedthe requisite one year for earning an incrementwas unfortunately glossed over. The Staff Sidewas also told later that the case filed by one ofthe officials in the Central Administrative Tribunalagainst denial of increment was turned by theCourt. No doubt, grant of increment in adeserving case is an executive decision andno court will be able to compel the Executiveto exercise their powers in a particular manner.In fact, the Government ought to haveappreciated the fact that the demand is onjustified ground and the technicalities shouldnot have come in the way to deny justice. Wenow send you a copy of the GO issued by theGovernment of Tamilnadu, granting oneincrement on the date of superannuation in thecase of those personnel who have completedone year of service. In the light of the decisionof the Government of India that the grant ofincrement can be resorted to even in the caseof a person who has completed at least six

ORDER:

As per the provisions under FundamentalRules 26 (a), the annual increments of theGovernment Servants are regulated in fourquarters viz. 15th January, 15th April, 1st Julyand 1st October. However, there is no provisionin the Fundamental Rules to sanction annualincrements in the case of the GovernmentServants who have rendered one full year ofservice and retires on superannuation on thelast date of completion of one year and theirincrement due date falls on the next day ofsuperannuation. As such an anomaloussituation arises in the case of those GovernmentServants who retires on the 31st March, 30thJune, 30th September and 31st December, asthe case may be, inspite of the fact that they

have completed one full year of service whichare countable for increment as perFundamental Rules 26(a), (b), (bb), (c) and (d)as the case may be, and on the date 'ofretirement.

2) The above issue was-brought to thenotice of Pay Grievance Redressal Cellconstituted in the Government Order secondread above by several Employees Associationfor due rectification. The Pay GrievanceRedressal Cell, among others, hasrecommended that “when date of increment ofa Government Servant falls due on the dayfollowing superannuation on completion of onefull year of service, such service may beconsidered for the benefit of a notionalincrement purely for the purpose of pensionarybenefits and not for any other purpose. Suchconcession may be made applicableprospectively”.

3) After careful consideration, theGovernment have decided to accept the aboverecommendation of Pay Grievance RedressalCell. Accordingly, the Government direct thata Government Servant whose increment fallsdue on the day following superannuation, oncompletion of one full year of service which arecountable for increment under FundamentalRules 26, be sanctioned with one notionalincrement at the rate as described under rule6 of Tamil Nadu Revised Scales of Pay Rules,2009, purely for the purpose of pensionerybenefits and not for any other purpose. Theabove concession of sanction of notionalincrement shall take prospective effect from thedate of issue of this order.

4) Necessary amendment to theFundamental Rules shall be issued byPersonnel and Administrative ReformsDepartment separately.

Second stage family pensioner KrDamayantiben S Choudhary is the onlysurviving member of the deceased pensionerand applied for family pension. After completionof all formalities, the application alongwith 17documents including Service Book of thedeceased pensioner were sent to the AccountsOfficer (Pension), CTO Bldg., MH Circle,Mumbai-400001 by the Accounts Officer (TA),O/o CGMM, WTR, Mumbai-28 vide his letterNo.CGMM/WTR/Pension Corr/SSC/21 dated11-09/20-10-2014 (Annexure 1). Later anothercommunication No. STE-381/Grievances/2014-15/3 dt.09-03-2015 (Annexure-II) was sent toSr.A.O. (Pension) O/o CCA, MH Circle,Mumbai-400054 by Asstt Genl Manager(Admn), of CGM, WTR, Mumbai-28 alongwithanother copy of Form 21 sanctioning the familypension admissible @Rs.975/- per monthw.e.f.05-01-2007. Letter dated 09-03-2015 is onthe complaint of family pension beneficiarythrough BPS in February, 2015.

2. Not hearing anything, BPS listed the

grievance on C PENGRAM on 25-04-2015 andagain a copy of C PENGRAM forwarded to Sr.AO (Pension) O/o CCA, MH Circle, JuhuDanda Telecom Complex Santa Cruz (West),Mumbai-400054 vide Asstt Genl Manager(Admn) letter dt.30-04-2015 (copy at Annexure-III). BPS is now informed by the office of CGM,BSNL, WTR, Mumbai-28 vide letter no.STE-381/Grievnaces/D S Chaudhary/2015-16/09dt.02-05-2015 (Annexure-IV) that the grievancecan be re-dressed by CCA, MH Circle only andno action is pending in the office of CGM(BSNL), WTR, 12th Floor, Telephone House,Prabha Devi, Dadar (West), Mumbai-400028.The casual attitude in handling the case andtreating it as closed without giving any relief tothe petitioner aged around 50 yrs despite lapseof 10 months, is not a good reflection of theworking of BSNL.

Pensioners personal visit to theoffices of concerned PDAs - makingavailable an additional facility ofsubmission of life certificates.

