SG BPS S C Maheshwari and Editor M MKapur were invited on 14th September, 2016on the inauguration of MAHALEKHANIYANTRAK BHAWAN, the new off icialpremises of the O/o Controller of Accounts,Deptt of Expenditure, by Union Minister forFinance & Corporate Affairs- Sh. Arun Jaitley,Sh Arjun Ram Meghwal,Minister of State forFinance presided the function attended byvarious Secretaries and other seniorfunctionaries of the GOI. Hon'ble FinanceMinister launched a new Digital India initiativeof the O/o CGA namely a Web ResponsivePensioner's Services developed by CentralPension Accounting Office (CPAO). Sh SanjaiSingh, Chief Controller (Pensions) explained themain features of the this service which will allowgovernment pensioners to track the status oftheir pension and grievance redressal thru SMSas well as monitoring online with the sole aimto lessen harassment often complained. Thisweb portal will enable central civil pensioners /family pensioners and freedom fighterpensioners to view their complete pension profiledigitally by logging into www.cpao.nic.in. It isa mobile responsive facility by registering onthe CPAO website by providing PPO numberand Date of Birth alongwith Date of Retirement/Date of Death. It entails facilities of Login usingany mobile device; view complete pensionerprofile; digital record of pension and revisionorders; downloading of pension/revision orderssent to banks by CPAO; tracking status ofpension processing; grievances redressal andtheir status; SMS facility of status of pensionprocessing at CPAO and of grievanceregistration and disposal; access to JeewanPramaan, Bhavishya and CPENGRAMSPortals; dashboards for banks, PAOs,ministries/Deptts and facility of obtainingfeedback of pensioners. It will not be out of placeto mention that S C Maheshwari S G BPS andM M Kapur Editor BPS gave important feedback at development stage of this portal whichhas been taken care of in the final version

Honorable Chief Guest, Guests of honor,dignitaries on the dais, respected Seniorcomrades, affiliates & members of NFRPA,Ladies and gentlemen:
I am honored to be speaking to you on theoccasion of Triennial AGM of National Federationof Railway Pensioners here at Palakkad. On thisoccasion I congratulate the leaders, Management,Affiliates and members of NFRP & wish themmany successful years ahead. NFRP, BharatPensioners Samaj & AIFPA,Chennai are MOUpartners and together we represent over 10 lacpensioners and have successfully walked throughdecades, serving the cause of pensioners.
Ladies & gentlemen, we are retired but nottired, our endeavor is to bring all pensionerstogether. When 54 lac CG pensioners, 80 lac statepensioners & 45 lac EPS 95 pensioners will walktogether, all our woes will get resolved as thenwe will have the strength to change the politicalscene of the country.
We, i.e, BPS NFRP & AIFPA have been movingtogether struggling jointly & severally for thecommon issues of pensioners.

3. Social security.
Financial Security : We represented the issueto the 7th Central Pay Commission. PayCommission listened to us patiently. But alas!the outcome is not encouraging. Inspite of thefact that 7th CPC in principle accepted a few ofour submissions, bureaucracy has negatedthese. We had represented that wide gulf betweenminimum & maximum paid should be narroweddown and brought back to 1.7.1996 level of 1:8and a common multiplication factor for revision ofpay & pension be worked out so that everyonegets uniform raise. PC instead of reducing, furtherraised minimum maximum paid gap to 1:13.88 &worked out 2.57 common multiplication factor. This2.57 fitment factor recommended by the 7th CPCand accepted by the Govt. is essentially a multiplefactor which is the ratio of the new minimum payarrived at by the 7th Pay Commission,i.e.,Rs

18,000/- and the existing minimum pay Rs.7,000/-. This provides only 14.29% rise in Salary(which in terms of money is Rs 2250/-{7000+125% DR = Rs.15750/- to 18000} anddifference in take home after deductions is justRs.500/- after 10 years) as well as in Pensionwhich is the historically the lowest raise given byany Govt. in the past seventy years. This hashappened because of incorrect calculation ofminimum revised salary resulted not only byadoption of lower prices of commodities but alsodue to adoption of Aykroyd formula of 1948 withoutupdating it. It is surprising as to how a genderbias 1948 formula of Dr Aykroyd adopted by ILC in1957 is applied, without updating, in digital Indiaof 2016. In today’s scenario how can Indian civilsociety accept a formula for minimum requirementwhich treats the lady of the house as 0.8 unitcompared to the adult male of the house as 1unit. Further this formula does not at all take intoconsideration the minimum requirement of today’sdigital India i.e. a smart mobile phone withinternet connection. Considering wife to be .80unit is nothing but gender bias indicating a colonialmindset of Dr Aykroyd. In the present scenario awife too puts in the same amount rather more ofphysical and intellectual work as compared to thehusband. She needs more nutrients & healthcareto keep herself fit to be a mother and as aneducationist for her school going children. Sheneeds better clothing than 1957. A lady whethershe is a wife of a labourer or of a Secretary to Govt.of India, has a basic right to keep herselfreasonably presentable for which she needssome minimum add-ons. As such treating her tobe less than a unit is gross injustice, gender biasand unconstitutional. Similarly growing childrenof up - to 14 years of age need more of proteins,fats & carbohydrates, need to take sufficientexercise & field activities for healthy growth. Todaythey need much better and more clothing, bettereducation & healthcare compared to 50s. TheNation needs healthy & stout young citizens. It isagainst the National interest to restrict their needbased minimum requirement to .6 unit.
Thus the Minimum Salary & correspondinglythe fitment benefit of 2.57 needs upwards revision.As of now Govt. has refered the issue to a high-powered committee.But as per indications hardlyany change is expected,
The 2nd big issue in this connection is 100 %parity between pre & post 1.1.2016 retirees :7th CPC recommended vide their Para 10.1.67that : All the civilian personnel including CAPFwho retired prior to 01.01.2016 shall first be fixedin the Pay Matrix recommended by theCommission, on the basis of the Pay Band andGrade Pay at which they retired, at the minimumof the corresponding level in the matrix. Thisamount shall be raised, to arrive at the notionalpay of the retiree, by adding the number ofincrements he/she had earned in that level whilein service, at the rate of three percent. Fifty percentof the total amount so arrived at shall be therevised pension. Govt. says it may not be feasibleto implement. However, on our insistence, thisrecommendation has been accepted by the Govt.but, subject to feasibility. On this issue we couldreach consensus with S 30 & S 29 Associationand have represented that the required recordsare available in 95% cases & the remaining canbe recasted, thus the recommendation can easilybe implemented.
Currently both the above issues are underconsideration of committees constituted for thispurpose and we will have to wait for the outcomeSimilarly, the issue of raising FMA is also underconsideration of a committee. In 2014 whilesubmitting memorandum to 7th CPC, based onthe information gathered under RTI, we had askedfor Rs 2000/- per month which was rejected noton merit but on the flimsy ground that FMA wasrecently raised from 300/- to Rs.500/-. Taking intoconsideration the sky rocketing inflation of healthcare we have requested the spl committee to raiseFMA to Rs 3000/-per month.
There are several other issues relating to ourfinancial security a few of which I wish toenumerate before you today : No 1 is regardinggranting of revised corresponding 5th CPCscales to the specific categories as detailed inRly Board orders dated 16.10.1998: NFRP & BPShave been representing that this is not a case ofupgradation but it is an issue of grantingcorresponding 5th CPC scales to specif iccategories. Sh K S Srinivasan has beenvehemently pursuing the case for the last severalyears & BPS is whole heartedly supporting it. InJuly this year there had been long discussions