For the above purpose, D O P & P W, Govtof India, held five Aadhar seeding andregularization camps in Delhi NCR incollaboration with PNB for 5 consecutive daysfrom 13th to 17th July,2015 from 9 am to 5 pmin the order: Rajendra Place, Civil Lines,Lakshmi Nagar(all in Delhi), Noida Sector-1 andFaridabad. Pensioners Organisations/Federations in NCT of Delhi were requested tomake pensioners residing in Delhi NCR awareof these camps and make them to understandthis digital life certificates' scheme. BharatPensioners Samaj gave it wide publicity &

deputed M M Kapur, Editor ‘Bharat Pensioner’to assist and study the results of thisCampaign. M M Kapur found the camps veryuseful and informative for a pensioner who isnot well-versed / computer savvy. Apart fromparticipation of 29 pension disbursing banks,a team from UIDAI also participated which tookcare of all who had not yet got their Aadharcards made or were not carrying the same forRegistration/Enrollment at these camps. On13-07-2015, team from Govt Business (of PNB)comprising s/Sh K V Rajesh Dy GM, RajinderKr Chief Manager and other officials guidedevery pensioner and clarified their doubtsrelating to benefits of DLC as compared to ageold system. Three officers viz. Jt Secy, Dy Secy& U Secy DOPPW also visited the camp. Inall 327 pensioners came out of which 41 gotthemselves enrolled on spot.

On 14-07-2015, the camp was at PNBCentral Staff College, Civil Lines, UnderhillRoad, Delhi and was inaugurated by Sh GauriShanker, MD & CEO of PN Bank and Sh.AlokRawat, Secy ,DOP&PW, Govt of India. monthly organ Bharat Pensioner/ flashed onsocial media, pensioners Visiting BPS officeunderwent the entire drill and were issuedPramaan IDs. During the process it has beennoticed that majority are facing problems inmatching their bio- meteric identification.. Bio-meteric matching/ identifications in thesecamps would have alerted both the PDAs &pensioners of the difficulties likely to beencountered and time required for completingDLCs. BPS suggests that PDAs start well inadvance and DOPW issues instructions to allPDAs to draw pension for the month ofNovember, 2015 payable in December, 2015in all cases where DLCs are not ready due totechnical lacuna to avoid any hardship to theaged ,infirmed & chronic sick cases who areunable to appear before the PDA. During theentire 5 days, 1513 pensioners visited thecamps including 248 new enrolment/Registration. Pensioners drawing pensionsfrom Allahabad Bank, Central Bank, PNB, SBIand UCO Bank came in large numbers forRegistration. Ambience on both days wasexceedingly good. Proper care of pensionersand officials was taken by members of hostbank.

A Railway staff Sri Joseph Khakha, retiredas MCM / SSE (AC) / BSB, N.Railway on31.01.2009, went to his native place atHashimara (North Bengal) and expired on30.01.2012. After the death of the pensionerwhen his wife Smt Anjala Khakha approachedthe Disbursing Bank (State Bank of India,Hashimara Branch) claiming for family pension,

it was revealed that her name was missing inthe PPO and hence the Bank refused her topay the family pension. The Lady has all otherrelevant documents to establish her maritalstatus, and family certificate issued by theRailway Authority, Voter I / Card, Joint BankAccounts with her husband etc. Sri BimalenduChakraborty, Secretary (Railway Pensioners)BPS / NDLS at New Jalpaiguri, took –up theissue with the Northern Railway Authority (DRM/ P / LKO, N.Rly) in the month of October /2014 referring the case to Sri S.C.Maheswari,Secretary General, BPS / NDLS for his personalintervention.

The Secretary General referred the issue tothe Ministry of Personnel, and the case wasregistered vide no: DOPPW / E / 2014 / 02841dated 24th NOV’2014, followed by severalreminders. The case was further referred to theExecutive Director (PG), Railway Board evento the Ministry of Railways. At every step, itwas Sri S.C.Maheswari, who continuouslypursued the case and ultimately on 24th June,2015 it was informed that, “Pension Case forissue of fresh PPO has been sent to Sr.DFM /LKO assuring to issue fresh PPO in the monthof July, duly countersigned by the NorthernRailway Authority.” At last the PPO has beenreceived by the party, duly corrected, includingher name and amount of Revised Pension.

Sub: Revision of pension of pre-2006pensioners – reg.

The undersigned is directed to say that asper Para 4.2 of this Department’s OM of evennumber dated 1.9.2008 relating to revision ofpension of pre-2006 pensioners w.e.f. 1.1.2006,the revised pension w.e.f. 1.1.2006, in no case,shall be lower than 50% of the sum of theminimum of pay in the pay band and the gradepay thereon corresponding to the prerevised payscale from which the pensioner had retired. Aclarification was issued vide DoP&PW OM ofeven number dated 3.10.2008 that the pensioncalculated at 50% of the minimum of pay in thepay band plus grade pay would be calculatedat the minimum of the pay in the pay band(irrespective of the pre-revised scale of pay) plusthe grade pay corresponding to the pre-revisedpay scale.