with Rly Board top officers, the outcome is awaited.However, in the meantime Madras High Court on02.08.2016 in Writ Petn. No.13207 of 2013R.Sethumadhavan Vs UOI has given a favorablejudgement we have yet to see if UOI files an appealin SC or accepts the HC judgment.
No.2 Is Restoration of 2/3rd commutation :our simple argument is that commutation is anadvance given by the employer to the retiringemployee at a specified rate of interest, the retiredemployee repays it through monthly instalmentsfrom his/her pension,thus as soon as the entireamount with interest is recovered deduction fromhis/her pension should stop restoring full pension.Recently on 01.09.2016 Supreme Court in thecase of Union of India -Vs- (Late) K. Ganesan inCivil Appeal No. 6048 of 2010 and Civil AppealNo. 6371 of 2010. has issued orders forRestoration of 2/3rd Commuted Pension after15 years of PSU Absorbees who took fullCommutation of Pension. We have representedthat this judgement be applied to all similarlyplaced persons.
3. Additional age related Pension : werepresented to 7th CPC that Sixth Pay Commissionhad recommended additional Pension of 20, 30,40, 50 and 100 % for retirees and familypensioners on attaining the age of 80, 85, 90, 95and 100 years respectively. However, in thepresent scenario of climatic changes, incidenceof pesticides and rising pollution, old agedisabilities/diseases set in by the time anemployee retires and go on manifesting very fast,needing additional finances to take care of thesedisabilities and diseases, especially as the costof healthcare has gone very high.Recommendation of Sixth Pay Commission forgrant of 100% additional Pension after 100 yearsof age was rather illusionary in view of chances ofsurvival up to or beyond age of 100 years beingrare. It was, therefore, requested the 7th CPC that10% Additional Pension should be granted every5 years from the age of 65 to 75 years & thereafter20% every 5 years from 80 years onwards and100% after 90 years of age. During the discussion7 CPC was agreeable to start age relatedadditional pension from the age of 75 yrs but finallythey rejected the demand, not on merit but,simplybecause Ministry of Defence was not agreeable
to it. We have represented against the rejectionbut Govt. is silent.
4. NPS for post 2004 recruited employees :As of now, taking into consideration exigency ofservices, the Defence Forces have been kept outof the purview of NPS. We have represented thatRailway services too are as arduous & risky asthose of Defence forces. Every year over 3000 Rlyemployees get run over and killed while on duty,most of them get cut into pieces. They are notcalled martyrs, waiting postmortem their bodiesare shelved in morgue for several days & no onefrom administration goes to their families forconsolation or attend their funeral. Over 800Railway employees become disabled due toaccidents on duty. Not only that, during war timeRly is lifeline for the armed forces. It is the devotion& dedication of Rly employees that men andmaterial including Arms,Ammunition,Artillery &Ration reaches them in time. As such, Rly servicestoo should be given the benefit of pre 2004pension scheme. Earlier Sh Mallikarjun Kharge,the Railways Minister in the previous government,had raised the issue with the then FinanceMinister in March 2014.The present Rly Ministertoo wrote to Finance Minister to exclude Rlyemployees from NPS. But alas,the FinanceMinister has declined to accept it.
5.Deprivation of all the Central PayCommission benefits in terms of pay revisions& Pensionary benefits to pensioners born on1.1.1946/1938/1928 owing to their retirementson 31.12.2005/1995/1985 : The modified FR56(a), requires every one whose date of birth is thefirst of a month to retire from service on theafternoon of the last day of the preceding monthon attaining the age of superannuation. As a resultof this modification pensioners born on 1.1.1946/1938/1928 are deprived of all the central paycommission benefits in terms of pay revisions &Pensionary benefits owing to their retirements on31.12.2005/1995/1985. This proviso singled outthe Ist Jan. 1946/1938/1928 - born pensionersfor deprivation of the Pay Commission benefits. Such of the pensioners are made to suffer for nofault of theirs and are deprived of EQUALITY ofstatus and of opportunity. This violation of Article14 of constitution need to be set right immediatelyissue was discussed with 7th CPC as it was one