2. Several petitions were filed in CentralAdministrative Tribunal, Principal Bench, NewDelhi inter alia claiming that the revised pensionof the pre-2006 pensioners should not be lessthan 50% of the minimum of the pay band +grade pay, corresponding to the pre-revised payscale from which pensioner had retired, asarrived at with reference to the fitment tablesannexed to Ministry of Finance, Department ofExpenditure OM No.l/1/2008-IC dated 30thAugust, 2008. Hon’ble CAT, Principal Bench,New Delhi vide its common order dated1.11.201lin OA No.655/2010 and three otherconnected OAs directed to re-fix the pensionof all pre-2006 retirees w.e.f. 1.1.2006 basedon the Resolution dated 29.8.2008 of theDepartment of Pension & Pensioners’ Welfareand in the light of the observations of Hon’bleCAT in that order.

3. The above order was challenged by theGovernment by filing Writ Petition No.1535/2012in respect of OA No. 655/2010 and WP No.2348-50/12 in respect of the three other connected

OAs in the High Court of Delhi. The Hon’bleHigh Court in Its common Order dated29.4.2013 noted that the DoP&PW had, in themeanwhile, issued an OM No.38/37/08-P&PW(A) dated 28.1.2013 which provided for steppingup of pension of pre - 2006 pensioners w.e.f.24.9.2012 to 50% of the minimum of pay inthe pay band and grade pay corresponding topre-revised pay scale from which the pensionerhad retired. Hon’ble High Court observed thatthe only issue which survived was, withreference to Paragraph 9 of OM dated28.1.2013 which makes it applicable w.e.f.24.9.2012 instead of 1.1.2006. Hon’ble HighCourt of Delhi dismissed the Writ PetitionNo.1535/2012 along with three other WritPetitions vide its order dated 29.4.2013. SpecialLeave Petitions (No.23055/2013 and No.36148-50/2013) filed against the said order dated 29/412013 of the Hon’ble Delhi High Court havealso been dismissed by the Hon’ble SupremeCourt.

4. Accordingly, in compliance with the abovejudicial pronouncements, it has been decidedthat the pension/family pension of all pre-2006pensioners/family pensioners may be revisedin accordance with this Department’s OMNo.38/37/08-P&PW(A) dated 28.1.2013 witheffect from 1.1.2006 instead of 24.9.2012.Further, this benefit has already been grantedto the Applicants in OA No. 655/2010 vide OMof even No. dated 26/08/2014 read with OMdated 19/09/2015 following dismissal of SLP(C) No.23055/2013 by the Hon’ble SupremeCourt.

5. In case the consolidated pension/familypension calculated as per para 4.1 of O.M.No.38/37/08-P&PW (A) dated 1.9.2008 ishigher than the pension/family pensioncalculated in the manner indicated in the O.M.dated 28.1.2013, the same (higher consolidatedpension/family pension) will continue to betreated as basic pension/family pension.

6. All other conditions-as given in OM No.38/37/08-P&PW (A) dated 1.9.2008, asamended from time to time shall remainunchanged.

The undersigned is directed to say that inpursuance of Government’s decision on therecommendations of Sixth Central PayCommission, orders were issued for revision ofpension/family pensioners vide thisDepartment’s OM No.38/37/08- P&PW(A)dated 1.9.2008, as amended from time to time.

2. It has been decided that the pension ofpre-2006 pensioners as revised w.e.f. 1.1.2006in terms of para 4.1 or para 4.2 of the aforesaidOM dated 1.9.2008, as amended from time totime, would be further stepped up to 50% ofthe sum of minimum of pay in the pay bandand the grade pay corresponding to the pre-revised pay scale from which the pensioner hadretired, as arrived at with reference to the fitmenttables annexed to the Ministry of Finance,Department of Expenditure OM No.1/1/2008-IC dated 30th August, 2008. In the case of HAGand above scales, this will be 50% of theminimum of the pay in the revised pay scalearrived at with reference to the fitment tablesannexed to the above-referred OM dated30.8.2008 of Ministry of Finance, Departmentof Expenditure.

3. The normal family pension in respect ofpre-2006 pensioners/family pensioners asrevised w.e.f. 1.1.2006 in terms of para 4.1 orpara 4.2 of the aforesaid OM dated 1.9.2008would also be further stepped up to 30% of thesum of minimum of pay in the pay band andthe grade pay corresponding to the pre-revisedpay scale in which the Government servant hadretired, as arrived at with reference to the fitmenttables annexed to the Ministry of Finance,Department of Expenditure OM No.l/l/2008-ICdated 30th August, 2008. In the case of HAGand above scales, this will be 30% of theminimum of the pay in the revised pay scalearrived at with reference to the fitment tablesannexed to the above OM dated 30.8.2008 ofMinistry of Finance (Department of expenditure).