of the items of BPS memorandum to 7th CPC butnothing positive could be achieved. Howeverissue is still on BPS agenda and is being pursued.
6.Income tax on Pension : The purchase valueof pension gets reduced day by day due tocontinuous high inflation and steep rise in cost offood items and medical facilities. Retired persons/senior citizens do not enjoy fully, public goodsand services provided by the Government forcitizens due to lack of mobility and many otherfactors coupled with falling interest rates on theirdeposits.Their ability to pay tax gets reduced yearto year after retirement due to ever increasingexpenditure on food, medicine and otherincidental. Their net worth at year end gets reducedconsiderably compared to the beginning of theyear. Inflation for pensioners is much more thanany Tax. It erodes the major part of the alreadyinadequate pension. To enable pensioners, atthe far end of their lives, tolive in minimum comfortand to cater for ever rising cost of living, they maybe spared from paying income tax on pension &the DR as was recommended 5th CPC.
7. Application of S C judgements in case ofsimilarly placed persons Govt. should notindirectly pressurize courts by appealing again &again to get judgements reversed in their favourand must implement all Supreme courtjudgements to all similarly placed persons FifthCPC recommended in Para 126.5 of their reportthat any court judgement involving common policymatter of pay/pension to a group of employees/pensions, should automatically without drivingevery affected individual to Court of law.
Healthcare :
It is a major issue facing Rly RELHSbeneficiaries in spite of the fact that the right tohealth, medical aid to protect the health and vigourof a worker while in service or post retirement is afundamental right.{ in terms of Article 21 read withArticle 39 for a 41, 43, 48A and all related Articlesas pronounced by the Supreme Court inConsumer Education and Research Centre &Others vs Union of India (AIR 1995Supreme Court922)} M/O Railways on the issue of Smart Cardand the M/O Rlys have been cutting jokes withRly RELHS beneficiaries over the last onedecade.
The CASHLESS TREATMENT SCHEME INEMERGENCY (CTSE) FOR RELHSBENEFICIARIES AT EMPANELLED HOSPITALSfloated vide Railway Board’s letter No.2014/H/28/1/Smart Card/Part ‘A’ dated 14.07.2016 isanother big joke with Rly pensioners & familypensioners as it requires additional payment ofexorbitantly heavy amounts of money rangingbetween Rs.10000 to Rs.50000 from existingRELHS beneficiaries who have already paid lastmonth’s Salary/2 pensions for joining it and thenan amount of Rs 2000 to 10000/ to the empaneledhospital for getting medical treatment in case ofEmergency under CTSE. BPS has representedthat the Scheme of Cashless Service for RELHSCard Holder to take treatment in recognizedPrivate Hospitals in emergency promulgated videRly Board No.2007/H/28/1/RELHS/Smart CardNew Delhi, dated 18.07.2012 and which standsimplemented on Eastern Railways (ReferenceCMD ERlyNo. MD. 173/0/Smart Card Dated: 11thJune, 2013) is much better and may with slightamendments be adopted for PAN INDIA Smartcard for RELHS beneficiaries

1. DOP&PW vide its orders dated 30-9- 1996cited above, had restored one third commuted

1. We seek your benign intervention in amatter of extreme hardship perpetrated on thelarge number of Railway Pensioners who havebeen asked vide the Railway Board’s letter citedabove, to pay exorbitantly heavy amounts ofmoney ranging between Rs.10000 to Rs.50000for getting medical treatment in case ofEmergency under CTSE.
2. The RELHS beneficiaries had already paid
one month’s salary or two months Pension forjoining the Railway Employees Liberalized HealthScheme (RELHS) – 97.
3. Under this scheme the RELHS beneficiariesare already entitled for getting Medical treatmentin any Private Empaneled Hospital in case ofEmergency – on Billing or Cashless system inthe area in which they are registered and onReimbursement basis in any Government orPrivate Hospital anywhere in India in case ofEmergency.
4. The only difference the above cited ordersof the Railway Board have incorporated thecashless treatment in Empanelled Hospitals allover India. But they were in case entitled for sucha treatment in case of Emergency anywhere inIndia even though on Reimbursement basis.
5. As per settled law, Pensioners are entitledto proper health care by the Government and forreimbursement of Medical expenses even if theyhave not opted for CGHS or RELHS.
6. Asking RELHS Optees for payment of suchheavy amounts (ranging from Rs.10,000 toRs.50,000) merely for providing a Cashless facilityinstead of Reimbursement, tantamounts to sheare exploitation and fleecing the poor pensionersby showing a carrot of cashless treatment insteadof reimbursement.
7. Above all, the CTSE is proposed to beintroduced only as an experimental basis for oneyear and that too in 4 Metro cities only. What willhappen to the heavy amounts of money paid bythe poor pensioners if the scheme is closed aftera year or two, is not clear, thus creating a doublejeopardy.
8. BPS, the largest Federation of PensionersAssociations recognized by DOP & PW, humblysubmits that the Scheme of Cashless Service forRELHS Card Holder to take treatment inrecognized Private Hospitals in emergencypromulgated vide Rly Board No.2007/H/28/1/RELHS/Smart Card New Delhi, dated 18.07.2012and which stands implemented on EasternRailways (Reference CMD ERly No. MD. 173/0/Smart Card dated: 11th June, 2013) is much betterand may, with slight amendments,be adopted forPAN INDIA Smart card for RELHS beneficiaries.

It is, therefore, requested that withoutpushing each one of the affected pensioner tocourt of law, keeping in view the S C order quotedin para 2 above, order for the restoration of two-third commuted portion of pension after 15 years from the date of commutation,may be issued in respectof all the similarly placed Government servantswho had drawn lump-sum amount on theirabsorption in a Public Sector Undertaking/Autonomous Body.

In Para-5, it is minuted that “In this regard FinanceSecretary mentioned about the delays in finalisingpension matters and asked FAs to keep track ofprogress of cases of employees retiring within ayear”. Further, the action point at Para-12 (i) readsas “A list of employees retiring within one yearshould be prepared by 15.06.2016 and theirformalities should be completed so thatcomplaints from pensioners are reduced to theminimum. Administration division of each Ministry/department should be sensitized in this regard”.

2. The quick disposal of grievances ofpensioners has been on top priority of CPAO. Forthis purpose, a Grievance Cell is functioning inCPAO and grievances received through differentmodes are settled by it. Subject wise categorizationof grievances reveals that most of the grievancesarise due to delay in start of pension in freshpension cases. The reason for this delay is mainlybecause of late receipt of Pension PaymentOrders (PPO) of the pensioners by CPAO. ThePPO of a retiring government employee must bereceived in CPAO by the last day of the precedingmonth of retirement, however, as per reportgenerated by CPAO, only 1.7 per cent PPOs hadbeen received in time in CPAO during the financialyear 2015-16. This is because of late submissionof pension papers by the concerned HOOs/DDOsto their Pay and Accounts Officers (PAOs). Rule56 of CCS(Pension) Rules provides that “everyHead of Department shall have a list preparedevery three months each year, of all Governmentservants who are due to retire within the nexttwelve/fifteen months and a copy of each such listshall be supplied to the Accounts Officerconcerned”. The objective of preparation of thislist is to monitor the timely submission of pensionpapers by the HOOs to PAOs. However, in majorityof cases, provisions of Rule-56 have not beenfollowed and in the manual system, monitoring ofthe timely preparation of such lists is difficult forthe ministries/departments.
3. To fill this gap, facility to upload quarterlylists of retiring government servants andmonitoring thereof by the higher authorities hasbeen developed in the CPAO website www.cpao.nic.in under the Web Responsive Pensioners’Service. HOOs/DDOs are required to preparequarterly lists of retiring government employeesand furnish the same to concerned Pay andAccounts Officers who in turn will upload the liston CPAO website. For monitoring of this work,login IDs & Passwords have been created forCCAs, JS (Admin) and Financial Advisors in theCPAO website along with Dashboards andmeaningful MIS reports through which timelypreparation/uploading of quarterly lists andsubmission of pension papers thereof by theHOOs/DDOs can be monitored. This facility to FAsis provided to facilitate the decision taken in the
FA’s conference held on 3rd June, 2016 underthe chairmanship of Finance Secretary to keeptrack of progress of cases of employees retiringwithin a year.
4. In view of above, FAs are requested to usethis online monitoring facility on timely preparation/uploading of quarterly lists and submission ofpension papers and kindly intervene in case ofdelays in this regard by DDOs/HODs by taking upmatter with concerned HOD/JS (Admin) so thatdelay in finalization of pension cases and resultantpensioners’ grievances may be avoided. Theonline monitoring facility is also provided to JS(Admin) of ministries/departments as well as toCCAs.