4. A revised concordance table (Annexure)of the pre-1996, pre-2006 and post 2006 payscales/pay bands indicating the pension/familypension (at ordinary rates) payable under theabove provisions is enclosed to facilitatepayment of revised pension/family pension.

5. The pension so arrived at in accordancewith para 2 above and indicated in Col. 9 ofAnnexure will be reduced pro-rata, where thepensioner had less than the maximum requiredservice for full pension as per rule 49 of theCCS (Pension) Rules, 1972 as applicable before1.1.2006 and in no case it will be less thanRs.3,500/- p.m.

6. The family pension at enhanced rates(under sub rule (3)(a) of Rule 54 of the CCS(Pension) Rules, 1972) of pre-2006 pensioners/family pensioners revised w.e.f. 1.1.2006 interms of para 4.1 or this Department’s OM No.1/3/2011-P&PW(E) dated 25.5.2012 would befurther stepped up in the following manner:

(i) In the case of Government servants whodied while in service before1.1.2006 and inrespect of whom enhanced family pension isapplicable from the date of approval by theGovernment, i.e.24.9.2012, the enhancedfamily pension will be stepped up to 50% ofthe sum of minimum of pay in the pay bandand the grade pay corresponding to the pre-

revised pay scale in which the Governmentservant had died, as arrived at with reference tothe fitment tables annexed to the Ministry ofFinance, Department of Expenditure OM No.1/1/2008-IC dated 30th August, 2008. In the caseof HAG and above scales, this will be 50% ofthe minimum of the pay in the revised pay scalearrived at with reference to the fitment tablesannexed to the above-referred OM dated30.8.2008 of Ministry of Finance, Departmentof Expenditure.

(ii) In the case of a pensioner who retiredbefore 1.1.2006 and in respect of whomenhanced family pension is applicable from thedate of approval by the Government,i.e.24.9.2012, the enhanced family pension willbe stepped up to the amount of pension asrevised in terms of para 2 read with para 5 above.In case the pensioner has died before from thedate of approval by the Government,i.e.24.9.2012, the pension will be revised notionallyin terms of para 2 read with para 5 above. Theamount of revised enhanced family pension will,however, not be less than the amount of familypension at ordinary rates as revised in terms ofpara 3 above.

7. In case the pension consolidated pension/family pension/enhanced family pensioncalculated as per para 4.1 of OM No.38/37/08-P&PW(A) dated 1.9.2008 is higher than thepension/family pension calculated in the mannerindicated above, the same (higher consolidatedpension/family pension) will continue to betreated as basic pension/family pension.

8. All other conditions as given in OM No.38/37/08-P&PW(A) dated 1.9.2008, asamended from time to time shall remainunchanged.

9. These orders will take effect from the dateof approval by the Government, i.e. 24.9.2012.There will be no change in the amount of revisedpension/family pension paid during the period1.1.2006 and 23.9.2012, and, therefore, noarrears will be payable on account of theseorders for that period.

10. In their application to the persons

belonging to the Indian Audit and AccountsDepartment, these orders issue in consultationwith the Comptroller and Auditor General ofIndia.

11. All the Ministries/Departments arerequested to bring the contents of these ordersto the notice of Controller of Accounts/Pay andAccounts Officers and Attached andsubordinate Offices under them on a top prioritybasis. CPAO is successfully sending digitally signed

revision authorities alongwith hard copies of

the same to the three banks i.e. State Bank

of India, Chandni Chowk, Canara Bank and

Bank of Baroda. Now it has been decided to

roll out this project in the CPPCs of remaining

banks w.e.f. 01.08.2015.In the meanwhile, all

the remaining CPPCs are advised to complete

their preparatory work and other formalities by

the end of July, 2015. For this purpose they

have to provide:-

i) Server finger print for SFTP

ii) User name for SFTP

iii) password for SFTP by 15th of July 2015.

CPAO will send both paper authorities and

digitally signed PDF and XML files on the SFTP

login provided by bank w.e.f. 1st August 2015.

Sub: Revision of pension of Pre-2006pensioners- inclusion of non-practicing Allowance (NPA) forrevision of pension for Armed ForcePensioners/Family pensioners.

The undersigned is directed to referprovisions contained in this Ministry’s letter NoI (1)/99(Pension/Services) dated 7.6,1999 andeven number dated 11.9.2001. The MoD’s letterdated 7.6.1999 provides that with effect from1.1.1996, pension/family pension of all ArmedForces pensioners, irrespective of their date ofretirement, shall not be less than 50% / 30%respectively, of the minimum pay in the revisedscale of pay introduced with effect from 1.1.1996of the rank, and rank Group (in case of PBOR)‘held by the pensioner. MoD letter dated11.9.2001, however, stipulates that NonPracticing Allowance (NPA) shall not be addedto minimum of revised scale of pay introducedwith effect from 1.1.1996 of the rank held bythe pensioner at the time of retirement. It wasalso clarified vide this Ministry letter No17(4)12008(1)/D(Pen/Policy) dated 16.3.2010that while revising pension of pre-2006 retireesMedical officers of Armed Force from 1.1.2006,NPA element shall not be added to determinethe emoluments for minimum guaranteedpension in terms of Para 5 of this Ministry’sletter No 17(4)12008(1)/ D(pen/Policy) dated11.11.2008.

2. In implementation of Hon’ble SupremeCourt order dated 27.11.201.3 in Civil AppealNo 10640-46/2013, Government of India,Ministry of Personnel, Public Grievances &Pension, Department of Pension and.Pensioner Welfare, in consultation with Ministryof Finance, Department of Expenditure andMinistry of Law, Department of Legal Affairs,has issued three OMs bearing No 38/31/11-P&PW(A) (Vol-IV) dated 14.10.2014, dated21.10.2014 and dated 18.02.2015. It has been

decided therein that while determining minimumguaranteed pension of past retirees from1.1.1996 in terms of DP&PW OM dated17.12.1998, with effect from 1.1.2006 in termsof DP&PW OM dated 1.9.2008, and with effectfrom 24.09.2012 in terms of DP &PW OM dated18.02.2015, the NPA element, shall be addedto the minimum of the revised pay scale subjectto maximum ceiling prescribed from time totime.

3. Matter was under consideration of theGovernment for quite some time to extend thesaid provisions for Armed Forces personnelalso who were drawing NPA element at the timeof their retirement. It has now been decidedthat in case of pre-1996 retired Medical officersof Armed Forces, NPA @ 25% shall be addedto minimum of scale of pay as on 1.1.1996while determining minimum guaranteedpension/family pension in terms of this Ministryletter No 1 (1 )/99 (Pen/Sers) dated 07.06.1999subject to the ceiling that pay plus rank payplus NPA shall not exceed Rs 29,500/, It hasalso been decided that in case of pre-2006retired Medical officers of Armed. Forces, NPA@ 25% shall be added to the minimum of thepay in the pay band plus the grade pay andMilitary Service Pay, where applicable, whiledetermining minimum guaranteed pension/family pension from 1.1.2006 in terms of Para5 of this Ministry letter No 17(4)/2008(1)/D(Pen/Policy) dated 11.11.2008 subject to the ceilingthat pay plus grade pay plus Military ServicePay wherever applicable and. NPA, shall notexceed Rs 85,000/-. Similarly, for revision ofpension/family pension with effect from24.9.2012, NPA @ 25% shall also be added tothe minimum of the fitment table for the rank inthe revised pay band as indicated under fitmenttables annexed with SA1 2/S/2008 andequivalent instructions for Navy and Air Force,plus Grade pay and Military Service Pay, whereapplicable, for determining minimumguaranteed pension in terms of this Ministry’sletter No 1 (11 )/2012- D(Pen/Policy) dated17.1.2013, as modified vide letter dated25.11.2014 subject to the ceiling that pay plus

Sub: Clarification on simplification ofprocedure for payment of pensionand other benefits to AIS officersretiring from Govt of India/State Govt:exercise of option regarding.

The undersigned is directed to refer to thisDepartment’s Order No. 250141212002-AIS-IIdated 11th April, 2007 wherein measures forsimplification of payment of pension and otherretirement benefits to All India Services officersretiring/retired from Government of India/StateGovernment have been revised and theGovernment of India had taken over the entirepension liability of all the All India Serviceofficers. Besides, all retiring All India Serviceofficers either from the Central Government orState Government uniformly have the option ofdrawl of their pension through Government ofIndia or through the State Government. However,in the aforesaid order dated 11th April, 2007,the issue of revocation of their earlier option fordrawl of pension exercised by the All IndiaService pensioners was silent.

(2) Accordingly, keeping in view the agingfactor and to ease and comfort in a retired life,the issue of exercising option for drawingpension either from Government of India or StateGovernment was revisited in this Department

in consultation with the Central PensionAccounting Office, Department of Expenditureand Department of Pension and Pensioners’Welfare and has decided that the optionexercised by the pensioner for drawl of pension/family pension either from the Government ofIndia ‘or State Government in reference to thisDepartments Order dated 11th April , 2007would continue as “zero option’ (optionexercised at the time of retirement wouldconstitute as zero option).