Orders for revision of 1/3rd restored pensionof absorbees, who had drawn lumpsum paymenton absorption, were issued vide this DepartmentOM. of even number dated 15.9.2008 as amended/modified vide OM No. 4/30/2010-P&PW(D) dated11.07.2013. As per these memorandums, the fullpension of the absorbees was notionally revisedw.e.f. 1.1.2006 in accordance with the instructionscontained in this Department O.M. No.38/37/08-P&PW(A) dated 1.9.2008. The payment of DR andadditional pension to old pensioners is regulatedon the basis of the notional full pension.
2. Instructions were issued vide thisDepartment’s OM No.38/37/08-P&PW(A) dated28.1.2013 for stepping up of the pension of pre-2006 pensioners w.e.f. 24.9.2012. Accordingly, thenotional full pension of the absorbee pensionerswas also stepped up w.e.f 24.09.2012 inaccordance with the instructions contained in theaforesaid OM dated 28.1.2013 vide thisDepartment’s OM of even number dated03.04.2013.
3. Instructions were issued vide thisDepartment’s OM No 38/37/08-P&PW(A) dated30.07.2015 for revision of pension/ family pensionof all pre-2006 pensioners/ family pensioners inaccordance with this Department’s OM dated28.01.2013 with effect from 1.01.2006 instead of24.09.2012. Accordingly, the notional full pensionof absorbee pensioners was also revised inaccordance with the instructions contained inaforesaid OM dated 30.07.2015 w.e.f. 1.01.2006instead of 24.09.2012 for purpose of payment ofdearness relief and additional pension for old
pensioners vide this Department’s OM of evenno. Dated 17.02.2016.
4. Instructions have now been issued vide thisDepartment’s OM No. 38/37/08 P&PW(A) dated6.04.2016 that the revised consolidated pensionof pre-2006 pensioners shall not be lower than50% of the minimum of the pay in the Pay Bandand the grade pay (wherever applicable)corresponding to the pre-revised pay scale as perfitment table without pro-rata reduction of pensioneven if they had qualifying service of less than 33years at the time of retirement. Accordingly, thenotional full pension of absorbee pensionerswould also be revised in accordance with theinstructions contained in aforesaid OM dated6.04.2016 w.e.f. 1.01.2006 and dearness reliefand additional pension for old pensioners wouldbe admissible on such notional revised fullpension. There will, however, be no change in theactual 1/3rd restored pension determined inaccordance with the OM dated 15.09.2008 readwith OM dated 11.07.2013.

Sub : Provision of Yatri Mitra Sewa at railwayStations.
Indian Railways are committed to provideevery possible support to old and differently abledpassengers requiring assistance at the stations.A Yatri Mitras Sewa may be provided at majorstations for enabling passengers to book wheelchair services cum porter services. The salientfeatures of the proposed Yatri Mitra Seva are asunder:
1. Yatri Mitra: A Yatri Mitra can either be aSahayak or any other person provided by IRCTCor the service provider appointed by IRCTC forthis purpose.
2. Services to be provided by Yatri Mitra :Yatri Mitra shall provide Wheel chair cum porterservices to differently abled, ailing and oldpersons.
3. Provision of Yatri Mitra Sewa:
3.1 The responsibility of providing Yatri MitraSewa has been entrusted with IRCTC. IRCTC mayprovide this service ‘Free of cost’ through someNGO, charitable trust, PSUs etc under CSR.However, if this service can’t be provided ‘Free ofCost’ due to lack of response from NGOs,Charitable trust, PSUs etc, IRCTC may arrangethis service on payment basis through a serviceprovider or on its own.
3.2 IRCTC may also arrange these servicesthrough existing Battery Operated Car (BOC)Operator, wherever, an agency is providing theservice.
4. Booking of Yatri Mitra : The booking of YatriMitra can be done as under:
4.1 The Yatri Mitra service can be booked onIRCTC e-ticketing website and 139 (IVRS andSMS) or through a mobile.
4.2 A Mobile Application developed by CRISwould also be made available for booking of YatriMitra as and when it is developed and releasedby CRIS.
4.3 A dedicated Mobile number for each
station, where this service is available, shall bemade available by the Service provider/IRCTCwhich would be displayed on IRCTC e-ticketingwebsite and zonal websites of IR to facilitatebooking of Yatri Mitra.
4.4 Based on the station at which the facility isbooked by the passenger, the booking details(Train Name and Number, date and time of arrival/departure, PNR number, Name of the passenger,Coach and berth number) will be sent by SMSboth to the passenger and service provider/IRCTC along with the amount chargeable, ifapplicable, for the service.
4.5 The mobile number of the Yatri Mitra shallalso be sent to the passenger through SMS beforethe expected time of the arrival of the passengerso that the passenger can contact the Yatri Mitra.
4.6 The Mobile Application developed by CRISwould have the facility for the service provider toupdate the status after providing the service. Thepassenger would also have the option to givefeedback regarding compliance for his booking.
5. Operation of Yatri Mitra Seva : The YatriMitra sewa shall be operated on following linesfor arriving, transferring and departingpassengers;
5.1 Arriving/Transferring Passengers :
5.1.1 The IRCTC/service provider on receiptof SMS will ensure that the Yatri Mitra is arranged/positioned at the platform near the coach of thearriving passenger
5.1.2 The mobile number of the Yatri Mitrashall also be sent to the passenger through SMSin advance.
5.1.3 On arrival of the train, the Yatri Mitra shallapproach the passenger near his coach, greethim, show his mobile message which will besimilar as sent to the passenger himself. Oninstructions of passenger, he will pick up his/herluggage and help him/her in sitting in wheel chairand take him to desired exit gate or any otherplatform in case of transfer passenger.
5.1.4 In case of late running of train, the serviceprovider shall contact the passenger on themobile number given, by the passenger at thetime of booking and arrange the service as perexpected arrival of the train at the station.