(3) Thereafter, the retired officer can furthermake two options for which the first option wouldbe permitted without obtaining the permissionof Central Government and the second optionwould require permission of the CentralGovernment. No further option shall beconsidered after the Second option is permittedby the Central Government. The first optionshall be applied by the pensioner to the DrawingDisbursing Authority of her/his pension in theprescribed format (Annexure-1).

(4) The proposal for revocation of earlieroptions which required permission of theCentral Government shall be applied to theconcerned Cadre Controlling Authority of AllIndia Services in the prescribed format(Annexure-II) and such proposal shall beprocessed in consultation with the ChiefController (Pension), Central PensionAccounting Office (Department ofExpenditure), New Delhi for according approvalof the Secretary of the concerned CadreControlling Authority.

(5) It is to state that every time a change inoption is made, it shall be notified to the CentralPension Accounts Office (Department ofExpenditure) for carrying out necessaryupdation in its data base.

(6) The revised format for exercising zerooption for drawl of pension in respect of retiring/retired members of All India Services isannexed as Annexure-III.

xxx The issue is whether a person retiringfrom a higher grade can receive pension lessthan a person retiring in the lower grade. Is itnot arbitrary and in view of the Judgment of theHon’ble Apex Court in the case of Union of Indiaand another Vs SPS Vains (Retd.) and ORS

since reported in (2008) 9 SCC 125, thepension of a person in the Higher Grade wouldhave to be stepped up accordingly.

Petitioner retired in 1992 from Indian Rlysas additional Genl Manager, Eastern Rly,Kolkata and was an officer in HAG. xxx GOIclassified its staff in 33 scales and oneexclusive scale for cabinet secy. S-28, S-29,S-30 and S-31 are scales corresponding toSelection Gd, Sr Administrative grade, HAGand HAG+. As per recommendations of 6thCPC, Central govt declared scale for PB-4which was for SG(S-28), SAG (S-29), HAG (S-30) as 37400-67000 but provided for Gd Payfor each scale separately at 8700; 10,000 &12,000 respectively. But S-30 was provided aseparate pay band with scale 67000-79000 but,vide Min of Rlys circular dt 26-5-2009, GdPay of 12000 for HAG removed.

xxx Petitioner had retired in 1992 and asper Rly Boards notification, his notional paywas fixed at the minimum of HAG (S-30) i.e.67000 without Gd pay and pension at 50%thereof i.e. 33500. A person in SAG (S-29), aninferior & feeder grade for S-30, the pay bandbeing 37400-67000 without a Gd pay ofRs.10000 will get a pension of Rs.38500(37400-67000+Gd pay 10000=77000 & 50%of this being 38500) xxxxx A person retiring inS-29 at the minimum scale will not only gethigher remuneration but consequently higherpension than grade S-30. xxxxx This is hostilediscrimination arbitrary and improper. Brieflysubmitted a junior can not get higherremuneration or pension than a senior.Petitioner in support has given names withdesignation of at least 3 officers of the Rlysretired from SAG (S-29) and receiving pensionbetween Rs.35690 and Rs.36640 as againstpetitioner getting pension of Rs.33500.Petitioner has also in support given names ofeight persons who would be retiring from SAG

in near future & their pension would ordinarilybe 38500 & has thus proved the discrepancycapable of happening and also happening – aclear case of impermissible discrimination andviolative of Article 14 of the constitution of India.The only counter affidavit filed by Rlys statesthat the petitioner retired prior to 2006 whereasthe case illustrated by petitioner are of personsretired after 01-01-2006 or are yet to retire &accordingly a reasonable classification for lowerpension in the higher grade.

Respondent (Rlys) was silent as to why aperson of higher grade will get pension lessthan of a junior grade. No where the respondent(Rlys) have challenged the factual assertion ofdichotomy pointed by the petitioner. Problemwould have not arisen if Gd pay of Rs.12000not removed from HAG (S-30). Further a veryunhappy situation would arise when a personof S-29 at the maximum of SAG scale i.e 67000+ Gd pay Rs.10000 i.e.77000/- on promotionto HAG will have basic pay of HAG S-30 atRs.67000/- and has to be given pay protectionupon promotion. Respondents defence that thisanomaly is inherent in the system which courtobserved, is not permissible. Respondentsupported his case with the Apex CourtJudgement in the matter of UOI Vs SPS Vains(Retd) and others supra. None of the counselsfor the respondents could counter the decisionof the Hon’ble Apex Court. xxxxxxx

Hence, having considered the matter andin the absence of any dispute either of facts orlaw, the judgement and order of CAT, PatnaBench, Patna set aside and held that the basicpension of the petitioner w.e.f. 01-01-2006 bestepped up to Rs.38500/- to avoiddiscrimination. Further directed thatRespondent no.3, Min of Rlys thru the chairmanRly Bd and Respondent no.4, Rly Bd thrusecretary are given three months time tocalculate the arrears of pension accordingly andpay the same without the said period.

This writ petition, is accordingly, allowed.

ASSN- Monthly meeting of RPWA held on 05-

01-2015 attended by 120 members was chaired

by its Sh V Thirunavukkarusu. In his welcome

address Chairman highlighted activities of the

organization and advised members to join yoga

& meditation classes. Secy D Krishnamoorthy

explained of the cases handled & all pending

cases to be taken up in the coming pension

Adalat due in July, 2015 under advise to

authorities to expedite redressal of long out-

standing cases involving pensioners’

GOVT PENR’S WELFARE ASSN –AGM 2014-

15 held on 21-06-2015 was attended by 101

members despite erratic weather and presided

by its vice prez B N Chakraborty. Annual report

and Accounts were presented and approved.

House elected unanimously the new Managing

Committee of 17 members with S M Goswami,

B G Saha and S K Chattergjee as President,

Genl Secretary and Treasurer respectively.

Octogenarian members were honoured.

KOZHIKODE : CENTRAL GOVT PENRS’

ASSN-31st AGM held on 18-04-2015 was

presided by CGPA’s prez P Chandrasekharan

and inaugurated by V U Eradi, a senior life-

member (Retd Member CBTD Delhi) who later

was elevated by house as patron of CGPA. After

‘Vandematram’, house observed 2 minutes to

pay homage to departed souls. President in

his address explained grievance of pensioners

Balasubramanian stressed the need and

importance of strengthening CGPA through

CGPA calicut’s affiliation with BPS, Delhi which

K M Narayanan explained the salient issues

involved in the judgements of Hon’ble Supreme

Court delivered on 17-03-2015 and 20-03-2015

and also pensioners’ demands of extending

CGHS wellness centres in Kerala – middle &

northern parts/ DR merger. House unanimously

resolved to continue with existing incumbents

of the posts of Prez, VP, Genl Secy, Treasurer,

Org Secy, 2 Jt Secys & Auditor except

replacement of 2 executive committee

members. Jt Secy A Balakrishnan proposed

vote of thanks. Meeting ended with singing of

‘National Anthem’ and a good feast.

KRISHNAGAR (DIST. NADIA-WB)

CENTRAL GOVT PENR’S ASSN- 46th AGM

held on 05-04-2015 was chaired by its

prez Rajat Kr Chatterjee and anchored by its

Genl Secy Biswesar Dutta. 24 octogenarian

members were felicitated with rose buds,

shawls and sweets. House adopted resolutions

on increase in FMA; merger of 50% DR;

commuted pension to be restored after 12

years and discrimination–free fitment for S-7

to S-23 pre- 2006 pensioners.

SERAMPORE (DIST HOOGHLY –WB):

CENTRAL GOVT PENR’S ASSN- 30th AGM

held on 20-05-2015, with nearly 400 members

present, was presided by R R Halder. After

welcome by genl secy P K Mukherjee, house

Thereafter genl secy apprised all of the

developments on OROP, DR merger, IR etc. 6

nonagenarian, 28 octogenarian and 35

septuagenarian members were felicitated with

gifts & ‘Sambardhana Patras’. Nonagenarian

members were given Uttariyas also. Old

incumbents R R Halder, P K Mukherjee & K K

Ghosh holding charge of prez, genl secy &

treasurer respectively were re-elected. AGM

ended with serving of refreshments.

TALENGAON DABHADE (DIST PUNE-

MH): SEWA NIVRUTTA SANGHATANA- 35th

AGM held on 14-06-2015 was attended by 160

members with chief guests Smt Anjali Raje

Dabhade and Sh Basaheb Jhambhular, both

ex-presidents. Function started with lighting of

lamps and garlanding by chief guests and prez

BV Dabhade. House observed two minutes

silence as a mark of respect to the departed

souls of SVS and earthquake victims of Nepal,

UP & Bihar. Chief guests and invitees were

greeted by president Dabhade with Shripal &

bouquets. President briefed house of activities

undertaken during previous year. For 2015-16,

it was agreed to continue with the old body

except the internal auditor. Secy B A Koli read

the minutes of last AGM & Rajshekhar Ulvi

presented accounts & same accepted. Meeting

ended with a vote of thanks and lunch.

TAMBARAM (TN): A I R PENR’S SANGAM

– Monthly meeting held on 4-07-2015 was

chaired by its prez Sh N Kalivaradan. After

prayer, two minutes silence was observed on

the demise of Mrs. Matilda Premavathy w/o

Sh J C Devraj. Sh A William elaborated the

Acupuncture treatment & its effectiveness. Sh

E Anban apprised members present of the

keen interest of the president in resolving the

grievances of the pensioners which involved

meeting higher authorities and enrolment of new

members. President stressed for regularly

attending the meeting by all and informed of

grievances resolved which included payment

of family pension to Mrs. Suganthi, stoppage

of recovery of overpayment from Mrs. Kasthuri

(the pensioner has later cleared all dues of her

own) and action taken for expeditious release

of secondary family pension of Ms. D Saranya.