5.2 Departing Passengers;
5.2.1 The IRCTC/service provider on receiptof SMS will ensure that the Yatri Mitra is arranged/positioned at the nominated entrance of the stationbuilding from where the passenger will beboarding the train.
5.2.2 Yatri Mitra shall contact the passengeron the mobile number given by the passenger atthe time of booking and confirm the expected timeof arrival of the passenger and entrance gate ofstation.
5.23 On arrival of the passenger at entrancegate of station, the Yatri Mitra shall approach thepassenger, greet him, and show his mobilemessage which will be similar as sent to thepassenger himself. On instructions of passenger,he will pick up his luggage and help him/her insitting in wheel chair and take him to the platformwhere train has to arrive.
6. Storage/Parking of wheel chairs: TheRailway shall provide space for storage/parkingof wheel chairs as per requirement of number ofwheel chairs and charging point if wheel chairsare battery operated. In case service is providedFree of cost, electricity for charging battery of wheelchairs shall be provided free. In case of paidservice, the cost of electricity on consumptionbasis and connection shall be charged to theservice provider as per extant practice.
7. Service Charges : The service charges, ifapplicable, shall be kept reasonable andaffordable keeping in mind the objective ofproviding services to the needy. The servicecharges should be collected by the Serviceprovider directly from the passenger.
8. IRCTC shall provide adequate number ofwheel chairs at the station as per the requirementto be decided in consultation with Sr.DCM/DCMof concerned division. Preference should be givento battery operated wheel chairs.
9. The Yatri Mitra appointed by service providershall be issued an ID card and permit to providethese services at the station by Sr.DCM/DCM ofthe concerned Division.
10. IRCTC shall be responsible for any claim/compensation/loss etc. arising out of anydeficiency in the service. Indian Railways will not
be bear any financial liability tor provision of YatriMitra service by IRCTC/Service provider appointedby IRCTC.
11. A monthly report of utilisation of the serviceshall be sent to Sr.DCM/DCM(lC) of concerneddivision by IRCTC.

Ref: Railway Board’s letter No. 2016/F(E)/III/1/ (1)8dated 12.08.2016.
The detailed instruction for revision of thesettlement dues as well as pension/familypension of railway servants who retired/died inharness on or after 01.01.2016 has been issuedvide above referred letter. Necessary modificationsin ARPAN software has already been done and isready for deployment. Similar modifications inIPAS software have also been processed by CRIS.The scheme for revision of the cases whethersettled through ARPAN/IPAS as mentioned belowmay be adopted uniformly across the railways fortimely completion of the revision process.
A. Revision of Post-2016 cases alreadysettled through ARPAN:
(a) Revision of settlement dues as well asrevision of PPOs will be carried out in ARPAN-Revision Module.
B. Revision of Post-2016 cases alreadysettled through IPAS:
(a) Payment of revised settlement dues willbe made through IPAS- Settlement Module.
(b) Revised particulars (IPAS data) along withPensioners Photograph (scanned image) andcomplete Family details will be uploaded toARPAN data base.

Attention is invited to Ministry of Finance,Department of Expenditure Uo No. A-32022/6/85-EG dated-05.10.1992 (copy enclosed) circulatedvide o/o the CAG of India letter No.1993-NI/1-90(II)dated-12.11.1992 (copy enclosed) which is selfexplanatory. It was reiterated to all AGs vide O/othe CAG letter No. 968-AC/1/SP-I/133-94 dated-06.12.1994 (copy enclosed) that the procedurecontained in the above circular may be followedstrictly so as to avoid undue hardship to the retiring/retired Divisional Accountants / DivisionalAccountants Officers. Further, the attention isinvited to para 3 of the letter dated-06.12.1994 ofthe CAG wherein it has also been clarified thatthe pensionary liabilities in respect of all DivisionalAccountants whether paid by PAO (Audit) orotherwise will be paid by the State Govemment inthe same manner as required at present providedthat in such cases where the State Govemmentshave taken over the work of authorisation ofpension, the said authorisation for suchemployees who have not been confirmed asregular Divisional Accountants but confirmed intheir respective employment under the StateGovemment will continue to be covered by theState Govemment Rules.
In brief the pay scales of DivisionalAccountants/Divisional Accountants Officersconfirmed in their Cadres, follow the CentralGovemment pattern and they are govemed by FRs& SRs as well as by CCS (Pension) Rules, 1972.
(c) Revised PPOs based on updated IPASdetails, will be issued from ARPAN.

However, the incidence of their Pay & Allowancesas weil as pension is entirely born by therespective State Governments and met out of theirConsolidated Fund. Instances have come tonotice where, inspite of clear instructions issuedby O/o the CAG, most of the AGs have not followedthe prescribed procedure. Therefore, all Pr. CCAs/CCAs/CAs/AGs and Administrators of UTs arerequested to instruct their PAOs to strictly followthe prescribed procedure to avoid undue hardshipto the retiring/retired DAs/DAOs.
It is also requested to provide a list of suchDAs/DAOs who have retired since January,1990to till date and whose pension cases have beenrouted through CPAO for arranging payment oftheir pensionary benefits and being debited toPension Grant of Central Govemment managedby Central Pension Accounting Office so thatnecessary claims may be raised against themfor reimbursement. This issues with the approvalof CC(P).

Supreme Court has passed orders forRestoration of 2/3rd Commuted Pension of PSUAbsorbees who took full Commutation ofPension. The orders were passed in the case ofUnion of India & Another -Vs- (Late) K. Ganesanin Civil Appeal No. 6048 of 2010 and Civil AppealNo. 6371 of 2010.
Following is the text of the orders passed:

“Having heard learned counsel for theappellants, and having perused the record of thecase, we find no justification whatsoever to interferewith the impugned order, directing restoration of2/3rd pension in respect of the respondent herein,after the expiry of the requisite period ofcommutation.”
The instant appeal is accordingly dismissed.

Supreme Court again and in the decision reportedin 1996(2) SCC-187, the Honourable SupremeCourt once again considered the validity of O.Mdated 05.03.1997. While doing so, the HonourableSupreme Court took note of Rule 37 and 37-A ofthe CCS Pension Rules, 1972, and ultimately heldthat in so far as the 1/3rd commuted pension wasconcerned, even the absorbed employees wereentitled for the benefits granted in the “CommonCause” Judgment and accordingly granted thesame. In the ultimate conclusion, the HonourableSupreme Court held as under :
“For the foregoing reasons, we hold that thepetitioners are entitled to the benefits as given bythis Court in “Common Cause” case so far as itrelated to restoration of one-third of the commutedpension. Consequently, the impugnedparagraphs-4 of Office Memorandum dated05.03.1987 is quashed. The writ petitions areaccordingly allowed to the extent indicated above.No costs.”
3. While granting the said relief, theHonourable Supreme Court also referred decisionreported in Welfare Association of AbsorbedCentral Government Employees in PublicEnterprises vs. Union of India reported in (1991(2)SCC 265), distinguished the same by stating thatRule 37-A was not brought to the notice of theCourt. That apart, in a subsequent decision inWelfare Association of A.C.G.E in P.E v. ArvindVerma reported in ( AIR 1998 SC 2862), by way ofclarification the Honourable Supreme Court statedas under in paragraph - 6.
“After hearing counsel on both sides, we makeit clear that the respondents are liable to restorenot only the pension as ordered by this Court inthe said judgment, but also all the attendantbenefits as given to the Central Governmentpensioners. We hold that there was some genuinedoubt on the part of the respondents in construingand giving effect to the judgment of this Court and,therefore, there is no contempt. We now direct therespondents to comply with the judgment of thisCourt as explained hereinbefore within threemonths from this date.”
4. Subsequently, in the decision reported inAIR 2000 SC 3387 (P.V.Sundara Rajan v. Unionof India), the question arose as to whether theabsorbees who had commuted 100% pension
of Accounts in the third respondent organisation.He opted to join a public sector undertaking, viz.,the Bharat Heavy Electricals Limited based onthe Government of India O.M.No.28016/5/85-Estt.(c) dated 31.1.1986. Accordingly, hesubmitted his resignation on 12.05.1986 to thethird respondent and sought for its acceptancewith effect from 28.05.1986. He also submittedhis option on 12.05.1986 for receipt of pensionarybenefits as per paragraph-4(i)(b) of the Provisionscontained in O.M.No.28016/5/85-Estt.(c) dated31.01.1986, which provided for a particular mannerof commutation of pension and of 1/3rd and 2/3rdapart from pro-rata gratuity as prescribed underRule 37-A of the CCS Pension Rules. Theresignation of the petitioner was accepted and hewas relieved from the Government of India Servicewith effect from 26.05.1986 afternoon. He joinedthe services of BHEL on 03.06.1986. By virtue ofthe option for receipt pensionary benefitsexercised by the petitioner, the entire pension ofthe petitioner was commuted and the same waspaid to him in July, 1986.
2. Be that as it may, in the Judgment of theHonourable Supreme Court in “Common Cause”case reported in (AIR 1987 SC 210), wherein theHonourable Supreme Court held that on the expiryof fifteen years from the date of commutation, theentire pension would get revived in respect of theGovernment servants who have commuted theirpension partially. The said judgment was to takeeffect from 01.04.1985. To give effect to theJudgment, the third respondent is stated to haveissued O.M.No.34/2/86-P & PW dated 05.03.1987stating that the Central Government employeeswho got themselves absorbed in the public sectorundertakings and who had received or opted toreceive a lump sum amount in lieu of pensionwere not entitled to the benefit granted by theHonourable Supreme Court in the decisionreported in 1997(1) SCC 142. An associationcalled Welfare Association of Absorbed CentralGovernment Employees in Public Sectorundertakings approached the HonourableSupreme Court for the extension of the benefitsgranted in the “Common Cause” case to theabsorbed employees also which was rejected bythe Honourable Supreme Court. However, thesaid association approached the Honourable

were also entitled for the relief granted in thecommon cause case. While dealing with the saidclaim, the Honourable Supreme Court has heldas under in paragraph-13.
“13. The parity claimed by Lt.Col.Malhotra andother absorbees who had commuted 100%pension, in our view, is entirely misplaced. Thecontention that what is commuted or given up isan amount and not the right to receive pension orright to receive post-commutation revision andattendant benefits’ including dearness relief onthe gross entitled pension on the dates they weregranted to other Government pensioners, is onlyillusory. The decision in the case of State of T.N. v.V.S.Balakrishnan, 1994 Suppl.(3)SCC 204: (1994AIR SCW 3277) on which reliance was placed byMr.Gopal Subramanium, Senior Advocate has noapplicability to the point in issue. Those whocommuted 100% pension continue to remain non-pensioners till their pension is restored. In WelfareAssociation Case (1998 AIR SCW 1700: AIR 1998SC 2862) (Supra), persons who commuted thefull pension and who will not be given any monthlypension by deeming monthly pension to havebeen reduced to nil has been treated as aseparate category. Those who commute 100%pension are not entitled to the benefit of dearnessrelief on full pension or other benefits as claimedherein. We also do not find any discrimination inso far as this class is concerned.”