He advised members to attend AIFPA AGM

due on 24/25-07- 2015. He lauded AIFPA &

BPS for including their demands to 7th CPC.

Representatives of Exide Life Insurance

organization explained the benefits of insurance

and donated Rs.1000/- to meet expenditure of

the day. President sponsored ‘Laddu’ on

account of his 80th birthday. Meeting ended

with thanks by Sh C S Balakrishnan.

TUTICORIN (TN): CENTRAL GOVT

PENR’S ASSN- EC meeting held on 20-06-

2015 chaired by its prez S Pitchaiah began

with recitation of prayer followed by homage to

six members who have passed away during

the previous month. Secy V Govindaraj read

the proceedings of the previous meeting

followed by annual report for ensuing 19th AGM

of CGPA Tuticorin. Both were approved.

Discussing the finances of the assn, Treasurer

S Natarajan requested members present to

donate liberally to meet the expenses of the

AGM of CGPA and of 36th AGM of AIFPA,

Chennai. Later secretary informed of the

likelyhood of 7th CPC’s report by the end of

September 2015; likely increase in pension;

courts unfavourable verdict on upgradation of

few posts etc. President summed up various

issues spelled by speakers and talked of the

36th AGM of AIFPA, Chennai. Meeting ended

with a vote of thanks by P A Perumal.

Sub :Provision of Emergency RailwayMedical Facilities to Railwaybeneficiaries.

All railway employees, their spouse andeligible dependents are ligible to avail railwaymedical facilities in Railway Hospitals andHealth Units etc. Similarly on joining RELHS-97, retired railway employees, their spouse andeligible dependents also become eligible for

same level of medical facilities as that of servingrailway employees. Instances have come tothe notice of the Board that the railway medicalbeneficiaries are facing difficulties in availlingrailway medical facilities during emergenciesin places other than the place where theirmedical card is registered.

The matter has been examined in theBoard’s office and it has been decided, withthe approval of competent authority, that allrailway Hospitals,Health Units etc wouldensure adequate medical facility to servingemployees, their spouse and eligibledependents/RELHS-97 card holders, theirspouse and eligible dependents inemergencies. Such a facility will be extendedon production of railway medical identity card/any other documentary proof that estabilshesthe railway identity in case of serving railwayemployees and RELHS-97 cards in case ofretired railway employees.

Survival of pensioners’ organization is on performance.Good organization care more for therecognition by the masses they serve ( pensioners in our case) than the recognition by theGovernment. BPS has a history of learning from the past & to mould itself to the future requirement.Ithas been our endeavour to serve you better & it is this zeal that BPS wish its affiliates to progress& strengthen themselves .If you grow BPS too will grow. Though often Secretary has been givingyou inputs through his writings & speeches being published in monthly magazine of ‘BharatPensioners Samaj’ but in today’s scenario of modern technology & management skills, upgradationof both i.e the Federation & the affiliates is necessary. THE FINAL GREAT SUCCESSModified Parity Case : Arrears Won

Govt finally yields to pay arrears w.e.f 1.1.2006Members should now be very happy to find that ultimately the Govt.has now agreed and issued

Orders (OM No. F.NO 38/37/08-P&PW(A) dt : 30.07.15) - published elsewhere in this issue ofBHARAT PENSIONER - in regard to payment of the arrears on account of Modified Parity for theperiod from 1.1.2006 to 23.9.2012. The final victory has come despite the fact that the Govtchallenged the CAT Principal Bench decision dt : 01.1.2011 in the High Court of Delhi and it wentupto the Highest Court against the pensioners.

In compliance with the above judicial pronouncements, it has now been decided that the pension/family pension of all pre - 2006 pensioners/family pensioners may be revised in accordance withthe department’s OM No. 38/37/08-P&PW(A) dated : 28.01.2013 with effect from 1.1.2006 insteadof 24.09.2012. It may kindly be noted that this OM grants benefit to only those pre-2006 pensioners/family pensioners whose basic pension as on 01.01.2006 is less than 50% / 30% of the minimumof pay in the Pay Band + Grade Pay as the CAT judgment dated : 01.11.2011 relates to only thiscategory of pre-2006 pensioners.

The glass is now full but only in respect of Modified Parity. Full Parity and full pension with 20years of qualified service are yet to be achieved . You may approach your Pension SanctioningAuthority for implementation of the Orders dt : 30.07.2015.