It is in the above stated background, thepetitioner made a representation to the thirdrespondent on 25.05.1997 contending that byvirtue of Section 12 of the Pension Act 1871, thesurrendering of his own right for drawing 2/3rd ofhis pension by opting under paragraph-4(ii)(b) ofO.M dated 31.01.1986, read along with Rule 37-Aof the CCS Pension Rules, was prohibited andtherefore he was entitled for the restoration of his2/3rd pension also after the period ofcommutation. The said claim of the petitioner wasrejected by the third respondent in i tscommunication dated 28.08.1998. Challengingthe same, the petitioner preferred the presentO.A.No.471 of 2001 before the Tribunal whereinthe petitioner sought for a declaration that Rule37-A (b) of the CCS Pension Rule, 1972 read withClause(b) in O.M dated 31.01.1986 was illegaland in violation of Section 12 of the Pension Act to
call for the records of the second respondent dated28.09.1998 rejecting the petitioner’s claim andissue directions to the respondents 2 and 3 topay pension to the petitioner on the 2/3rdcommuted pension from the date of commutationafter adjusting the amount already paid withinterest.
6. The claim was resisted by the contestingrespondent herein contending that the decisionsof the Honourable Supreme court are notapplicable to the petitioner and that based on thesaid decision, there was no scope for the petitionerto challenge the validity of Rule 37-A of the CCSpension Rule and claim for restoration of the2/3rd pension.
7. The tribunal by taking note of the optionexercised by the petitioner as provided underparagraph-4(ii)(b) of Official Memorandum dated31.01.1986, surrendering his right to claim 2/3rdpension once and for all held that none of thedecisions of the Honourable Supreme Courtreferred to above ensure to the benefit of thepetitioner. The tribunal also held that the challengemade to the validity of Rule 37-A by the petitionerwas not maintainable and dismissed the O.A.
8. Assailing the order of the tribunal, Mr.BalanHaridass, the learned counsel appearing for thepetitioner after referring to the above decisions ofthe Honourable Supreme Court, contended thatin all the above referred to decisions what wasprimarily dealt with was only the entitlement ofabsorbed employees to the benefit which wasgranted in the “common cause” case on par withthe Central Government Servants and that in noneof the decisions, the validity of Rule 37-A readalong with paragraph-4(ii)(b) of O.M., dated31.01.1986 vis-a-vis Section 12 of the PensionsAct, 1971, was never canvassed and thereforethe conclusion of the tribunal in the orderimpugned in the writ petition is liable to theinterfered with. According to the learned counsel,when under Section 12 of the Pensions Act, thereis a prohibition imposed on the pensioner himselfto trade off his right of pension, the surrenderingof such a right in so far as it related to 2/3rdpension while exercising the option at the time ofabsorption in a public sector undertaking was notvalid and that the very provisions providing forsurrendering of such a right under Rule 37-A as

october 2016JUDGEMENTSwell as the provisions contained in the OfficialMemorandum dated 31.01.1986 are consequentlydeclared to be invalid.
9. As against the above submissions,Mr.S.Udayakumar, learned Senior CentralGovernment Standing Counsel, would contendthat when under Section 10 of the Pensions Actprovision has been made for commutation of partor whole of the pension on such terms deem fit,the provision made under Rule 37-A providing forthe commutation of the entire pension on certainterms including a provision of surrendering of theright to claim 2/3rd pension cannot be held to bein violation of the Pensions Act. According to thelearned Senior Central Government StandingCounsel, in any event, the petitioner havingaccepted the commutation of the 2/3rd pensionby subjecting himself to Rule 37-A and havingavailed the commutation of such pension, cannotbe permitted to reopen the same after 11 longyears as that would unsettle settled things. Thelearned Senior Central Government StandingCounsel also pointed out that Rule-37-A (b)providing for surrendering of 2/3rd pension itselfcame to be ultimately withdrawn on 31.03.1995and therefore the validity of the said Rule neednot be gone into in this writ petition.

After hearing the learned counsel for thepetitioner and the Senior Central GovernmentStanding Counsel, and after perusing theimpugned order of the tribunal as well as thevarious decisions placed before us, at the outsetwe wish to point out that by virtue of the decisionsof the Honourable Supreme Court reported in1996(2) SCC 187, (Welfare Association ofAbsorbed Central Government Employees inPublic Enterprises v. Union of India), what everrights which were available to a Governmentservant of the Central Government was grantedin the common cause case was mutatis mutandismade available to even the absorbees. In fact byvirtue of the said decision, it is no longer open tothe contesting respondents to contend that afterthe absorption in the public sector undertakings,the applicability of either the Pensions Act or CCSrule would cease to apply.
11. The Honourable Supreme Court hasasserted in unequivocal terms the rights of theabsorbees for pension along with other attendant
benefits under the provisions of the Pensions Actread along with CCS Pension Rules for the periodof service rendered by the absorbees in theCentral Government. In the light of the said settledlegal position, in so far as the right of theabsorbees to base their claim by relying upon theprovisions of the Pensions Act and the CCSPension Rules framed thereunder can no longerbe questioned. As far as the present contentionraised by the petitioner, based upon Section 12 ofthe Pensions Act is concerned, in none of theabove referred to decisions of the HonourableSupreme Court, the said question was focusedin the manner in which it is now raised before us.Though in the decision reported in 1996(2) SCC-187(Welfare Association of Absorbed CentralGovernment Employees in Public Enterprises v.Union of India), the issue was raised by making areference to O.M., dated 31.01.1986 as well asRule 37-A of the CCS Pension Rules, the questionwas confined to the limited extent as to whetherthe right of the absorbees to claim the benefits asgranted in the common cause case was availableto them in so far as it related to 1/3rd commutedpension pursuant to their obsorption in the publicsector undertakings for the period of servicerendered in the Central Government Organisation.The Honourable Supreme Court hascountenanced such a right and held that suchbenefit which was made available in the commoncause case to the Central Government Employeeswas equally available to the absorbees in respectof 1/3rd commuted pension. Though we madeour anxious consideration to the decisionsreported in 1991(2)SCC 265 (Welfare Assn. OfAbsorbed Central Government Employees v.Union of India, 1996(2) SCC-187 (WelfareAssociation of Absorbed Central GovernmentEmployees in Public Enterprises v. Union ofIndia), AIR 1998 SC 2862 (Welfare Assocn. OfA.C.G.E., in P.E V. Arvind Verma), and AIR 2000SC 3387 (P.V.Sundara Rajan v. Union of India), innone of the decisions, the question as to theprohibition imposed under Section 12 of thePensions Act to surrender one’s own right of apensioner was never considered. In paragraph-13 of the decision of the Honourable SupremeCourt reported in AIR 2000 SC 3387, theHonourable Supreme Court while holding that theabsorbees who had commuted 100% pension,

continue to remain non-pensioners made clear,such position would be prevalent only till theirpension is restored. Therefore, when in the caseon hand, when the petitioner who also sought for100% commutation of pension at the time of hisabsorption in BHEL in the year 1986, in the light ofthe decision of the Honourable Supreme Courtreported in 1996(2) SCC-187 (WelfareAssociation of Absorbed Central GovernmentEmployees in Public Enterprises v. Union ofIndia), he was fully entitled for the benefits grantedto the Government Servants in the common causecase in so far as it related to 1/3rd pensioncommuted by him. By virtue of such a declarationof law made by the Honourable Supreme Courtwhich made it clear that the petitioner wasnevertheless a pensioner, it will have to be heldthat as a pensioner, he would be entitled for theprotection under Section 12 of the Pensions Act1871 in so far as it related to surrendering of hisrights as provided under Rule 37-A of the CCSPension Rules. In other words, we hold that havingregard to the above statement of law asenunciated by the Honourable Supreme Court inthe decision reported in 1996(2) SCC-187(Welfare Association of Absorbed CentralGovernment Employees in Public Enterprises v.Union of India), the petitioner would be governedby the provisions of Pensions Act 1871 andconsequently the case of the petitioner will haveto be examined in the light of the provisionscontained therein. When once we reach the abovesaid conclusion, thereafter the question iswhether the commutation of whole of the pensionby the petitioner in so far as it related to 1/3rd and2/3rd of it based paragraph-4(ii)(a)(b) of O.M.,dated 31.01.1986 read along with Rule 37-A canbe held to have disabled the petitioner fromseeking for restoration of such pension as hasnow been claimed in the O.A.
12. Section 12 of the Pensions Act, 1871, readsas under:
“12- Assignments etc., in anticipation ofpension to be void. All assignments, agreements,sales and securities of very kind made by theperson entitled to any pension, pay or allowancementioned in section 11 in respect of any moneynot payable at or before the making thereof onaccount of such pension, pay or allowance or for
giving or assigning any future interest therein arenull and void.”
13. Under Section 10 as stated by us earlier,while commutation of pension for the whole orany part of it can be opted by a pensioner basedon such terms fixed under the Rules, it will haveto be stated that such enabling provision providingfor commutation for either part or whole of thepension can only for commutation purposes andthat under the guise of commutation, it will not beopen for the Government to once and for all wipeof the very right to restoration of such pensionafter the expiry of the period of commutation. Infact, Rule 37-A clause (b) though uses theexpression the commutation of balance amountof pension namely the 2/3rd of pension, thestipulations contained therein providing for suchcommutation of 2/3rd pension would be subjectto surrendering of the right of Governmentservant, for drawing the 2/3rd pension would runcounter to the very concept of commutation whichwill not be in consonance with Section 10 providingfor commutation of pension alone and not the rightto claim pension after the period of commutation.
14. That apart, even if the petitioner wasobliged to surrender such a right for the drawal of2/3rd of his pension by agreeing for the termscontained in Rule 37-A of Pension Rules in asmuch as such a wholesale surrender of the rightto pension as contained in the said Rule conflictsSection 12 of the Pensions Act, it will have to beheld that the Rules providing for suchsurrendering of right in opposition to Section 12of the Act cannot be permitted to operate. Whenunder Section 12 of the Act, there is a prohibitionimposed on the pensioner himself to barter awayhis right under very many circumstances exceptas provided under Section 12-A of the PensionsAct, we are convinced that surrendering of the rightfor drawal of 2/3rd of Pension after its commutationas provided under Rule 37-A (b) is repugnant toSection 12 and is straight away hit by theprohibition imposed under Section 12.Consequently any action based on Rule 37-A(b)is wholly illegal and therefore the surrendering ofrights of the petitioner for drawing 2/3rd of hispension at the time of its commutation to that extentcan not operate against his interest. We thereforedeclare that such surrendering rights by the

Widow, not dead man's mom, willget pension: SC

New Delhi : Deciding a long and bitter `saas-bahu' fight over a dead man's pension, the SupremeCourt stood behind the daughter-in-law and ruledthat a widow alone was entitled to pension afterdeath of an employee and not his mother. A benchof Justices A R Dave and L Nageshwar Rao faceda tricky question while deciding this dispute betweenthe mother and wife of deceased Haryanagovernment employee Yash Pal.While the widowlaid claim to her late husband's pension, the mothercited the Hindu Succession Act to stake her claim.
Writing the judgment for the bench, Justice Davesaid so far as provisions of Hindu Succession Act,
1956 were concerned, the properties of a Hinduwho dies intestate (without writing a will) would firstof all go to persons categorised as class-I heirs.
“Therefore, so far as the properties of late YashPal are concerned, they would be divided amongthe mother and widow, provided no other familymember of Yash Pal is alive who would fall withinclass-I heirs,“ Justice Dave said.
But the position on pension was different, theSC said. Citing an earlier judgment, the court saidfamily pension did not form part of the deceasedemployee's property to be divided among his familymembers categorised as class-I heirs.
“Even the employee has no right to dispose offamily pension in his will by giving direction thatsomeone other than the one entitled to it should begiven the same,“ the bench said and set asidePunjab and Haryana High Court's order entitling themother to 50% of family pension.
On the fight between the daughter-in-law andthe mother-in-law over Yash Pal's pension, thebench said, “Under the family pension scheme,widow is the only family member entitled to thepension and, therefore, the mother of the deceasedwould not get any right in the pension. Of course, itcannot be disputed that if there are other assets leftby late Yash Pal, his mother would get 50% share ifhe had not prepared any will and it appears that lateYash Pal had died intestate and no will had beenexecuted by him.“

petitioner at the time of his absorption in the year1986 while commuting 2/3rd of his pension, wasinvalid and consequently the petitioner waslawfully entitled for the restoration of his pensionafter the expiry of the period of commutation of 2/3rd pension.
15. Having regard to our above conclusion,we set aside the order of the third respondentdated 28.09.1998 and direct the second and thirdrespondents to restore the pension payable tothe petitioner after the expiry of period ofcommutation of 2/3rd pension and pay all thearrears payable to him and continue to pay thesame for the future period. While directing therespondents 2 and 3 to restore the petitioners 2/3rd pension after the expiry of its commutationperiod, we however refrain ourselves fromdirecting payment of interest on the arrears,inasmuch as, the petitioner came forward withthis claim for the first time in the year 1997, that isnearly after 11 years after his retirement. Wetherefore do not find any justification for grantinginterest while restoring the petitioner’s 2/3rdpension after commutation. The writ petitionstands allowed. The impugned order is set asidewith the direction for restoration of 2/3rd pensionalong with direction for payment of arrears asstated above. The second and third respondentsare hereby directed to comply with our directionswithin eight weeks from the date of receipt of acopy of this order. There is no order as to costs.
